Canadian Fine Art tLOTS 1 - 62 The great theme of the Canadian Fine Art section of The Canada Auction is not found in the subject or style of its artworks, but rather in a shared desire on the part of the artists it includes: a desire to expand the visual vocabulary of this country, to move the needle of artistic expression. To some, the sublime landscapes of the Group of Seven can feel as familiar as the Canadian flag. However, with approximately 100 years of history between the painters and their present-day viewers, it is easy to forget this collective was once seen as deeply provocative. The Group was formed with the goal of rebelling against the constraints of Old World aesthetics, to create a national school of painting, and to change conservative Canadian tastes. The establishment at the time disliked their rhetoric as much as their paintings, which were negatively reviewed – their first exhibition was famously compared to “the contents of a drunkard’s stomach.” Today, these paintings form the bedrock of what we call Canadian Fine Art. Bidders will enjoy work in this auction by Lawren Harris, A.J. Casson, Frank Hans Johnston, A.Y. Jackson, and J.E.H. MacDonald. Norval Morrisseau was also in search of a new artistic vocabulary, which he would find through blending traditional Anishinaabe legends with contemporary mediums. Morrisseau broke open the contemporary art scene for First Nations artists. Fellow member of the Professional Native Indian Artists Incorporation (PNIAI) Alex Janvier was similarly driven to forge a new path, aiming to “take our art out of the ethnological and war museums in Ottawa, Ontario and bring it to mainstream Canada.” Janvier has made lasting contributions as a muralist, painter, activist, community leader and educator. Women artists have also worked hard to express their unique viewpoints. This auction is enhanced by the work of Laura Muntz Lyall, one of the first female artists to receive recognition outside of Canada; Anne Savage, part of the Beaver Hall Group and a founding member of the Canadian Group of Painters; and Pegi Nicol MacLeod, who used quotidian subjects – children, gardens, street scenes – to bring a vibrancy to a progressive modernist style that was all her own. We are pleased to be featuring their work alongside art by Marion Long, Doris McCarthy, and Carol Wainio. Rounding out this spring’s selection are excellent examples of Canadian post-war abstraction. Three members of the influential Painters Eleven group – Kazuo Nakamura, William Ronald, and Jack Bush – are represented in this auction, artists who pushed to introduce abstraction into Canadian culture. These paintings are complemented by an excellent work by Gordon Smith, who devoted his practice to facilitating a conversation between the abstract and the representational. Bringing the auction full circle is Takao Tanabe, who, like the Group of Seven, was driven by a desire to create a new vocabulary with which to speak about the land, a revolutionary in the wilderness. Since Waddington’s first auction devoted to Inuit art in 1978, we have watched the market for the sculpture, works on paper, and textiles the Inuit artists create soar ever higher, often surpassing the art of mainstream Canadian artists with respect to the high price levels and international interest it has achieved. The continued expansion of this market is reflected in our Inuit art auctions, attracting many eager bidders who are all vying to acquire their must-have pieces. Canadian collectors lead the way but are competing with collectors from Belgium, France, Italy, Switzerland, Sweden, the UK and the United States — and more. The key to this success is of course, the beautiful and powerful artform which reflects a uniquely beautiful and powerful culture. We are continuously delighted to watch as collectors from other disciplines discover Inuit art. The diversity of offerings from our various departments means that our public and online previews attract wide audiences, many of them new to the art of the Canadian Arctic. At a recent auction preview we displayed Inuit art pieces alongside fine Asian art; an overseas collector flew in to examine a group of historic Chinese jades to find himself captivated by the work of Manasie Akpiliakpik and bought one — and just like that, a new collector. Our Spring 2023 auction of Inuit art focuses on rarity and quality, the work of top artists, both young and old, alongside classic, early anonymous pieces — many which have often been tucked away in private collections for decades. While collectors’ individual tastes are as unique as the art they collect, this auction is sure to have something for every palate. Canadian Arts, Culture & History tLOTS 301-401 Waddington’s Canadian Arts, Culture, and History auction reflects the country’s incredible breadth of talent across various disciplines. A twice-yearly occurrence, this auction echoes our popular Cabinet of Curiosities series, but instead of presenting all things foreign and exotic, the focus is instead turned