We are currently accepting applications for Designated Lobbyist of A.B.A.T.E. of Arizona, Inc. This position is appointed by the Board of Directors. The Designated Lobbyist interacts with the state legislature and motorcycle safety
and awareness organizations, develops A.B.A.T.E.’s legislative plans, formulates plans to circumvent negative motorcycle legislation, drafts positive motorcycle legislation, keeps officers informed, and writes an informative article each month
for publication in The Masterlink. This person needs to be personable and have a full understanding of the workings of both state and federal government, be an articulate speaker and writer, familiar with local, state and federal laws, and be
proficient in legal research methods. Interested applicants may submit their application with background information to president@abateofaz.org

Hello fellow freedom fighters! This is my favorite time of year, minus the allergies! Here in the Valley O’ the Sun, the weather’s been in the 50’s at night and upper 80’s during the day for the last few weeks, and expect it to hit the 90’s next week. We are running hotter than average, but no one’s complaining … yet. Get some fresh sun screen, I think you’re gonna need it!!
There are more motorcycle events at this time of year than you can possibly cover. A biker’s dream, if only it’d last longer!! We’ve got a pretty extensive calendar of places to go, people to see in this paper. Remember to support those who support YOU first, by SUPPORTING A.B.A.T.E. of AZ chapter events;
A.B.A.T.E. of AZ will be at AZ Bike Week, March 25th – 29th, 2015 at Westworld of Scottsdale. East Valley members will be working the crowds at West World out of the Aid to Injured Motorcyclists (A.I.M.) booth, manned by “Muskrat”. If you would donate an hour or so to spreading the good word about A.B.A.T.E. and inviting folks to TOO BROKE FOR STURGIS while at West World, stop by and ask Muskrat for white bandannas and TBFS flyers. Our Phoenix-Shadow Mountain members will be circulating and distributing our propaganda at Phoenix Bikefest-Westgate in Glendale March 26-28. There was a lot of confusion about whether or not they were going to allow “colors” at Phx./Bikefest-Westgate, so we did not buy a booth and liability insurance.

with Chester’s Harley-Davidson on massive radio spots featuring TBFS & Chester’s H-D, together. Chester’s H-D has offered A.B.A.T.E. to be the nonprofit organization to benefit at their monthly “Party on the Patio” events for April and May. Chester’s H-D provides the food, A.B.A.T.E. provides volunteers to cook and serve it and we keep all the donations that night. Chester’s will also allow us to use their dealership as a rally point or meeting place for group rides up to TBFS Thursday and Friday mornings, 8am-10am. We need a couple of volunteers to meet and greet at Chester’s, hand out maps to the event. More to be announced …
Of all the bands we’ve had at TBFS, the one that stands out as our favorite is PHAT BASTARD, so we’ve signed them to play for us again Friday and Saturday nights. I’m sure you won’t be disappointed. ACES & EIGHTS will be playing at the Mormon Lake Lodge Saloon during TBFS also. We’re still planning on showing old biker movies under the big tent Thursday night, so come up early!! Registration will open Thursday, June 11th at NOON. 2 Gal Events has some new, sexy contest ideas for our people and bike games, too. A.B.A.T.E. of Arizona is currently without a Designated Lobbyist on file with the AZ Secretary of State, which means we cannot lobby our legislators as a Principal identity. We can, however, still ask our members to contact their legislators, as constituents, and ask for their support for or against bills. I know I for one am looking forward to next month’s presentation by Nolan, Jim, and Ron from Trauma Mama’s Accident Scene Management class. I am sure it will be not only informative but also entertaining with these three fellows. It is starting to get warm everybody please remember hydration is super important.

