Lino PD, school district work together to keep schools safe

Because of the perceived impact of legislative changes, there will no longer be a school resource officer (SRO) stationed at Centennial Middle School.
Due to recent legislative changes to Minnesota Statute 121A, police officers who are under contract with the school district are no longer allowed to provide services in a school setting in the same manner as they have in previous school years. The law changes also impact the department’s ability to provide police officers to work extracurricular events, such as football games or school dances, police officials have said.
Specifically, Director of Public Safety John Swenson explained that the new legislation makes the SRO an agent of the school district and limits its officers’ ability to use force if necessary.
“If one of our officers were to interact with a student after they attempt to deescalate and the student is out of control, disruptive, breaking property — you pick the scenario — and our police officer has to go hands-on, if the police officer who is the SRO takes that student to ground to handcuff them and puts them down on their stomach, that is a crime under this new law,” Swenson said.
He added that the police officer would then be open to criminal liability and the city to civil liability.
Although the Lino Lakes Public Safety Department will no longer have an SRO at the middle school, Swenson said officers will not be strangers to the schools.
“We are still going to have presence in the school, we just won’t have a contract with the school district,” Swenson said. “School safety is a priority for us. We just may have to do some things that make it fit this law better to ensure that our schools are safe.”
As of last week, Superintendent Jeff Holmberg said the district had not received official notice of the suspension of SRO services.

Corridor study plans for future of 20th Avenue

It’s not too late to weigh in on what you would like to see 20th Avenue look like in the future.
Anoka County, in partnership with the cities of Centerville and Lino Lakes, is studying the CSAH 54 corridor (20th Avenue) between 73rd Street and Birch Street (CSAH 34), as well as the Main Street (CSAH 14) and 21st Avenue intersection. The county is working with Transportation Collaborative & Consultants (TC2).
The area has seen a spur of
development lately. Amazon, Sutton Transport and Kwik Trip have all built new facilities, and Watermark, the residential development west of I-35E, continues to add new homes. The primary goal of the study is to identify the future vision for the corridor that addresses known issues, while providing safe and efficient mobility for all users.

LINO LAKES CITY COUNCIL SNIPPETS
• Two properties in the city will be assessed $360 for weed abatement charges. City code section 904 establishes weeds or grass growing in excess of 8 inches in height to be a public nuisance. Property owners in violation of this requirement are notified and provided an opportunity to cure the nuisance. If the violation is not addressed within a specified period of time, city staff and/or private contractors are directed to abate the nuisance. The cost of abatement is charged to the property owner. In the event that the property owner fails to pay the costs incurred, the city may certify the charges against the property for collection with property taxes as a special assessment.
• Eagle Brook Church will host an event from 5:30 to 8:30 p.m. Sept. 21. The event will include outdoor yard games, amplified music and an outdoor space for food and nonalcoholic beverages.
• The Lino Lakes Lions Club will conduct a raffle Oct. 7 at St. Joseph of the Lakes Catholic Church.
• Beginning Oct. 1, residents won’t be able to consume any form of cannabis in a public place or on public property.
• Effective Oct. 5, liquor license holders will no longer be prohibited from selling lower-potency cannabinoid products. The city has amended an ordinance regulating edible cannabinoid products following changes to state laws.
In the 2023 Minnesota Legislative Session, further amendments were made to existing law to allow for recreational use of cannabis. One such amendment removed restrictions placed on exclusive liquor stores to sell lower-potency cannabinoid products. Beginning Oct. 5, liquor store owners can begin the application process for cannabinoid licenses.
• The city of Chaska will purchase one set of firefighting turnout gear and fire boots for $4,542. Last summer, after implementation of the city’s part-time duty crew, new turnout gear was ordered by the city for new part-time duty crew members. All turnout gear and fire boots purchased were sized to fit each staff member and the Fire Division took delivery of this gear in October 2022. Recently, a part-time duty crew staff member has left the city of Lino Lakes and began working as a full-time firefighter/inspector for the city of Chaska.
Deputy Director of the Fire Division Dan L’Allier explained that due to delays and supply chain issues, it can take several months to receive turnout gear when it is ordered, and thus the city of Chaska has requested to purchase the turnout gear and fire boots for the former employee.
• The Lino Lakes Public Safety Department will no longer have a school resource officer stationed at

