I’m back and with good news. As the bits and pieces of information trickle in about my position as your Lobbyist, things that need to be done get done.

I found out on 11/03/13 that I am responsible for setting up Motorcycle Day at the Dome. I called the other Lobbyists together so we would all be on the same page before involving any one else. Billy Larson and I went down to the capital to

On 11/13/13 I received confirmation of the date of the event. Now for the hard work. We would like to return this to the way it used to be done.

Oh yeah I also forgot, the date for Motorcycle day at the Dome is 3/12/14. There is a lot of work to be done between now and then and we will be needing volunteers. This event is a perfect opportunity to get in touch with your legislators.

Anyone who wishes to help please contact me, JohnnyD, SkyPilot, or Billy Larson. Your

help will be appreciated.

And as always remember document all encounters with law enforcement and report any and all incidents of profiling, and keep the shiny side up and the rubber side down. Hello to all my Brothers and Sisters;

Hoping everyone had a very Happy Thanksgiving! As most of you know this is my last President’s Report. The past 2 years have been both rewarding and sometimes challenging. I must say that it has been mostly a rewarding experience. I want to take this opportunity to thank all the Officers and Members of ABATE of Arizona for the support you have given me and our current and outgoing Officers. This organization would not exist without dedicated members and Officers fighting for all Motorcyclists’ Rights.

Thank You All!!! Welcome to all new and past State Officers for stepping up or continuing as leaders of ABATE of Arizona. Currently we have an issue that we all need to address, and that is a Federally Mandated Helmet Law. Whether you wear a helmet or choose not to wear a helmet is a matter of choice, that is what ABATE of Arizona wants to preserve for all motorcyclists. This is simply, FREEDOM OF CHOICE!

The Motorcycle Riders Foundation and the American Motorcycle Association has informed us that there is a push by the CDC, (Center for Disease Control) Task Force to mandate that all riders and passengers wear an approved helmet throughout the United States. Please call your Federal Representatives (2) and ask them to sign onto U.S. Representative Tom Petri, (R-WI) letter. Below is a complete explanation of the purposed legislation. The American Motorcyclist Association reports that a federal task force is

The Community Preventive Services Task Force, whose 15 members are appointed by the director of the Centers for Disease Control and Prevention, makes recommendations to the CDC and reports to the U.S. Congress about community preventive services, programs and policies to improve health. The task force will report that a universal helmet law would reduce injuries and deaths as well as result in economic benefits.

The CDC, which oversees the task force, is a federal agency under the Department of Health and Human Services and is headquartered in Atlanta. Its official mission is to protect America from health, safety and security threats, both foreign and in the United States. "Whether diseases start at home or abroad, are chronic or acute, curable or preventable, human error or deliberate attack, CDC fights disease and supports communities and citizens to do the same," the agency says on its website. This is an issue that we all need to get on board with and give our full attention too. Please call your Federal Representatives (2) and ask them to sign onto the Petri letter. Please remember that we can either get involved and take action now or yell about it later!!! By then, it will be too late.

TBFS Report: Time O’Rielly · Charity Stuart is chairperson of the TBFS Committee. · The event will be moved to the 3rd weekend in June 2014, June 19 – 22, 2014.

Old Business: · BOD vacancies were filled by Clyde Brooks, Phoenix-Shadow Mountain; Jack Batty, East Valley; Deb Butitta, Yavapai. · Policies & Procedures were updated and changed to reflect the decision to not list a specific date for the event. · Discussion regarding possible changes to reduce expense of Masterlink production. Expense of current publication and distribution of the Masterlink must be compared to proposed decreased production expenses before a decision can be made. Time will contact the publisher for information. The Masterlink is already available on the ABATE website. Discussion will continue at next meeting. New Business:

· The P&P will be updated to reflect that all Meeting Minutes are to have two officer signatures and the date to validate minutes. For example, BOD minutes require the Chairperson and Secretary signatures; State Officer Minutes require the President and Secretary signatures; chapter minutes require both Coordinator and Secretary signatures. This procedure will also conform to the banking industry federal guidelines, which with organization is expected to follow. · Kat Grover has stepped down as Authorized Lobbyist. She has advised the BOD that since her responsibilities with the ACMC and MRF have expanded, she must resign from her Authorized Lobbyist position. She was thanked for her efforts supporting ABATE and for her dedication to the motorcycling community. Critical Time Frames: · Chapter Officer elections take place in November. The Chapter Secretary is responsible to document the election results in November Chapter minutes and to submit the results to the State Secretary. The results should also be

YOU AND YOUR HARLEY GETTING HIT HEAD ON BY A VAN - HOW CAN THAT EVER BE A GOOD THING? HERE IS HOW THAT TURNED OUT FOR THE BEST FOR JEFF BRITTON.

In September, this year, Jeff was riding on a state highway - life was good. His Harley was sounding and looking wonderful. No particular place to go. Just putting along at the speed limit. Another biker he didn’t know was trailing him just like the MSF tells us to do for the sake of safety. Ahead of him was a car driven by a minor on a learner’s permit - his mother was in the passenger’s seat as the law requires. The young driver thought he saw a turn signal on the approaching van and started a left turn. Problem was the oncoming driver wasn’t turning left and wasn’t slowing. She was coming right at them. Instead of braking sufficiently, the oncoming van cut across the yellow line directly into the path of Jeff and the fellow rider. What happened next wasn’t pretty - an instant head on collision. Not even enough time to say your favorite word. And everyone was doing the speed limit. What is 2 x 40 or 50 mph? Both bikers were air-evaced to the hospital with severe injuries. It is never a fair fight between a van and 2 Harleys. During the course of Jeff’s treatment, diagnostic tests were done. And guess what? One of the scans revealed a cancer in one of his kidneys - a big mass, and tests showed it was malignant. Bad news on top of the broken bones etc. that he already sustained. Or was it? Had the cancer spread? Was it a death sentence? In the following days, the surgeons removed the kidney and determined that, while it was malignant, the cancer had not spread and he had just been shot at and missed. The Grim Reaper would have to wait for another day for Jeff. IT’S ALWAYS A GOOD IDEA TO CONSULT WITH ABATE LEGAL BEFORE ACCEPTING A CHECK FROM THE INSURANCE COMPANY

If you are injured in an accident or have had your bike or car trashed, you should consult with us before accepting a check from the insurance company. Our consult is free. If the offer from the insurance company is fair we will tell you so and send you on your way. Even if it is a bit short the offer may still put more money in your pocket after fees, expenses and time for litigation. With any settlement, all you should care about is how much money goes into your pocket.

