That’s the vision of the home building and land development industry. The industry faces many hurdles in executing great city plans but believes it will take the power of alignment to get Toronto and GTA to the next level. That means aligning all of the stakeholders involved: politicians and senior civil servants at both the municipal and provincial level, the industry, new-home buyers and the public. As you can imagine, the GTA was a different place 40 years ago and today all of our partners must share a common vision of policies, values and outcomes to ensure that our industry can continue to build quality, complete communities for up to 100,000 people and 50,000 jobs that come to this vibrant region every year. Recently, BILD and OHBA submitted two papers to the province on the Development Charges and Land Use

Planning and Appeals consultations that offer up some very worthy solutions to make the development process more efficient. Among our solutions, we believe that there is a lack of fair and consistent application of provincial planning policy through municipal planning documents across Ontario. It’s difficult to set a course for that new vision of building complete communities when many zoning bylaws around the GTA date back to the 1980s and 1990s, with some even from the 1950s. The lands most affected by outdated planning policies are often in downtown areas and transit corridors. Both areas are earmarked in the provincial Growth Plan, Places to Grow, to be the focus of intensification. The problem is that landowners must apply to rezone the land at a costly price in order to build there. The province must do more to encourage municipalities to update zoning bylaws to reflect the intent of Places to Grow by pre-zoning and pre-designating lands, streamlining the process of building approval so that municipalities can create a city that lives up to the goal of the provincial plan’s vision. If municipalities updated their zoning bylaws as they refreshed their Official Plans (OPs), they would reduce unnecessary processing delays, which would save new-home buyers a lot of money and help them achieve their dreams of homeownership. Best of all, this shift in priorities doesn’t have to cost taxpayers a penny. It’s simply a change in using the public resources that are already in place. Legally, Official Plans must be updated every five years and zoning bylaws within three years of an OP update. The province must take on greater responsibility to ensure municipalities are meeting this legislative requirement. This will lead to more certainty, fewer building delays and fewer appeals to the Ontario Municipal Board. We are all in this together and we should all be part of the solution. The industry, the consumer and government partners must work collaboratively for solutions and with integrity. It is time to imagine the city region in 40 years and make that vision happen. That’s alignment. Together with our partners in government, BILD will continue to work toward building safe, quality, complete communities that new-home buyers can afford to purchase. Why do we care so much? Because we live here, too.

Get ready, Torontonians, for months of rhetoric, bickering, banter and hyperbole. Until Oct. 27, the date of the Toronto mayoral election, you will hear and read all about the candidates’ views of tearing down the Gardiner Expressway, subways versus light-rail transit, infrastructure needs and a host of other issues. For homeowners and prospective homebuyers, some of these matters are more important than others: chiefly, proximity to infrastructure. Indeed, access to a variety of amenities and essentials – from transit to health care to schools to shopping to recreation – are critical determining factors for builders and buyers alike, for lifestyle and comfort while residents live there, as well as for resale potential down the road. It’s an important topic we’ve written about before in Fundamentally Speaking and elsewhere in New Home Guide. It’s also a topic home building associations across the country are paying close attention to. In the GTA, for example, development charges imposed by local and regional municipalities typically total many tens of thousands of dollars per home – costs that are passed directly on to new-home buyers – before a shovel even hits the ground. The federal government has provided some hope in this regard, increasing support for infrastructure development. Still, municipalities across Canada continue to lobby Ottawa to make sure they get their share of available funds to address road and transit needs. In Toronto, for example, the TTC is campaigning for the federal government to kick in a large chunk for the city’s transit plan.