I brought up the AMA Action Alert about S. 424 dealing with the Wi-Fi Innovation Act. AMSAF article from Feb 16, 2015 about Rep Tom Bennett of Springfield IL proposing that more time behind the wheel to help students learn about motorcycle safety be incorporated
Jim gave a safety reminder about checking air pressure before riding. It was discussed that Jim, Nolan, and Ron will put on a presentation showing what they learned at the Accident Scene Management class at the meeting on Mar. 22nd. Jim is looking at April to do his MAP program and he wants to groom Nolan and me to help with the program. It was suggested that we look into what it will take to get driver schools to incorporate motorcycle safety into traffic school.
Donna let us know that she is waiting for a response from Todd & Jess before looking elsewhere to have both the Chapter & Support our Troops shirts made. The pin supply was also discussed.
I reminded everyone about the AMSAF scholarships being available again on March 2nd, the Tri City Eagles Scavenger hunt being on Feb 28th, Riding the long haul on March 7th, Miracle in the Desert Benefiting Sunshine Acres Children’s Home on March 21st, and Ernie’s Finish the Ride on March 21st, We talked about Motorcycle Day at The Dome being on Monday Feb 23 and encouraged anyone who could go to be there, Bike Fest 3/27 – 3/29, and Bike Week 3/27 – 3/29
Need to check into a booth at Bike Fest. Get started working on Spaghetti Feed. New member Ralph brought up info on a communication network that benefits kids. A motion was made and seconded for Ralph to bring more detailed info to the next meeting. We talked about sharing a booth with
Muskrat at Bike week, being at the Swap Meet for MMA Motorcycle Awareness in May, and Jim brought up that we need to get together a volunteer list for Too Broke. Jack motioned to adjourn Mike T second it. Our next meeting will be on Sunday March 22, 2015 as always everyone is always welcome to come.
High Country Chapter
Hello Brothers and Sisters. WILD IN THE WEEDS is only one month away so mark it on your calenders. This year it is going to be at Punkin Center Bar, and motel rooms are available, so if you don't like to camp, make your reservations now. For reservations call; 1-877-2229, mention ABATE for discounts. Camping and RV parking is available.
We have booked two bands for the weekend, Band-X for Friday night and Plum Krazy for Saturday night. These are two of the best Rockin bands that the High Country has to offer. While we are on the subject of entertainment, lets not forget the Wet T-shirt Contest. Ladies make sure to sign up for this because without you the wet t-shirt would be "pointless". So join in the fun and make these t-shirts feel needed.
For those that would like to ride. we have a bead run. We have a long and a short route with stops at some of the best establishments in Payson and surrounding areas. There will also be people games, these are always fun to play and to watch. You will also have a chance to test your riding skills in the bike games. You don't want to miss this, it's always a hoot. There will be a tattoo artist on site, Wolfskin Ink will be joining us again this year, so you can "get your ink on". We will also have other vendors on site. Outdoor grill and beer garden will be serving for your convenience. They will also be serving breakfast Saturday and Sunday. These are some of the things we have been working on. I think this year is going to be an epic Wild In The Weeds. Come join the fun.
Something else we have been working on is increasing membership. We have a contest within the chapter to bring in the most new members. Winner receives a H.C.C. hoodie. On that note, we had the highest turnout at our last meeting that we've had in years. As before, our invitation to join us at our meeting is extended once again. Our meetings are held the 3rd Sunday of the month at the Moose Lodge in Star Valley. Meeting begins at 10:00 am. We meet for breakfast prior to the meeting at the Spur Bar around 8:30 am. Our meeting was called to order at 10:45.
We had 3 guest speakers this month. The first was our representative from American Income Lie Insurance, who handles ABATE of AZ's accidental death insurance. He informed us of the other benefits we automatically get and some of the additional options available for us and our families. Lyn Peterson, our new treasurer gave us the current status of our accounts.
We also covered topics such as as, the upcoming bike week and the number of motorcycle thefts during this event, volunteers for bikefeast and if course the stuffing of TBFS packets which is coming up in just a few months. Additional speakers where Judge Jayne

The February meeting was held at the Kettle Restaurant on February 21st. The meeting started at 9:05 AM with the Pledge of Allegiance and Prayer for fallen Brothers and Sisters and those in harm’s way.

Sean had information on the bills coming up this session. HB 2345, which would eliminate the wording regarding the handlebar height restrictions, has passed the house and now goes to the Senate. The second Annual Patrick Donaldson Memorial Run will be held March 8th. As many of us know, Pat was struck while riding his motorcycle on the Northwest Side of Tucson. He tragically passed away leaving behind two beautiful little girls. A benefit poker run will be held WITH ALL PROCEEDS BENEFITING THE GIRLS!! The Chapter along with The State office will be providing white bandanas, application, and bumper stickers etc. for all registered participants. Woody from High Country has issued a challenge to all ABATE members to bring in 10 new members each by May 1st.

The Yuma chapter met on March 10th at 6:00 pm at the Kountry Kitchen Café in the foothills to conduct our monthly business meeting. The meeting was called to order, the Pledge of Allegiance was recited, and normal reports were addressed. National Coalition of Motorcyclists (NCOM) ANTI-PROFILING BILL INTRODUCED IN CALIFORNIA
Legislation aimed to curb anti-biker profiling has been introduced in California. Citing anecdotal evidence that Golden State motorcyclists tend to get pulled over unjustly, Assemblyman Ken Cooley (DRancho Cordova) authored a bi-partisan bill that would have police officers undergo training emphasizing that profiling of motorcycle riders is prohibited.
The measure seeks “to ensure that anyone entering law enforcement in California knows the ground rules to apply the law fairly without regard for irrelevant factors of, ‘I’m on a bike’ or they’re dressed a certain way,” Cooley said, adding that “it is an important issue of people being secure in their persons and the administration of traffic laws.”
Assembly Bill 334 would add Section 13519.17 to the Penal Code, relating to the profiling of motorcycle riders: “This bill would require the Commission on Peace Officer Standards And Training to ensure that the profiling of motorcycle riders is addressed in the course of basic law enforcement training and offered to

