A MESSAGE From the CEO & President

A Letter to Our Supporters: Congress has not passed a real federal budget since 1997. In 1997: • Bill Clinton was inaugurated for his second term. • Madeline Albright was sworn-in as the first female secretary of state. • Tony Blair became Prime Minister of the United Kingdom. • Princess Diana died. • Mother Teresa died. • Justin Bieber was three-years-old. • Miley Cyrus was five-years-old. In other words, 1997 was a long time ago…nearly 20 years. The amount of money the United States owes is larger than our National Economy. The interest alone on our debt is the third largest line item in U.S. budget behind social security/Medicare and national defense. If we do not get spending under control, the United States will soon follow in the footsteps of Greece and Argentina of becoming a troubled debtor nation beholden to its international creditors. Fortunately, our Founding Fathers provided a way to come together, state-bystate, and amend the Constitution. Article V of the Constitution offers a provision that with just 38 states in agreement, the states themselves can propose and ratify the necessary balanced budget amendment into the Constitution. Can you imagine? With just 38 states in agreement, we can force Congress to operate under a balanced budget and limit the use of debt in doing so. The Compact for America initiative presents a comprehensive approach to Article V to pass a Balanced Budget Amendment in as few as 12 months. While there are other approaches to Article V currently in action, we believe that our plan is the safest, quickest and surest solution.

With Alaska, Georgia, Mississippi and North Dakota already on board, right now we are only 34 state laws, one congressional resolution, and one 24 hour convention away from ratifying a powerful Balanced Budget Amendment. All other Article V efforts are at least twice as far from the goal of a ratified amendment. Our hope is not to attack members of Congress, or to create a political organization that will diminish or promote one side or the other. Our hope is to exercise our right as Americans to provide a solution to an enormous problem that weakens America: DEBT. Many strong fiscally conservative members of the House and Senate already agree with passing a balanced budget amendment. Most Governors and State legislatures operate under a balanced budget law. These leaders exist on both sides of the aisle. The Compact for America simply hopes to provide an additional avenue for those who agree with us (whether Democrat or Republican), to ultimately have a positive outcome and obtain a balanced budget and to control the unlimited spending that currently is the norm in Washington DC. We hope you will join us in this fight to ensure that our children and grandchildren are not strapped with a freedom-threatening burden of debt; and that America is renewed and once again prosperous. The goal of the Compact for America (“CFA”) initiative is for the states to propose and ratify the powerful balanced budget amendment that is contained in the Compact for a Balanced Budget. This can be achieved in as little as one session year, with a target of July 4, 2017, and a "do or die" date of April 12, 2021 (when the Compact for a Balanced Budget already joined by the States of Alaska, Georgia, Mississippi and North Dakota sunsets).
The “payload” of the Compact is a powerful balanced budget / debt control amendment where the states are re-positioned as a “board of directors” over Congress. In this role, the states control the new constitutional debt limit that is established in the amendment. Congress can only increase the debt limit in the future with the approval of a majority of the state legislatures. The policy implications of the amendment and the state control mechanism are huge and are intended to instill fiscal responsibility and restraint on the part of the U.S. Congress. Time is of the essence – the future of our children and grandchildren are in jeopardy.
The Compact approach makes advancing constitutional amendments to the U.S. constitution from the states plausible. It does this by condensing into a single enactment joined by 38 states ALL of the legislative acts involved in originating a constitutional amendment from the states under Article V of the U.S. Constitution. It also consolidates into a single resolution passed ONCE with simple majorities and no presidential presentment all of the stages of the process that Congress controls. This cuts the time and resources needed to originate a balanced budget amendment from the states dramatically-by sixty percent or more. The consolidated design of the Compact delivery vehicle thus allows for the amendment to be ratified as early as the summer of 2017 provided that 38 states have joined the Compact and Congress has activated it. The Compact approach is uniquely powerful and impactful for other reasons as well.
Over three years in the making, the Compact for a Balanced Budget is now a reality. With the signing into law of the Compact legislation by the governors of Georgia and Alaska in April of 2014, and subsequent adoption by Mississippi and North Dakota in 2015, an officially recognized organization of states is now ready to attack the problems of an out of control Congress and a level of national debt that is crippling our future generations. When states enter into a formal contract to legally obligate themselves among each other in an organized effort to achieve a common goal, such a contract is called a “compact." Currently, there are over 200 compacts in existence, and each state is typically a member of 20 or more compacts.

