IF Prime Minister Justin Trudeau is able to work with opposition parties, either formally or informally, then the possibility of significant constitutional drama is pretty remote, at least in the short term, according to a University of Alberta constitutional law expert. “I think Mr. Trudeau has a willing partner in the NDP to provide him with the support that he’ll need to govern, at least for a few years,” said U of A law professor Eric Adams. He said in the Westminster Parliamentary system, Trudeau remained the prime minister whatever the election result and always had the option of taking the first shot at forming government, although constitutional tradition dictates that he would have resigned had the Conservatives won a majority. Adams said this runs counter to assertions made by Conservative leader Andrew Sheer in the final days of the campaign, that the leader who gets the most seats

may have an easier time evolving. “It could be that unwritten rules are a little more responsive to the facts on the ground, and changes over time.” Adams said the first order of business will be for the prime minister to recall the house and face the first big confidence test of any government—the passing of the throne speech. After that, Adams explained that with the exception of budgetary measures, minority governments can and do lose votes in the House of Commons that don’t trigger a loss of confidence and a resulting election. That said, the government has the option of making any measure a matter of confidence. “Sometimes it’s a bit of a game of chicken, with the government say-
ing, ‘This legislation is important to us and if you don’t vote for it, we’re going to blame you for precipitating an election,’” he said. Over the course of the most recent two federal minority governments, former prime minister Stephen Harper often dared the opposition to vote against his legislation and risk suffering the consequences of an election Canadians didn’t want, Adams said. “At least in the short term, that kind of governing tactic has a lot of purchase for a newly elected minority government,” he explained. “However, what always ends up happening, if history is any guide, is that at some point that game of chicken gets called and an opposition party thinks, ‘You know what? I think we’re ready for that election.’”

Besides NDP Leader Jagmeet Singh, four Liberals – Harjeet Sajjan, Sukh Dhaliwal, Randeep Sarai and Hedy Fry – were re-elected in B.C., while Liberal candidate Jati Sidhu lost to Conservative candidate Brad Vis in Mission-MatsquiFraser Canyon. The Conservatives won 17 seats (+9 compared to seat counts at dissolution of Parliament) with 797,413 votes (34% of the total vote). The Liberals were next with 11 seats (-6). They garnered 611,575 votes (26.1%). The NDP won 11 seats (-1) with 571,651 votes (24.4%). The Greens bagged 2 seats with 290,391 votes (12.4%). There was one independent (former Liberal MP Jody Wilson-Raybould) who got 34,161 votes (1.5%). The People’s Party won 39,481 votes (1.7%) but got no seats. New indictment offers more details about Dave Sidoo case U.S. prosecutors have it seems built up a detailed case against Vancouver businessman David Sidoo in the college admissions
scandal as a new indictment shows (see link below). Prosecutors allege that William ‘Rick’ Sing-
er, who they say was behind the scheme to help wealthy families get their children’s entrance to prestigious schools, falsified an application essay in or about October 2013 describing Sidoo’s younger son’s purported internship with an organization that worked to combat violence among Los Angelesbased gangs. “The essay falsely claimed that SIDOO’s younger son had been held at gun point by gang members in Los Angeles. Singer e-mailed the essay to SIDOO,” reads the indictment. “SIDOO wrote back with minor changes to the essay, and asked, ‘can we lessen the interaction with the gangs. Guns…? That’s scary stuff. Your call you know what they look for.’” It adds: “The essay, without the reference to guns was later submitted as part of SIDOO’s younger son’s application for admission to multiple universities.” The indictment also says: “Beginning in approximately 2015, SIDOO asked Singer if he could have Riddell take either the Graduate

