beginnings to conversations, when you urge your representatives to pass them.

Representative Jerry Weirs is sponsoring bills HB2074 Motorcycles: lane advancement and HB2077 Motorcycle Operations: riding between lanes. If passed they will be effective from and after August 30, 2013. In other states that have adopted Lane Advancement for motorcycles they found that there is: increased visibility for the motorcyclist, allowing the rider to proactively maneuver based on traffic conditions ahead and it reduces the percent of motorcycle rear-end collisions. You may want to familiarize yourself with these bills as they can be good

“Motorcycle Day at the Dome! Wednesday February 22nd, 2012 – On the Senate Lawn! Have you made plans to be there? Please mark your calendar and take advantage of the opportunity to talk to your Legislators one on one. We are hoping for a more personal exchange with our legislators and the opportunity of having all motorcyclists in Arizona become familiar with the process. Call ahead and make an appointment if possible, this is the first year we’re attempting a more personal visit and we can’t expect the legislators to be available at the last minute. Don’t be disappointed if you are seen by your legislators’ aide, sometimes the legislators are called to the floor unexpectedly for a vote.

The beauty of the MDATD is that we get to know who the people are that are making some very important decisions for us. Whether it’s a law effecting motorcyclists or one that affects

you as a home owner or parent, you want them to know who you are. You can build relationships with them on this level that can carry over to other areas. This is an election year and many legislators are up for reelection, offer to help with their campaign. You may not be able to donate much money, but you could volunteer your time, whether it’s handing out fliers, answering phone calls or knocking on doors. Remember, we’re not having a luncheon this year and it is certainly a step into the unknown. I’ve heard pros and cons on the issue, but I hope the new approach will be the beginning of more dialog and mutual respect. We as a community have the opportunity to make the first move to become involved in the process. It is much more difficult than offering food; it means we are actually offering support. Pac Report -

Hello to all my Brothers & Sisters,

Wow, February already, for those of us who live in or around the valley this is beautiful riding weather. Last month even those who live just a little further north got a pleasant surprise with the weather cooperating.

The other day I received an email asking if Too Broke for Sturgis was going to happen this year. I immediately wrote back and advised that YES, it definitely was on. I also gave him the date of our event which is, July 27, 28, and 29, 2012! So that got me thinking, if one person questioned if TBFS event was still on then there are probably many more people who have the same question. A flyer will be designed and available for distribution as soon as possible from the TBFS Committee. As of Feb. 1st. there are only 177 days before Too Broke, that time goes by almost in the blink of an eye. The good news is that the TBFS Committee will be ready to put on Arizona’s best old fashion Biker Party in the State. Now, this is where all ABATE members come in, we need your help in spreading the word of our annual event. We will also need members’ participation in helping out your Chapter’s responsibilities. Volunteers will be needed for Security, Registration, Merchandise sales, Gate duty / Traffic Control and First Aid.

For a successful event all Chapters need to ensure that they have sufficient members to cover their Chapter duties. If you’re a biker and have attended this event, you know how much fun it is. There is no other event in Arizona that compares to Too Broke. You also should know how much work it takes to assure that everyone in attendance enjoys themselves for the entire weekend. This doesn’t just happen, it happens because volunteers like yourselves, give up some of your personal time and work to ensure our guests have an enjoyable weekend. If everyone donates a few hours of their time we all can enjoy Too Broke.

In the next few months your Chapter Coordinators will have sign-up sheets available at your meetings. Now is the time to start thinking about how you can support your Chapter, by volunteering some time to support ABATE of Arizona and Too Broke For Sturgis.

Drive now text later You can’t do both

Remember; Democracy begins with you, and Democracy only works when you get involved. Until next month;

Tim O’Reilly State President ABATE of Arizona

Membership needs to be informed on the legislators in their area.