On minor cases where the offer is close to fair, we advise our members to say the the following to the insurance company, “I would like to get this matter concluded but you are low on the offer so how about increasing your offer before we go to Rod Taylor and have him help us with this case?” That works a lot of the time when the insurance company is a little off the fair mark in its offer, and usually they will sweeten the offer to get the matter resolved quickly. And thereby cut out the middle man - us.

CDC TASK FORCE CALLS FOR HELMET LAWS A task force operating under the auspices of the Atlanta-based Centers for Disease Control (CDC) is recommending that all states have a mandatory helmet law in place to require motorcycle riders of all ages to wear a helmet.

Some insurance companies will try and get a check to you immediately, usually for less money, hoping that you will accept a lower amount right away. They know you have bills to pay and money may be short. The old “bird in hand approach.” They are trained to do that - not fair but that is the way it is. You should consult with us to evaluate whether the offer will be enough to cover your damages before accepting any checks.

Importantly you need to know the status of any liens held by your insurance company and medical providers for amounts paid/incurred because of your crash. And the V.A. and Medicaid Medicare issues are nightmarish. You definitely need us for those matters. Usually your health and auto insurers have language in your policy that requires you to pay them back for the amounts they have paid to you or on your behalf. The last situation you want to be in, is one where you accept a check from the insurance company only to find it does not cover your losses, leaving you stuck to pay the remaining bills and liens that should have been paid by the insurance company. And you don’t want all of the above lienholders knocking on your door trying to take away some of your settlement dough. Remember, once you accept a check and sign a release to settle your claims, that is it, there is no turning back. Short of being crazy, drunk, incapacitated, gun to your head or blackmailed when you sign the release and accept the check - you are stuck - almost no matter how unfair the settlement or how many liens you have to pay. So, call your lawyer or your ABATE Legal Services team and schedule a free consultation if you get the offer you think you can’t refuse. HE GOT AN OFFER HE COULDN’T REFUSE FROM THE INSURANCE COMPANY

A while back, an ABATE member was involved in a car/farm tractor crash. A young girl crashed into the back of his farm tractor knocking him off the tractor and puncturing a main tire. He was treated and released at the emergency room, incurring a bill for those services and a replacement tractor tire. A New York minute hadn’t passed before the friendly Farm Bureau Insurance adjuster was knocking on his door offering him money for his loses. (They are my insurance company and we have a love - hate relationship.) As he was a stand up American kind of guy had never sued or been sued in his life - he thought the offer was fair and accepted it and signed a release - only days after the crash. He thought he was ok physically, taking a “rub dirt on it approach.” When I talked to him, he had just returned from his neurosurgeon’s office. He needed back surgery, and probably would not be able to drive a farm tractor again. I told him to send me the document that he signed and was hoping it was a release for the damages to his tractor tire only. Some insurance com-

panies will try and be a good guy and settle the property damage separately from the bodily injury. Not in this case. The adjuster did a great job for his company (that is what he is supposed to do) in obtaining a total and complete release for all damages - including the bodily injury damages. Remember it is you versus them. They are not your friend. My heart sank when I reviewed the document . Yep - it was a document that fully released all of my client’s claims, and would be held against him no matter how unfair. I suppressed a desire to say, “why didn’t you call me and have me look at the release before you signed it?” Now, my only choice was to contact the insurance company and argue that the settlement was unfair - grovel in other words. And that is what I did.

Even though I knew and had gone to school with its general counsel and pulled out all the stops I could think of - no joy. Their lawyer and my old friend told me what I was hoping not to hear - “your client signed a full and complete release and we are holding him to it.” Damn. So I had the un-high honor of calling my client and saying what I have said too many times before, “short of being crazy, drunk, incapacitated, gun to his head when he signed, or otherwise blackmailed, he was screwed.” Moral of the story? Always call us or any lawyer worth half his salt when you get an offer that seems like you can’t refuse. It will save me from groveling to the insurance company and giving the gun to the head speech to you. HOW ABOUT THOSE BEARS? ILLINOIS/CHICAGO STOPS PROSECUTING CARRY LAWS - SO IT IS RIDE AND CARRY FOR NOW.

In People v. Aguilar, 2013 IL 112116, the Illinois Supreme Court unanimously struck down Section 24-1.6(a)(1), (a)(3)(A) of the aggravated unlawful use of weapons statute (that law prohibited gun possession outside the home) saying that the Second Amendment guarantees the right to keep and bear arms and as such rendered the unlawful use statute unconstitutional. Aguilar was so clear that the Cook County state’s attorney’s office started dropping previously filed charges and will stop filing charges in the future under this law. Now Indiana permit holders can ride thru Illinois with their “friend” - maybe. Call me if the boys in Southern Illinois did not get the message and want to charge you. HOW DO YOU GET TO CALIFORNIA ON YOUR MOTORCYCLE IF YOU WANT TO CARRY YOUR LITTLE FRIEND?

Everybody loves camping. But it is not fun if you run into a grizzly. And it becomes one of those SOL situations when you run into a grizzly/ or other while camping and you don’t have your friend. Here is a guide for all the states that recognize an Indiana gun permit so you can peacefully camp, ride and carry with your gun and avoid bears, bad guys and arresting officers. The MRF Farmer

The CDC, whose primary mission is to fight disease, issued a report last summer recommending that all 50 states enact universal helmet laws in response to a sharp increase in motorcyclist fatalities; but ignoring the fact that the number of motorcycles in use nationwide has increased substantially over the past

decade, and that costs associated with un-helmeted cyclists involved in fatal accidents represent a tiny fraction of overall U.S. healthcare expenditures.

In the meantime, U.S. Representative Tom Petri (R-WI) has authored a joint letter from members of Congress calling for the CDC to stop investigating motorcycling issues such as helmet laws, which they have no experience or expertise with, and “…to direct your attention and resources to areas that are not currently already being addressed elsewhere in the government.”