Despite the fact that helmet legislation has only recently been introduced in New Mexico, and not passed as yet by the state legislature nor signed into law, “I have received two complaints that in the last few days riders have been pulled over for no helmet use by city police in Albuquerque and have been given a verbal warning,” reports Annette Torrez, chairperson for the New Mexico Motorcycle Rights Organization (NMMRO) and member of the National Coalition of Motorcyclists (NCOM) board of directors.
In the meantime, the national office of the U.S. Defenders (www.usdefender.net) has issued a nationwide CALL TO ACTION to oppose the two current helmet bills which were introduced into the 2015 legislature; Senate Bill 327 Requiring the use of helmets for all motorcycle operator and passengers, and Senate Bill 308 creating a distinctive motorcycle validation sticker ($692) allowing qualified operators and passengers to refrain from wearing a safety helmet. “We must unite and fight this or by this summer it could be mandatory for every biker to wear a helmet in New Mexico,” according to the US Defenders’ CTA, which goes on to state; “We were told that the Centers for Disease Control are following this bill in New Mexico as a pilot program if it passes for other states in the future.” TEXAS LEGISLATION WOULD ALLOW RIDERS TO LANE SPLIT IF HELMETED

Muñoz (D-Palmview), motorcycle riders would be allowed to ride between lanes of traffic moving in the same direction, if traffic is traveling 20 mph or slower, and if the motorcyclist is not traveling more than 5 mph faster than other traffic. Lane splitting would be prohibited in school zones and in areas where the posted speed limit is 20 mph or less. However, HB 813 would also require that riders and passengers must wear helmets. Senate Bill 442, introduced by Sen. Watson (D-Austin), does not include the helmet provision, but lane splitting would be restricted to controlled-access highways. “Filtering” is common in Europe and Asia to alleviate congestion in urban areas, but in the U.S., only California allows the maneuver.

Indian Scout Recall
Indian Motorcycle has filed a recall with NHTSA that affects 806 units of the company’s 2015 Indian Scout motorcycle.
The recall is due to the Scout having a fault with the rear brake’s master cylinder, which can have a decrease in braking performance, or a complete loss of braking power.
The issue appears on the following Scout models: N15MSA00AA, N15MSA00AH, N15MSA00AR, N15MSA00AS, N15MSA00BA, N15MSA00BH, N15MSA00BS, N15MSA00CA, & N15MSA00CS, which were also manufactured between May 12, 2014 and February 13, 2015. Indian will notify affected owners, and Indian dealers will inspect and replace the rear brake master cylinder, as necessary, free of charge.
The recall is expected to begin in March 2015. Concerned owners may contact the Indian Motorcycle Consumer Service Department at 1877-204-3697, referencing recall number I-15-01 A/B.

LANE “FILTERING” RIDES INTO AUSTRALIA
New rules have come into effect for motorcycle riders in Queensland, Australia as of 1 February 2015, including safe lane filtering. "Lane filtering can be a complex manoeuvre requiring plenty of on-road experience to be done safely, so only fully licensed riders are allowed to lane filter," Department of Transport and Main Roads (DTMR) says on its website, noting heavy penalties for riders who don’t follow the rules.
DTMR said motorcycle riders who hold an open licence for riding a motorcycle may lane filter at speeds not greater than 30km/h between stationary or slow-moving vehicles travelling in the same direction as them, provided it is safe to do so.
New rules also allow riders to ride on road shoulders and in emergency stopping lanes.

Legislators’ have become more interested in the views and opinions of riders both here in Arizona and elsewhere across the nation.

The AMA’s efforts to combat the “motorcycle-only checkpoints” has resulted in California, Louisiana, Missouri, North Carolina, Illinois, New Hampshire and Virginia passing legislation to stop the use of motorcycle-only checkpoints. There is currently S. 127 which is “Stop Motorcycle Checkpoint Funding Act” that needs your support to be signed into law this year. Tell your Senators to support this S. 127 Act. By putting an end to the funding from the National Highway Traffic Safety Administration, states would be restricted in the programs they could create to check helmet use/paperwork and force an unsafe stop off the pavement to discriminate against motorcyclists. These are your tax dollars that are being misused when they could be directed towards training and education. This brings me to the next subject: WHERE DOES OUR MONEY GO????
It’s important for individual motorcyclists, clubs and rights organizations to closely observe where our funds are being directed. When a bill or a budget is introduced that threatens funding for motorcycle trails or safety programs, contact The AMA so they can help fight these proposals. California, for example has and offhighway trust that has been raked for $221 million since 1982.
In Texas, $16.5 million allocated for motorcycle safety programs is sitting not being used. (This sitting of funds, threatens education for future motorcyclists).
Each year States across our nation, “borrow” money to balance budgets and fund other programs. Monies are directed to the “General Fund” and historically not reimbursed.
PAGE 9 2009- Ohio: The Off-road riding community raises user fees and the monies are put into a State RV Fund. When the inserted sunset clause came to be, two years later, the advisory board was dissolved and the guaranteed voice to oversee the spending of the money went with them. Currently those fees remain in place however; SB 383 is now before the Energy and Natural Resources Committee that will restore the Advisory Board to study the possibility of a grant program for funding RV projects. And in Illinois in 2004 the state legislature passed a law allowing the governor to “sweep” such funds to balance the state budget.
$1.2 million was pulled from the Cycle Rider Safety Training Fund. A percentage of motorcycle registration fees go into this fund. ABATE of Illinois sued and lost with the Supreme Court justifying that the money had come from legislative appropriations. Although the ruling was not what motorcyclists had hoped for, the General Assembly and governor has not attempted to sweep the fund since.
Also in Illinois, SB 2808, known as the Freedom from Location Surveillance Act would prohibit law enforcement for obtaining location as to a person or his or her effects without first obtaining a court order based on probable cause. This bill passed the state House and Senate unanimously and was sent to the governor for his signature.
Here in Arizona we have been proactive in defeating bills that would mean big changes for most of us motorcyclists. We have to stay focused and fixed on the prize, Freedom of the Road and protecting our rights. So whether your journey is around the block or taking in the scenes of the lower 48, stay on top of what is going on elsewhere and don’t be caught off guard. New legislation is being introduced and implemented where you least expect it.

