2009 was a challenging year for families living in poverty and the civil justice community that endeavors to serve them. Legal aid organizations throughout the country and California experienced significant financial shortfalls with resulting reductions in service. At Bay Area Legal Aid, we moved the Alameda County office into the new building we purchased in downtown Oakland, added two terrific attorneys, welcomed three new fellows to our staff, and handled more cases and served more people than ever in our first ten years as a regional poverty law firm. Many of the cases we handled changed public policy, others changed unlawful practices, and all of them impacted the lives of our clients.

Our accomplishments are due to the work and contributions of many. As we reflect on BayLegal’s Tenth Anniversary, we would like to acknowledge four groups of standard bearers, beginning with the Board of Directors — the people at the helm of our efforts to establish the only legal aid firm serving the entire Bay Area, who hold us accountable to our mission and clients, and work tirelessly to mobilize the legal community to support our work. The Board’s stewardship has produced remarkable results. Consider that in our first ten years, we doubled the number of attorneys in our firm from 30 to 60, thereby strengthening our capacity to effectively serve clients throughout the Bay Area. In today’s legal aid world, that’s remarkable. Of course, the Board’s success goes hand-in-hand with the steady commitment of our Partners in Justice. You make possible our efforts to address our clients’ most pressing needs: housing, healthcare, economic security, and safety from violence. You help us represent the disabled, immigrant survivors of abuse, the working poor, the young, the old, and people of every color, language, ethnicity, and sexual orientation. Your continued support is vital to BayLegal’s sustainability and future success and a critical element to achieving what lies at the very core of our system of justice, the notion that everyone with a meritorious claim should have an opportunity to be heard. The third group is the BayLegal staff; the lawyers, advocates, and support staff in San Jose, Redwood City, San Francisco, San Rafael, Richmond, and Oakland who breathe life into our mission as you will learn from the stories in this annual report. A Domestic Violence Survivor Shares Her Story
BayLegal Attorney Earns Accolades from CLAY and Top 100
involved in illegal drugs and activities. He became controlling, violent and unpredictable. I suffered from verbal abuse and physical violence. I feared not only for my safety, but the safety of my children. I took a stand and after the most violent of attacks by my husband, called the police and pressed charges.
I truly had what I thought was the American dream. I was a stay at home mom, had a beautiful family with the white picket fence lifestyle. My husband had a great job, and seemed to be a devoted father.
Ultimately, he pled guilty to felony domestic violence charges; however, he continued to make my life a living hell. Divorce proceedings were filed, a custody battle ensued and I attempted to represent myself during this horrific ordeal. I was struggling to physically protect myself, my four children and keep the divorce on track. I had no job and no financial support. I was referred to Bay Area Legal Aid by the Judge on my case and met with a BayLegal attorney. After a three year legal battle I obtained a long term restraining order, full custody of my children, child and spousal support orders, had the divorce finalized and regained control of my life.
Unfortunately it quickly all came to a very dramatic end. My husband suffered a major mental breakdown stemming from Bipolar Disorder. He began self-medicating and became seriously

Minouche Kandel was among 43 California attorneys honored for their achievements as California Lawyer Attorney of the Year (CLAY). In addition to the CLAY award for her domestic violence work, Kandel was listed by the Daily Journal as one of the “Top 100” most influential lawyers in California in 2009. Ms. Kandel joined BayLegal more than 13 years ago. A graduate of Harvard Law School, her work in public-interest law extends over a decade to her volunteer work with Oakland-based Shalom Bayit. The daughter of Holocaust refugees, her career in social justice is influenced by her parents’ past. Focusing mainly on women’s issues, Ms. Kandel represents battered immigrant women to help them escape domestic violence.
Domestic Violence In the LGBT Community Members of the low-income Lesbian, Gay, Bisexual and Transgender (LGBT) community often do not have the information or resources to advocate for their rights in disputes concerning domestic violence, custody, public benefits and property distribution. In 2009, BayLegal welcomed Alana Chazan, Equal Justice Works/Greenberg Traurig Fellow to begin to address the specific and often complex legal issues LGBT families face. Alana’s project is designed to empower individuals and protect the legal rights of the Bay Area’s low-income LGBT families by providing direct legal services, and by conducting training, education and outreach to inform people of their legal rights and resources.

A domestic violence restraining order is a powerful civil order that includes provisions to protect a domestic violence survivor and her children, providing means to gain independence and to escape the violence. BayLegal operates clinics in Concord, Pittsburg, Antioch, Redwood City and in San Francisco with the Cooperative Restraining Order Clinic (CROC). In San Mateo County, BayLegal is a member of the San Mateo Domestic Violence Collaborative Partnership with Legal Aid Society of San Mateo and Communities Overcoming Relationship Abuse. Through the partnership, pro bono attorneys provide limited representation in domestic violence restraining order hearings for unrepresented low-income domestic violence survivors.

