hopping for a home online is a great way to narrow your search, but there’s nothing like visiting the sites, models and sales offices to get down to the nitty-gritty. Before you venture out, here are some pointers: First, be clear about what you want and expect in a new home and in your builder. Remember, the range of prices in the new-home market generally reflects differences in location, features and home styles. There’s no magic involved. If a builder’s pricing seems out of whack with others in the area, ask for an explanation. Higher prices could mean better quality materials, finishings, features and service. Make sure that
the price you are paying will deliver the quality you want. Second, understand exactly what is included with the home you are buying and what is optional. Ask the sales representative to show you samples, and request a “spec” sheet that clearly lists what is included, as well as any upgrade options. Third, evaluate any promises that have been made during your visit. Is the builder prepared to put them in writing? Hearsay comments should not be included as part of your evaluation process. Sit down with your sales representative, ask questions and discuss your Agreement of Purchase and Sale in detail – then take it to a lawyer before it’s finalized.

o each his own, as the saying goes, and when it comes to choosing what type of new home to purchase, today’s buyers have plenty of options. For some, choices are dictated primarily by budget, location or family circumstances; for others, financial freedom and where they are in life may allow them to select purely by home type. Indeed, the answer to this question varies and depends on many factors. One common mistake buyers – particularly first-timers – make is buying more home than they can handle. Experts agree making yourself house-

For Jason Lester, Canary District is a big feather in his cap. The president of developer Dundee Kilmer loves being at the helm of creating this innovative, complete community, located on 35 acres in the West Don Lands area in downtown Toronto’s southeast. “It’s a privilege,” Lester says. “It’s a complete community with retail, a residence for George Brown students, and the YMCA will be a huge anchor. It’s very dynamic.” Let’s expand on that: Canary District will start off as an athlete’s village to 10,000 competitors from 41 countries participating during the 2015 Pan Am/Parapan American Games. By 2016, about 2,000 people will live in the transformed village in more than 1,300 units, and that will grow to 3,500 people in 2,500 units by 2020. The community’s new housing will be comprised of: Canary Park towers, a condominium with 11 storeys and 15 storeys on a podium, for 437 units; 808 townhome and loft units; 253 units of affordable housing comprising two-storey maisonettes and one- and two-storey apartments; and a 175,000-sq.-ft. satellite campus residence for George Brown College students. But the hub of the community will be the massive new Cooper Koo Family YMCA, an 82,000-sq.-ft. athletic complex with a pool, gym, fitness centre and community facilities. Atop the centre is an 11,000-sq.-ft. Green roof, which provides more outdoor greenspace to the community. Greenspace and parks will play a big role in Canary District: about one-fifth of the area will be greenspace. That includes a linear park on Front St. This park will be “almost like a promenade in Europe. It’s unprecedented in terms of its design,” Lester says. Front St. will be extended into a vibrant promenade: it will be lined with 40,000 sq. ft. of retail space on the ground

floors of its residential buildings, with public art, courtyards, cafes and galleries. While the community will have a touch of culture, the overall theme of Canary District is health. Lester says it was important for the area to distinguish itself from its surrounding neighbourhoods, such as the arts and culture-oriented Distillery Historic District. The area’s theme would draw people to the complete community, a place where they can live, work, shop and play, Lester says. “People that live a very active lifestyle might go to the Y, then eat at a healthy restaurant, we might have a yoga studio or a yoga wear store, or a bike store. We want to be a hub where the sum of the parts is greater than the whole,” he says. “The community will always tie back to its athletic beginnings of the Pan Am Games.” In Canary District’s early stages, “move-down empty-nesters” make up a good portion of the buyers thus far, says Lester. “We just feel that with a lot of our purchasers, in the 416 and 905, people want to live there in their retirement years. There’s also people who live in the Distillery District who have a one-bedroom who want to have a two-bedroom plus den in our community, and they’re some of our buyers as well.” I’m proud to tell you that Dundee Kilmer is yet another BILD member that’s helping transform Toronto into a world-class city. Calling all new-home buyers! If you bought a new home in the past year, this is your chance to tell Tarion all about your homebuying experience. Every fall, Tarion sends customer satisfaction surveys across the province to most new-home buyers. We’re looking for feedback on your builder’s customer service and your experience with Tarion. The survey covers most stages of the new-home buying experience, beginning with the signing of the agreement of purchase and sale, through to construction, the pre-delivery inspection, and finally your builder’s after-sales service. You’ll also be asked about your interactions with Tarion. As a recent new-home buyer, your feedback is essential in improving the new-home buying experience for everyone in Ontario. Over the years, significant enhancements have come to fruition directly based on the feedback we receive from our annual survey. For example, results of our surveys over the past few years have showed us that homeowners who used our online warranty service, MyHome, continue to have a significantly higher level of satisfaction with Tarion than those who didn’t manage their warranty through MyHome. This kind of information helps us focus on what homeowners want, such as updating the features of MyHome to help make managing your warranty a more seamless process. Your opinion also helps us educate builders, letting them know what they are doing right, or where improvements can be made. Over the many years that Tarion has been conducting this survey, we’ve noticed a clear trend in what matters most to homeowners, based on certain attributes that are directly correlated to whether a homeowner will recommend their builder. Some examples include: the builder’s ability to deliver the home as agreed to in the Agreement of Purchase and Sale, overall customer satisfaction before move-in, the builder’s level of accessibility and the builder’s ability to complete repairs and leave the home clean and undamaged. This information helps Tarion work with builders to improve their customer service. Every year, builders that have enough responses to their surveys are provided with detailed individual builder reports comparing their results to the average (without identifying the participants, of course!). We also meet with builders to help analyze their scores and offer advice on improving customer service, host builder clinics