Arlen Ness and Rick Fairless Collaborate On Custom Bike For Allstate Sweepstake
Allstate Insurance Company and legendary motorcycle designers Rick Fairless and Arlen Ness, Inc. haved unveiled their first-ever collaborative creation at Daytona Bike Week on Friday, March 6. The custom Allstate Victory Gunner Bike is this year’s grand prize for the sixth annual Allstate Motorcycle Sweepstakes.
The Victory will be comprised of Ness-signature parts and a custom paint job by Fairless. Notable features also include Ness billet grips, pegs and side covers, Ness-modified modular handlebars and Fairless custom motor cages. Cory Ness, Arlen Ness’ son, was the brainchild behind the custom-built bike.

While most ABATE members across the country tend to ride Harleys and that is only one piece of the pie when it comes to motorcyclists in Arizona. I was recently in Miami Florida and noticed numerous bikes on the road. The majority of them were sport bikes and it got me to thinking. tions for the rights of motorcyclists. The Freedom Fighter award is awarded to individuals who have made a significant impact to the sport of motorcycling for an extended period of time. They also advised me to nominate him again next year for the regular Hall of Fame, who is given to groups and organizations for their achievements, and with the many programs he has founded they were sure that he would get in.

Freedom of the road Freedom of the road means different things to different people. Just ask your neighbors and co-workers. For some it may mean the ability to travel anywhere at anytime without interference. To others it may be just the freedom to ride their bike to work. Does it matter what one persons definition of freedom is as long as they are free to ride?
Fight discriminatory legislation So many videos recently about law enforcement going crazy on citizens have gone viral. The only way to stop profiling, riders worrying about laws, and other stupid things that get in our way of just riding is to put an end to the discriminatory legislation that keeps coming out of closed door chambers. We have a lobbyist at the state capital who works endlessly in keeping us informed so we can intelligently discuss with our elected officials how certain pieces of legislation will affect their constituents. If we don’t tell them, they won’t know.

Rider education/motorcycle awareness Our state board of directors is working with T.E.A.M. Arizona to set up a rider education partnership. I have been riding motorcycles for over 40 years and still do everything I can to improve. I have taken a few of the courses that T.E.A.M. Arizona provides for a little “tune-up” in the skills department and have a friend I ride with who taught riding skills for 20plus years and he always gives me tips to improve. I f we as riders can improve our abilities then I truly believe there will be less riders going down. That leads me to the next point, motorcycle awareness. Car drivers still don’t have a clue about how to share the road with motorcyclists. Some are oblivious but others would like to know how to.

Lane-Splitting To Move Beyond California?

SAN FRANCISCO-Eric Kondo rides a motorcycle from his home in Alameda, across the congested Bay Bridge and into the city, every weekday morning for work. On a bad day, it takes him 25 minutes-about half the time it takes by car during rush hour.
That's because California is the only state in the country where motorcyclists are allowed to cruise between lanes of cars, a practice called lane-
splitting that is normally used to cut through stalled traffic.
Now, an effort to legalize lane-splitting in other states, such as Washington, Oregon, Texas and Tennessee, is gathering momentum amid a push by motorcyclists and by some lawmakers looking to relieve highway congestion.
Those moves have set off a debate because some traffic-safety officialsand many automobile drivers-see the practice as unsafe. It's also the latest entry in a long-standing battle over motorcycle-safety laws such as helmet requirements, which are in place for all riders in 19 states, including California, but have been fought or even repealed in many others.
Eric Kondo, a Bay Area motorcycle commuter, rides between lanes to get through traffic on the Bay Bridge. Motorcyclists like Mr. Kondo, a 53year-old who works in building maintenance at a hospital, say that splitting lanes is safer for him because it reduces his risk of getting rear-ended while sitting in traffic. "I can get through the cars, keep moving, and not be a fixed target," Mr. Kondo said.

