The new law that addresses creeping property-tax rates American poet Carl Sandburg once reflected on the creeping of fog, how it “comes on little cat feet.” That type of stealth is fine for the weather but not for Texas property-tax policy. Many Texans get sticker shock from their property-tax bills. They get an even bigger shock when they discover that their local taxing jurisdiction— municipality, county, school district—raised tax rates without their knowledge. Members of the Texas Legislature have heard

the outcry from Texans. You want a more transparent process and stricter requirements to approve tax-rate increases. This year, legislators took a major step to address this issue. Effective Jan. 1, 2016, a local taxing unit must have a supermajority to approve a propertytax rate increase. That means at least 60% of the unit’s members must vote in favor of the increase. Furthermore, all property-tax changes will be posted in an easily accessible and consumer-friendly

manner. This new law didn’t get a lot of attention last session but could have a significant impact on your wallet. Taxing jurisdictions will no longer be able to hide behind voice votes, simple majorities, and ambiguous public notices to increase tax rates. Each year tens of thousands of Texans show up at central appraisal district offices to protest the values assessed on their property. But almost no one attends the budget hearings where property-tax

rates are set. This new law enables citizens to take a more active role in setting their tax rates and helps them understand why their elected officials feel a rate increase is necessary. We know taxes are necessary for communities to fund government services. However, increases should be done in a judicious, transparent manner—not approved in a stealthy manner, creeping up on little cat feet.

How to determine the true value of home improvements (BPT) - As the U.S. housing industry continues to emerge from the Great Recession, signs are pointing toward positive recovery. In fact, a recent report from the Joint Center for Housing Studies of Harvard University states that the home improvement industry could see record spending in 2015. Buying Down Points

Selecting a mortgage is a tough job filled with research, questions and some home study before signing on the dotted line. A good loan officer will evaluate your unique situation to include how many years you intend to live in your new home, recommend a type of mortgage to match your fixed or fluctuating monthly income and offer you the opportunity to lower your interest rates and reduce your monthly payments with the “buying down points” technique. In some cases, buying down points is the best approach to home financing, and the purchaser may wish to wait an extra few months to save the additional cash to get the discount. Ask your loan officer what he or she recommends for your current and future financial status, and ask them to formulate a plan especially for your unique and individual situation.

Tax Implications The Internal Revenue Service offers the following advice for the tax deduction for mortgage interest points: “If you pay interest in advance for a period that goes beyond the end of the tax year, you must spread this interest over the tax years to which it applies. Generally, you can deduct in each year only the interest that qualifies as home mortgage interest for that year. An exception (discussed later) applies to points.”

WHAT IS IT?

Buying down points is a means of financial leverage to plunk down some extra cash at the time of your signature in exchange for a favorable adjustment to your interest rate. Each buy-down point equates to 1 percent of the balance financed, so if you have a $500,000 loan balance, each point would cost you $5,000.

HOW IT HELPS

Buying down points may require an uncomfortable amount of cash out of pocket in the beginning, but over the life of the loan, the homeowner will enjoy substantial savings and may be able to pay the mortgage off early. Although the monthly savings may be less than $100, the longterm financial strategy is to keep your money in your wallet, where

It may take several years to recoup your initial cash investment of buying down points, but a mortgage will follow you most of your life. It’s important to consider your future income and retirement funds available in your later years.

THE BEST SITUATION

The home buyers who will benefit the most from buying down

points are those who intend to keep the home for a longer period of time and opted for a fixed mortgage for 20, 30 or 40 years. Because it takes nearly a decade to recoup the buying points strategy investment, the homeowner will not see a significant amount of mortgage payments saved unless he or she remains in the property for close to or exceeding the life of the loan.

IDEAL CANDIDATES Home buyers who earn a fixed

income, such as a standard salary that may or may not include bonuses, have a dependable cash flow and can plan for their future mortgage payments from a pattern of monthly income. However, home buyers who earn their living through sales commissions or experience highs and lows with seasonal cash flow months may wish to explore buying down points to counter against tough times down the road. In addition, it is important to understand your retirement pack-

age and all its benefits to carefully calculate what is going to be a comfortable monthly output on a mortgage in case your property is not paid off when you retire. If you are purchasing a home and your retirement will come before paying off the loan balance, it’s smart financial shopping to use the buying down points program to enjoy a lower monthly payment and reduced balance at the end of the loan.

What’s Included in a Sale?

Selling a home is a precise process when everything is in writing with clear-as-a-bell instructions set forth at the time of the sale. Nothing is ever assumed or presumed when it comes to the transfer of property and all the legalities that come with the deal. When selling your home, you must be absolutely clear on which items will be included with the sale or offered at an additional price. Likewise, you have to spell it out when fixtures and accessories are not going to be part of the sale.

Home Warranties A home warranty may be included in the sale of your home. For new homes, the warranty typically is issued by the builder. For existing homes, a buyer or seller may purchase a home warranty from a third-party company.

WHAT IS REAL PROPERTY?

The legal definition of real property is the land, the structure and anything that is permanently attached to it. In most cases, this would include faucets, built-in lighting, permanent floor coverings, and even a tree house firmly attached in the backyard. If you wish to keep a dining room light or similar affixed item, you will need to itemize these pieces and declare them separate from the sale of the property. If the items are not clearly dismissed from the sale in writing, there is a danger of a nasty lawsuit from a disgruntled buyer who had a passion for your swinging lamp over the billiards table. You are free to take what you want with you when you move. Just be sure your buyer has it in writing that select decorative fixtures are going with you.

KITCHEN APPLIANCES

Another area for concern is your kitchen and the appliances. Many home buyers will appreciate a complete kitchen in place to make their move-in turnkey and ready to cook. You do not have to include your

If the high-end range in the kitchen of your new home struck your fancy, be sure to check that it’s included in the sale of the home. Some items may be excluded, per the contract. refrigerator, stove, dishwasher and other appliances, but adding these items in the sale can make or break the deal. In addition, you will be paid a tidy sum for the sale of the property and should be able to replace your kitchen appliances for your new home if need be. However, the buyer may be on a tight budget where installing a full kitchen appliance suite is cash out of pocket that they would rather not spend. The choice is yours, but savvy sellers include the kitchen appliances to sweeten the deal.

GET APPROVAL TO REPLACE

In some instances, an object

should not be removed because its absence would interfere with the utility of the home. For example, if you have a fireplace screen that you love dearly and must take with you, be sure to replace the screen and get your buyer’s approval for the replacement. The same thing applies to indoor or outdoor wall lanterns, ceiling fans and other objects that contribute to the normal functions of the home.

SELL FURNISHINGS WITH THE HOME

If you wish to include some furnishings, you must itemize them

one by one rather than simply saying the living room set is included. When adding furniture to the total sale price, this can be an attractive selling feature for a new buyer strapped for cash and in need of quality furnishings. You must offer the wares at a deal either as a complete package or allow the buyer to pick and choose what they can afford. The new home buyer has an instant living space set up without a cash transaction, and the seller has increased the sale of the property and starts over with a clean slate for decorating. It’s a win-win situation for both buyer and seller and adds value to your final price.