Specifically, the proposed Balanced Budget Amendment would define a balanced budget in common sense terms: cash-flow-out cannot exceed cash-flow-in except for borrowing under a constitutional debt limit. That debt limit would not be in the hands of Washington alone; it could be increased, but only with the approval of a majority of state legislatures. The amendment avoids a game of chicken over debt limit increases by requiring spending impoundments when borrowing reaches 98 percent of the debt limit. Finally, the amendment would quell fears of across-the-board tax increases by requiring any new income or sales tax to secure two-thirds approval of both houses of Congress, excepting measures that close loopholes or completely replace the income tax with consumption (end-user sales) tax (and leaving untouched the current constitutional rule for tariffs and fees).
The passage of the Compact pre-ratifies the balanced budget amendment it advances-and that preratification is triggered not only by the convention organized by the Compact, but any other convention that proposes the same Amendment (including one organized by Convention of the States), as well as by the direct proposal of the Amendment by Congress. Even if the Compact fails to organize the convention it contemplates, its proposed amendment will still have political legs (before the Compact's sunset date of April 12, 2021). As proclaimed in a recent Heartland Institute policy report, this effort is “Article V 2.0.”

GAME PLAN
THE CFA INITIATIVE HAS KEY COMPONENTS – EDUCATION, GRASSROOTS MOBILIZATION, AND PASSAGE OF REQUIRED LEGISLATION IN THE STATE LEGISLATURES AND IN CONGRESS Education Compact for America Educational Foundation, Inc. (the "Educational Foundation") will take the lead on all educational efforts. The Educational Foundation is a not-for-profit tax-exempt educational organization formed under section 501(c)(3) of the Internal Revenue Code. The Foundation will spread the word that an interstate compact can streamline and safeguard the use of Article V of the U.S. Constitution to propose and ratify constitutional amendments originated by the states. With the Education Foundation's leadership, the general public, academia, think tank scholars, donors, state legislators and members of Congress will first find out details of the CFA initiative online. The CFA briefing teams will provide further education and technical details to the general public, academia, think tank scholars, donors, state legislators and members of Congress through widely publicized non-partisan speeches, debates and forums, as well as through scholarly publications.

Grassroots mobilization CFA is employing a targeted national, bipartisan grassroots coalition building and mobilization plan to provide training in each state and marry the work of the activists with the work of the legislators, expert testifiers and lobbyists to provide a streamlined approach to passage in all states.
Passage of required Compact legislation 34 more states are required to join the Compact before the amendment process goes live. State legislatures will have to pass the Compact bill which will be signed into law by the state governor. Congress is required to pass simple-majority resolutions in each house to activate the Compact. Once 38 states join the Compact and Congress passes the resolution, the states will then officially meet to formally propose and ratify the BBA payload into the U.S. Constitution. The only Compact for America entity authorized to influence legislation either directly or by way of grassroots calls to action is Compact for America, Inc. ("Compact for America Action"), which is a not-forprofit, tax-exempt social welfare organization under section 501(c)(4) of the Internal Revenue Code.

President Obama and Congress have failed to provide leadership, which is causing gridlock and partisanship in Washington and has made it impossible to pass meaningful legislation to balance the federal budget. Currently, the United States is borrowing over 40 cents on every dollar it spends and the credit of the United States has been downgraded for the first time in history. SURVEY SUMMARY: Six in ten voters favor a balanced budget amendment and at least 70% favor Compact for America’s specific and common sense proposals to rein in the federal deficit. These survey results demonstrate that Compact for America has the potential to obtain broad support. After being probed about the failed leadership in Washington and the fiscal instability of the United States, 62% favor a constitutional amendment to balance the federal budget annually, while 24 oppose. Intensity is strong among those who favor the amendment, 41% strongly favor to 21% somewhat favor.

METHODOLOGY: This national survey of 1,000 likely general election voters was conducted on from June 10th – June 12th, 2012. All interviews were conducted via telephone by professional interviewers. Interview selection was random within predetermined geographic units. These units were structured to correlate with actual voter distributions in a nationwide general election. This national survey of 1,000 likely general election voters has an accuracy of +/- 3.1% at a 95% confidence interval.