I think first and foremost the thing we as PAC officers need to do is to get our members up to speed on who their legislators are and feel comfortable contacting them. This would be achieved in such ways as presenting form letters on the proper ways to address the legislators, getting the new district maps , and contact lists for the Leg. Then prepare our own contact list so when the need to contact our legislators arises we will have the means in place to do so. Our job as PAC officers is to learn the workings of our government and be able to explain the process to our membership. Also to be able to explain exactly how why, and what our lobbyists are doing. East Valley Chapter

First off let me say hello and congratulations to all the new State and Chapter officers. Thank you for volunteering to keep our organization going and also to all the returning officers let me say thanks for your continued support. I have some bad news. We at the East Valley Chapter have lost one of our own. Robert Vasquez passed away on Jan. 14th of this year. Robert has been our Sgt. of Arms for the last few years and very active in our chapter. He will be deeply missed. Look for an article on Robert in this issue.

On to upcoming events at East Valley. Our Valentines party will be held on Feb. 11th at the Monastery bar & grill at 4810 E. McKellips & Falcon Rd.(McKellips &48th St.) at Falcon Field Airport. The party is from 5:00 to 10:00pm. We will be selling raffle tickets for a Samsung laptop and case that will be raffled off that night. Look for the flier in this issue. It will be a great time for all so try to make it.

Well, that’s about it for now. Keep Roberts family in your prayers. Look for me to get back on my Soap Box about all kinds of things in our world next month.

Ride Hard or Stay Home Jack Batty East Valley Comm. Officer

High Country Chapter

Hello brothers and sisters,

Here I sit now for my 30 minute allotment that my doctor allows me. Yes I broke my back at work . Yes I'm in pain and yes I envy you riders right now . I want to thank Billy for stepping up to run our meetings until I am able to get back on my feet again !

Well here in the high country the weather is a little cooler now so dress up warm cause you can always take it off. Here our chapter is getting things in motion for Wild In The Weeds ! I'm sure this event will be better than last year’s !

We also are doing a thing up here for safety and awareness month in May.

Now we all know Feburary is M.D.A.T.D. I hope to see alot of my brothers and sisters there ! That's the 22nd of this month.

fresh. Use your standard hand signals when riding! On the subject of insurance be aware that a company can deny your benefits if you aren’t wearing a helmet even though the other person is at fault and we are a helmet free state. This is something that also needs to be addressed in the future.

Carole O’Reilly is hard at work for Motorcycle Day at the Dome 2012 to be held on February 22nd, 2012. We will not be hosting a lunch this year and she asks that everyone make appointments with your state reps to have a one on one meeting to discuss the main talking points. At the top of the list is anti-profiling and lane splitting.

Jean Cooper our State Safety Officer will teaching Accident Scene Management Training at Buddy Stubbs Feb. 11th 9-4 . The basic class is $ 50.00 and Abate will pay ½ for members. The ASMT advanced is Feb. 12th 9-4 and the cost is $55.00 all students pay total cost. Space is limited sign up at www.accidentscene.org or azjkc@aol.com. Hope to see you there!

Northern Arizona Chapter

With snow on the ground the Northern Arizona Chapter had our first official meeting in Show Low. We had a good turn out including a few guests, Tim O'Reilly, ABATE State President, and Carol O'Reilly our ABATE State Designated Lobbyist and Mike McCall the President of the Mountain Motorcycle Association of AZ. As of our first meeting we have 20 members and 1 business member, with no doubt we will be signing up more very soon. We have some good members already but unfortunately we still have a few officer positions open so anyone in the area that might have wondered what ABATE is about we welcome you to come to a meeting. Our meetings are held at JB's in Show Low the 2nd Saturday of the month at noon. We will be planning a membership drive in the very near future and hope to see you all there. Well, with 1 meeting under our belts there's not much to report but, keep your eye on us we plan on getting a lot accomplished in our first year here!.

Till next month, ride safe and watch out for the cager not watching out for you.

Well that is it from us in the high country ! Happy Valintine to every, one !

Phoenix/Shadow Mountain Chapter

Welcome to 2012! I hope that everyone found their ways through the Holidays safe, sound and pleasurable.

My name is Melissa Everest and I am taking over Communications for Casey Yates. Casey has done a great job for the past 2 years and is ready to be a 1 position gal as State Secretary! Good Job Casey!