LBEP Program Helps Cancer Victim Return to Work Diagnosed with colon cancer at age 59, John was forced to stop working as a truck driver in order to get the lifesaving medical attention he needed. John was fortunate and his cancer went into remission. He found himself ready to get back to work, however, this proved to be a more difficult task than he imagined. While recovering from his illness, John failed to pay a ticket he received for improper use of the carpool lane, and his license was suspended.

John made an effort to pay the fine but this proved impossible. John’s limited disability income barely covered his meager living expenses, and left little to pay toward the ever-compounding
In Contra Costa County BayLegal brought suit challenging the county’s administration of its General Assistance (GA) program. BayLegal attorneys, along with co-counsel from the Public Interest Law Project (PILP) and pro bono counsel from Paul Hastings, demonstrated that the county’s management of the program was resulting in interminable delays in processing applications for the lifeline benefits. The Board of Supervisors accepted BayLegal’s settlement terms and GA applications will now be acted upon in a timely manner and retroactive benefits will be paid out as required by law.

On the same day, BayLegal’s Alameda County office was successful in its appeal of a GA rule requiring recipients to provide a copy of their landlord’s tax form showing rental profits were reported to the IRS. Those unable to provide the county with the document would have their grant reduced to basic needs (a maximum of $105 per month) and likely would have become homeless. The Court struck down the rule.
Stephen Bingham Awarded Champion of Justice Award From The National Lawyers Guild BayLegal veteran attorney Stephen Bingham was honored in March 2009 by the National Lawyers Guild for his lifetime of work dedicated to the pursuit of justice. From the Juvenile Probation Department Family Services Project – a project designed to ensure that low-income youth in San Francisco remained in intact families and out of the juvenile justice system—to the development of the Legal Barriers to Employment Project (LBEP), Steve remains at the forefront of helping families break the cycle of poverty.
fines. John was caught in a never-ending cycle: without a job he was unable to pay off the remaining balance on the fine. Until he paid off that balance, though, the hold on his license would not be revoked. The financial difficulties he faced placed John in a complicated situation: he had a job offer from an old employer but was unable to clear the fine he owed to the DMV. John acknowledged that he had made a mistake by using the carpool lane, but he needed help. He turned to BayLegal and its unique, free legal aid program, the Legal Barriers to Employment Project (LBEP). BayLegal worked with John to apply for a loan to the LBEP remediation fund (funded by the SF Human Services Agency) for a loan to pay the DMV fees. BayLegal’s LBEP staff then contacted John’s previous employer to confirm that he was eligible for re-hire. John qualified for the loan and his application was approved. With the fine now paid, the hold on John’s license was lifted and he was able to accept the job offer from his previous employer. With the assistance of his BayLegal advocate, John had the opportunity to successfully acquire a loan to clear the fine, regain his license, and secure steady employment. BayLegal and the LBEP program ultimately provided him with the stability to reclaim control of his life. John is now back to work and is paying back his loan to the remediation fund.
PEOPLE STABILIZED THEIR HOUSEHOLD INCOME with help from a BayLegal attorney or advocate. A National Model for Helping People Get Back to Work BayLegal’s Legal Barriers to Employment Project (LBEP) helps San Francisco families and individuals receiving welfare benefits who are seeking to transition to work by addressing a variety of legal problems that interfere with their obtaining or retaining employment. LBEP, with its holistic approach to legal representation, has helped numerous former welfare recipients become economically independent. The LBEP successes have encouraged many of the project’s law students Steve supervises to pursue public interest law careers.
BUILDING HEALTHY COMMUNITIES
A CLIENT’S STORY
Collaboration Yields Justice Tremayne was seven years old when he was first diagnosed with severe asthma. Within months his condition worsened, requiring nearly weekly visits to San Francisco General Hospital’s (SFGH) emergency room. Nothing seemed to control his asthma. The flare ups were frequent and severe, leaving Tremayne gasping for air, even causing him to pass out and lose consciousness on more than one occasion. The level of care he required resulted in his mother’s frequent absence from work, which ultimately led to her losing her job.
Just after Tremayne’s eighth birthday he experienced another severe attack. His mother rushed him to the emergency room. He was treated with steroid infusions and other strong medicines to quell the attack. SFGH then prescribed these medicines to Tremayne to administer at home in an effort to prevent future deadly flares of his disease. The medical staff also determined that the frequent flare-ups were likely caused by the family home. The apartment they lived in was infested with mold and pests. With his mother unemployed and living on a fixed income, the family did not have the resources to move to a mold- and pest-free apartment. SFGH referred the family to the office down the hall from the emergency room – the BayLegal/SFGH medical-legal attorney, Sabrina Adler. With the help of BayLegal, Tremayne’s family successfully appealed a prior denial of disability benefits for Tremayne. Using this new source of income the family was able to move to an apartment that does not have such a detrimental effect on his asthma.

