Care Free Doesn’t Just Happen

Discover the difference financial planning can make.

We live in a highly interconnected world, and things don’t always go the way we want them to. Today’s column therefore is about preparedness for extraordinary occurrences. Consider these events: • In May of this year, hackers disrupted fuel supplies for several weeks with the Colonial Pipeline ransomware attack. This had an enormous impact on anyone on the east coast who relied on a motor vehicle for transportation. • During the pandemic, global supply chains were disturbed, resulting in shortages of some items. The turmoil for some products is expected to continue for another year or so. • Last February, the Texas electrical grid shut down, affecting 5 million Americans for as long as 3 days. • In 2003, the Northeast Blackout, while shorter, affected 45 million Americans and 10 million Canadians. Is it conceivable that the electrical grid could go down over a wide region for multiple weeks? Yes it is. Disaster planners call this a “black sky” event, because when the power goes off the sky turns black over even the most populous city. There are many scenarios in which this could happen – extreme weather events, hackers or other bad actors, even a solar storm, such as the Carrington Event in 1859, in which a solar flare dumped an enormous amount of energy into the earth’s atmosphere. That incident burned up the much of the world’s telegraph system, which at that time was our only electrical infrastructure. Where would we be without power? Realistically, we’d be in a tough spot. • Municipal wells that depend on electrical water pumps would go dry. • Credit card processing would stop, causing a massive disruption in our increasingly cash-less society. • There would be panic buying in most retail establishments, especially gas stations and grocery stores. • The Internet would go down, with

cascading effects in every single area of our lives. One response to this possibility is to adopt a survivalist lifestyle and attempt to live self-sufficiently off the grid. For most of us that’s not a realistic option. But there are smaller steps that we can take to reduce the impact of a black sky event and give us a greater sense of security, so that we don’t have to get swept up in the panic. 1. Buy extra bottled water, one gallon per person per day for 14 days. 2. Stock up on non-perishable food, such as jarred and canned goods and shelf-stable dry goods like pasta and rice. 3. Add a few space blankets to your kit. They are inexpensive, extremely compact, usually weighing no more than a few ounces, and 90% to 95% efficient for retaining body heat. 4. Think through how you will meet your treatment needs for ongoing medical conditions without power. 5. Lay in a supply of flashlights and batteries. Include some candles and matches in case the batteries go dead. 6. Have toilet paper and plastic garbage bags on hand. We all saw what happened to toilet paper supplies during the pandemic – they vanished. As for the garbage bags – well, the waste has got to go somewhere. 7. Have a reasonable amount of cash on hand. It may be the only way to pay for things if credit cards and ATMs don’t work. 8. And buy an emergency radio that does not depend on the Internet. What is the likelihood you will need these items? Hopefully it’s not high, but no one can say for sure, so it is best to be prepared. And one final preparation: Let your Congress-person know that you think they should consider pro-active measures that will reduce the risk of a black sky event.

similar goals so it made sense to join forces. But Tom Kilian, on the city’s committee, said he was voted into office to represent city residents, not county ones, and felt he was best serving his residents if he stuck to city matters. Pretty much everyone agreed that, if not combining the two committees, it might make sense for the committees to share a liaison or even have occasional joint meetings to help communicate and collaborate. No decision was made Thursday. The bodies will meet jointly again, perhaps in a couple of months, Xiong told City Pages following the meeting.

Dozens of goats are hard at work eating away invasive species at Barker-Stewart Island, under a new program by the Parks Department. Mayor Katie Rosenberg advocated for the goat program after seeing it be successful in other cities. Rosenberg worked with the parks department, which researched the idea and found the goats to eat invasives. The goats rolled in last week, and are surrounded by an electric fence that keeps the goats within the confines of the park. On a Thursday afternoon, dozens came to watch the goats eat. The animals ranged from full-grown adults to young goats foraging on the invasive species. Goats are effective at removing invasive species because they go right for the nonnative plants, without ruining the local vegetation. A local design company even started a goat T-shirt, With GOAT (playing on the acronym Greatest of all Time) and Wausau, WI underneath. Residents may view the goats at work, but are advised not to interact with the goats or cross the electric fence.

