President’s Message -
What a GREAT Summer! As the summer of 2010 winds down, I reflect and acknowledge that it has been a great summer! I was very fortunate to be able to attend the NAA Conference and Show (C&S) in Greensboro in July. While there, I was able to attend extremely informative sessions, take the Benefit Auctioneer Specialist (BAS) course, and meet some very talented auctioneers. In August, we had our VAA Mid-Year Seminar in Sandston. I want to thank Brian Hash and Dubby Isgett for a fantastic job in organizing a packed day of informative education and fun. Brian assembled impressive speakers for 6 hours of continuing education and Dubby, along with his cadre of volunteers, organized a first-class Virginia State Championship contest. Special congratulations to Benjamin DeBruhl for winning the 2010-2011 Virginia State Championship and a job well done to all of the contestants who made this a top quality competition. I want to also extend our thanks and gratitude to George Daniel and N & W Salvage for once again hosting the contest. urday evening was wonderful and George and his crew did a superb job. The message I took away from the NAA Conference and Show, as well as our Mid-Year Seminar was how the Internet has become such an essential part our business. From “online only” personal property auctions to “live and online” simulcast auctions, the impact of the Internet is growing more and more in our daily business. Many auctioneers at the Mid-Year stated that they are using services such as www.Proxibid.com and www.BidSpotter.com for online and simulcast auctions. I urge you to “get on board” with these services if you have not already done so. The Internet has allowed us to spread the word much farther and faster than previous methods such as newsprint, and at a fraction of the cost. Local auctioneers are now having buyers from locations such as Australia, Canada, and the U.K. participate in their auctions. One of your benefits of being a member of the VAA is that you can post your auctions on the VAA website for free which is hosted
Ernie Rogers Midlothian, VA through www.AuctionServices.com. Again, this is a free service and it is one of your membership benefits. Your website doesn’t have to be hosted through www.AuctionServices.com to utilize this service. Once your auction is posted on the Ignite system, the folks at www.AuctionServices.com will “push” your auction out to many other websites automatically to include such sites as www.AuctionZip.com and www.Auctioneers.org. If you post your auction to www.AuctionZip.com Continued on Page 22

Honest Success
I
t is a perfect day. Clear skies overhead, a large, colorful crowd has assembled and curiosity has led each to the large assortment of interest to be sold today. Dogs are on leashes, children have found their own entertainment, food vendor in place, and the starting time draws near. I assess the event and everything looks promising. Before I take my place and turn on the microphone. I pause for a moment to assess myself and my role today. There are many great auction companies in business today. Personally, I have a great deal of experience as an auctioneer. Our company name is new to the area, but our faces are not. Should that make a difference to the crowd that I am about to address? I think about the consigners when I am explaining the contract terms and proposed date of auction. In that explanation, I want the honesty in writing, and the contract to expand to a reasonable assurance that for one day I am their agent. I am striving to represent the person and their items offered for auction while working toward the best price I can receive for that item/ lot. Honesty in any business
equates to success. Many auction companies have overlooked the simple promise between you and the client. It is that credibility, accountability, and responsibility that I want to project to my audience. I am the maestro; the one in charge to find the bigger and hopefully, secure a price for the item that is worthy and fair. There is a mindset among most people regarding name brands or name that are familiar. What about the lesser known? Should the public distrust those that do not have their name in the local newspaper each week? There was a time that America conducted business on a handshake. The lesser known, and the newcomers struggle to compete with the flash of the good old boys. The old adage “more bang for your buck” comes to mind. Consigning with the upper echelon of auction companies means people are comfortable with the familiar names. Why would you wear a plain shirt when you could wear on with “Polo” written on the material? The crowd is restless; the time is near to explain the terms and conditions of the auction today. As I stand before all, I will project a genuine ex-
Bo Cox King George, VA tension of trust from myself to the audience. I want to ignite a reputation that will follow me. It is my promise to stand before my peers as an honest man. One who can humbly stand to answer to a higher being; that I am trustworthy and let no one second guess my integrity. In closing, I hope that each new auction firm conducts themselves with honesty and integrity in every aspect of their business. For it is my belief that with these two key ingredients and some hard work, success will surely come your way. Bo Cox VAA Director

Does Fast Bid Calling Make You A Good Auctioneer?