Faced with such infrastructure and funding challenges, municipalities typically are also considering other options – including new taxes, road tolls and other fees – to help pay for what’s needed. For homeowners and prospective new-home buyers, then, it is clear that proximity to existing infrastructure and amenities is becoming more important than ever. With continuing immigration, general growth and construction expansion – all happening at a quicker pace than infrastructure improvements – our highways and transit systems will all be tested until everything catches up. Consider, for example, the population of the GTA continues to increase by about 100,000 people per year. Research suggests that by 2031, there could be three million more people living in the area – bringing with them an additional 1.5 million vehicles. You think traffic and transit in Toronto are challenging issues now? Just wait. So, as you listen to the mayoral candidates argue, and while you’re out shopping for your new home, look around to see how far you are from the nearest highway or rapid transit system that affords you a reasonable commute; and how close you are to health care, schools, shopping and recreation. These communities will be at a premium, now and in future.

thousands of dollars of personal financial research dollars have been poured into making the case and giving the final decisive pearl of wisdom to consumers. Here is some wisdom that will work in any set of market conditions, and perhaps most importantly, will help you determine the best choice for your own personal risk tolerance and financial circumstances. Anyone who suggests you should go with either a fixed or variable rate mortgage without knowing your long term goals, the longer term picture of your cash flow and your own individual risk tolerance, is a financial professional you should be very wary of. I have more than seven years of post-secondary education, I have worked directly in the global treasury operations of one of Canada’s big five banks, and I can assure you – anyone who pretends to know what is going to happen with long term interest rates is either delusional or has a grossly exaggerated opinion of themselves. At any given time, Canada’s capital markets represent about three per cent or less of global capital markets and our economy is heavily reliant on exports to our key trading partners. For Canadian mortgage consumers, no matter how closely we watch our own economy, we will always be subject to changes in our capital markets (debt and equity markets) as a result of shocks to the global system and particularly shocks to our key trading partner – the United States of America. What this means to the fixed versus variable decision is this: at any given time, there is a set spread between the difference in the discounted five-year fixed rate (the most popular long-term mortgage product) and the discounted variable rate product. This spread can increase or decrease in response to movements in the overnight lending rate set by the Bank of Canada and the Government of Canada bond market. This difference in rate represents the premium that mortgage consumers have to pay for the peace of mind that a longer term fixed mortgage offers. Conversely, the difference in savings for going variable represents the reward for taking on the extra risk of not locking in your rate and protecting yourself against future potential rate movements. In reality, the only thing a longer term fixed mortgage gives you is a guarantee against your rate and subsequently your payment moving for a longer period. In fact, it is essentially an insurance premium against interest rate risk, and like all insurance premiums, they change and are more or less valuable to different market participants.

The difference between this longer term fixed rate and the variable rates, rise and fall in different market conditions. Traditionally, the difference between short and long-term rates is highest when inflation is high – at some of these points in time, the difference was more than two per cent. When inflation is extraordinarily low, the difference in these two rates has been as low as less than 0.5 per cent. Regardless of the difference in the two rates, the relative cost-benefit analysis really comes down to your own tolerance for risk and how much you ultimately pay (cost) for that piece of mind, or stand to gain (save) from taking the extra risk. Only you can ultimately gauge that decision, but if you want to do the math, it is fairly simple – just multiply the mortgage balance you have or were considering taking between the difference in the fixed versus variable. For example – if you have a $100,000 mortgage and the difference between a competitive fixed rate mortgage and a variable rate mortgage is one per cent, then the additional premium per year for that peace of mind is $1,000 or $100,0000 x (the difference in interest rates). If this cost seems reasonable, you are likely psychologically suited for a longer term fixed mortgage. If it seems expensive, you are more likely a candidate for a variable rate mortgage. One final caveat: there is no amount of financial gain that ever warrants putting yourself under financial duress. When it comes to mortgage or financial decisions, the wise consumer does not take on more risk than they can financially handle. The implication – if you can’t afford an upswing in rates then going variable is not a sound decision in any economy.

