The 26th amendment (granting the right to vote for 18 year-olds) took only 3 months & 8 days to be ratified! Why? Simple! The people demanded it. That was in 1971 - before computers, e-mail, cell phones, etc.

Of the 27 amendments to the Constitution, seven (7) took one (1) year or less to become the law of the land - all because of public pressure.

Usually you won’t find me passing along something I’ve read on the internet; this however will be the exception. In the past there’s been obvious discontent and frustration with much of our representation (or lack thereof) we as motorcyclists receive from our legislators. The following is an article I’d like to pass along that summarizes why we, as citizens, not just motorcyclists, feel that we’ve become nothing more than after thoughts to Congress and perhaps this offers a cure for the problem. Warren Buffett, in a recent interview with CNBC, offers one of the best quotes about the debt ceiling:

Congressional Reform Act of 2012

No tenure, no pension – A congress person collects a salary while in office and no salary after.

Congress, (past, present and future) participates in Social Security. All funds in the Congressional retirement fund move to the Social Security system immediately. All future funds flow into the Social Security system and Congress participates with the rest of the American people. It may not be used for any other purpose.

Congress may purchase its own retirement plan, much like the rest of Americans.

Congress may no longer vote a pay raise for themselves. Congressional pay will rise by the lower CPI or 3%. Congress no longer participates in their current health care system, but instead participates in the same health systems as the rest of the American people.

All contracts with current legislators are void, effective 12/1/12. These contracts were not authorized by the American people’s vote. The legislators have granted themselves these “perks”. Serving in Congress was never meant to be a career. The Founding Fathers envisioned citizen legislators, not career politicians; they were to fulfill their terms, then return home and go back to work. In Arizona perhaps we should look at true term limits. There would be a certain number of terms allowed, period! Hello to all my Brothers and Sisters;

I hope everyone had a safe and happy 4th of July this year. I say that because today is July 4th. I am writing my article thinking what today means to me. 236 years ago this week 56 men gathered in Philadelphia to approve a document that would change the world. Everyone who signed this document was individually declaring their independence, and collectively they were our Country’s first freedom Fighters. The signing of the document was just the beginning of their fight for freedom. Already they were at war fighting for liberty and the freedom to govern themselves.

“Posterity! You will never know how much it cost the present Generation to preserve your Freedom! I hope you will make good use of it. If you do not, I shall repent in Heaven, that I ever took half the Pains to preserve it.” ― John Adams John Adams, who was our Country’s first Vice President and then second President, wrote to his wife; “I hope you will make good use of it”. Let’s fast forward to the present… Are we?

In less than 2 months Arizona will have a Primary Election. Are you prepared for it? Are you registered to VOTE? If not, why? This election matters most when it comes to electing the Arizona Legislature. Historically most of you will not participate in this election. Two years ago only 12 % of registered voters opted to exercise their right to vote. That means that only 12% cared enough to have a say in who runs this State.

I have been asking many people if they are registered to vote. It is shocking to me that over half of the ones I have spoken to are not even registered to vote! Come on it’s free, and it’s one of the most important rights you have as a citizen of this country. Why are

you not exercising your freedom to vote? Can’t get off work? No problem vote by mail, they even provide the postage. Thousands of American Military men and women have paid the ultimate sacrifice in protecting our right to vote. Did they die in vain protecting a right that many no longer cherish? That is not only sad but it’s disgraceful to their memory.

If you are waiting for the general election to register it’s probably too late, as many districts in Arizona only have one party running in that district during the general election. Most district primaries have a choice, but if you wait, it’s all but over and you will have no say in picking your Candidate. Maybe, just maybe if the majority of voters voted in the primary August 28, we could elect somebody that really cares about the citizens of Arizona. If you are not registered you must register by July 30th. The last day to request an early ballot is August 17th. On line go to; www.recorder.maracopa.gov or call your County Election Office and request an early ballot.

The bill soared through both chambers this afternoon. Both chambers did have some nay votes, all coming from Republicans because of a few riders that were attached concerning student loan rates and the national flood insurance program. NCOM CONVENTION LAPS THE CIRCLE CITY

Indianapolis is known for its world famous racetrack, but few people realize that the first race ever ran at the “brickyard” was with motorcycles way back in 1909. After more than a century, we’re still in a race -- but it’s not a shiny trophy we’re out to win, but our rights as riders.

The 27th annual NCOM Convention was held over Mother’s Day weekend, May 10-13, 2012 at the luxurious J W Marriot in Indy, and this yearly gathering drew bikers’ rights activists from across the country to discuss topics of concern to all riders; such as biker discrimination, motorcycle-only roadblocks, and mobilizing motorcyclists to advocate motorcycle-friendly legislation and defeat antibiking bills. Early motorcyclists didn’t face many restrictions on themselves or their machines, and our goal as grass roots activists over the years has been to maintain our Freedom of the Road, while promoting a pro-motorcycling agenda to make roads safer for future riders.

The National Coalition of Motorcyclists (NCOM) is solely sponsored by the Aid to Injured Motorcyclists (A.I.M.) nationwide legal services program and serves as an umbrella organization for more than 2,000 NCOM Member clubs, organizations and associations worldwide, representing well over a quarter of a million politically active motorcyclists. NCOM has successfully outreached to numerous segments of the motorcycling community in an effort to unite for our rights, both legal and legislatively, and has become a unifying voice amongst North America’s motorcycle rights organizations (MROs), motorcycle clubs, women riders, religious riding organizations, touring groups, trikers, sportbikers, and minority motorcyclists.

All motorcyclists are welcome to attend the NCOM Convention, hosted this year by the Indiana Confederation of Clubs, and encouraged to participate in the many meetings, seminars and group discussions that focused on legislative efforts and litigation techniques to benefit our right to ride.

HEALTH AGENCY PUSHES HELMETS WITH BOGUS FINDINGS

Researchers at the Centers For Disease Control are using flawed logic to promote their crusade for helmet laws, but “Garbage-In, Garbage-Out” numbers reveal helmet use is actually in indirect proportion to motorcycle fatalities.

In a newly-released CDC study of Fatal Accident Reporting System (FARS) data, the following has been quoted recently by media outlets from coast to coast; “According to a CDC analysis of fatal crash data from 2008 to 2010, a total of 14,283 motorcyclists were killed in crashes, among whom 6,057 (42 percent) were not wearing a helmet. In the 20 states with a universal helmet law, 739 (12 percent) fatally injured motorcyclists were not wearing a helmet, compared with 4,814 motorcyclists (64 percent) in the 27 states with partial helmet laws and 504 (79 percent) motorcyclists in the three states without a helmet law.”

The National Coalition of Motorcyclists (NCOM) looked over the CDC’s own numbers and found some serious faults in their findings:First off, if 6,057 motorcyclists were not wearing helmets of the 14,283 motorcyclists who were killed in crashes during the 3-year study period, that means that 8,226 riders (58%) WERE wearing helmets when they died, meaning that the vast majority of motorcyclist fatalities nationwide wore helmets!