It seemed like a sensible idea — take the county’s Diversity Affairs Commission and join forces with the city’s Freedom and Liberation Committee — and combine them together. They had, after all, once been a joint committee. That didn’t go over too well as members of the city and county’s respective groups largely rejected the idea Thursday at a meeting in the Marathon County Courthouse. The county’s Diversity Affairs Commission entered the national spotlight when its resolution A Community for All was rejected by the county’s Executive Committee. A subsequent article by the New York Times, which covered the meeting, drew national criticism of Wausau and upset people from both political leanings at the portrayal. Part of the idea of joining the two committees, Diversity Affairs Commission Chair Yee Leng Xiong says, came from the past. Diversity affairs used to be one shared committee, and also shared a part-time minority affairs director between the city and county. The committee was formed in response to the Wausau 2000 study which highlighted new waves of Hmong migration to the Wausau area. At some point the two committees split and the director position was eliminated — likely during the Great Recession when many municipalities were slashing budgets, says Wausau Mayor Katie Rosenberg. LaTanya Campbell, who serves on both the city and county bodies, says she didn’t see the need for the county and city committees to be separate. They both shared


Ruling on mobile home park in Schofield expected next month

A ruling on a suit brought by the city of Schofield against the owner of the city’s mobile home park is expected next month. A court is expected to rule Aug. 2 whether Sustainable Resources operated illegally without a license, and didn’t pay taxes for 2018 and 2019, according to the 2020 suit. That same judge will also rule on a countersuit brought by Sustainable Resources against the city, saying they didn’t charge rent for several months during the COVID-19 pandemic and that the company lost its property manager without any warning. All told, according to the suit, Sustainable Resources owes nearly $100,000 in taxes to the city and county. Sustainable Resources bought the property in 2018 and promised to fix it up to health department and city standards. The park had come before the city council in Schofield many times with numerous health and building inspection violations and previous owners were inadequate in addressing those issues.

Planning underway for street revamp around mall

If a new plan for Washington Street, along with Jackson, Second and Third Streets, is ultimately approved, downtown will look dramatically different in the next couple of years. The city’s Capital Improvements, Streets and Maintenance Committee looked at the first renderings of what those streets could look like post-mall. The committee decided to wait until August to get more detailed renderings of the streets. The city is working with Toole Design, which came up with the street concepts during mall planning phases a couple of years ago. The initial proposals have wider than usual streets — Washington’s was proposed to 74 feet, whereas the current streets are only 30 some (including street, sidewalk and boulevard areas). The initial proposal calls for curbless flat streets, extra wise sidewalks and boulevards that could be used for purposes such as outdoor dining, and two-sided parking on Washington. Jackson, Second and Third would only have parking on one side of the street. None of the streets would have bicycle lanes, because those streets already feature slow-moving traffic, explained City Engineer Allen Wesolowski. The committee will decide in August on whether the amount of street right of way is appropriate. Part of the modified mall development agreement calls for Wausau Opportunity Zone to give away some of the development area for street right of way. There’s still plenty of time right now, says project manager Chuck Ghidorzi, but as demolition continues on the mall, eventually the exact amount of development space will need to be known so that developers can start pitching proposals for the land.

Environmental cleanup of a city owned site previously marketed to developers could be cleaned up sometime in 2022, city staff say. Public Works Director Eric Lindman says the results of a series of tests at the site is being reviewed by the Department of Natural Resources right now. They have up to 60 days to review the tests, and then a plan can be put together for cleanup. That work would need to be bid out, and it would likely be winter by the time that happens, putting cleanup into 2022. The site, 1300 Cleveland Avenue, had a history of industrial use and most recently was the city’s business incubator. The city had marketed it to developers and received several responses before city leaders put the brakes on the process after discovering a history of potential contamination. Testing revealed several toxic chemicals found on the site. A second phase of testing would cost around $98,500, Lindman later told the city’s finance committee.