PAGE 3 Award Winner, Gary Sellers asked me some time ago to advise him on how to get to California from here and carry on his bike. Well, he can get to California, but only to the border and here is barely how.

First, there is no going straight west out of Indiana. Illinois (see above for the latest) will - or used to - nab you for carrying a gun with only a Indiana permit. Not sure S. Illinois got the Cook County memo. So, you gotta go around Illinois either north or south, through Michigan or Kentucky. If you go north through Michigan you’ll have to go up through the Upper Peninsula and then down through Wisconsin, or you could hop a ferry and head over to Milwaukee and then on to Iowa. From Iowa, you can go to South Dakota or Missouri. From South Dakota you can go to North Dakota, Montana, Wyoming, Idaho, Colorado, Utah, and Arizona. For folks that carry, Idaho, Utah, and Arizona have become your new western border, unless you want to take your chances in California, Nevada, Oregon, or Washington none of which will honor your Indiana or any other state permit to carry. If you want to take the long way east after Arizona you will have to go back through Utah and Colorado, because New Mexico doesn’t like your Indiana permit either. Heading back, south east from Colorado, you pretty much have your pick of states to choose from. I call this the slow, safe and scenic route. Below the Mason Dixon, you won’t run into any problems until you hit South Carolina. If you go around South Carolina and start heading north like you’re going to Maine, you are all clear until you hit West Virginia and Maryland. This is pretty much the end of the road unless you want to make a mad (illegal) dash through Maryland to Pennsylvania -- which recognizes your Indiana permit. But if you make it to Pennsylvania, good luck, because now you are surrounded by states that will bust you on all sides. And I thought we were the United States of America? Sure glad that some states don’t have special rules about Fords? Will the other “carry prohibiting” states follow the Illinois Supreme Court lead? Stay tuned.

East Valley Chapter

Our last chapter meeting was held on Sunday, October 26 at our usual place, F.O.E. #3468 Tri-city Mesa. We have been seeing some new faces, and we appreciate that. Jim Silk and Mary K described some of the seminars they went to during Meeting of the Minds Sept. 26-29 in Columbus, OH. One class taught us how to approach volunteers based on their character type, i.e.: Gilligands Island; Skipper, Gilligan, the Professor, Mary Ann, Ginger and The Howells. It taught to place volunteers where they’ll be happiest. Some volunteers are like the Howells, they just want to give money, they don’t want to ‘work’. Others are bossy, others don’t work well alone, and need direction, for some – it’s all about them (Ginger). They need attention. They become the 50/50 seller! We have to be careful of Gilligan-type people. They mean well, but need direction. If you are too critical towards them, they may leave and never return. Don’t be too hard on your volunteers. Recognition goes a long way. People join volunteer organizations for the personal reward and growth, as well as friendships and FUN!

We had another class about “What do you see when your driving?” It flashed a bunch of pictures you got to see for 1/10th of a second, then asked if you saw all of the important signs/obstacles. That was really hard. It teaches you to absorbed as much as fast as possible!

One of our enthusiastic chapter members, “Troll”, just moved to Fort Lauderdale, FLA to work at a Chester’s H-D location there. He left a big hole. He had stepped up to be Run Coordinator and Communications Officer, but those chapter positions are now open for 2014.

Redbone stepped down from his Board position for personal reasons. We want to thank him for his past dedicated service. He is one of our charter members, and we owe him a lot.

THANKS to Jack Batty for stepping up as Chapter Secretary for 2014 as well as our Board Representative for the remaining 14 month term.

Congratulations to Jim Silk for being appointed to the ABATE Safety Officer/MAP position. He does a fantastic job presenting MAP to our driver’s ed students. It definitely makes a difference in their awareness of motorcycles on the road. Keep up the great work Jim! Best regards brothers and sisters,

The US government decided to open again, so we had a lot to cover this month.

Vic spoke of the great time he and others had at the Marine anniversary. PAC let us know that there are 3 bills currently in the works: Motorcycle only stops, anti-profiling and handlebar height.

Ernie, our safety officer has confirmed the Phoenix Fire Department will be at our December 8th meeting, to give a demonstration of how a down biker is handled. The demonstration will be held at 11:00. The holidays are coming. Turkeys on bikes, Toys for Tots and don't forget, after the December chapter meeting, we will be heading to Christown Spectrum mall to sponsor Christmas Angels.

Southern Arizona Chapter

Our meeting was held on Saturday October 19st at the Kettle Restaurant at I-10 & Starr Pass in Tucson. Due to a scheduling problem with the hall our meeting was cut short and a small group had a meeting in the restaurant.

We had the “ROAD CLEAN-UP” on Saturday September 28th and would like to thank all that attended. Once again John did a great job of setting up and organizing everything for supplies to lunch for those who attended. THANKS again John.

The State meeting is coming up in November and anyone looking to ride up should contact Jim. There are no contested offices but a couple still open. We look forward to the new leadership in the future. The Chapter is looking for members to step up for various positions for the upcoming year. Elections are coming up quickly. If you can help by taking on one of the positions please try and do so. We all need to pull together to make this work. We have several positions that are open for the upcoming year. Next meeting will be Sat November 16th at the Kettle. I hope to see everyone there. Ride Safe!!

Yavapai Chapter

We met at the Drunken Lass on 11/10/13, and elected officers for 2014. Here are next year’s officers: Paul ,coordinator/treasurer, Doc, vice coordinator/secretary, John, sgt. at arms, 44Dan safety, Chino, membership, Longhair James, events, PAC/merchandise, Ralo, and Dawolf, communications. Thanks to all of those that stepped to serve for 2014.

In other chapter news, a run/event committee will be formed for 2014, as Longhair James and Ralo have done a lot of work by themselves the pat couple of years, and it is on just that we pitch in to support their yeoman efforts. Introduced by Reps. Bob Goodlatte (RVA), Jim Costa (D-CA), Steve Womack (R-AR), and Peter Welch (D-VT), H.R. 1462 would effectively overhaul the Renewable Fuel Standard (RFS) which mandates that 36 billion gallons of renewable fuels be part of our nation's fuel supply by 2022, almost all of which being fulfilled by corn ethanol which in turn diverts nearly 40% of our nation’s corn crop from food and feed.

