Three simple steps to success Consider these pointers before heading out on your search

S

SUSAN LEGGE

hopping for a home online is a great way to narrow your search, but there’s nothing like visiting the sites, models and sales offices to get down to the nitty-gritty. Before you venture out, here are some pointers: First, be clear about what you want and expect in a new home and in your builder. Remember, the range of prices in the new-home market generally reflects differences in location, features and home styles. There’s no magic involved. If a builder’s pricing seems out of whack with others in the area, ask for an explanation. Higher prices could mean better quality materials, finishings, features and service. Make sure that

the price you are paying will deliver the quality you want. Second, understand exactly what is included with the home you are buying and what is optional. Ask the sales representative to show you samples, and request a “spec” sheet that clearly lists what is included, as well as any upgrade options. Third, evaluate any promises that have been made during your visit. Is the builder prepared to put them in writing? Hearsay comments should not be included as part of your evaluation process. Sit down with your sales representative, ask questions and discuss your Agreement of Purchase and Sale in detail – then take it to a lawyer before it’s finalized.

What type of home should you buy? When answering this question, be sure to take all factors into consideration

o each his own, as the saying goes, and when it comes to choosing what type of new home to purchase, today’s buyers have plenty of options. For some, choices are dictated primarily by budget, location or family circumstances; for others, financial freedom and where they are in life may allow them to select purely by home type. Indeed, the answer to this question varies and depends on many factors. One common mistake buyers – particularly first-timers – make is buying more home than they can handle. Experts agree making yourself house-

poor is not a wise decision, and the best news is that with the variety of product available from builders today, you are sure to be able to find a new home that suits your taste and budget. It’s also important to remember that homeowners buy and sell many times over in their lifetime, so if your first or second home isn’t quite your dream home, you can always plan to move up, downsize or adjust however you need to in your homeowning future. And as a number of stories in this issue illustrate, builders offer excellent, award-winning homes to suit just about everyone. Get out there and explore!

For Jason Lester, Canary District is a big feather in his cap. The president of developer Dundee Kilmer loves being at the helm of creating this innovative, complete community, located on 35 acres in the West Don Lands area in downtown Toronto’s southeast. “It’s a privilege,” Lester says. “It’s a complete community with retail, a residence for George Brown students, and the YMCA will be a huge anchor. It’s very dynamic.” Let’s expand on that: Canary District will start off as an athlete’s village to 10,000 competitors from 41 countries participating during the 2015 Pan Am/Parapan American Games. By 2016, about 2,000 people will live in the transformed village in more than 1,300 units, and that will grow to 3,500 people in 2,500 units by 2020. The community’s new housing will be comprised of: Canary Park towers, a condominium with 11 storeys and 15 storeys on a podium, for 437 units; 808 townhome and loft units; 253 units of affordable housing comprising two-storey maisonettes and one- and two-storey apartments; and a 175,000-sq.-ft. satellite campus residence for George Brown College students. But the hub of the community will be the massive new Cooper Koo Family YMCA, an 82,000-sq.-ft. athletic complex with a pool, gym, fitness centre and community facilities. Atop the centre is an 11,000-sq.-ft. Green roof, which provides more outdoor greenspace to the community. Greenspace and parks will play a big role in Canary District: about one-fifth of the area will be greenspace. That includes a linear park on Front St. This park will be “almost like a promenade in Europe. It’s unprecedented in terms of its design,” Lester says. Front St. will be extended into a vibrant promenade: it will be lined with 40,000 sq. ft. of retail space on the ground

The area’s theme would draw people to the complete community, a place where they can live, work, shop and play 14 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

floors of its residential buildings, with public art, courtyards, cafes and galleries. While the community will have a touch of culture, the overall theme of Canary District is health. Lester says it was important for the area to distinguish itself from its surrounding neighbourhoods, such as the arts and culture-oriented Distillery Historic District. The area’s theme would draw people to the complete community, a place where they can live, work, shop and play, Lester says. “People that live a very active lifestyle might go to the Y, then eat at a healthy restaurant, we might have a yoga studio or a yoga wear store, or a bike store. We want to be a hub where the sum of the parts is greater than the whole,” he says. “The community will always tie back to its athletic beginnings of the Pan Am Games.” In Canary District’s early stages, “move-down empty-nesters” make up a good portion of the buyers thus far, says Lester. “We just feel that with a lot of our purchasers, in the 416 and 905, people want to live there in their retirement years. There’s also people who live in the Distillery District who have a one-bedroom who want to have a two-bedroom plus den in our community, and they’re some of our buyers as well.” I’m proud to tell you that Dundee Kilmer is yet another BILD member that’s helping transform Toronto into a world-class city. Let the games begin!

HAVE YOUR SAY:

It’s your chance to rate your new-home builder » by HOWARD BOGACH

HOWARD BOGACH

is President and CEO of Tarion Warranty Corp. His column appears monthly in New Home Guide. For more information about how Tarion helps new-home buyers, visit tarion.com or find us on Facebook at facebook.com/ TarionWarrantyCorp.

