MEMBER NEWS Year Ends with Losses
In Memory – John Lambert Godar
Arnold Greenfield, former owner of Califorms Printing Company, San Jose, died on Sunday, 11/27/16. He was active for 40 years in the Printing Industries of Northern California, serving as its president and health insurance PINC/VMA Greats Herb Riley (L) and Arnold trust chairman. He and several other industry Greenfield circa 1998 pioneers were responsible for starting VMA’s health insurance program over 38 years ago. Today, that program insures over 20,000 printing industry employees statewide.
John Lambert Godar passed away on December 1. He was born and raised in Chicago and began his working life there. California beckoned him in the 60s and his printing career began. He first worked at Westwood Blueprint in LA for 5 years, George Lithograph from 1965 to 1985, G & H Printing Co-Owner for 6 years, Olympian Graphics for 3 years and founded Bindery Solutions in 1995 until retirement in 2001. John loved the printing world. He was an excellent salesman even with his mild manner, but his trustworthiness was the trait that moved him forward. If there was something to be printed, John could name most paper types, know which method to use and get the job done. His wife Judy recalls that when they dined out, he would study the menu not for dinner but for the quality of how it was printed.
Industry Pioneer and Leader Dies at 95
Arnold always knew he wanted to be a printer and attended the New York School of Printing. He started his career in business forms with Alfred Allen Watts Company on the East coast, before serving for 3 years in the Army in Europe during World War II. At Watts Arnold worked his way up to Executive Vice President under President Joe Steir. The Greenfield and Steir family grandkids are close friends to this day. Moving to California in 1967 to work for Courier Citizen Company for 8 years, he purchased Califorms in 1975 from its founders, and grew the firm to over 100 employees at its peak. Arnold loved music, dance, street fairs, parades, the circus and especially the theater. He had an infectious zest for life that he shared with all who met him. He loved people and had good friends all over the world. He will be missed! Arnold’s daughter, Darshana Maya Greenfield, is hosting a Celebration of Life on Friday, February 3 at McCormick & Schmick’s, 900 North Point Street, San Francisco from 3 - 6 pm in the Captain’s room overlooking SF Bay, one of Arnold’s favorites. One of John’s hobbies was collecting cars including a 1929 Model “A” Ford and later a 1950 Ford Crestliner which was his pride and joy. He also owned a 1956 Ford pickup truck which Judy never let him paint because she liked it “rustic.” Photography was also his hobby and he had several exhibitions of his work. Steve Decker, Zooka Creative, San Jose, presented a case study, The Branding of Union City, California at PIA Color Conference in Phoenix in December. In addition to traditional graphic design services for branding/print/package/web design, Zooka also has in-house industrial design, printing, and fabrication capabilities to produce sales kits and point-of-purchase displays. The company celebrated 10 years in business in 2016.
Tim Poole, Dome Printing CEO, recently competed in the Sacramento Capital Cup, which promotes community pride, healthy competition and raises money for the Sacramento region’s most deserving charities. Twenty-four executive leaders from the Sacramento region are divided into two Capital Cup teams. Participating in a 3-day golf competition, donors have the opportunity to support their favorite player (or their favorite charity), as each player is competing to benefit his or her favorite charitable organization. The Capital Cup 2016 raised approximately $740,000 for local charities this year. Tim was able to present Michelle Johnston, Regional Director of the Alzheimer’s Association with a check for $16,551 at the closing celebration.

with key decision-makers. Therefore, they strategize about the people they are selling to and how the products they’re selling fit into the organization instead of focusing on the functionality of the products themselves.
4. Curiosity. Curiosity can be described as a person’s hunger for knowledge and information. Eighty-two percent of top salespeople scored extremely high curiosity levels. Top salespeople are naturally more curious than their lesser performing counterparts. A high level of inquisitiveness correlates to an active presence during sales calls. An active presence drives the salesperson to ask customers difficult and uncomfortable questions in order to close gaps in information.

successful salespeople are pushy and egotistical, 91 percent of top salespeople had medium to high scores of modesty and humility. Furthermore, the results suggest that ostentatious salespeople who are full of bravado alienate far more customers than they win over.
