“The 1999 is the greatest Palmer made since 1961, 1966, 1970, 1983, and 1989. It is one of the superstars of the vintage. The wine is a blend of 48% Cabernet Sauvignon, 46% Merlot, and 6% Petit Verdot. It boasts a staggering bouquet of violets and other spring flowers intermixed with licorice, black currants, and subtle wood. Only 50% of the production made it into the grand vin. This is a multidimensional, compelling effort with both power and elegance, it offers sweet tannin along with flavors that caress the palate, and a 45-second finish. “One of the candidates for wine of the vintage, this beauty has a dense purple color to the rim and a classic, noble nose of graphite intermixed with black currant, spice box, licorice, and red and black fruits. Medium to full-bodied with exceptional precision and definition, this beautifully textured wine stands out as one of the most successful wines of this irregular vintage.” WA (RP) 2005
“This is one of the great wines of the vintage, and certainly a candidate for one of the finest wines made at this estate under the management of Christian Seeley and proprietor AXA. Showing incredibly well at two tastings of 2000s, the wine has a dense bluish/ purple color and a beautiful nose of incense, melted asphalt, and creme de cassis as well as hints of new saddle leather and licorice. It is superbly concentrated and very pure, with excellent texture and opulence. The acidity seems low, the tannin high but wellintegrated. This is a compelling 2000 that is just closing in on its window of maturity and should stay there for at least 20 or more years. Bravo! 97 Pts.” WA (RP) 2010

“...Two recent tastings confirmed that this is the greatest Troplong Mondot between their profound 1990 and more recent vintages such as 2005, 2008, and 2009. Copious chocolate, graphite, blackberry, blueberry, cassis, and ink characteristics are present in this full-bodied, powerful, massive St.-Emilion. While the tannins are noticeable, they are better integrated than they were seven years ago, and the fruit, extract, and richness clearly outweigh the wine’s structure... 96 Pts.” WA (RP) 2010

“A genius for sure, Angelo Gaja can not be faulted for what he puts in the bottle. This work of art is worth every cent it will fetch. A virtually perfect effort is the 1997 Sperss (30,000 bottles), which represents the essence of truffles, earth, and black cherries in its striking aromatics and multidimensional, opulent, full-bodied palate. The acidity seems low because of the huge glycerin levels and prodigious concentration of fruit, but I suspect it is normal in the scheme of oenological measurement. This profound wine requires 3-4 years of cellaring, and should age well for 30-35 years. 99 Pts.” WA (RP) 2001

A S a i n t H e l e n a Th o ro u gh b r e d “I have followed Spottswoode since the debut release, and even vintages that seemed somewhat monolithic now appear to be evolving more gracefully. I have often made reference to the fact that while no California wine tastes like Chateau Margaux, the Spottswoode Cabernet possesses an aromatic profile, weight, and textural dimension that is vaguely reminiscent of that first-growth Bordeaux estate. This pure, fragrant wine depends on its beautifully layered fruit, ripeness, and balance to impress tasters, in contrast to those Cabernets that offer a blast of wood, glycerin, and alcohol. Recent vintages have been exceptionally successful.” WA (RP) 1996

“...exhibits sumptuous aromas of sweet saddle leather, cigar smoke, chocolaty black currants, and blackberries. It is sweet, rich, fullbodied, complex, and tastes like a Bordeaux on steroids. This is an enormously endowed, classic, distinctive cuvee that must be tasted to be believed. It represents a synthesis between France’s Medoc and Northern California’s ripe fruit. 96 Pts.” WA (RP) 2002

“The medium to dark ruby-colored 1999 Almaviva, a joint venture of the Baron Philippe de Rothschild and Vina Concha y Toro, has a Margaux like red currant, blackberry, and violet scented nose. While its fruit remains youthfully reticent in the mid-palate, this wine’s attack and finish reveals loads of red cherries, raspberries (both red and black), currants, and cassis liqueur. It is a well-structured, full-flavored, and mouth-coating wine armed with admirable concentration. Its tannin is exquisitely ripe, supple, and angle-free.” WA (PR) 2002

