This is my “maiden voyage” as Designated Lobbyist for A.B.A.T.E. of Arizona and at this time I would like to thank Bobbi Hartmann for all she has done for the motorcycling community in Arizona over the past several years. Her legacy will be a challenge to duplicate. Our bill SB1227 to close the HIPPA Loophole for Motorcyclists is currently still active, and we’ve been reassured that it will move forward, however it still has hurdles to overcome and unfortunately

time to get through the legislature is just ticking away. We had a stakeholders meeting with representatives from the insurance industry, (Blue-Cross/Blue Shield and United Healthcare), after much discussion we conceded definition 20-448 that states: A health care insurer shall not deny health care coverage to any individual based solely on that individual’s casual or nonprofessional participation in the activity of motorcycling. The bill needs to move forward and we are still waiting for it to be scheduled in Rules with the concessions we’ve made. Thanks to all who came down to the Capitol for MDATD, it was certainly an interesting mixture of activists that day. Of course there was the Motorcycling Community and two groups from the Hispanic Community that were marching in front of the Capitol as well as a group of Engineers gathered on the north lawn. No matter your political views it was a great show of what our country is all about. We were clearly diverse and incred-

ibly free to press our individual issues directly to our elected officials. If you call yourself a patriot please don’t make this, one day of the year, the only time you reach out to communicate with your political representatives. It doesn’t matter if you’re out of work or employed, college educated or a high school dropout, you are an American and you must participate in the process in any way that you can. President’s Report

Bobbi Hartmann, ABATE’s Designated Lobbyist for 13 years has stepped down. The accomplishments by her and the Lobby Team are to numerous to mention here. But ABATE wants to thank her for all her hard work and dedication for those years. Also we would like to wish her well in all future endeavors. GOOD LUCK Bobbi, you will be missed. Motorcycle Day at the Dome was held last month at the Capital. We had another good turn out. I would like to thank all the people that helped make it work. We had a good turn out of Legislators, even though they were a little late getting out because session lasted longer. But they still wanted to talk to their constituents. There was some added entertainment, protesters for illegal immigration and some other groups were there. So as usual the media ignored our event. This event is for all Motorcyclist to help let the Legislators know what our concerns are, so if you were not there they think you don’t care. Everyone

needs to show up next year, protect your rights. The Website improvements are about ready. I will be getting with our Webmaster to check them out and getting them online. Then you will be able to do membership and preregister for Too Broke Broke online. Also we are working on a commercial and PSA’s to promote Motorcycle Awareness and safety. State Officer Meeting Minutes March 6, 2011 Call to order: Pledge of Allegiance and a moment of silence led by Joe Ferrucci

The secretary minutes from February 2011 were waived by Margie Ferrucci and 2nd by Joel Jackson. All in favor.

Carole O’Reilly read the lobbyist report to the officers a copy to be emailed to secretary

Joel Jackson read the treasure’s report for February. This included expenses to be covered for TBFS.

Casey Yates, a copy of this report will be sent as an attachment to each officer as well.

Ron Kool of membership was absent.

Treasurer Joel Jackson stated that the P & P’s need to be updated by the communications officer Casey Yates.

State Safety Jean Cooper spoke about getting a proclamation from the Governor to make May Bike Awareness Month. Margie and Jean will work together making May Bike Awareness month. Jean reported Southern Arizona ABATE Chapter is planning a Safety Bike Night. Jean suggested that the State sponsor a safety focused educational presentation sometime in the fall. Perhaps having a keynote speaker like Slider Gilmore would be a good speaker to try and get. More information to be shared at the April 2011 State Meeting. Jean Cooper has new ideas to share at the state meeting. 1. Use ABATE funds to help smaller chapters with safety events. The chapters can apply for funding at the beginning of the year. 2. Regarding motorcycle it was suggested that she get stats on bike crashes in Arizona and compare data from national reports. More information to follow on this. 3. In the past ABATE Chapter and other organizations have applied for Grant money from the Governor’s Advisory Council on Motorcycle awareness and safety events. Need to check and see if there is still money from the council. Margie Ferrucci stated that we should collaborate with other groups to make a larger impact to the city regarding signage and other addenda. Ross is currently working on a PSA to air on TV Stations. P.A.C. Officer Tim O’Reilly told us that the distracted driver bill did NOT pass. And that Tucson is ticketing drivers whose handlebars hare higher than their shoulders. The bill to exclude motorcycles from emissions is still on the table. Tim also passed out 2“Limited Power of Attorney” forms that can be used after an accident to allow person/persons to retrieve property and/or have a vehicle released from impound. The POA does