• The city has finished paying its bills for the 2022 street rehabilitation project. Most recently, the council approved the final payment of $57,903 to T.A. Schifsky & Sons Inc. The full project cost was $1,213,104.
• Motorists can no longer park their vehicles on either side of Lake Drive (CSAH 23) between Aqua Lane or Main Street. City Engineer Diane Hankee says that Lake Drive is designated as a principal arterial. Such streets are designed to carry longer trips at higher speeds with minimal land access.
• Lil’ Explorers Childcare Center will construct a 16,941-square-foot commercial day care facility located south of Apollo Drive and north of Lilac Street.
• Currently, construction activities are only allowed to take place from 7 a.m. to 7 p.m. Monday through Friday and 9 a.m. to 5 p.m. on Saturdays. Community Development Director Michael Grochala explained that currently, the only exemption is for persons working on their own private residence. Certain projects, such as a repair of a water main break or storm damage repairs, that are currently undertaken during prohibited hours would be in violation of city code.
The city will now provide some exemptions from the work hour and day prohibitions, which will allow for an emergency repair such as a water main break. Other work may be allowed by the city engineer or public services director, on a case by
case basis, if determined necessary to restore public service.
• The city has reached an agreement with Java Companies LLC to purchase 2.24 acres of property at the corner of Lake Drive and 77th Street (Lots 12 & 13, Block 2, Carole Estates 2nd Addition) and a remnant of 7685 Lake Drive. The sale price is $519,080. The purchase is subject to several contingencies. Java Companies is currently constructing a multitenant commercial project at 601 Apollo Drive.
• WSB will complete a feasibility report and a topographic survey for the proposed 2024 street project. The project is proposed to include the Pine Haven Area, including 81st Street, Elbe Street, Danube Street and the Red Maple Lane
neighborhood. Diane Street and Evergreen Trail are also proposed to be included as reclamation projects.
The feasibility report, which WSB will prepare for $59,842 or less, will include the project cost, preliminary design and a proposed assessment roll. The city plans to hold a public informational meeting to introduce the project and gather feedback in the future.
The next City Council meeting will be at 6:30 p.m. Monday, Sept. 12, at City Hall. There will also be a work session immediately beforehand at 6 p.m.

Letterpress comes alive
This is the 37th year the Minnesota Newspaper Association Foundation Letterpress Museum has been in operation at the Minnesota State Fair. The paper printed each day at the State Fair is called The Maynard News, named after the Maynard paper, which was operated by Barney Shelrud. After Barney's death the paper closed, but the equipment was stored and eventually gifted to the MNA Foundation with plans to open a complete operating newspaper at the Minnesota State Fair.
It's beginning was at Heritage Square and many donors made it happen. A building was set up just like a country newspaper would be.
With increased transportation requirements, the State Fair moved the letterpress to the front of the 4-H building several years ago.
Each year volunteers come together to operate an Intertype, a Linotype, Miehle cylinder press, a handfed job press and a Kluge automatic feeder press.
Kathy and I were there on Aug. 28. As usual, she folded newspaper hats to give away and I was in the editor’s chair this year, as the Linotype chair was filled.
The museum gets about 1% of the State Fair attendance. So many people have some connection to the letterpress era of hot type.
Reactions include, “Oh, the smell of ink and the hot lead brings back nostalgia and it feels so good to be here.”
I can’t remember all the names of the visitors, some we knew and some we didn’t, but one of the early morning visitors was Dave McGilvery, former city planner in White Bear Lake. After leaving White Bear, he was a consultant until his retirement.
Mike Branch of Lino Lakes stopped by to visit. He is with a financial planning firm in Minneapolis. He enjoys the Quad Community Press.
A lot of people asked if there is a future for print and I assured them there is, especially in smaller communities. It is residents primary, and perhaps only, source of communication about what’s going in schools and city government, as well as with their neighbors. A lot of daily newspapers will reduce their frequency, but the community weekly will carry on and expand with website content. For advertisers and others who want information shared, it provides a total market coverage. If small towns with a population under 4,000 residents decline, so will weekly newspapers. Some will merge.
Carlton DeWitt from Glenwood City, Wisconsin starts preparation at the State Fair Museum a week before it opens and works the first day and the last day. He does an amazing job getting the type setting machines operating and the press prepared with new packing. Jon Drew operates the two commercial presses. He has a letterpress shop in his home and works all days at the fair.
We are fortunate to have a lot of younger volunteers joining. They usually get involved not necessarily because of newspapers, but because of letterpress printing as a form of art.
This year an addition to the exhibit was a large revolving screen on which front pages of Minnesota newspapers were highlighted. Carter and I had five front pages on the screen, including the White Bear Press, The Hugo Citizen, the Isanti-Chisago County Star, the Moose Lake Star Gazette and the Kanabec Times.
The museum provides a lot of detailed information about the letterpress equipment, and also about state and national laws protecting freedom of the press. There are also samples of legal cases that have protected the First Amendment.