Congress created the RFS program in 2005 to promote the ethanol industry by setting the minimum amount of renewable fuel that must be blended into motor fuels annually. E10 (10% ethanol blend) has become widely accepted and helped kickstart the ethanol industry, but in 2010 the EPA approved E15 for use in newer vehicles even though many automobile manufacturers claim its use can damage engines and void warranties, and no motorcycles or ATVs are currently

Rep. Goodlatte has also introduced the RFS Elimination Act (H.R.1461), “which eliminates the RFS altogether and makes ethanol compete in a free market.” Both the RFS Elimination Act and the RFS Reform Act have been referred to the House Energy and Commerce Committee.

In a letter dated October 31, 2013 to Rochester Police Chief Roger Peterson and City Attorney Terry Adkins, A.I.M. Attorney Michael M. Bader of St. Paul, MN states that by denying access to people displaying affiliations to these clubs, the establishments are violating Minnesota Statute 604.12. The statute, the first and only biker anti-discrimination law in the country, says that access cannot be denied to "a person who operates a motorcycle or is wearing clothing that displays the name of an organization or association," unless the person's behavior is endangering other people or property, or the person's clothing "is obscene or includes the name or symbol of a criminal gang."

Meanwhile, on November 15, the EPA recommended reducing the total amount of ethanol required by the RFS to be blended into U.S. transportation fuel nationwide in 2014 from 18.15 billion gallons down to 15.21 bg, though the move to reduce the minimum volume of renewable fuel next year does not provide a permanent solution to the inflexible short-term mandates nor the longterm diversion of feed stocks to fuel.

Bader's letter states that he has been provided "irrefutable evidence" that Rochester restaurants and bars violate the law by practicing "discrimination" against members of motorcycle clubs, and told the Post-Bulletin newspaper that the evidence includes taped recordings of conversations with bar owners who say police advised them to deny access to

ROCHESTER, MINN ACCUSED OF DISCRIMINATING AGAINST BIKERS An attorney representing the Confederation of Clubs of Minnesota claims that Rochester bars and restaurants illegally deny access to people wearing clothing that displays affiliations to certain motorcycle clubs and that the

people wearing jackets or other clothing with certain motorcycle club colors and insignias. "The reason given by police, as evidenced in recordings, is: 'that these groups have a history of violence,'" but Minnesota Statute 609.229, which pertains to gang crime, requires a gang or club to have a "pattern of criminal activity" before establishments can deny access to its members.

"Our suggestion would be for Chief Peterson to send a memo to all licensed clubs and restaurants in Rochester with a copy of Minn. Stat. 604.12, advising the license holders that discrimination upon dress alone violates the statute and makes each establishment liable for damages and attorney fees for each person who suffers the discrimination," Bader wrote in his letter. Peterson told the paper he has no plans to send the type of memo Bader suggested because the police department is not violating any statute, saying it is wellknown and well-established that the motorcycle clubs Bader represents have

If Peterson refuses to do so, "the next step is litigation," Bader said in a recent interview. "And then it would be incumbent upon the city to prove this pattern of criminal activity." THREE-WHEELERS EXEMPTED FROM MOTORCYCLE LICENSING & HELMET LAWS The Michigan legislature has approved a bill to change the state’s motorcycle laws to allow Elio Motors to sell a three-wheeled car in the state without buyers being required to get a motorcycle endorsement.

The "Elio" (pronounced EE-lee-oh) is considered a “motorcycle” under federal and state safety regulations because it has three wheels and weighs less than 1,600 pounds. Nonetheless, it handles like a car according to inventor Paul Elio, who says Michigan's old law would have required buyers of the Elio to take a motorcycle safety test that teaches things like, "the throttle is on the right handlebar" and you should "lean into a curve."

The company is banking on other states with similar laws to have them modified by the time Elio Motors plans to start production of the Elio in late 2014, but their main concern is the five states that require drivers of three-wheeled vehicles to wear a helmet.

Joel Sheltrown of Elio Motors says those laws must be changed by the time the Elio is for sale, because wearing a helmet in a car obscures the person's vision and hearing, and the weight of the helmet also has the potential to cause severe neck damage in an accident.

Such laws could also hinder sales of the three-wheeler, which will be manufactured in Shreveport, Louisiana, where the state recently amended their laws to allow Elio occupants to ride without a

helmet and operators won’t have to get a special "M'' endorsement on their driver's license as required of motorcyclists.

GLOBAL TIRE MARKET PROJECTED TO GROW, DRIVEN BY MOTORCYCLES The worldwide market for tires is projected to grow at a 5% annual rate for the period 2014-2015, and motorcycles will be a key driver.

According to an industry report, the increasing demand for motorcycles positively influences the demand for tires and hence leads to the growth of the Global Tire market. The demand for motorcycles comes from developing and under-developed countries where the penetration rate of cars is low.

Also, it is expected that the adoption of tubeless tires in the Global Motorcycle market will increase and will have a positive impact on the Global Tire market.

1 IN 4 DRIVERS ADMIT SURFING THE WEB WHILE BEHIND THE WHEEL Texting while driving used to be an offense identified with younger vehicle operators, but a new poll shows how it has spread to older drivers as well. The poll also found that one in four drivers are now accessing the Web while driving, yet another dangerous distraction, and the increase is driven by older drivers using smartphones.

The number of drivers who report using their cell phones to access the Internet while behind the wheel continues to rise, to a point where nearly one of four drivers are going online while driving, according to a national survey that has tracked the potentially deadly practice over the past five years. There were also jumps in the percentages of people who read or respond to e-mail, and who read or update social media networks while driving, according to an article appearing on the front page of USA TODAY on Tuesday, November 12th.

Insurer State Farm began asking drivers in 2009 whether they went online while driving. The percentage of drivers who said they do so has nearly doubled, from 13% in 2009 to 24% this year. Among drivers ages 18-29, that number rose from 29% to 49%.