Run/Event Coordinator Margie Ferrucci brought us up to date on the many projects she is working on. With bike week right around the corner Margie secured us spot that we will be sharing with another vendor. She introduced new business Sutures Embroidery. The subject of giving plaques to business Members rather than Printed Documents, it was agreed that this would be a better way of showing that ABATE supports Business and supports ABATE. Ross suggested that we get plaques that we can update each year Margie to get quotes to present in April. In old business regarding patches for the Yuma Chapter, they must get more members before they can be called a chapter. In new business the new slogan “joining ABATE is a $25 investment you can’t afford not to make” is going to be used on cups, key chains, bumper stickers etc. Two guests attended the state meeting Shadow Mountain Coordinator Jimmy Page and Chairman of the Board, Eric Hampton. Jimmy page had a list of ideas he presented, he will get with each member accordingly to corroborate such ideas. Eric Hampton spoke about the Meeting of the Minds 2011. A motion was made to have Safety Coordinator Jean coordinate the MAPP Program; the decision to make Jean in charge was unanimous. Treasurer Joel Jackson made a motion to have Casey Yates made a signer on the ABATE account as he is the only signer at this time. This was 2nd By Margie Ferrucci, the officers were all in favor. The next state meeting: April 3, 2011, 11:30 a.m. at AIAC. Motion to adjourn by Joel 2nd by Joe the meeting adjourned at 1:15 pm.

Eric told the officers know he had emailed them an updated agenda, the Run Coordinator Budget for 2011, and the TBFS 2011 Treasury report. Chairperson Eric Hampton stated that there was no old business at this time to discuss as this was an emergency meeting. The B.O.D. liked the teleconference meeting and found it to be a good solution for emergency meeting.

A vote of officers was taken all were in favor, no opposed. A motion to approve the vote was by Bill Hensler -High Country Chapter and 2nd by Jean Cooper of Yavapai Chapter. There were no questions.

Chapter Reports East Valley Chapter East Valley meeting was held Sunday February 27, 2011 at 11:30 AM. Some topics talked about consisted of the out come of our valentine party, the spaghetti feed coming up in June and To Broke For Sturgis. On Friday 4th, 2011 East Valley was down at Motorcycles on main with a booth set up. It was quite a turn out, many bikes were down there that day. Unfortunately motorcycles on Main will not be In this month of April, due to AZ Bike week. On March 5th, 2011 East Valley Chapter was over at SunShine Acers helping out, cooking, and serving food, some members gave kids a ride, this too was a great turn out. Mohave Chapter Weather is getting better and more bikes are out and about. We all had a great time on the "Sweetheart Run" in Lake Havasu. The size of the run is increasing and new venues are being added to accommodate the riders. We are gearing up for our 3rd Annual Gun Raffle and we will have more details to follow. This years gun is an Springfield Armory XDM it should be great.

Phoenix/Shadow Mountain Chapter Can you believe that it is March already? And bike week is just around the corner! With that being said it is time to remember bike safety, safety officer Mike Falcone used the tragedy in Carefree, to make a statement reminding us to be aware of what’s around you when you stop? Pay attention to what’s going on around you. When you leave a stop/light, pay attention again, to what’s going on around you instead of thinking about how cool it’s going to be when you charge on out there. Not only do you have to pay attention to what’s going on around you, but also what is behind you. February was a month of changes as well. Bobby Hartman resigned as designated lobbyist. Connie Johnson also resigned. Thank you, Casey Yates for stepping up to the plate and taking State Secretary position and another Thank you to Carole O’Reilly who also stepped up to be our new designated lobbyist. PAC Officer Tim O’Reilly said Day at the Dome could’ve used more riders, but was still a decent turnout. This year

we had more legislators, and 32 representatives. Better chance to talk to everyone.

Emissions are in the hands of the EPA still waiting but hopeful. ABATE is a much admired Grassroots organization, keep plugging along and fighting, we can, and are, making a difference. One more big shout out to Donna Woodworth who stepped in to be our Chapter Secretary as well, she was voted in unanimously. This years Bikerball game between East Valley chapters brought the trophy back to the Phoenix-Shadow Mountain chapter. We won the softball game with 5 people and a few borrowed! Score: 20/7 Look out East Valley chapter we aren’t planning on giving this one back! Run Coordinator Darin Yates won the trophy for best Classic Bike at the Yavapai Chapter Poker Run. What a great day the run was awesome! Thanks for having us! Communications officer (me) took a moment to remind us the ABATE is a team our chapters are split by locality only. That together as a whole we make a larger statement for biker’s rights. Too Broke is only 4 months away, we are still in need of security. Coordinator Jim Page said we need to start thinking about the Chapter Anniversary party in May. May is also motorcycle safety month. Chapter t-shirts are soon going to be available. The design was approved. Chapter patches are now available for $6 ea. Member Charity Stuart being deployed