But some officials worry that it could create more danger on the roads.
"We're skeptical, and it's not something that we would encourage states to do," said Jonathan Adkins, executive director of the Governors Highway Safety Association, which represents state highway-safety offices. "With highway safety we've made great progress, but motorcycle safety is an area where we haven't been making progress generally speaking."
Pete terHorst of the American Motorcycle Association, which counts 215,000 riders as members, said opposition to the practice is based on a gut reaction from car drivers, not on research.
There were 4,668 motorcycle deaths in the U.S. in 2013, a higher total than a decade earlier, although the fatality rate nationally per motorcycle registered has gone down in the past decade. Still, in 2012, the most recent year available, motorcyclists were 26 times as likely to die per vehicle mile traveled as people riding in cars, according to the National Highway Traffic Safety Administration.
MASTERLINK APRIL 2015 In California, where there are more than 850,000 registered motorcycles, the fatality rate per registered motorcycle in 2012 was slightly lower than the national rate.
No one has tracked exactly how many highway accidents are caused by lane-splitting. But last year, a study from the California Office of Traffic Safety found that motorcyclists' injuries were kept down as long as they split lanes in slowly moving traffic and exceeded the speed of other traffic by less than 10 miles an hour.
"Lane splitting, when done in a safe and prudent manner, is no more dangerous than regular motorcycling," said Chris Cochran, a spokesman for the state traffic-safety office.
Further, the study found that motorcyclists were less likely to die or be injured in lane-splitting crashes when compared with other kinds of collisions.
A survey by the traffic-safety office released last year found more than 60% of automobile drivers said they disapproved of lane-splitting-a slight decrease from the previous two years. Most disapproved because they said it was unsafe, while some called it startling, and a few said it was unfair that motorcyclists were getting ahead of them in traffic.
Meanwhile, the number of drivers who said they knew the practice was legal increased to 61% from 52% in the past two years, as California officials stepped up efforts to publicize guidelines for splitting lanes safely.
While the state allows the practice, there is no existing law regulating it. A bill now in a legislative committee would codify the practice, allowing it to occur at a speed differential of less than 10 miles an hour in traffic moving at less than 30 miles an hour.

The lane-splitting measures in other states also set varying limits to motorcyclists' speed and speed differential. Most of those bills are also in committee, although Washington state's measure passed the state Senate this past week.
The motorcycle association favors bills that legalize lane splitting, even with speed restrictions. The group is neutral on the California bill.
Surj Gish, 41, a Bay Area motorcycle commuter who runs a website called lanesplittingislegal.com, said he believes car drivers over the years have become more accepting of lanesplitting. "I haven't seen an intentional cut-off in a long time," he said.
In places with heavy traffic like the Bay Area, motorcycle riders say there are intangible benefits to lane-splitting as well.
"I'm never in a bad mood when I get to work," said Gwynne Fitzsimmons, 54. "The other guys are always talking about what a crummy commute they had-they start their day angry."

Riding The Road Of Bones Documentary Announced
In May 2014 sixteen riders left London to embark on a 105-day adventure expedition to Magadan. Documentary filmmaker, Robin Newell joined them with the end result being called “Beyond Siberia – Riding the Road of Bones” and soon to become a 2 x 1 hours TV mini series.

The Buffalo Chip is one step closer to becoming the newest municipality in South Dakota. The Meade County Commission today accepted the petition presented by registered voters for incorporation. The registered voters and founding members of Buffalo Chip, SD will vote in an election to make the incorporation official on May 7, 2015. Buffalo Chip, SD may well be operating as a municipality before the 75th Anniversary of the rally this August.
The idea of incorporation was first presented to encourage economic development and business friendly environment that will benefit the entire region. The new municipality aims to provide investors a heightened level of stability and help bolster future area growth.

Bikers Want To Drive California’s Roads Without Getting Harassed By The Police
Citing anecdotal evidence that California motorcyclists tend to get pulled over unjustly, Assemblyman Ken Cooley, D-Rancho Cordova, has
introduced legislation that would have police officers undergo training emphasizing that that profiling of motorcycle riders is prohibited. Assembly Bill 334 would also require law enforcement agencies to create policies barring discrimination against riders.
The bill seeks “to ensure that anyone entering law enforcement in California knows the ground rules to apply the law fairly without regard for irrelevant factors of, ‘I’m on a bike’ or they’re dressed a certain way,” Cooley said. “We recognize that this issue is a much bigger issue right now than the motorcycling setting,” he added, “but it is an important issue of people being secure in their persons and the administration of traffic laws.”
PAGE 13 It was while rumbling home from a bikers’ unity rally in Sacramento last year that Joseph Iosefa and his fellow United Motorcycle Clubs of Alameda County riders were pulled over for no apparent reason, Iosefa recalled after a Tuesday press conference for Cooley’s bill.
“Unfortunately, it is common,” Iosefa said, recalling a separate time he was pulled over for a broken taillight that he said was not in fact broken. “A lot of the pretexts that they’re going for don’t exist.”
Intimidating outfits like leather jackets can give the wrong impression, said Assemblyman Katcho Achadjian, RSan Luis Obispo, one of several Republican coauthors of the bill. Achadjian rides a motorcycle, as does his wife, and said the helmet and leather jacket he dons for protection conceal his identity.
“We’re all human beings. We all have our professional jobs,” Achadjian said, recounting meeting bikers and learning that “they were doctors, lawyers, plumbers – all who love to ride.”