“I am always blown away by the 1959 Mouton, one of the greatest Moutons made in the last thirty-five years. Every time I have this wine it is undeniable that Mouton made a richer, more persuasive wine in 1959 than in 1961. Astonishingly young and unevolved, with a black/purple color, the wine exhibits a youthful nose of cassis, minerals, and new oak. It is exceptionally powerful and super-extracted, with the fruit supported by high levels of tannin and some lusty quantities of alcohol. 100 Pts.” WA 1998

“The 1983 Chateau Margaux is the wine of the vintage. Dense purple-colored, with a classic nose of acacia flowers intermixed crème de cassis as well as hints of blueberry, truffle, and licorice, the wine is full-bodied, with silky tannins, still very young, but stunningly complex aromatically, rich and long in the mouth, with a seamless integration of acidity, tannin, and wood. “The 1955 should be a vintage to buy at auction as I suspect the price is more reasonable than what such acclaimed vintages as 1959 and 1961 fetch. The color reveals no amber or rust, only a slight lightening of intensity at the edge. The nose offers up that explosive Mouton perfume of mint, leather, cassis, black olives, and lead pencil. In the mouth, there is stunning concentration, magnificent extraction of fruit, and plenty of tannin in the long finish. The wine still tastes remarkably young and could easily last another 20-30 years. Amazing! 97 Pts.” WA (RP) 1994

“Stunning, massive, full-on, classic La Tache nose that displays almost unbelievable complexity so with many different elements that it is impossible to even begin to describe them all; the primary components include ethereal and still fresh pinot fruit, clove, knock out spiciness, anise, hoisin, soy and a trace of earth but these elements only hint at the sheer depth. The flavors are big, rich, refined, classy, penetrating and superbly powerful yet everything is in perfect balance and there is more than sufficient sève to balance off the still considerable tannins. The finish is intense, pure and so long that it is haunting; I can literally still taste this wine days later after I had it because it has such a dramatic and emotional impact. This is one of the finest, perhaps even the finest young Burgundy I have ever been privileged to try and it only seems to get better with each passing year. 99 Pts.” BH 2009

It is so unresolved by imperceptibly it coalesces into the wonderfully pure, floral Pinot bouquet. But this is after two hours in my glass! The palate is filigree tannin, displaying just a hint of saddle-leather, but very youthful red-berried fruit leading to a bashful, stoic finish. Margaux, premier cru classe “The 1986 Margaux continues to be the most powerful, tannic, and muscular Margaux made in decades. One wonders if the 1928 or 1945 had as much power and depth as the 1986? The black/ ruby/purple color reveals no sign of age. The reluctant nose offers up aromas of smoky, toasty new oak and black currants, as well as a few flowers. The wine is mammoth, with extraordinary extract, superb balance, and a frightfully tannic finish. This is a Margaux of immense stature, made in a masculine, full-bodied style... 96 Pts.” WA (RP) 1998

“The 1982 Lafite possesses a dark, dense ruby/purple color with only a subtle lightening at the rim. Spectacular aromatics offer jammy cherry and black fruits intertwined with lead pencil, mineral, and smoky wood scents. Powerful for a Lafite, this wine unfolds to reveal extraordinary richness, purity, and overall symmetry in addition to stunning flavor depth and persistence. The finish lasts for nearly a minute. Plenty of tannin remains, and the wine displays a vibrancy and youthfulness that belie its 18 years of age. The modern day equivalent of Lafite-Rothschild’s immortal 1959, the 1982 will enjoy another 30-70 years of life! An amazing achievement! 100 Pts.” WA (RP) 2000

Pauillac, premier cru classe
“Close to perfection, the saturated blue/black-colored 1997 Maya exhibits complex aromatics of creme de cassis, smoke, spice box, iron, and espresso. The wine has a viscous texture, huge, concentrated, ripe fruit, remarkable body, and a seamless, multilayered finish. The tannin, acidity, and alcohol are all beautifully integrated. This is profound stuff! 99 Pts.” WA (RP) 2000
“This wine remains one of the legends of Bordeaux. It has thrown off the backward, youthful style that existed during its first 25 years of life, and over the last 4-5 years has developed such secondary nuances as cedar and spice box. The creme de cassis, underlying floral note, full-bodied power, extraordinary purity, multilayered texture, and finish of over a minute are a showcase for what this Chateau accomplished in 1982. The wine is still amazingly youthful, vibrant, and pure. It appears capable of remaining fruity and vibrant in 2082! “ WA 100 Pts. 2009