Southern Arizona Chapter NO REPORT

Yavapai Chapter On March 12th our chapter held a membership drive run. Although, we only signed up 3 new members, I hope we got the word out of what we want to accomplish with A.B.A.T.E. in Arizona. It seems many riders don't want to join, join, as they are there to have fun. As a chapter, we have vowed to change that. We are out to unite for biker civil rights for all on two or three wheels. No matter what you ride, crotch rocket, VW trike, or a Honda Trail 90, we think A.B.AT.E. will fight for your rights. So our membership run might not have gotten a significant number of new members, we want all riders to know there is a price for the freedom to have fun, and remember knowledge is power, and we are a good source for that knowledge. Participation in the run was a big success, (thank you weather gods!). We had approximately 150 riders, which tops most Maricopa County run for shear number according to A.B.A.T.E. V.P. Margie Ferrucci (thanks for joining Margie). Our run included, a poker run, bike show, and fashon show. Our high hand poker run winner was Shannen Foley, and low hand Dan LeMond. Bike show winners included, Mary Wolf Olsen (Trike), Carol Watson (Sportster), Ron Parker (Rat), John Lucke (Bagger), Dave Anderson

The fashion show was MC'ed by Ralo and longhair James (thanks for putting together such a great run) and featured fashions from Biker Babes and Beyond and some sexy models (Katie, Nikki Lee, Mandy, and Tara (make up provided by Karen of Adrenaline Salon). We also had traveling entertainment provided by “Dog of the Moon” (check out the new CD “Home Brew”). Tons of raffle prizes were given out throughout the run from Crescent Moon, Grand Canyon H-D, Pine Cone Inn Supper Club, Apache Motor Lodge, Taj Mahal Restaurant, J & P Cycles, Hardtailz, Adrenaline Salon, GMR, Lyzzards, Miller Beer, Budweiser, DJ's Trikes, Hold Fast Tattoo, Penetration Tatoo, Planet Beach Salon & Tanning, Smokin Harley's Roadhouse, and Coffee Roasters. In addition, Taj Mahal had a special discount on the excellent buffet, and Lyzzards provided some free grub as well. We will be riding to Jerome to attend the Gold King Mine event. We will be having a bike show, swap meet, free poker walk, bike games, vendors, fashion show, raffles, auction, and music. Cost is $10 per rider, $15 per couple, and $15 for general public. Camping with porta-potties will be available with shuttles from Jerome to the Gold King Mine. This is a 21+ minimum event, with t-shirts going to the F1st 25 registered and run pins to the 1st 300 registered. Gates open at 11, so be there for the ride and fun. Board of Directors Special Session Minutes (continued) 3rd order of business was to appoint Carole O'Reilly as our designated Lobbyist, all were in favor. A motion to approve was made by Ray and 2nd by Rick Henry. There were no comments. 4th order of business was the TBSF 2011 Treasury report. Bill from the High Country Chapter was not able to open the attachment. Discussion: Sanitation invoice from Sandoval Sanitation in Flagstaff $5155.00. Chairperson JR and Mary Kay of the TBFS committees asked that questions be directed to either or both of them. Chairperson Eric Hampton asked them about line item for security seemed high, Mary Kay explained the cost difference due to additional security, sanitation (more porta potties 24 this year, trash removal etc.) There is a concern about the security; Mormon Lake Lodge now requires security stay until 4; 00 am both Friday and Saturday nights. The cost for security this year will be $5000. Also included in the contact was a section regarding last year's eviction notice as it

was not a problem in the past? Included in the contract was a guarantee of 1800 guests. Mary Kay stated that would be no problem as TBSF has grown more than 10% each year. Due to regulations for sanitation a guest approximation of how many will be in rvs/tents and cabins an additional 6 porta potties will be provided from the day of possession until the end of the weekend. Mary Kay told us the 1800 guests number is works accurate and works for us. This is put to a vote: The consensus is that a new location should be investigated prior to next year. That the quote/good faith estimate from Mormon Lake Lodge needs to be received by January not in February as in previous years. The total cost increase from MLL 2011 vs. previous years. Mary Kay has these costs for comparison. In agreement also that a change of venue would be a good negotiating tool. The suggestion also of a comparison of costs incurred at MLL vs. costs of a similar

event held in Winkleman. 5th order of business Budgets: The TBFS asked for an increase of dollars budgeted for product. Currently the budget for merchandise is $4600 Mary k would like to increase the budget to $11500.These costs include the cost of screen printing an increase of product and new merchandise which included hoodies and men's denim. The increase in budget is a concern, but numbers from previous TBFS indicated we have run out of merchandise before the main day of the event. The TBFS committee has asked Jan Rassmussen to assist them with merchandise again. The board has seen the new design for TBFS; the logo is from the first TBFS with added features. The color has not been 100% determined yet. Eric pointed out that we have a new webmaster and instead of multiple admission prices for pre-registering online and

incurring additional costs, members will have to pay the same entry fee as a guest when registering online but will receive a $5 coupon to use on TBFS merchandise.This will push sales on merchandise. The increase in the budget was put to a vote. The TBFS committee is considering raising Saturday ticket prices, Saturday day passes will increase to $20. The increase is a TBFS committee decision. Clancy Jayne to attend our next BOD meeting to discuss purchasing land and./or partnering with another group on land. JR commented that we will still be a MML. Volunteers are still needed for security at the campsites. The TBFS budget was put to a vote, the decision to accept the budget was unanimous. The next BOD meeting will be April 3rd, 2011 1pm at the AIAC. Joyce Rutherford made a motion to adjourn 2nd by Bill Hensler.

