The Washington State economy has added almost 370,000 jobs since the lowest point of the recession at the start of 2010. Additionally, total employment is 176,000 jobs higher than seen at the 2008 peak. With a vast majority of our metropolitan areas having fully recovered from the job losses seen during the recession, I expect to see somewhat more modest job growth in the coming year. That being said, our economy will continue to expand, which will be a benefit to our region’s housing market.

There were 16,895 home sales during the fourth quarter of 2015, up by 4.6% from the same period in 2014. Sales activity is starting to slow somewhat but this is due to inventory constraints. The growth in sales was most pronounced in Cowlitz and Lewis Counties and double-digit growth was also seen in Thurston County. Sales declines were seen in Grays Harbor County and Skagit County, but only minimally.

I am not surprised to see some decline in sales start to appear. Listing activity was down by 28% compared to the fourth quarter of 2014, and there were no counties where there were more homes for sale in Q4-2015 versus Q4-2014.

Prices in the region rose by an average of 9.3% on a year-over-year basis but were 0.4% lower than seen in the third quarter of 2015. Unsurprisingly, no counties saw a drop in average home prices compared to fourth quarter last year. When compared to the fourth quarter of 2014, San Juan County again saw the fastest price growth with an increase of 37.6%. However, this county is notorious for extreme swings given the huge variations in prices in the San Juan Islands. Double-digit percentage gains were also seen in five other counties. As long as inventory constraints persist, it is likely that price growth will continue. That said, modest increases in interest rates, in combination with declining affordability conditions in several markets, will likely slow price appreciation.

The average number of days it took to sell a home dropped by nine days when compared to the third quarter of 2014.

It took an average of 78 days to sell a home in the fourth quarter of this year—down from the 91 days it took to sell a home in fourth quarter of last year.

There were just two markets where the length of time it took to sell a home did rise, but the increases were minimal. Jefferson County saw an increase of eight days while Mason County rose by two days. King County remains the only market where it takes less than a month to sell a home.

This speedometer reflects the state of the region’s housing market using housing inventory, price gains, sales velocities, interest rates, and larger economics factors. For the fourth quarter of 2015, I have left the needle at the same position as the previous quarter. In as much as the market is still very heavily in favor of sellers, I fear that some markets are reaching price points that will test affordability. Furthermore, while inventory levels are likely to see some growth in 2016, it will not be enough to satisfy demand, adding further upward pressure to prices. Overall, 2015 was a stellar year with sales volumes and home prices moving higher across the board. In 2016, I believe we’ll see some growth in sales activity, as well as continued price growth – just at more modest levels than last year. Interest rates are going to rise moderately through the year, but still remain very competitive when compared to historic averages. In other words, any increase in interest rates should not be a major obstacle for home buyers. Looking forward, I believe 2016 will be a year of few surprises. Because it is an election year, I do not expect to see any significant governmental moves that would have a major impact on the U.S. economy or the housing market.

WINDERMERE STELLAR COMMISSION SCHEDULE I.

This commission plan and its terms and conditions shall govern the commission pay-out to all Windermere Associates for closed real estate transactions.

II.

For all Associates whether in a calendar or anniversary year the commission payout shall be: 60/40--During any calendar year/12 month anniversary year, the Associate shall receive 60% of the listing and/or selling portion of the commission received by the Broker based upon the Associates role in the transaction. 100%--Once the Associate has earned the Broker $19,950 in fully paid and received company dollar, the commission shall be paid 100% to the Associate less appropriate taxes and deductions.

III.

Transactions Fees: Each Associate will pay $175.00 per closed transaction commencing on the Associates calendar/anniversary year for the first 10 transaction in said 1 year period.

IV.

Monthly Fees: Each Associate shall pay $65 per month to the Company as a miscellaneous fee.

V.

In-House Splits: For the purposes of in-house transactions, 55% will be allocated to the listing side and 45% shall be allocated to the selling side.

VI.

Commission Modification: The Broker reserves the right to modify this commission plan at anytime, upon 30 day written notice to Associate.

VII.

Shared Commissions: Arrangements for commissions shared between two or more Windermere Stellar Associates shall be expressed as a percentage of the listing or selling side and paid out according to each Associate's split at the time of closing.


VIII.

Fee/Costs: Broker shall deduct any and all fees, and costs applicable to Associate's real estate activity, including but limited to, franchise fees, B & O taxes, E & O charges, foundation fees, advertising or marketing charges and Association of Realtor charges.

IX.

Company Discount: Associates will receive one personal transaction per year with no company dollar.

WINDERMERE STELLAR INDEPENDENT CONTRACTOR AGREEMENT This Agreement, made and entered into this ___ day of ________, 20__, between WINDERMERE STELLAR, a Washington corporation, herein called "Firm" whose address is 210 E 13th Street, Suite 100, Vancouver, Washington and _________________, herein called "Broker" whose address is _______________________, _______________.

WITNESSETH: The Firm is a duly licensed real estate broker under the laws of the State of Washington and is engaged in the real estate brokerage business. The Broker is a duly licensed real estate sales broker or associate broker under the laws of the State of Washington. NOW, THEREFORE, in view of the premises and in consideration of the mutual promises of the parties hereinafter set forth, the parties hereto agree: 1)

This Agreement shall be for a period of one (1) year from the above date and may be terminated by either party upon two weeks advance written notice to the other. If this Agreement terminates or is terminated by one of the parties, the rights of the parties to any commission or for payment of expenses shall not be divested.