Napa Valley “The 1997 Harlan Estate is one of the greatest Cabernet Sauvignon-based wines I have ever tasted. A blend of 80% Cabernet Sauvignon, with the rest Merlot and Cabernet Franc, this enormously-endowed, profoundly rich wine must be tasted to be believed. Opaque purple-colored, it boasts spectacular, soaring aromatics of vanilla, minerals, coffee, blackberries, licorice, and cassis. In the mouth, layer after layer unfold powerfully yet gently. Acidity, tannin, and alcohol are well-balanced by the wine’s unreal richness and singular personality. 100 Pts.” WA (RP) 2000

“Coming out of a relatively dormant state, this 2000 is a spectacular Cheval Blanc. Of recent vintages, I think only the 2009 can give it a run for its money. A blend of 53% Merlot and 47% Cabernet Franc, the wine has a sweet nose of menthol, melted licorice, boysenberry, blueberry, and cassis. A broad wine with compelling purity, a layered texture, and sweet tannin, with hints of coffee and earth in the background, this is by far the best Cheval Blanc since 1990 and before 2009. It is a legend in the making and can actually be drunk now, as the tannins have nearly melted away. This is a beauty with incredibly complex aromatics. 99 Pts.” WA (RP) 2010

The wine is massively concentrated, still black/purple-hued to the rim, and offers a nose of incense, blackberries, blueberry liqueur, acacia flowers, and forest floor. Margaux, troisiemes cru classe “Palmer has done a magnificent job with their 1989, which continues to be a wine of immense seduction. The expansive, rich, fat texture owes its opulence to the high percentage of Merlot used by this property. Opaque deep ruby/purple, this full-bodied, satiny wine has considerable alcoholic clout, is low in acidity, but splendidly concentrated and abundantly full of velvety tannins. It will be fascinating to see if this wine ultimately rivals the great Palmers made in 1983, 1970, 1966, and 1961. This is a thrilling 1989! 96 Pts.” WA (RP) 1994

Pauillac, premier cru classe “...a prodigious effort, it boasts a saturated purple color as well as a gorgeous perfume of smoke, cedar, creme de cassis, flowers, crushed rocks, and blackberries. Massive and multi-layered, with huge richness and low acidity, it is about as unctuous as a young Latour can be. It could be compared to the 1982, but it may be even more pure, at least at this early stage, than that monumental wine. “A deep garnet hue. The nose is lovely with cedar, freshly picked mint and blackberry leaf. The palate has good depth, very wellbalanced with a “solid” rather than “hollow” middle. Masculine, good weight, blackberry leaf and tobacco towards the linear, tannic finish. It just fades a little on the finish when I thought it would go on and on. Now that the 1988, 1989 and 1990 vintages have had some time in the bottle, it appears that the light to medium gold colored 1990 may be the most complete and botrysized among this trio of exceptional wines from RaymondLafon... Although there are no Red Label Riservas from Giacosa in 2005, the wines display remarkable quality across the board. The 2005 Barbaresco Santo Stefano is striking in its beauty. This firm, structured wine bursts from the glass with layers of dark red fruit, spices, flowers and menthol. “Grattamacco must surely be regarded as one of Bolgheri’s historic properties. The estate’s first vintage was 1978, well before the area became the fashionable spot it is today. The wines are made under the direction of consulting oenologist Maurizio Castelli. Unlike many of its neighbors Grattamacco has always included a portion of Sangiovese in its wines with the goal of maintaining some regional typicity. 1985 was a benchmark year in the early development of Bolgheri, as it was a great vintage for Sassicaia, the region’s most iconic wine, and also the first vintage of Ornellaia.” WA (AG) 2009

