Statement We are aware of the homeowner's complaint. The Millers are the third owners of the home and purchased it from a bank following a protracted foreclosure proceeding. The warranty period for the condition of which the Millers are complaining expired long ago. Moreover, it is unknown how long this home sat unoccupied, but it is clear from our inspections that general maintenance required of every home was neglected for an extended period of time. The home has never been repainted and normal stucco cracks were left unattended. Without proper maintenance, even a hairline crack could continue to expand. As is typical with most home purchases, The Millers presumably were afforded the opportunity to inspect the home before purchasing it and would have readily noted the home’s condition.
Based on the inspections by our warranty department and a third-party engineer we retained, our warranty department informed the homeowners that the cracks had not been maintained as part of normal homeowner maintenance, and therefore the progression of the cracks was not covered under warranty.