Using the CDC’s twisted logic, nearly half of all motorcyclists killed were in the 20 states that required them to wear a helmet!

If the agency’s numbers are to be believed, between 64-78% of riders in the 30 partial and no-helmet law states legally chose to ride without a helmet, yet only 38% of the fatalities involved non-helmeted riders, so helmet use is astonishingly over-represented in motorcyclists’ mortality statistics!

But the CDC also touts that 12% of the biker deaths in helmet law states were not wearing a helmet. The most amazing thing about this figure is that helmet use rates approach 100% in helmet law states and virtually no one rides without one at the risk of facing hefty fines! What the government’s numbers most likely reveal, if they have any legitimacy at all, is that helmets come off in about one in ten fatal accidents. This revelation is consistent with prior estimates, and seriously skews their other helmet use/nonuse data, because it would mean considerably more riders were wearing helmets up to the moment of their demise than previously anticipated, which means all the Center’s fiscal extrapolations are meaningless as well. Another gem proffered by the CDC to bolster their helmet law push is that while motorcycles represent only 3% of registered vehicles they represent nearly 14% of traffic fatalities. But when you consider that motorcycles offer little in the way of physical protection during a

collision, unlike cars with airbags, crumple zones and impact-absorbing structures, it’s easy to understand why motorcyclists seldom have fenderbenders…yet auto drivers routinely walk away from high-speed impacts.

The true numbers are pretty clear; a previous DOT Traffic Safety Facts Research Note states in 2010 that 54% of all U.S. motorcyclists were observed wearing a helmet when they rode, whether by choice or by law, and since the CDC says 58% of fatally injured riders wore a helmet at that time, then helmets obviously are not designed to protect against fatal injuries. MOTORCYCLIST FATALITIES REMAIN STEADY

U.S. motorcyclist fatalities have remained roughly the same over the past three years, following a sharp decline in 2009, according to preliminary data recently released by the Governors Highway Safety Association.

In a May 21 report, the GHSA projects the final tally for 2011 will be very close to the 4,502 fatalities reported for 2010 and the 4,469 deaths in 2009, which represented a dramatic 16% decline from 2008.

Earlier, the National Highway Traffic Safety Administration projected that overall motor vehicle fatalities declined 1.7% in 2011, reaching their lowest level since 1949, but the GHSA says high gas prices are driving more people to ride motorcycles. Motorcycle deaths increased in 26 states for the first nine months of last year, declined in 23 states, and remained unchanged in one. “States with fewer motorcyclist fatalities attributed the decrease to poor cycling weather, reduced motorcycle registrations and motorcycle travel, increased law enforcement, rider training, and motorcycle safety education," according to the GHSA report. "States with more fatalities cited good cycling weather, increased motorcycle registrations and travel, and a return to normal levels after an abnormally low fatality count in 2010." FEDERAL LAWMAKERS SEEK TO BAN MOTORCYCLE-ONLY CHECKPOINTS

Federal lawmakers have sent a bipartisan letter to the leadership of a key HouseSenate conference committee to urge support for legislation that prohibits federal funding for motorcycle-only checkpoints. Reps Jim Sensenbrenner (R-WI) and Tom Petri (R-WI) were joined by 29 congressional colleagues who sent the letter on May 25 urging the panel to include H.R. 904 and H.Res. 239 in the surface transportation reauthorization conference report.

H.R. 904 would prohibit the U.S. Transportation Secretary from providing grants or any funds to a state or local government to be used for programs to check helmet usage or to create motorcycle-only checkpoints. H.Res. 239 would support efforts to retain a ban on the National Highway Traffic Safety Administration’s (NHTSA’s) ability to lobby state legislators using federal tax dollars and urges

PAGE 3 the agency to focus on motorcycle crash prevention and rider education and training. “There is broad bipartisan support on Capitol Hill, and among motorcycle groups across the country, for efforts by Congress to prohibit the U.S. Department of Transportation (DOT) from funding motorcycle-only-checkpoints (MOCs),” the letter states, further noting that “We take motorcycle safety seriously and want NHTSA to focus its safety efforts on proven lifesaving methods.”

CONGRESSIONAL RECORD RECOGNIZES VIABILITY OF MOTORCYCLES

Congressional Motorcycle Safety Caucus Member and House Highways and Transit Subcommittee Chairman John Duncan (R-TN) entered a statement to the Congressional Record on May 18 recognizing motorcycles and scooters as viable transportation options for many Americans. Previously, President Obama had proclaimed May 15 through May 21 as National Transportation Week and acknowledged that America needs a safer transportation network that will provide more transportation choices. “As a Member of the Congressional Motorcycle Safety Caucus, I would like to highlight one such choice and point out that two wheeled vehicles can be transportation options for many Americans,” said Chairman Duncan. “In his proclamation, the President called for increased transportation options that cut commuting time, ease traffic congestion, reduce oil consumption and lower greenhouse gas emissions. Motorcycles and scooters are options that can help to meet all of these goals. Motorcycles and scooters also have the advantages of being much cheaper than cars or trucks as well as considerably easier to park – and a lot of fun to ride.” “I own a scooter myself and I enjoy riding when I get the opportunity,” said Duncan. “I encourage all riders to get trained, licensed and obey traffic laws, and I remind all road users to be aware of motorcyclists.” OUTDOOR RECREATION REPRESENTS MULTI-BILLION DOLLAR INDUSTRY

Americans spent over half a trillion dollars enjoying the great outdoors last year, according to a newly released joint study that documents the continued growth and significance of outdoor recreation to the economies of our individual states and the nation overall. The Motorcycle Industry Council, along with the Recreational Off-Highway Vehicle Association and Specialty Vehicle Institute of America, collaborated with the Western Governors’ Association and other outdoor industry groups to fund a report on the combined economic impact of motorized and nonmotorized outdoor recreation. The findings of this first-of-a kind study show the outdoor recreation industry generated $646 billion in national sales and services in 2011. We are working on a charity run up here, to help support Breast Cancer Awareness, will give you moredetails on it, but we are calling it SAVE THE TWINS MOUNTAIN STYLE ! Also our brothers and sisters in the M.M.A. up here in the rim country (which a lot of our members) are in both will be having the 2nd annual Camp and Jam at the Double D Saloon,in Tonto Village there will be free camping there, another true biker party! Howdy Gang!

Sorry about the last chapter report. I was down in Mexico diving and learning that my Spanish sucks!

Phx-Shadow Mountain has been hard at work all year long preparing for “Too Broke for Sturgis”. I know this will publish after it is over, so I hope that everyone had a great time. I was not at the last meeting due to Granny Nanny Issues, my husband filled in and his notes are to follow. Thank you Steve!

