Astorino and Republicans Could Face Federal Rico Action for Election Rigging, Fraud By JEFFEREY LULANOVICH On August 12, 2013, a decision and order was rendered in a case under the caption “RICHARD v. THE WESTCHESTER COUNTY BOARD OF ELECTIONS, EVELYN MCCORMACK, ELISABETH L ALBERTY, CHRISTINA OROS, THEODORA M CERINO, MARGARET SCULTI, JAMES F TRAVELINO, AND NICOLE M DEHENSKY, by the New York State Supreme Court, Westchester County, the Honorable Court Judge Robert DiBella.. The Plaintiff Richard Rhoades, a long time Independence Party member sued the Defendants he perceived were attempting to raid the Independence Party in order to rig the outcome of the independence Party Primary Election for Robert Astorino’s upcoming election for Westchester County Executive. The lawsuit alleged the 57 individuals engaged in a concerted and organized effort to raid the Independence Party. Rhoades accused the Defendants of being controlled operatives of Westchester County Executive Robert Astorino, who is seeking his second term. In this decision and order the Court states, “it is clear that most if not all of the fifty seven enrollees including respondents had some familial, social or employment related connections to the County Executive�. Testimony given by Sam Zhreka, regarding to a taped recorded conversation between Zherka and County Executive Robert Astorino, totally implicated the County Executive in this most elaborate scheme of conspiring to rig the Independence Party Primary Election process. Zherka, testified that Astorino told him in words or substance that they raided the Independence Party as “Insurance� because the Chairman (Giulio Cavallo) would not give him the endorsement for his re-election bid. The Court Decision and ruling which was in favor of Richard Rhoades and the Independence Party was appealed and upheld by the APPELLATE DIVISION
2nd DEPT and by the New York Court of Appeals. Independence Party officials, along with disenfranchised registered voters are now planning a new Civil Action, this time in Federal Court against Rob

Smith Astorino, County Republican Chairman Douglas Colety, The Westchester republican Party, The Westchester Board of Elections, Deputy County Executive Kevin Plunkett, Chief of Staff George Oros and his daughter Christina Oros, and as many as eighty-five of Rob Astorino’s top administrative employees and Republican politicians. Allegations are as follows: The Westchester County republican Party
Chairman Douglas Colety, Robert Astorino and County Officials conspired and orchestrated an elaborate scheme to rig an election by fraudulently converting thousands of Republicans and County Employees in order to rig the Primary Election for the benefit of Robert Astorino’s election bid. “The only thing worse or more dangerous to our democracy than a corrupt politician or government official is a bunch of corrupt politicians and Government officials�, said Sam Zherka. Attorney’s for the Independence Party state that Astorino’s attempt to rig the Primary Election was thwarted by the lawsuit filed by Richard Rhoades where the NYS Supreme Court tossed Astorino from the ballot by voiding the Petition for the Independent Primary. Sheila Marcotte of Eastchester, John Tesla of Peekskill, Bernice Spreckman of Yonkers, and Verni of New Rochelle, were just a few who succeeded in the electionrigging scheme and according to sources directly involved, will be named “in the Fraud and Election-Rigging Case�. Attorneys for the Independence Party will be calling on the United States Justice Department in Washington, D.C. for a federal investigation of these allegations. In a tape recorded conversation with Sam Zherka, Astorino is heard stating that he wants to decapitate “these two�, referring to Dr. Giulio Cavallo and Dyalma Vasquez, leaders of the Independence Party because they would not endorse Astorino. Giulio Cavallo, Chairman of the Independence Party, compared the illegal actions committed by Rob Astorino and the County Republicans to those of former NYS Senator Malcolm Smith who was arrested and indicted on similar Election-Rigging charges. Attorney Peter Tilem, of the Law Firm Tilem & Campbell, of White Plains, is slated to be the lead attorney in what could be a ground breaking case of first impressions. Joining Tilem will be attorneys Laurie Dallos of New Rochelle, Maureen Pritchard of Queens, and Stuart Melnick of New York City. Lawyers for the group allege that

Astorino and Republicans Could Face Federal Rico Action for Election Rigging, Fraud Astorino and his Republican cohorts may have violated numerous Federal laws including “Mail” and “Wire Fraud”. See State Law which may have been violated: “Election Law” 16-110 “False Registration”, which deals with attempts to register dalsely in a party or knowingly permitting or aiding as such. In tape recorded conversations, Robert Astorino and Douglas Colety, the
Westchester County Chairman admit to having knowledge of the illegal scheme to rig the election. “Election Law 17-128 Violations of Election Law by Public Officer or Employee:” Dels with a public officer such as a person who is employed by th County, who knowingly and willfully omits, refuses or neglects to perform his job. “Election Law 17-144: Giving Consideration for Franchise”: Any person
directly or indirectly who pays, lends, contributes or offers or promises to pay, lend or contribute money (or other consideration) to or for any voter to vote or refrin from voting on exchange for a gift, employment, etc. is guilty of this offense and ispunishable by fine and or imprisonment. In this case in point, over fifty Republican County Employees with direct links to Robert Astorino and Republican Chairman Doug Colety were offered
continued employment with the County if they participated in this criminal, fraudulent scheme to rig the election process. It is alleged that there may be additional tape recorded conversations by and between Republican County Operatives and undercover investigators hired by the independence Party. “Election Law 17-132 Illegal Voting:” Anyone knowingly voting when not qualified to do so or aiding one in voting when
not qualified is guilty of this section. “Election Law 17-152 – Conspiracy to Promote and Prevent Election:” Two or more persons conspiring to promote or prevent the election of any person to a public office by unlawful means and that conspiracy is acted on by one or more of the parties. If such a case is proven, and its alleged that the evidence is overwhelming, it may be the catalyst for the end of Rob Astorino’s political and possible federal implications.