He makes a tiny quantity of late-harvested, extremely rich, concentrated 100% Cabernet Franc. Perhaps the only way I can effectively articulate what this wine tastes like would be the following: imagine Cheval Blanc (1) picked at even higher sugars than it was in a great vintage like 1990 or 1982, (2) given more aging before release, and (3) bottled with no fining or filtration! ...one of the rarest, most provocative, and profound dry red wines to emerge from Italy.” WA (RP) 1996

A rich ruby with light garnet highlights, the powerful and expressive nose of red fruit, herbs, and leather is matched by an equally important palate, of major intensity and concentration, warm and round with impressively defined Sangiovese fruit and much complexity on the lengthy, and intense finish.” WA (DT) 2005

Umbria “One of the greatest pleasures in my professional life over the past fifteen years has been the discovery of the wines of Marco Caprai and, through him, the tremendous potential of Sagrantino, at the time a totally unknown grape which no one, even in the wildest stretch of his imagination, could have ever considered a variety capable of giving some of Italy’s greatest wines... The 2000 Montefalco 25 Anni simply multiplies all the elements exponentially with roomfilling aromas of sweet berry fruit and perfectly integrated oak and a mouth-coating cascade of ripe fruit, powerful, dense, and sensual tannins in a swelling flow of unrelieved pleasure. 97 Pts.” WA (DT) 2007

“This hedonistic Cabernet Sauvignon’s saturated purple color is accompanied by an exuberant, sweet, enveloping fragrance of smoky new oak, and jammy blackberry and cassis fruit. In the mouth, this lavishly wooded, black fruit-filled Cabernet is extremely fullbodied, with superb levels of fruit, glycerin, and extract. Like many 1994 Cabernet Sauvignons, it possesses extraordinary equilibrium, with the sweet tannin giving the wine considerable accessibility. The finish lasts for nearly 30 seconds. “I cannot recall a disappointing vintage of the Private Reserve... always at least 97% Cabernet Sauvignon, and aged for 22-24 months in 100% new French oak. One of the common threads I find in the wines is a smoky, chocolatey, licorice character that works well with the lavish quantities of fruit and glycerin these wines possess. One of the safest choices a consumer can make, the Private Reserve has been a consistently fine and accurate representation of Cabernet’s varietal characteristics.” WA (RP) 1998

“I have had a difficult time keeping the corks in my bottles of 1994 Dominus... a strikingly thick, compellingly rich wine with the texture of a great Pomerol, despite being made primarily from Cabernet Sauvignon. The wine exhibits a dense purple color, and an incredibly fragrant nose of jammy black fruits, spice, smoke, and loamy, truffle-like scents. In the mouth, it is full-bodied, with thrilling levels of extract and richness, but no sense of heaviness or harshness. This seamless Dominus possesses no hard edges, as its acidity, tannin, and alcohol are beautifully meshed with copious quantities of ripe fruit. This wine offers early drinking, yet has the potential to last for 30+ years. 99 Pts.” WA (RP) 1997

“The deep opaque purple color, and tightly wound nose and flavors still reveal enough profound aromas and flavors to mark this as one of Mondavi’s most sensational efforts. The nose possesses a Margaux/Mouton-like cassis, lead pencil, floral aroma, backedup by copious quantities of blackcurrant fruit. In the mouth, my notes said, “great stuff.” The wine is full-bodied, layered, multidimensional, and astonishingly well-balanced, with an inner-depth and core of exceptional richness and intensity. “The 1994 Cabernet Sauvignon Hillside Select, is a prodigious Cabernet. I had it at a tasting in Japan, and the Japanese were as enthusiastic about it as my rating suggested they should be. They were crestfallen when informed they probably would not be able to buy multiple cases of the wine! The 1994 combines the vintage’s spectacularly ripe, luscious fruit with a rarely seen degree of elegance and finesse. The wine is extremely rich, as well as gorgeously poised and graceful. The saturated ruby/purple color is accompanied by Medoc-like, lead pencil aromas intermixed with cassis, cedar, minerals, and spice. I wrote the word “great” four different times in my most recent tasting note, which mirrored every other tasting note I have. It is full-bodied and seamless, with a silky texture, voluptuous richness, and fabulous purity. The finish lasts for over 40 seconds. 99 Pts.” WA (RP) 1998