Most research on distracted driving -and most laws against it -- has focused on texting while driving, which creates a crash risk 23 times greater than not doing so, according to the National Highway Traffic Safety Administration. But the rise in ownership of smartphones, which allow users to surf the Web, access social media and send and receive e-mail, means there are more opportunities than ever for driver distraction, and over the past three years the sharpest increases in smartphone ownership were among drivers 40 and over. For drivers ages 40-49, the percentage that owns smartphones rose from 47% in 2011 to 82% in 2013; for those 50-64, it went from 44% to 64%, and for those 65 and older, from 23% to 39%. Perhaps reflecting the nation's sustained campaign against texting while driving, that problem is growing much more slowly than surfing the Web. The percentage of people who report texting while driving rose slightly over the past five years, from 31% to 35% of all drivers. Among those 18-29, the number who report doing so has actually decreased, from 71% to 69%.

Chris Mullen, State Farm's director of technology research says, "We need to keep an eye on social media, reading email, all these other functions folks can use. … That could be legislation, it could be enforcement, it could be education and awareness." DRIVERS WOULD OPT TO LOSE CONTROL A new survey finds that one in five Americans would never take the wheel again if a self-driving, or autonomous, car were available. CarInsurance.com asked 2,000 drivers whether they would buy an autonomous car if it meant they never had to drive again, and 20% of them said yes. That number soars if cheaper car insurance is part of the deal.

While 1 in 5 licensed drivers surveyed said they would gladly turn over the keys and let computers do the driving, more than a third of those surveyed said an 80% discount on car insurance rates would make purchase of an autonomous vehicle “very likely,” and 90% of respondents said they would at least consider the idea.

Cars that park themselves, navigate stop-and-go-traffic or avert an impending collision are already on U.S. roads today, and Nissan has promised to deliver a fully autonomous vehicle -- one that allows a computer to assume control under the right conditions -- to showrooms by 2020. A fully automated vehicle that doesn’t need a human operator could someday follow. “Our survey shows cheaper insurance will greatly influence consumer acceptance,” said CarInsurance.com managing editor Des Toups. “Some of the liability of operating a car will doubtless be assumed by the manufacturer,” Toups said. “But a lot of the decrease in rates could come simply because there would be many fewer accidents.”

Trust will be a big hurdle, the survey results show, as 64% said computers were not capable of the same quality of decision-making that human drivers exhibit, and 75% said they can drive a car better than a computer could. Asked what they would do with their additional free time, 26% responded that they’d text/talk with friends, 21% would read, while 10% would sleep and 7% would work. Where Have All The Riders Gone? cycling of the past 40 years has been the displacement wars. There was a time, not so long ago, when a 1-liter motorcycle engine was considered a monster. Now, even the 2-liter barrier has been surpassed. I never thought I would see the day, but there are actually several new models of motorcycles for sale right now with engines larger than the one in my car.

Then there was the rise of the “dualsport” bike, fostered by the BMW GS. These are bikes designed to perform equally well off-road as on, which gave birth to the new genre of “adventure touring.”

The greatest popularity of these bikes came in Europe, where — oddly enough — people bought giant dual-sport bikes and dressed them up with every radical off-road accessory imaginable, and then never actually took them off-road. It was much like what many SUV owners do in the U.S. But Where Has Riding Gone?

Contrary to the rise of bikes, of all the trends I have watched come and go over the years, there is a recent one that makes me sad: the decline of riding as a lifestyle.

I’ve seen it in repeated trips across the same route at the same time of year. Believe it or not, I have ridden coast to coast across the United States at least 35 times. Thirteen of those trips were from California to Daytona to attend Bike Week, starting in 1990 and running through this past March.

In years past as I rode across the country, the closer I got to Florida the more bikes I saw on the road. Layovers at rest stops, gas stations and restaurants invariably included meeting up with other riders and chewing the fat in the parking lot for a few minutes. In a normal year, I would guess that I saw around 600 to 700 riders on my route, not counting the last 100 to 150 miles into Daytona, which is always jammed with thousands of bikes. This year, I saw fewer than 30 — that is,

if I only counted the bikes being ridden. I’m sure I saw at least 500 more being trailered in or on the backs of pickup trucks. And yes, I understand that this March saw some of the worst early spring weather ever on record in the Northeast. I certainly don’t fault riders from New England and the Midwest for having to trailer their bikes down to Daytona. I know that a lot of people are going to trailer their bikes rather than ride them. Daytona has always been that way. But the ratio has changed: for nearly two decades I could count on observing roughly a one-to-one mix on the road; this year, it was more like one bike being ridden for every 20 being trailered. And that was on the southern route.

The scene was the same in the hotel parking lot, where I counted 68 bikes that had come on trailers and five (counting my own) that had been ridden. Hotel management had to ask people to move their trailers to a nearby shopping center lot or be towed.

The bottom line seems obvious: motorcycle sales, licensing and training all are up, all across the country. More people are buying bikes than at any other time in the past five years. Yet as near as I can tell, people are actually riding less and less all the time.

The balance seems to have shifted from the touring and sport riders to the casual weekend riders. Or to put it another way,

the popularity of motorcycling as a lifestyle is waning. The new normal is owning a bike to take out on the occasional weekend, when the weather is nice, for a three- or four-hour ride. Or in this case, to trailer to an event and ride from the hotel to the rally, or to parade up and down Main Street. My guess would be that a lot of this shift is due to the aging of the motorcycling

populace. I know my annual cross-country trek is getting more and more difficult as the years pile up, and I suppose as much as I dread it, there will come a time when I need to trailer my bike too. Change is inevitable, and not worth carping about. But personally, I intend to continue bucking the trend just as long as possible.

California Inks Law Paving Way for Google's Driverless Cars to Hit State's Highways

Gov. Jerry Brown signed legislation Tuesday that will pave the way for driverless cars in California. The bill by Democratic Sen. Alex Padilla will establish safety and performance regulations to test and operate autonomous vehicles on state roads and highways. The governor signed it at the Mountain View headquarters of Google Inc., which has been developing autonomous car technology and lobbying for the regulations.

Self-driving cars might sound like science fiction, but they are already cruising California's roads and could become sold commercially within the next decade.

Google's fleet of a dozen computer-controlled vehicles - mostly Toyota Priuses equipped with self-driving technology -- has logged more than 300,000 miles of selfdriving without an accident, the company said.

Autonomous cars use computers, sensors and other technology to operate independently, but a "driver" can override the autopilot function and take control of the vehicle at any time.