Freeing the Yonkers Police Department from Political Influence By HEZI ARIS Yonkers Police Department (YPD) brass seem to be consumed with the internal mess that has been allowed to foment under the aegis of Yonkers Police Benevolent Association (PBA) President Keith Olson, and two of his dubious associates, and counterparts; Captain John Mueller, commander of the Yonkers Fourth Police Precinct, and Detective Sergeant Brian Moran of the Detective Division. Sometimes individually, at other times in concert, since Olson acceded to the helm of the PBA, under the guise of questionable internal union politics, when former PBA President Eddie Armour relinquished his position as PBA President to become union treasurer, Olson ran unopposed to take over the union in 2010; Olson has been stirring the political cauldron ever since. In what turned out to be a bait and switch tactic promoted by former Yonkers Mayor Phil Amicone, who used Olson and his politically astute gofers, well-respected Police Commissioner Robert Taggart was unseated with the lure of John Mueller becoming the next Yonkers Police Commissioner. Instead, Edmund Hartnett had acceded to the position of Yonkers Police Commissioner. For Olson and his friends the pattern of dismissing friendships, and selling out the union with the systematic dismantling of all now defunct units was hardly unique under the Olson / Hartnett reign of terror. Since then, and under Olson’s leadership, the membership has paid a heavy price. The City of Yonkers (CoY), purportedly the third largest city in the state, is also the city devoid of a burglary unit, no school resource officers, despite over forty public schools, and a membership working without contract for over five years - this, ever since Olson’s cozy relationship with Hartnett and
Amicone jelled. At a recent PBA monthly meeting Olson did not address any questions concerning the alleged unethical conduct by him or his counterparts. He did however tell the membership not to look for any type of settlement on a contract with CoY until the year 2015. Such a timeline would imprint his reign of ineptitude over the men and women in blue to almost a decade. Olson, Mueller, and Moran’s unscrupulous ways have plagued the department with numerous internal complaints of verbal threats, harassments, unauthorized investigations, unauthorized searches of work stations, missing police personnel files, and the collection of official police records on Captains, Lieutenants, Sergeants Association (C.L.S.A.), and PBA members, used against personnel as an effective mode of intimidation. There seems also to be internal allegations of excessive fundraising practices, and some missing funds that may have never been delivered. There are also reports that there are pending Federal Lawsuits, and more said to be on the way. It is often said that opposites attract. Olson, known to be a schoolyard bully has little to no education, is inept as a speaker, and currently has a serious credibility problem because of his “thug-like ways”. On the other hand, Mueller, and Moran are more educated, but lack people skills. All three are driven by their thirst for dominance, control, and power. They salivate at the thought and demonstrate their respective lust by targeting members from their own unions with premeditated discipline notices, and staged incidents of acts of harassments to disguise their own actions. For example, according to some insiders, Mueller supposedly received some type of mailing to his home address, but never cooperated with officials over this allegedly “staged” mailing by not letting investigators examine his claim. Moran and Olson’s brother-in-law, Fourth Precinct Lieutenant Anthony Chiarella have
also filed some questionable reports with the department. Sources report that they were using those reports to counteract the negative kickback they were experiencing of late.
Captain John Mueller, known as the “Joker” within the department because of his pasted grin, is perceived as a guy struggling with his own insecurities. Since his induction into the department, both Moran and Mueller have made it very clear their relationship with Olson is very tight. In fact, since Olson took over, he has been manipulating messages to the membership; giving them false hope so as to buy himself another term in office. The truth widely known to be circulating in the department is that Olson cannot be trusted, and that he has lost the confidence of most of the supervisors, as well as the membership. His most recent folly was when he, along with Captain John Mueller, fought back a departmental transfer in which they hoodwinked some politicians into rescinding Police Commissioner Charles Gardner’s Transfer Order. That gave the Police Brass a black eye, and also sent shock waves throughout the CLSA membership, because other professional Captains ended up transferred in place of Mueller’s refusal. That may have given city officials a black eye, too. Since the order was given to save Mueller, he is
currently under investigation for an all-night beer party that went into the wee hours of the morning at the Fourth Police Precinct. There are reports that Mueller himself gave misleading statements to Internal Affairs Investigators, and that he and Olson may have impeded the investigations by advising Internal Affairs they allegedly saw nothing. In fact, since the investigation, John Mueller and his cohorts have been continuing to berate, and besmirch a well-decorated Police Sergeant, who allegedly witnessed the commanders’ “gone wild” party. Sources say John Mueller is in full deflective mode. Reports are that he is running about the city offering extra-ordinary police services to church groups, community activists, and city educators as a protective cloak against being discipline, and transferred. His conduct is not authorized. He has been setting up fruitless meeting with these groups for self-serving reasons. Sources close to his day-to-day activities claim that Mueller is a wolf in sheep’s clothing, and will purportedly lie and do just about anything to give these groups a sense of false security. This internal investigation is nearing a year, and the City of Yonkers owes it to its citizens to clean up the foul odor. The department also needs to closely scrutinized Mueller’s original statement, which is reportedly full of discrepancies. There seems to be a developing pattern of double standards. So if a commander of the largest precinct in the city is allowed to intentionally deceive investigators, what can he do for the citizenry? If all of these allegations and accusations are true, which according to some insiders are verifiable by way of departmental emails, memos, and letters, where does the average Yonkersite stand. One thing is certain; Olson, Sergeant Brian Moran, and Captain John Mueller have done irreparable damage to the department and its members.They did it; don’t hate the messenger. The membership recognizes Olson’s lame duck, longstanding presidency.
They have also learned he is not omnipotent. YPD’s top brass, and city officials seem to be struggling on what to do with the Yonkers PBA leader, and his friends who are embroiled in controversy. One has to wonder why? Is it because Yonkers’ “godfathers” (Angelo Martinelli, John Spencer, Phil Amicone, and Nick Spano) bought his silence over a no contract deal, by giving his sister a high paying city job, and getting Det. Sgt. Brian Moran’s mother her job back with the city after she was terminated? Yes, the “godfathers all have a hand or two in it! Is it possible the YPD and/or Yonkers Corporation Counsel is intentionally interfering with these investigations as per the directive of present Mayor Mike Spano and the pressure exacted over him by the “godfathers” noted above in this paragraph? If that is so, then they will also be held accountable when the Federal Lawsuits are revealed, or when the Department of Justice (DoJ) moves to widen their investigation into alleged union corruption. There is a definite rancid stench of dirty politics that have short-changed the hard working police professionals of the Yonkers Police Department. It appears these rogue cops are getting some type of protection because of their past political connections. The cancer permitted to ravage the YPD from the inside will come to consume the “godfathers” and other politicians. Mayor Mike Spano must take the bull by the horns lest he be gored. As dark clouds hover over Olson and his two cronies, there are some things that are very apparent to the CLSA and PBA membership. Olson continues to drive about Yonkers and beyond in a city own vehicle with a union stipend that costs the membership $4,000 every month – equating to $48,000 every year, with free city gas, and a credit card. In all the years under Olson’s reign, when was the last time anyone took a look at the books? The membership is also aware that other municipalities are getting decent contracts as they show up to work. Things are not looking good for the YPD as

And Olson, he has been protected all these years by Phil Amicone. It seems behind every man is a stronger man... Truth be told, it is a standard that can no longer be tolerated. It’s up to Mayor Mike Spano to remove the political influences from the situation and permit Police Commissioner
Charles Gardner to do right by the U.S. Constitution, New York State Constitution, and the Yonkers City Charter, and Yonkers Police Department’s men and women in blue, or get someone who can. The YPD cannot wait for a remedy any longer.

News & Notes from Northern Westchester By MARK JEFFERS Since all my pro sports team are in trouble… the Giants have not won a game in NFL action; the Yankees did not make the playoffs; my fantasy football team is awful, and I have yet to win a dime in any pools I am in,… I had lots of time to write this week’s pro-sports free edition of “News & Notes.” Our friends at the Community Center of Northern Westchester (CCNW) in Katonah will start collecting NEW warm sleepwear, robes, socks, and slippers for children, sizes infant through 18 years on November 1st. CCNW is also currently collecting food and monetary donations so that they are able to provide special holiday meals for hundreds of folks in need during November and December. I got scared just writing about this… Taking the tale of The Legend of Sleepy Hollow to its darkest extremes, Horseman’s Hollow returns for a fourth year of highly entertaining haunted mayhem, now expanded by popular demand to 13 evenings through November 2nd. Philipsburg Manor transforms into a terrifying landscape ruled by the undead, the evil, and the insane (a usual Saturday night at our house). Here’s another fun and frightening event… tiny ghouls, ghosts and goblins, along with a gala adult costume party will highlight the annual Halloween Exhibit and Train Show, which takes place October 26th and 27th at Lasdon Park, Arboretum and Veterans Memorial in Somers. The South Salem Ghost Walk will commence at 7:00pm on Friday October 25th at the Lewisboro Library. Maureen Koehl will lead a walking tour of local sites with a haunted history.The one-hour tour will travel through the Old White Churchyard, along Spring Street toward the South Salem cemetery. Good work by the organizers of the 2013 Bedford Central School District Elementary BikeRun as they made a $7,000 donation from funds raised at this year’s event to the Bedford Central School District’s Board of Education. Looks like the BikeRun will return for a fourth year on May 18, 2014 at the Fox Lane Stadium and Campus. On Sunday October 27th at 10:00am, the Katonah Museum of Art presents “Eye to I… 3,000 Years of Portraits.” The exhibit will use portraits to explore the various ways that individuals look at and understand imagery. Each of the 60 portraits on display will have an interpretive copy explaining the work from a range of personal perspectives. Visitors are also invited to add their own responses. This fall, seniors everywhere are applying to colleges and it can be a stressful time, believe me. I Respect Peter King More Than Ever (By the time this is published, the Shutdown may be over – or may not.)

