FREEDOM FROM ABUSE AND PROTECTION OF HUMAN RIGHTS

NB: This policy incorporates the BINSA Freedom from Abuse Policy

Overview The Brain Injury Network of South Australia Inc. (BINSA) will not discriminate against staff or clients on the basis of race, colour, sex, language, religion, political or other opinions, national or social origin, state of wealth or birth.

Policy Statement BINSA is responsible for ensuring reasonable steps are taken to prevent assault, neglect and abuse of clients and staff must employ respectful strategies and approaches when working with all clients; including those who have challenging behaviour or communication difficulties. BINSA is responsible for training staff in regards to preventing, detecting and reporting abuse. Clients of BINSA have the right to: 

Respect for their individual human worth and dignity

Be treated with courtesy

Access the service without discrimination

Be informed and consulted about their care

Choose from available alternatives

Pursue a complaint without fear of retribution

Involve an advocate of their choice

Receive good quality services

Privacy and confidentiality

Information about Human Rights will be provided to staff on commencement of employment with BINSA.

Clients will be advised that BINSA have a policy on Human Rights.

Staff have a duty of care to report any alleged or suspected instances of abuse, assault or neglect to the Executive Officer (EO) or Program Coordinators. All staff and volunteers will have access to information and training which will assist them to undertake their responsibility to notify the National Disability Abuse and Neglect Hotline if he/she has reason to believe that a person with a disability is being abused and/or neglected. (See contact details at the end of this policy). The client maintains the right to make a decision about pursuing the matter within the criminal justice system. BINSA is responsible for recommending an advocate for the person to assist in making this decision.