Calling all new-home buyers! If you bought a new home in the past year, this is your chance to tell Tarion all about your homebuying experience. Every fall, Tarion sends customer satisfaction surveys across the province to most new-home buyers. We’re looking for feedback on your builder’s customer service and your experience with Tarion. The survey covers most stages of the new-home buying experience, beginning with the signing of the agreement of purchase and sale, through to construction, the pre-delivery inspection, and finally your builder’s after-sales service. You’ll also be asked about your interactions with Tarion. As a recent new-home buyer, your feedback is essential in improving the new-home buying experience for everyone in Ontario. Over the years, significant enhancements have come to fruition directly based on the feedback we receive from our annual survey. For example, results of our surveys over the past few years have showed us that homeowners who used our online warranty service, MyHome, continue to have a significantly higher level of satisfaction with Tarion than those who didn’t manage their warranty through MyHome. This kind of information helps us focus on what homeowners want, such as updating the features of MyHome to help make managing your warranty a more seamless process. Your opinion also helps us educate builders, letting them know what they are doing right, or where improvements can be made. Over the many years that Tarion has been conducting this survey, we’ve noticed a clear trend in what matters most to homeowners, based on certain attributes that are directly correlated to whether a homeowner will recommend their builder. Some examples include: the builder’s ability to deliver the home as agreed to in the Agreement of Purchase and Sale, overall customer satisfaction before move-in, the builder’s level of accessibility and the builder’s ability to complete repairs and leave the home clean and undamaged. This information helps Tarion work with builders to improve their customer service. Every year, builders that have enough responses to their surveys are provided with detailed individual builder reports comparing their results to the average (without identifying the participants, of course!). We also meet with builders to help analyze their scores and offer advice on improving customer service, host builder clinics

that include information on what matters most to homeowners and deliver customer service training to low performing builders. Survey results are also used to determine finalists and recipients of the Tarion Awards of Excellence. The Awards of Excellence are the only awards in the province that recognize builders solely on the basis of their customer service. And they are judged by the people whose opinions matter most – you. So, if you have taken possession of a new home in the past year, look for the Tarion survey arriving in your mailbox or inbox this month. This is your chance tell us about your home buying experience and influence whether your builder should be recognized for their customer service. And remember – your opinion matters, so share it with us!

Window of opportunity

MORTGAGE RATES REMAIN AT HISTORICAL LOWS, SO TAKE ADVANTAGE WHILE YOU CAN – BUT CAREFULLY » by WAYNE KARL

WAYNE KARL

is an award-winning writer and editor with experience in real estate and business. In Fundamentally Speaking, Wayne explores the basics – such as economic fundamentals – you need to examine when buying property. He can be reached at

wayne.karl@wall2wallmedia.com

or follow him on Twitter at Twitter.com/WayneKarl

Last month marked a significant milestone in the mortgage world: It’s now been four years since the Bank of Canada last adjusted its influential overnight target rate. Yes, four full years. In its latest announcement on Sept. 3, the BoC again held firm at one per cent – where the rate has been since September 2010. And with rates expected to remain at these historical lows until mid-2015 at least, the window of opportunity for those looking for a home remains wide open. If you could lock in at a low rate over 10 years, for example, that gives you the comfort of knowing what your mortgage payments will be over that period, while over that time you can also take advantage of any pre-payment and lump-sum payment options to pay down your mortgage. Another appeal of this scenario is that, as we often point out, experts advise you take a long-term view of your home purchase. For example, there has been some talk recently about cooling prices and softening sales. But even if that were to happen in your market and housing type, ask yourself: in 10 years, is a home you buy today likely to be worth more or less? If you need an answer to this question, just take a look back at prices 10 years ago. Of course, there are no guarantees, but if you’re in the homebuying mode anyway, today’s low rate environment makes a pretty compelling reason to act sooner than later to take advantage of these opportunities. Low rates notwithstanding, the banks, financial firms, brokers and other experts still advise homebuyers to practice smart borrowing. Indeed, a recent study from CIBC shows the number of Canadians taking advantage of low rates to pay down their mortgages sooner declined this year, compared to

20 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

2013. Some homeowners, it seems, are being lulled into a false sense of security. Experts stress that even as rates remain low, buyers should explore everything from putting down a larger down payment to taking advantage of pre-payment options to “stress-testing” your mortgage at a higher rate to ensure your finances can accommodate rate fluctuations or other unforeseen circumstances.

Take advantage of today’s low rates while you can, but also spend the time necessary to find a broker or banker you trust and who knows their business, and explore the options that are best for you. One day, perhaps next year, the mortgage landscape will change. And if you’re among those homeowners who have been somewhat spoiled by continuing low rates, you could be could be in for an unpleasant surprise. Take advantage of today’s low rates while you can, but also spend the time necessary to find a broker or banker you trust, who knows their business, and who can help you explore what options might be best for you. More so than in any other area of homebuying, you’re going to rely on this advice – now more than ever. It will prove to be time well spent.