I’ve always liked Congressman Peter King (R-NY) although I don’t always agree with him – no make that “don’t usually agreed with him”. Maybe I like him because our fathers were both NYPD officers – or maybe it’s because we both grew up in New York City – or both had 16 years of Catholic School education (he added on Notre Dame Law School) or both served in the New York State National State National Guard. More likely, it’s because he has always come across as a straight shooter who speaks his mind no matter what the pressure from anyone, including his own party. Nowhere has King’s independence been more apparent than in his recent rebelling against his House Republican Leadership over the government shut down. In an editorial in the Irish Voice, publisher Niall O’Dowd wrote “When you go looking for a responsible adult in Washington during this current budget crisis, you’ll probably find Long Island Congressman Peter King in

Politico reported that on Monday (JFM – that was then), as the wild men of the Republican right cheered on their breakneck race to shut down the government, King alone stood up in a packed party meeting and said that were heading in the wrong direction.” In a Fox News interview on October 6th http://www.rawstory.com/ rs/2013/10/06/republican-rep-peterking-we-are-the-ones-who-shut-downthe-government/), King did not back down, saying in part, “I’m talking basically about Ted Cruz, who was saying if we [voted in the House to defund] Obamacare, he could manage to both keep the government open and defund Obamacare. The fact is, it was done in the House and the government is now closed and Obamacare is going forward. This was a strategy that never could work. It was almost sort of a nullification, to say we’re going to shut down the government if we don’t defund a law that we don’t like. If we want to defund something, we should repeal it, And do it the same way the president got it signed: elect Republicans to both Houses of Congress, repeal it and then have a Republican president sign it. This was a strategy doomed to failure.” King also had strong words for
the Republicans who were blaming the Democrats and the president for shutting down the government, saying “We are the ones who did shut the government down. You don’t take the dramatic step of shutting down the government unless you have a real strategy.” Admittedly, King is not the only prominent Republican to speak out against the Ted Cruz / Tea Party strategy. The last two Republican presidential nominees, John McCain and Mitt Romney have also spoken out – McCain: although he realizes that Republicans don’t want to hear it, especially when it comes to health care, “elections have consequences” and Romney: instead of this, the other option for eliminating Obamacare “would be potentially working hard to get Republicans elected” (Cahir O’Doherty, in the same Irish Voice, after quoting McCain and Romney, opines “Senator Ted Cruz.., has a more exciting strategy, which seems to be to work as hard as possible to make sure Republicans don’t get elected”) – but neither McCain nor Romney are members of the House where their voice might make a real difference and where there could be punishment from the leadership for their rebellious talk. Additionally, King has announced his
interest in exploring the possibility of exploring a 2016 campaign for the Republican presidential nomination; it seems to me that his stand on the shutdown has ended that possibility – and he had to be aware of that risk before he opened his mouth. To put my position on this in some perspective – while I favor Obamacare (although I would have much preferred universal coverage single-payer Medicare for all), my opposition to the shutdown is not based on policy; I would feel the same if it were a Democratic group, having control in only one House of Congress, trying to block implementation of a law which I abhorred that had been passed both Houses of Congress and signed by the president (and, in this case, vetted by the Supreme Court and made a major issue in a losing presidential race). What is being done is, as Tom Friedman has pointed out in the New Your Times, a subversion of our democratic process. Friedman wrote “What we’re seeing here is how three structural changes that have been building in American politics have now, together, reached a tipping point — creating a world in which a small minority in Congress can not only hold up their own party but the whole government. And this is the really scary part: The lawmakers doing this can do so with high confidence that they personally will not be politically punished, and may, in fact, be rewarded. Okay the tunes here sound a bit dated, but this is 1963 and Billy Preston is just sixteen years old playing with seasoned veterans and he’s more-than holding his own. Most tracks are covers and all titles are instrumentally performed finding Preston playing organ and keyboards while he was still attending highschool. There’s two sessions both are quartets: Preston with the great Tommy Tedesco on guitar, Clifford Hills’ bass, and Milt Turners’ drumming. The other session (my preference) has Hills as the only return player on bass, the wonderful Gene Edwards on Guitar, and the legendary Earl Palmer (who just moved from his native New Orleans to Los Angeles.) Preston had made his imprint as the B3 player on the immortal Sam Cooke’s “Night Beat” album for J.W. Alexander’s label, and the supposed intention was to feature young Preston with his very first solo recording. The album opens with “Greazee” authored by Preston and his two producers Alexander and Fred Smith. Preston’s bluesy here and is delightfully supported by Edwards crystal-clear guitar and Palmer’s
sophisticated drumming. “Lost and Lookin’” is a late-night blues with Preston leading on piano. Don Gibson’s “I Can’t Stop Loving You” (made famous by Ray Charles the year prior,” Preston’s B3 is prominent as he sounds a bit like Jimmy Smith. Frankie Brown’s “Born To Lose” was another Ray Charles hit, that features Preston switching back and forth from organ and piano. Sam Cooke’s “Bring It on Home to Me” features Edwards’ superclear guitar tone as Preston toggles between piano and organ. Billie Holiday’s classic “God Bless the Child” is short and sweet but it’s not memorable. “Good News” authored by Preston and his producers (hmm,) sounds like the later Sam Cooke “Ain’t That Good News”mega-hit from ’64, where Preston gives a rollicking ride that’s propelled by Palmer’s swinging and relentless drumming. This 2013 CD reissue on www.RealGoneMusic.com adds a couple of previously unreleased bonus tracks, an un-credited tune titled “Sweet Thing” and a cover of Cooke’s “Win Your Love for Me,” where it’s understandable as to why these two added tunes were omitted
from playing by the traditional rules of our system, if we do not defend those rules — namely majority rule and the fact that if you don’t like a policy passed by Congress, signed by the president and affirmed by the Supreme Court then you have to go out and win an election to overturn it; you can’t just put a fiscal gun to the country’s head — then our democracy is imperiled.” (http://www.nytimes.com/2013/10/02/ opinion/friedman-our-democracy-is-atstake.html). I agree with Friedman – much more is important here than the future of Obamacare. McCain and Romney are right – “Elections have consequences” and the way to repeal or modify the law is by “working hard to get Republicans elected”. Any other method, be it done by Republicans or Democrats, is a challenge to our Democratic process. While King may have doomed his chance for the Republican nomination for President, he once again showed his integrity and his willingness to stand up for his beliefs and speak out for them – and I salute him for it and wish we had more like him in both parties. not be more compelling. Not least remarkable is the play’s unpredictability, with its canny insights into the quirks of otherwise highly consistent characters.There are three love- or near-love stories, but enough is left to our imagination. No less

So it is extremely satisfying that the Roundabout Theatre Company has revived “The Winslow Boy,� not seen on Broadway since its 1947 American premiere. This is one of those rare unassailable plays (Rattigan has written more than one) in which there is nothing the most finicky critic can wrinkle his nose about. It is based on the true case of George Archer-Shee, a Royal Naval Academy cadet, wrongfully accused of stealing a five-shilling money order and forging the required signature. The law suit dragged on for two years and stirred up even a House of Commons debate, and, what with press headlines, got the entire nation taking sides and making history. On one side was the Admiralty, on the other the Winslows and their brilliant advocate Edward Carson (prosecutor of Oscar Wilde), in the play, Sir Robert Morton. The cost for the family was very nearly ruinous—in history initiated by a brother, in the play by a stubborn father and suffragette sister—but its sensational outcome changed the laws of the land. Whatever facts may have been at Rattigan’s disposal, what he wrote is largely his superlative invention: witty, acerb, and immensely humane. All the characters— sister Catherine and her two suitors, John and Desmond, mother Grace and lackadaisical older brother Dickie, loyal maid Violet, doggedly embattled father Arthur and accused schoolboy Ronnie—are magisterially portrayed, and the dramatic arc could
delightful is the very British humor, rich in irony and couched in understatement. Take the bit when John sues for Catherine’s hand. To her father Arthur’s query whether he really wishes to marry his militant daughter, John replies, “Of course, sir.� To which Arthur: “Why of course? There are plenty of people around who don’t wish to marry her.� There is much delicious ambivalence running through the play, as in, for example, the attitude of the press to the case, about how it was “a fuss about nothing and a shocking waste of Government’s time, but

how it was a good thing all the same because it could only happen in England.� Especially fine is the closing scene, which transcends spoiling by my summary. Despite Sir Robert’s haughty condescension to feminism and Catherine’s
resentment of his hauteur and sexism, the two yield to a mutual appreciation within some amusing boundaries. Noteworthy too is a curtain line that has nothing of the customary punch line bravado, but gains by its very restraint.