hen most people think of an auctioneer, they think of the bid calling and how fast you can talk. However, does this make you a good auctioneer? Summer and fall are the times for most local county fairs and their 4H and FFA Livestock auctions are in full swing with Livestock projects being sold at auction. I have been attending and working some of these county fair livestock auctions and have been horrified of what I’ve seen from auctioneers that have been trusted to work for the many 4H and FFA youth. Yes, work for the youth even though they have “volunteered”, in my opinion, you are still working for a seller no matter if you are paid or not. I have seen these auctioneers use the youth livestock auctions as a bid-calling contest. They come in with big egos, call themselves good bid callers, and fly thru the lots with little care as to how much they ultimately get for the youth/seller, just to make themselves look good. They compete with the other auctioneers and try to outdo them in their speed of selling. This however is at the expense of the youth, who have put a lot of hard work, time and money into their projects. Are these auctioneers doing this to impress
the child they are selling for or their parents? Do they think this will ever lead to them being hired for their auctioneering services down the road? I think it would not. Remember it is very important to be the professional auctioneer first, the good bid caller second. We must never forget we work for the seller, no matter who that is or what type of auction setting that may be. When we work as a professional for the seller, this ultimately results in higher earnings for them, which in turn is payment for you. It may be the result of you being hired in the future vs. someone else It is important to also remember you never know who is in the crowd watching. The livestock fair auctions usually bring out many of the local businesses, other profession services IE; Realtors, Politicians, Lawyers, etc. Every time you speak into a mic, it could be an interview and you not even know it. In a world today where everyone thinks only “me, me, me”, remember your actions can affect all of us in the auction business. Always remember to project yourself to the public – both buyers and sellers – as the professional auctioneer, not just a fast bid caller. This will in return leave a good impression
“Remember it is very important to be the professional auctioneer first, the good bid caller second.”
Brian Hash Berryville, VA for not only you as the auctioneer and your business, but also the auction profession as a whole. Each one of us needs to leave a positive impression on the public as auctioneers, each time we can. So that the people look at our industry as an asset and we can change their views to become the First Choice, rather than the last resort. PS: I would like to thank those of you that attended the Spring and Mid-Year seminars hosted by the VAA. I hope you were able to get some value out of the educational seminars. Thanks to those of you that have been of help to me with putting on theses seminars. Remember to mark your calendars for January and our Annual VAA Convention in Richmond VA. John Nicholls Elected to National Auctioneers Board Fredericksburg, VA – Nicholls Auction Marketing Group, Inc., (www.nichollsauction.com) announces that the National Auctioneers Association elected John Nicholls of Nicholls Auction Marketing Group to its Board of Directors at its recent 61st International Auctioneers Conference and Show held in Greensboro, NC. The NAA is the auction industry’s largest trade association with over 4,000 members. Nicholls said that he saw his role as one of service, commitment and dedication to professional at its highest level. “I do not know if one person can make a monumental difference in an entire organization,” stated Nicholls. “However, I do believe passionately that one person who is willing to work together with other team members can accomplish amazing things. Service must be priority number one.” In his speech before the NAA election, Nicholls said he would diligently promote the auction profession and its association to enhance its image to the general public and the business world. As president of Nicholls Auction Marketing Group, Inc., Nicholls oversees all day to day operations of the company. I’ve got an auctioneer here, will anybody give me two? In 1960, the Hickory Ruritan clubhouse on South Battlefield Boulevard took a beating from a storm. Repair money was scarce. Then farmer Jack Peoples had an idea. “Let’s have an auction,” he said and he volunteered to be the auctioneer. When it was over, there was $1,800 in repair money plus a new career for Peoples. In 1961, he got a license and today he and his son Wesley operate one of the best-known auction companies around. Jack is not as active as he was but I tested him. He can still roll out the syllables faster than a jack rabbit headed downhill. First, I had to clear up a major issue. How come Jack and Wesley don’t call themselves colonels? I thought that was practically mandatory for an auctioneer. In fact, Jack’s diploma from the Arkansas auctioneering school he attended in 1961 was signed by nine colonels. Turns out that neither Jack nor Wesley are hung up on titles but they did explain the practice of auctioneer colonels . During the Civil War, only colonels were authorized to hold auctions and a tradition was born. Jack, 77, grew up on Head of River