PAC Report who has contracted Apathy? No it’s not a disease but it’s very easy to catch. How can you as a member, Chapter or State Officer of ABATE of Arizona help to stop spreading Apathy? It may not be an easy task, but I believe we all can rid ourselves of this syndrome if we take time each day to work a little on developing interest in ABATE of Arizona. None of us should be surprised at how easy someone can develop a mild case of Apathy today with all the demands placed upon us from family, work, and things that arise every day from outside influences. Hello to all my Brothers and Sisters; Happy Spring !!! To all especially those who live north of the Valley. Some of you may just be getting your bikes out for the first time. Remember to check all your fluids and tire pressures, after a long season without riding a while. For those of us in the Valley and Southern Az. we need to check them because we’ve been riding all winter, and the temperatures are getting warmer. Thanks to all who attended Motorcycle Day At The Dome. There were 125 that signed in, 17 Senators and 28 Representatives attended. Several news stations were there but there was no TV news coverage of our event. This year more Legislators attended than last year, even though others were attending committee meetings and were unable to attend. Remember that old hair shampoo commercial from a few decades ago, where the flaxen-haired actress was so impressed with her just-shampooed hair that she told two friends, and so on…? Well, we need to use that as inspiration to light a fire under some of our friends that don’t feel the need to get involved in ABATE. We are a Motorcycle Rights Organization that protects ALL riders rights, to do this we need not only members but involved members. Apathy, do you have Apathy, do you know anyone who rides a motorcycle

Did you know that ABATE is one of the most influential lobbying groups in the nation? For the longest time I did not know this. This is how it was explained to me. Politicians actually like grassroots organizations such as ours because we are made up of a bunch of volunteers from all walks of life that believe in something so strongly that they are willing to go out and get things done. This is what ABATE is all about. Dedicated individuals that are willing to go the extra mile to preserve our past and protect our future. I have to wonder if the small handful of people that got together more than two decades ago had the slightest idea how this organization would just snowball into what it has become today. Yes, our membership has shrunk in numbers over the past few years, there is no disputing this fact, it is happening all over, not just in our organization. So, what do we do about this? We keep plugging away, that’s what we do about this. We keep talking, we keep educating and we keep moving forward. The members of ABATE of Arizona make a difference.

ABATE of Arizona has a new Board of Directors and a new Designated Lobbyist that are all interested in creating new membership participation to make this organization work for everyone. Including but not limited to; Grassroots participation, contacting your Legislators when asked (Defender Program) Call to Action. We need to get involved and stay involved. Our Legislators are making decisions which effect all of us, whether it is motorcycle related or other issues affecting everyone’s daily life. When asked to contact your legislators, (Federal, State, County or local) regarding a motorcycle issue and after doing it just a couple of times, you will get to know your legislators and their assistants and they will get to know you, and they will know that you care and that you VOTE!!! So, see how this can help you in the future when you feel it necessary to contact your lawmakers. The Governors’ Office of Highway Safety (GOHS) has contracted with several radio stations for Public Safety Announcements (PSO’s) Listen for motorcycle ads. The 3 stations I listen to have played them. I think they are much more effective than the billboard ads, and of course much less distracting for drivers. How many accidents have been avoided and how many bikers avoided serious injured or death? The MRF encourages you to schedule appointments with your Representative and Senators during the lobbying hours. It is best to begin scheduling them now, as the calendar will fill up on this busy legislative day. Plan your appointments according to your arrival time. If you plan to arrive promptly at 9AM you can schedule meetings anytime from 9:45 until 2:00 without conflict with the program. If you plan on arriving at 11:00, then you can schedule meetings from 11:30 until 2:00. Should you not be able to get appointments, plan on dropping by as many offices from your state as you can during the scheduled lobby time. Feel free to contact the MRF office with any questions about scheduling or otherwise. This year's Bikers Inside The Beltway national lobby day coincides with the MRF's eastern regional conference, BEAST of the East, which begins the next day, Friday May 13, in Baltimore, MD. Clearly motorcycle checkpoints do not promote accident avoidance. H.R. 904 will not stop the Georgia checkpoints, only future funding of motorcycle checkpoints. "We introduced this important piece of legislation because Secretary LaHood and NHTSA remain adamant that mandating helmet use will prevent motorcycle crashes," Sensenbrenner said. "The first step in motorcycle crash prevention should be rider education and increased awareness. Taxpayer money should not be spent on helmet checkpoints that do not prevent crashes." Roadside Checkpoints The Motorcycle Riders Foundation reports that the Georgia Department of Public Safety (GA DPS) has announced some of the details of the motorcycleonly roadside checkpoints. The details include some the reasoning, time frame and locations of the checkpoints. Lt. Colonel Mark McDonough, GA DPS Deputy Commissioner, explained that the reason for the checkpoints is the rise continued of motorcycle fatalities in the State of GA from 2005-2008. There were 167 motorcyclists killed in crashes in 2008. McDonough did acknowledge the State's education campaign in 2009, which focused solely on raising awareness of motorcyclists with all other road users. The campaign included safety presentations to school, church, civic groups and media outreach by State Troopers. The GA DPS credits the campaign with a 35 percent decrease in motorcyclists fatalities over the previous year. The Department called this historic decrease a "good first step". The next step, according to GA DPS, is the motorcycle-only roadside checkpoints. The first of these checkpoints will be conducted Wednesday, March 9th, 2011 from 8AM-5PM along Interstate 75 at the southbound commercial vehicle inspection station in Monroe County. During the same time frame an additional checkpoint will be established at the southbound commercial vehicle inspection station along I-95 in Chatham County, north of Savannah. The checkpoints will check for proper licensing, DOT helmets, alcohol usage, valid tags, as well the general operating condition of the motorcycle.