One item I would like to address is mailing notices for meeting reminders and such. I receive a lot of mailing bounces and I am concerned that maybe spam controls may be hindering our mail outs. Judge Clancy Jayne, a longtime member, attended and spoke of the Breakfast with the Judge event . He also informed us that littering is being targeted, including cigarette trash. Be sure your butt is off the ground when you’re ready to ride. Pam Costello spoke on how to protect against theft when selling your bike. Verifying identification, bill of sale test rides and not releasing the title until check is cleared where some of the highlights. In God we trust. All others cash only! Redbone was the winner if the 50/50 raffle and donated his winnings to ABATE. Way to go Redbone! Since this will not be published until

Southern Arizona Chapter

Our “Can You See Me Know?” poker run did make money, but with very few riders. Organizing a run takes a lot more effort, and event only made money due to the end location at the Red Garter where numerous people showed up for the raffle, 50/50 and socializing. Our last Pasta dinner made the same amount of money and was a single location event with far less effort and overhead. Moving forward for the time being Southern AZ Chapter has decided to go with the single location events, as the trend for the last few years have seen dwindling riders in fundraising rides. Partnering with a Bike night may be a good idea as discussed.

Jim DeYoung spoke about the dangers of Heat Stroke in AZ, the symptoms and handed out some flyers for reference. If you have had a heat stoke previously, you are now more susceptible. It is always a good idea to hydrate yourself before a ride, and stop more often than usual in the summer AZ heat. Cool vest and water retention neck wear are great new technologies to keep you body temperature low. Keeping yourself covered, especially your head, is a good idea to keep the direct sunlight off your skin. I know it sounds counter-intuitive, but adding clothing like long-sleeves and a bandana versus bare skin keeps the sun from directly heating your skin and actually keeps you cooler. If you stop sweating, feel nauseous, get a headache or feel dizzy, these are serious signs not to be ignored. Pay attention to your buddies, and if they slur their speech or seem incoherent and rambling, this may also be a symptom, unless you buddy is normally rambles and does not make a whole lot of sense anyway. Seriously, if you are thirsty, then you are showing signs of dehydration already.

At the Federal level, the highway bill has been approved by both houses with the Motorcycle Only Checkpoints in the bill, although House and Senate have their respective committees to reconcile the different versions. Good news is this has been the First time the bill has been approved by both Houses in awhile instead of temporary extensions, which mean it will be effective through 2014. The continues the grant program that was designed and implemented into law in 2005 by the Motorcycle Riders Foundation (MRF), along with many State Motorcycle Rights Organizations (SMROs.

Locally, the Tucson texting Ban went into effect April 1st, 2012 and is a primary offense. While, enforceability was discussed to be an exception while, “legally parked” the law is only enforceable while in motion. This means if you are stopped at light and not moving texting is allowed. The term “texting” in the law includes sending and reading texts, email, and Internet of a Mobile communication device, and is a $100.00 fine for a primary offense, and $250.00 if involved in an accident.

Dollar Jar was up to $172.00 and Warren Elliot’s member number was pulled. However he was not present, so the money rolls over to July. You can’t win if you do not attend. Don Boule won the 50/50, and we had a fire sale to clear out some merchandise and raise a few more bucks for the Chapter.

curse in AZ). Our July meeting had a lot of good information. 44Dan gave a how to avoid heat stroke talk when riding in the Arizona summer. Handy gave an interesting and disturbing PAC report with some help from Doc. It seems the Feds are trying to find still another way to limit the rights of bikers. The CDC is now getting in on the act in regards to the wearing of helmets nationwide. The CDC of course stands for “Center for Disease Control.” This implies that a biker without a lid is riding around spreading some sort of disease. I wonder what kind of disease it could be. Hmm, I know, “freedomitis!” The disease one gets when you are riding with the wind in your hair and bugs in your teeth. This is a very sad state of affairs, and I think I smell what the Feds are cooking. It smells of another consequence of the Orwellian implementation of Obamacare. If this latest freedom grab is not enough to wake up those who have not joined the MRF, we are truly doomed. On a lighter note, our chapter is already

making plans and forming a committee for the 2013 “Run to the Hills” event. Our goal is to make the event better for all as we have listened to the suggestions of our members and 2012 attendees. We would like to encourage all bikers to support the M.S. Run that is being run by the Journeymen M/C, and the Desert Eagles M/C on September 2nd. Last year's ride was great, so come out a support a great cause. There will be more details in August. ABATE Of Arizona, Inc. is a non-profit motorcycle rights organization that is dedicated to freedom of the road for all motorcyclists.

ABATE is a volunteer organization that fights discriminatory legislation aimed towards the motorcycling community. ABATE's position is that all motorcycle riders have the right to choose not only the machine that they ride, but also the riding gear that they choose to wear or not to wear, (i.e. leathers, gloves, boots and helmets.) ABATE promotes rider education for all motorcycle riders and motorcycle awareness for all automobile drivers. ABATE needs the support of all motorcyclists.

DOC JONES LEADS THE INDIANAPOLIS 500!

Of course, he did this in a sidecar of an ‘84 shovel at the Miracle Ride. They were all there for Doc- his family, friends, and fellow members of the motorcycling community. I can’t tell you how important it was for Doc to make this ride. He did it for his kids and the kids at Riley Hospital. Many of us know how difficult this ride was for Doc as he has ALS, is on a breathing machine and is unable to walk. Marc Falsetti, the sage of Hoosier Motorcyclist, was there to memorialize the trip. With the help of Patsy Jones, his wonderful girls, Jay Jackson, Ed Schetter, and George Tinkham, Doc was strapped into the sidecar with Hooker Harnesses like a jet fighter pilot ace. As a steely, good hearted VietNam era Navy veteran, there was no way Doc wasn’t going to make this ride work. And work it did. But when you have ALS, a lot of your pride is left at the back of the bike.

Here is the deal we had with Doc. If the ride was too much, he could bail at any time. He had not been on a bike since October and was failing. His wife Patsy would ride behind me and monitor his oxygen machine, manage his mask and help with his head position. I was nervous, actually more than nervous. I knew what his doctors would say about me doing this. I tried not to care about what they or anyone else thought. Doc wanted to do this one way or the other, and we were going to do whatever we had to do to get this done. I couldn’t wait to do this ride, but I couldn’t wait for it to be safely over. Being happy and miserable all at the same time is intense.

on Doc like drones. It was a time that stopped for me; everything was in slow motion and the noise of the crowd was muted and dream-like. Oddly, it seemed like none of the rest of us were there and it was just Doc and the kids, and that was okay. Actually it was more than okay. Those kids saw another human being in trouble - just like them. And they waved and waved and waved, or at least those that could. Doc could not waive, but he looked and looked and looked, and smiled, mostly at those who could not waive. It was emotional for those of us who were lucky enough to notice. Even with his condition, for that one special moment, I envied Doc. They say that when we pass into the hereinafter we all will have a list of special times that flash before our eyes. I am sure that moment will be one of ours.

