Announcement from the Provisional Executive Committee on Council Temporarily Taking Over the Duties of the Court 1. The Provisional Executive Committee was notified by the Court on 23rd November that the resignation of three judges Mr CHAN Yu Hang Jason, Ms CHUGH Rhea and Ms WONG Sze Ching has come into effect on the same day. The Provisional Executive Committee deeply regrets their departures and wishes to thank the former judges for their contribution and dedication to the judiciary and rule of law of the Union. 2. The Provisional Executive Committee was notified, on the same day, by the Court that judge Mr MIN Hyeonjong had graduated after the academic year 2016-2017. As stipulated in the Union Membership Act 2017 subsection 11.2, Mr MIN had ceased to be an undergraduate student of The Hong Kong University of Science and Technology due to graduation, thus his status as Full Member of the Union was lost. By virtue of Article 14.4 of the Constitution, his term of office had ended as he ceased to be the Full Member of the Union. 3. According to the website of the Court, there are eight judges being listed. Since three of the judges have resigned and one has ceased to be a judge due to loss of membership of Union. There are only four judges remained and is below the threshold stipulated in Article 14.1 of the Constitution. 4. By virtue of Article 17.16, the powers and duties of the Court are suspended from 23rd November 2017, until the vacancy is being filled. The Council will take over of the powers and duties of the Court except those stated in Article 14.3 (d), (e) and (f) of the Constitution. The Council will announce such arrangements in its earliest possible time. Thank you for your kind attention.