GUTZMAN, JD, PhD, Professor of History - Western Connecticut State University Kevin R. C. Gutzman is the New York Times best-selling author of four books. Professor of History at Western Connecticut State University, Gutzman holds a bachelor’s degree, a master of public affairs degree, and a law degree from the University of Texas at Austin, as well as an MA and a PhD in American history from the University of Virginia. Happy to be a former attorney, Gutzman devotes his intellectual energy to teaching courses in the Revolutionary and constitutional history of the United States, to writing books and articles in these fields, and to public speaking on related topics. Dr. Gutzman's first book was the New York Times best-seller, The Politically Incorrect Guide to the Constitution, an account of American constitutional history from the pre-Revolutionary days to the present. This work is unique in joining the fruits of the latest scholarship, a very readable presentation, and a distinctly Jeffersonian point of view. His second book, Virginia’s American Revolution: From Dominion to Republic, 1776-1840, explores the issue what the Revolutionaries made of the Revolution in Thomas Jefferson’s home state. After that, he co-authored Who Killed the Constitution, The Federal Government vs. American Liberty from World War I to Barack Obama with New York Times best-selling author Thomas E. Woods, Jr. Gutzman's new book is James Madison and the Making of America, and he is already at work on At Swords' Point: Thomas Jefferson, Alexander Hamilton, and the Rivalry that Shaped America (forthcoming). Gutzman has edited new editions of John Taylor of Caroline’s Tyranny Unmasked and New Views of the Constitution of the United States. THOMAS C. PATTERSON, MD, Past Chairman - Goldwater Institute Dr. Patterson is Chairman of the Board. He is also a retired emergency room physician who led a 60 physician practice serving emergency departments in the greater Phoenix area. It was during this time that he served as the President of the Arizona Chapter of the American College of Emergency Physicians. He received his BA from Yale University and his MD from University of Nebraska. Throughout his medical career, Tom was also involved in Arizona state politics and community organizations. He served in the Arizona State Senate from 1989-1996, during which he was the Senate Minority Leader from 1991-1992 and then Majority Leader from 1993-1996. From 1999 to 2014, Tom was a member of the board of directors of the Goldwater Institute, and chaired the board from 2001 to 2014. He has also chaired the Arizona Advisory Committee to the United States Commission on Civil Rights. His community and civic activities, include the Americans for Tax Reform, Goodwill of Arizona, Arizona School Choice Trust, and Hospice of the Valley. He is a political columnist for the East Valley Tribune and a blog page contributor to the Arizona Independent Newspapers. CPA, CGMA DeMoss holds professional certifications as a Certified Public Accountant and a Chartered Global Management Accountant, and is a long-time member of the American Institute of Certified Public Accountants. He is also a FINRA registered investment banker and is affiliated with Tanglewood Capital Partners, LLC, a Houston-based investment banking firm specializing in linking growing businesses in the energy-sector with debt and equity investors. He is a graduate of Texas A&M University and holds a master’s degree from Massachusetts Institute of Technology (MIT). Chip began his career in the audit assurance and business consulting segments in the Houston office of the firm now known as PricewaterhouseCoopers (PWC). PWC is now the world’s largest professional services firm and the largest of the “Big Four” accountancy firms. While at PWC, Chip specialized in clients associated with the real estate and energy sectors. Chip left PWC after five years to assume the controllership position for a master-plan community land developer in Central Florida. After obtaining his MS degree in Real Estate Development from MIT, Chip spent the next 15 years working for land development firms in California and Texas, where he developed a reputation for planning and executing complex multi-year and multi-phase real estate master-planned developments. He was involved in project management on a daily basis including working with city planners, development attorneys and city council members dealing with planning and zoning issues; state legislators and legislative attorneys in developing project-specific and state-wide land use regulations; state, federal and local community interest groups who either supported or opposed the planned development; and architects, engineers and consultants involved in project design, construction and marketing. In his work as an investment banker, he has performed extensive investment, cash-flow and valuation analysis and prepared and made numerous presentations to both clients and investors. NICK DRANIAS, JD Nick Dranias currently serves as the President and Executive Director in the Office of the President of the Foundation. Nick also serves as Policy Advisor and Research Fellow with the Heartland Institute and an expert with the Federalist Society, as well as an Advisory Council member for Our America Initiative. He previously served as General Counsel, Steering Committee Member, Policy Development Director, and Constitutional Policy Director for the Goldwater Institute, where he held the Clarence J. and Katherine P. Duncan Chair for Constitutional Government and directed the Joseph and Dorothy Donnelly