lead the first lap of 8000 bikers around the track for Riley. It was like the Red Sea story as they parted for Doc. And lead he did. We cranked that sidecar car thru the back stretch; blasted by the third turn and were pressuring that sidecar as hard as we could to hit the historic fourth turn and as fast as the cops would allow. But, Doc was up for faster. Heading to the start finish line, I saw Doc do a weak fist pump and that slight veterinarian “you are ok smile” that I am sure he has given to a lot of his patients. Whatever mother nature has dealt him, for this time and moment, Doc was winning. Patsy was monitoring his oxygen machine and fussing with his head position. But Doc did not care. He was riding and riding for the kids at Riley. After leaving the track, Doc had the chance to go back to the comfort of his wheelchair. TOWNS PASSING HELMET LAWS IN STATES THAT ARE HELMET FREE

Q. A member of ABATE was riding through Portage and was stopped by a cop for not having a helmet. When the biker produced his motorcycle endorsement, the police officer advised that the endorsement was invalid in Portage because the city had an ordinance requiring a helmet. How can this be when Indiana is a helmet free state? ABATE of Indiana member. A. The officer is wrong. It only makes sense that we have uniform laws throughout the states. To hold otherwise would be to require bikers in helmet free states to map a path of travel in order to avoid helmet requiring towns. Those cities and towns are not being practical, or good citizens. They may mean well, but they are off the rail. Recall that Myrtle Beach in South Carolina tried to pull that one a few years back. The Supreme Court of that state slapped Myrtle Beach and held the ordinance unconstitutional. Likewise in Cleveland, where the city passed a stronger law on gun possession than the state required. The Ohio Supreme Court ruled “no way” on the more restrictive ordinance, and held Cleveland’s ordinance unconstitutional by saying that in areas where the state has laws, cities and towns need to back off where the state has already decided to regulate. One way to cure aggressive tactics of wayward cities and towns that violate our rights by stopping us based on bogus laws, is to require those towns to pay damages to the biker for the unconstitutional stop. If they can fine us, we should be able to fine them. PROGRESSIVE INSURANCE COMPANY DENIES PAYMENT TO BIKER FOR LOSS OF USE OF MOTORCYCLE ARE THEY TAKING ADVANTAGE OF BIKERS?

Q. Rod: A fellow motorcyclist that was not paying attention crashed into the rear of my brand new 2012 Street Glide that still had the paper tags on it. I am sick about it as I only had it for two weeks. The guy that hit me admits it was his fault and Progressive, his insurance company, has accepted responsibility for the damage to my rear fender, but are not willing to pay for my loss of use of the bike. The dealership says that they can not get me a new fender for 6-8 weeks. It does not seem fair that Progressive can get off the hook by paying only for the fix of the fender. Don’t they owe me something for loss of use of my motorcycle? After all, it is riding season! That way I could rent another bike until my bike is repaired. Mark

A. Hold your ground; they owe you. Progressive Insurance Company touts itself as user-friendly for motorcyclists, so I am sure they are not trying to pull a fast one - at least you should give them the benefit of the doubt on that one for the time being until we give them a chance to overrule the adjuster handling your claim.

You have a duty to lessen your damages, but you also have a right to be put in the position you were in prior to the crash. Just because an insurance company says they don’t do something doesn’t make it so. Most states in the midwest, including Illinois, Indiana and Ohio allow loss of use damages which is payment for loss of use of your motorcycle. This loss is measured by the reasonable rental value of your motorcycle and will vary depending on the value of the vehicle/motorcycle involved. In most states, it does not even matter if you rented a replacement vehicle, you still get the value of your loss of use. Indiana and Illinois courts have said that to decide otherwise would be to favor those who could afford to rent a replacement vehicle over those who could not. Those that can’t afford to rent a replacement vehicle still have a loss of use which can be measured by the loss of the reasonable rental value. Despite the law, some insurance companies still try to take advantage of motorcyclists by saying you can still drive your car/truck so you don’t have a loss. This is false. Surely a company like Progressive, which seeks motorcyclists’ business would not take this approach. Share this article with the Progressive adjuster and I will send Progressive correspondence bringing this to their attention.

Send the adjuster the communication that you received from the Harley dealer that is doing the repair confirming the 68 weeks delay in getting the parts for repair. Then get a figure from Harley as the to reasonable rental value for a motorcycle comparable to yours. Armed with this information, you should “educate” the Progressive agent as to the facts and the law. If he balks have him call me. I promise you that they will pay for your loss of use. Center for Disease Control Considers Helmetless Motorcyclists an Epidemic

Editor’s Note: Well folks, you had to know that it was gonna happen. The safety nanny bureaucrats are once again leaning toward a national helmet mandate and this is just the beginning.

First they tried to do it through the National Transportation Safety Board (NTSB), but we pointed out that they were basing their findings on studies on a mere SIX motorcycle accidents. They are, without a doubt, the experts when it comes to most air and ground transportation - but their ignorance was showing when it came to motorcycles. Since that end-around run failed, the CDC picked up the ball and has been running full speed toward the end zone. But, like nearly government agency that you coud name, they stepped on their shoestrings while performing an early celebration before crossing the line.

GW Peterson with ABATE of Virginia was searching for a breakdown of which part of the body was injured during motorcycle fatalities (percentage of head trauma vs. chest trauma vs. abdomen etc.) He could not find anything so he contacted our friends at the CDC. Below is the response from the Director of the Office of Statistics and Programming. I do not have to point out to this esteemed body the obvious question for which the response calls. Please read the response below:

Thanks for your inquiry. We do not have Motorcyclist injury deaths tabu-

lated by body region/part. With deaths, there are usually multiple injuries and the primary body part affected is often difficult to determine.

You might search the literature to see if anything is published by body region for motorcyclist deaths. I did a search using http://www.safetylit.org/ but did not see any articles surface on motorcyclist deaths by body part affected.

There are public use multiple-causeof-death files that are available upon request if you wanted to analyze those data. If you are interested in requesting those files, let me know and I will put you in contact with one of my colleagues at the National Center for Health Statistics.

I am also checking one other resource to see if she knows of any published articles on this topic. I will let you know what I find out. Sorry that I couldn't be of more help.

The quote from the NHTSA statistician, Umesh Shankar, was "yes, the numbers are inaccurate, but they are consistently inaccurate", or something very close to that. They admit that their data is flawed but they continue to preach it as gospel.

Believe it folks, there is a big push for a federal helmet mandate coming our way as sure as the monsoon rains in Arizona.

Membership in ABATE of Arizona is soon going to be a necessity if we are to have half of a chance in defeating such a mandate in Arizona. I urge all of our members to make the effort to recruit as many new members as possible in the coming months - like your freedom depended on it - BECAUSE IT DOES.

