Sheriff denies NAACP entrance into jail

Are You Planning On Voting in this Election Are you planning on voting? You sure ought to be, there have been a lot of people who sacrificed a great deal in order to secure by Kenneth Lumpkin

NECKBONEOLOGY that right for you. If you think things are bad now, don’t believe for a moment that they will get better if you sit home on election day. Democracy is all about participation, and quite honestly, we need to be engaged on a full time basis, not just on election day. Getting to know who the candidates are for any particular office, even before the primaries, is actually part of our responsibility as citizens.

And speaking of candidates, some of us seem to believe that politicians are somehow different from the rest of us, that there are some sort of special qualifications that you must have to serve in public office. Well, as an elected official myself, who has been around other elected officials and candidates for office, I can tell you that isn’t necessarily so. The first and foremost qualification that you must have is a desire to hold office. Beyond that, anyone can do it, and there are certainly some who should not. There’s a reason why it is referred to as “public service”, because that’s what it is intended to be. Ideally, any elected official should be dedicated to serving the public that he or she represents. That means all of the people, not just themselves or their friends. Unfortunately, when we don’t participate in the process, and wait until election day to select from candidates that others have chosen, we can end up having to decide between two people who might not care about our needs at all. So what’s a citizen to do? Well, the very first step in becoming a participating member of this democracy is to register to vote. And it’s not that difficult (despite some people wanting to make it so). There are people actively working to get folks registered right now. If they haven’t found you yet, then I recommend you make an effort to find them. Call the NAACP at (262) 554-4611.

Fair and his attorney feel the Place On 6 is being targeted by city Racine Public Safety and Licensing committee, which consisted of three women and one man, on Monday night recommended that the liquor license for The Place on 6th, 509 Sixth St., owned by Alderman Keith Fair, be revoked. For nearly six hours a due process hearing, a court like proceeding, was held in the City Hall's council chambers, 730 Washington Ave. Committee members, chaired by Alderman Robert Mozol, sat through several hours of testimony before going into closed session to deliberate the controversial Alderman's Alderman fate. Alderman Ron Hart and Alderman Sandra Weidner listened briefly to the proceedings. All 15 Alderman, including the four that were on the committee, will vote on the matter when it matter goes before the full City Council later this month. The fifth time was the charm for City Hall's effort to have the bar shuttered. The committee and city have spent closed to $50,000 trying to hold a due process hearing to consider whether the establishment should be allowed to con-

tinue to sell alcohol or soda. Four previous hearing dates were either canceled or adjourned. The most recent attempt to hold the proceeding was canceled when the newly appointed Racine Chief of Police learned that he could not be a complainant because he did not live in the City of Racine. This led to Alderman Greg Helding, a self-appointed critic of Fair, to assume the role as the city's complainant. Fair's attorney then raised a question of the basic validity of the complaint inasmuch as it was prepared by the city attorney at taxpayer expense rather than by Helding himself. In Helding's complaint, the city alleges the bar “constitutes a disorderly Keith Fair or riotous, indecent or improper house,” and cites seven separate incidents between Jan. 1 and June 23. During testimony, police said they were called to the bar or an area near the bar for fights, assaults, other civil disputes or disorderly behavior, according to their Phoenix system. The Phoenix system is used by the police department to document patterns of police calls. Lt. William Macemon testified that he had tracked downtown bar active between June 1 and Aug. 16. Park 6 wins appeal over City of Racine Could Bar Reopen? Thomas Holmes, owner, looks at his options Wisconsin Court of Appeal has upheld Kenosha County Circuit Court Judge Bruce Schroeder was correct to overturned a decision by Racine aldermen to revoke the liquor license for the former Park 6 bar, 500 6th Street, according to a Wednesday, Oct. 10, ruling by the Wisconsin Court of Appeals. Thomas Holmes business was closed at the end of 2011 after a judge granted the city’s motion for a temporary injunction. The city’s had asked for a permanent injunction against the bar, but it was dismissed in February after a lease that Holmes had at the property expired. Holmas told the Insider News by phone that he was happy over the decision of the higher court. “My lawyer and I has long contend that the city was acting improper and maliciously,” he said. The injunction was the latest installment of the ongoing legal battle between Holmes and the city regarding Park 6, a local downtown club that was frequent by a primary African American clientele. Kenneth Lumpkin, a Racine County