2)

The Firm agrees to maintain a real estate office equipped with desks, telephones, furnishings and facilities suitable for real estate business and will make available all current listings to the Broker. The Broker agrees to work diligently to sell, lease or rent any and all real estate listed with the Firm. Unless authorized in writing by the Firm, the Broker shall not have authority to bind the Firm to any promise or representation, nor shall Firm be liable for any Broker incurred expense. Both parties agree to conform to and abide by all laws, rules and regulations and codes of ethics of the Federal government, State of Washington and the National Association of Realtors that are binding upon or applicable to real estate Firms and Brokers.

All advertising shall be handled by the Firm and in the name of the Firm. The Broker shall not publish any advertising or promotional material or merchandise, directly or indirectly, without approval of the Firm.

4)

The Firm shall have the right, after notifying the Broker, to return earnest money deposits and documents and to settle, adjust or compromise suits, actions, disputes and controversies in which Broker is a party. Suits can only be commenced in the name of the Firm. Controversies between two or more Brokers shall be arbitrated by the Firm at the request of any party. The Firm's decision shall be final and binding on all the parties.

The Sales Broker shall be responsible for payment of all sums necessary to engage in real estate brokerage activity, including license fees, all dues and charges of multiple listing services, National, State or County Board of Realtor dues or charges, State of Washington B & O taxes, and any expenses or costs necessarily incurred by the Broker in performing his/her normal real estate activities. Should Firm incur any such expense by Broker, Firm shall have the right to deduct the amount due from any future commission payment.

Broker agrees to carry general auto liability insurance at Broker's own expense, with limits of liability of not less that $100,000.00 bodily injury for one person. $300,000.00 bodily injury for more than one person arising out of a single accident, and $50,000.00 for property damage. Broker is to secure an endorsement naming WINDERMERE STELLAR as an additional insured.

All information, paper, contracts, books of account, methods of doing business or copies thereof shall remain the sole property of WINDERMERE STELLAR, and Broker shall not use to his or her own advantage, during or after termination of the Agreement, nor permit the same to be so used by any competing person, corporation or company or remove the same from the corporation's premises at any time. Broker shall endeavor to increase the goodwill of the corporation. Upon termination of this Agreement, Broker shall return to Firm all keys, writings, documents and property belonging to the Firm. Broker acknowledges that listings are the property of the Firm.

Broker agrees to indemnify and save and hold Firm harmless in the event Firm is required to respond in damages by reason of any misrepresentations, misconduct, promises or untrue statements made by Broker during the term of this Agreement or arising out of any transaction that occurred during the term of this Agreement.

This Agreement does not constitute a hiring by either party. It is the parties' intentions that so far as shall be in conformity with law the Broker be an (2)


independent contractor and not the Firm's employee and, in conformity therewith, that Broker retain sole and absolute discretion and judgment in the manner and means of carrying out the Broker selling and soliciting activities. Therefore, the parties hereto are and shall remain independent contractors bound by the provisions hereof. The Broker is under the control of the Broke as to the result of Broker’s work only and not as to the means by which such results is accomplished. This Agreement shall not be construed as a partnership and the Firm shall not be liable for any obligations incurred by Broker. To comply with Federal law, it is specifically agreed and understood that Broker will not be treated as an employee for Federal tax purposes, with respect to Broker's services under this Agreement. Similarly, Broker will not be treated as an employee with respect to said services for the State of Washington tax purposes, if any such taxes are applicable. 10)

The attached Compensation Plan is hereby made a part of this Agreement.

IN WITNESS WHEREOF, that parties hereto, having read this entire Agreement consisting of three (3) pages, plus the attached Compensation Plan, have executed these presents in duplicate on this, the day and year first above written.

For more than twenty years Windermere has provided Brokers with access to a “qualified profit sharing” retirement plan with 18 mutual funds and 5 model portfolios.

Profit sharing plans are ideal for the self employed whose income varies month-­‐to-­‐month and year-­‐to-­‐year. Contributions are under your control. They can be changed, stopped or restarted as your income and financial situation warrants. Profit sharing plans allow self-­‐employed sole proprietors or partners, or incorporated individuals, to make discretionary contributions from earnings on a tax-­‐deductible basis. Taxes on earnings are deferred until the money is withdrawn from your account. Investment options in a profit sharing plan have the look and feel of a 401(k) plan. Who is eligible to Participate? All U.S. Windermere licensed brokers/agents are eligible to adopt and participate in the plan. The program accommodates those who are sole proprietors as well as those who have incorporated into S-­‐Corps or LLCs. Employees of participating agents may enroll under their broker’s plan. To make contributions and take 2016 deductions, adoption and enrollment paperwork must be filed on or before December 31, 2016. What are the contribution limits for 2016? Sole Proprietors: the lesser of 20% of modified net Schedule C profit or $53,000 in 2016. Incorporated Individuals (LLC, S-­Corps, C-­Corps): the lesser of 25% of eligible W-­‐2 compensation or $53,000 in 2016.
