The Firm In 2013, the CITY TOWER Insolvency Administration, a general partnership of insolvency practitioners (Czech name: Administrace insolvencí CITY TOWER), was spun off by CÍSAŘ, ČEŠKA, SMUTNÝ to continue the firm’s five years of successful insolvency practice. The core of the partnership is comprised of three licensed insolvency practitioners: Jaromír Císař, Oldřich Řeháček, and Petr Michal. With almost 2,700 insolvency cases tackled and resolved, our insolvency practice is the largest in the Czech Republic. Nevertheless, we are aware in our operations that size in itself is not a hallmark of quality. We therefore strive to help cultivate the way in which insolvency practitioners perform their role in the Czech Republic. Our partnership’s guiding principles include efforts to make insolvency proceedings as transparent as possible and to maximise the yield for creditors, combined with, equally importantly, a humane approach to debtors and their needs. Our partnership’s range of operations and expertise includes all forms of

insolvency management provided for in Czech insolvency law, including major reorganisations. Despite keeping a very low profile while in private practice, Mr. Simeon V. Marcelo, after a very distinguished legal career [which included being the private counsel, at the age of only 38, of an incumbent President (Pres. Fidel V. Ramos)] for twenty (20) years, was already acknowledged in the legal and business circles as one of the country’s top dispute resolution lawyers. He later caught national public attention during the 2000 impeachment proceedings against then President Joseph Estrada when he was chosen to handle the presentation of the prosecution’s star witness. Subsequently, Mr. Marcelo joined the Office of the Solicitor General in February 2001, an independent agency whose head serves as the government’s principal lawyer and has the same rank as the Secretary of Justice. (The Manila Bulletin, 06 September 1992, front page; The Philippine Daily Inquirer, 14 December 2000, front page and 14 February 2001, page B13; The Philippine Star, 13 February 2001, at pages 7-8) As Solicitor General, his exceptional focus on the much neglected ill-gotten wealth cases against the Marcoses and their cronies resulted in the recovery of ill-gotten wealth amounting to at least P130 Billion, compared to the P26 Billion ill-gotten wealth recovered over a period of almost fifteen years since February 1986. Having won all of his major cases, he is considered one of the most successful Solicitors General. (Philippine Graphic, 15 October 2007, pages 24-15) These accomplishments led to his subsequent appointment as the youngest head of the constitutionallycreated independent anti-corruption body, namely: The Office of the Ombudsman. Despite the severe lack of resources, he was able to pursue an effective crusade against corruption, earning praises from foreign and local media, including the Philippines’ normally critical newspapers. The Washington Post stated that Mr. Marcelo “restored credibility to that organization xxx, taking on the most powerful vested and entrenched interests

in a country that perennially ranks among the worlds’ most corrupt xxx”; “targeting the most corrupt agencies, daring to prosecute even members of the historically untouchable military.” (10 June 2005, at page A14) As Ombudsman, he also led the prosecution team that secured the historical first ever plunder charge conviction of a former President, known as the “Trial of the Century” (The Philippine Star, 13 September 2007; The Philippine Daily Inquirer, 06 June 2010, page A13) When he resigned effective 30 November 2005, a well-respected journalist wrote: “Exasperated by political infighting, George Washington wrote: ‘Few have the virtue to withstand the highest bidder.’ Simeon Marcelo had what it took. International and local observers agree on that. Street yokels, like us, got a first close look at this 1979 topnotcher during the Estrada impeachment trial. People liked what they saw then: a talented comer without guile. In Adlai Stevenson’s words, he could ‘lead a cavalry charge without feeling funny astride a horse.’” (Philippine Daily Inquirer, Juan Mercado, 20 October 2005, at page A12) In January 2008, Mr. Marcelo returned to private practice. He was described by two publications as “perhaps the country’s best litigator”. [The Philippine Starweek, p. 5; Metro Society, p. 168] Immediately thereafter, his legal services were engaged by the largest local power utility to defend against a hostile take-over attempt by the government pension fund backed by one of the largest companies in the country. Subsequently, Mr. Marcelo was tapped by the Bangko Sentral ng Pilipinas (Central Bank of the Philippines) to prosecute the owner and officers of the Legacy group before the Department of Justice (DOJ) in the biggest bank fraud case in the country’s