It was a short week here in D.C. with a federal holiday and a citywide shutdown for a day due to snow. It seems silly that a major city would shut down for a less than spectacular amount of snowfall, but D.C. is so inept at snow removal that essentially the master plan for clearing the white stuff is springtime sunshine. That being said it gave me a rare quiet day that I used to do some heavy research into intelligent transportation systems (ITS). There is a bill in both chambers that opens up a certain spectrum of WLAN (wireless local area networks). This affects motorcycles how, you ask? There is some concern that the spectrum could be used for unlicensed devices. There are several portions of WLAN spectrums that are dedicated to a single purpose, such as Terminal Doppler Weather Radar (TDWR), or for only indoor use, or in this case, only for ITS. The concern is that the spectrum will be opened up to outside devices that may not play nice with the ITS infrastructure and cause radio interference, which could delay auto braking, for example. I am meeting with the bill's sponsors next week to drill down on this. I'll report more next week. These same bills were introduced last congress and did not get any traction at all.
Friday February 20th, I attended, by invitation, the welcome home ceremony for Department of Transportation Secretary Anthony Foxx. Foxx has been on a multistate transportation tour snaking along the coast from Florida, with stops in Georgia, both Carolinas, and Virginia. He ended the trip at D.C.'s Union Station, where he spoke to a group of attendees and press about the dire state of our infrastructure and the need for Congress to get its act together and pass the GROW AMERICA act. GROW AMERICA is President Obama's blueprint transportation bill. The draft is widely accepted as DOA by most in Congress. Congress was in recess this week and is slated to return to business next week.

Motorcyclists are frequently stopped by police as they travel simply because they ride a motorcycle or are wearing motorcycle riding apparel. Often these pretext stops are accompanied with the explanation that a traffic infraction has occurred, which is not always the case. In some cases people have been told they are violating a law that does not exist. In other cases the violation cited simply has not occurred. Motorcyclists come from all walks of life and most are law abiding citizens. They have their travel interrupted on their way to work, family events, meetings, church and other places. Motorcyclists should not be treated differently from other members of the transporta-

New Mexico and South Dakota 2015 Legislative Accomplishments March 4, 2015
South Dakota passed S.B. 85 to remove the restrictions on handle bar heights for motorcycles. Current law dictates that handle bar height must be at or below shoulder height. The new law removes the restriction, and as ABATE of South Dakota State Coordinator Jiggs Creasy put it, “There actually is still one restriction, interstate overpasses.” The MRF salutes the fine work done by ABATE of South Dakota. Sturgis attendees will no longer be harassed by the police for handlebars. South Dakota joins thirteen other states that have no handlebar height restrictions of any kind.
New Mexico is celebrating the demise of not one, but two helmet law attempts. S.B. 327 would have simply mandated helmets for all motorcycle operators and passengers. Current law states that motorcyclists seventeen and under must wear a helmet. The second bill, S.B. 308, would have allowed both operator and passenger to ride helmet-less after purchasing a $697 license plate sticker to offset the burden that some believe comes with helmetless riding. Both bills were killed in the New Mexico Senate Public Affairs Committee by a vote of 4-3. ABATE of New Mexico faced some tough opposition with lots of health care professionals and doctors in the committee room. ABATE of New Mexico was ready. They had over 700 motorcyclists at their State Capitol Bike Day and handily defeated the legislation. Both of these are perfect examples of education, organizing, and executing at the state capitol. A recent release went out about the great work being done by the motorcyclists in New Mexico to defeat two helmet law attempts. The Motorcycle Riders Foundation would like to apologize for failing to give credit to multiple organizations in New Mexico. The organizations who did the work, and do deserve the credit are, New Mexico Motorcycle Rights Organization, Coalition of Clubs, US Defenders, National Coalition of Motorcyclists, and many independent riders.

============================= The WiFi Innovation Act of 2015 March 9, 2015
Congress wants more wi-fi available to the general public, and in order to do so, both
the U.S. House and Senate have legislation to explore one possibility of getting you a new way to access a wireless signal. Congressmen Bob Latta (R-OH) has introduced H.R. 861 and Senator Marco Rubio has introduced S 424, and both do the same thing. They order a test to see if a wi-fi signal can coexist with the incumbent licensee on the 5850-5925 megahertz (MGh) band. Currently the most popular band for wi-fi is 2.4 and the incumbent licensee for the 58055925 MGh is vehicles. The license was dedicated for use by vehicles in 1999 by the FCC, before wi-fi was even available for public use. What that means is the Federal Communications Commission set aside that particular spectrum specifically for anything related to your vehicle communicating with other vehicles (v2v) or the infrastructure, also known as telematics. They saw the day when your vehicle will communicate with the red light or approaching toll booth to alert you of the upcoming need to brake. The FCC did that so that the frequency would be free from outside interference and avoid any hiccups with the technology that could result in injuries and fatalities. It was a great idea at the time. However, the technology that has been developed since 1999 has changed the way that the frequency spectrum is used and it has been proven that parts of the spectrum can accommodate both wifi and another use in the same frequency. Since the spectrum is only so big, we must develop technology to accommodate multiple uses on one spectrum. This bill tasks the National Telecommunications and InformationAdministration (NTIA) to publish a test plan to see if wi-fi can coexist with the vehicle technology. NTIA is an agency within the Department of Commerce that oversees spectrum management. Should the bill be passed into law, NTIA would have six months to issue the plan to conduct the test; then they have 15 months to actually conduct the test and gather information, along with the FCC and DOT, and issue a report. Should they find that it is possible for the multiple uses to occur with out harmful interference, then the FCC will have to approve the matter. Should the testing fail, then the idea will be abandoned.
It is not certain if this bill would allow for complete coverage of wi-fi only indoors or out of doors as well. That depends on the test results. This is not referring to the internet you may be able to generate from your car, smartphone or hot spot. This would be a new type of wi-fi on a totally different spectrum and would generate a blanket signal available to all who are within coverage, much like many college campuses and municipalities are doing, but on a different frequency. The Motorcycle Riders Foundation (MRF) is tracking this issue because like all driver assist technology, we fear that this will reduce the amount time drivers spend watching the road. “Technologies that take the actual operators out of the equation are always worrisome; this is no different. If operators become accustomed to not needing to pay attention for red lights and stop signs, we all know that will pose problem for motorcyclists,” said Jeff Hennie Vice President of Government Relations and Public Affairs for the Motorcycle Riders Foundation.
The MRF does not currently have a position on this issue. The distracted driving portion of this issue is completely separate from this legislation. This legislation simply conducts a technical test to see what's possible with modern technology. The distracted driving issue will always be part of the discussion as more and more technology is employed by vehicles. The FCC would have ultimate sign off on the use of the frequency for a wireless source. Should they see any foreseeable