We have here a faithful re-creation of a successful London production, again expertly directed by Lindsay Posner, albeit with a mostly American cast that nevertheless sounds British enough. It may be that the winning Roger Rees slightly exaggerates Arthur’s irascibility, and that the otherwise apt Alessandro Nivola looks a trifle unimposing as Sir Robert, but none of this really matters. I have nothing but praise for Charlotte Parry’s adroit Catherine, Mary Elizabeth Mastrantonio’s appealing Grace, and Henny Russell’s pawky parlormaid Violet. Kudos too for Zachary Booth’s frivolous brother Dickie, and for Catherine’s two very different guys: Chandler Williams’s debonair John and Michael Cumpsty’s touching Desmond, as well as for Spencer Davis Milford’s Ronnie and, in cameo roles, Meredith Forlenza and Stephen Pilkington. This originally Old Vic production enjoys perfect décor and costumes by Peter McKintosh, assured lighting by David Lander, and flawless hair and wig design by the ever reliable Paul Huntley. I cannot urge

two Brooklyners, Holocaust survivors in their sixties, now retired to Florida, but forced to a brief stay in an inhospitable model apartment while awaiting readiness of their condo. They have typical minor spats until they are disturbingly surprised by the arrival of their hugely overweight and fairly deranged daughter Debby. Thirty and unmarriageable, Debby has grotesque delusions about the Holocaust and her imagined place in it, although even her mother Lola has some fantastic notions that, while in Bergen-Belsen, she was closest
friend to Anne Frank and inspirer of her diary, as well as playing a major role in it. Husband and father Max, on the other hand, has recurrent dreams of little daughter Deborah, who died on their escape from the Nazis, adult and beautiful in the dreams. An additional surprise even to Debby is her being tracked down by her fifteen-yearold black, teen-aged lover, Neil, an orphaned, thieving street kid whom she lovingly adopted. Here he is played by Hubert Point-Du Jour, rather too old and way too handsome for the part.
Though not a mental case, Max is grouchy and querulous under the circumstances. But neither Mark Blum’s solid performance, nor good work from Kathryn Grody (Lola) and Diana Davis (fat-suited Debby and svelte Deborah) can make us care very much. Evan Cabnet has directed suitably on Lauren Halpern’s convincing set. Google: Wonderful? Or Bad? Or Both–Part 1 By JOHN F. McMULLEN In a recent piece, I lambasted what I considered Apple’s shoddy user interface in its new mobile Operating System, iOS7. Taking issue with Apple, my longtime favored technology company in terms of elegance and user interface, brings me to the next logical question -- what are the alternatives? The trade press has, by in large, decided that, currently, there are four technology companies vying for number one in the world -Amazon, Apple, Facebook, and Google (in alphabetical order) with the former number one, Microsoft, lurking in the shadows and hoping for an opening. Each of the above companies has its own particular niche but has expanded into the bailiwick of others to compete. A case in point -- Amazon, one of the largest retailers in the world, has leveraged its substantial computer network, necessary for its sales, inventory, and distribution operations, to provide a significant “Cloud Service,” competing with Google’s, Apple’s, and Microsoft’s services (as well as IBM’s, recently defeating IBM in a head to head contest for a
major government contract; IBM has asked for a reconsideration). Another case -- Google has two operating systems, “Chrome” (also the name of its browser, to further confuse you) and “Android”, pushing its way in territory formerly occupied only Microsoft, with its many varieties of “Windows,” Apple with “Mac OSX” (Desktop and Laptop Systems) and “iOS” (Mobile Systems), and the ubiquitous “Linux.” Then, to further confuse things is another major player in the field, Samsung, which makes components for Apple, is one of the two manufactures for Google’s “Chromebook,” manufactures laptops and netbooks running Microsoft’s Windows OS, and manufactures (and markets very successfully) a full line of tablets, minitablets, and smartphones, running Google’s Android OS, to compete with units bearing the names of Apple, Microsoft, and Google -and it and Apple are suing each other, all over the world, while continuing to do business with each other. Sound incestuous, as well as confusing? That’s because it is! In an attempt to shed a little light on how these companies branch out from the startup focus to much wider areas, I’ll focus on Google which has moved from a 1996
startup by Stanford University PhD students Larry Page and Sergey Brin into a worldwide technology powerhouse -- the firm’s mission statement, when incorporated in September 1998, was “to organize the world’s information and make it universally accessible and useful;” it has since gone far beyond that. The firm’s initial product, the search engine, rapidly became so popular (outpacing Yahoo, Excite, HotWired, and other search engines of the time) that the expressions “Google him” and “Google it” became parts of the English language. According to “Search Engine Watch” (http://searchenginewatch.com/article/2289560/ Googles-Search-Market-Share-ShootsBack-to-67), Google’s share of the Search Engine market was at 67% in August 2013, far surpassing Microsoft’s “Bing” (17.9), Yahoo (11.3), Ask (2.7) and AOL (1.2). The September 2013 “Hummingbird” addition to the search engine allows users to enter “Natural Language”questions rather than just “Keywords” on the search engine query line. Google has also added a terrific audio search capability which I use regularly on my Nexus 7 and find far more responsive than Apple’s Siri on my iPhone. In 2000, Google began to accept
targeted advertising based on the search terms entered by the user and, when Google introduced it free web-based e-mail service, “Gmail,” in 2004, the use of targeted advertising based on scans of the incoming e-mail for keywords drew initial heavy criticism from industry groups, such as the Electronic Frontier Foundation (“EFF”), but the fact that Google offered more free storage that its main competitors at the time and introduced “threading mail by subject” (keep all mail with the same subject line together) quickly attracted millions of users and the criticism was vastly ignored. The Gmail service has expanded to include a contact management system, task lists, and link to a full calendar system, thus competing with Microsoft’s desktop mail client, “Outlook.” In 2004, Google moved into Social Networking with “Orkut,” a product, while very successful in Brazil and India, has never reached the worldwide market shares of Facebook and “MySpace.” Google introduced another social networking product, “Google+” in 2011, a system with a different interface and look from Facebook, MySpace, and Orkut. In April 2013, Google+ became the second largest social networking system, surpassing “Twitter.” Google entered the photo storing market in 2004 when it acquired “Picassa” from Lifescape, its 2002 founder. It moved
into video storage and retrieval in January 2005 with the launch of “Google Video” and greatly expanded its presence in the field with its acquisition of “YouTube” in October 2006. It maintained the two services for a number of years until it migrated all “Google Videos” (the changed name of Google Video) to YouTube and shut down Google Videos in August 2012. Google launched its first major assault on Microsoft in August and September 2006 when it announced the first components (word processing and spreadsheet) of what would become “Google Docs,” a webbased competitor to “Microsoft Office,” the largest selling productivity product on the market for Windows-based machines and Macintoshes. Google Docs not allowed anywhere-use of these functions, it provided seamless integration with the file formats of Microsoft Word and Microsoft Excel, allowing users to download the results of their web work into desktop and laptop versions on Microsoft Office (or its free competitor, “OpenOffice”) for final editing and / or printing. More importantly in the long run, Goggle Docs opened the concept of “Cloud Computing” (the process by which neither the programs nor the data are kept on the local

slogan, “Do no evil” by violating privacy with its target ad programs or it street level views in Google Earth or other aspects of its business. Google introduced its Web Browser,
“Chrome” in late 2008 and, by this year, StatCounter estimates that, with 39% of the world’s browser usage, it is the most used browser in the world (Net Applications lists it as the third ranking browser, based on user registrations, behind “Internet Explorer” (which ships with every Windows system) and “Firefox”). It is, by the way, my browser of choice on all platforms (including the Macintosh, iPhone, and iPad).
Google has many other software products and services, including “Google Translate,” which translates written text from one language into another; “Google Maps,” providing street maps and travel directions; and “Google Earth,” providing a view of earth from globe size to individual street views; with its add-on “Google Sky” with its pictures of space. Location, Location, Location! Beautiful Weather Advisory in Effect for Mexico’s Costa Grande By BARBARA BARTON SLOANE “One of the top 50 resorts in Mexico” is what Conde Nast Traveler says about it. Travel + Leisure includes it on its “500 World’s Best” list. So, what is this? Take me there – quick! It seems somebody up there likes me and heard my plea because I recently spent an enchanting few days at the Viceroy Zihuatanejo and yes, it’s all that. A natural first question then: how do I find this place – and how the heck do I pronounce it? Zihuatanejo is located on the Pacific coast of Mexico known as the Costa Grande, about 150 miles northwest of Acapulco. The town spent most of its history as a sleepy fishing village but then in the 1970s the government decided to develop Ixtapa, just 3 miles away, into a master-planned tourist community and, of course, the rest is history. Happily, good history because Zihuatanejo has managed to keep its traditional feel and charm. And you pronounce it: Zi-Wat-EnAy-O with stress on the syllable “Ay” as in “Bay.” There you go! The word comes from the Nahuatl language meaning “place of women” and refers to their universe known as the home of the “goddess women.” No wonder I felt so instantly at home!

