hen looking for a new home, a number of factors come into play: How far from work? How close to schools and shopping? What other important amenities are nearby? For your own enjoyment while you live in your home as well as for future resale potential, proximity to transportation, shopping, schools and other amenities is among the key determinants that affect your property’s appeal and ultimately its value. After all, those are the qualities potential buyers look for when searching for a home; the more of them your home has when you go to sell, the more desirable it will be to a greater number of people. Th is equates to demand – multiple offers and a higher price. INFORMATION Whether you’re a fi rst-time homeowner, “buying up” to accommodate a growing family or “right-sizing” as an empty nester, education is critical. And these days, with

When you get ready to start your house hunt, you’ll likely start by compiling a list of “needs” and “wants.” Your needs will include the size of the home, including how many bedrooms and bathrooms your family wants. Your wants, on the other hand, may include more conveniences, such as new upgrades and appliances and extra storage. If you’re part of a growing family, finding a home near a good school is probably also near the top of your needs list. Depending on where you live, it may not always be possible to find something within walking distance. But beyond just proximity, you may be more concerned about the testing results of any schools your kids could potentially go to. So, where can parents find this information? Unfortunately, it can take time to dig around for it online. Every year, the Fraser Institute releases “report cards” for schools all across Canada. Divided by province and then again by elementary and secondary schools, parents can view charts online

and download PDFs that reveal everything, from average exam marks, fail rates and graduation rates, to gender gaps in certain studies and more. Each school then receives an overall rating out of 10 – 10 being the best score a school can get. In most provinces, there are also other organizations that measure student achievement through standardized tests. For example, the Education Quality and Accountability Office (EQAO) in Ontario is responsible for measuring achievement in reading, writing and mathematics in relation to the province’s curriculum requirements. EQAO takes the average scores of these tests (in percentages) and gives each school a grade between zero and 100 – 100 being a perfect score. The task of looking for these scores for every individual school your kids could potentially go to is daunting. According to the RealNet New Home Price Index, highrise prices remained stable, down one per cent to $444,505.

In true New Year’s resolution form, the new home industry started off 2015 with healthy home sales in January, according to the Building Industry and Land Development Association (BILD). Sales of new homes and condominiums in the GTA were just above the 10-year average in the first month of the year. This was consistent for both the highrise and lowrise sectors, which were tracked at 825 and 1,114 sales respectively. While prices in the highrise sector remained relatively unchanged, the ground-related market reached a new recordhigh of $710,628 – an eight-per-cent increase over last January. “This is what happens when demand outpaces supply,” explains BILD president and CEO Bryan Tuckey. “Our

AS JANUARY HOUSING SALES SLIP January was a chilly month in Canada, not just due to the frigid temperatures and wicked weather. The latest figures from the Canadian Real Estate Association (CREA) show national real estate sales slipped last month, down due to the drag in activity in the Prairies. REAL ESTATE SALES SLIP

The number of MLS home sales fell 3.1 per cent in January 2015 compared to December 2014. “As expected, consumer confidence in the Prairies has declined and moved a number of potential homebuyers to the sidelines as a result,” says Beth Crosbie, CREA president. “By contrast, housing market trends in the Maritimes are continuing to improve, which underscores the fact that all real estate is local.” The drop in sales was seen in about 60 per cent of all local housing markets. “Comparing sales activity for January this year to sales one year earlier, there was a fairly even split between the number of markets where sales were up versus the number of markets where sales were down,” says Gregory Klump, CREA’s chief economist. “The decline in national sales largely reflects weakened activity in Calgary and Edmonton. If these two markets are removed from national totals, combined sales activity remained 1.9 per cent above year-ago levels.” NEW LISTINGS, INVENTORY UP

While sales fell, new listings rose 0.7 per cent from December 2014, led by Edmonton and Greater Toronto. By contrast, Greater Vancouver, Calgary and Regina posted the largest monthly declines in new listings. The national sales-to-new-listings ratio was 49.7 per cent in January – the first time it fell below 50 per cent since December 2012 – marking a return to a balanced housing market. Another factor indicating a balanced market was the amount of housing inventory, which reached 6.5 months – the highest reading since April 2013. PRICES CONTINUE TO CLIMB