Congress looks at Vision Zero March 11, 2015
Vision Zero is the concept that it is possible to drop the fatalities within the road transportation community to zero and that it should be done at all cost. Vision Zero plans are lofty and admirable, but the approach is just not plausible. At the core of Vision Zeros philosophy, life and health can never be exchanged for other benefits within the society, rather than the more conventional comparison between costs and benefits, where a monetary value is placed on life and health, and then that value is used to decide how much money to spend on a road network towards the benefit of decreasing how much risk.
The plan also places human life and health as a priority over mobility and other objectives of the traffic system. It also describes how we should build roads with no possibility of a side or frontal impact, and prohibition to use those roads on more vulnerable road users. Another part of plan is speed limits; should the plan be adopted in full American speed limits would plummet to 19 miles per hour in areas where there is contact between pedestrians and cars, and 43 mph for all other roads. The creators envisioned a slow moving, padded fantasyland right at home in a Disney movie, not the real world. Vision Zero began in Sweden in 1997 and has since been adopted in some part at least by Netherlands and United Kingdom. In the United States some major cities are also adopting the concept; so far New York, Portland, and San Francisco are all on board. A lawyer in Boston gives out a law school scholarship in the attempt to get the city to take look at considering the idea.
Last week Congressman Earl Blumenauer (D-OR) introduced H.R. 1274, a bill that would make money available to local governments to develop and implement Vision Zero plans. A mandatory national helmet law would just be the jumping off point. Make no mistake that the full implementation of Vision Zero in America would eliminate motorcycling as its known now. Of course it is everyone’s wish that no one would become injured or killed on our roads. Every life is precious and every American should do all in their power to reduce bloodshed on the roads. But simply slowing every vehicle and prohibiting other “vulnerable” vehicles from the traffic mix, all while padding the roadways and interior of vehicles and installing cameras everywhere to find the scofflaws, is the stuff of science fiction, not the real world. Vision Zero has a blind spot; it does not take into account any budget, financing or the effects on the economy by slowing traffic. Zero fatalities is always the goal, however when you have moving parts operated by human beings traffic safety will always have a component that will never be a control for: human behavior. In the discussions of financing the bill one of the concepts is to roll back the federal role in the highway process. The practice is known as "devolution." The Federal tax would dial down and so would the authority of the federal government. The states would take control of all highway safety, construction, repairs etc. It is a horrible idea. Safety would be compromised and no consideration of where the states would make up the money gap with the shrinking of federal funds. Some federal rules arguably increase costs and slow construction however, decimating the federal funding for our nations most critical infrastructure is not going to make it any better. Devolution does not empower states as the proponents suggest, just the opposite, it saddles them with 90 percent of the fiscal responsibility to support

highways that, under the Constitution, the federal government has an obligation to maintain.
The MRF joins a healthy group of organizations on the letter such as American Association of State Highway Transportation Officials (AASHTO), US Chamber of Commerce, American Trucking Association, and a host of others. This letter is going to every member of the House and Senate. The letter is still gaining support and therefore has been embargoed until public release so it cannot be shared publicly yet. The MRF also joined another coalition this week, the Alliance For Toll Free Interstates (AFTI). They have a paid lobbyist, a paid PR team and a website. By the numbers: According to USDOT drivers in the USA ticked off three trillion miles driven last year. This is the highest miles driven since 2007 and the second highest since data collection has begun, 79 years ago. This is why we need a robust highway bill; our roads are in the worst shape with