Moller Center for Constitutional Government. Dranias led the Goldwater Institute’s successful challenge to Arizona’s system of government campaign financing to the U.S. Supreme Court. Dranias also serves as a constitutional scholar, authoring scholarly articles dealing with a wide spectrum of issues in constitutional and regulatory policy. His articles have been published by leading law reviews, bar journals and think tanks across the country. Dranias’ latest significant works are In Defense of Private Civic Engagement (Heartland Institute) and Introducing "Article V 2.0:" The Compact for a Balanced Budget (Heartland Institute/ Federalist Society). Nick previously was an attorney with the Institute for Justice for three years and an attorney in private practice in Chicago for eight years. DeMOSS, JR., Senior Federal Judge (ret.) - US Fifth Circuit Court of Appeals Judge Harold R. DeMoss, Jr. is a recently retired senior federal appellate judge and sat on the US Fifth Circuit Court of Appeals. He was appointed to the court in 1991 by President George H. W. Bush, and took senior status in 2007. Judge DeMoss graduated from Rice University in 1952 and the University of Texas Law School in 1955. After serving in the United States Army from 1955 to 1957, Judge DeMoss joined the Houston law firm of Bracewell Reynolds & Patterson (now Bracewell & Giuliani), where he became a partner and remained until his appointment to the federal bench. In 1988, he took a six-month sabbatical from the firm to work as a senior advisor to President Bush (41) during his successful campaign for President. Judge DeMoss is known as a strict constructionist and believes the words of the U.S. Constitution mean what they say and should not be “interpreted”. SVEN R. LARSON, PhD, Senior Fellow (fmr.) - Wyoming Liberty Group Sven Larson, originally from Sweden, is currently an economist with Republic Free Choice in Cheyenne, Wyoming. He was previously a senior fellow in economics with the Wyoming Liberty Group. After having earned his BA in economics and philosophy at University of Stockholm, Sweden, Larson worked as a teacher assistant in economics and free-lance political writer. During the dark years of Sweden's deep recession in the early '90s, he lectured all over the country on the virtues of economic freedom and sound fiscal policy. On two occasions he was invited to the national parliament to speak on fiscal policy and budget matters. In 1996, Larson returned to school to pursue his PhD in economics at Roskilde University in Denmark. Four years later he successfully defended his dissertation, titled Uncertainty, Macroeconomic Stability and the Welfare State. The dissertation suggested that in times of uncertainty, there are stabilizing mechanisms in the economy that prevent a free-fall from a recession into a depression, but that these mechanisms can be upstaged by overly invasive fiscal policy. Larson's thesis was recognized internationally and published by Ashgate, a renowned British academic publishing house. In 2002, Larson came to the United States to teach economics at Skidmore College. He developed a class on the European economic integration, a unique offering in America at the time. Three years later he switched careers and went to work for free-market think tanks. After a brief stint at the American Institute for Economic Research, Larson joined the Center for Freedom and Prosperity, based in Alexandria, VA. Working closely with Dan Mitchell, now senior fellow at the Cato Institute, Larson wrote numerous blogs and several research papers on the virtues of free markets, economic freedom and low taxes. Larson also worked for think tanks in New York, North Carolina, South Carolina and Utah before joining Wyoming Liberty Group in February 2009. In 2010, Larson published Remaking America: Welcome to the Dark Side of the Welfare State, a book that explained how the Obama administration's policies to expand entitlement systems in America would eventually lead to fiscal disaster. In 2012, he followed up with Ending the Welfare State: A Path to Limited Government That Won't Leave the Poor Behind. In this book, Larson presents tangible reform ideas for key entitlement systems, including Social Security, welfare and health care, and shows how Congress can introduce an economic-freedom checkpoint into its legislation. On his blog The Liberty Bullhorn, Larson tracks the economic developments in Europe. He wants to draw America's attention to the dire situation of the European economy, as a warning of what happens when the welfare state and government borrowing together run out of control. LAWRENCE REED, President - Foundation for Economic Education (FEE) Lawrence W. (“Larry”) Reed became president of FEE in 2008, after serving as chairman of its board of trustees in the 1990s and both writing and speaking for FEE since the late 1970s. He is currently the State Policy Director for the 1889 Institute based in Oklahoma City, Oklahoma. He was formerly Director of the Center for Economic Prosperity for the Goldwater Institute in Phoenix, Arizona. Prior to his fellowship, Baker was the F.M. Kirby Research Fellow at The Heritage Foundation. His research at The Heritage Foundation, which covered the time from 1989 through 2013, was focused on national security and defense policy issues. This included matters related to defense budgets, missile defense, nuclear issues and arms control. He played a prominent role in The Heritage Foundation’s research related to extricating the U.S. from the 1972 Anti-Ballistic Missile (ABM) Treaty in the aftermath of