Road where his home and business is today. Wesley, 47, joined the business in 1982 and – I checked – can rapid-fire chant just as well as his daddy. But Jack explained the lickety-split linguistics are for the more professional ears. He’ll slow down for something like a charity auction. OK, what was the most expensive thing he ever auctioned? A $1.3 million commercial building. What was the oddest? An electric chicken plucker. It sold for $50, but only after they figured out what it was. Another oddity was a coffin with a mannequin inside. It had been at a gas station under the sign “Don’t let this happen to you.” I asked for advice to pass on to would-be auction buyers. Answer from both Jack and Wesley: know the value of things. If you don’t, you might end up paying more for a used item than it would cost new. And since bids can be made by silent gestures they have another warning: “Don’t swat flies at auctions.” Bidding wars are dangerous, too. One time they were holding an auction in a private home. A man in one corner of the room and a woman in another corner of the room were bidding busily against each other. Suddenly, the woman realized the man she was bidding against was her own husband. Jack cut them a break. He started the bidding Page 10

over.
I have a favorite auction story of my own and I had to tell it to them before I left. Back in 1981, the tobacco-busy city of Danville held a contest to determine the world’s greatest tobacco auctioneer. It was a spirited display of serious gibberish and, when it was over, a nice young guy had won. He accepted the trophy with tears in his eyes. After the ceremony, I cornered him for an interview. “I noticed you had tears in your eyes,” I said. “It must have meant a lot to you to win.” But the tears were not emotion. That’s when the man just named “World’s Greatest Tobacco Auctioneer” confessed to me that he was allergic to tobacco. After one year, Dixon’s Auction owners sold on Powhatan By Roslyn Ryan Editor, Powhatan Today Like so many of us, Billy Dixon usually has no idea what awaits him when he hears the familiar ring of the telephone on his desk. The difference is, most of us don’t get someone on the other end of the line offering us the entire contents of their home. Or a car. Or a pair of what the caller thought were yard-sale-quality bookends that turned out to be worth around $500 each. No, none of these things would happen to most of us on a typical day. But for Dixon, who moved Dixon’s Auctions from Midlothian to Powhatan with his father Ed just over a year ago, it’s all in a day’s work. The woman who called last week about the contents of the house wasn’t exactly giving it to Dixon of course; like all of his customers, she wanted the company to sell it for her, giving her 60 percent of what it all sold for. There are a number of reasons someone might do this, said Dixon last Wednesday, sitting in his office above the auction floor in the still-shiny-new Dixon’s Auction building on New Dorset Circle. People will often call after a loved one has died and they need to find a way to handle decades’ worth of furniture and belongings. Other times, particularly in this economy, people are simply trying to scare up some extra money by selling things they don’t need. Then there was the recent pair who called Dixon as they prepared to tie the knot. Each had been married before, each had a house full of stuff, and neither wanted to hang on to anything that reminded them of their former spouse. So Dixon got all of it. The items Dixon collects go on the auction block every Wednesday at 4 p.m. You can expect to see just about anything come up for bid, he explained, from small house wares, to estate jewelry, to full bedroom suits. The least expensive thing they have sold, he guesses, was probably around $2. The most expensive? A silver coin – circa 1895 – that recently went for $26,100. Business has been steady since the company moved from Midlothian into its new location just over a year ago, said Dixon. They recently added an auto auction site across the street from the main auction house, The troubled economy has touched them as it has everyone, admits Billy, but he’s encouraged by the warm welcome they have received in Powhatan and the fact that everyday beings with is the possibility of a new find – both for himself and his customers. “There’s always deals to be had,” he says smiling, just before taking another phone call. Virginia Auctioneers Association Legislative Committee Report August 15, 2010 2011 General Assembly Each session, The General Assembly will consider many bills (Delegates and Senators are already pre-filing bills for the 2011 session) that contain the words auction or auctioneer in a number of forms. Generally, the legislative action does not directly involve auctions or auctioneers. However, we need to be alert for legislation that may impact you and your business. It is important that each of us keep an eye and ear towards Richmond so that we will not be surprised. A recent example is Senate Bill 474 which stayed completely under our radar. Senate Bill 474 – Issuance of temporary licenses and certifications. Provides that regulatory boards within the Department of Professional and Occupational Regulation (DPOR) may issue a temporary license or certification to any applicant who holds a comparable license in another state. The Auctioneer Board moved to not issue emergency regulations to implement this legislative action.