CALIFORNIA LAWMAKERS BAR MOTORCYCLE-ONLY CHECKPOINTS

On Friday, July 13, California became the fourth state in the country to oppose roadside checkpoints that target motorcyclists. Governor Jerry Brown signed Assembly Bill 1047 into law, joining with Virginia, North Carolina and New Hampshire in prohibiting law enforcement agencies from using safety grant money to fund motorcycle-only checkpoints.

“Persistence pays off!” said Jim Lombardo, lobbyist for ABATE of California. “It took two years of hard work to get our bill through both Transportation Committees, the Assembly and Senate Appropriations Committees, passed by both Houses and then returned to the Assembly for concurrence to a stronger amended bill!” AB 1047, sponsored by Assemblyman Kevin Jeffries (R-Lake Elsinore), passed its final legislative hurdle by a unanimous 77-0 vote in the Assembly. The new law becomes effective Jan. 1, 2013.

“The funding of such checkpoints has made the passage of AB 1047 of paramount importance,” noted a letter of support circulated to legislators by C.O.I.R. through the US Defenders program; calling the checkpoints discriminatory and un-American, they noted that “Across California, law enforcement agencies have been using these funds, not to establish generic checkpoints intended to stop all vehicles looking for impaired operators, or unsafe vehicles. Rather, these checkpoints have been stationed adjacent to motorcycle events and stop only motorcycle riders while automobile drivers are waved on.”

On the federal level, dozens of Congressional Representatives have signed onto House Resolution 904 by Rep. Jim Sensenbrenner (R-WI) to bar the U.S. Department of Transportation from providing funds to government agencies for motorcycle safety-equipment roadside checkpoints. Meanwhile, Aid to Injured Motorcyclists (A.I.M.) Attorney Mitchell Proner of NYC is appealing a federal judge’s ruling

First and foremost, find out who your representatives are you can do that by going to az.gov and on their homepage under Elected Officials there will be a tag that Govt. information locator. Click on that and type in your address and zip code. It will give you all of your local and national reps. No Actually the first thing you should do is make sure you are registered to vote! Then the second thing would to find out who your legislators are. When we get the new district maps, we will get a copy out to all of the chapters. The districts have just been redrawn and new maps will be out shortly.

Ok, so having done all that. When Day at the Dome comes around we will be asking everybody to make appointments with their representatives. Just call the number that is given from the contact info that you can find in this paper, and make an appointment. So far, so good. Now the hard part. You have to do some studying to learn all you can about what you want to talk about. Learn the subject forward and backwards. Then Practice with a friend. This year we will get talking points out early and will put out the background useful facts before the run.

Remember always be respectful and polite. Always use facts and be truthful. Don’t try to bullshit them. The old saying goes “you can’t Bull………………..” OOPS! I had better not say that. CONGRESS PASSES FEDERAL HIGHWAY BILL

The Highway Bill, HR 4348: MAP-21, has cleared both chambers of Congress and is expected to be signed into law soon by President Obama. The 600-page $120 billion federal funding measure reauthorizes funds for transportation projects through 2014, and extends the motorcycle safety grant program to the states amounting to a percentage of each state's federal safety dollars that must be spent on rider education and awareness campaigns.

Despite considerable lobbying by motorcyclists, language from HR 904 to block funding of motorcycle-only checkpoints was not included in the final passage due to technical germaneness issues, but on the flipside no provisions were adopted in the bill that would negatively impact motorcycling. EPA OFFICIALLY APPROVES E15 FOR SALE IN THE U.S.

Putting E15 (a mixture of 15% ethanol and 85% gasoline) on sale in the U.S. has been all but official since April, when the Environmental Protection Agency approved the first applications to make E15. Now, “all but official” has become official, with the EPA giving approval for retailers to start selling the controversial biofuel, which many claim can damage smaller engines such as motorcycles and ATVs and void manufacturers’ warranties.

NEVADA MOTORCYCLE CLUBS SUE POLICE FOR CIVIL RIGHTS ABUSES

Four motorcycle clubs that belong to the Southern Nevada Confederation of Clubs (COC) have filed a federal lawsuit against the Metro and North Las Vegas police departments claiming that their civil rights have been systematically violated.

Dozens of club members of the Mongols, Bandidos, Vagos and Stray Cats allege they have been “unlawfully targeted and harassed” by the two police departments for several years, and the 78 complainants are seeking over $75,000 on each of its 15 different claims and puni-

tive and exemplary damages of more than $75,000.

The lawsuit claims that Las Vegas police threatened to revoke the liquor licenses of local businesses if they served certain motorcycle club members or let them frequent their place of business. The legal action cites numerous other incidents of abuse, including police officers purportedly informing members of the Stray Cats that they had “no constitutional rights on the streets of Northern Las Vegas.” Legal documents detail six encounters that occurred between June 2010 and September 2011 that violated the patch holders’ First, Fourth and 14th Amendment rights, but attorney Stephen Stubbs and Southern Nevada Confederation of Clubs President Guido Novicelli say the harassment has gone on for more than the two years the lawsuit covers. "All we're really looking for is to be able to meet and have a good time and ride motorcycles without being harassed," said Novicelli. "Everybody has the same constitutional rights," said Stubbs, serving as legal counsel for the 37 Las Vegas-based clubs that comprise the Southern Nevada COC. "The minute we start disregarding someone's constitutional rights because we don't agree with them, this country is in big trouble." NY BILL WOULD REQUIRE MOTORCYCLE SAFETY EDUCATION FOR NEW DRIVERS

A New York bill that would improve motorcycle safety by including awareness training in the state Department of Motor Vehicles required courses passed unanimously in the Senate on June 4.

S.7138 would amend the Vehicle and Traffic Law to create a two-hour motorcycle safety and awareness component to the DMV’s mandatory five-hour prelicensing course for new drivers. Specific requirements would be set by the Commissioner of Motor Vehicles.

“This is just one more step towards making our highways safer for both motorcyclists and those traveling on four wheels,” said state Senator Patricia A. Ritchie (RHeuvelton) who cosponsored the bipartisan measure along with Sen. Kevin Parker (D-Brooklyn). “By teaching people how to properly share the road, we can cut down on accidents and help save lives.”

RHODE ISLAND RIDERS GET DESIGNATED PARKING A new Rhode Island law will require all state and municipal buildings to provide designated parking spaces for motorcycles from April to November. The legislation, sponsored by Senator John J. Tassoni Jr. (D-Smithfield) and State Representative Peter John Petrarca (DLinclon), was recently approved by the General Assembly and signed into law by Governor Lincoln D. Chafee (I). The legislation dictates that city and town officials create parking plans by this November for parking areas at municipal buildings and mandates that the new parking spaces, marked by appropriate signage, be made available by April 1, 2013. All state, city, or town buildings must establish a motorcycle parking plan by November, with the number and placement of the motorcycle parking spaces varying by building, and to be determined by the number of employees who use motorcycles. The law does not apply to state airport parking lots. NOVELTY HELMETS OUTLAWED IN CANADA

A new provincial law announced by the Ministry of Justice requires motorcyclists in British Columbia to wear helmets that show proper industry certification, such as Snell or a U.S. Dept. of Transportation sticker.