Hopefully, you made a profit! The real estate market has been healthy for the past several years and continues to be strong, over the long term. Selling a real estate investment property will generate either a capital gain/loss or a recapture of income/terminal loss. You will have a capital gain when the proceeds of the sale exceed the original cost of the property. A capital gain must be included in your personal tax return (if you own it personally) and is taxed on 50 per cent of the gains at your personal tax rate. A capital loss occurs when the cost is greater than your proceeds. The capital losses should be included on your personal return and applied against capital gains in that year. Any excess losses can be carried back three years, or carried forward indefinitely to reduce capital gains. In calculating the capital gain/loss, determining the adjusted cost of the property is an essential factor. The adjusted cost must include not just the purchase price but also other costs incurred that had to be capitalized. As well, the proceeds of disposition are all the cost, including the selling price and adjustments pertaining to the sale of the investment. In addition to the capital gains/losses, you may have a recapture of income. This occurs when you are taking Capital Cost allowance (depreciation) on the building, in any of the years that it was owned by you. The balance in this account is called the “undepreciated portion.” A recapture of income occurs when the lesser of the proceeds and the cost of the property is higher than the

Undepreciated Capital Cost (UCC). The recapture of income is taxed in its entirety at your personal tax rate. New home design is becoming ever Green » by HUGH HERON When I think back over the 45 years that I’ve been in the new home building industry, I am amazed at how far we’ve come in terms of quality. When you buy a new

home, you benefit from the most advanced building techniques and materials – and nowadays, that includes Green features that lessen wear and tear on the environment and save you on utilities costs. This approach to construction is so universally agreed upon that Ontario Building Code has advanced to require that all new homes reach EnerGuide 80 levels of energy efficiency. As of Jan. 1, 2012, any company applying for a building permit in Ontario has to comply with this standard. Then there are third-party rating systems that builders can adopt such as Energy Star and LEED, and in the case of Heathwood Homes, we have created our own Green Home Energy Program that combines Energy Star features and many other green elements. What does this all mean for the consumer? When shopping for a new home, find out what each builder means by “Green.” Adding energy-efficient features and systems adds to construction costs, which means you will pay more. It may well be worth it to you. Find out first what is included. Ask questions about the green products and techniques and find out whether they have been tested enough. As I often say, avoid seeing Green through rose-coloured glasses.
When shopping for a new home, find out what each builder means by “Green.” The reason I caution about that is based on history. Since we first started to hear about the ecology movement decades ago, some experimental products came onto the market that didn’t work out so well. During the 1970s, there was the trend toward energy-efficiency in Canada became all the rage, and urea-formaldehyde foam insulation (UFFI) was installed in homes, thinking it was a step forward in our approach to helping the environment. In fact, the substance hadn’t been tested enough and was often installed improperly – causing overexposure to the toxic gas formaldehyde. Finally, in 1980, the use of UFFI was banned in Canada. Another example from the 1970s is solar energy, which was introduced before it had been developed enough to actually be an effective heating source. The technology simply wasn’t there in those days. It is advancing quickly today, but is it far enough along that it will make a valid difference to homeowners? The 48 NEW HOME GUIDE GTA | APRIL 5 - 19, 2014
same goes for thermal energy. We can extract heat from the ground, but are our current methods advanced enough to make it worthwhile? How about windmills? There are conflicting opinions on how much and even whether they make a difference. Who’s right? Another way to look at Green aspects when you are shopping for a new home is whether the items the builder is including will be obsolete within a short period of time. Do your homework. Read about these things and ask questions. Think of technology in other areas like computers. So much of what we buy today is passé in a short period of time. On the other hand, like computers and televisions, if you continually wait for the best and most advanced, tried-andtrue technology you’ll never buy anything. As homebuyers become more educated, they want to know about the Green features in houses, whether they are looking at new homes or resale. That’s a good thing. Of course you want a home that is energy efficient, and the new homes of today are the resale homes of tomorrow. Remember that everything comes with the responsibility to do research on your part, especially with one of the largest financial investments you will ever make.