Shields Jones Stafford, VA
Regulatory Initiatives Regulatory Review – General Review 2009 On August 31, 2009, the Department of Professional and Occupational Regulation (DPOR) published in the Virginia Register notice of its intent to consider amending existing regulations dealing with disciplinary action and the compliance of such actions and for further clarification of the regulations. DPOR provided the Auctioneer Board with a draft of proposed regulations which were identified in the 2009 General Review. The proposal follows DPOR’s notice of intent with proposed regulations generally updating and clarifying obsolete regulations. The proposals amend the regulations dealing with escrow funds, reciprocity, and disciplinary action. DPOR should be publishing the proposed regulations for comment in the future. More detailed information, including Stage Information, Documents, and Contact Information, about the regulatory action can be found at the Virginia Regulatory Town Hall at the following website: http://www.townhall.virginia.gov/L/ViewStage.cfm?stageid=5169 Shields Jones - (540) 659-8191, (540) 220-1130, namg22554@verizon.net Jack Peoples Larry Linkous Tip Pangle Shawn Rutz Mark Motley Tony Wilson

Auxiliary News Upcoming Auxiliary Events If you were in Richmond for the Mid-Year Seminar and the 33rd Annual State Championship Contest, I’m sorry that I missed seeing you. We were in the hotel, but Jack was not feeling well. And, since we came home, he has fallen and broken his ankle. I did see Marilyn Smith while I was there, and she has arranged to have a local garden club present a program on flower designing at our annual meeting in January. I’m really looking forward to that.

What Auction Goers Dislike
John Stephen Proffitt III I opened my last column with this excerpt from a reader’s letter: “Steve, I’m a new auctioneer. Do you have any specific advice for me as I start my new career?” I began by advising this auctioneer to “always do the right thing.” I stated “[t]here are many things in this life far more important than money” and emphasized he should “never let financial considerations override (his) integrity – NEVER!” Then I listed ten things that I’ve learned auction-goers like about auctions. Now I’m going to hit ten items on the opposite side of the fence. Let’s see what really puts a thorn in the heels of bidders. First, bidders are increasingly catching onto the bad and illegal tricks that some auctioneers use. They don’t like shills, phantom bids, or bogus “buy backs.” These are not practices that will earn an auctioneer a reputation for integrity and fair dealing, but they will tar a reputation with the black pitch of fraud. Once that stain is there, it’s next to impossible to remove. Second, bidders hate unannounced seller bidding. Who can blame them? It’s illegal, unethical, and a serious problem. Even honest auctioneers fear it. That’s because they have no way to know everyone a dishonest seller might dispatch to secretly bid to illegally inflate prices. Auctioneers must be ever alert for the scourge of unannounced seller bidding and do everything they can to prevent it. Third, bidders strongly dislike reproductions being represented as originals. Many auction-goers don’t know an original from a fake and they depend upon the auctioneer to provide reliable information. There’s nothing wrong with an auctioneer selling anPage 20