homeward—and what treasures abound! One of the highlights of this auction is lot 301, a 19th century Canada-United States Border Marker. It was not until the 1818 Convention of London that the line between the two nations was both legislatively defined and socially understood. Established along the 49th parallel, the demarcating line stretching from coast to coast is the longest undefended border in the world. Made from granite, cast iron, bronze and stainless steel and placed in 1861, this obelisk is just one of the 8,600 total markers erected along the border between Canada and the United States. Photography is one of the threads of this auction. Fans of SCTV and Toronto’s Second City troupe will enjoy a look behind the scenes, courtesy of lot 322, an album of polaroids of John Candy, Eugene Levy, Catherine O’Hara, Andrea Martin, Joe Flaherty, Harold Ramis and Dave Thomas in character makeup for their first television appearances on Global TV’s Second City, as photographed by Diane Rowe, a makeup artist who worked with the troupe from 1977 through 1979. Lot 303 is a rare carte de visite belonging to Louis Riel and bearing his photographic likeness, from an era that saw the election of Riel as President of a Provisional Métis government, the accession of the Province of Manitoba into Confederation (then the Red River Settlement), the execution of Thomas Scott on the orders of a Métis court-martial, Riel's election to the House of Commons, and subsequent escape to New York. Another lensbased work of note is lot 306, a photograph by Bob Olsen which captures the passing of John Diefenbaker's funeral train through Rosthern, Saskatchewan. Maps, posters and other works on paper are also a theme of this auction, from lot 377, Giacomo Gastaldi’s woodcut map, said to be the first printed plan of a North American town or village, published in 1556, to lots 373-377, similarly interesting maps from historical Canada. Canada’s great contributions to the musical field are reflected in lot 320, a self-portrait by Leonard Cohen, and lot 327, a signed album by Neil Young. These works are enhanced by historical items from Indigenous cultures, European explorers and settlers, the fur trade, the Confederation of Canada, and the nation’s involvement in two World Wars. By 1818 the relationship between Canada and the United States had come a long way from President John Adam’s assertion in 1776 that “Canada must be ours; Quebec must be taken”. The American War of Independence was the first concrete step towards delineating a boundary between the North and South, with the War of 1812 serving as another catalyst for change; but it was not until the 1818 ‘Convention of London’ that the line between the two nations was both legislatively defined and socially understood. Established along the 49th parallel, the demarcating line stretching from coast to coast is the longest undefended border in the world. The Convention outlined a series of articles that firmly stated the geographical and commercial rights of each country. It initially included a clause that left what was west of the Rocky Mountains to be “free and open” to either British or American settlement, a policy later nullified by the Oregon Treaty of 1846 which extended the 49th parallel to the Strait of Georgia in the Pacific Ocean. According to the preeminent historian of early painting in English Canada, J. Russell Harper, Robert Field was born in England and died in Kingston, Jamaica in 1819. Field was a painter and engraver, studying at the Royal Academy School in London in 1790. He became a skilled mezzotint and stipple engraver in England before 1794. In that year he emigrated to the United States, spending time in Baltimore, then Philadelphia. From 1800-1802, he lived in Washington, then moved to Boston from 1805-1808. During his time in the U.S., Field executed many miniatures and a few portraits in oil of prominent Americans including Martha Washington and Thomas Jefferson. In 1808, when tensions between America and England started to rise in the lead up to the War of 1812, Field remained a loyalist and moved from Boston to Halifax, Nova Scotia, Canada. He served in the 1st Company of Halifax Volunteer Artillery in 1812 and became a member of the Charitable Irish Society of Halifax. Recognized as one of Canada’s leading portrait artists, Field was probably the most professionallytrained painter to settle in Canada at the beginning of the 19th century and certainly ranked as Canada’s leading portrait painter on the eastern seaboard. Working in the neoclassical portrait style of Henry Raeburn and Gilbert Stuart, his patrons of the over 50 fine portraits Field painted in oil in Canada were of army and naval officers and prominent citizens. He also executed portraits for the Rockingham Club of Halifax, several of which were engraved. Property From The Estate of Roland Michener LOTS 501-606