With smartphone-wielding drivers more distracted than ever, backers say robotic vehicles have the potential to make roads significantly safer, noting that nearly all car accidents are a result of human error.

The legislation requires the California Department of Motor Vehicles to draft regulations for autonomous vehicles by Jan. 1, 2015. Currently, state law doesn't mention self-driving cars because the technology is so new.

The regulations would allow vehicles to operate autonomously, but a licensed driver would still need to sit behind the wheel to serve as a backup operator in case of emergency.

The legislation is also aimed at keeping California at the forefront of the autonomous car industry since Stanford University and Silicon Valley companies have been working on the technology for years.

In February, Nevada became the first U.S. state to approve regulations spelling out requirements for companies to test driverless cars on that state's roads. In recent years, automakers have been introducing autonomous functions such as self-parking, lane departure warnings and adaptive cruisecontrol, which allows vehicles to automatically accelerate and decelerate with the flow of traffic.

Carmakers such as Audi AG, BMW AG, Ford Motor Co. and Volvo have been working on autonomous car technology for years, and experts say commercial vehicles could feature an "autopilot" function in as few as five years.

At the State level, I was Secretary 4 years, 2006-2009. I’ve been riding motorcycles since 1979 and currently ride an H-D Wide Glide and Honda Gold Wing.

I will work to increase our membership by reaching out to more diverse motorcycle enthusiasts and present ABATE in a professional manner. All motorcyclists face the same challenges on two wheels, and discrimination in a variety of ways. ABATE is one way to unite for the good of all. Together, we have a loud voice. The new domain is the result of a huge expansion of domains that unleashes new generic top level domains (gTLDs) like .shop, .free or even .smile. The expansion is touted to make the Internet more consumer- and search-friendly.

Industry Brief — Polaris Announces Buyback of 3.96 Million Shares From Fuji Heavy Industries

Polaris Industries Inc. (NYSE: PII) today announced that it has purchased all of Fuji Heavy Industries Ltd.’s (“FHI”) 3.96 million shares of Polaris’ common stock for a purchase price of $497.5 million, thereby reducing its outstanding share count by approximately six percent. Polaris funded this purchase with a combination of cash on hand and $250 million of borrowings under the Company’s revolving credit facility.

Polaris and FHI have a long successful engine supplier relationship dating back to 1968, when FHI began manufacturing Polaris’ exclusive “Star” engine. FHI was the sole manufacturer of Polaris’ engines from 1968 to 1995, at which time Polaris gradually began to produce its own engines for select models. For model year 2013, FHI supplied approximately one-fourth of Polaris’ engines used in a

After taking into consideration the funding and transaction costs and lower outstanding share count, this transaction is expected to have only a slightly positive impact on the Company’s 2013 fourth quarter and full year earnings per share from continuing operations. The Company’s previously issued guidance for full year 2013 earnings per share from continuing operations, raised on October 22, 2013, remains unchanged at $5.30 to $5.37 per diluted share. On a pro forma basis, assuming this transaction had occurred on January 1, 2013, the positive impact on expected full year 2013 earnings per share from continuing operations would have been approximately $0.25 per share. Chris pre-ordered an Indian Chief Vintage the day after attending the Sturgis Reveal from Indian Motorcycle of Little Rock (Gregory Polaris). He rode his bike home on September 25th and is proud to own a badged bike. ============================

HD750 VERSUS THE AGING SPORTSTER–

We all by now have heard about the new 500cc and 750cc water-cooled HarleyDavidsons, it seems everyone has an opinion from it is not a true Harley because it is water-cooled, to it is not American made. Well these are all arguments we have heard before, from the aluminum-cylinder Evolution Engine to the V-Rod we all screamed the sky is falling, that the Motor company was breaking from tradition.

I am sure that the same thing was screamed when Harley came out with the V-twin engine in 1909. Now we are heading into 2014 with a new platform coming out with smaller engines. They do away with the signature 90 degree VTwin in favor of the V-Rods 60 degree overhead cam motor that is cooled not by air but by water. Lets put all of that to the side and look at some potential facts.

Lets compare the New 750cc to the 1200cc Sportster:

1.) Watercooled vs air-cooled both have advantages but the future of air-cooled bikes is limited as the EPA emission crap is causing heat problems on bigger Engines

The recall is for trikes manufactured from July 24 through Sept. 2, according to the National Highway Traffic Safety Administration. The recall affects 436 cycles manufactured during this period.

2.) The Evolution Sportster motor is getting a little long in the tooth other than the rubber mounting (2004) we have not seen any real changes to the platform since 1986. Stock the HP of the 1200cc sportster is 68 HP on a good day and most that I have seen on a Dyno are averaging around 60. Damn anemic in today’s motorcycle market. We don’t have HP figures for the new 500 or 750 yet but I was able to dig up some numbers for the 650cc ATK which is a very similar motor to the 750cc H-D. The ATK is putting 79 HP to the ground and I am sure the new 750 H-D will put out comparable numbers.

Harley-Davidson Inc. has issued another safety recall on its 2014 Project Rushmore motorcycles, this one for a defect that could result in the loss of brake fluid.

Due to an incorrectly machined part, the trike may have an excessive steering angle that allows the inner fairing to come into contact with a brake fluid reservoir, resulting in a loss of fluid. Also, the steering damper may be damaged.

3.) The Sportster is limited to 5 gears from the factory, the new 750 H-D is running a 6-speed transmission this should make it very easy to keep in the power band .

So what does all this tell us, I am not sure I haven’t ridden one yet but looking at the numbers and how much fun riding an ATK 650 is I think Harley- Davidson may have a winner with this one. If the aftermarket takes an interest in the new platform I can see the writing on the wall. The days of the bike most of us learned on, raced, carved canyons with, is numbered. This could be the bike to replace the aging Sportster and I believe this bike will be the future of the Motor-Company.

Harley’s News Street Bikes Will Be Manufactured In Kansas City and India

Harley-Davidson’s new Street 750 and Street 500 motorcycles will be produced in Kansas City and India.

The new street bikes are the first motorcycles that Harley-Davidson has designed from scratch in 13 years. The company’s last newly designed motorcycle was the V-Rod, which is produced in Kansas City. The plant also produces the Dyna and Sportster models.