Board Supervisor, said in a number of his bi-monthly columns entitle “Neckboneology” has long suggested that other Black bar owners feels the city of Racine is out to close downtown minority bars making their license available to other establishments. In the city complaint, the city argued the business was a public nuisance and had created numerous neighborhood disturbance. Holmes claimed the city was discriminating against blackowned businesses. In a 2009 report by the local branch of the NAACP, entitle: A Report on the State of Racine's Downtown, stated, “With the exception of one or two entertainment venues that recognize money as the only color, minorities/blacks be they patrons or owners/operators are not welcome downtown Racine.” In January 2011 after Holmes was called before the city’s Public Safety and Licensing Committee in December 2010 for a due process hearing after two incidents at his nightclub, the City Council voted to revoke the bar’s

liquor license Racine County Circuit Court asking for judicial review of council’s and committee’s decisions. In the petition, Holmes’ attorney, Vincent Bobot, said the city should not have held the due process hearing because then-Racine Police Chief Kurt Wahlen did not file a “sworn” complaint against Holmes. That wasn’t enough to stop the process, argued city officials. When Schroeder overturned the committee’s decision in August 2011, the city appealed. In its ruling, the Court of Appeals called “the oath or swearing requirement” important and not a “meaningless legal trapping.” “The solemnity imposed by an oath requires the actor to stop and consider the allegations he or she is making,” the ruling states. “Requiring a complainant to swear to his or her allegations prevents baseless harassment of legitimate businesses” Holmas said that the city should give him his liquor license back and he should be allow to reopen. “I am looking into the options available and soon will make a decision.”

Mrs. Owens has been a pioneer in Racine's Civil Rights Movement for over 50 years. Mrs. Owens targeted issues of discrimination, employment, and crime and fought for fair housing, and more minority representation on our police force. Snow said individuals in jail are counted during every census as part of the district voting block in which the jail is located. So, absent of any felony they should be afforded the opportunity to register to vote. "As a Felon, inmates are thoroughly informed that they cannot vote and once they become eligible we should be just as encouraging to get them to register to vote," he said. Alderman Fair feels that the civil rights organization should ask the circuit court to overturn Schmaling's decision. "In America people are innocent until proven guilty, " he said. Fair believes that the disenfranchising voters in the jail is another example of these Republican administrations trying to suppress the inmate's votes. Snow says, "There is no basis for jail inmates to be denied the opportunity to register to vote especially since most if not all of these persons are awaiting trial, with substantial additional numbers serving misdemeanor sentences, which do not result in disenfranchisement as a felon would." Rogers said that the NAACP will remain vigilant, but with only a few weeks before the presidential election, it is unfair that Sheriff Schmaling has brought an abrupt halt to the inmate's rights to vote.

Fair’s attorney, Vincent Bobot, question weather or not the report was being created to target the bar that host a primary Black clientele. During Fair's testimony on the stand, Fair seemed visible upset when he accused the city of practicing racism. “You trying to pit two Blacks against each other, the Chief of Police and me. Fair's attorney in his closing arguments alluded also to race playing a factor in the complaint. Bobot argued that the city has reputation for unfairly targeting minorityowned bars.” Fair's bar has been shut down since Aug. 16, after city officials contended it was a nuisance and brought action in Racine County Circuit Court against Fair. Old Timers League near playoff Upper photo: Traivon Woods #60, 12, running back for the Cardinals, and a student at Mitchell Middle School, makes a long gain before Damonta Hudson, #21, of the Tatins cought him and tackled him during last Saturday’s game. The two are members of the Old Timers Football Association 24 members team league. The 40 year old league provides full tackle football for youth from ages 5 to 13 years old. Right. #11 Casey Morgan,11, a Starbuck Middle School student, pull away from a tackle and scored in a game between the Ravens and Greenbay.