Single-estate auctions function as powerful portraits of their owners. They are the expression of an individual through the objects that meant something to them, items which accompanied them through the years. In assembling the estate of lawyer, politician, and diplomat Roland Michener (1900-1991), it became clear that the pieces in this auction tell a story about the incredible breadth of a life spent in service to his country. Michener served as the Speaker of the House of Commons from 1957 to 1962, the High Commissioner to India from 1964-1967, and as the Governor General of Canada from 1967 to 1974. These positions placed him in the centre of many of the events which defined Canada in the last half of the 20th century. Only ten days into his tenure as Governor General, he opened Expo 67. Michener also faced down a constitutional crisis while in office, when Prime Minister Lester B. Pearson's government was defeated on a tax bill in February 1968. The FLQ Crisis also occurred during Michener’s period of service, sparking his invocation of the War Measures Act. Many years later, it was revealed that it was Michener himself, rather than James Cross and Pierre Laporte, who was the FLQ’s intended kidnapping target. As Governor General, Michener ushered in a new precedent when he undertook a state visit to Trinidad and Tobago in 1971, followed by his trip to Persepolis for what would enter the history books as the most expensive party in modern history: Shah Mohammad Reza Pahlavi’s banquet to commemorate the 2,500th anniversary of the Persian Empire (see lot 501, a menu from this event). These trips sparked controversy, as Michener was not Canada’s head of state, yet was presiding over what looked like state visits. However, Michener’s successes on these trips would end up changing the conventions of the role and broadening the responsibilities of future Governors General. Michener and his wife Norah were also noted for relaxing protocol at Rideau Hall – particularly in their dissolving the requirement for women to curtsey. After serving his term as Governor General, Michener and Norah relocated to the Rosedale neighbourhood of Toronto. He served as Chancellor of Queen's University until 1980, and remained active in business. Michener’s affairs, presented in this auction, include historical documents, signed photographs of international royalty, dignitaries and politicians, alongside presentation items from his time in office. These more formal items—sure to be of interest for the historian or lover of international affairs¬—are enhanced by personal belongings, books, and artworks. A few items bear the touch of Michener’s wife Norah¬—a similarly impressive figure—who annotated a few of the items in this auction, and purchased a few others. A poignant example of this is lot 527, a painting by Clayton David Insley, which was a gift from Norah to her husband on their 36th wedding anniversary, 26 February 1962. All lots will be offered and sold subject to the Conditions of Sale which appear in this catalogue as well as any Glossary and posted or oral announcements. By bidding at auction, bidders are bound by those Conditions and Glossary, as amended by any announcements or posted notices, which together form the contract of sale between the successful bidder (buyer), Waddington’s™ (auctioneer) and the consignor (seller) of the lot. Description or photographs of lots are not warranties and each lot is sold “as is” in accordance with the Conditions of Sale. CONDITION OF LOTS All of the items are to be considered, unless otherwise noted in the catalogue description or condition report, in good condition. The definition of “good” when used in reference to condition, describes an object as having had no major damage or repair but as with the nature of the material, may show minor surface wear, discolouration etc., which indicates the acceptable wear that the piece may acquire with age. If you are particular about minor flaws, you should have our staff answer any questions before bidding. Sizes are approximate. Frames on artwork are not included as part of purchase or condition. It is the sole responsibility of the bidder to inquire as to the condition of a lot before bidding. Condition reports are available upon request by phone, fax, email or in person. You are advised to make any requests well in advance of the sale. BUYER’S PREMIUM Waddington’s charges a buyer’s premium of 23% on the hammer price up to and including $25,000 cad. Hammer prices in excess of $25,000 cad will be charged a buyer’s premium of 20%. Buyer’s premium and applicable Canadian taxes are added to the hammer price. A charge of 13% HST (Harmonized Sales Tax) is applicable on the hammer price and buyer’s premium except for any items directly shipped from our premises out of Canada. In the case where purchases are shipped out of the province of Ontario, the HST or GST is charged based on the tax status of that province. Conditions of Sale