The actual (not seasonally adjusted) national average price for homes sold in January 2015 was $401,143 – up 3.1 per cent year-over-year. This average, however, is skewed by Greater Vancouver and Greater Toronto, which are among Canada’s most active and expensive housing markets. markets out of the equation, the average price is a relatively more modest $312,280, which represents a year-overyear decline of 0.3 per cent. Two-storey single-family homes continued to post the biggest year-overyear price gains (6.57 per cent), followed by townhomes (five per cent) and one-storey, single-family homes (4.61 per cent). Price growth remained comparatively more modest for apartment units, at 3.11 per cent. Greater Vancouver (5.53 per cent), Greater Toronto (7.47 per cent) and Calgary (7.76 per cent) continued to post the biggest year-over-year increases, though that rate is slowing in Calgary. In other markets from west to east, prices were up on a year-over-year basis in the Fraser Valley, Victoria and Vancouver Island, while remaining stable in Saskatoon, Ottawa and Greater Montreal. By contrast, prices declined on a year-over-year basis in Regina and Greater Moncton.

Out of sight, out of mind? MORE THAN HALF OF CANADIANS HAVE NEVER CHECKED THEIR CREDIT SCORE Many Canadians are unaware how their fi nancial behaviour may be affecting their overall credit standing and the impact that can have on getting approved for a mortgage or a lease to rent an apartment. Th is, according to a new BMO Bank of Montreal report. Conducted by Pollara, the survey was designed to reveal the overall knowledge among Canadians on credit and how it is rated in Canada. Findings include: » More than half of Canadians (56 per cent) say they have never checked their credit score and only 14 per cent check at least once a year » Almost one third (31 per cent) lack knowledge about how to achieve a good credit rating » One fi fth believe that checking their credit score can decrease their score » While Millennials (18 to 34 year olds) are more aware of their credit standing, with 20 per cent checking at least once a year, more than one-third (35 per cent) say they lack knowledge about how to attain a good credit score The study also revealed that more than half (52 per cent) of Canadians do not know what would be considered a good credit score, with one-fi fth (21 per cent) believing it to be below 600. “A good credit score is generally considered in the range of 680 to 720,” says Tony Tintinalli, regional vicepresident, BMO Bank of Montreal. “A poor credit rating results in significant fi nancial limitations – everything from being approved for a loan to renting an apartment. BMO offers the following tips to help Canadians improve or maintain their credit score: Pay bills on time. One of the best ways to improve your credit score is to pay your bills within the grace period. If you have past-due bills now, get current as soon as you can. If possible, set up an automatic bill payment schedule to help you stay on track. In the event you miss a payment, a call to your credit card or mortgage company to work out a plan can help save you unnecessary dings on your credit score. Manage your credit cards; don’t cancel them. A popular myth is that closing old accounts will increase your credit score; this is not necessarily true. Credit bureaus look at a combination of factors, including the total length of your credit history, which means it may be better to keep your credit cards but manage them responsibly. Check your credit report. A credit report is a record of how you’ve paid your debt. It shows how much debt you have and whether you’ve made payments on time. You can order your own credit reports free from the three major credit reporting bureaus (Equifax, Experian and TransUnion) annually and check to see if there are any errors or problems.

I recently purchased a new home from a builder in north Toronto. Occupancy is in November and I expect to complete transaction in March of next year. My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? How much and can I claim the lifetime exemption? Brian, Scarborough

A

Capital gains tax is charged on the profit realized from the sale of non-inventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment. Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to

On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit. Using a marginal tax rate of 40 per cent in the example; ›› Capital gains $40,000 ›› Taxable capital gains (50%) $20,000 ›› Tax rate: 40% ›› Taxes payable: $20,000 x 40% = $8,000 Under certain circumstances the lifetime capital gains exemption can be claimed to reduce or eliminate capital gains. An individual that disposes of qualified farm or fishing property and small business corporation shares may claim an exemption up to $750,000. Your particular transaction does not qualify for this exemption. Some other issues you should ponder and discuss with a lawyer and/or tax professional: ›› GST/HST – how will investment be treated on closing? ›› GST/HST – are rebates available? ›› Land Transfer tax – How will this be managed at closing? ›› Is builder okay with this assignment? ›› Any issues with occupancy? Who takes? ›› Have you considered the cost of occupancy period?