2. Conscientiousness. Eighty-five percent of top salespeople had high levels of conscientiousness, whereby they could be described as having a strong sense of duty and being responsible and reliable. These salespeople take their jobs very seriously and feel deeply responsible for the results. The worst position for salespeople to be in is to have relinquished account control and to be operating at the direction of the customer, or worse yet, a competitor. Conversely, top salespeople take command of the sales cycle process in order to control their own destiny.
3. Achievement Orientation. Eighty-four percent of the top performers tested scored very high in achievement orientation. They are fixated on achieving goals and continuously measure their performance in comparison to their goals. During sales cycles, top sales performers seek to understand the politics of customer decision-making. Their goal orientation instinctively drives them to meet
5. Lack of Gregariousness. One of the most surprising differences between top salespeople and those ranking in the bottom one-third of performance is their level of gregariousness. Overall, top performers averaged 30 percent lower gregariousness than below average performers. Dominance is the ability to gain the willing obedience of customers such that the salesperson’s recommendations and advice are followed. The results indicate that overly friendly salespeople are too close to their customers and have difficulty establishing dominance. 6. Lack of Discouragement. Less than 10 percent of top salespeople were classified as having high levels of discouragement and being frequently overwhelmed with sadness. Conversely, 90 percent were categorized as experiencing infrequent or only occasional sadness. In casual surveys I have conducted throughout the years, I have found that a very high percentage of top performers played organized sports in high school. There seems to be a correlation between sports and sales success as top performers are able to handle emotional disappointments, bounce back from losses, and mentally prepare themselves for the next opportunity to compete. 7. Lack of Self-Consciousness. Self-consciousness is the measurement of how easily someone is embarrassed. The byproduct of a high level of self-consciousness is bashfulness and inhibition. Less than five percent of top performers had high levels of self-consciousness. Top salespeople are comfortable fighting for their cause and are not afraid of rankling customers in the process. Not all salespeople are successful. Given the same sales tools, level of education and propensity to work, why do some salespeople succeed where others fail? Is one better suited to sell the product because of his or her background? Is one more charming or just luckier? Accommodation Fortunately, there is already precedent for employment issues that may arise when someone is using medical marijuana, and employment law experts say the same precedent would apply to recreational pot as well. In 1996, California passed the Compassionate Use Act, which allows “seriously ill Californians” to use marijuana for medical purposes with a doctor’s recommendation. But some employers were sued for having in place drug-testing policies in light of the law. In 2008, the California Supreme Court tackled the issue in the case Ross vs. RagingWire Telecommunications Inc., opining that the Compassionate Use Act does not apply to employment and that marijuana, even for medical use, is still illegal under federal law. The court ruled that California employers can require preemployment drug tests and take illegal drug use into consideration in making employment decisions. Essentially, Prop. 64 codifies that ruling.

Pot’s Legal. What Does It Mean for Your Business’s Anti-drug Policies? Now that Californians have overwhelmingly voted to legalize the recreational use of marijuana, many employers may be wondering where they stand if they want a drug-free workplace. Fortunately, Proposition 64 included a number of safeguards for employers, allowing them to have anti-drug workplace rules in place. In fact, these safeguards were built into the initiative to the point that the California Chamber of Commerce took a neutral stance on the measure. Prop. 64 would allow Californians who are 21 and older to possess, transport, buy and use up to an ounce of cannabis for recreational purposes, and allow individuals to grow as many as six plants. But that doesn’t mean that you must allow workers to spark up at work. Under the measure: • You can still conduct pre-employment drug tests and have policies barring from hire any applicants who test positive for marijuana. • You can fire workers who test positive when they are tested for permissible reasons, like if they may be at fault in a workplace accident. • You can bar use or consumption of marijuana at work. • You can bar possession, transfer, display, transportation, sale or growth of marijuana in the workplace. 10 VISUAL MEDIA ALLIANCE | CONNECTED | WINTER 2017
Wrongful termination cases in California have subsided dramatically since the RagingWire decision, but some employees still sue their employers alleging they didn’t have a right to drug test them. Under Prop. 64, however, these suits would have no merit. According to a report in the San Francisco Chronicle, the more typical actions these days are ones filed by employees who got high during a lunch hour or break and after returning to work caused an accident or harassed a colleague. In those cases, it’s the victims who may sue the company, accusing it of not monitoring workers for intoxication or condoning the use of medical marijuana in the workplace. Orange County employer defense attorney Todd Wulffson told the Chronicle that employers may want to consider: • Having drug and alcohol policies in place. • If you plan to drug test, having policies stating that “for purposes of drug testing, marijuana is an illegal drug.” • Ensuring that employees read your drug and alcohol polices carefully and understand under which conditions they may be tested. • Having someone on your human resources staff who is trained to spot drug intoxication. • Having a zero-tolerance policy for being high on the job. • Requiring that managers refer signs of drug use to human resources.