history. As a result, several syndicated estafa cases, which are non-bailable, were filed by the DOJ against the owner and senior officers of the Legacy group with the proper regional trial courts. Also, Mr. Marcelo was later engaged by one of the country’s leading companies to defend it in a P7-Billion tax collection suit, perhaps the country’s biggest tax case in recent

years. In 2014, taking over from another law firm, Mr. Marcelo and his tax litigation lawyers were able to persuade the Supreme Court’s First Division to reverse its original decision and render a new one in favor of a client, annulling the Bureau of Internal Revenue’s assessment of excise taxes on its aviation fuel sales to international carriers, resulting in the refund of hundreds of

millions of pesos already paid to the government and saving the client billions of pesos to be paid in the future. The 2014 Decision was affirmed by the Supreme Court’s Third Division in another case handled by Mr. Marcelo early this year (2016). (The Decision also directly favored the other companies selling aviation fuel to international carriers.) Last year, Mr. Marcelo headed CMT’s legal panel that secured a very significant favourable award in an important arbitration proceedings conducted by the Construction Industry Arbitration Commission. Mr. Marcelo served as the Executive Secretary of the Asian Development Bank Administrative Tribunal from 2007 to 2010 and was a Professor of Evidence and Trustee of one of the leading law schools from 2006 to 2008. From September 2008 to June 2014, Mr. Marcelo served as one of the four members of the World Bank’s Independent Advisory Board (IAB), which provided advice on good governance and effective anti-corruption measures to the Bank’s President, Audit Committee and Department of Integrity. Mr. Marcelo was also appointed in late 2012 by the Supreme Court as a member of the Core Committee (and Content Chairperson – Special Remedies During Trial) which was tasked with the drafting of the new Rules of Civil Procedure. Certain sections of the proposed new Rules of Civil Procedure are now being pilot-tested by the Supreme Court. Mr. Marcelo served as the President from 2009 to 2010 of the Philippine Bar Association (“PBA”), the country’s oldest and largest voluntary organization of lawyers. During his term, the PBA led the opposition to the appointment of “midnight appointees” (including the appointment of a new Chief Justice of the

Supreme Court) by the then President during the election period despite the existence of an explicit ban contained in the Constitution on appointments during this period. (Incidentally, the appointed Chief Justice was later impeached and convicted of graft charges by the Senate and thus, as a penalty, dismissed from government service.) Moreover, the PBA, under him, played a major role in the crusade for clean, honest and peaceful May 2010 elections for the new President and other elective positions. The University of the Philippines Alumni Association, during its Centennial Year in 2013, conferred upon Mr. Marcelo the Distinguished Alumni Award in Public Service. Currently, he is involved as legal counsel in numerous high-profile cases in the regional trial courts, the intermediate appellate/trial courts and the Supreme Court, aside from presently serving as the chairman of an arbitral tribunal handling a very important arbitration proceedings between a foreign corporation and a domestic company. Because of his vast experience as the former head of the Philippines’ anticorruption body, a principal adviser of the World Bank on good governance and his continuing active participation in the good governance and anti-corruption movement in the country, he is the arbitrator/counsel of choice for arbitral disputes involving public/private corruption, corporate fraud and money laundering. [In 2013-2014, he served as a member of an ICC Arbitral Tribunal that resolved two (2) related international disputes that arose previously from allegations of public corruption. Also, because of the just-mentioned credentials, he is now serving for a second term as an independent director of the local subsidiary/affiliate of the biggest cement company in the world.]

Biography Michael F. Brockmeyer is a partner in the Washington, D.C. office of Frommer Lawrence & Haug LLP. His practice concentrates on antitrust and consumer protection law. Residency has a specific meaning under Belgian law: you must be registered at city hall. This registration will allow you to hold a residence permit, generally after only one police control at the very beginning of your stay (the police will only check your presence).