Fitted with liquid-cooled Revolution X power trains, the motorcycles are agile and designed for the stop-and-go traffic of urban environments. The power train is placed on a narrow chassis, with a super low seat height, new suspension and broad handlebar sweep to gain more maneuverability.

The motorcycles will be sold around the globe. The U.S. models will be produced in Kansas City. For the first time ever, the international models will be completely constructed in Bawal, India, at a plant Harley-Davidson opened in 2011.

A 1953 Triumph motorcycle stolen in Omaha, Neb., in 1967 was recovered just as it was about to be shipped to Japan, and California Highway Patrol officers were working today to return the bike to its original owner.

The vintage British motorcycle had a stated value of $9,000 on its manifest papers when it was seized by U.S. Customs and Border Protection agents at the Los Angeles-Long Beach port complex. It was being shipped to Yokohama, Japan, but no immediate arrests were announced. Depending on the model and condition, some 1950s Triumph motorcycles are worth up to about $16,000.

The original owner, now 72, reported the motorcycle stolen out of his yard in Omaha in February 1967, according to Lee Harty of CBP. The motorcycle was turned over to the California Highway Patrol Wednesday. =============================

Discussion: There are approximately 10 MAP instructors affiliated with ABATE at this time. Jim Silk has been the most active, having taught approximately 1000 high school students in the past year, mostly in the East Valley. Jim collaborated with ‘Rev’ to update and improve the PowerPoint presentation. Jim plans to energize the MAP and increase instructor engagement and activity.

· Lobbyist Plan of Action: Clyde Brooks reviewed the survey report and provided a prioritized report. Unfortunately, there is no consensus regarding the top three legislative issues. Action: Clyde and Rick Breadwell will work on producing a 2014 legislative survey for the membership to complete by Officer Training in January, so the Lobbyist will have direction for 2014. The completed surveys will be returned to Clyde and Rick no later than 12/15/13, so they may be collated by January.

· Motorcycle Day at the Dome: Vic has not yet secured the date. Action: Vic Grady will make the necessary contacts at the State Capitol within the coming week to secure a February date for the event and report back to the Board.

· New Budget Forms for Officer Training: New forms will be available in the graphics and forms section of the ABATE website. The forms will also be made available at Officer Training. · Top Gun: Deferred due to Jim Clark’s absence. New Business:

· Freedom Rally vs. Day at the Dome: The Freedom Rally, even though it was held on a weekend, had a better turn out than Day at the Dome. The Rally provided an opportunity for ABATE to grow its membership. The legislative issues for the coming year were presented to the attendees; there were energetic speeches given by motorcycle rights activists from around the country. Some legislators attended despite the weekend. Day at the Dome has experienced less participation, partly because it is held during the week. There must be a way to increase Arizona’s motorcycle community involvement is promoting motorcyclist rights. New Harleys Create Quite A Buzz

The new Harley-Davidson Street 750 and Street 500 created a huge buzz all over the motorcycle community, but here are images of a different kind of buzz.

This swarm of bees was seen clustering onto a parked motorcycle in a dealership yesterday in Palmerston North, New Zealand. The spectacular swarm had motorists bees a wide berth. The bees settled on the bike, a Hyosung, about 12.30pm. Later, the dealership’s staff called a beekeeper in to remove them. Bees were generally docile when they were without a hive to defend, something the beekeeper backed up by approaching the bees without protective gear and brushing them into a box.

Here it is. My last PAC article. Ha, I’ve written so many last articles I feel like Ozzy Osborne or KISS with their “Last Tour”. But, this is it. After twelve or thirteen years of writing articles, (It really doesn’t seem that long. It seems like just yesterday when I bought my most recent bike and Mary K says to me “Now go join ABATE.” Eh? What’s that? I’m rambling? OOPS. Sorry, back to the article.) I’m going to take a little break. For real this time. I know, I know, I’ve tried this before. I even think there was about four or five months that I actually wasn’t doing anything. This time though, I’ve slowly been handing off my responsibilities little by little to some very awesome folks that have stepped up and taken over. Thanks guys!!!!

OK. So, you really need to look at the poster that I hope Mr. Editor can fit in close to this article. It’s from Australia. The Government there has decreed that Pub (Bar) owners cannot serve anyone that is in or associates with Outlaw Motorcycle Gangs. If they do, they lose their liquor license. As usual the definition of Outlaw Motorcycle Gangs is open to interpretation. The Publicans (Bar owners) are left to their own devices to

determine what an Outlaw Motorcycle Gang or associate is. This has in some cases led to an outright ban on motorcyclists. I hear you “It can’t happen here.” Right? Wrong it has happened here although on a smaller scale. Think Kingman, Prescott or even Cave Creek Road. If you do a little digging you will see what I’m talking about. But I’ll shut up about that for now lest I wind up on some “subversive” List. OOPS too late! We need to take action to nip this behavior in the bud. As the great Barney Fife once said “All of the authorities on the subject are in favor of bud nippin.” So how do we start this ‘bud nippin’? Glad you asked!

With the shutdown over, Congress is literally limping back to work. The House of Representatives is working on the other side of the Hill and the U.S. Senate has decided to give themselves one more week of vacation. During the government shutdown both bodies of Congress missed a recess period. The House opted to stick to the schedule, but the Senate decided it needs the missed recess week so they are adjourned until next week.

Representative Tom Petri (WI) has drafted a letter to the Centers for Disease Control (CDC) asking them to cease their meddling with motorcycle safety. As previously reported here, the CDC did a weak reconfiguring of some other tired studies done by other government agencies.

The letter is being held until November 1st when it will be sent to the CDC director. The Motorcycle Riders Foundation (MRF) is asking you to contact your Member of the House of Representatives to ask them to cosign the Petri CDC motorcycle letter. The text of the letter is below and the CDC response will be printed here when it is received. We are writing to express our concern about activities of the CDC regarding motorcycle safety, in particular the Motorcycle Safety report, which focuses on pressuring states to pass universal helmet laws.

The issue of transportation and motorcycle safety has been studied extensively by agencies within the Department of Transportation and the National Transportation Safety Board. These agencies have transportation professionals who are experienced in this area. The extensively footnoted report seems to be little more than a compilation of work that other agencies have done, and with questionable conclusions.