1. Each lot is subject to a buyer’s premium of 23% on the hammer price up to and including $25,000 CAD as part of the purchase price. Hammer prices in excess of $25,000 will be charged a buyer’s premium of 20%. 2. Unless exempted by law, the buyer is required to pay Federal Good and Services Tax on the total purchase price including the buyer’s premium. 3. The auctioneer reserves the right to withdraw any lot from sale at any time, to divide any lot or to combine any two or more lots at his sole discretion, all without notice. 4. The auctioneer has the right to refuse any bid and to advance the bidding at his absolute discretion. The auctioneer reserves the right not to accept and not to reject any bid. Without limitation, any bid which is not commensurate with the value of the article offered, or which is merely a nominal or fractional advance over the previous bid may not be recognized. 5. Each lot may be subject to an unpublished reserve which may be changed at any time by agreement between the auctioneer and the consignor. The auctioneer may bid, or direct an employee to bid, on behalf of the consignor as agreed between them. In addition, the auctioneer may accept and submit absentee and telephone bids, to be executed by an employee of the auctioneer, pursuant to the instructions of prospective purchasers not in attendance at the sale. 6. The highest bidder accepted by the auctioneer for any lot shall be the buyer and such buyer shall forthwith assume full risk and responsibility for the lot and must comply with such other Conditions of Sale as may be applicable. If any dispute should arise between bidders the auctioneer shall have the absolute discretion to designate the buyer or, at his option, to withdraw any disputed lot from the sale, or to re-offer it at the same or a subsequent sale. The auctioneer’s decision in all cases shall be final.

7. Immediately after the purchase of a lot, the buyer shall pay or undertake to the satisfaction of the auctioneer with respect to payment of the whole or any part of the purchase price requested by the auctioneer, failing which the auctioneer in his sole discretion may cancel the sale, with or without re-offering the item for sale. 8. The buyer shall pay for all lots within 48 hours from the date of the sale, after which a late charge of 2% per month on the total invoice may be incurred or the auctioneer, in his sole discretion, may cancel the sale. The buyer shall not become the owner of the lot until paid for in full. Items must be removed within 10 days from the date of sale, after which storage charges may be incurred. 9. Each lot purchased, unless the sale is cancelled as above, shall be held by the auctioneer at his premises or at a public warehouse at the sole risk of the buyer until fully paid for and taken away. 10. All lots are sold “AS IS”. Any description issued by the auctioneer of an article to be sold is subject to variation to be posted online and/or announced via email prior to the time of sale. While the auctioneer has endeavored not to mislead in the description issued, and the utmost care is taken to ensure the correct cataloguing of each item, such descriptions are purely statements of opinion and are not intended to constitute a representation to the prospective purchasers and no warranty of the correctness of such description is made. Some lots are of an age and/or nature which preclude their being in pristine condition and some catalogue descriptions make reference to damage and/or restoration. The lack of such a reference does not imply that a lot is free from defects nor does any reference to certain defects imply the absence of others. It is the responsibility of prospective purchasers to inspect or have inspected each lot upon which they wish to bid and to bid accordingly.

11. In the event of failure to pay for or remove articles within the aforementioned time limit, the auctioneer, without limitation of the rights of the consignor and the auctioneer against the buyer, may resell any of the articles affected, and in such case the original buyer shall be responsible to the auctioneer and the consignor for: (a) any deficiency in price between the r e-sale amount and the amount to have been paid by the original buyer (b) any reasonable charge by the auctioneer for the storage of such articles until payment and removal by the subsequent buyer and (c) the amount of commission which the auctioneer would have earned had payment been made in full by the original buyer. 13. It is the responsibility of the buyer to make all arrangements for insuring, packing and removing the property purchased and any assistance by the auctioneer or his servants, agents or contractors, in packing or removal shall be rendered as a courtesy and without any liability to them. 14. The auctioneer acts solely as agent for the consignor and makes no representation as to any attribute of, title to, or restriction affecting the articles consigned for sale. Without limitation, the buyer understands that any item bought may be affected by the provisions of the Cultural Property Export Act (Canada). 15. The auctioneer reserves the right to refuse admission to the sale or to refuse to recognize any or all bids from any particular person or persons at any auction.