nounced reproductions, but selling reproductions as originals is fraud. Whatever short-term gain there might be, this practice has negative, long-term consequences for both auctioneers who do it and the auction industry in general. Fourth, too many auctioneers waste valuable time whining. We’ve all seen this. I’ve got seven children and I hate whining – so do auctiongoers. Bidders don’t care and don’t want to know if an auctioneer is upset by low prices, a poor sale, an argument with his wife, or anything else. While on the block, the auctioneer should do the best he can with what he’s got – and smile all the while. That’s professionalism. Fifth, bidders dislike auctioneers and their staff members bidding on and buying the merchandise. This complaint seems to be rooted in a combination of distrust as to whether these bids are legitimate, plus the feeling that the goods are being bought from under the very people who came to the auction to do the buying (the bidders). Sixth, would you like it if someone insulted you? Of course you wouldn’t. Well, bidders don’t like insults either. They resent being talked down to by auctioneers and they chafe at being abused and degraded, either individually or collectively. An auctioneer’s cashier once wrote me: “Auctioneers should realize that bidders are as smart as they are and should treat them accordingly.” There’s a paycheck of wisdom in that nugget. Seventh, move it! That’s right – bidders hate slow auctions. People have a lot of competing interests for their time, so they want auctioneers to put the stuff up, sell it, and move along. If the auctioneers fail to do this, the bidders will move along. Eighth, bidders resent being treated as less than equal to other bidders who they see as receiving preferential treatment from the auctioneer. The Virginia Auctioneer/Fall 2010
It’s Auction Time! (cont’d) Auctioneers should work hard to build a reputation for honesty and fairness with everyone. Remember, all money spends alike, no matter the source. Ninth, smoking is a huge negative with a lot of bidders, particularly in auctions conducted indoors. One auctioneer wrote me that he smokes Cuban cigars, but he added that he had banned smoking at his auctions several years ago. Once the ban took effect, his business improved. Both of my wife’s grandfathers spent their lives growing tobacco in southern Virginia and both smoked until they died … of lung cancer! A lot of families have felt this pain, and there’s a lot of resentment against smoking even in tobacco country. Tenth, a potpourri of complaints I’ve received would include things such as uncontrolled crowd noise, repeated disruptions, general confusion, poor
sound equipment, stopping the auction before everything advertised has been offered, and charging for admission and bid numbers. Bidders don’t like any of this.
tice this and you’ll find most people are very understanding and forgiving if you’ve tried to do the right thing. Learn from your mistakes and do better the next time.
It’s important for auctioneers to know what bidders like and dislike, because they’re in business to attract these people and sell to them. You won’t much good selling if bidders don’t like you or how you run your business.
Ask yourself what it is that you would like to know if you were in the bidders’ shoes – then tell people what you know. Fair disclosure is not only fair, it’s a great inoculation against hard feelings, legal claims, and costly litigation.
Here are a few additional thoughts on dealing with bidders for the new auctioneer who wrote me. If you want to be a big success that is widely liked and respected, be a good guy – be honest and sincere, do what you promise, and always do your best. When you make a mistake, acknowledge it and say you’re sorry. You’ll have plenty of chances to prac-
There’s no place in auctions for deceit, lies, trickery, or fraud. Be an honest auctioneer, a pillar of integrity, and always a gentleman. Finally, guide your life by the wisdom of the golden rule: “Do unto others as you would have them do unto you.” You can’t get better advice than that.