the collapse of the Soviet Union; outlined the dangers posed by U.S. ratification of the Comprehensive Test Ban Treaty; and created a series of tabletop exercises for examining stability issues in the context of the proliferation of nuclear weapons. Prior to joining The Heritage Foundation, Baker worked as a Legislative Assistant to two United States senators. He received his BA from Washington & Lee University in 1980 and his MA in National Security Studies from Georgetown University in 1988. A joint venture with Exxon Pipeline Company to convert Exxon’s 18-inch Longhorn crude oil pipeline, which ran from Baytown, Texas across the state to El Paso, then on to Santa Fe and Albuquerque, NM to Phoenix, AZ into a products pipeline. A joint venture in Alaska with Sasol LTD, the largest African oil company and the world leader in Coal to Liquids (CTL) and Gas to Liquids (GTL) technology A second joint venture with Sasol LTD to convert the coal of the massive Beluga Coal Field into synthetic fuels. The Beluga Coal Field is the largest proven coalfield, located on the tidewater in the United States. LAWRENCE LESSIG, JD, Director - Edmond J. Safra Foundation Center for Ethics -Harvard University Lawrence Lessig is the Director of the Edmond J. Safra Foundation Center for Ethics at Harvard University, and a Professor of Law at Harvard Law School. Prior to returning to Harvard, Lessig was a Professor of Law at Stanford Law School (where he was founder of Stanford's Center for Internet and Society), Harvard Law School (1997-2000), and the University of Chicago Law School. She won the election and served on the Board of Education until 2008. In 2006, she launched a successful community magazine to highlight businesses and events in her local community while continuing to run the marketing company. In 2010, she ran for the Georgia House of Representatives in a challenging race unseating an incumbent legislator. She had a strong grassroots team and worked hard to win the seat against the odds. She currently serves as the State Representative for her district. In 2014, with the help of fellow legislator Andy Welch, Governor Nathan Deal, The Goldwater Institute, Compact for America and the head of the Tea Party in Georgia, Ms. Rakestraw-Braddock got H.B. 794 - the Compact for Balanced Budget - passed into law in the State of Georgia. Georgia thus became the first member state to join the Compact. Shortly after Governor Deal signed the Compact legislation into law, he appointed Paulette as the Compact Commission member from the State of Georgia. Paulette has served in board positions of the American Marketing Association Atlanta, and the Atlanta Direct Marketing Association. She received a Distinguished Sales & Marketing Executive award in 1997 from the Sales & Marketing Executives Association. She has been honorably mentioned in several books and has been featured on ABC’s 20/20. She has also been in several magazines and newspapers for her success in business as a young female entrepreneur. She is a graduate of the 2005 Leadership Cobb program and a 2011 graduate of the Leadership Paulding program. Paulette is a mother of three grown children and a former member of her local Rotary Club. She has served as a judge for the state DECA awards competition in Atlanta, helping to prepare emerging leaders and entrepreneurs in marketing, finance, hospitality and management. She earned a Bachelor’s degree in Public Relations and Communication from Kennesaw State University. ROBERT C. REINARZ, President & CEO - R.C. Reinarz & Company Bob Reinarz is an arbitrator, executive and underwriter with over forty years of “hands-on” experience in both insurance and reinsurance companies, functioning as chief executive officer, chief operating officer, senior underwriting officer, as well as director of ceded reinsurance for a major top twenty insurance group. Bob’s employers and consulting engagements have included: St. Paul Insurance Group, Great American Insurance Group, Worexco, First International Reinsurance Company, American Overseas Reinsurance Company, Atlantic Reinsurance Company, Old American Insurance Services, and Old American County Mutual Fire Insurance Company. In 1988, he was awarded the Roy Nelson Award by the Independent Reinsurance Underwriters (IRU) in recognition of his contributions to that organization. In 1990, he was designated an Honorary Counsellor by the International Insurance Society in recognition of the significant influence he had on the development of the Society over a number of years. In 2002, Bob was awarded a Lifetime Honorary membership in the Automobile Insurance Agents of Texas (AIAT) for his contributions to the organization, his continuing commitment to the preservation and wellbeing of the independent automobile insurance agent. Bob received his BBA in Finance with a minor in Insurance from the University of Texas in 1960. After serving in the Navy, he was awarded a teaching fellowship at the University of Texas to pursue graduate studies in Finance, completing his studies and receiving an MBA in Finance in 1964. In 1969, he wrote of his experiences at The St. Paul, which were later published in his book “Property and Liability Reinsurance Management.” He has written a number of chapters in the American Insurance Institute’s “Reinsurance and Practices” handbook. He also wrote a number of articles that have appeared over the years in publications such as the “National Underwriter” and “Best’s Insurance Review.” In 2003, Bob retired to central Texas to focus on his family, friends, church and political causes.