//MORTGAGE ADVICE

Are collateral mortgages good? In theory… » by ALYSSA RICHARD

ALYSSA RICHARD

is the Founder and CEO of RateHub.ca, a mortgage rate comparison site that aims to empower Canadians to make smart financial decisions.

When you sit down with a mortgage broker or bank to talk about your mortgage financing options, one of the products they may offer you is a collateral mortgage. Collateral mortgages are a readvanceable mortgage product, meaning it comes with the option to borrow more money as your property value increases, without having to refinance your mortgage. In theory, this should be a fantastic product for mortgage holders. Normally, if you wanted to borrow equity from your home partway through your mortgage term, you’d have to refinance your mortgage – and pay a hefty penalty to do so. As well, whenever you refinance, you have to pay a real estate lawyer to oversee the transaction. Hello, legal fees – and more costs that need to come out of your pocket. Unfortunately, the grass isn’t always greener on the other side, and a collateral mortgage might not always be as great as it sounds. Why? Well, for starters, on paper, having a collateral mortgage can make it look like you have more debt than you actually do. Collateral mortgages are registered with a collateral charge, meaning lenders register the home as being worth slightly more than it is (up to 125 per cent more, in fact). They do this so that when the value of your home does go up you’re able to borrow up to 80 per cent of the increased value – not the original amount it was valued at when you first bought it. The downside to this is the collateral charge could make it look like you have more debt than you really do. If, sometime throughout your mortgage, you wanted to secure secondary financing for other things, a lender would have to review your credit history and would see this larger amount registered under your name. Depending on your financial situation at the time, this may be reason enough for them to decline your application for more financing. The second and final reason collateral mortgages aren’t always as great as they sound is that you can’t transfer them to another lender – not even when your mortgage term is up. See, collateral loan agreements aren’t registered with your land title or registry office. Instead, they’re registered under the Personal Property Security Act (PPSA) of Canada. For that reason, it may contain terms that other lenders don’t

Unfortunately, the grass isn’t always greener on the other side, and a collateral mortgage might not always be as great as it sounds. agree with. So, if you ever decided you wanted to switch lenders, you would need to hire a real estate lawyer (and pay those legal fees) to get you out of your agreement. Now, I’m still not saying you should just steer clear of these products. If you think you’ll need to borrow equity in the future, and plan to keep your mortgage with the same lender, a collateral mortgage would be a great product for you! But for those who favour flexibility: do all your research, before simply signing on the dotted line.

Geranium’s urban town MODELS NOW OPEN AT UPTOWNES IN STOUFFVILLE Geranium Homes welcomed visitors to browse two new model townhomes that are brimming with design ideas, during the recent grand opening at Uptownes at Cardinal Point in Stouffville. Los Angeles-based interior designer, Jo-Ann Capelaci created two themed approaches for modern living in a stacked townhome, and Geranium capitalized on her experience and is providing visitors with a printed handout. The company has also produced a series of videos with Capelaci that are full of inspiration and useful tips, now available to view on geraniumhomes.com “We designed our marketing strategy to include new and interesting ways to present these three-storey townhomes to prospective buyers, before we were able to build the model homes,” explains Sue Webb Smith, Geranium’s marketing director. “Jo-Ann has worked with us at every stage, creating furnished floorplans for every room in all four of the Uptownes designs. She assisted an artist to produce perspective illustrations that accurately reflect her furnished plans. And, ultimately, Jo-Ann chose interior finishes, furniture and decor for the two model homes.” From the multi-purpose ground level recreation room to the magnificent rooftop terrace, each model demonstrates how these homes are designed for comfortable living. Throughout each model, Capelaci has integrated basic elements along with her choice of interior finishes from Uptownes’ standard package sprinkled with a few upgrade options that provide big impact for a small investment. Buyers may choose from the two designs in the Chicago Series of back-to-back and two layouts in the Gooderham Series of stacked units, 38 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

Low monthly maintenance fees are just $89. Uptownes’ exteriors of brick and stone with loft-style window details result in streetscapes that are modern yet also reflective of an era highlighted by machine and industry. Calculating capital gains tax » by HENRY CHOO CHONG

Q HENRY CHOO CHONG,

CGA, sits on many committees and provides accounting and tax services to individuals and businesses in the GTA. He can be reached at 416.485.5225. Questions to Taxing Issues can be emailed to choochonghcga@yahoo.ca

I recently purchased a new home from a builder in north Toronto. Occupancy is in November and I expect to complete transaction in March of next year. My sale price was $40,000 more than the initial purchase price. I have never lived in the property. Thus far, it has all been handled by my lawyer. Will I have to pay capital gains tax on this? How much and can I claim the lifetime exemption? Brian, Scarborough

A

Capital gains tax is charged on the profit realized from the sale of non-inventory assets. Most common assets are stocks, bonds and real estate. Currently, the income inclusion rate is 50 per cent. The taxable inclusion rate has bounced from inception 50 to 75 per cent, to 66 per cent, to its current rate. Therefore, an individual with capital gains must include in his/her personal tax return, 50 per cent of the capital gain. Yes, this can add up to be a large chunk of change and reduces your actual after tax rate of return on your investment. Where did this tax come from? You say, many countries do not have this! Canadians were first introduced to capital gain tax in 1972. The Canadian government claims this was necessary to

Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. 42 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

finance our social security programs and create a more equitable taxation system. Almost 40 years since and it is still around. Don’t you feel more secure about your social security and equality in our tax system? Some countries such as Belize, Barbados, Cayman Islands, Egypt, and Hong Kong have no capital gains tax. On the other hand, there are many countries with similar taxation to Canada’s such as Bulgaria, Denmark, France, Finland and Iceland. Regardless, if you actually move in or not, you will be subject to capital gains tax on your sale in the year the transaction is completed. Individuals that purchase new or resale homes are treated no differently. Mr. Harper wants his share of the profit. Using a marginal tax rate of 40 per cent in the example; ›› Capital gains $40,000 ›› Taxable capital gains (50%) $20,000 ›› Tax rate: 40% ›› Taxes payable: $20,000 x 40% = $8,000 Under certain circumstances the lifetime capital gains exemption can be claimed to reduce or eliminate capital gains. An individual that disposes of qualified farm or fishing property and small business corporation shares may claim an exemption up to $750,000. Your particular transaction does not qualify for this exemption. Some other issues you should ponder and discuss with a lawyer and/or tax professional: ›› GST/HST – how will investment be treated on closing? ›› GST/HST – are rebates available? ›› Land Transfer tax – How will this be managed at closing? ›› Is builder okay with this assignment? ›› Any issues with occupancy? Who takes? ›› Have you considered the cost of occupancy period?

SUCCESS AT AURORA GLEN LEADS LINDVEST to move up launch of Phase 2

O

n Tuesday Sept. 30, with a group of distinguished guests in attendance including Aurora Mayor Geoffrey Dawe, the ribbon cutting ceremony occurred to launch one of Lindvest’s most innovative projects, Aurora Glen. The following day began the pre-registrant weekend of appointments. A custom developed online software was built specifically for this site to allow for appointments to be booked in the order of pre-registration, and for real estate agents to do the same and book appointments for their clients. The software allowed for buyers to preview the homes individually, starting prices, site plan and the agreement of purchase and sale, all on line. Timeslots for 44 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

appointments were evenly distributed throughout the day to minimize a crowded sales office, and prevent lineups and “camping out” to be first in line. That initial pre-registrant release of Aurora Glen was an overwhelming success, 135 firm home sales in four days. As a result, Lindvest will be moving up the launch of Phase 2. At the pre-registrant launch, Lindvest displayed uniquely defining characteristics of first release of Aurora Glen homes, from the contemporary and traditional style elevations and double-car garages on all lots; to state-of-the-art technological features such as self-learning thermostats and intelligent locks. As they profess, this is future living, now. Architecturally, Lindvest’s elevations offer a mix of brick and stone, traditional brick and spectacular contemporary design. Fresh style details and stone accents combine with brick and glass to create truly stunning exteriors while sleek, modern interiors are complemented by thoughtful layouts with open-concept designs and high quality features and finishes. The main floors provide a sense of openness with nine-ft. smooth ceilings, while the living areas are set off with natural gas fireplaces inset with clean face drywall finish, spotlighting contemporary linear burners and opaque pebble stones. Kitchens

feature gorgeous granite countertops and ceramic backsplashes creating a beautiful space for one of the rooms you use the most. The character of the homes is a unique blend of comfort and style, making them places you want to show off and keep all to yourself, all at the same time. The highlighted features of Aurora Glen focus on innovative living. For instance, each residence comes installed with a smart thermostat that learns how you use your home – when you come and go, when you sleep – and adjusts the climate accordingly. You can even control the settings from your smartphone so you’ll never have to come home to a cold house again. Seeing as though heating and cooling can add up to 50% of your energy bill, this more efficient use of your utilities has the potential to quickly show itself in savings. When it comes to convenience, the exterior doors are fashioned with intelligent locks that don’t require keys but rather are controlled by “keys” on your smartphone. These “keys” can be transferred to family members, guests, even cleaners or dog walkers. You can