A Community Works Together to End Domestic Violence BayLegal serves as the sole provider of comprehensive legal services to clients at the Alameda County Family Justice Center (FJC), which was established to help domestic violence survivors escape the abuse in their lives. A BayLegal Fellow, Linnea Forsythe, sponsored by Equal Justice Works/Bingham McCutchen, works in collaboration with other service providers to establish a safety net of supportive services for victims of domestic violence, including restraining orders, mental health counseling, transportation assistance, employment assistance, and medical services.

The establishment of the civil legal clinic at the FJC has resulted in more robust services that domestic violence survivors require to escape the violence and build new lives for themselves and their children.
BayLegal Establishes San Francisco’s First Medical-Legal Collaborative
Empowering Families to Break the Cycle of Poverty The destabilizing issues faced by the poor are often compounded by their lack of access to civil legal remedies. For this vulnerable population, an unwarranted eviction notice, the presence of domestic violence, or wrongful termination of healthcare or government benefits can have significant long-term effects on their self-sufficiency. In addition, low-income people are often targets of illegal practices precisely because they cannot afford legal assistance when their rights are violated. BayLegal’s free, high-quality civil legal assistance helps increase the quality of life and self-sufficiency of low-income Bay Area residents by helping victims of domestic violence and their children escape the abuse and begin to establish long-term independence; assisting tenants in asserting their rights and preventing homelessness; assisting clients in underserved groups to obtain or retain health care; and assisting clients who have no other means of financial security to obtain or reinstate their public benefits.
Children living in poverty frequently experience poor health as a result of many destabilizing factors. Leaky roofs, mold, and rodent infestations produce poor indoor air quality that can cause or exacerbate health conditions such as asthma. While medical providers can treat asthma, they are not often in a position to take steps to prevent or eliminate the underlying housing conditions that may have caused it. In addition, factors such as a lack of health insurance, homelessness resulting from escaping domestic violence, and inadequate income for food have severe negative effects on the health and wellbeing of children and their families. These and other problems undermine the efficacy of even the best medical treatment. To lessen or eliminate the poverty-driven factors that exacerbate children’s medical conditions Bay Area Legal Aid has partnered with the Children’s Health Center at San Francisco General Hospital (SFGH) to establish the city’s first medical-legal partnership. The program provides free legal assistance related to housing, public benefits, health access, family law, disability, and special education to low-income children and their families. With a BayLegal attorney housed on site at SFGH, the partnership provides low-income children and families with legal assistance to which they might not otherwise have access.
PRESERVING AFFORDABLe HOUSING
A CLIENT’S STORY
The Unseen Victims of the Foreclosure Crisis Richard Gonzalo is a single father of two young boys. His youngest son, Jeremy, suffers from severe asthma. Last year, Richard rented several rooms in a home. After moving into the home, paying his deposit and first and last month’s rent, he learned that the home was in foreclosure. Living on a fixed income, Richard did not have the resources to move his family again; he needed time to save money. He tried contacting the landlord about the foreclosure and to discuss getting his security deposit back to put toward a down payment on another apartment, but his efforts were unsuccessful. After a few weeks Richard was served with eviction papers by the bank.

Instead of going through the proper court process to evict Richard and his children from the foreclosed property, the bank sent a real estate agent who locked the family out of their home with no notice whatsoever. The bank blocked access to all of their clothing and belongings including Jeremy’s asthma medicine. Richard took his family to a motel that night in hopes of working out a solution with the bank in the morning. When Richard was unable to make any progress with the bank he turned to BayLegal for help. A BayLegal attorney specializing in helping low-income tenants facing eviction after foreclosure met with Richard and took immediate steps to get the family back into the home to retrieve the family’s belongings, in particular, Jeremy’s asthma medication. However, the bank neither allowed Richard to move back in nor gave him the move-out notice he is entitled to by law. As a result, BayLegal filed two separate lawsuits on the family’s behalf. The first suit is a forcible detainer suit, which would give Richard the right to have possession of his home. The other is an unlawful eviction case, which would entitle him to damages based on the lock out. BayLegal obtained a favorable ruling in the forcible detainer suit and the unlawful eviction action will move forward this year.

The often unseen and unknown casualties of the foreclosure crisis are the tenants who occupy the homes going into foreclosure. Renters who are suddenly living in foreclosed properties find themselves at an increased risk of eviction and on the verge of homelessness. Banks foreclosing on properties, as well as the agencies hired to manage the properties frequently neglect the rights of tenants living there. Tenants, many of whom are elderly or disabled, are often subject to repeated, aggressive demands to move out, and many have had their utilities abruptly and wrongfully cut off, leaving them in untenable conditions. Tenants often lose their security deposits, months of rent, and have their credit scores ravaged when banks mistakenly list them as defendants in foreclosure cases. Tenants can also encounter additional challenges looking for a new home to rent if they have an eviction on their record, as most landlords do not want to rent to a previously evicted tenant, regardless of the reason. The need to enforce the housing rights of tenants of foreclosed properties is growing, and experts predict that it will only continue to do so, which is why BayLegal started its Eviction After Foreclosure Rights Project.