Viceroy Zihuatanejo resides on a private beach on serene Playa La Ropa. My adobe-inspired suite was enclosed by luxurious tropical gardens that kept my plunge pool secluded and concealed. I’d been told that the spa offers both indoor and outdoor massage so of course, looking out toward the iridescent indigo sea and feeling the caress of the sun, you just know which location I chose! The treatment brushed away all my flight discomfort and I was oh so ready for

At twilight, Chinese lanterns and tiki lights blazed, a sunset turned everything pink and gold, and we enjoyed some wicked tropical potions while a silvery full moon shone down, making matters perfect. The scene was set for a captivating experience– and it didn’t disappoint. Both La Villa and La Marea restaurants, under the guidance of talented Chef Paco Isordia, serve Mediterranean and Mexican fare. My grilled corn and poblano soup followed by red snapper enchiladas with thyme and lime, enjoyed to the murmur of gently lapping waves, made for a truly celestial evening. A Great Getting’-Up Morning Each day the staff brought coffee and Danish and left it just outside my door, so it was - wake up, rub sleep from the eyes, stumble to the door, open - and voila, invariably the pretty breakfast tray was there. Can there be a more pleasant way to greet the morn? And if I felt like crawling back into bed – what a bed, surrounded by illusion netting and massed with deep pillows for dreaming; when I returned to my room each night, a special welcome pillow was positioned front and center on the bed, decorated with fresh flower petals.
Doing Good, Feeling Great
I had the opportunity to sit down
with General Manager Martin Kipping. He pointed out that unlike so many other Caribbean resorts, Viceroy Zihuatanejo’s location is not overpopulated, thus lacking the trinket/tourist feel. Its residents live from the sea and a deeply ingrained respect for it and nature infuses all. Chef Paco, for example, is able to use 85% of Viceroy’s perishables from the surrounding bay, land and farms, enabling the resort to be truly a part of the community. Kipping explains that there’s a strong service culture here and the majority of the property’s employees are from the area. A large number have been a part of the resort for over 25 years, further enhancing this “of the land” atmosphere. And the icing on the cake – the resort has a program in place to financially aid local schools and hospitals. Perhaps this explains why a happy, cheery feel pervades;

Constitutional Amendments Appearing on November 5th Ballot By MARY C. MARVIN The New York State Legislature has proposed six Constitutional Amendments that will appear on the November 5th ballot. Though often ignored in relation to election for office holders, because voters often do not cast ballots for topics they have not studied, the Amendment changes do have lasting impact. Like most state constitutions, New York’s provisions tend to be more detailed than its Federal counterpart and therefore amended more often. There have been 220 amendments to the current constitution since 1895. Because constitutions protect fundamental rights and define core governmental structures, they are logically harder to amend than ordinary laws. To change the New York State Constitution, both chambers of the Legislature in successive Legislative sessions
must approve the proposed amendment by a simple majority vote. It is then referred to the New York State Attorney General who is required to provide a written opinion as to how the proposed amendment language meshes with other provisions of the constitution. If after a general statewide vote approves the amendment by a simple majority vote, it becomes part of the constitution on January 1st. The Governor has no formal role in this process. The first amendment allowing an expansion of casino gambling has dwarfed all others in attention and a great fall off in votes is expected on the other issues. In addition to the five casinos run by Indian tribes and the nine State run racinos, the proposed amendment would add a maximum of seven full scale casinos most located north of Albany. Proponents of the amendment believe casinos will provide tourism, good jobs, increase revenue currently lost to Connecticut and New Jersey and the Constitutional provision that limits
the growth to seven will curb their proliferation. Opponents argue that expanding casino gambling increases gambling addiction, and has harmful effects on the casino communities including increased crime. Note: In a very interesting divergence, the casino amendment is the only one with one-sided positive wording stating that approval will be, “promoting job growth, increased aid to schools and permitting local governments to lower property taxes.”This is a clear departure from the non-judgmental bone dry language always employed in proposed amendments. How this passed muster with the ultimate arbiter, the State Board of Elections, remains a mystery. Amendment Two would allow veterans who were disabled in combat to get more “points” when competing for jobs within the Civil Service system.Because it alters the Civil Service Law, the change has to come via a constitutional amendment. Those in favor of the change argue that the amendment would not only increase employment opportunities
for disabled veterans, but would also put their training and experience to work for State and local governments. Currently, there is no expressed opposition to this change. Amendment Three would allow local governments to exceed their long term debt limits if the money is used for sewage improvements. This exemption began in 1963 and has been extended every ten years since. The genesis of the 1963 amendment was to encourage municipalities to participate in a then new State sewer construction plan without impairing the financing of other needed capital improvements. Since pollution concerns continue as well as the need to constantly maintain and upgrade sewage treatment systems, this amendment appears to be universally non-controversial. The next two amendments address land within the Adirondack Parks and the New York State Constitution via the “Forever Wild” clause forbids the lease, sale, exchange or taking of forest preserve land without a Constitutional change.
Amendment Four settles a century’s old private-public dispute over 200 parcels near Raquette Lake. Proponents of the amendment believe it will finally settle a long standing and costly dispute and in the end, in a land trade, will actually add significantly to the Adirondack Preserve. Opponents believe such disputes should be resolved via the judicial system and not a Constitutional change, setting a very poor precedent for this type of dispute resolution going forward. The Fifth proposed amendment would authorize a land swap with a private company, NYCO Minerals of Willsboro, to expand its current wollastonite mine (a mineral used in paints, plastics and auto parts). The current mine has only three to four years of material remaining. In exchange for mining on adjoining property, which would extend company operations by eight to ten years, upon completion the land would be donated back to the State. Proponents argue a “yes” vote would preserve jobs in a very depressed area and eventually leave New York with more preserved park land. Opponents fear

that does not reflect current life expectancies. Opponents argue conversely that the current retirement rule encourages fresh ideas, healthy turnover and diversity. Net net, the more umbrella issue is whether the above issues are truly worthy of State-wide Constitutional Amendment

Saint George’s is now open in the old Buffet de la Gare, across from the train station. The internal space has not changed dramatically - it remains the cozy and exceedingly French place it previously was (and still is). A focused menu featuring French bistro classics, raw bar, excellent wine (13 by glass), some good beers on tap and absinthe provide the makings of an excellent night out. The owners, Jason and Chris, run successful, established restaurants elsewhere (in Dobbs Ferry and Scarsdale). They welcome you Tuesday through Saturday for

There is a compact menu with a range of prices and appealing items. My personal favorite, however, is the 12 craft beers on tap. Food is served from 5PM to 11PM Tuesday through Saturday and the bar remains open until midnight. The owners run a similar place in Tarrytown. (Ours is better.) Bramson Supporters UCBNR Against Echo Bay Development By PEGGY GODFREY United Citizens for a Better New Rochelle’s (UCBNR) statement “setting the record straight” reaffirmed their non-partisan opposition to the proposed Echo Bay development project. What was new in their statement was a list of the party membership and previous donations made in favor of Mayor Noam Bramson, and New Rochelle Councilmember Barry Fertel’s campaign efforts.The original eight founding members were Daniel Bases, Adam Egelberg, Jeffrey Hastie, Dmitry Khaykin, Andrew Newman, Bradley Richmond, Howard Stevens, and Noah Syken. Most of them had voted for
Bramson and supported him financially and politically. Although they rejected the Forest City Residential (FCR) plan for Echo Bay, they also wanted to “showcase the waterfront” in New Rochelle. They believe any and every development should improve the city’s finances. UCBNR members cannot appreciate the presently proposed plans as they do not meet the tenets to which UCBNR subscribe. UCBNR’s highly visible law signs and their “overwhelming opposition” to Forest City Residential’s plan is certain to give voice to the group’s perspective to all of New Rochelle’s elected officials and validate