that include information on what matters most to homeowners and deliver customer service training to low performing builders. Survey results are also used to determine finalists and recipients of the Tarion Awards of Excellence. The Awards of Excellence are the only awards in the province that recognize builders solely on the basis of their customer service. And they are judged by the people whose opinions matter most – you. So, if you have taken possession of a new home in the past year, look for the Tarion survey arriving in your mailbox or inbox this month. This is your chance tell us about your home buying experience and influence whether your builder should be recognized for their customer service. And remember – your opinion matters, so share it with us!

Last month marked a significant milestone in the mortgage world: It’s now been four years since the Bank of Canada last adjusted its influential overnight target rate. Yes, four full years. In its latest announcement on Sept. 3, the BoC again held firm at one per cent – where the rate has been since September 2010. And with rates expected to remain at these historical lows until mid-2015 at least, the window of opportunity for those looking for a home remains wide open. If you could lock in at a low rate over 10 years, for example, that gives you the comfort of knowing what your mortgage payments will be over that period, while over that time you can also take advantage of any pre-payment and lump-sum payment options to pay down your mortgage. Another appeal of this scenario is that, as we often point out, experts advise you take a long-term view of your home purchase. For example, there has been some talk recently about cooling prices and softening sales. But even if that were to happen in your market and housing type, ask yourself: in 10 years, is a home you buy today likely to be worth more or less? If you need an answer to this question, just take a look back at prices 10 years ago. Of course, there are no guarantees, but if you’re in the homebuying mode anyway, today’s low rate environment makes a pretty compelling reason to act sooner than later to take advantage of these opportunities. Low rates notwithstanding, the banks, financial firms, brokers and other experts still advise homebuyers to practice smart borrowing. Indeed, a recent study from CIBC shows the number of Canadians taking advantage of low rates to pay down their mortgages sooner declined this year, compared to

2013. Some homeowners, it seems, are being lulled into a false sense of security. When you sit down with a mortgage broker or bank to talk about your mortgage financing options, one of the products they may offer you is a collateral mortgage. Collateral mortgages are a readvanceable mortgage product, meaning it comes with the option to borrow more money as your property value increases, without having to refinance your mortgage. In theory, this should be a fantastic product for mortgage holders. Normally, if you wanted to borrow equity from your home partway through your mortgage term, you’d have to refinance your mortgage – and pay a hefty penalty to do so. As well, whenever you refinance, you have to pay a real estate lawyer to oversee the transaction. Hello, legal fees – and more costs that need to come out of your pocket. Unfortunately, the grass isn’t always greener on the other side, and a collateral mortgage might not always be as great as it sounds. Why? Well, for starters, on paper, having a collateral mortgage can make it look like you have more debt than you actually do. Collateral mortgages are registered with a collateral charge, meaning lenders register the home as being worth slightly more than it is (up to 125 per cent more, in fact). They do this so that when the value of your home does go up you’re able to borrow up to 80 per cent of the increased value – not the original amount it was valued at when you first bought it. The downside to this is the collateral charge could make it look like you have more debt than you really do. If, sometime throughout your mortgage, you wanted to secure secondary financing for other things, a lender would have to review your credit history and would see this larger amount registered under your name. Depending on your financial situation at the time, this may be reason enough for them to decline your application for more financing. The second and final reason collateral mortgages aren’t always as great as they sound is that you can’t transfer them to another lender – not even when your mortgage term is up. See, collateral loan agreements aren’t registered with your land title or registry office. Instead, they’re registered under the Personal Property Security Act (PPSA) of Canada. For that reason, it may contain terms that other lenders don’t

