New P.C. entertainment laws help and frustrate restaurateurs T

he four-tiered entertainment law package which was put in place by the Port Chester Board of Trustees over the past year has allowed some additional restaurants to begin offering entertainment in order to make them more attractive to customers and increase business. It has also made the application process more complicated for existing establishments with cabaret licenses (which allow them to offer or host entertainment). And lastly it has made the rules more stringent for anyone thinking of opening an adult entertainment establishment in the village. Preventing another Diamond Club, a topless club turned nude juice bar which previously occupied the space that is now Edo Japanese Steak House, was what motivated the village board to enact a new entertainment law—which ended up a four-volume set—in the first place. The laws were many years in the making and required the help of a nationally-known expert in this field to get them right.

Restaurant ancillary entertainment licenses The law allowing for restaurant ancillary entertainment licenses— to permit entertainment that is incidental to a restaurant with no recreational dancing—was adopted Sept. 2, 2008 and went into effect shortly thereafter. Since then, four restaurants have received licenses and two others are in the process. Churrascaria Copacabana at 29-31 North Main St. was the first restaurant to apply for and receive a license back in November. While the Brazilian steakhouse did have live music inside for several months, it wasn’t until their deck was covered and reopened in midJuly that it became a hot spot on the weekends. Music on Friday and Saturday nights varies from Brazilian to jazz and sometimes there is a deejay. It plays from 7-10 p.m. During the summer there were patio parties on Sunday, but these have now transformed into American football parties that run from noon till 8 p.m. Manager John Freitas called them “a long happy hour.” Customers get free wedges and pasta, and drinks are specially priced at $3 for beer and $5 for shots while football games are aired on four large screen TVs. Having music on the deck has helped business, said Freitas. “It brings a different crowd.” While the restaurant is known for its price-fixed service of various meats carved from skewers in the rodizio style, this meal is not offered outside where there is a separate menu of Brazilian specialties such as mixed barbecue, baby lamb chops, beef ribs or pork sausage with fried yucca, fried pork tenderloin, top sirloin platter, skirt steak, Buffalo wings, fried tilapia, fried calamari, deep fried shrimp and garlic and oil shrimp. Since plastic has been installed around the deck, said Freitas, it will likely be open for business into November when the music will move indoors. Having the ability to offer entertainment was important to Copacabana and is appreciated.

What else could the village do to help restaurants? “No taxes,” joked Freitas, and then, on a more serious note, said “Main Street parking is always a problem, the sidewalks on Main Street are terrible and they should plant some trees and make it look nicer.” Port Chester has received a $425,000 New York Main Street Grant from the state Division of Housing and Community Renewal. The award will help

revitalize the downtown business district by renovating buildings and facades, improving streetscapes and expanding affordable and workforce housing. This grant will provide up to $15,000 to interested property owners to improve exterior building facades and up to $15,000 per property owner for interior loft construction/renovation projects to provide more workforce and live/work housing opportunities downtown. Property owners within the three-block area between Adee and Mill streets will be eligible to participate in the grant program. Fox Island Seafood House (F.I.S.H.) at the foot of Fox Island Road has also taken advantage of this new class of license and offers a Mediterranean jazz brunch from 12-4 p.m. every Sunday. A jazz duo or trio plays while patrons enjoy such delicacies as a blue crab, sour cream and chive omelet; king salmon hash and poached eggs; lox, eggs and onions; lobster fra diavolo and eggs in purgatory; or cinnamon sugar French toast. In addition, co-owner Billy Rosenberg plans to throw a big Halloween party with a deejay or live band, a New Year’s Eve party with a band, an opening of summer or spring bash and an all-day Fourth of July party with 5-6 bands. “I think it’s a nice addition,” said Rosenberg of the new class of cabaret licenses. “You have a little more versatility.” As far as what else the village could do for restaurants, he thinks “safety is a big thing in town, making people feel comfortable. A lot of people are still nervous to come into Port Chester.” Live Latin music became a part of the landscape at Brisa Marina Bar & Grill about seven months ago, said manager Miguel Nunez. On Friday and Saturday nights from 7 p.m. to midnight and Sunday from 4-10 p.m. a guitarist and pianist play inside at 40 Grace Church St. The

music is also piped outside to the restaurant’s tropical patio complete with impressive murals and a waterfall. Nunez said business has picked up about 35% since the music was added. “People like it,” he said, with some customers coming in every 15 days, others twice a week. “They enjoy the patio because I put out a mini buffet with eight or nine different items,” said Nunez. “For $25.95 for each person you can eat anything you want.”