Bramson Supporters UCBNR Against Echo Bay Development Continued from page 11
the position of others who are not as vocal. Proponents of Echo Bay have tried to label the Westchester County Executive race a partisan issue but UCBNR, whose members have donated $2,150 to Bramson, refute the assertion. Andrew Newman said the group is not opposed to development. More specifically, the “tens of millions dollars of costs” and insufficient offsetting revenue”, according to Howard Stevens, would create a “large new tax burden” for residents. The group further asserts because Bramson accepted at least $5,000 in contributions from Forest City Residential, he must recuse himself from voting on the proposal. A list of UCBNR political contributions can be found on the website: www. EchoBayfacts.com. UCBNR had produced a list of reasons
why the New Rochelle City Council should vote “No!” on the Echo Bay Development Project. Firstly, approval would be nothing more than a contribution of corporate welfare to Forest City Residential, while the City of New Rochelle would lose $20 million in tax revenue in the process. The retail space of under 25,000 square feet in the revised plan is too small to produce any real increase of sales tax. The already crowded public schools would become overburdened with more students. Dredging the mud flats will not occur, rendering the residents’ waterfront usage to only six hours per day. Worse yet, the proposed four-story building actually walls off the waterfront. In addition to the $20 million in lost revenue, another $34 million will be needed in debt service to move the present venue of City Yard to another location. The group characterized the finances in the report as “Voodoo
Accounting.” When the public hearing on July 23, 2013 was held on the proposed Echo Bay redevelopment, UCBNR attended. Those residents opposed to the project outnumbered supporters by more than l0 to l. However, it was Bramson’s comment at the end of the long hearing that “he was not counting heads” on this issue and his vow to vote for “the best interests of New Rochelle,” that triggered a response from the members of the UCBNR that had come to speak at the hearing. The members felt they needed to show the Mayor and the City Council that “heads do matter, “ especially since there was evidence from that hearing among other civic meetings that the people in the community were overwhelmingly opposed to the proposed Echo Bay Development. The group decided to purchase a large number of lawn signs, which could be placed
at homes of residents who opposed this -”ill-conceived and ill-financed project.” Astonishingly almost all the signs UCBNR had purchased were distributed in two days. This, the committee hoped, would show Mayor Bramson, “opinions and ideas of his constituents do matter” and that democracy is not “one man’s opinion.” Further, the Echo Bay proposal should not be “rammed down” the residents’ throat, especially since it does not benefit the city. The group accused Bramson of using “scare tactics” and financial gimmickry and using a developer with a “checkered past,” (perhaps alluding to the Ridge Hill Development scandal). Approval of Echo Bay Development Project would be a black eye suffered by the community for many years. More information can be found on their website, http://www.echobayfacts.com . One member of UCBNR, Jeffrey Hastie, who also serves on the New
Rochelle School Board, spoke about New Rochelle Board of Education costs. He previously believed residents had trusted New Rochelle’s elected officials. (He is is listed having donated a total of $1,100 to Bramson’s campaign efforts.) Adding to residents’ concern was New York State Comptroller Thomas DiNapoli’s report that the New Rochelle Industrial Development Corporation (NRIDA), which was scheduled to give benefits to Echo Bay, rated the project second worst in New York State. The present Forest City Residential proposal does not open up the waterfront and the conditions in the deed of the New Rochelle Armory are not being met. Chris Burdick: Candidate for Bedford Town Supervisor By RICH MONETTIª With the coming retirement of Bedford Town Supervisor Lee Roberts, the top spot in the town is open. Chris Burdick has secured both the Democratic and Independence Party nominations in the November 5, 2013, general election, and feels his long service on the Town Board gives him a decided advantage over the Republican challenger, Don Scott. “Being the only candidate with town board service; it’s an important consideration. Nearly six years on the Board, I’ve
participated in formulating solutions and working with my colleagues in a nonpartisan way,” he asserted. In that capacity and approach, Burdick stands proudly for his part in keeping property taxes down. “When I was first elected the average annual tax increase for the town was 5.4%. We’ve now brought that down to 2.4% annually,” said Burdick who is an attorney with a law degree from Seton Hall. Under the tax cap, Burdick sees his fiscal contribution to the town board as one where it hasn’t become a trade off with services. Always looking to find ways to cut costs, Burdick took the initiative when he

Chris Burdick: Candidate for Bedford Town Supervisor. found the town wasn’t seeking competitive bidding on insurance policies. Pressing the issue, Burdick got highly favorable results. “We saved over a half-amillion dollars on competitive insurance bidding alone,” he advised. He has extended the competitive approach across numerous areas, while supporting agreements with the county and other municipalities to share services. But neither success is necessarily an exercise in reinventing the legislative wheel, and any winning candidate will operate along similar lines. “I think that goes to a larger question,” Burdick says as he complimented his opponent as a “nice fellow” who’s done “a lot of good for Bedford.” Once again Burdick is referring to his
time spent on the town board, and his opponent’s lacking in that regard. “I think I’m better equipped through that experience and have the readiness to serve as supervisor,” said Burdick who is also a Senior Vice President at Stewart Title Insurance. That said, he defers on the idea of a town wide reassessment. “It sounds like a compelling argument since the last one was done in the early 70s, but that doesn’t mean the system is totally broken,” he said. Coming in at a cost of $900,000 for a total town reassessment, he believes the returns wouldn’t add up. He sums it up primarily in the fact that only one other town in the Bedford Central School District and none in Katonah-Lewisboro would take part. “Without all of them,” he said, “it’s like the sound of one hand clapping.” On the other hand, if a tree falls in the woods, he just wants to make sure there’s always another one to replace it. “We have something precious in our town, which is beauty and our semi-rural character,” he said. His Dark Skies initiative had just that in mind. With an eye on conserving energy but to also preserve the beauty of Bedford’s dark nights, Burdick was key in setting standards for future lighting in commercial areas. “Our night sky might not look like Canada’s, but its certainly not White Plains,” he noted of the Dark Skies law. There’s more to it, though, than aesthetics. “As you know, the wetlands are very important to protecting our water quality, and as chair of the Wetlands Control
Commission, I worked hard in that capacity to achieve and fulfill the objectives of the law,” he said. At the same time, Burdick did so in a manner respecting property owner project plans. “I tried to do it in a way that they were nearly always able to proceed – maybe not precisely as they first set out, but with reasonable modifications,” he said. He’s a lot less yielding on the issue of Fracking. “I think based on the present science and practices it would have a harmful effect,” he said. This especially since the hamlets of Katonah and Bedford Hills get water from New York City’s upstate reservoirs. He also hopes to stand firm against the next wave of severe winter storms and hold the utilities accountable. One such shortcoming was in the breakdown of communication. “It was quite lacking, particularly with NYSEG in terms of coordinating with the National Guard and our own Department of Public Works,” he said. As such, he plans to work with County Legislator Peter Harckham so cell towers have backup generators. “This way at least cell service can be retained,” he said, and emergency communication is not silenced,” he advised Finally, he finds himself in search of his opponent’s positions. This is in stark contrast to the manner in which he’s running his campaign. “I don’t have a problem in letting people know where I stand,” he concluded. Signature Oak Tree Losing a Limb Demands Bedford Board Discussion By RICH MONETTI
On Tuesday, October 1, 2013, The Bedford Town Board took up a very specific, somewhat narrow issue that truly reflects the town’s broad commitment to the environment and the desire to preserve the rural beauty of their community. A limb from the town’s signature oak tree suddenly crashed to the ground, and as
the board addressed the occurrence and its importance, a divergence between experts emerged on how to proceed. The falling from “The Bedford Oak” elevated to a level of significance because no external factors like high winds or rain preceded the thud. Nonetheless, the root system, according to Doug Erickson, local Branch Manager of SavAtTee, is in good health, but a distinct level of saprot exists in the tree structure remains a
long-term concern. Determined by way of a scanning process, Erickson recommended an approach that condenses the outward crown of the tree by pruning. “This puts a lot of stress on the structure, said Erickson. Bedford’s Tree Advisory Board was in agreement. “Analyze the soil and give it what it needs,” said Serio. But he differed on the cause of the recent drop. Attributing the incident to a syndrome known as Sudden Branch Drop, it occurs as inner portions of the tree dry and the outside humidity rises on calm days. “I believe the weather conditions were perfect that day,” said Serio.
In turn, he likened taking the invasive approach of pruning the tree to giving a 99 year old man new hips and knees and then expecting him to walk happily out of the hospital. “The surgery will do more harm than good,” said Serio, who has been working with the Cornell Cooperative Extension on the problem. In tree-speak, any augmentation amounts to a draining zap that only