So, if you ever decided you wanted to switch lenders, you would need to hire a real estate lawyer (and pay those legal fees) to get you out of your agreement. Now, I’m still not saying you should just steer clear of these products. If you think you’ll need to borrow equity in the future, and plan to keep your mortgage with the same lender, a collateral mortgage would be a great product for you! But for those who favour flexibility: do all your research, before simply signing on the dotted line.

I recently purchased a new home from a builder in north Toronto. Occupancy is in November and I expect to complete transaction in March of next year. My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? How much and can I claim the lifetime exemption? Brian, Scarborough

Capital gains tax is charged on the profit realized from the sale of non-inventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment. Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to

On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit. Using a marginal tax rate of 40 per cent in the example; ›› Capital gains $40,000 ›› Taxable capital gains (50%) $20,000 ›› Tax rate: 40% ›› Taxes payable: $20,000 x 40% = $8,000 Under certain circumstances the lifetime capital gains exemption can be claimed to reduce or eliminate capital gains. An individual that disposes of qualified farm or fishing property and small business corporation shares may claim an exemption up to $750,000. Your particular transaction does not qualify for this exemption. Some other issues you should ponder and discuss with a lawyer and/or tax professional: ›› GST/HST – how will investment be treated on closing? ›› GST/HST – are rebates available? ›› Land Transfer tax – How will this be managed at closing? ›› Is builder okay with this assignment? ›› Any issues with occupancy? SUCCESS AT AURORA GLEN LEADS LINDVEST to move up launch of Phase 2

n Tuesday Sept. 30, with a group of distinguished guests in attendance including Aurora Mayor Geoffrey Dawe, the ribbon cutting ceremony occurred to launch one of Lindvest’s most innovative projects, Aurora Glen. The following day began the pre-registrant weekend of appointments. A custom developed online software was built specifically for this site to allow for appointments to be booked in the order of pre-registration, and for real estate agents to do the same and book appointments for their clients. The software allowed for buyers to preview the homes individually, starting prices, site plan and the agreement of purchase and sale, all on line. They went on to say that once the contract is signed there is an obligation to perform in good faith. What does this mean to you? Here is a list: JAYSON SCHWARZ

remember is that, generally, if it is not in writing in the Agreement of Purchase and Sale, it is not binding on either side; 02 It does not matter what the agent says or promises - see 1 above; 03 It does not matter what is in the brochure, or the sales material or sales office â&#x20AC;&#x201C; see 01 above; 04 Good faith only starts when the contract is signed, up till then, as long as what you are told or shown is not a fraudulent misrepresentation, it is probably ok; 05 Every Agreement should be reviewed before it is binding, by a lawyer, who knows real estate. 06 Only your lawyer has a legal, moral and ethical requirement to protect and put you first. 07 Every Agreement must be conditional on lawyers review and the condition in writing and keep it that simple. Some agreements have condition clauses that are mumbo jumbo, that do not let you really change anything. Also make sure the time for review is there and sufficient.
Ok, the Agreement is signed, reviewed, amended and ready, now what? The parties must thereafter act in good faith to complete the contract in accordance with the terms of the Agreement. Remember, most people and their sales people are honest, caring individuals who want to deliver a quality product. Just be careful so any bad apples cannot succeed. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. So help me! Get ‘Smashed’ on Oct. 24 THIRD ANNUAL PING PONG CHARITY TOURNEY
What happens when good friends, ping pong enthusiasts and a good cause come together? The third annual Smashed Charity Ping Pong Tourney and Party. Co-chairs Robert Galletta of Blackjet Inc. and Fabrizio Cortellucci of Zancor Homes couldn’t be more thrilled with the early results of this year’s event, which takes place Friday, Oct. 24 at Muzik – one of Toronto’s hottest nightclubs. “The response from friends and business associates has been astonishing. We are truly humbled by the support and excitement from the real estate community and beyond,” says Cortellucci. In its previous two years, Smashed raised $45,000 for charities and this year will surpass the previous two-year total. This year, Smashed will be raising money for Lifeline – a charitable foundation recently launched by Lifetime Developments, whose mission is to provide aid and support for Toronto’s homeless and at-risk communities. “We’re really excited to be working with Smashed, which is helping our foundation raise money and awareness for one of our city’s biggest issues. There are approximately 5,000 homeless people in Toronto and thousands on the wait list for supported housing. Whether you are moving this busy autumn season or maybe a little further down the road, I recommend the following 15-point checklist to help you complete your move in a stress free way:

1. Double-check all closets, drawers and shelves, in addition to the attic and garage to ensure they are empty. 2. Carry important documents, money and jewelry with you. 3. Pack toys, games or special items for the kids to keep them busy during the move. 4. Remember to pack a box of basics that you may need on move-in day (tools, paper products, all-purpose household cleaners). Be sure to have it loaded last so that it will be first off the truck at your new home. 5. Don’t pack paint, bottles of bleach, gas cans or other flammables. It is against federal law for movers to transport flammable and combustible materials. 6. Use strong boxes and containers that can be secured tightly. Purchase special boxes for dishes, wardrobes and other special items. 7. Pack audio-video equipment in their original boxes. Label cables and tighten transit screws. Before removing cables, take pictures of the back of the unit so you can hook everything back up the same way. If removing screws, tape them to the objects they are removed from. 8. Avoid loading more than 50 pounds into one box. 9. Label each box and indicate the following: which room it should go in; whether it is fragile; and if it should be loaded last so it will be unloaded first. 10. Cushion contents with packing materials such as bubble wrap, newspaper or tissue. Save room by using towels and blankets to wrap fragile items. 11. Pack books tightly on end in small boxes. If they are musty smelling, sprinkle talcum powder between the

pages and wrap the books before packing. Leave them stored for a couple of months to eliminate the smell. 12. Have rugs and draperies cleaned before moving and leave them in the wrappings for the move. 13. Pack medicines in a plastic re-sealable zipper storage bag or leak-proof container. 14. Check the weather forecast for your move day, so you can plan ahead for bad weather. 15. Call your moving company the day before your move to get a contact number for the crew in case you need to contact them en route. Give your mover your cell phone number and be sure to fully charge your cell phone the night before your moving day.

You’ve got to be creative in finding new places to store things, because closets and furniture will only get you so far. Take advantage of your condo’s height. GO VERTICAL OR GO HOME When you’ve run out of storage space, lie on the floor and look up. There is a limited amount of horizontal space (countertops, desks, tables and the floor) but vertical space is abundant and often overlooked. Consider putting shelves above door frames or around the perimeter of the room, like a border. Hang things from the ceiling in the kitchen. When purchasing armoires, bookcases or shelving units, choose the tallest you can find and put baskets on top of them. CLEAR UP VALUABLE TABLETOP SPACE We all have a limited amount of counter and tabletop space, but our wall space is often under-utilized. By hanging photos and framing special mementos in shadow boxes on the wall, you’ll free up space on your tabletops and create a less-cluttered, morespacious look.
Running out of kitchen-cabinet space? If your kitchen supplies exceed your cabinet space, consider mounting a metal rail to your wall. Use hooks (usually included with a rail) to hang everything from utensils to hand towels. This attractive storage solution gives you easy access to your items and utilizes previously unused wall space. MAKE THE MOST OF CEILING SPACE Rather than putting up a wallpaper border, install shelves a foot or so below the ceiling around the perimeter of your children’s rooms. On them, display prized belongings and collectables. This gets your treasures out of the closet where they take up valuable space, and allows the kids to enjoy them. ADJUST YOUR STORAGE SYSTEMS A common misconception is that once you have organized your entire home, you’re done. However, organizing is a process, not a destination. As your interests change, so will your organizing systems. Put some time aside to tweak existing systems on a regular basis – especially when you experience a lifestyle change. AVOID SHAMPOO OVERLOAD IN THE BATH For a more streamlined look in your bath or shower, consider attaching wallmounted soap and shampoo dispensers. This will eliminate the sticky mess of shampoos, soaps and lotions crowding the bath or shower, contributing to a more serene, spa-like space. STORE MAGAZINES CREATIVELY When looking for interesting ways to store magazines, think outside the box. As a creative alternative to a magazine stand, consider using a ladder. Propped up against a wall, a ladder is an interesting way to display magazines and make use of otherwise-wasted vertical space.