No officers left in schools
Governor Walz, Senator Heather Gustafson and Rep. Brion Curran need to do the right thing and amend these laws. They voted for these policies to be law. It is unfortunate that every police officer in this state feels they can’t do their job properly. There will be no officers left in schools.
I am a mom of a second grader at Centerville Elementary and a sister of a metro police officer (Roseville).
BUSINESS BRIEF
If an officer that has taken an oath to protect and serve can’t do that. We have done something wrong. The use of force and the use of the prone position if deemed necessary should be able to be used. Those officers are there to keep everyone in that building safe.
This state needs to get it together.

CENTENNIAL SCHOOL BOARD SNIPPETS
• The district recently approved three contract settlements for 2023-24 and 2024-25 — one with administrative assistants, one with Kids Club and another with paraprofessionals. The contract terms can be found on the district’s website.
• Fifty-six new teachers have joined the district so far for the 2023-24 school year.
• The district will begin the process of long-range district and facilities planning. Superintendent Jeff Holmberg explained that the purpose of the Long-Range Planning Committee (LRPC) is to create a 10year facilities and enrollment plan with the following outcomes:
- Review student enrollment trends, demographic information, and current district enrollment, and formalize student enrollment projections.
- Examine current school district educational capacity relative to providing current and future programming opportunities for students to explore their interests and prepare them for career and post-secondary opportunities.
- Examine deferred facility maintenance needs.
- Examine facilities space to provide comprehensive co-curricular opportunities for students and serve the communities today and in the future.
“This is a multiyear plan that has stakeholder fingerprints on it,”
Holmberg said. The board will likely take action on the plan in March or April.
• The board continues to review policy updates. Previously, the board requested considering smaller batches of policies at a time so it could understand each of the policies and the changes that were recommended. Holmberg said the board will continue to discuss policy updates this fall, and the process will wrap up by November.

The Lino Lakes Police Department reports the following incidents:
• An officer stopped a vehicle for speeding on I-35E near 80th Street Aug. 22. The driver showed signs of impairment and was subsequently arrested for seconddegree driving while impaired.
• An officer responded to a report of a suspicious person near a correctional facility in the 7500 block of Fourth Avenue Aug. 22. The officer checked the area but did not find the described person.
• An officer received a report of suspicious activity that occurred at a business in the 700 block of Apollo Drive Aug. 22. The officer investigated the incident; there are no criminal charges at this time.
• An officer responded to a report of theft from vehicle in the 6900 block of County Parkway East Aug. 22. The incident was documented and is under investigation. There is no suspect information at this time.
• Officers responded to a call of a person possibly passed out in a vehicle in the 2000 block of Cypress Street Aug. 22. Officers located the involved vehicle and the male driver was subsequently arrested for third-degree DWI.
• An officer responded to a request from another law enforcement agency to check an address in the 400 block of Arrowhead Drive for property stolen in their city Aug. 22. The property was located and taken as evidence. The investigating law enforcement agency was advised.
• Officers assisted the Minnesota State Patrol in trying to locate a motorcycle that fled from them Aug. 22. Officers located the motorcycle in the 8000 block of Lake Drive, but it continued at a high rate of speed. The Minnesota State Patrol is investigating the incident.

• An officer took a complaint of construction workers starting too early in the morning in violation of ordinance in the 7200 block of Ada Drive Aug. 24. The officer made contact with the workers and advised them of city ordinance.
• Officers were dispatched to a parking dispute in the 200 block of Egret Lane Aug. 24. One individual was issued a citation for disorderly conduct.
• An officer received a traffic complaint of a vehicle that was driving recklessly and passing on the shoulder in the 7700 block of Lake Drive Aug. 24. A description of the vehicle was provided by the caller, and the area was checked. Extra patrol was conducted in the area, but the suspect vehicle was not located.
• An officer responded to a delayed theft report in the 7600 block of 20th Avenue Aug. 24. There are no suspects at this time.
• An officer responded to a hitand-run accident in the 8000 block of Lake Drive Aug. 24. The officer documented the incident and provided information to the caller for insurance purposes. The investigation is ongoing.