easily keep track of who has come and gone and there is no worry about leaving a spare key in the garden. Plus, if you don’t remember locking the door when you left you can easily do it remotely with a touch of your smartphone. Of course the locks can be opened with traditional keys, but why bother with the hassle of digging for them when the door unlocks as you approach? Efficiency and cost savings are two things that are paramount to the development of Aurora Glen. That is why each house will be outfitted with LED lighting throughout. What does that save you? Given LED lights are 80 per cent more efficient than incandescent bulbs it means the energy costs are dramatically lowered. Take into consideration that LED lights last 25,000 operating hours compared to only 2,500 hours from an incandescent bulb and you realize that you won’t have to replace light bulbs for years. In addition, the lights contain no mercury and are UV free which means they are safe on artwork and paint – they also provide full bright light as soon as you turn them on. In terms of location, Aurora Glen couldn’t be better. Secluded from main thoroughfares, it is mere minutes to an abundance of amenities. Five golf courses, 25 km of nature trails and 700 acres of parkland offer access to the outdoors while the nearby SmartCentres Plaza, complete with major retailers, redefines convenience. After 60 years in Canada, it’s not a coincidence – it’s a plan INNOVATION, INGENUITY AND COMMUNITY PROPEL MINTO TO ITS SECOND OHBA BUILDER OF THE YEAR AWARD IN THE LAST THREE YEARS Innovation: This year, Minto’s 180 Kent became the single location with the most Leadership in Energy and Environmental Design (LEED) certifications in Canada. Ingenuity: Minto qualified more than 300 homes under the Energy Star standard. Community: The Minto Foundation donates to more than 200 charities each year, including $1.1 million to University of Waterloo Faculty of Environment. For the second time since 2012, the Ontario Home Builders’ Association recognized Minto as Builder of the Year. This esteemed industry award emphasizes outstanding professionalism and integrity within the business, industry and community, and is the culmination of an incredible run of success for the family-owned business. “It’s rewarding and humbling to be recognized by our peers. This was a record-breaking year for Minto and I’m very proud of our team,” says Daniel Belanger, senior vice-president, GTA. “We want to change the way people think about building communities. We want to deliver products the customer can depend on, that are sustainable, and have great value. An award like this lets us know we are on the right path.” In a year full of noteworthy highrise and lowrise projects, the highlights begin with the unprecedented launch of Minto Longbranch. With more than 350 sales and 8,000 registrants in less than one year, Longbranch is the most successful debut in company history. The numbers are a testament to Minto’s decision to re-introduce affordability along Toronto’s iconic Lakeshore West in the Long Branch neighbourhood. In North Oshawa, Minto Kingmeadow was singled out as the community of the year by the Durham Region Home Builders’ Association, and new releases were ramped up to keep with surging demand. Minto Orchard Park was another notable success, selling 262 homes in less than one year. But success can be measured by more than just sales. Minto775 was the first building to meet the requirements of Toronto Green Standards Tier 2, a voluntary certification that accounts for reducing light pollution and the urban heat island affect that is present in artificial landscapes. And Minto’s 180 Kent was the first building of its size to achieve LEED Platinum certification, while also securing the most LEED certifications of any building in Canada. This reputation for sustainable building is why Minto was selected 50 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

ABOVE: Amanda Wilson Watkins, vice-president of marketing and sales; Lee Koutsaris, development manager; Vicki Schmidt, director of sales; Natascha Pieper, director of marketing; Vince Santino, vice-president of development; Daniel Belanger, senior vice-president, GTA to build five zero-energy homes as part of Natural Resource Canada’s ecoEnergy Innovation Initiative (ecoEII). “It all starts with a simple question. What can we do to design a product that will have mass appeal, but still emphasizes quality, still emphasizes the environment and still puts the purchasers and communities first,” says Amanda Wilson Watkins, vice-president of marketing and sales. Notions of community extend beyond the homes that are built, with a top-down emphasis on community service. Minto employees are encouraged to take paid days off to volunteer and, each can access $500 toward a cause of their choice. Meanwhile, CEO Michael Waters raised $63,000 for cancer research in the “Ride the Rideau” 100-kilometre cycle last year and the company gives to more than 200 charities each year that build community through education, sports and recreation, health care, the arts and the environment. Previously, Minto won the OHBA Green Builder of the Year award in 2008, 2010 and 2011 after continuously delivering environmentally friendly building designs, leading-edge waste management strategies, a strong internal culture and support of the sustainable building industry. In 2012, the criteria for the Green Builder of the Year award were incorporated into the Home Builder of the Year award. “The idea that you can be a builder for 60 years without focusing on helping people is foreign to us,” says Belanger. “It’s what we build. Community drives our company.”

//LEGALLY SPEAKING

The law of good faith (OR THE LACK THEREOF) Âť by JAYSON SCHWARZ The Supreme Court of Canada has said that good faith is not a requirement by either side in the negotiation of a contract. They went on to say that once the contract is signed there is an obligation to perform in good faith. What does this mean to you? Here is a list: JAYSON SCHWARZ

LL.M. is a Toronto real estate lawyer and senior partner in the law firm Schwarz Law LLP. If you have a topic in mind, mail, deliver or fax letters to the magazine or to the firm, email (info@schwarzlaw.ca) and give us your questions, concerns, critiques and quandaries.

01 The most important thing to

remember is that, generally, if it is not in writing in the Agreement of Purchase and Sale, it is not binding on either side; 02 It does not matter what the agent says or promises - see 1 above; 03 It does not matter what is in the brochure, or the sales material or sales office – see 01 above; 04 Good faith only starts when the contract is signed, up till then, as long as what you are told or shown is not a fraudulent misrepresentation, it is probably ok; 05 Every Agreement should be reviewed before it is binding, by a lawyer, who knows real estate. 06 Only your lawyer has a legal, moral and ethical requirement to protect and put you first. 07 Every Agreement must be conditional on lawyers review and the condition in writing and keep it that simple. Some agreements have condition clauses that are mumbo jumbo, that do not let you really change anything. Also make sure the time for review is there and sufficient.