“While such statements are difficult to make for a variety of reasons, the ‘49 de Vogüé Musigny is one of the greatest red Burgundy of my lifetime and writing a tasting note about such a wine is frankly impossible because mere words cannot possibly capture its greatness. This is not because we lack descriptors for its sensorial brilliance but rather because wines such as this are emotionally thrilling experiences. They touch you in a way that is impossible to adequately communicate. Superlatives such as “awesome”, “stunning”, “astonishing”, “fantastic”, “otherworldly”, etc. really only give a superficial notion of just how dazzling this wine is... 99 Pts.” BH 2007

Cote de Nuits, grand cru one 5.5 cm, one 6 cm, one 7 cm, one 7.5 cm “From 90 year old vines in a parcel measuring .32 ha... This arguably possesses the most interesting and complex set of aromas in the entire range, which given that there are close to 50 wines reviewed in 2007, and most of them top flight, is really saying something. A kaleidoscopic nose is just knock out in terms of its depth and breadth with a striking spiciness to the ripe red, blue and black pinot fruit trimmed in bits of earth, cassis and underbrush, all of which continues onto the incredibly rich, powerful and mouth coating flavors that are at once seductive and serious, all wrapped in a textured finish that seems to go on and on. Southern Rhone “Decanted several hours in advance, the 1989 Henri Bonneau Réserve des Céléstins was pure essence of old Grenache, revealing notes of smoked herbs, sweet, bloody meat, plums, licorice, sweet cherries, and some blacker fruits. As the wine sat in the glass, additional roasted meat and truffle aromas arose. Full-bodied, fresh, lively, gorgeously pure, and rich, this is a monument to old style Châteauneuf du Pape. 100 Pts.” WA (RP) 2007

Southern Rhone “One of the greatest wines ever produced ... anywhere ... is the 1990. Having consistently merited 100 points (if my scoring system went higher, it would be there), it continues to perform like a young wine, yet is accessible enough to be appreciated for its extraordinary combination of power, complexity, and majestic layers of flavor. The color is a dark plum/ruby to the edge. The monumental bouquet offers up aromas of liquified charcoaled beef intermixed with pepper, smoke, creme de cassis, kirsch liqueur, truffles, and new saddle leather. This full-bodied, viscous, prodigious Chateauneuf du Pape must be tasted to be believed. It is more like a food than a beverage. 100 Pts.” WA (RP) 2003

Exotic Elixirs Handed Down Through the Generations
Cote de Beaune, grand cru
This amazing cellar, owned by the same family and handed down through three generations, features some incredible finds with impeccable provenance. After the passing of the original owner in 1984, these bottles remained untouched in a locked cellar for 20 years. We were able to borrow and photograph the original catalogs and brochures dating back to 1938 showing provenance for where these wines originated. Upon request, photocopies of these documents can be provided to interested bidders. Some of the highlights from this cellar include sparse vintages of Yquem and a highly unique and rare bottle of 1934 DRC Romanee Conti. These wines were removed from a subterranean wine cellar two levels below ground.
“Scents of lily, honeysuckle, and hyacinth grace a Coche-Dury 2007 Corton-Charlemagne that is as wafting in floral perfume, buoyant, vivacious, and generous as any young wine from this formidable, often youthfully forbidding appellation (not to mention any of Coche’s) as I can recall. There is a lovely creaminess here, along with savory, saline and almond and pistachio oil elements, underlying juicy fresh apple and lime. This finishes winsomely, with its sheer persistence spelling grand cru. 95 Pts.” WA (DS) 2009