Dave Sidoo Photo submitted Management Admission Test (“GMAT”), a standardized test that is widely used as part of the business school admissions process, or the Law School Admission Test (“LSAT”) on behalf of his oldest son. In exchange for taking one of the exams, Sidoo agreed to pay Singer a sum of money, and Singer, in turn, agreed to pay [Mark] Riddell approximately $100,000.” “Singer and Riddell researched the security measures in place for both exams. On or about April 28, 2015, Singer told SIDOO that their plan to have Riddell take the LSAT in place of SIDOO’s son was “[n]ot happening due to fingerprinting,” requirements on the exam,” the indictment states. “On or about December 15, 2016, Riddell used Western Union to wire $520 to China to pay for fraudulent drivers’ licenses that he intended to use to pose as SIDOO’s older son for the GMAT. Riddell had the identification mailed to Simger. The false identifications were not of high quality, and Riddell ultimately decided not to take the exam on behalf of SIDOO’s son. “On or about October 25, 2018, Singer called SIDOO from Boston, Massachusetts. During the call, SIDOO noted that his older son was applying to business school, adding, “I thought you were gonna call me and say I got a 2100 on my GMAT.” In fact, the GMAT is scored on a scale of 200 to 800. Singer responded, “They don’t have a 2100 for GMAT. But I would do my best to get it for ya.” SIDOO replied, “I know.”” Last March, Sidoo was accused of paying Singer to have Riddell write SATs for his sons in 2011 and 2012, besides a high school graduation exam. The older son got admission to a private university in California. The younger son went to the University of California-Berkeley. The details contained in the charging documents are allegations. The defendants are presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law. CBC adds: “A total of 35 wealthy and celebrity parents have been charged in the scheme, including a mother from Surrey, B.C. “Fifteen parents have already pleaded guilty in deals with prosecutors. Of the 10 sentenced so far, nine have received prison sentences, ranging from 14 days to five months. Desperate Housewives star Felicity Huffman was the first parent to be sentenced and is now serving her 14-day prison sentence. “The parents named in Tuesday’s indictment are among those fighting charges. “Singer flipped on the parents during the U.S. investigation and helped the FBI build the case against them for a chance at a lenient sentence. He pleaded guilty to charges including racketeering and conspiracy. “Riddell pleaded guilty to charges against him in April.”

10. RAMESH SANGHA Brampton Centre Ramesh Sangha was first elected as the Member of Parliament for the riding of Brampton Centre in 2015. AMARJEET SOHI LOSES TO TIM UPPAL IN ALBERTA 3 South Asians – all Conservatives - elected AMARJEET Sohi (Liberal) lost in his riding of Edmonton Mill Woods in Alberta, to Conservative candidate, Tim Uppal.
Amarjeet Sohi Sohi served as Canada’s Minister of Infrastructure and Communities from 2015-2018, and he had been Minister of Natural Resources since 2018. In a stunning upset in 2015, then-Minister of State for Multiculturalism Uppal was defeated by Sohi, who was an Edmonton City Councillor, by only 80 votes. Sohi bagged 20,399 votes, while Uppal won 20,319 votes. Uppal was evidently a victim of then-Prime Minister Stephen Harper and thenMulticulturalism Minister Jason Kenney’s bigoted attack on the niqab that upset millions of Canadians across the country. But this time, Uppal won a resounding victory. Uppal was the Member of Parliament for EdmontonSherwood Park from 2008 to 2015. He was appointed Minister of State for Democratic Reform; introducing legislation to reform the Senate, increase fairness in representation in the
House the Commons, and strengthen regulations for political financing. In July 2013, Tim became Minister of State for Multiculturalism. Vancouver Police renew warning about virtual kidnappings VANCOUVER Police are issuing a new warning about virtual kidnappings, after foreign fraudsters tried to extort a 27-year-old Vancouver man of thousands of dollars on Wednesday night. VPD’s Major Crime Section is investigating the elaborate extortion attempt, which was thwarted after police were alerted. The scam has all the hallmarks of similar virtual kidnappings that happened last year. “The victim typically receives a phone call and is convinced there is a warrant for their arrest in China, or that Chinese police need help with an investigation,” said Sgt. Aaron Roed. “The suspects then tell the victim to go into hiding and to make fake videos claiming they’ve been kidnapped. The scammers send the videos to the victim’s family and friends asking for money to pay for their release.” Victims are typically women in their early 20s from Mainland China who are in Canada studying on a student visa. VPD believes many of these incidents have gone unreported. Others come to light after concerned relatives phone police asking for help. “Police from outside Canada will never arrest you in this country, ask for photos or videos of yourself pretending to be a victim of crime,” said Roed. “Any contact from international authorities should be through your local police.” Anyone receiving phone calls from someone claiming to represent a foreign police agency should call 9-11 immediately. Anyone with information about virtual kidnappings is asked to call VPD’s Major Crime Section at 604-717-3679 or Crime Stoppers 1-800-222-8477.

