The code for workers’ thermal shock is not implemented The code for workers’ thermal shock that was issued in June 2014 by the Labour Ministry is not implemented by many employers, as noted by PEO, warning that the workers’ health and safety is at risk. In a letter sent to the Labour Minister, the S.G. Pambis Kyritsis, calls her to accept the adoption of the recommendation of PEO as for the Labour Inspection Department to proceed with the issuance of an announcement for the workers’ protection from thermal shock. “We have noticed that in spite of the attempt of the L.I.D. for informing about the Code and the obligations that it sets, a great number of employers does not implement the code, and as a result the workers’ health and safety are at risk. Unfortunately, the philosophy of auto-control and autocompliance, principles on which the code is based have not offered the expected results. It seems that the employers where they must autocontrol are not eager to do so”, as mentioned in the letter of Kyritsis to Zeta Emilianides. The issue of re-examination of measures taken for protection of employees from the thermal shock was set at a conference of the Labour Counselling Council and it was agreed that the

в связи с этим жизнь и здоровье трудящихся находятся в опасности. Генеральный секретарь ПЕО Памбис Кирицис направил послание в Министерство труда, в котором призывает министра Зету Эмилианиду одобрить предложение Федерации о том, чтобы Служба по инспектированию издала Заявление о защите трудящихся от теплового воздействия. В послании говорится: «Мы утверждаем, что несмотря на усилия Службы по информированию о Кодексе и обязанностях, которые он накладывает на работодателей, не выполняются его условия и подвергаются опасности здоровье и жизнь трудящихся. К сожалению, принципы, на которые опирается Кодекс, не дали ожидаемых результатов. Видно, что работодатели не желают делать это добровольно».
Вопрос о пересмотре мер, предусматривающих защиту трудящихся от теплового воздействия, был поставлен на заседании Трудового совещательного совета. Было получено согласие на то, чтобы тема, о которой говорится в послании ПЕО, стала предметом обсуждения Всекипрского совета безопасности и здравоохранения. Кроме того, в послании говорится, что на совещании Совета, состоявшемся в апреле 2018 года, ПЕО предложила, чтобы в качестве дополнительной и усиливающей меры защиты трудящихся, Служба издавала заявления. Это делалось в предыдущие годы; тогда работодателей обязывали принимать меры по защите своих рабочих от солнечного воздействия. Эти меры включали в себя запрет работы под открытым небом без специальной одежды с 12:00 до 16:00. Генеральный секретарь ПЕО отмечает: «Заявление окажет существенную помощь не только профсоюзным кадрам и комитетам по безопасности труда, но и трудящимся, которые должны настаивать на защите от жары. Памбис Кирицис добавил: «На заседании Совета безопасности и здравоохранения, где в очередной раз обсуждался этот вопрос, стало ясно, что отсутствует какое-либо желание принять дополнительные меры. В связи с этим, мы обращаемся с просьбой о принятии нашего предложения».

Right to strike is holy
Cyprus Health and Safety Council will occupy with this issue, according to the letter. As mentioned in this, during the meeting of the said Council in April 2018, PEO suggested as an additional and strengthening measure for the workers’ protection from the heat wave, for the Labour Inspection Department to proceed with the issuance of announcement as it used to do in the past, to record the results of measurements and to refer the measures that employers must take including the measure stating that workers should not work from 12.00 to 16.00 outside exposed to the sunlight. “This announcement will help the trade union officers, the safety committees and all the employees to better claim their protection from heatwave”, as noted by PEO S.G. and add that “due to the fact that in the recent meeting of the Health and Safety Council where this issue was again discussed, it was shown that there is no intention of adopting additional measures, we address you and we please you to adopt our suggestion aiming for the measures framework to be strengthened and improved for preventing the employees’ exposure to thermal shock conditions”.

By the chance of an announcement issued by OEV attacking the teachers, the doctors and the cooperators and calling the Parliament to vote a Law that will regulate the exercise of the right to strike, PEO stresses that if the Employers’ and Industry Owners Federation is really interested for the common good, it must stop causing fire by indicating that lawful claims of employees are evil and by bring back the issue of penalizing the right to strike. As stressed by PEO in an announcement it issued, the labour turbulence worrying OEV, it is mainly caused due to the decisions and actions of the government, which instead of respecting the agreed procedures of dialogue and negotiation, instead of acting as keeper of the social dialogue, it proceeds with unilateral decisions, which target the trade unions, aiming for burdening them with the dead ends and the weaknesses of Anastasiades’ government. PEO also mentions that via this public post, OEV states the right understating that the labour turbulence in education, health and Cooperative Central Bank has serious risks for the economy. However, the Federation wonders who they are those whom with their attitude and actions lead them to this labour turbulence. What is that it fires the developments that oblige more and more employees to go on strike to defend their rights in a modern democratic state?
Подготовила: Людмила Папаконстантину У ТРУДЯЩИХСЯ ЕСТЬ ЗАКОННОЕ ПРАВО НА ЗАБАСТОВКИ Федерация работодателей и предпринимателей (ОЕВ) выступила с Заявлением, содержащим в себе нападки на преподавателей, врачей и кооперативных служащих. ОЕВ обращается к парламенту с призывом принять закон, регулирующий право трудящихся на забастовки. ПЕО указывает, что если Федерация работодателей и предпринимателей в действительности заинтересована во всеобщем благе, то она должна прекратить осуждение законных требований трудящихся. ОЕВ не должна осуждать обоснованные требования трудящихся, вновь и вновь поднимая по любому случаю вопрос о наказуемости за проведение забастовок. Необходимо, чтобы соблюдались договорённые много лет назад процедуры урегулирования трудовых отношений, включая и вопросы забастовок в сфере оказания значительных общественных услуг. ПЕО подчёркивает, что трудовые волнения, так беспокоющие ОЕВ, в основном вызваны решением властей, которые не соблюдают договоренные процедуры диалога и переговоров, а идут на принятие односторонних решений. Тем самым они делают мишенью профсоюзные организации, на которые стараются переложить тупиковое положение и слабость, в котором оказалось Правительства Анастасиадиса. ПЕО указывает на то, что ОЕВ в своём заявлении верно отметила, что исподволь назревающие волнения в области образования, здравоохранения и Кипрском Кооперативном Банке таят в себе серьёзную угрозу для экономики страны.