How do the state associations fit with Essential NAA? If you attended the National Auctioneers Association International Conference and Show you may have heard about E-ssential NAA. We know that NAA members are essential to NAA (we couldn’t exist without them!), but is NAA essential to our members? Probably not. Our hope is that in the next year or two or three, it will become so. NAA will accomplish this by determining what NAA members want and what they need to either grow their business or make them more efficient. We know that if we can accomplish the latter two objectives (growing business or being more efficient), it means money in the pockets of our members – and that’s what will make NAA essential to them! NAA will spend time and resources devoted to two major areas: 1) understanding what is happening in the auction industry and 2) ensuring that our organization can deliver the best possible results to our members. In order to understand what is happening in the auction industry, we will form the Council on Future Practices – this group will be expected to read about trends in the auction industry and talk to experts in those fields to determine how they will impact the auction industry. They will deliver their thoughts to the NAA Board about the industry, who will then determine how to address the challenges identified by the Council on Future Practices. This could be in the form of a new widget that needs to be developed, a new educational program that should be offered, or a new partnership with an organization that will strengthen our marketing efforts. NAA will focus on being flexible and able to change to meet the dynamics of the world around us. However, one thing will not change – we must have a strong partnership with state associations. At the Conference and Show, then President Scott Musser, CAI, BAS and President-elect Mark Rogers, CAI, AARE and I visited with the executive directors of the state associations. In that meeting we reiterated our commitment to work WITH the state associations in helping all of us be the best in the auction industry. We do not need an industry that is fragmented – we need strong advocates for auctions on the local and the national level. NAA is not a large enough organization and doesn’t have the deep pockets necessary to mount a massive marketing campaign for auctions. We rely on our partnerships and on NAA members. And we need to rely on state association members to help us communicate to the public why they should use auctions. At the NAA level, we will make sure that relationships such as what we have with USA Today continue to flourish (USA Today gives preferred advertising rates to NAA members and aggregates them in one area called the Auction Showcase in their Tuesday and Friday editions). We will make sure we keep an eye on what is happening in the industry and we will share that information with the state associations. Working together we should be able to make Auctions E-ssential to the American public. It will be at that point where we are all successful! The Virginia Auctioneer/Fall 2010

Minutes - VAA Board Meeting (continued from page 27) Study committee – Chuck Boles gave a summary of the results of the “VAA Membership Survey Report”. (a copy of the report will be attached to the permanent set of minutes). Boles stated that conclusions are worthless unless they are turned into actions. Nicholls stated this was the results of 14 months of work and commended the committee for their work and valuable information. This is information that should not be just data but data that should be acted upon. During the January membership meeting, it was proposed that the current membership definition be reviewed. Boles stated that as chair of the committee, his role was to chair and not take a position unless it required a vote due to a tie. This is a committee project. The current language in the bylaws read as follows: “Any Auctioneer currently licensed to conduct auctions in the Commonwealth of Virginia shall be eligible for Active Membership.” The committee reviewed the current language and recommends the following by motion from the committee: “Individuals whom the seller engages to direct, conduct or be responsible for a sale by auction shall be eligible for Active Membership in this Association.” The vote by the committee was 5 in favor, 1 opposed, 1 no response and 1 abstained. Boles stated that if the Board and membership voted to accept this recommendation, it would open up the membership to a broader number of people. It would not allow someone to run for the board unless they hold an auctioneer license. The board suggested that the membership definition as proposed by the committee be mass emailed to VAA membership for their comments/reactions. And said comments/reactions would be weighed by the board at the January 2011 meeting. Boles stated that in reviewing the membership database, the categories in the database are not consistent with the bylaws. Elaine stated that the database classifications are internal and database categories will be updated in the VAA database to agree with the bylaws. Recommendation from the Study Committee is to change classifications to: Full, Associate and Honorary. After discussion, Jerome Clark made a motion to table until the January meeting, second by Christine Corbin. Motion carried. Nicholls asked that the committee simplify this report and share with the membership via emails or the magazine to keep them informed. Ways and Means – Chuck Boles stated that the committee was charged with suggesting fundraising ideas and ways of generating revenue for the Association. The committee submitted six potential motions to the board. Nicholls stated that Ernie Rogers as President would probably direct these ideas and suggestions to the proper committees and individuals. New Business: Billy Dixon of Dixon’s Auctions presented a proposal to play host to the 2011 Mid-Year Seminar and the Auctioneer Grand Champion Competition. This will be voted on at the board meeting Friday, January 7, 2011. Something will be included in the newsletter that if anyone is interested in playing host, they should present a proposal during the January 7 board meeting. Kelly Strauss made a motion to purchase five banners to be shipped to the approved VAA schools promoting the Morris Fannon Scholarship, cost of banners and shipping not to exceed $500. Second by Christine Corbin. Motion carried. Jerome Clark made a motion to have the VAA accept and have the President sign the proposal presented by Executive Management for management services for a three year period beginning January 1, 2011 and ending December 31, 2013, second by Brian Hash. Motion carried unanimously. Meeting adjourned at 6:15 PM Respectfully submitted, Elaine Christian