The Board thus was perfectly satisfied to let the experts analyze all the data and then afford the tree its proper justice. “I feel confident that between both of you, the best course of action will emerge,” said Supervisor Roberts. Four years ago, when Rob Astorino ran against incumbent long term County Executive Andy Spano, a chunk of his campaign had to do with Mr. Spano and his 9th floor employees campaigning on the taxpayers dime. Fast forward to 2013 and if you are an astute campaign watcher, you’ll see that Mr. Astorino has adopted the same strategy that Spano used. Political patronage staffers are out on the campaign trail every day and not in their offices. All that one has to do is to spend a few days sitting on a bench in front of 85 Court Street in White Plains
and watch the comings and goings of those who are supposed to be working on the 9th floor of the County Office building. With campaign breakfasts and photo-opportunities occurring on a daily basis, it’s not unusual to see high ranking staff members arriving to work after 11:00 am or to take a walk down the block to Republican Headquarters on Mamaroneck Avenue to see county staff members stuffing envelopes or making phone calls. one has to wonder with a good chunk of the 9th floor spread out throughout the county, extolling the virtues of the current CE, then who is preparing the budget ? Running on his record of stopping the tax madness, Astorino reminds voters that he has not raised taxes in the four years he’s been in office. As a matter of fact, he campaigns on the platform that he and the County Board of Legislators have cut taxes by 2 %. At what cost however; child care, bus routes, laid off union workers? He has claimed that he has
streamlined government and has indeed laid off hundreds of county workers to save money on salary and benefits. What many people don’t realize is that he has replaced those laid off workers with many, many of his own staff who were “owed” a position whether it was a payback for a large campaign donation or diligent campaigning in the past. It is common knowledge that every new administration will bring in their own people but when the voters continually hear “it’s not in the budget” while county

Spano was far from perfect but if we think the Astorino administration is as pure as the driven snow, then we’ve all been mistaken. The drivers are still there, the power lunches still go on, there is still the fleet of county vehicles complete with drivers being used, body guards abound and DPW contracts being handed out. Yeah, it is all still there, it’s just hidden a little bit better these days. Voters have a choice this November and the outcome is ultimately up to them. There may not be the overt trips to China or the purchase of Chinese
granite to rehab the Kensico Dam but there is the same amount of waste and corruption. This group is just a little sneakier and a bit more devious all hidden behind a cute face and great public demeanor. Yeah, Rob Astorino and his administration members are every bit as wasteful and arrogant as his predecessor. You have to wonder when Astorino looks in the mirror, which is in the reflected image; Andy Spano has never looked better.

This is just so disingenuous and disheartening to see qualified county workers laid off while word of new hires and promotions for those in the friends and family network swirled around the streets of White Plains this week. These
same promotions were given to individuals who never even took or passed a Civil Service Examination. That’s not honest and clean government; it is more like a game of three card Monty…as is the budget. Voters by now should be starting to realize that the CE isn’t saving taxpayers a ton of money, he has played musical chairs with his hires and he has had his bean counters manipulate this budget
in an accountant’s nightmare of musical budget columns. Borrowing against a fund balance and moving money from Column A to Column B isn’t good budgeting. Sooner or later, what is borrowed will have to be paid back and it will be the taxpayers who will be left to pay the bill. Anyone can balance a budget when you move a fund balance back and forth but that’s not transparent government. and his implicit threat to them to do things “his way” and if they support him, he will support them, which under the law may be a criminal act, but certainly, corrupt activity. Is this the way a mature, sophisticated elected public official should conduct themselves? While the Guardian agrees that a City Council person should certainly have an independent mind of thought, tactics like these are corrupt and unacceptable. Questions and answers from the Westchester Guardian Q-Currently, Latinos make up less than 2% of the elected judiciary in New York State. What is your opinion and why? A-The problem is not getting Latinos elected; the problem is getting them on the ballot. New Yorkers are informed voters. They want candidates they can relate to. Diversity is the norm in New York, but not always in judicial elections. If elected, I would be the first Latino Supreme Court Judge ever elected in Orange County and one of the few ever elected in the 9th Judicial
District. Experience and knowledge of the law is crucial, but a judge’s understanding of people, their backgrounds, and culture are essential features in explaining how the law may affect them. Just look at the United States Supreme Court; it stands as proof that America’s greatest strength is the diversity of her people. Q- You are a mother of triplets, an attorney, judge, sportswoman, and conservationists. How do you handle it all? A-I grew with the belief that God does not give you what you cannot handle. My parents struggled to raise 7 children. My father was a factory worker and my mother a school safety officer. They sacrificed so their children could realize the American dream. Hard work, honesty, and a firm grasp of right and wrong are what I inherited from them. That is how I handle it. My triplets were born premature at 27 weeks, and less than 3 lbs. each. It has been challenging both emotionally and financially. Faith is a powerful tool. It overcomes every hardship. Each step we take puts us that much closer in bringing meaning and purpose in our own lives and prepares us to better understand each other. I know the law… I also understand the people who come before me on the bench. American justice is not only about the law; it recognizes the dignity and rights of the people who appear before her. Q- I understand you are licensed to carry a firearm. Yes. The Constitution and The Bill of Rights grants us the right to responsibly protect ourselves. It is a right the Founding Fathers entrusted to their fellow Americans.
Q- What inspired you to become a judge? I must confess it is the American judicial system, which inspires me. Our system of justice serves as a model for the rest of the free world. This week, all eyes were turned to Oslo where the 2013 Nobel Peace Prize recipient was announced Friday. Surprisingly, I was not issued a press pass this year and so like you, I was forced to wait with bated breath to find out which visionary would be ushered into the pantheon of peace, alongside such placid prodigies as Yasser Arafat, whose covert and overt support of so-called Palestinian terrorism directly led to the deaths of untold numbers of innocents and provided the basis for today’s continuing aggression toward Israel. Or Kofi Annan, whose inaction during the genocidal purges in Rwanda and the Balkans failed to halt the deaths of more than half a million people (at least 500,000 in Rwanda and 8,000 in Bosnia). And let us not forget Secretary of State Cordell Hull, upon whose advice FDR denied port to the SS St. Louis, a ship carrying 950 Jewish refugees from Europe in 1939. The refugees would ultimately return to Europe and most of the passengers would perish in Nazi concentration camps. Hull was given the Nobel in 1945. In light of these stellar alumni and the ho-hum-ity of the winner, it seemed necessary to offer the selection committee some suggestions, as it appears they could use a refresher on who is responsible for peace around the world. In a world seemingly more volatile by the news-cycle, finding a crop of nominees for a peace prize is not easy. However, I do not take this responsibility lightly and have spent the last couple of weeks combing through newspaper headlines, conducting hours of interviews, and leaving no stone unturned. This last task being the most important, given the number of past winners who were likely found in that very location: under a rock. Without further ado, I give you my Nobel Peace Prize Nominees for 2013: The 7th Circuit Court of Appeals in Illinois - The 7th Court of Appeals in Illinois struck a blow for peace by forcing the oligarchy in Illinois to adhere to the 2nd Amendment, finally allowing Illinoisans to protect themselves and
their families outside of the home. And as we know from the statistical evidence, this in turn will deter violent criminals from preying on law-abiding citizens. Given that Illinois is home to the murder capital of the world, as categorized by the FBI, any deterrent to violent crime will be an improvement. NFL Commissioner Roger Goodell – Pulling an 8-figure income isn’t easy in this Obamaconomy, but Commissioner Goodell deserves every penny of his reported $29m salary, for doing his best to remove violence from the game of football. Conventional wisdom would have suggested that ticky-tac fines and mandatory pink uniform accessories were anathema to an organization which spawned the likes of Mean Joe Green, Concrete Charlie, and the Nigerian Nightmare, but conventional wisdom is no match for a nanny in an expensive suit. The National Park Service Director – The Director of the NPS is a thankless job, but making it difficult to visit sites which commemorate violence, like the World War II Memorial in DC, is the first step towards breaking from America’s blood-soaked, imperialist past. Or at least that’s what my college History professor told me to think... Sydney Leathers – This young woman deserves a nomination simply for putting the spotlight on NYC mayoral candidate Anthony Weiner, virtually guaranteeing a temporary cessation of violence dealt to American eyeballs by more Weiner selfies . . . at least until the end of the campaign. Arab Spring, Part Deux – It is rare that the sequel is better than the original, but the Arab world has done its best to prove this maxim wrong. Just when it seemed that the inspiring scenes of brotherhood from last summer’s Arab Spring were peerless in the annals of democracy, this summer’s festival of bonhomie across the Middle East has doubled-down. The Obama Doctrine of encouraging radical Islamist “democracy” while ignoring the ensuing threat to the safety of cultural minorities is paying dividends like never before. Which brings us to… President Obama – Yes, he has already won the award but to be honest,
can you think of anyone who better deserves a second helping of Europhilic adoration? To be frank, he has been the best firearm salesman the world has ever seen. There were an estimated 67,000,000 firearms purchased during his first term in office and plenty more since, including a record 4.7 million firearms in the last 2 months of 2012. As a firm believer in peace via superior firepower, I am nominating President Obama for a second Nobel Peace Prize for helping to sell more guns than Sam Colt. All sarcasm aside, I do have a genuine nomination for the 2013 Nobel Peace Prize: the U.S. Special Forces Operator. No group of men has done more to secure a peaceful future for the world than these few, these dangerous few. They endure deprivation and isolation to make the world a safer place and they never, ever get the appreciation they deserve. Not only do they put blood-thirsty animals down for dirt naps on the regular, but they do so from the shadows, with no regard for fame and/or fortune. As Orwell said, “People sleep peaceably in their beds at night only because rough men stand ready to do violence on their behalf.” If there was any fidelity to the nominating process and if the panel of judges had two logical thoughts to rub together, they too would nominate the U.S. Special Forces Operator for the Nobel Peace Prize, for 2013 and many years to come. Should A Victims’ Fund Only Be For Victims? By LARRY M. ELKIN Almost from the minute it began, the BP oil spill of 2010 has muddied the distinction between error and crime. Even before the crude oil stopped flowing in the Gulf of Mexico, Attorney General Eric Holder and President Obama made it clear that punishment was a priority. Two years ago, I wrote about the efforts of Ken Feinberg, the administrator of the Gulf Coast Claims Facility, who faced the unenviable task of trying to wrench as fair a result as he could out of a system that seemed designed to hurt BP rather than to fairly measure the company’s liability. Carl Barbier, the federal district judge who oversaw the final BP settlement last year, appointed Patrick Juneau as the settlement’s claims administrator. BP has insisted, in every public forum it could find, that Juneau misinterpreted the compensation formula to which it agreed in its settlement, paying claims that were inflated or entirely fabricated. As BP has no control over payments to claimants, it could do little else but fight the process in court. Barbier, however, initially upheld Juneau’s interpretation. Meanwhile, claims for exaggerated or nonexistent losses continued to drain the relief fund, for which BP had not negotiated a cap.
BP’s complaints have finally gained some legal traction, yet the dispute remains very odd. In what other advanced country could there possibly be a legal debate over whether a fund established to compensate victims for damages should be limited to compensating real victims for real damages? According to Louisiana trial attorneys and Barbier, real damages were not a requirement for deciding the amount of the company’s settlement fund. The fund was carved out of the $20 billion that Obama strong-armed from BP when the oil was still flowing from the busted Macondo oil well. The Fifth U.S. Circuit Court of Appeals, however, took issue with Barbier’s decision in a divided ruling. The judges sent the case back to Barbier, ordering him to craft a “narrowly-tailored injunction that allows the time necessary for deliberate reconsideration of these significant issues.” As a result of the court’s decision, Barbier issued an order for the settlement fund to suspend payments on business claims in which the “matching of revenues and expenses is an issue,” though other claims will continue. The Washington Post reported that BP has lost about a third of its value since the Deepwater Horizon disaster. The company was initially eager to settle, but the extent of the claims eventually engendered pushback from the company. Eventually, BP had to fight in two courts – the Fifth Circuit and, through a