Lt. Col. McDonough claims that for the average operator with the proper license and equipment the delay should take about one minute. Additional checkpoints will be conducted in the spring and fall of 2011. Checkpoints are funded into 2012 as well. In Other News U.S. House and Senate pass Highway Bill Extension. One day after the House overwhelmingly passed the Surface Transportation Extension Act of 2011 by a final vote of 421 to 4, the Senate approved by voice vote today vital legislation to extend highway, transit and highway safety programs through September 30th. The measure now goes to the President's desk, where it is expected to be signed into law soon. "With unemployment in the construction industry at an all-time high, it is imperative that we extend the surface transportation programs through the end of the fiscal year," said Highways and Transit Subcommittee Chairman John J. Duncan, Jr. (R-TN). ======================= 11NR11 - MRF News Release - NHTSA Requests Motorcycle Safety Money

National Highway Traffic Safety Administration (NHTSA) has submitted his 2012 budget request to the Appropriations Committees. One item in particular jumped off the page when the Motorcycle Riders Foundation (MRF) examined the $860 million request. Section 3011, Motorcycle Safety Grants, includes a $7 million ask that specifically adds the promotion of DOT compliant helmet use to the fund. In the past, the motorcycle safety grant program has solely put money toward two areas: teaching people to ride motorcycles and educating the rest of the motoring public to look for motorcycles while driving. Diluting this already small grant program to include helmet use promotion will certainly diminish the effectiveness of the two existing programs. In a recent Senate hearing, Department of Transportation Secretary Ray LaHood was asked by Senator Lautenberg (D-NJ) to include a mandatory helmet law in his budget request. LaHood responded, "This administration believes that is a State issue." Apparently Strickland did not get that information. It is troubling that NHTSA, whose mantra should be "crash avoidance," continues to promote "safer crashing." The MRF believes that the best crash is the one that doesn't happen. Coast to Coast NCOM BIKER NEWSBYTES Compiled & Edited by Bill Bish, National Coalition of Motorcyclists (NCOM) MOTORCYCLISTS AWAIT ROADBLOCK RULING Motorcycle riders across the country are anxiously awaiting a decision from the U.S. District Court for the Northern District of New York which they hope will declare New York’s “motorcycle only” roadblocks to be unconstitutional. The so-called “safety checkpoints”, which target well-known motorcycle events, force motorcyclists to leave the roadway, regardless of any wrongdoing, and have their persons and property inspected for equipment violations, proper paperwork, DUI and stolen VIN numbers. The National Highway Transportation Safety Administration (NHTSA) is now providing Federal funding for law enforcement to conduct such motorcycle-only checkpoints nationwide despite objections raised by members of Congress and legal challenges from the biker community. The New York lawsuit is the first to challenge the constitutionality of motorcycle checkpoints. The plaintiffs are being represented by Proner & Proner, led by N.Y. Aid to Injured Motorcyclists (A.I.M.) Attorney Mitch Proner, a motorcycle-riding lawyer who has a long history of doing “pro bono” (free) legal work to protect the rights of motorcyclists. The Proner law firm commenced the lawsuit