The aromas just soar from the glass with dazzling freshness and nuance plus layers upon layers upon layers of superbly detailed violet and spiceinfused aromas. The nose was literally so captivating that I didn’t even taste the wine for almost 20 minutes, which then revealed deep, sweet and impossibly rich and pure medium full flavors that culminate in a palate staining and hugely long finish. Neck Levels for Bordeaux and Bordeaux Shaped Bottles Neck Level – The level is into the neck of the bottle. This is a normal level for wines less than 10 years old. In wines 10-30 years old, a neck level usually indicates pristine storage history. BN – Bottom Neck level: acceptable for wines 10-20 years old. In bottles 20-30 years old, a base neck level is an excellent level and usually indicates excellent storage history. VTS – Very Top Shoulder level: acceptable level for wines 20 to 30 years old. Considered excellent for bottles older than 30 years.
68
Generally indicates that a wine has been properly cellared.
acceptable level. For bottles with excellent storage history, risk of oxidization is low.
TS – Top Shoulder level: acceptable for wines 30-40 years old. In bottles older than 40 years, a top shoulder level usually indicates proper storage.
MS – Mid Shoulder level: acceptable for wines 60 years old or older, unless they were previously re-conditioned. If the cork is sound and the bottle has an excellent storage history, risk of oxidization is low to moderate.
US – Upper Shoulder level: acceptable for wines 40-60 years old. In bottles older than 60 years, an upper shoulder level usually indicates excellent storage history. For mid 20th century or older wines that have not been reconditioned, this is considered an
LS – Low Shoulder level: usually an indication that the wine is spoiled. Bottles with this level are rarely sold by reputable auction houses.
Buying at WineGavel Neck Levels for Burgundy and Burgundy Shaped Bottles Measurements are normally taken below the cork, if visible. 1.5 cm or better: normal level for wines that are 10 years old or less and a good level for wines aged from 10-20 years. 2 to 3 cm: acceptable level for wines 10-25 years old and an exceptional level usually indicating excellent storage for wines more than 25 years old.
3 to 4 cm: acceptable level for wines 25-40 years old and a very good level for wines older than 40 years. 4 to 5.5 cm: acceptable level for wines 40-60 years old and an excellent level for any wine older than that. Cork condition and clarity of wine need to be taken into account for wines with this level of ullage and are sometimes noted in the cataloguing process.
6 cm or more: generally considered acceptable for wines older than 60 years. Storage history is highly relevant for bottles with this degree of ullage.
Tasting Notes Tasting notes marked with “BH” are from Allen Meadows’ Burghound.
Tasting notes marked with “WA” are from Robert Parker’s Wine Advocate.
Tasting notes marked with “WS” are from the Wine Spectator.

Special Notes Often producers in Burgundy fill their bottles close to the top of the bottle. This practice sometimes results in some seepage when the cork is inserted. Unless the ullage is severe for the age of the wine, seepage for Burgundy or for wines in Burgundy shaped bottles is usually not a sign of poor storage.
B ottle S izes
Special Notice WineGavel Fine and Rare Wine Auctions makes every effort to evaluate and measure the ullage levels on wines more than 25 years old, but sometimes corks in older wines can loose their elasticity, causing slight variations in the level from the date of inspection until the date of sale. In rare instances, corks in very old bottles can fail during shipment. Please be aware that shipping insurance does not cover corks falling into the bottle during transportation.