Jawahar Singh Padda loses court appeal; was sentenced to 29 months in prison JAWAHAR Singh Padda, a Surrey businessman who runs a pizza joint in Newton, was sentenced to 29 months and 22 days in prison in Surrey Provincial Court on June 26. He was convicted on one count of possessing a prohibited firearm loaded with ammunition to be served concurrently with a sentence of 18 months’ imprisonment for one count of pointing a firearm. Padda was charged in connection with an incident on November 1, 2016. According to the summary of the ruling by the B.C. Court of Appeal: “The appellant purchased a prohibited handgun and stored it at a restaurant he owned. One evening, under the influence of alcohol and cocaine, he brandished the handgun and pointed it at some of his employees. He pushed and struck an employee with his hand while in possession of the handgun. The appellant’s offending behaviour was out of character, and he was otherwise a model citizen. He purchased the handgun because he felt he needed it for protection. At the time of the offence, he was experiencing problems with alcohol and depression. After his arrest, he took significant rehabilitative steps. Held: Appeal dismissed. A 30-month sentence is at the bottom

Under “The offences,” the ruling states: “Mr. Padda was in possession of a prohibited handgun, along with ammunition, because he had purchased it illegally for $4,000 at the end of October 2016. He felt he needed the handgun for protection at his
restaurant, even though he had already hired a security firm to protect him and his employees from questionable acquaintances who had shown up late on one occasion and threatened staff. “Just after midnight on November 1, 2016, Mr. Padda entered the kitchen of a restaurant he owns, brandishing the handgun. Several employees were present in the kitchen area. He loaded the handgun in front of his employees. He was clearly intoxicated; drunk on alcohol and he had also used cocaine. The incident, which lasted about 35 minutes, was captured by video cameras and recorded. The recordings, together with recordings from other times proximate to the incident, were exhibits on sentencing and were viewed by the judge. “The recordings showed that Mr. Padda pointed the handgun at female employees. He gestured “as if to cock the firearm” while pointing it at his employees. At times, Mr. Padda appeared to be joking with his employees; at other times he became aggressive. He struck a female employee with his hand at least twice and pushed her while in possession of the handgun. As articulated in the reasons for sentence, the judge found that Mr. Padda, in striking and pushing his
employee while armed, had “terrorized a woman that he, as her employer, was in a position of trust and authority over” … Eventually, Mr.
Padda dropped the handgun after grappling with a security guard. The judge found that Mr. Padda had put his employees in grave danger.”

shooting. A CTV news report on Tuesday night said the shooting took place at a gas station. It said a black BMW SUV at Abbotsford Regional Hospital had blown out tires, a smashed windshield and what appear to be bullet holes in the driver side window with visible damage to the front of the vehicle. The vehicle that was set on fire was on Queen Street near Peardonville Road. Later, CTV obtained video footage that shows how innocent victims could have been killed. It shows two people with their faces partially covered approach a dark-coloured SUV in the line-up at a Tim Hortons drive-thru. The two raise their arms and point something at the vehicle. The SUV then takes off, hitting a car to escape.

