THE NEW NORM It would be a very rare community now where the one time nuclear family of a father mother and children was the norm. Even countries that frowned on divorce for religious reasons, are making marriage between samesex couples legal. The blended family due to second or third relationships have become the situation for so many children of divorced parents. Working in the area of Family Law and Wills and Estate Law, we see all too often the damage caused when parents do not get it right at separation. The ongoing bitterness between the parents and the trauma that the children have endured because of this, carries on unto the grave. Why do we know this? Because when one parent dies all the pain, anger and trauma that occurred with alienation of children from another parent comes out again. Mothers (and unfortunately it is more often mothers although some of our more spectacular cases have seen alienating fathers
at their worse - one with helicopter prison break-outs and a very damaged child being the result) who interfere in the minds of their children and enforce complete alienation from their father results often in grief beyond the norm when that father dies and the child realises that they have missed out on a relationship they would have dearly loved. In other cases the adult child realises the alienation and the situation backfires on the mother who loses that relationship as a result. Often the alientated child is left out of the parent’s will causing another round of litigation as that child files a Family Provision Claim – this is iespecially so in Common Law Countries where division of property is not partially mandated as in some European countries. You do not lose your child or his or her love because you encourage a relationship with the other parent. Failure to do so can often make that child very bitter about you, the alienating parent. I have long fought for the recognition of alienation as a part of a parenting case that requires a stronger response from the Courts. I am not
convinced that I have succeeded. It is up to you, the parents, not to promote generational trauma. Your Will can ensure that occurs. In nearly all countries and particularly every state in Australia, one must be “eligible” to make a claim on an Estate of a deceased person. Children of that deceased person are inevitably “eligible”. Therefore it is important to obtain good legal advice and be asked the right questions by your lawyer if you are contemplating leaving one of your children out of your will. Not to provide a Statutory Declaration outlining good reasons could very likely to result in your Will bequests being altered by the Supreme Court. This inevitably occurs in most cases at a day-long relatively expensive mediation. Even then that ‘Stat Dec’ is not guaranteed protection. Thus alienating a parent at separation can result in all the pain resurfacing at death. It is up to parents to avoid that and to seek professional advice when going through these difficult times.

The Firm Sanzo e Associati – SeAS is a partnership established in 2011 as an evolution of the Law Firm founded in Milan by Atty. Salvatore Sanzo in 2001.