Officers with the Centennial Lakes Police Department responded to a report of a possibly deceased individual near the 9000 block of South Highway Drive in the city of Lexington around

• Officers located two suspicious vehicles in the 6800 block of Black Duck Drive Aug. 25. The vehicles fled when officers attempted to stop them. One vehicle was later located and the driver was arrested for fleeing police in a vehicle and various theft-related crimes. The second vehicle was determined to be stolen from a nearby address. The investigation is ongoing.
• An officer located an unoccupied stolen vehicle in the area of Hodgson Road and Birch Street Aug. 25. The officer learned the vehicle was taken overnight from a different county and assisted that county agency with the recovery of the vehicle. The investigation of the incident is ongoing.
• An officer took a phone call regarding a neighbor dispute in the 200 block of Baldwin Circle Aug. 25. The caller asked for a report to be filed for documentation purposes. The officer provided information on restraining orders.
• An officer took a delayed phone call report of child abuse and possible sexual assault Aug. 25. The incident was documented and forwarded to the criminal investigations division.
• Officers received information regarding an intoxicated driver in the 7800 block of Lake Drive Aug. 25. The vehicle was stopped, the driver showed signs of impairment, and was arrested and booked into jail for DWI and test refusal.
• An officer responded to a report of a tree blocking the roadway in the 900 block of Lois Lane Aug. 25. When the officer arrived, residents had already moved the tree to the shoulder of the road and public

• An officer conducted a traffic stop near Pine Street and Lake Drive Aug. 27. The male driver was arrested and booked into the Anoka County Jail for seconddegree DWI and driving after cancellation inimical to public safety.
• An officer and fire personnel responded to the 7600 block of Fourth Avenue for a power pole and tree on fire Aug. 28. The fire was out when the officer arrived. The utility company was advised for repair.
• Officers responded to a residence in the 8000 block of Lake Drive to locate a female who had a warrant for her arrest Aug. 28. The female was arrested, but transported to a hospital by ambulance to be assessed for chest pain before jail.

MDE releases statewide assessment, accountability data
The Minnesota Department of Education (MDE) has released the 2023 statewide assessment and accountability results.
The results confirm the need for continuing support for students and educators as they do the hard work of learning recovery by rebuilding connections and skills in all subject areas. The data also underscores the need for the investments in education made during the legislative session by Gov. Tim Walz and the Legislature in literacy, education workforce and student support.
Today’s release of the 2023 North Star Accountability report contains results of the 2023 statewide assessments, which include the Minnesota Comprehensive Assessments (MCAs), Minnesota Test of Academic Skills (MTAS), Assessing Comprehension and Communication in English State-to-State for English Language Learners (ACCESS for ELLs), and Alternate ACCESS for ELLs.
Assessment results are mixed with a 1% increase in overall math scores, a 1% decrease in reading scores and a 2% decrease in science scores since assessments were last completed in 2022. Scores in each assessment area remain about 10 percentage points below their pre-pandemic levels from 2019.
“These statewide assessment results reinforce what we and other states around the country already know—our students, families, school communities and educators are continuing to recover from the pandemic and need our support,” said Commissioner Willie Jett. “This data is important as one part of a broader set of measures that tell us how our students and families are doing and what we need to do in partnership with our school communities to provide support for students to not only recover, but also excel.”
Students take statewide reading assessments in grades 3-8 and 10. Of the students who took the reading MCA and MTAS, 49.9% met or exceeded grade level standards, down 1.2 percentage points from 2022.
In math, 45.5% of students in grades 3-8 and 11 who took the MCA or MTAS met or exceeded grade level standards, up 0.7 percentage points from 2022.
The science MCA and MTAS are administered for students in grades five and eight and once in high school. In 2023, 39.2% of students who took the assessments met or exceeded grade level standards, a 2.1 percentage point drop from 2022.
ACCESS for ELLs measures students’ English language proficiency. Of the students who took the ACCESS for ELLs in 2023, 8.6% were proficient in English, a 0.2 percentage point decrease from 2022.
MDE also released North Star attendance data for the 2021-22 school year. This is the first attendance data release since 2019. North Star Attendance data tracks consistent attendance, or the number of students who are attending school at least 90% of the time and who are not chronically absent. Statewide consistent attendance fell to 69.8% of students attending at least 90% of the time. Prior to the pandemic, Minnesota’s consistent attendance rate was about 85%.
"We will not shy away from what the data are telling us. These results send a renewed sense of urgency and underscore the importance of key supports that are already underway,” Jett said.
“As we enter a new school year, MDE is committed to providing support, through programs such as COMPASS and implementing the READ Act and other new legislation, to help every school in Minnesota as they strive to meet the academic, social-emotional and mental health needs of students.”
For the first time the assessment and accountability reports use the Minnesota definition for all racial student groups. The state definition allows students to be reported as American Indian even if they also belong to other racial and ethnic groups. Under the federal definition of American Indian or Alaska Native, these students would fall under “Hispanic/ Latino” or “two or more races” and would not be counted as American Indian or Alaska Native in reporting.