Buying at WineGavel C onditions of S ale Bidders should read through the “Conditions of Sale” printed in this catalog as they state the terms of purchase of all lots sold by WineGavel. C atalog L ayout Wines are normally grouped by individual consignments and introduced by a heading that provides information about the storage history and provenance of the wines. Each lot contains information about the wine, size, and quantity of bottles. An index listing all of the wines grouped by region is posted at the end of the catalog. C ataloging and D escription of W ines WineGavel makes every effort to verify that all wines were properly stored prior to being delivered to our temperature and humiditycontrolled warehouse. Every bottle has been diligently inspected by the WineGavel team and then described as accurately as possible at the time this catalog was published. Buyers of older and more fragile wines are advised to take proper considerations for natural variations of ullage and general condition. No returns will be accepted as stated in the Conditions of Sale. Tasting Notes From time to time we use tasting notes in our catalogs from some of the world’s leading wine publications. Where applicable we insert the initials of the individual critic who reviewed the wine in parentheses following the publication title. For example WA for Robert Parker’s Wine Advocates and (RP) for Robert Parker himself or (AG) for Antonio Galloni.
70
A uction Value E stimates Each lot contains an estimate with the expected range of prices that the given lot may sell for. Conditions of Sale Premium and Payment The buyer’s premium for WineGavel™ Fine and Rare Wine Auctions is 19%. Payment is due within 14 days after each sale. Please see “Buying at WineGavel” for further instructions on payment for wines. 1.800.774.2130 415.283.3236 info@WineGavel.com
PLEASE NOTE: We will not be held responsible for typographical errors on lots, and reserve the right to withdraw such lots from each sale. C onditions I. All estimates are per lot as numbered in the catalog. We reserve the right to withdraw, divide or group lots prior to sale. WineGavel™ and/or the auctioneer may have a direct or indirect ownership interest in any or all lots in the sale resulting from ownership or purchase by WineGavel™ of the lots (or an agreement to purchase), or from an advance of monies or property to the seller, or a guarantee of minimum proceeds made by WineGavel™ to the seller. II. The highest bidder shall prevail. Should any dispute arise between bidders, the decision of the auctioneer as to the successful bidder and the re-offering or resale of the lot under dispute shall be final. The auctioneer shall regulate the bidding and reserves the right to refuse any bid believed by him not to be made in good faith. Any bid which is merely, or which is merely a nominal or fractional advance over the previous bid, may be rejected by the auctioneer, at his discretion. Neither we nor the auctioneer shall be liable for errors and omissions in executing instructions to bid, whether caused by our negligence, the auctioneer’s negligence, or otherwise. III. Any lot in this sale may be subject to a reserve. The auctioneer or its agent shall have the right to bid on behalf of the seller for any lot subject to a reserve. The auctioneer may open bidding on any lot by placing a bid on behalf of the seller or the auctioneer and may further bid on behalf of the seller or the auctioneer by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. Any “hammer” price listed is the price for which a lot closed on the floor at the sale (or a reserve price), and such prices do not indicate whether or not any lot met its reserve price if such a price had been established. Bid only as much as you are prepared to pay as in most cases, bidders will pay their top bid. IV. E-Mail, Fax, or Telephone Bidder. A successful e-mail, fax or telephone bidder will be notified of lots purchased and must remit payment before the lots are shipped. Payment must be received by us within fifteen (15) days of notification. Delivery to a successful bidder will be based on the instructions given by the customer in the “Collection and Delivery Form” which will be included with payment. V. Title shall not pass to the buyer until full payment is received by WineGavel™. VI. If a bidder shall fail to comply with these Conditions of Sale, then, as to any lot with respect to which such failure to comply occurs, we shall be entitled (but not obligated), at our sole discretion, to resell the lot or cause it to be resold by public or private sale, without notice to the bidder and in any manner of sale (whether or not commercially reasonable), and to hold the non-complying bidder liable for any deficiency in the purchase price attending such resale, as well as for all charges, costs and expenses incurred in both sales, and all incidental damages. In no event shall any surplus arising from such resale be payable to the non-complying bidder. VII. If WineGavel™ takes any action to enforce these Conditions of Sale, or to secure payment of any amount due to us from a bidder or purchaser, the defaulting bidder or purchaser shall be liable for all legal and other costs and expenses incurred by us, including but not limited to reasonable attorneys’ fees. VIII. Successful bidders agree to pay for lots as specified above and no credit will be extended. A late payment charge of 1 1/2% per month shall be imposed on overdue payments. A minimum monthly surcharge of $10 shall apply. All lots purchased in California are subject to sales tax, unless the purchaser is a licensed entity, in which case any and all documentation regarding that entity’s license(s) must be submitted to WineGavel™ prior to each sale. A 19% Buyer’s Commission will be added to all purchases. Lots will be considered as paid when all fees, including but not limited to, shipping, handling, late charges, purchase price, commissions, and any and all sales or use taxes are paid in full. IX. All agents will be personally liable and responsible for the purchases of those persons they represent, and for other costs and expenses which would be the responsibility of the buyer under these terms and conditions.