Nine states have raised their gas tax since 2013. Wyoming, Maryland, Massachusetts, New Hampshire, Pennsylvania, Rhode Island, Vermont, Virginia, the District of Columbia, and Iowa. But we cannot get support for a small federal increase? Wyoming and Iowa both raised their taxes by a whopping 10 cents. $2.6 million: That’s the amount the federal government doled out this week to thirteen cities to implement real time travel information. Manners are usually a two-way street. It’s like a good stereo system; it needs to come from both sides. A bit like, treat people the way you want to be treated yourself; respect. Yes, there is a manner about riding...
When coming up behind another biker, don’t honk, and don’t immediately overtake. At a red light when the other biker is stopped, don’t pull up beside him/her, but staggered behind the bike. The reasons for this, is that you don’t know the rider’s abilities and street smarts. Coming up behind a biker and continuing fast, may result in the biker suddenly pulling out to accelerate and bump into you. Coming up behind the other biker and staying a few seconds will ensure that the other biker has seen you. Sitting behind the biker at a red light, staggered, will give the biker time to see that there’s someone behind.
Mind your manners and,, Don’t suddenly overtake another biker. Don’t honk.
When you ride up to another slower bike and there’s no lanes available to pass, wait. The slower bike will hopefully see you and wave you through on the same lane. If you don’t, you stand the chance of crashing.
If you see another motorcycle that has broken down, it can be a good idea to stop and see if they need help. We’re on our own out there in SUV land, and the more help we get from our brothers & sisters, the easier and safer our lives will be. The same obviously applies to bikers who are in trouble with car drivers. Go and help them.
This manner is what we are about,, When possible, help out other bikers on the road who are in trouble. The Wave
The actual form of wave is not that important, it could be a high held hand, a low one, one, two or all fingers, whatever the “wave”, as long as the others can see it. Obviously when you are riding in a dense motorcycle area, like Too Broke for Sturgis, you don’t need to wave, or even nod. In cities where there are many more motorcycle riders, you could be spending all your time waving. Here maybe a nod will do, or nothing at all.
Dang good old manners your just gotta have... If you can, wave or nod to other bikers riding any brand or type of motorcycle. Its what we do! I love a good group ride however,,
When riding in a group, if there’s a smoker out there, would you like to ride behind that person and receive their cigarette in the face when they flick it away;
Yes you can always show good manners about this... Don’t throw away cigarettes when riding (it’s illegal anyway). Remember the bikers behind you, East Valley newest member Jim Austin can attest to being a non flicker of butts, he says so.
Don’t try to get others to ride at your pace, especially when your pace is fast. It’s nicer for everyone to ride at their average pace.
One of the most common forms of manners, or protocols (etiquette) is the famous wave between bikers. When you are riding and come upon other bikers, give them a wave, or at the least a nod with the head. The “wave” shouldn’t be just to motorcycle riders who are riding your favorite motorcycle. The wave is to any motorcycle, even scooters. It’s a form of respect, a respect to their chosen form of transportation. We are a brotherhood.Remember we all started out somewhere on a smaller bike,just ask East Valley member James Hammond about his Sporty!

When you see a parked motorcycle, even if the owner is right there, never, ever, sit on the parked motorcycle. If you want to sit on it, ask permission. You don’t see people go into someone else's car to sit in it. It’s just not done. Totally uncool as well.
You will learn this manner fast... Never sit on someone’s motorcycle without asking for permission.
When you have to park in car spots, if the spot is taken up by another motorcycle, do not put your bike in that slot. You
are going to give the other biker problems taking out his/her ride. Only put multiple bikes in one parking slot if you are all riding together.
A very good parking manner is... Do not park in the same car parking space as another motorcycle.
Your gorgeous fender fluff needs to know...
When you get a new fender babe, tell them what is expected from them. Tell them where to get on or off the bike, what to do when you are in a curve and what not to do. Even if she has been riding with others, just remind them of “your” rules. Why do you think my airline keep telling you about the safety procedures? Just listen and follow,,and thank you!

State Officers Meeting Minutes (continued)
1. Topic: By Laws – 10.02 TREASURY REPORTS, Check signatures requirement Discussion: Current By Law states “All drafts against all Corporation accounts shall require two (2) officer’s signatures, one of which shall be the Treasurer’s. The second signature shall not be that of an officer residing in the same household as the Treasurer.” Two (2) signature requirement on drafts (checks) has not been adhered to and is not workable in practice.
Action: MOTION made by Mike, 2nd Vic to replace verbiage with “Corporation drafts issued by chapters for items not budgeted for over $500.00 shall require two officer’s signatures, one of which shall be the Treasurer’s, the second signature shall not be that of an officer residing in the same household as the Treasurer.” All voted in favor, motion passed.
By Law change requests need to be presented to the B.O.D. at their 11 April 2015 meeting.

2. Topic: By Laws – 10.05 TREASURY AUDITS Discussion: Current By Law states “(a) Each chapter will have an annual internal audit. The State Treasurer and President will be responsible for having a qualified person perform each chapter audit. Audit results for each chapter shall be reported to the B.O.D. at the third annual quarterly B.O.D. meeting.” (b) The State Treasurer shall have an internal audit annually. Such an audit will include the State Treasurer, President and all the Members of the B.O.D. State treasury audits will begin no later than the fourth quarterly B.O.D. meeting in 2003 and continue annually at the fourth quarterly B.O.D. meetings.”
We have not adhered to this rule. Do we need to hire an independent CPA to perform a forensic review? Can chapter treasurers audit each other? Would Matt start kicking back chapter treasurer reports that don’t match bank statements?

APRIL – Designated Lobbyist, Chapter PAC Officers and assigned BOD member – develop Annual Legislative Survey to be polled by members, as well as conduct