take on this more comprehensive look of not just the immediate area around Amazon but further along the corridor as well,” explained Matt Pacyna, TC2 project manager.
Centerville City Administrator Mark Statz added, “The project here is to look at a comprehensive look at the future of 20th Avenue … That future is really not mapped out right now and that's our job, is to help map it out.” He added, “We are in the very early stages of this, and that your input is very much important to us.”
The study will lay out both the short-term and longterm needs for the corridor. The study will look at a number of metrics, including safety and crash history, access, environment, land use and traffic operations.
At a recent open house, residents were able to voice their opinions on what the project should prioritize: improvements to mobility, safety, or multimodal facilities; minimizing environmental impacts or property impacts; or adding landscaping.
A priority that is top of mind for residents is safety along the corridor. Residents voiced concerns regarding the speed vehicles are traveling; they also stressed that pedestrians have to cross the busy street to access recreational facilities. Traffic from Eagle Brook Church and increased truck traffic were also emphasized. One resident asked who was going to pay for any proposed improvements.
Jack Forslund, Anoka County project manager, said that it has not been the county’s practice to assess property owners for such projects. Statz added that both city taxes and county taxes would likely be impacted.
It’s important to note that any recommended capital improvements that come out of the study are likely five to 10 years out, depending on funding, although some projects may be able to take place sooner.
Residents who missed the first open house have the opportunity to attend another one this fall or winter. An online survey will remain open for about another month so residents can weigh in on the corridor. On the project’s website, visitors can also click areas along a map and leave comments about them. “You all are a critical component of establishing that future vision for the corridor,” Pacyna said.
The corridor study is expected to wrap up next spring.

Centennial boys soccer had a strong week, starting Northwest Suburban play with wins over Robbinsdale Armstrong 2-1 there Monday and Park Center 2-0 at home Wednesday.
The Cougars handed both opponents their first loss, and improved to 2-1 overall, having lost their opener at St. Cloud Tech 1-0.
“Super proud of the team effort and how they supported each other,” coach Jeff Ottosen said after the Park Center win. He had high praise for the core of the defensive unit — back-liners Keaten Frase, Noah Marquard and Beckett Babiash and goalkeeper Georden Tschida.
Against the Armstrong Falcons (1-1), Marquard and Frase notched the goals, and Tschida made three saves.
Against the Park Center Pirates (2-1-1), the first half was a 0-2 tussle but CJ Scherer scored early in the second half and Sebastian Fernandez also found the net. They were assisted from Minty Shady and Mateo Ortiz.