your decor centre appointment As Geranium Homes’ marketing director and a purchaser of a number of new homes in my lifetime, I cannot emphasize enough the importance of the selection of your interior finishes. This appointment is
scheduled by your builder in the early weeks of construction and is held at the decor centre. This might be one centrally located showroom or it may be an area designated within the sales centre. I recently spoke to Wendy Wotton of WJW Design, an experienced decor consultant who meets with Geranium’s new-home buyers at The Neighbourhoods of Cardinal Point in Stouffville and The Verandas in Port Hope to complete their interior finishes. Wotton has been helping owners to personalize their new homes for the past 15 years. “I am fortunate to work with people from all stages of life. First homebuyers who are enthusiastic and excited about the prospect of owning their own place, those moving into larger homes because they need more room for their growing families, as well as retirees seeking well-designed and functional space more suited to a carefree lifestyle,” says Wotton. Her number one piece of advice to purchasers is to visit the decor centre well in advance, to review the samples available. Wotton also recommends coming to the selection appointment with a colour scheme and budget amount in mind; this is particularly helpful when more than one person is involved in decisions. “Study the floor plan of the home you’ve purchased and have an idea of where you are likely to place furniture. This will help us to locate cable and phone rough-ins when we meet,” Wotton says. We all have limited resources so it is advisable to consider what items to put your money towards and what can be postponed for installation at a future date. Wotton suggests that materials such as flooring are areas that should receive consideration. After all, flooring – especially in today’s open concept designs – accounts for a large area of the home. “If you have your heart set on a particular tile or hardwood, chances are it will pull together your entire home and give you a lot of happiness when you move in. Some items are expensive and messy if tackled while you are trying to live in the home,” she notes. Wotton’s clients also appreciate her advice when it comes to making kitchens more functional. “Corner hinged doors, pot and pan drawers and angled corner cabinets are just a few ways to maximize kitchen storage space,” she says.

My advice is to take full advantage of the knowledge a decor centre consultant has to share about materials, decor and trends. Ask them any questions you believe will assist you to make decisions that you’ll be comfortable with for a number of years. “I am so lucky to meet many people and to have the opportunity to help them personalize one of the biggest investments they’ll make,” adds Wotton. Before you go new-home shopping, visit your bank, trust company or other financial institution to see what amount of mortgage you qualify for. Take your significant other, if you have one, because everyone’s income and assets help. Once you know how much you can borrow, secure the best rate you can and lock it in for as long a period as possible. Don’t be afraid to negotiate – the banks want and need your business. Don’t be afraid to shop around for rates and lock-in periods. You should also visit the sales centre armed with your knowledge and check what mortgage rate and term the builder is offering. Take note that the builder may have brought the rate down to make his package more attractive or forced his bank as part of his deal with them to offer special rates. Remember, if your bank’s offered rate and terms are

close, you may be able to negotiate a better deal with the builder. If you do not take the builder mortgage you may be able to get some leverage in your overall negotiations as the builder may save money by not having to pay his bank for the better rate. Question this and make sure you understand all of the financing details. Regardless of where you go to get financing, get your commitment in writing! When we walk into that sales centre, all ready to buy our beautiful new home, perhaps the most important piece of the puzzle we need to have is security in our financial arrangements. A tragedy waiting to happen occurs when you sign an unconditional offer, give your hard-earned, harder-saved deposit to the builder and later find out you do not qualify for the mortgage. In other words, don’t buy the home unless you have a mortgage commitment or a conditional deal. This leads us into the next part of the discussion – what happens if it goes wrong? An Agreement of Purchase and Sale for the purchase of land is a contract, and once it is signed it binds both parties to certain obligations. If either party does not hold up to their end of the arrangement, they can be held liable to the other party for either specific performance or damages. Firstly, if the purchasers default, they will likely lose their deposit. The builder will then have the option of suing to force them to close the deal and pay all legal fees related thereto, or sue them for any damages the builder might suffer before he resells the condo (for items such as interest, changes and price differential) and legal fees. Sometimes, in a booming market, kindhearted builders will release purchasers who have made a mistake or encountered personal tragedies. But don’t count on it! The moral of the story is to make sure you have financing or that the offer is conditional for a few days on both financing and review by a lawyer. It is critical you get the right advice, and only a lawyer can provide legal advice – that is the law. When you select a lawyer, find one who cares about you and a long-term relationship. No bubble to burst
IN CANADA’S HOUSING MARKET Fears of a housing bubble are exaggerated, though Canadian house prices may be headed for a modest decline nationally and in some local markets, according to The Conference Board of Canada’s initial Housing Briefing: Bubble Fears Overblown. “Mortgage costs, not just house prices, are the principal deciding factor for potential homebuyers,” says Robin Wiebe, senior economist, Centre for Municipal Studies. “Mortgage rates are expected to rise this year, but not dramatically, because the Canadian economy remains in a slowgrowth mode. “The housing market may be undergoing a correction in some regions and market segments, but it is more likely to be a soft landing than a bubble bursting.” Fears of a housing bubble hinge on the ratio of house prices to apartment rents and house prices to incomes. The Conference Board’s view is that while these ratios are high, they are also misleading. Better indicators of affordability are the ratio of mortgage payments to rents and mortgage payments to incomes, and neither presents much cause for alarm about a housing bubble.