Budget signed

Evers signs GOP budget, including big tax cut, while directing $100M fed money to schools GOP lawmakers bristled as Gov. Tony Evers took credit for signing a $2 billion income tax cut. Sen. Alberta Darling, R-River Hills, accused Evers of “trying to re-write history.” Meanwhile, Senate Majority Leader Devin LeMahieu, R-Oostburg, charged Evers “got boxed into a corner and rather than fight for his unpopular budget and risk a political knockout, he and his team threw in the towel and signed our responsible budget.” The budget Evers sent to the Legislature included a net tax increase of $1 billion. That February proposal was released before President Biden signed the American Rescue Plan Act that pumped billions into Wisconsin’s economy and before a big projected surplus. The Legislative Fiscal Bureau cited the federal act and the improving outlook on COVID-19 for revised revenue estimates in June that project the state will take in $4.4 billion more through mid-2023 than had been expected just five months earlier. Republicans used that influx of cash to cover the income

tax cut. But Evers said during a ceremony at a July 8 Whitefish Bay elementary school that he could take credit for the cut because he signed the document. “I signed the budget, simple as that,” he said. “I could have vetoed that. I made a promise to the taxpayers of the state that we would reduce middle-class taxes by 10 percent. We did 15 percent, so it is a bipartisan effort.” Joint Finance Committee Co-chair Mark Born, RBeaver Dam, called it laughable and hypocritical for Evers to take credit for the tax cuts. While the $4.4 billion in additional revenue paved the way for the GOP tax cut plan, Born pointed out the state was already looking at a surplus when Evers put together his budget and still chose a net tax increase.

Regents start UW System prez search

The UW System Board of Regents announced that Regent Vice President Karen Walsh will lead a committee to find a new UW System president. The 19-person search group, appointed by Regent President Edmund Manydeeds III, consists of representatives from 11 out of 13 UW System universities. The group includes five regents, two former regents, three professors, three chancellors, two provosts, three staff and one university foundation officer. “It’s a very diverse group in terms of areas of expertise. We have people of color on the committee,” Walsh said. “That was done by design.” The two students on the committee have both served on the Board of Regents and one is currently on the board. Walsh said students, faculty and staff can offer suggestions at listening sessions to be held at each UW System campus starting in September.

A federal list meant to identify underperforming nursing homes named one Wausau nursing home — one of only two in the state — on its list of under performing homes but has now graduated from the list. The Bay at Colonial Manor Health and Rehabilitation Center in the city was just removed from the list developed to solve the regulatory problem of underperforming nursing homes from late 2019 to the beginning of this month. The list on the Centers for Medicare and Medicaid Services website may not have it removed as of this story being filed, but a letter from state officials confirmed it has graduated and was previously on the list from late 2008 to early 2010 before New York-based Champion Care bought The Bay in 2017. Before the ongoing COVID-19 pandemic led to increased focus on this field, state and federal regulators were the ones most familiar with facilities with regular problems surrounding care. For years such places have been put onto the national Special Focus Facility (SFF) list. This CMS program highlights about 90 homes – nine in Wisconsin are presently candidates for future inclusion – inspects them more often and can cut Medicare and Medicaid funding if services offered to residents do not improve. The road to less stringent oversight was not easy to travel. Community residents who declined to speak on record said the facility already had a negative reputation before Champion Care came in, two consecutive surveys with no deficiencies of a serious nature found were needed for removal, the virus slowed regular inspection times and incidents on-site which the company sees as isolated led to demerits. Public records show officials visited Wausau in August 2019 and found staff at the site did not thoroughly investigate an allegation of theft. The report found on the Care Compare section of Medicare’s website describes an individual stealing a debit card from a client’s room and withdrawing $200 at a local Kwik Trip. The administrator at the time told officials she may have “dreamed” about telling staff to secure the area but twice had no examples of actions taken to keep people safe.