on behalf of four motorcyclists who were detained at two separate checkpoints, as well as representing the interests of ABATE of New York and the National Coalition of Motorcyclists (NCOM). The checkpoints in question are funded by a grant from the New York Governor’s Traffic Safety Committee and the troopers who work them are paid overtime. Although the stated purpose of the checkpoints is to promote safety, the majority of the more than a thousand tickets which were issued during the first year of the checkpoints had nothing to do with safety and instead focused on non-safety violations such as loud pipes. The written guidelines for the checkpoints specifically state that one of the purposes of the checkpoints is to look for stolen and forged VINs and the police readily admit that they often have undercover members of their gang and auto theft units working the checkpoints looking for signs of criminal activity. According to Proner, the Supreme Court of the United States has repeatedly made it clear that any roadway checkpoint whose primary purpose is general crime control constitutes an unreasonable search and seizure under the Fourth Amendment and is presumptively unconstitutional. Notwithstanding that fact, the progress reports which the police prepared on the checkpoints specifically state that the grant funds are used “for overtime for intelligence gathering and the subsequent

criminal and traffic enforcement.” The police admit that the checkpoints, which focus only on equipment violations and forged and stolen VINs, do not address any of the major causes of motorcycle accidents such as reckless driving, driver inattentiveness and alcohol impairment. The case, Wagner et al. v. The County of Schenectady, et al. could wind up in the U.S. Supreme Court. The future of motorcyclists’ rights hangs in the balance. BILLS INTRODUCED TO PROHIBIT MOTORCYCLE-ONLY CHECKPOINTS Even as Georgia police prepared to launch the nation’s first federally-funded motorcycle-only checkpoints during Daytona Bike Week, lawmakers in Washington were taking steps to cut federal funding for the controversial practice. Wisconsin Reps. Jim Sensenbrenner, Paul Ryan and Tom Petri introduced House Resolution 904 on March 3rd that would prohibit the secretary of transportation from providing funds to state and local governments for the use of motorcycleonly traffic checkpoints. “The first step in motorcycle crash prevention should be rider education and increased awareness. Taxpayer money should not be spent on helmet checkpoints that do not prevent crashes," Petri said in a news release. "Also, it's outrageously intrusive. Nobody is suggesting pulling cars off the road for unscheduled

inspections, so why are motorcycle riders being harassed?" “We stand in solidarity against the unconstitutional use of motorcycle-only checkpoints being implemented in Georgia, and may be coming to your state soon,” said Escondido Paul, National Lt. Commander of the US Defenders, in issuing a Call To Action (CTA) urging all motorcyclists to contact their federal officials to “solicit their support against grant money being used by the Federal Government to induce other States to participate in such discriminatory actions!” In related news, bills have been recently introduced in New Hampshire (HB 148) and California (AB 1047) to prohibit any state law enforcement agency from accepting federal funding to establish motorcycle-only roadside checkpoints. SUPREME COURT RULES IN FAVOR OF MILITARY FUNERAL PROTESTORS Freedom of Speech was considered by our Founding Fathers to be our most important Constitutional right, which is why it is the First Amendment to the Bill of Rights, but the U.S. Supreme Court’s recent ruling favoring the rights of hateful protestors over the dignity of a military funeral doesn’t sit well with some motorcyclists. In particular, the Patriot Guard