In addition, Canadian employment continues to increase, albeit modestly, and the national population is growing. In general, housing starts are in line with demographic requirements, and markets do not appear to be overbuilt. Total housing starts in Canadian cities with at least 10,000 residents ended 2013 at just below 170,000 units. Although down from nearly 194,000 starts in 2012, this is in line with Canada’s 25-year average. Furthermore, a low proportion of Canadian mortgages are in arrears. As a result, a market downturn in Canada would not be amplified by a wave of “distressed” home sales, as occurred in the United States in the 2000s. Over the medium-term, a modest market correction, particularly in market segments in Ontario and Quebec as projected rising interest rates potentially crimp affordability, could produce a moderate decline in the national average housing price. Toronto’s resale market is balanced. Sales stabilized in June 2013, and rose on a year-over-year basis during each of the six months leading up to the end of 2013. Price growth remains healthy and a major price correction is hard to envision, given solid employment and population growth. While the condominium market is at some risk, a soft landing appears to be the most likely scenario.

INDUSTRY APPLAUDS PROVINCE FOR PROPOSING NEW BUILDING OPTIONS
Wood is good: six-storey wood buildings coming to Ontario The building industry has long advocated for Ontario to adopt an OBC six storey wood standard similar to what currently exists in British Columbia
The Ontario Home Builders’ Association (OHBA), the Building Industry and Land Development Association (BILD) and the Residential Construction Council of Ontario (RESCON) applaud the provincial government’s proposal to allow for the construction of six-storey wood-frame buildings.
All three associations recognize the leadership of Premier Kathleen Wynne and Municipal Affairs and Housing Minister Linda Jeffrey on this important proposal that provides new building options for the land development and building industry. “Communities across Ontario, from London to North Bay, will all benefit from the housing, rental and office opportunities that this provincial proposal provides,” says Joe Vaccaro, CEO of OHBA. “We look forward to seeing Ontario projects this year.” Currently, the Ontario Building Code limits wood-frame construction to four storeys. The building industry has long advocated for Ontario to adopt an OBC six storey wood standard similar to what currently exists in British Columbia. BC has benefited from over 100 building projects as a result, giving B.C. consumers new housing and rental choices. “The proposed change would result in the construction of safe, affordable midrise buildings that will bring new housing and rental options to our communities and vibrancy to our streets,” says BILD president and CEO Bryan Tuckey. “More importantly, we believe this proposal will help cities and towns achieve their goals of planning for the up to 100,000 people and 50,000 jobs that come to the GTA every year.” In May 2013, the Associations’ strong planning and economic rationales were outlined in the report, Unlocking the Potential for Mid-Rise Buildings: Six Storey 70 NEW HOME GUIDE GTA | APRIL 5 - 19, 2014
Wood Structures, commissioned by BILD and authored by former City of Toronto Chief Planner Paul Bedford. The report showed that these lands are often well-served by existing infrastructure and transit, and midrise buildings can help to meet the demand of the increasing population of the region, offering a variety of sizes and design features for people of all ages. “Permitting six-storey wood structures in Ontario will generate new innovated design options from the building community,” says Richard Lyall, President of RESCON. OHBA, BILD and RESCON look forward to working with all stakeholders, including the Canadian Wood Council and the Ontario Forestry Industries Association, on this safe and affordable building option.