BCSC reaches settlement with Gagan Deep Bachra and others in illegal sale of shares THE British Columbia Securities Commission (BCSC) has reached settlement agreements with three B.C. men and one man from Alberta who were involved in companies that were illegally selling shares. Chung-Shen “Johnson” Kao, Gagan Deep Bachra, Chi Kay“Dixon” Wong and Meng Cher “Phillip” Tsai were nominee directors of three companies that raised a total of $19.6 million between 2016 and 2017: * FS Financial Services (Alberta) Inc., of which Kao was a director, raised $12.6 million from 72 investors in B.C. * Verico FS Capital Inc., of which Bachra was a director, raised $5.38 million from 35 investors * FS Financial Systems Inc., of which Wong and Tsai were directors, raised $1.62 million from 15 investors All of the money was raised without a prospectus, a formal document that explains the details of an investment and the risks involved. None of the investors qualified for an exemption from the prospectus require-
ments under the Securities Act. Kao, an Alberta resident, admitted that by acting as a nominee director he engaged in conduct abusive to the capital market. The other three admitted to allowing an illegal distribution of securities. As part of the settlement, Wong has agreed to pay $15,000, and Tsai and Bachra have agreed to each pay $7,500, to the BCSC. All four men are required to take a course on the duties and responsibilities of corporate officers and directors. Wong, Bachra and Tsai are prohibited for two years and Kao is prohibited for one year from: * trading in or purchasing securities or exchange contracts (with some limited exceptions) * relying on any exemption under the Securities Act * being a director or officer of any issuer or registrant * being or acting as a registrant or promoter * acting in a management or consultative
capacity in connection with the securities market * and engaging in investor relations activities

Structure fire investigation at Surrey gas station, 1 dead SURREY RCMP is on the scene of a large structure fire at a business where one person has been located deceased. On October 21 at 5:30 a.m., the Surrey Fire Service and Surrey RCMP responded to a report of a fire at a gas station in the 8700-block of Harvie Road. Once the fire was deemed under control and the area could be searched, one person was located inside the gas station deceased. The exact cause of the fire is yet to be determined and the Surrey RCMP General Investigation Unit will be continuing to investigate the fire in collaboration with the Surrey Fire Service. Surrey RCMP’s Project Lavender aims to empower young women and girls SURREY RCMP have launched “Project Lavender”, a program which aims to empower young women and girls to make positive choices, and surround themselves with healthy relationships. Project Lavender is a Surrey RCMP-led initiative built in collaboration with female students from across the Surrey School District. The content of the program focuses on topics identified by the young women and girls who participated in the collaborative development
process. Project Lavender, will tackle topics which include texting; ‘sexting’; understanding sexual exploitation; drug and alcohol awareness; and the importance of healthy relationships. It is a one-hour presentation geared towards Grade 5-10 students, the presentation can also be adapted to suit community groups and organizations, particularly those who engage with youth. “We are excited to see the impact Project Lavender will have

This is hurting communities throughout our province that are dealing with the consequences of criminal activity and high home prices, and it needs to stop.” Effective May 1, 2020, amendments to the Business Corporations Act will require private businesses in B.C. to keep and maintain transparency records of beneficial owners, including individuals who have direct or indirect control of the company or its shares. Information collected includes full legal name, date of birth, citizenship and last known address. The amendments will help end hidden ownership, which can be used to avoid taxes and launder money, by requiring private companies to hold accurate and up-to-date information about the true owners of a company. “The previous government let criminals shelter the illegal proceeds of crime, but we are listening to British Columbians, experts and municipalities to end hidden ownership,”

It’s time to introduce choices in auto insurance.” B.C. drivers have seen the average ICBC premium go up a whopping 18.2 per cent under the NDP, and ICBC projects a 24 per cent increase in premium prices over the next three years, noted the B.C. Liberals. “David Eby’s tinkering with ICBC has not only cost British Columbians more for auto insurance but it also just blew a $400 million hole in John Horgan’s budget,” added Wilkinson. “Two years into their mandate, after 19 new and increased taxes and no plan to grow the economy, John Horgan and the NDP have burned through the surplus left by the BC Liberals and will now have to drain the contingency fund or run a deficit because of losing yet another foolish court case.”