For example, the report states that motorcycle-related deaths have increased by 55 percent since 2000. But nowhere in the report is it mentioned that motorcycle registrations have also increased substantially since 2000. The report also notes that 41 percent of motorcycle operators and 50 percent of motorcycle passengers who died in 2010 were not wearing a helmet - which seems to indicate there were more deaths with helmets than without. It would seem to follow that 59 percent of motorcycle operators and 50 percent of passengers who died in 2010 were wearing a helmet. Interesting, but what is the conclusion we should reasonably draw from these figures? Given the demands on your budget and

Illinois State Legislature Puts the Heat on Congress

Both the Illinois State House and Senate have resolutions before them urging the United States Congress to pass H.R 875, a bill to require scientific testing of the fuel blend E-15. At the specific request of ABATE of Illinois, Senators Mike Jacobs and Linda Holmes have sponsored Senate Resolution 634 along with Representatives Kay Hatcher and Tomas Morrison who sponsored identical legislation known as House Resolution 524.

The measures are non-binding but send a clear message to Washington D.C. that something needs to be done to address the problematic issues associated with the new, higher level of ethanol blends. This is resounding especially coming from a State like Illinois where the local economy highly depends on the sale of corn.

H.R. 524 and S.R. 634 are great examples of what can be done at the State level to combat the effects of a nationwide problem.

When the Environmental Protection Agency (EPA) issued the waiver that allowed for the sale of E-15 they did no testing on the power train of the motor, only the tailpipe emissions. Failing to test the effects of the blend on nothing else has resulted in manufactures refusing to do any warranty repair on any motorcycle that has run E-15 though it.

H.R. 875, the Sensenbrenner bill, would force the EPA to conduct an independent study on all of the effects of the E-15 blend on internal combustion engines and at the same time halt the sale of the blend to avoid any further damage to the fleet.

CDC Task Force to Recommend Mandatory Helmet Laws

The Motorcycle Riders Foundation (MRF) reports that the rumors are true. A Centers for Disease Control (CDC) task force is set to issue a report calling on all 50 States to enact mandatory helmet law.

The task force, known as the Community Preventative Services Task Force, is a 15 member, non-federal, independent group that utilizes CDC staff and resources to develop "Findings and Rationale Statements". These statements make recommendations that run the gamut of topics from asthma control to work place safety. The past recommendations have included motor vehicles, focusing on seat belts, child seats and alcohol use. This is the first time the task force has recommended anything to do with motorcycling. Task force members are appointed by the Director of the CDC and serve a five-year term. All current members are doctors, with one exception.

The report claims that mandatory helmet laws will save lives and money. This is the same tired, lopsided theme used by the CDC in their last report about motorcycle safety. According to the CDC website the six main safety tips for riders are: always wear a DOT helmet, never drink and ride, don't let friends drink and ride, avoid tailgating, wear bright colored protective clothing, and don't ride fast on gravel. There is not one mention of rider education or licensing. It is not a surprise that the CDC's answer to motorcycle safety are helmet laws, it is their go to answer. The new report was drafted by associates of the individuals that issued the last CDC motorcycle safety report. The repetition is to be expected. In conversations with the MRF, the CDC clearly expressed their opinion that rider education does not work. Strangely lacking from the long list of prior recommendations of the task force was distracted driving.

One would think that a group of highly educated individuals may appreciate that education should play a role in motorcycle safety. The motorcycle safety community has proven that rider education works. Over the first 10 years of the New Hampshire State motorcycle safety rider education program, more than 23,000 motorcyclists were trained and since then only one person from the 23,000 has been in a fatal crash. In addition, the CDC asserts that fatalities have nearly doubled since 2000 while failing to take into account the increase in registered motorcycles. In fact, in 2000 there were 2,862 fatal crashes for 4.9 million registered motorcycles. This means in 2000 .058 percent of all registered motorcycles were involved in a fatal crash. In 2010 there were 4,502 fatalities for 8.4 million registered motorcycles, which puts just .053 percent of registered motorcycles in a fatal crash. A slight decrease in the ratio of registered motorcycles to fatalities with 3.5 million more motorcycles on the road. These are just some of the facts presented from the CDC research that have been presented at all four MRF conferences going back to fall of 2012. The CDC solution to motorcycle safety is safer crashing. We at the MRF have been urging the government to shift the focus of motorcycle safety to crash avoidance, not safer crashing. The best crash is the one that does not happen.

The task force report will try to convince their reader that states with choice helmet laws experience a higher amount of health care costs. That's just not true. In 2010, the Kaiser Family Foundation conducted a study of inpatient hospital expenses by state. Of the 12 most expensive states for daily inpatient hospital expenses, seven had mandatory helmet laws. The 12 least expensive states for daily inpatient hospital expenses, four had mandatory helmet laws. Mandatory helmet laws do not save money.

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us.

One of our newest Business Members is none other than our own Herman Roush. While Herman has been a member of ABATE he has recently decided to make the jump to become a Business Member. He actively participates in Chapter events and has regularly helped out with our Road Clean-up.

As a mechanic and a gear head Herman has been involved with cars and bikes his whole life. His present bike is a 2007 Triumph Rocket 3 with a 2300cc engine, this thing real gets up and walks.

The letter was authored by Mr. Tom Petri (WI) and was publicized and promoted on Capitol Hill by the MRF. The MRF sent numerous releases asking the motorcyclists to help get congressional support. The CDC Director's response is sure to be weak, but will be reported on. The MRF learned from CDC staff that the task force report is expected to become public sometime the first week of December. The MRF is working on obtaining an embargoed copy of the

report. This is certain to be national news. Even the staff members at the CDC are aware of this and are calling the report "controversial".

Use the MRF's latest "Fact or Fiction" piece, which was made public at the most recent Bikers Inside the Beltway event in Washington D.C. in May of 2013 to educate your legislators. The one page document has information about the CDC and the misconception related to the effectiveness of helmet laws. The MRF encourages you to use this information and contact your friends in Congress to let them know this is coming.

Call for MAP Instructors

To become an instructor you must:

Be available during the day: 1. The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in the material presented.

Commit to teaching at least 2 4. classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.