The Building Department was able to help with a decade-old document that should be sufficient. “Is that outrageous?” he asked about

about the cabaret licenses. “All of those with current licenses have received a communication from us letting them know it is time to apply, they have been given an application and time to fill everything out.” He has received many phone calls with questions about the process. “We now have four types of licenses,” said Monroe. “Some might want to adjust what they’re applying for to fit their type of business. They could be a catering establishment or more of a restaurant where ancillary is better suited.” The annual fee for the one-sizefits-all cabaret license the village used to have was $800. Now the fees range from $150 for an occasional ancillary restaurant type to $1,500 for a cabaret or adult entertainment license at an establishment where the occupancy is more than 600. A catering and events license runs from $500 to $800 depending on occupancy.

A complicated application process

The menu at Brisa Marina, billed as an international eatery, features grilled meats, seafood, steak, chicken, fish and combinations such as chicken and shrimp or ribs and shrimp or salmon and lobster as well as sandwiches and burgers. Bo Tan took over management of Euro Asian Bistro in the Waterfront at Port Chester complex at 30 Westchester Ave. three weeks ago. The restaurant, which offers Asian fusion cuisine in a contemporary setting, has gotten an ancillary entertainment license and features a deejay playing 80s music Friday and Saturday nights from 10 p.m. to 1 a.m. in the lounge. Next month live music will be added on Thursday night—either a jazz trio or an acoustic guitarist. The schedule and hours have not yet been set. “It’s something new that we will give to the people and maybe they’ll like it,” said Tan. “If it’s not going to work, we will just stop it.” Restaurants pay $500 per year for the privilege of providing ancillary entertainment, $150 for an occasional license which allows them to book bands or deejays up to 20 days in a 12-month period. The American Legion Post 93, which had a cabaret license before the new laws went into effect, is applying for an occasional license so the veterans’ organization can have a deejay from time to time at its 78 Pearl St. headquarters. As an “association of war veterans,” it was previously exempt from a fee. But no more. So Howard Weiss, bar chairman and finance officer, is upset about the new law, not only because of the fee but also because of the require-

the required paperwork. “Do they think we are criminals or something?” “They’re gouging,” he added. “They’re killing us.” Having received a letter that the American Legion’s cabaret license was expiring, he went to the village clerk’s office and was faced with a big book containing the four new laws. had to pick which one applied to the Legion. With help from employees in the clerk’s office, he figured out what type of license to apply for. “I said, ‘What happened to the simplified license?’” Rosie’s on the River (formerly Per Voi) at 23 North Main St., which often has live bands on Saturday night, previously had a general cabaret license. Along with all the others, it expired Sept. 8, according to the village clerk’s office. Rosie’s has just applied for a restaurant ancillary entertainment license.

Other entertainment licenses Letters have gone out to the 11 establishments that currently hold cabaret licenses telling them of the need to renew and conform to the new laws. The American Legion and Rosie’s on the River are among them. The clerk’s office is taking care of the restaurant ancillary and catering and events licenses, with Det. Lt. Royal Monroe in the Port Chester Police Department handling the cabaret and adult entertainment permits. “We just started the application process, so no one has received any yet because we are just working through the process,” said Monroe

John Muscatella, who coowns and operates T&J Villaggio Trattoria at 223-225 Westchester Ave., is beside himself about the paperwork and architectural drawings required to maintain a license the establishment has had for many years. “What they did is try to make it easier, but they made it more difficult,” he said. “If I haven’t changed anything, I should just be able to renew my license.” But he’s told it’s a new law and he has to apply like anyone else. “I have to send them an engineering schematic by a professional engineer and it’s going to cost me money and why when this building has been here for 100 years? I have to fight like the guy who’s opening up a new place.” Mayor Dennis Pilla raised the issue of possibly relaxing the need for professional drawings at the last village board meeting. No decision was made. “Meanwhile I have my check in front of me because they sent it back to me,” said Muscatella. Now I have to hire an engineer to do the drawings for a 100-year-old dance floor.” Muscatella is applying for a catering and events establishment license. He rents out the downstairs room at the popular Italian restaurant for private parties, as has been done at this location under various restaurant names for decades. Customers can bring in a deejay or band and encourage dancing. Once in a while the restaurant itself holds paid-in-advance events such as comedy shows open to the public. As far as enforcement, the new laws are clear cut and specific, said Police Chief Joseph Krzeminski, “creating some differences between a piano bar and a dancer.” However, he said: “Perhaps the legislation itself is a deterrent to some places. It is a pretty complicated process depending on the type of application you need. It requires the fingerprinting of not only the owners but also the employees.” There have been no applications for adult entertainment licenses since that law was adopted Sept. 2, 2008, and the chief thinks “the legislation will probably discourage it.” As far as the village board is concerned, that’s a good thing.
