FREEDOM FROM ABUSE AND PROTECTION OF HUMAN RIGHTS

Information Information about Human Rights will be provided to staff on commencement of employment with BINSA. Clients will be advised that BINSA have a policy on Human Rights. Where staff are responsible for the security of clients personal effects, fair and clearly documented processes must be in place and accessible to the client or legally appointed or authorised person to make financial decisions on behalf of the client.

Procedure for Staff Members Responding to and Reporting Incidences of Abuse or Neglect The employees of BINSA are expected to: 

Seek immediate medical assistance and avoid contact between the person and alleged offender

All incidents must be recorded: o

The nature and extent of any incident

o

How the incident occurred

o

Name and contact details of those involved

o

Outcome of the initial follow up

o

Response provided

o

Date and signature of the person writing the report.

Documentation will be kept in a secure place and made available for inspection should it be required at some future time.

If the person making a report is unsatisfied they can refer the matter to: o

SA Police

o

SA Guardianship Board

o

Office of the Public Advocate

o

Ombudsman

o

Public Trustee

o

National Disability Service Abuse and Neglect Hotline

o

Department for Community and Social Inclusion (DCSI).

Procedure for Allegations against a Staff Member BINSA is to conduct an investigation into the allegation. 

Make recommendations and take actions in regards to the incident to prevent it from recurring. Actions may include: o

Counselling for the staff member

o

Training

o

Transfer of duties

o

Increased supervision

o

Official warning

o

Dismissal

Seek advice from the Department for Families and Communities or other relevant organisation

Document the actions taken and the outcomes and keep this documentation confidential and secure

At the conclusion of the process review the material and determine how the risk of the situation re-occurring can be reduced.