The Law These are the current rights of California employers: • Employers can conduct pre-employment drug testing as long as they test all applicants. • Employees can only be tested if there is a reasonable suspicion they are under the influence, or after an accident – unless there is no way the employee could have caused it – or if it is required under federal law. • Random testing is generally only allowed for safety-sensitive jobs, including construction, driving and any other jobs that can put employees or the public in harm’s way. that the employee is “suffered or permitted” to work. To prevent this kind of behavior from occurring in the future, it is perfectly permissible to create and enforce a policy stating that employees are not permitted to perform work off-the-clock (including checking e-mails and voicemails) while on vacation or taking any other kind of paid or unpaid leave. While you can’t withhold pay for time worked, you can hold employees accountable to the off-the-clock work prohibition policy by disciplining for any violation. Employers can take steps to prevent off the clock work by having a clear understanding of which employees are covered by the FLSA, establishing clear, written “work time” policies, closely monitoring work time and training all employees about off-the-clock work.
Help for Domestic Violence Victims Individuals who are unemployed or unable to work due to domestic violence abuse may be eligible for monetary benefits from the Employment Development Department (EDD) through the Unemployment Insurance (UI) or State Disability Insurance (SDI) programs. These programs provide temporary payments to workers to ensure that some of life’s necessities can be met during periods of unemployment. See below for further information. The proposed FLSA overtime rule may have come to a halt, however, in California, there is one change that is sure to take effect. On January 1, California’s minimum wage increased to $10.50 per hour for businesses with 26 or more employees. Businesses with 25 or less employees will remain at $10 till January 1, 2018. Eventually, all businesses will work towards the $15 hourly rate. Employers should be mindful of the differences in their minimum wage requirement as some localities have their own rate which is different from the state rate. Update I-9 On November 16, 2016, the USCIS released a new updated Form I-9 which is used for employment eligibility verification. All new hires must fill out this form when hired or within 3 days of a new hire to confirm their identity and employment authorization. This version replaces the old form Rev. 03/08/13 N* which is still valid to use until you download the new version Rev. 11/14/2016 N* which is valid from 11/14/16 to 08/31/2019. Keep Tabs on Off-the-Clock In the case where you find an employee performing off-the-clock work, even if you didn’t authorize or permit it, you are required to compensate them for the time
I have seen cases in which California employers still believe that they have 72 hours to pay employees final pay. This is only the case when the employees quit immediately with no notice or as they say, quit on the spot. I still get calls from members wondering about this procedure. A California employee who is discharged or gives notice of separation of employment (e.g. 2 weeks’ notice or notice time) must be paid all of his or her wages, including accrued vacation or PTO, immediately at the time of termination. Terminated employees must be paid at the place of termination, i.e. where the news of the termination is delivered be it an office or site where the employee had worked. Be sure to have all the final paperwork ready to be given to the employee such as EDD notices, etc. An employer who willfully fails to pay all final wages such as vacation or hours worked, may be assessed a waiting time penalty. The waiting time penalty is an amount equal to the employee’s daily rate of pay for each day the wages remain unpaid, to a maximum of thirty (30) calendar days. Best practice is to use a sample employment termination checklist to ensure all the applicable boxes are checked, available as a membership benefit via VMA.bz, in the Resource Library.
