Marketing Guernsey AIFs in the EU – Post-Brexit Access to the EU market:

The Alternative Investment Funds Management Directive (AIFMD) leaves most AIFMs with two choices when marketing their products to EU investors, by either EU (AIFMD) passport or the National Private Placement Regime (NPPR).

Guernsey provides proven, smarter, faster access to investors in the EU through the NPPR.

Marketing Guernsey AIFs in the EU – Post-Brexit Following the UK's departure from the EU (31 January 2020), and the end of the subsequent implementation period (31 December 2020), the NPPR agreement remains the same. The agreement remains business-asusual for Guernsey AIFs where they can continue to market into the EU under NPPR, irrespective of whether the AIFM is based in the EU, or not.

Marketing Guernsey AIFs in the UK – Post-Brexit EU access to the UK investor market: Following the UK’s departure from the EU, and the culmination of the implementation period, EU Directives no longer have jurisdiction in the UK. This means EU member states do not have access to the UK investor market through the route of the EU (AIFMD) passport. Guernsey access to the UK investor market: Guernsey and the UK signed a MoU regarding Article 42, stipulating that Guernsey funds can continue to have unchanged access to the UK market following Brexit and the end of the implementation period.

Marketing Guernsey AIFs in the UK – Post-Brexit Following Brexit and the end of the implementation period, the Memorandum of Understanding between Guernsey and the UK guarantees Guernsey has continued and unchanged access to the UK for the marketing of AIFs.

Following the UK's departure from the EU, Guernsey remains the specialist leader of the European private equities market, and home to more non-UK entities listed on the London Stock Exchange than any other jurisdiction globally. Guernsey has an unchanged arrangement for marketing AIFs into the EU 27 and UK.