Cougars (1-2) nab first win for new volley coach
Centennial picked up its first win, over Irondale 25-17, 25-23, 26-28, 25-22 on Tuesday, Aug. 29, then lost to Hopkins 25-10, 25-23, 25-23, on Wednesday, both on the road.
“There was a lot of great hustle and effort in each rotation,” assessed new coach Nicole Christensen about the Irondale match, her first win with the Cougars. “It's fun to watch them put the ball away in system and we hope to see more of that.”
The Cougars (1-2) opened with a loss to Moorhead 25-10, 25-10, 25-22 on
Saturday, Aug. 26, at home.
Against Irondale, junior Emma Peterson led with 15 digs and six blocks while delivering 11 kills with a strong .408 efficiency. Elena Hoecke, sophomore middle, led with 16 kills and .370 efficiency. Freshmen adding spark were Chase Manthey with 43 assists and Aubrie Wirkkala with nine kills.
At Hopkins, the Cougars were nipped in the last two games and got swept.
DNR to offer free entrance to state parks Sept. 9
The Minnesota Department of Natural Resources (DNR) is waiving vehicle permit fees at all 75 state parks and recreation areas on Saturday, Sept. 9. This “Free Park Day” is one of four days each year on which the Minnesota DNR waives the
requirement for a vehicle permit at state parks and recreation areas.
Most Minnesotans live within 30 miles of a state park. Visitors looking for certain recreational opportunities or amenities can use the ParkFinder tool(mndnr.gov/parkfinder) to find the best state park or recreation area for their trip.
Visitors are advised to look for alerts and notices on park webpages of the Minnesota
DNR website (mndnr.gov/parks) before heading out to be aware of construction, trail closures or other circumstances that might impact their trip. For more information, visit the Minnesota DNR’s Free Park Days webpage (mndnr.gov/freeparkdays).

Noah Marquard, a returning all-conference soccer player for Centennial, is lauded by coach Jeff Ottosen as “the total package” as a defender. “Big, physically dominating, speedy, powerful in the air and on the ground,” Ottosen assessed. The 6-foot-2 senior also displays excellent field vision and communication skills, the coach said, and is “dangerous” going the other way on the attack. This week, Marquard had one of the goals in a 2-1 win over Armstrong and helped shut down a good Park Center team 2-0.
Brol Scherman, Centennial junior lacrosse standout, has netted 22 goals and provided seven assists for the Cougars (4-2) while notching 17 ground balls (a change of possession statistic). Scherman was all-conference as a sophomore with 36 goals and 28 assists. The recruiting website ILMCA said of him: “Endto-end playmaking machine with striking confidence both on and off the field. AN ORDINANCE ENACTING CHAPTER 502 OF THE CITY OF LINO LAKES CODE OF ORDINANCES PROHIBITING CANNABIS USE IN PUBLIC PLACES
The City Council of Lino Lakes ordains:
SECTION 1 ENACTMENT Lino Lakes City Code Chapter 502 is hereby enacted to read as follows:
Sec. 502.01 Definitions.
For the purposes of this chapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
CANNABIS FLOWER, CANNABIS PRODUCTS, LOWER-POTENCY HEMP EDIBLES, AND HEMP-DERIVED CONSUMER PRODUCTS. The definitions as enacted in Minn. Stat. §342.01 ELECTRONIC DELIVERY DEVICE. Any device manufactured, marketed, or sold as e-cigarettes, e-cigars, e-pipes, vape pens, mods, tank systems, or any other product name or descriptor used for the purposes of delivering a substance intended for human consumption through inhalation of aerosol or vapor.
PUBLIC PLACE. Property that is generally open to or accessible by the public, except on those premises licensed by the State of Minnesota to permit on-site consumption.
PUBLIC PROPERTY. Property, real and personal, that is owned, managed, or controlled by the City, including but not limited to: City buildings and all the land thereon, parking lots, pathways and trails, and city rights-of-way consisting of both the traveled portion and the abutting boulevard, sidewalks and trails, and any City personal property, such as motor vehicles, city equipment, and the like.
Sec. 502.02 Prohibited Activity.
No person shall consume or smoke cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived products in a public place or on public property.
Sec. 502.03 Penalty.
Violation of this section shall be a petty misdemeanor.
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication according to law. Adopted by the Lino Lakes City Council this 28th day of August, 2023.

The City Council of Lino Lakes ordains:
Section 1. That Section 617.05 of the Lino Lakes Code of Ordinances be amended to read as follows:
CHAPTER 617. EDIBLE CANNABINOID PRODUCTS.
619.05 Ineligible for License. No license under this Chapter will be issued to or held by:
(1) Any person whose primary place of business will be within 1000 feet of a school or church.
(2) Any person manufacturing Edible Cannabinoid Product on the same premises as the retail sales; unless retail sales are conducted in a separate area of the premises with a separate entrance/exit from the manufacturing operation.
(3) Any person who does not have a primary place of business. No door to door sales or pop-up vendors of Edible Cannabinoid Product is allowed.
(4) Any person who has been convicted of a violation of Minnesota Statutes Chapter 152.
(5) Any person who has been convicted of illegal acts involving alcohol, tobacco, or Minnesota Statute 151.72.
(6) Any person under the age of 21.
Section 2. This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter.