Not all lawyers are created equal. If you needed a heart surgeon, you certainly would not go to see a podiatrist. By the same token, lawyers generally have expertise in one area greater than another. Do not believe that the granting of a law degree instantly bestows knowledge of all laws on the head of a lawyer. The fi rst thing you need to do to find a lawyer is the same thing you ought to be doing to find a home – research! Where do you look? Start with media and look in magazines (editor’s note – you already have your issue of New Home Guide, so you’re off to a good start!), newspapers, listen to radio, watch real estate television. Generally speaking, the lawyers who appear in public, speaking or writing about real estate, are thought to be experts in the area. Go to seminars and listen to the speakers. Generally, if a lawyer is taking the time to participate in a seminar, he/she knows what he/she is talking about and is happy to take on new clients that come out of those seminars. Next, go online and check out the websites of different real estate lawyers. Look to see whether they give good, informative advice; whether they give you pricing; and whether they make you feel comfortable. Call the Law Society of Upper Canada, Lawyer Referral Service. Th is service keeps lists of lawyers and refers requesting members of the public to lawyers who practice in the area requested. Th is just gets you someone in the area. You really need to check them out when referred. Speak to friends who have used a lawyer for the type of service you require and ensure they did the job professionally, courteously and for the price quoted.

Who is making the referral? Is the referral coming from a real estate agent, a mortgage broker or a bank? Th is is not necessarily bad, but you have to be careful. Quite often, lawyers develop relationships with various groups over the years and receive referrals because they do a great job. On the other hand, ensure that your lawyer is independent and will represent your interests even if it puts him/her into an adversarial position with one of those parties. Th is is quite important, so make sure you are comfortable with this issue before you hire someone. Now to bring this back to the original idea, what you need to understand is that there are general law practitioners just like there are family doctors. What this means is that a lawyer may have a wide-ranging practice composed of many areas. The smart lawyer who falls into this category knows that if there is a serious issue that arises outside of their expertise they should bring in a specialist, just like your family doctor would. The bad lawyers try to do it all. The general practitioner can probably handle your real estate deal just fine, but make sure he/she understands any complicated offers and that he/she reviews them carefully, pointing out any problems. Ensure that he/she knows what can be negotiated and what cannot, or you may lose your deal. Remember, your lawyer is a very important part of the process, so take your time and find the right one.

I’ve been buying the same time planner for years, and I believe it’s the single most important part of my timemanagement success. I once tried changing it up and using a digital calendar instead, but I found that I was missing deadlines, confusing appointments and feeling overwhelmed. After a three-month trial, I ditched it and went back to my trusted paper planner. For a calendar system to work, you need to use it consistently. Choose one that suits your learning style and using it will come naturally. Your natural way of taking in information greatly affects which scheduling method will work best for you. Rather than trying to change yourself to adapt to your calendar system, select one that fits your learning and organizing style. If you are a hands-on learner (kinesthetic), choose a planner with a texture that is a pleasure for you to touch. What feels best in your hands: leather, faux crocodile or cloth? The physical act of writing down appointments and tasks will help you remember them. Place a sticky note on the front on your planner and list on it the things you must do that day and cross items off as you complete them. Use stickers to highlight important activities/events. If you don’t require the portability of a planner book, another option is a wall calendar or a whiteboard (with the days of the week across the top and the tasks written underneath). Hang it across the room and wipe off each task as it is completed. The key to getting a good fit is to make your calendar interactive for your hands-on preference. You may also choose to use an electronic calendar to keep track of your commitments, as this will keep your hands busy while giving you greater flexibility and freedom to change plans when you need to. If you learn best by seeing (visual learner) paper agendas and large wall/desk calendars work well for you. Choose a planner that is aesthetically pleasing to you. You will be drawn to fashionable colours, inspiring motivation quotes and beautiful pictures/artwork. Use bright coloured markers to highlight important events/activities on your calendar. Use sticky notes in various colours as reminders of important actions to take. A calendar with space for notes and to-do lists will allow you to see all of your commitments in one place, which will help you remember to check them more often. Alternatively, if you choose to use a computer calendar, you will likely want to print it out and use colour settings (i.e. to

differentiate between work and family commitments). Most importantly for visual learners, keep your calendar in a place where you will get a clear view of it throughout the day. If you learn best by hearing/speaking (auditory learner), it would be beneficial to have your to-do list and schedule both in one place and have it nearby at all times. This will help you remember to stop for an errand while already in that area. If you want to manage your schedule electronically, be sure to set alarms as reminders of important events/ deadlines. You may want to set your computer so it opens and reads your to-do list each time your start it up at the beginning of the day.