Ok, the Agreement is signed, reviewed, amended and ready, now what? The parties must thereafter act in good faith to complete the contract in accordance with the terms of the Agreement. Remember, most people and their sales people are honest, caring individuals who want to deliver a quality product. Just be careful so any bad apples cannot succeed. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. So help me! Mail, deliver or fax letters to the magazine or to us, use the website (schwarzlaw.ca), (email (info@schwarzlaw.ca) and give us your questions, concerns, critiques and quandaries. I will try to deal with them in print or electronic form.

The most important thing to remember is that if it is not in writing, in the Agreement of Purchase and Sale, it is not binding on either side. 54 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

The pros of buying a builder’s INVENTORY HOMES

B

uying real estate is a big investment – it might even be the biggest investment you’ll ever make. Whether you are buying a new home, a resale home or a condo, it is important that you make sure your biggest investment is a safe one. At New Era Homes, we offer a range of homes that were built before they went on sale with available 30 to 120 day closings. Why is this important, you may ask? Similarly to buying a car, you go to the dealership to pick out the car you like on the lot and even bring it for a test drive just to make sure that whatever vehicle you are buying is the vehicle that

Another big advantage of buying a ready-built house is peace and quiet. 64 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

suits your needs best. Well, the same goes for a builder’s inventory home. Before you buy the home you like, we are giving you the chance to experience it first-hand by: walking in the house, taking a look how it’s built, where the driveway is located, what direction the house is facing and so on. This gives buyers the real life image of the home and the area without having to worry about the fine print of a builder’s brochure where many items can be changed, such as: exterior colours, architectural styles, grades, interior designs and even square footage, which can be altered without your notice. Another big advantage of buying a ready-built house is peace and quiet. Yes, that’s right! Our Phase 3 is now a finished community with landscaping, paved driveways, and even a nice smooth road that welcomes you to your new home. One of my favorite topics, like many new-home buyers, is upgrades. Yes everyone loves upgrades in a new home but may not like the hassle of paying extra for them. Well when you buy one of our inventory homes, our job is to impress you and make you fall in love with the home as soon as you walk in the door. Some of our upgrades that are prebuilt into the house and included in the price are: main floor smooth ceilings, pot lights, upgraded tiles and hardwood, quartz kitchen countertops, kitchen backsplashes, stained oak stairs and more!

A quick closing can be good because we do not require a large deposit, and you can move into your new home without having to worry about your mortgage commitment expiring before you move in.

LOCATION: Newmarket HOUSING TYPE: Single-detached homes SALES CENTRE: Open Monday to Thursday, 1 to 7 p.m., closed Friday, open weekends and holidays 11 a.m. to 6 p.m. CONTACT: 905.953.9046 sales@newerahomes.ca newerahomes.ca

Last, let’s talk about the closings. A quick closing can be good because we do not require a large deposit, and you can move into your new home without having to worry about your mortgage commitment expiring before you move in. We are asking for only a $25,000 deposit, while most builders ask for $40,000 or more for singles. And just to make the process even easier, there are no hidden closing costs either, as these costs can really be an unsightly burden at the end. What makes a home great? An incredible location, a great design and price, a firm closing date and an easy down payment. Now that’s a home worth buying! Get ‘Smashed’ on Oct. 24 THIRD ANNUAL PING PONG CHARITY TOURNEY

What happens when good friends, ping pong enthusiasts and a good cause come together? The third annual Smashed Charity Ping Pong Tourney and Party. Co-chairs Robert Galletta of Blackjet Inc. and Fabrizio Cortellucci of Zancor Homes couldn’t be more thrilled with the early results of this year’s event, which takes place Friday, Oct. 24 at Muzik – one of Toronto’s hottest nightclubs. “The response from friends and business associates has been astonishing. We are truly humbled by the support and excitement from the real estate community and beyond,” says Cortellucci. In its previous two years, Smashed raised $45,000 for charities and this year will surpass the previous two-year total. This year, Smashed will be raising money for Lifeline – a charitable foundation recently launched by Lifetime Developments, whose mission is to provide aid and support for Toronto’s homeless and at-risk communities. “We’re really excited to be working with Smashed, which is helping our foundation raise money and awareness for one of our city’s biggest issues. There are approximately 5,000 homeless people in Toronto and thousands on the wait list for supported housing. As a professional in the new home building industry, this cause is near and dear to my heart,” says Brian Brown, vice-president of Lifetime. 68 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

Guests can purchase a Party-On ticket for $150, join the light-hearted Mixed-Doubles Tournament for $175, or if you’re feeling courageous, participate in the Elite Singles Tournament for $250. Admission includes a deluxe open bar, appetizers, a live auction featuring BMWs courtesy of Endras Automotive Group, and music from DJ MKutz. Corporate sponsors can enjoy VIP booths with bottle service (although booths are just about sold out). “We wanted to throw an event that didn’t feel like a stuffy, corporate fundraiser. Life’s too short not to have a little fun with good people for a great cause,” says Galletta. “Whether you like ping pong or not, if you enjoy good music, good food and good company then you’ll definitely like Smashed.” Participation honours every person who has been affected by homelessness, and helps those who may be affected in the future. Be sure to get your tickets early. Doors open at 7 p.m. with tournament play beginning at 7:30 p.m. Visit smashedpingpong.com