“At the end of the [administrator] interview, surveyors again asked for evidence of what was done to protect residents from further abuse,” the document on the case reads. “The [administrator] again stated there was no additional information.” In October 2020 a further trip to the manor by inspectors found facility staff did not consult with a physician or resident representative when a resident had a significant change of health. As of January, The Bay at Colonial Manor Health and Rehabilitation Center has received six citations — roughly close to the 6.6 statewide average. It is also below the national average of 8.2 citations and near 2019’s in Marathon County of 4.6. Champion Care also confirmed individuals involved with problems no longer work with the company and administration said they will maintain gains. “Protecting the health and safety of the residents and staff is our top priority,” Corina Krueger, licensed nursing home administrator for the manor said. “We are proud of the hard work the entire team did to facilitate [graduating] from being an SFF and have been working with our medical director to advance the facility’s Quality Advancement Performance Improvement plan as well as continuing to demonstrate effective care outcomes in key indicators such as wound care.” What will come for the industry however, remains to be seen. There have been and are many proposals to raise standards and prevent further issues like those which have happened at the manor and others from occurring again. The AARP has commented on the need for more funding – profits can be thin and the federal government only reimburses about 70 to 80 percent of costs of about $15 billion per year, others have advocated for more staff and greater standards and for many, the SFF list itself from CMS is in need of an overhaul. Programs like Last Week Tonight with John Oliver on HBO have noted it is as big as it is due to a lack of resources needed to investigate more than 400 other viable sites. first college class in 1954 in Madison. It sits on a shelf in her nursing home in Port Edwards, adjacent to Wisconsin Rapids. What did she do in the meantime? Urban taught piano and organ for decades, played piano and organ for church, was the go-to person for weddings and funerals. She met Louis Armstrong at a bar in Milwaukee while still in Madison, sharing a drink with the legend of jazz history after traveling to a bar upon hearing a rumor he’d be there. “He was a very nice man,” Urban told City Pages. She taught thousands of students, her children estimate, in the 50+ years she spent teaching piano and organ. So what about school? Urban attended UW-Madison right out of high school. Her piano instructor at the time wasn’t wild about the idea. He wanted her to attend a private school instead. But Urban went anyway. The physical education requirements always rankled Urban, and she stopped showing up to a bowling class that would have fulfilled her physical education requirement. She left Madison and returned to the Wisconsin

Rapids area, and was married in 1960. She returned to UW-Stevens Point in the 1970s as an adult student, and attended part-time, spending as much time in the Fine Arts Building as possible. She sometimes took her children to campus with her in order to attend class. She was successful in her academic career, except one thing: physical education. That missing credit from her bowling class haunted her even then, and she refused to do one more physical education class. By then, she didn’t see the need anyway. She was already teaching piano students and working for churches. She had no intention of taking any education credits. And definitely not one more physical education credit. Sans degree, Urban continued with a life of teaching and playing music. She retired from teaching around eight years ago, but even a couple of years ago played piano for her fellow assisted living residents. She is now in a nursing home and doesn’t play anymore. But one of her former students, a retired businessman and now doing some work for UWSP, Peter Crawford, decided to look into her degree. It turns out with a little finangling, they were able to make the credits work and get Urban her degree. In June, after keeping the plan a secret for nearly six months, they surprised Urban with her degree, her daughter Jill Donahue told City Pages. “Judy has accomplished all that a degree supports,” Crawford wrote in a note. “She has taught and inspired piano students. She has supported good quality choral music. She has helped expand appreciation of music history and the understanding of music theory.” Urban just thought she was meeting with her old student for a visit. When the chancellor, Peter and others showed up with a degree, she was shocked, Urban told City Pages. She’s proud of the degree, but was not amused by my suggestion they should have included a bowling minor. “I would have sent all the credits back,” Urban says. She’s proud of the degree, but perhaps more proud of her life of teaching music and inspiring others. The degree, as Crawford suggests, is a symbol of that more than anything.

What is a Constructive Trust? A constructive trust is not actually a trust at all. Rather, it is an equitable remedy used by the courts to prevent someone from benefiting from property that has been wrongly obtained. One might encounter the use of constructive trusts by a judge in a bankruptcy proceeding. For example, if a debtor who was filing for bankruptcy transferred certain property to their cousin just days before filing but did not disclose that transfer of property to the bankruptcy court, the court could require that property to be held in a constructive trust for the benefit of the debtor’s creditors even though the property’s title may be in the cousin’s name. This action by the court would thereby prevent the cousin from being able to sell or use the property for their own benefit until it can be turned over to the creditors who had a claim on the debtor’s property.