Coast to Coast (continued) Riders were formed in 2005 to protect the funerals of fallen warriors and shield mourners from the incendiary demonstrations waged by Westboro Baptist Church, which claims soldiers’ deaths are “divine retribution” for American tolerance of homosexuality. The High Court ruled 8-1 on Wednesday, March 9th with only Justice Sam Alito dissenting, that the First Amendment protects hateful protests at military funerals, despite the pain they cause grieving families. “Our soldiers fought to give Westboro the right to free speech,” said Mike Todd, a member of the Patriot Guard Riders from Reading, Michigan, noting the irony. Although describing the court’s holding as narrow, Chief Justice John Roberts wrote for the majority, saying of free speech; “It can stir people to action, move them to tears of both joy and sorrow, and -- as it did here -- inflict great pain … we cannot react to that pain by punishing the speaker.” He said the national commitment to free speech requires protection of “even hurtful speech on public issues to ensure that we do not stifle public debate.” The case arose from a protest at the funeral of a Marine who had died in Iraq, Lance Cpl. Matthew Snyder. As with hundreds of other funerals, members of the Westboro Baptist Church of Topeka, Kan., appeared with signs bearing such messages as “Thank God for Dead Soldiers” and “America Is Doomed”. Albert Snyder sued regarding the intentional infliction of emotional distress at the funeral of his son, and won an $11 million jury award that was later reduced by a judge to $5 million, but the verdict was overturned by a federal appeals court that ruled the Constitution shielded the church members from liability. The Supreme Court’s decision upholds the appeals court ruling that threw out a $5 million judgment to the dead Marine’s father. RIDING OUT THE RECESSION With gasoline prices approaching $4 a gallon, commuters are turning to more fuel efficient motorcycles to save money. Sales and interest are up across the country, and many motorcycle dealers anticipate the popularity of motorcycles to increase even more. Signs that the two-wheeled world is getting back on the road to recovery are coming from not only improving motorcycle sales, but also by the financial health of bikers themselves. Fewer bikers appear to be making late payments or defaulting on their motorcycle loans, according to a report issued by Fitch Ratings, a credit rating agency working with Harley-Davidson’s Financial Services (HDFS) division. In addition, the report also notes the improving market for previously owned motorcycles is again gaining strength, in part due to reduced inventory levels at dealers. This would allow for any repossessed motorcycles to be sold for a better price than they may have the year before. NEW JERSEY LIFTS BAN ON SUNDAY MOTORCYCLE SALES New Jersey motorcycle dealers are rejoicing that they can now sell bikes on Sundays. Governor Chris Christie signed a bill into law allowing the Sunday motorcycle sales on March 3; though the measure does not affect the state’s ban on Sunday automobile sales, nor does it apply in Bergen County where Blue Laws continue to prohibit the sale of most nonessential items on Sundays. State Senator Donald Norcross introduced the legislation after a Camden County dealership complained about losing customers to stores in nearby Pennsylvania and Delaware as a result of the Sunday ban, adding that most motorcycle buyers tend to make purchases on weekends. “With our dealerships closed for business on Sunday, consumers were heading across the river to make their purchases at bike shops in neighboring states,” said Norcross. “Especially in this economy, we need to give businesses the tools they need to remain competitive.” Motorcycle businesses in Indiana and Wisconsin have also been trying to overturn bans on Sunday bike sales.

A study conducted by an online insurance agency found that lawyers snared the No. 1 spot on a Top 10 list of “Most Dangerous Drivers By Profession,” with 44% claiming a prior accident when receiving a car insurance comparison quote from insurance.com. According to news accounts, an SUV traveling in front of Zien on Interstate 10 attempted to change lanes, lost control and flipped onto its side. Zien, 59, was unable to avoid the overturned vehicle. Early reports indicate that Zien lost part of his left leg and suffered a broken hip. Zien is a longtime member of the NCOM Legislative Task Force who fought against helmet laws and for bikers’ rights during his 13 years in the state Senate, from 1993 to 2006. He's been inducted into both the Sturgis Motorcycle Hall of Fame and the AMA Motorcycle Hall of Fame and rode more than 1 million miles on a 1991 Harley-Davidson Sport Glide. Hamstertime Good Morning America. Remember the late artist David Mann ? The fantastic motorcycle artist who's work was seen and appreciated by millions of people each month in the pages of Easyrider magazine ? I'm a huge fan of not only his work but all types of motorcycle art in general. Dave Mann's art reflected the "Biker lifestyle" better than anyone else ever had or maybe ever will. His art is timeless and will live on forever in his legions of fans. Art and motorcycles have always been intertwined but , as the old saying goes, beauty is in the eye of the beholder. The perfect example would be; Someone looking at an Arlen Ness creation may see it as a mind blowing custom while someone else may only see it as another motorcycle. When you start talking about art, you always have to bear in mind that the very nature of art is subjective. In other words, what one person likes the rest of the world may feel like it sucks but it's still considered, art.

This months column talks about 2 artist , painters to be exact, who are both very famous in their own right but who's style of approaching motorcycle art are vastly different. One artist left me wondering what they were thinking while the other artist left me standing in awe at the intricate detail and grasp of their subject matter. One show was held at a very upscale prestigious gallery while the other was shown at the V-Twin Expo . The venues are about 3 blocks away from each other , distance wise, but the artist approach to their subject matter is miles away . The first event I attended was held at the very prestigious Cincinnati Contemporary Arts Center. I was invited to a show that featured the work of Rosson Crow by my old friend Josh Martini who is taking a collage class in art appreciation. Ms. Crow is a 28 year old from Texas who ( according to her biography at this show) "immersed" herself in the "Biker Lifestyle" for a "whole

Hamstertime (continued) year" and then painted her interpretation. Her show even came with a title; Rosson Crow: Myth of the American Motorcycle. The staff at the Contemporary Art Center seemed quite shocked that real Biker type people might actually attend this show. I'm just glad it was free to get in on Mondays. Her work ( at least to me) can best be described as abstract impressionalism. Ms. Crow has a certain style to all of her paintings ; dark and vastly unappealing. None of Ms. Crow's pieces did any justice to our lifestyle beyond the usual clichĂŠs; Live to Ride ect....This is only my humble opinion...However . Assistant Museum Curator, Justine Ludwig expressed it with a verbal flourish that can only be described as " Art Speak" " Her ( Rosson Crow's) very personalized style takes direct aim at its subjects, creating rich and layered scenes infused with theatrical expression and raw emotion. The elements within her compositions are often distorted, obscured and disorienting. The outcome is an evocative funhouse effect of floating neon and dark recesses" ...Justine Ludwig. Different strokes for different folks. The person responsible for these amazing pieces was David Uhl. His grasp of his subject matter is second was second to none and the detail is exact. David is but one half of Uhl