Well, it’s settled. We’re selling the house. My husband and I love our area, but we’re bursting at the seams. If only our house had a little more room – well, maybe two or three more rooms! – we’d never leave. If you’ve decided to make a move, your choice is likely the result of some other major milestone in your life. Maybe you’ve graduated from university and landed your dream job. Maybe you’re getting married and want to plant your roots. Perhaps, like my family, you’ve outgrown your current home. So, here we are: the “For Sale” sign is up and our schedule now revolves around showings – the bane of my existence. Strangers size up our home, sit on our sofa, scrutinize the decor, and snoop through the closets and cabinets. I wonder how many of these “prospective purchasers” are serious buyers versus browsers? And, well, everyone who walks through the front door has got to be the one, right? Boy, this is already taking a toll, and it’s just the beginning! Deciding to move is an emotional experience. The experts will tell you that you have to detach from the process. Think objectively. Leave your feelings at the door. But parting with something as personal as a home is easier said than done.

If you’re considering a DIY sale, how much time can you devote to marketing, showings and closing the deal? That alone is a full-time job, and you probably already have one of those. REAL ESTATE LAW YER Don’t skip this step in the
interest of saving a few bucks – it’s a drop in the bucket, in the grand scheme of things. A home is an investment of hundreds of thousands of dollars, so do your due diligence. HOME INSPECTOR The money pit is a scary reality
many homebuyers jump right into, and one that can be avoided. A home inspector will identify components in your potential home that are missing, broken, unsafe and not up to code. While you may be tempted to forgo this condition of purchase – especially if you find yourself in a multiple offer – do so at your own risk! It can be difficult to think impartially about something as personal as a home, which can complicate things when it comes to pricing, staging and selling it. A professional, objective opinion certainly makes “detaching” a little easier.

MINTO WELCOMES FIRST RESIDENTS AT
Kingmeadow in Oshawa
A powerful moment in the evolution of North Oshawa, the first residents of Minto Kingmeadow recently moved into their new homes. Joined by the
Minto community, the neighbours celebrated together for the first time over a welcoming breakfast. “It’s quite special to witness a new community in the making,” says Amanda Wilson Watkins, vice-president of marketing and sales. “Minto was thrilled to celebrate with the new neighbours of Kingmeadow who will build their lives here in North Oshawa. Congratulations to all of the new residents!” The sales centre was a hub of excitement as Kingmeadow’s youngest residents played and danced while their parents enjoyed the delicious spread and shared stories of their new family home. The story of a family starting and growing in a new home, Justin Sousa knew Kingmeadow would be a great place to raise his family and that he couldn’t beat the price for the incredible space and high standards of quality offered by Minto. On a chilly December evening, he recruited his friend to take a photo of himself and then-girlfriend Kathy Giurukis, standing on the steps of their future home that was under construction at the time. Justin had said that he wanted a shot to send out with that year’s Christmas cards. Right as the shutter clicked, Justin got down on one knee and surprised Kathy by asking her to be his wife. The freshly engaged couple celebrated with Minto, thrilled to move into their finished new home this month. Next year, Justin says he plans to send out another photo taken on the front steps, but this time the couple will be able to show off their beautifully finished, spacious, three bedroom home. “The Kingmeadow community is growing to become quite a warm and welcoming neighbourhood and you could feel that as the first residents celebrated together this week. The homes at Kingmeadow are designed to be a place for families to grow and we look forward to seeing the residents of this community

Calculate the combined monthly before-tax income of you and your spouse. Divide by three. This figure is the monthly payment you can afford to make on your home. Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most firsttime buyers take the 25-year amortization.)