The law takes effect in July on Canada Day, and until now motorcyclists could wear anything that was sold as a motorcycle helmet, including so-called “novelty” models that are smaller, lighter and lack protective inner padding. “Many members of biker gangs and their followers wore such helmets,” noted the Maple Ridge News in announcing the policy change.

“A lot of the Hells Angels guys…they will wear the fake helmets, as well,” RCMP Constable Tom Sparks told the newspaper. Once the helmet law is enforced, $138 tickets will be handed out. In addition to a ticket, riders also will be required to park their bike if they’re caught using an illegal helmet. “You can-

It’s August which means that Too Broke has come and gone. I hope this will be a banner year for the event and we all had a great time in the cool pines of Mormon Lake. I also hope that we all got home safely and are busy telling everyone who didn’t go what a great time we had.

In July a friend of ours went down on his bike. It was a one vehicle crash, no road hazards, no distracted drivers, no driver impairment. It just happened. The thing that struck me was the after care. The Police and EMS arrived quickly. Our friend was able to communicate, but he had lots of road rash. He was wearing a helmet. Here’s where it gets interesting….The helmet had road rash. That tells me and should have alerted the Police and EMS that he BUMPED his head! drove him home. He went to an urgent care for deep cleaning of his wounds. After his wounds were cleaned he went home. There were no x-rays done of any part of him. No discussion of a possible head injury was had. In the early hours of the next morning, he awake with a vague feeling of something wrong in his shoulder. A few hours later, he had the same strange feeling in his shoulder, only this time it stayed longer. So, he thought maybe I’m having a heart attack and took himself to the ER to get his heart checked. He told his story of the motorcycle crash less than 48 hours earlier. The ER staff thought it would be good to check for broken bones, because by now some very colorful bruises were appearing all over, and he had what looked like a third cheek on his butt. But, still no examination of his head at all. They had decided to discharge him because the xrays showed no broken bones. As he was getting ready to leave, he had a seizure. Now! they decided to look at his BUMPED head. He suffered a bleed into his brain. WOW! It took 48 hours to even look for a head injury on a person who had a crash and road rash on his helmet. Our friend is doing well and now recovering at home.

One message of this story is for the person who crashes….Please go to the hospital and get examined. It may take awhile, but injuries do not always make themselves know right away. Realize that you may not be thinking clearly at

Call for MAP Instructors

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us.

To become an instructor you must:

1. Be available during the day: The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in

the material presented.

4. Commit to teaching at least 2 classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.

5. Provide record of teaching to the M.A.P. Coordinator on a consistent basis.

The other message is for those who respond to the crash…..Even if the person who went down says no thank you, please strongly encourage him/her to go get checked out, including the head. Head injuries are hard to see when they are on the inside. Time is very important. The brain can swell and in a short time cause permanent damage and even death. The helmet was the clue to how extensive our friend’s injuries were and no one took notice for about 48 hours, even though there were multiple contacts with medical personnel. We’ll never know if the bleed in our friend’s brain caused him to go down or was the result of the crash. Thank our lucky stars he is here to tell us about it.

Sorry, this was a sad discussion. On a positive note, more and more us are safety conscious and aware. We take responsibility to keep our riding skills up to the best or our ability and we keep our

PAGE 15 machines in their best running condition. We minimize our risks every time we go out by practicing defensive riding. Sometimes crashes just happen.

Okay, now I thought of something else regarding safety. We receive at least 5 different motorcycle magazines every month. One of those is AMA’s American Motorcyclist. In the August issue is a list of 50 Things New Riders should know (And Experienced Riders Shouldn’t Forget). Number 50 is: Don’t Ride Alone. I really like to get on the bike and just head in a direction all by myself. Is that such a smart idea, especially at my age? The AMA article suggests that motorcycling is a social activity and best enjoyed with others. That’s true, but….. However, the point is riding with other responsible, experienced riders can make you safer and can help to improve your riding skill and technique. Get out and enjoy the open road with friends. Recently the Centers for Disease Control (CDC) presented a study on motorcycle safety. Specifically the CDC National Center for Injury Prevention and Control, Division of Unintentional Injury Prevention.

The study is nothing new, in fact it is a collection of conclusions drawn from past studies and old statistics, some of the CDC's conclusions even seem to be drawn from thin air.

CDC uses the same tired worn out examples we have seen again and again. They cite the Florida study that said fatalities increased 63.4% from 2000-2009. Which is true, but like every other instance of using this statistic they fail to mention that motorcycle registrations increased over 100% during the same time frame.

The study goes on to uses imaginary numbers to back up their position that motorcycle helmets save money. They claim that in 2008, the United States saved $3 billion because of helmet use and then claim that the US could have saved an additional $1.8 billion if mandatory helmet laws were on the books. They provide absolutely zero evidence of this supposed financial burden.

The CDC makes no mention of rider education. We know rider education to be the best way to prevent crashes. Take New Hampshire for example, according to Robert LeTourneau, New Hampshire State Official Motorcycle Education Specialist, they have had 15 fatal motorcycle accidents of riders who took the class since 1990. Thats out of over 44,000 students trained in the same time period and .034% of fatal motorcycle accidents. All with no mandatory helmet law.

So we have more than doubled the motorcycle population and we have actually reduced fatalities. The study also contends that states without helmet laws have higher insurance costs. According to Insure.com, that's not true. Out of the top five most expensive states to buy insurance, only one allows for helmet free riding.

The supposed findings of this study are likely to show up in your local media. Do not let them get away with this.

The Wisconsin Department of Transportation and its Motorcycle Safety Program continue to blindly cite the same old statistics put out by the National Highway Traffic Safety Administration (NHTSA) regarding motorcycle fatalities. They continue to push motorcycle helmets along with bright clothing and the like as some type of "silver bullet" to solve the motorcycle fatality problem even though they are unable to produce any hard evidence that those practices create any measurable difference. If the Wisconsin DOT and its Motorcycle Safety Program were really serious about saving lives, wouldn't you think that they would take a page from programs that are

Highway Bill Nears Completion

The Motorcycle Riders Foundation reports that an agreement has been reached on the much anticipated Highway

legislation. The Conference Report has been agreed upon and is expected to be on the floor of the House and Senate for a vote Friday, June 29th.

As reported by the Motorcycle Riders Foundation in a previous release, the US Congress has passed the much anticipated highway funding legislation.

The 600 page bill comes just in the nick of time, as the latest extension expires at the end of the month.

President Obama is expected to grant the measure swift passage into law.

The reauthorization of surface transportation programs through fiscal 2014 is expected to cost roughly $120 billion, $11 billion more than the $109 billion Senatepassed legislation that would have run only until the end of fiscal 2013.