• The council continues to mourn the loss of Council Member Steve King, who passed away unexpectedly earlier this month.
• The city of Centerville is being recognized with the City of Excellence Award from the League of Minnesota Cities (LMC). The LMC is an organization designed to help the people running 838 of the state's 855 cities by providing services and helping its members resolve their questions. Centerville was awarded the City of Excellence in the category of cities with populations of under 5,000. The City of Excellence program is designed to encourage cities to improve the quality of city service, find innovative ways to solve common problems, save city money for better results and encourage greater participation in the community.
• The fourth time is a charm! After tabling action on the storm drainage grant program policy, the council has approved amendments to the policy that now allows individual property owners to participate in the program in which the city shares costs to remediate drainage problems. The vote was 2-1 (the council currently only has four members; Council Members Russ Koski and Darrin Mosher voted in favor, Mayor D. Love was opposed, and Council Member Raye Taylor was on Zoom and ineligible to vote). City Attorney Kurt Glaser said he started from scratch and incorporated everything that was said at the previous three meetings into a more formal policy. The new draft of the policy adds levels of accountability for project owners to demonstrate the worthiness of their project and relies on city staff to vet the projects. The project was approved as otherwise drafted, with the financial means clause removed and environmental sustainability criteria added.
The purpose of the storm drainage grant program is to financially assist residential property owners with remediation projects intended to fix ineffective stormwater drainage impacting their property. The policy spells out the purpose of the program, eligibility, program grant funds of $20,000 available annually, application guidelines, criteria for funding individual remediation projects, and operation of the program and conditions. The grant award program states that the city will pay 25% of the cost of a remediation project up to a maximum of $5,000 per parcel.
• With the adoption of the amendments to the storm drainage grant program policy, the two individual homes at 1605 and 1615 Widgeon Circle each saw their encroachment agreements and special assessment agreement and waivers of appeal unanimously approved. The two homes on Widgeon Circle requested cost participation from the city through the backyard drainage cost sharing policy. Under the revised policy, both homes' projects should qualify for funding, with a maximum total of $10,000 in city cost participation.
• Likewise, council unanimously approved a special assessment agreement and waiver of appeal for a single home at 6905 Oak Circle. The property owner also requested cost participation from the city through the backyard cost sharing policy. The newly revised policy now includes language that would allow for individual participation in the cost share program. The city will contribute 25% of the cost of the low bid, a share that amounts to $2,365.62, and will use funds from the city's storm water utility fund for the drainage project.
• The dead trees at Twin Townhomes of Eagle Pass have been given a stay of execution, after council approved a 32-day extension, from Aug. 24 to Sept. 25, to allow the homeowners association to hire a certified arborist to determine whether any of the dead trees pose an imminent danger to the public or neighboring properties. On Aug. 11, the city sent Twin Townhomes of Eagle Pass a letter regarding its violation of city code, Chapter 91, Subsection 91.08, after the city received a complaint about the dead trees on the property. On Aug. 16, the president of the board met with city staff on site to examine the trees in question, and the association is now exercising its
right to request an extension. Problematic trees will be removed by the Sept. 25 extension deadline. If the certified arborist determines that all or several of the trees in question can withstand winter conditions through Jan. 31, 2024, without causing danger to the public or neighboring properties, then that date will become the extension period deadline for the dead trees.
• The homeowner at 29 Eagle Pass, a single townhome in the Eagle Pass Owner's Association, will be permitted to build a 6-foot white vinyl privacy fence within the side yard setback within the city's right-of-way, drainage and utility easements on the south side of the property, after council approved an encroachment agreement for the fence.
• A new neighbor will get to welcome the rest of the existing neighborhood in style, after council approved a special event permit on private property for 1747 Dupre Road. There might be some noise, and council gave its blessing to the housewarming party. The block party will take place from 2 p.m. to 6 p.m. Sept. 17 for 40-50 people from the neighborhood.
• For those hoping to rent space at the fire station or police station for a graduation party, birthday party or other function, the rules have now been clarified, after council approved the Centennial Fire District use of facilities police and application form for when employees and non-Centennial Fire District members use the facilities.