74
X. Under no circumstances, including, but not limited to negligence, will WineGavel™, its officers, directors, employees, agents, or affiliates be liable to any bidder or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages (including, without limitation, damages for loss of business, loss of profits, loss of opportunity, or business interruption) arising out of participation in any auction, or the placing or acceptance or rejection of any bid, or the sale (or failure to consummate a sale) for any lot or lots, or resulting from failure or breach of security, mistakes, omissions, interruptions, deletions, or loss of files or data, errors, defects, delays in operation or performance, regardless of the cause including, but not limited to, acts of God, communication failure, theft, destruction or unauthorized access to WineGavel™ Fine and Rare Wine Auction’s computer network, programs or services, or for any claim by any other party. Not withstanding anything to the contrary in this agreement, the exclusive remedy for all damages, losses and causes of action which a bidder or other person or entity participating or involved in any auction may incur or suffer, whether in contract, tort (including negligence), equity, at law or otherwise, shall be to recover damages in an amount that is not in excess of the wholesale value of any lot that may be the subject of any such dispute. XI. In the event of any dispute under these Conditions of Sale, or any dispute between the auctioneer and bidders, or between any parties requesting inspection of any of the lots of the auctioneer, or between persons offering their lots to be auctioned and the auctioneer, the exclusive jurisdiction and venue over any such dispute shall be in the Federal and state courts having jurisdiction and located in San Francisco, California, the parties waiving any other jurisdiction or venue to which they may be entitled. XII. The auction is being conducted by WineGavel™ and no individual auctioneer, employee, office or director of WineGavel™, shall be held to any personal liability hereunder for negligence or otherwise. XIII.The placing of a bid shall constitute acceptance and agreement of these Conditions of Sale. XIV. Warranty Information, Buyer’s Remedies: (i) All property is sold “as is”, and neither WineGavel™ nor the consignor make any guarantees, warranties or representations, expressed or implied, with respect to the property, except as to warranty of title. WineGavel™ will only accept returns in the instance of an obvious or egregious cataloging error on the part of WineGavel™. Buyers will have 14 days after the sale to bring forth any issue regarding any lot. (ii) Neither WineGavel™ nor the consignor make any representations or warranty of any kind, expressed or implied, with respect, but not limited to any of the following characteristics of the property: age, authenticity, provenance, physical condition, importance, size, quality, quantity, parity, value, historical references or significance, material, source, or origin. (iii) All information in the catalog or elsewhere, concerning the characteristics mentioned in (ii) above, is offered to the bidders as a statement of opinion only. It is not intended to contain statements of fact for which we or the consignor may be held liable. This disclaimer of liability on our part applies whether the information is included in the catalog, advertisements, announcements, or communicated through our representatives, bill of sale or elsewhere, and whether written or oral. (iv) Neither WineGavel™, nor the consignor, shall be responsible for ensuring the correctness or accuracy of descriptions or other information in this catalog or elsewhere. The bidder assumes the full responsibility to inspect and evaluate the Property to his or her complete satisfaction prior to any purchase. The bidders and buyers must make an independent judgment about (1) the Property, (2) its value, and (3) descriptions or other information about the property. We may, without in any way diminishing the disclaimers of liability contained in this Paragraph and elsewhere, mention in the description of the lot, significant damage, although this does not include all faults, imperfections and deficiencies. (v) Neither WineGavel™ nor the consignor make any warranty or representation, express or implied, concerning the re-marketing of any wines purchased at our auctions. (vi) The estimates provided by WineGavel™ are merely our opinion of the price that a willing buyer might pay for the Property at auction. The actual price that might be realized at auction or upon sale of the Property may be substantially different from these estimates. We shall not be liable in any way for such estimate or differences in the final selling price. (vii) If there is any breach of a warranty of title, buyer’s sole remedy shall be to rescind the sale and receive a refund of the purchase price, including the buyer’s commission. This means that neither we, nor the consignor, shall have any liability for other damages, such as but not limited to , direct, indirect, special, incidental or consequential damages. No refund will be made until the Property is returned at buyer’s expense to the premises of WineGavel™ or where the Property was purchased in the same condition as the Property was in at the time of the sale. We act only as an agent for the consignor and make no independent warranty of any kind.