Unfortunately, due to technical germaneness issues, the language of NR 904 did not make it into this bill. Not for lack of effort on our part, that is for sure. We will continue to advance HR 904 on its own. It already has 51 cosponsors as of press time.

What did make it into the bill is very positive for motorcyclists. First, the bill has no mention of the word "helmet", whatsoever.

Second, the grant program that sends money to the States for motorcycle safety has been extended. This time it is not a specific dollar amount but a percentage of each State's federal safety dollars that must be spent on motorcycle safety. The best part is that the money can only be spent on rider education and awareness campaigns. None of this money can be spent on roadside checkpoints or helmet law campaigns - just simple education and awareness. The stuff we know that works. The House and Senate are likely to vote on this bill as early as Friday, June 29th.

The state of Florida has made a concerted effort to lower the motorcycle fatalities in its state by launching a massive billboard campaign, state-wide distribution of public service announcements on radio and television as well as creating a massive "Share The Road" program to educate young automobile drivers. Florida's Motorcycle Safety Coalition also ramps up their activity during the busier months of the year. So what have been the results? Florida has dropped their fatalities by over 200 per year using this approach and continues to improve! Now those are real numbers you can get excit-

ed about! This is exactly what ABATE of Wisconsin has been doing for years and all with donated dollars.

So, how does the state of Wisconsin stack up? As far as a billboard campaign, the state of Wisconsin Motorcycle Safety Program has created no motorcycle awareness billboards while ABATE of Wisconsin has put up over 150 to date. In the public service announcement arena, the state of Wisconsin Motorcycle Safety Program has created none while ABATE of Wisconsin has PSA's playing in all major markets in the state on radio and television. ABATE of Wisconsin is very proud of its "Share The Road" program where it has educated over 45,000 drivers education students about motorcycle awareness while the state of Wisconsin Motorcycle Safety Program has done nothing. The bill soared through both chambers this afternoon. Both chambers did have some nay votes, all coming from Republicans because of a few riders that were attached concerning student loan rates and the national flood insurance program.

The Highway Bill has been in the past, a vehicle for pro and anti-motorcycle issues. The Motorcycle Riders Foundation has worked closely with the primary authors of the legislation to ensure that this bill was all pro-motorcycle and had no anti-motorcycling issues.

The bill continues the grant program that was designed and implemented into law in 2005 by the Motorcycle Riders Foundation (MRF), along with many State Motorcycle Rights Organizations (SMROs). Since 2005, the program has infused over $46 million dollars directly into the motorcycle safety community. By law, the cash can only be used on rider education and motorist awareness campaigns. The new program continues this tradition.

Historically, the bill has been used to implement nationwide mandatory helmet laws. Due to the hard work of the citizen lobbyist motorcyclists of this country, that's not the case this time. Such good work in fact that there was never any official talk of attaching a helmet law on this bill. The last time Congress passed a highway bill, Sen. Lautenberg (D-NJ) offered an amendment on the floor of the Senate, just prior to passage. That amendment was defeated 68-29. The MRF would like to thank everyone who has helped work on this legislation by coming to DC, making calls, and visiting with their Members of Congress. The reauthorization of the Highway Bill goes through 2014 and is expected to cost roughly $120 billion dollars. The measure would cost riders over 1.2 Billion Euros extra per year, with no clear benefits for anyone, says FEMA in criticizing the proposal as unnecessary and ineffective and calls for its withdrawal.

"This is nothing less than a tax on poverty for those who cannot afford a new vehicle every three years" says FEMA General Secretary Aline Delhaye. "In terms of time and money, the cost for citizens is going to be astronomical, with no benefits in return.”

New Mexico is one of 31 states that do not require adults to wear helmets, and that’s not likely to change says KRQENews13, noting that “Motorcycle rider rights organizations are working diligently to keep it that way not because they don’t want people to wear helmets but

“Too many people are dying on our roads and all I’m asking is for people to look out for motorcyclists,” said Annette Torrez, Chair of the NM Motorcycle Riders Rights Organization. “I don’t want legislation telling me whether I should or shouldn’t wear a helmet,” said Torrez, who was recently recognized for her efforts at the annual NCOM Convention with a Silver Spoke Award.

It’s been about a decade since an adult helmet law was last introduced in the state legislature, and lawmakers told the news agency that is because the idea is always met with angry opposition not only from motorcycle groups but other lawmakers too. “There’s always individuals that you’re seeing here that come up to Santa Fe and institute their rights and say you know what, we really don’t want to see it and these are individuals who wear helmets on a regular basis,” said NM State Representative Rick Miera (DBernalillo County), a longtime rider and member of the National Coalition of Motorcyclists’ Legislative Task Force (NCOM-LTF). AUSTRALIAN MOTORCYCLE SALES INCREASE IN THE FIRST HALF OF 2012--Motorcycle sales in Australia increased in the first half of 2012, according to figures releases today by the Federal Chamber of Automotive Industries (FCAI). In the six months to the end of June,

51,952 motorcycles were delivered to Australian customers, representing an increase of 1,331 units (or 2.6 per cent) over the same period in 2011.

Sales growth was mostly driven by the road bike segment, which increased 8.4 per cent (1,567 units) to 20,174 and the All-terrain Vehicle (ATV) segment, which increased by 3.4 per cent (357 units) to 10,951 compared with the first six months of 2011. Scooter sales saw a big drop to 5,233 units, being 13.6 per cent or 832 less scooters sold year to date compared with last year.

The off-road segment accounted for 15,594 sales (to the end of June) for a 30 per cent market share.

The road bike segment remains the single largest by market share, with halfyear sales representing 39% of all motorcycles sold. ATV deliveries represented 21 per cent of the market, while scooters’ share decreased to 10 per cent.

Honda was the number one brand, delivering 11,788 motorcycles to the end of June. Yamaha was in second position to the end of June with 8,692 sales, followed by Suzuki (6,105), Kawasaki (4,612) and Harley-Davidson (3,643).

CONSTITUTIONAL RIGHT TO DO BURNOUTS

When officials cracked down on motorcyclists doing burnouts at this year’s annual Myrtle Beach Spring Rally, a local biker bar made a federal case out of it, literally. Now it will be up to a judge to decide if doing burnouts - revving a motorcycle’s engine while applying the front brake to let its back tire spin to create noise and smoke - is a constitutionally-protected right.

Horry County cracked down on burnouts during bike festivals last year, issuing a special event permit to Suck Bang Blow that limited the activity to between noon and 9 p.m. and only at the rear of the bar’s building. This year, the county issued a permit that banned burnouts altogether. SBB, which claims the activity has been a regular feature of bike rally events at the bar since it opened in 1996, obtained a temporary restraining order against the county just before the May rally, allowing the burnouts to continue at least for now. In a lawsuit filed in state court, SBB claims that burnouts are among several activities patrons participate in while “expressing their manliness and macho, as all males are prone and inclined to do to a greater or lesser degree.” The bar says burnouts are “expressive performances to the public” and is protected by

the First Amendment.