Weapons and stolen property seized from Langley residence SURREY RCMP announced on Tuesday that they had seized a large quantity of weapons and stolen property following a search warrant at a residence in Langley. On October 10, the Surrey RCMP Community Response Unit (CRU) executed a search warrant at a residence in the 7500-block of 202A Street in Langley. The search warrant stemmed from an alleged fraud that originated in Surrey in early October. Based on information collected from frontline and CRU officers, investigators were led to the residence in Langley, believed to be associated to the fraud investigation. As well as evidence of the initial fraud offence, the following items were located at the residence: * Two loaded firearms * Two replica handguns * Three crossbows * Three sets of body armour * Firearms ammunition * Six stolen vehicles * Multiple conducted energy weapons * Swords, brass knuckles, and various other weapons “Taking these weapons off of the streets is significant and will have a direct impact on public safety,” said Sgt. Ed Hryciuk, Surrey RCMP CRU District 4, Cloverdale. “This is an example of how a report received from the public can lead to a larger investigation that has a positive outcome for the community.” Nine individuals were located inside the residence during the execution of the search warrant and subsequently released
Suspects identified after schoolyard altercation in Port Coquitlam SEVERAL suspects have been identified and charges are likely after a confrontation involving OC spray (pepper spray) at a Port Coquitlam school on Tuesday. The incident happened at 12:45 p.m. in the parking lot of Terry Fox Secondary at 1260 Riverwood Gate and involved numerous young males. During the confrontation, OC spray was deployed towards two males who were inside a car. “Frontline Coquitlam RCMP officers were on scene in moments and stayed at the school throughout the day to make sure that students and staff felt safe, said Cpl. Michael McLaughlin. “Police are satisfied that we have identified all potential suspects who were at the scene. We are examining all the evidence to determine the exact charges that should be laid.” While the confrontation was occurring in the parking lot, staff at Terry Fox Secondary made the decision to put the school on hold and secure. The hold and secure was lifted about one hour after police arrived and determined that there was minimal ongoing risk. Apart from the use of the OC spray, no injuries were reported during the incident. Coquitlam RCMP would like to remind people to call 911 immediately if they see anyone acting suspiciously at or near a school. Homicide Team investigating two dead in Coquitlam home ON Monday (October 21), RCMP were called to a residence on Seaton Avenue in Coquitlam around 3:30 p.m. Frontline officers attended and located two deceased persons inside. The Integrated Homicide Investigation Team (IHIT) has now taken conduct of the investigation. “Evidence from the initial investigation indicates that one of the deceased persons was the victim of a homicide. Although the circumstances surrounding the death of the second person are still being examined, we do not believe that there are any outstanding suspects,” said IHIT Constable Harrison Mohr. “We believe this incident was contained within the residence, and can confirm that both persons knew each other. Our thoughts are with the family and friends affected by this tragedy.” CBC later reported that eight-year-old Oscar Taitinger was the homicide victim, according to his mother, Nicole Taitinger. She told CBC that she broke up with the boy’s father, Mark, after 25 years of marriage. Mark was also found dead in the home. Oscar was the youngest of three boys. IHIT’s investigation is ongoing, and is focussed primarily on the one residence. Investigators may be at the scene and in the neighbourhood for several more days as they continue to gather evidence.

Suspicious death of notary public Stephen Chong in Richmond THE Integrated Homicide Investigation Team (IHIT) is requesting public assistance to further its investigation into the suspicious death of 58-yearold Stephen Chong of Richmond. On Friday, October 18, at around 5:30 p.m., Chong was found dead inside his business in the 8200-block of Granville Avenue in Richmond. After an assessment of the scene by the Richmond RCMP, IHIT was called in as the circumstances surrounding Chong’s death appeared suspicious. IHIT is investigating with the assistance of the Richmond RCMP serious crime unit. Priority tasks will include conducting a complete neighbourhood canvass for witnesses and video surveillance footage. IHIT’s crime scene manager will also be working in tandem with forensic specialists from the Integrated Forensic Identification Services (IFIS) to collect and process forensic evidence. “Mr. Stephen Chong was a notary public in the Richmond community with no record of criminality,” said IHIT Sgt.