//MAKE YOUR MOVE

THE 15-POINT

moving day checklist » by CHUCK RESNICK

Whether you are moving this busy autumn season or maybe a little further down the road, I recommend the following 15-point checklist to help you complete your move in a stress free way:

CHUCK RESNICK

is vice-president, marketing and operations at Two Men and a Truck – Canada

1. Double-check all closets, drawers and shelves, in addition to the attic and garage to ensure they are empty. 2. Carry important documents, money and jewelry with you. 3. Pack toys, games or special items for the kids to keep them busy during the move. 4. Remember to pack a box of basics that you may need on move-in day (tools, paper products, all-purpose household cleaners). Be sure to have it loaded last so that it will be first off the truck at your new home. 5. Don’t pack paint, bottles of bleach, gas cans or other flammables. It is against federal law for movers to transport flammable and combustible materials. 6. Use strong boxes and containers that can be secured tightly. Purchase special boxes for dishes, wardrobes and other special items. 7. Pack audio-video equipment in their original boxes. Label cables and tighten transit screws. Before removing cables, take pictures of the back of the unit so you can hook everything back up the same way. If removing screws, tape them to the objects they are removed from. 8. Avoid loading more than 50 pounds into one box. 9. Label each box and indicate the following: which room it should go in; whether it is fragile; and if it should be loaded last so it will be unloaded first. 10. Cushion contents with packing materials such as bubble wrap, newspaper or tissue. Save room by using towels and blankets to wrap fragile items. 11. Pack books tightly on end in small boxes. If they are musty smelling, sprinkle talcum powder between the

74 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

pages and wrap the books before packing. Leave them stored for a couple of months to eliminate the smell. 12. Have rugs and draperies cleaned before moving and leave them in the wrappings for the move. 13. Pack medicines in a plastic re-sealable zipper storage bag or leak-proof container. 14. Check the weather forecast for your move day, so you can plan ahead for bad weather. 15. Call your moving company the day before your move to get a contact number for the crew in case you need to contact them en route. Give your mover your cell phone number and be sure to fully charge your cell phone the night before your moving day.

Treetops nets two honours AT 2014 OHBA AWARDS OF DISTINCTION As announced recently at the Ontario Home Builders’ Association (OHBA) Awards of Distinction in Ottawa, Treetops has taken top honours with two OHBA awards – Best Project Logo and the People’s Choice Prestige Award. This is the first time ever that the OHBA has introduced the People’s Choice Award with the finalists being chosen from the six best projects of the year in both the high to mid-rise and the low-rise categories. “We are truly honoured to be the recipients of two OHBA Awards this year,” says Dino Biffis, vice-president at Cable Bridge Enterprises Ltd. “We’re so proud of the entire Treetops team and the recognition at this year’s awards are a testament to the commitment, hard work and dedication that we collectively put into our unique community. On behalf of Treetops, Brookfield Residential and Orchard Ridge Homes, I would like to sincerely thank everyone who voted Treetops the best in Ontario as well as take this opportunity to congratulate all the OHBA finalists and winners.” Developed by Cable Bridge Enterprises (Nottawasaga Resort and Briar Hill homes), Treetops is a master-planned community of more than 1,800 homes that features an eclectic selection of home designs that are offered by two premier builders — Brookfield Residential and Orchard Ridge Homes. Located in New Tecumseth, you can truly “live beyond your backyard” in this amenity rich neighbourhood, which features 45 acres of preservation area that offers more than seven kilometres of trails, an off-leash dog park and outdoor fitness stations. The Treetops Park, which is now being constructed, offers seven acres of activities and diversions for every fitness and energy level and will feature an amphitheatre, splash pad, play structures, beach 76 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

volleyball courts, basketball courts gazebo, picnic areas and a promenade running throughout the park. Treetops is also next door to the world-class facilities of the Nottawasaga Resort, giving homeowners easy access to 45 holes of golf, a 70,000-sq.-ft. fitness centre, a 25-metre swimming pool and 100-ft. waterslide, two NHL-sized ice pads, restaurants and nature trails. With single-detached homes from the $340,000s, these beautifully finished homes, which are set on 32-, 36-, 40- 45and 49-ft. home sites and available in sizes from 1,471 to 2,960 sq. ft., give homebuyers exceptional value. » by ELISA KROVBLIT

Geometry, shape and lines are huge this season! We’ve moved past gentle curves and simple lines toward strong geometric shapes and big, repetitive patterns. Just add accent pieces that complement your foundation decor to get the look without the commitment. Or go big with feature pieces that dominate, and enjoy the strong, sassy style these prominent and playful patterns create. TIP: Patterns can be combined. While you don’t want to create an optical illusion, you can use patterns within a colour theme to play off of each other. Just be sure to include some solids in the overall melange. 90 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