Horry County, in its response to the lawsuit, calls burnouts a “public nuisance” and says it “is expressly authorized by state statute to abate public nuisances.” The county denies that it has violated any Constitutional rights, but since the lawsuit deals with federal rights it should be heard in federal court. A decision could come just in time for next year’s rally, with a jury trial scheduled to begin on May 6, 2013. QUOTABLE QUOTE: Wisconsin’s embattled Governor Scott Walker, following his strong win in the state’s recent recall election, sees support from Wisconsinites not just a ticket to govern, but also a ticket to ride; “I'm gonna go ride my Harley all around the state of Wisconsin. INDIAN MOTORCYCLE WELCOMES MIKE WOLFE OF “AMERICAN PICKERS”-- Indian Motorcycle is proud to team up with Mike Wolfe, creator and host of “American Pickers” on HISTORY. Wolfe has been picking, or finding antique gems in unique places, since the age of 5; and he has a passion for Indian Motorcycles. His self-proclaimed “best pick ever”, a barn full of classic Indians, fueled his desire to pursue the unique profession as a career.

“A few years back I was reading a motorcycle magazine. There was a classified ad that read ‘Buy-Sell-Trade Indian Motorcycles.’ I called the number. Dallas Deputy Arrests Motorcyclist After Pulling Him Over for Video Head Cam In an incident ripe for a hefty lawsuit, a Dallas County sheriff’s deputy arrested a motorcyclist after pulling him over for wearing a video head-cam, then demanding the footage as evidence against other bikers.

Dallas Deputy Sheriff James Westbrook ended up turning the video over to the department's gang unit, even though there is nothing in the video indicating Chris Moore was affiliated with a gang. The incident took place on Memorial Day Weekend as Moore was riding with

Tucked away just off South Montezuma Street in Prescott is a little gem called Miller’s Upholstery. The easiest way to get there is to turn west onto Leroux Street from Montezuma and pull into the back side of the building…a little hard to find, but well worth it if quality is what you’re looking for.

Brett Miller, the owner and operator, originated in southern California where he owned and ran an upholstery shop for over 30 years. Brett is also a musician and was in a band called “Buddy Reed & Th' RIp It Up's” that played periodically in the Prescott area. Brett fell in love with our little community after being out here a few times, and decided to make the move, so about 4 years ago Miller’s upholstery relocated to Prescott. Brett has 36 years experience at his craft and will tell you, “If it rolls, floats, or flies, we upholster it.” The shop does custom work, and motorcycles are a specialty. a pack of at least 50 other bikers. Deputies were hoping to prevent a repeat of the previous Memorial Day Weekend when more than 100 bikers ended up shutting down the freeway.

So Westbrook singled out the one biker wearing a video head-cam – who also happened to be driving below the speed limit. Here is the exchange that took place

MOORE: "Was I doing something wrong? What am I being pulled over for?" WESTBROOK: "The whole group of you guys."

MOORE: "No. I was not, individually. How can you pull me over?"

WESTBROOK: "The reason you're being pulled over is because I'm gonna take your camera and we're gonna use it as evidence of the crimes that have been committed by other bikers." MOORE: "I have not committed any crimes, and you cannot take my personal property from me, sir."

WESTBOOK: "That's fine. Need to see your license and registration."

Westbrook then announced that he was arresting Moore for having an obstructed license plate, which usually amounts to a citation.

WESTBROOK: "You're under arrest for your license plate being obstructed. Place your hands."

MOORE: "Are you kidding me, dude?"

WESTBROOK: "Place your hands behind your back."

As Moore continued to protest, the deputy lost his patience.

MOORE: "Why'd you pull me over in the first place?" WESTBROOK: "Have a seat, okay?"

MOORE: "Sir. Sir. What you did to me was not right. You know it." WESTBROOK: "I'm going to ask you one more time to have a seat." MOORE: "That's f'ed up. Where's my bike going?" WESTBROOK: "Sit down.I'm telling you to chill out."

Dallas resident and PINAC reader Avi Adelman, who writes the Daily Crime Report and has had his own run-ins with deputies over video recording, sent this letter to Dallas County Sheriff Lupe Valdez, which is reprinted in its entirety below. Dear Sheriff Valdez

Last evening, I watched in absolute shock a News8 / WFAA story regarding a motorcyclist stopped by a Dallas Sheriff Officer during the Memorial Day stunt bike crackdown. I watched as Deputy Sheriff Chris Westbrook created a reason for stopping Mr. Chris Moore, created a false reason for arresting Mr. Moore, and then seized without a warrant (or valid reason) the video-

tape, claiming it was evidence for a crime that in fact had not occurred (stunt riding).

Then, to make things even more incredible, the tape was turned over to the County’s Gang Unit, when in fact this kind of behavior is not even remotely related to any kind of gang issue as prosecuted by the Dallas County Prosecutor’s office. The temperamental behavior of Officer Westbrook– argumentative, refusing to provide a clear reason for the stop and arrest, and the slamming of the DSO vehicle door after Mr. Moore was pushed into the car, clearly shows the officer has anger management issues. Sheriff Valdez, I am not a stranger to you, and you are quite familiar with my activities on Lowest Greenville. I too have encountered a number of your deputies behaving in ways that would make DSO Westbrook’s behavior seem mild . For example –

September 2009 - An off-duty DSO working at a gang-banger club (Encore) demanded that I stop videotaping his presence, claiming I did not have his permission. Sorry, I don’t need his permission to roll tape in a publicly visible area, and he should not be working off-duty at a gangbanger club. I do not remember the exact outcome of my complaint, but I do know he was not there the next weekend. http://www.barkingdogs.org/news/node/66 0 October 2010 – Two DSO officers were working off-duty at Lost Society just days after a club patron was murdered up the street on the Char Bar parking lot. My complaint resulted in an investigation, which revealed that the officers working off-duty and their supervisor (who parked a DSO vehicle in front of the club for nearly an hour) were not approved to work

off-duty, had lied about their activities and falsified their timecards. This incident eventually became part of a lawsuit filed by the bar owner against me, in which he claimed I interfered with a contract relationship with the officers. However, the officers were all given one-day suspensions and the bar owner is now a guest of your jail on charges of possessing nearly 14# of methamphetamine and filing false papers with the TABC (the lawsuit was dismissed in April). Sheriff Valdez, I believe your office has a responsibility to make things right, and make those things happen now. There is no reason in the world to continue the prosecution of Mr. Moore, and your office should make the request that the charges be dropped immediately. Additionally, DSO Westbrook should be investigated for filing a false arrest report and illegally seizing property (the videotape) for a crime that not only never happened, but was not related to the traffic stop.