Studios the other half is Daniel James, an illustrator beyond compare. Their work is sought after and collected by some of the worlds most prominent art collectors and celebrities including Jay Leno, Steven Tyler and U2. Charles Osgood of CBS Sunday Morning fame referred to David Uhl as the Norman Rockwell of Harley Davidson artist. David's work is officially licensed by Harley Davidson. I met Fred Van de Perre at the Uhl studios booth during the show and contacted him about talking to David about his work and Fred was kind enough to arrange it. David Uhl is a very nice person and we talked for about 45 minutes on the phone. He is very insightful about motorcycling and has been an active rider for a good number of years. He prides himself on the massive amount of detail that goes into every one of his pieces. His attention to the most minute detail holds even the most discerning eye hostage for as long as you stare at the work. You will find Uhl Studios in Golden, Colorado or be sure to cheek out their booth at any number of large motorcycle rallies around the country. Business Member Spotlight When a cage made a left turn in front Al McDonald back in December, 2006 he knew he was in the right business. Al McDonald is a personal injury attorney and he was pissed when his new Fatboy got crunched. “I was struck by a vehicle turning left in front of my bike as I was traveling straight through the intersection. After Tboning the car I flew over the hood and landed square on my back about eight feet away," Al said. As it turned out the driver had no insurance and the vehicle wasn’t even registered. “Out of this accident I realized many things, not the least of which was the benefit of having a good personal injury attorney on your side,” he continued. With that in mind, Al made the decision to become more proactive in assisting people who had been hurt in motorcycle accidents.

Al has been an attorney for more than 14 years and his Law Office of Alfred McDonald P.C. does personal injury work with a strong emphasis on motorcycle accident cases. April’s Safety Article Car/Motorcycle Accidents – There are NO Winners… by Stacey “Ax” Axmaker Director - Idaho STAR Motorcycle Safety Program No doubt you have all seen the newspaper stories and TV news reports on recent motorcycle accidents and fatalities. They are tragedies, and unfortunately have been on the rise in recent years. Motorcycle and scooter sales and registrations have been growing very fast – this means more riders on our roads. This is one of the reasons for the increased number of crashes. We are encouraging three main approaches to help reduce the number of crashes:

While the rider generally takes the brunt of the impact, imagine how you would feel to be that driver…there are NO winners. * Motorcyclists are your neighbors, your co-workers, maybe your family and friends. We are you. There are over 7 million motorcyclists in this country – odds are you know some. Once you know that someone in your life rides, you’ll start to see more of us. Then we all win. Some simple suggestions:

1. Motorist awareness 2. Rider education 3.Reduce impaired riding/driving (alcohol) Some facts to consider: * Motorcycles are harder to see than cars. So, when you are driving, look

Drivers: * Give more space to motorcyclists, they are often hard to see and can change speed and direction quickly. * Riders often change position within their lane – this is normal and is one of their ways of adjusting for changing con-

ditions to improve their safety. * Please use your turn signals so motorcyclists know if you are going to turn - seeing that turn signal may just give them the heads up they need to avoid a collision. * Avoid alcohol when driving – it greatly reduces your ability to see other vehicles (especially small ones) early enough to avoid them; not to mention your judgment, reaction time, and coordination. Riders: * Drivers aren’t ‘out to get you.’ If one pulls out in front of you, most likely, they didn’t see you and meant no harm. Responding with road rage doesn’t help anyone. If it seems they are driving aggressively, give them more space and/or let them go ahead of you. * Do what you can to be seen. Bright colors and reflective material on your bike, helmet, and jacket can really help you to stand out in traffic. That driver seeing your brightly colored gear may just give them the heads up they need to

avoid a collision. * Practice your skills. Maximum braking, swerving, and cornering are skills that you can never be too good at – practice, practice, practice. * Avoid alcohol when riding – alcohol is one of the leading factors in motorcycle crashes and fatalities. It greatly reduces your ability to see other vehicles early enough to avoid them; not to mention your judgment, reaction time, coordination, and balance. * Dress for success – protect your arms, hands, legs, feet, eyes, and head. You are exposed to the wind, the sun, bugs, dust, and if there is a collision – you are vulnerable to the roadway itself and other vehicles. Good riding gear can greatly minimize injury in the event of a mishap. We are all road users – cars, trucks, buses, motorcycles, scooters, bicycles, and pedestrians. Let’s practice sharing the road.