Sooner or later, it’s your choice AT THE VERANDAS IN PORT HOPE

W

hether you are looking for a newly built bungalow to move into this year, or have a time horizon during 2015, Geranium Homes has many options available at The Verandas in Port Hope. What you’ll also discover by locating 30 to 50 minutes drive east is how much more affordable these popular bungalows are when compared to the price of a similar home in neighbourhoods in Toronto, Whitby and Oshawa. “In addition to the value, it is also clear to us that Port Hope’s wide variety of outdoor pursuits, culture, dining and conveniences, offer a highly desirable lifestyle,” says Sue Webb

92 NEW HOME GUIDE GTA | OCT 18 - NOV 1, 2014

Smith, Geranium’s marketing director. Port Hope Golf Club and Yacht Club along with more than 200 acres of parkland including trails, ball diamonds, gardens, naturalized areas and playgrounds, are all nearby. The Ganaraska River offers some of the best fishing in the province and the Waterfront Trail is just one of numerous hiking, walking and cycling trails in Northumberland County. Residents of The Verandas can walk to shopping and it’s just a 10-minute drive to Northumberland Hills Hospital in neighbouring Cobourg. The Verandas homes feature welcoming exteriors with sizeable covered front porches, double car garages and heritage-influenced low-maintenance materials. Set on 42- and 48-ft. lots, 10 different bungalow floorplans of two- and threebedrooms are available; many also have optional plans that include finished basement areas. A handful of homes in Phase 1 are nearing completion and loaded with upgrades, offering move-in dates in fall 2014 with prices starting from $313,900. Within Phase 2, there’s a wide choice of standard lots available with closing dates in spring or fall 2015. Or choose a premium over-sized, pie-shape and park view property. Designs range from 1,118 to 2,397 sq. ft., and prices start from

//QUICK TIPS

Use the wall to store it all » by HELLEN BUTTIGIEG Clearing clutter and putting everything away can be a challenge when you don’t have enough storage space. You’ve got to be creative in finding new places to store things, because closets and furniture will only get you so far. Take advantage of your condo’s height. Use the wall to store it all, and make a statement with decorative shelving and storage possibilities.

HELLEN BUTTIGIEG

Hellen Buttigieg, CPO, is a Certified Professional Organizer, life coach, TV host and owner of We Organize U. Visit her website, weorganizeu.com, for a free e-Book on how to find more time, energy and inner peace. Contact Hellen at info@weorganizeu.com

GO VERTICAL OR GO HOME When you’ve run out of storage space, lie on the floor and look up. There is a limited amount of horizontal space (countertops, desks, tables and the floor) but vertical space is abundant and often overlooked. Consider putting shelves above door frames or around the perimeter of the room, like a border. Hang things from the ceiling in the kitchen. When purchasing armoires, bookcases or shelving units, choose the tallest you can find and put baskets on top of them. CLEAR UP VALUABLE TABLETOP SPACE We all have a limited amount of counter and tabletop space, but our wall space is often under-utilized. By hanging photos and framing special mementos in shadow boxes on the wall, you’ll free up space on your tabletops and create a less-cluttered, morespacious look.

Running out of kitchen-cabinet space? If your kitchen supplies exceed your cabinet space, consider mounting a metal rail to your wall. Use hooks (usually included with a rail) to hang everything from utensils to hand towels. This attractive storage solution gives you easy access to your items and utilizes previously unused wall space. MAKE THE MOST OF CEILING SPACE Rather than putting up a wallpaper border, install shelves a foot or so below the ceiling around the perimeter of your children’s rooms. On them, display prized belongings and collectables. This gets your treasures out of the closet where they take up valuable space, and allows the kids to enjoy them. ADJUST YOUR STORAGE SYSTEMS A common misconception is that once you have organized your entire home, you’re done. However, organizing is a process, not a destination. As your interests change, so will your organizing systems. Put some time aside to tweak existing systems on a regular basis – especially when you experience a lifestyle change. AVOID SHAMPOO OVERLOAD IN THE BATH For a more streamlined look in your bath or shower, consider attaching wallmounted soap and shampoo dispensers. This will eliminate the sticky mess of shampoos, soaps and lotions crowding the bath or shower, contributing to a more serene, spa-like space. STORE MAGAZINES CREATIVELY When looking for interesting ways to store magazines, think outside the box. As a creative alternative to a magazine stand, consider using a ladder. Propped up against a wall, a ladder is an interesting way to display magazines and make use of otherwise-wasted vertical space.

Canadian mortgage payment factors Instructions:

01 02 03 04

Determine the appropriate 5-Year Fixed Mortgage Rate, which is easiest to qualify for. Run your finger down the left column of the table below to find the rate (round to the nearest 1/4%).

Choose your desired amortization period across the top of the table (25 years has lowest payment and is easiest to qualify for first-time buyers). At the intersection of the column and row is your mortgage payment per month per $100,000 borrowed.

» Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice and get pre-qualified.