And, after all, parliament would come through in the next session. Well, it all reminded me of a game we used to play as kids called “Let’s Pretend.” So, I’m going to live for the moment in the sanguine world of the dreamer and pretend that we still live in a Constitutional Republic and that Miley is virgin, just going through a phase. Let’s pretend that President Obama is really just a Democrat. There’s no evidence that Barack Obama is a Gramsci-Alinsky

The Louisiana bar treated the fund, sadly but characteristically, as just a trough from which to feed. Of course, BP only won the appellate decision by a 2-1 vote. Judge James Dennis, who wrote the dissent, argued that “BP has not satisfied its heavy burden of showing that a change in circumstances or law warranted the modifications it sought.” When it comes to justice in Louisiana, two out of three may be about as good as it gets. So the bontemps will roulez a little more slowly now. It is nice to see the system work, after a fashion. Even in Louisiana.

Let’s pretend that this climate is no different than the Carter ‘70’s; after just one term, the misery index will lead to certain defeat for Obama and the Democrats and Ronald Reagan will be waiting around the corner. Oh, wait. Well, let’s pretend this is no different than Jimmy Carter’s second term, right? We have a bumbling executive whose poor decisions are leading to temporary economic woes that we can turn around in a few election cycles by collecting signatures, walking precincts and listening to Lee Greenwood on our Discman. Then we’ll just vote the rascals out and the Republicans will act responsible and turn the ship around. Wait, why are Bill Kristol and Charles Krauthammer playing with chunks of ice on the Promenade Deck? Let’s pretend the rascals aren’t doing everything within their abused power to affect our fair election systems: like shunning photo ids, stuffing ballot boxes, rigging machines, or coaxing the homeless, the infirm and the room temperature to vote and to vote often. Let’s pretend that Democrats aren’t trying to give the vote to prisoners, rig the vote with illegals or suppress the vote with the IRS. Isn’t pretend wonderful? Let’s pretend that there weren’t any districts that had 110% of the registered voters turnout with 99% of the ballots for Obama. Let’s pretend that Ohio isn’t Cuba or Iraq. Let’s pretend that Elvis, Osama Bin Laden and Mickey Mouse really are registered Democrats in Nevada. Let’s pretend that we have an opposition party in this country that will stand for the Constitution and rally to the cause of the citizen. Let’s

Let’s pretend that the debt clock hasn’t been stopped for over 145 days at $16.7 trillion. Let’s pretend that the insurmountable debt and the socialized stranglehold of the healthcare debacle haven’t already sold our children and children’s children into bondage. Let’s pretend that the American People will eventually come around. That two generations of public school indoctrination and that Hollywood, New York and D.C. have had no influence on the low information voter. That there is a renewed interest in Bastiat and Friedman and, like Russell Crowe in “Cinderella Man,” the Obama zombies will rush en masse to the welfare office and turn in their Obamaphone and SNAP cards. Let’s pretend that there has been nothing nefarious going on, we can certainly turn it all around with a vote or two. The American body politic isn’t smitten with a flesh-eating virus - it’s just a fever. “This too shall pass,” - just sign these two petitions and call your “Cenataurs” and “Reprehensibles” in the morning. Let’s pretend that the Constitution wasn’t only made for a “moral and religious people” and that it is wholly adequate to the government of any other. Let’s pretend that the chains that have been forged will dissolve in wishful thinking and a faith in fair play. Let’s pretend that Marxists don’t lie, cheat, steal, and kill until the ends justify their “mean.” Let’s pretend that American Marxists don’t act like Marxists of any other country at any other time. Let’s pretend that we are Martin Luther King Jr. and Gandhi and that our adversaries will be constrained by their Christian “worldview” like the Imperial Brits and the 1950’s Americans.