We held our first meeting of the year on January 8th. It was a short meeting again this month as the State meeting was held immediately following.

Mikki Aaronson reported that that we have 17 new members and that we are slightly down from 230 to 186 members. She encouraged everyone to renew their existing memberships and to recruit, recruit, recruit more members!

Our Safety Coordinator Pam Costello gave us tips on safety while riding in groups. She suggested arriving early with a full tank of gas for group rides and conduct a meeting prior to the ride with stops and destination information provided. She recommended going to motorcyclesafety.org for more information and check the sight on a regular basis to keep skills

Southern Arizona Chapter

I may have attributed the wrong members as far as motion, seconds, etc. The dog ate the notes, really, oh well it didn’t work in grade school either.

The high light of my entire year was to see Rich Montgomery drive himself to the meeting from Sierra Vista. Rich thanked everyone for their continued encouragement and all those who visited him at the rehab center in Tucson and at his home in Sierra Vista. Rich spends a lot of his rehab time in a swimming pool. He is able to handle his rehab without coming to the VA in Tucson. Rich is one of the original three members who started our chapter in 2007. It’s amazing he is with us.

Some people will fake a coma and go on a ventilator just to get out of their officer duties early!

Safety: Last month we talked out T_CLOCK and how to check your bike before you go on a ride. This month the topic steered toward items you should carry with. Although Jim wasn’t present he had emailed in his report. One item is to carry some of the glow sticks. They alert other drivers when you are stopped on the shoulder. They can even be tied to your tail / brake light. Carry one of the disposable cameras since the digital pictures can be altered so easily. With the Arizona Sun carry a collapsible umbrella.

MASTERLINK FEBRUARY 2012

How about some aspirin to chew on incase of heart failure? Members with the baggers can carry more. I carry a small set of jumper cables. Besides bungees carry some of the parachute cord to tie things down or up with. Another good item is a siphon hose. It takes up minimal space. Don’t forget zip ties. Other ideas members had were duct tape and of course a first aid kit. Be sure your first aid kit has ointment for burns and latex gloves. Since we sold our stock we will order replacement first aid kits. Carry some female napkins. They pack small and are great for covering wounds. Carry some of the hand wipes. Remember how our excessive heat affects our items. Some members carry a little air compressor. Due to space limitations some members carry the small compressed CO 2 cartridges. I also carry a plug kit for the solid tires. You should always end your packing with as much water as you can carry. Did you remember your differ sets of glasses. When your day ride turns into a night ride don’t be stuck with only sun glasses.

Membership: We have 138 active members and 6 business members. We have been working on getting members strictly on the insurance policy. $2500 insurance for $25 a year is cheap. We have two new business members. The Eclectic Café on East Tanque Verde. They have excellent food and tend to lean towards the healthy selections. We have Paul’s SE Arizona RV Rentals in whetstone. He is on our road cleanup mile and Bob signed him up while doing our cleanup!! Speaking of members remember the membership contest started on January 1st, 2012.

Old Business: Thanks all around for our past officers and thanks for those stepping up to fill officer positions for 2010. All positions are filled except for Secretary. I’m not sure if Rich realizes he is secretary until he finds his own replacement. In fact as soon as you are elected you should start looking for your replacement! Our new officers are already having an impact. The new coordinator Jim brought in cards for all of our business members. Instead of mailing them we went as a group and delivered them in person.

As we reported last meeting Bob Welton had gone down on the fourth avenue trolley tracks. We have since learned that in addition to the many law suites the Tucson Police do not allow their motor officers to ride on any street that has the tracks. Many of the daily crashes are bicycle riders. We have some contacts with the main bicycle group. We may be able to join forces to get these tracks removed.

All T-Shirts are discounted to $5 and we sold several.

Jim DeYoung won the 50/50 for $ 16.50. Jim also won a scratcher lotto ticket, potentially worth thousands of dollars! The first meeting Art ever attended he won the dollar jar and we will never let him forget!

Art Burke won both the gas card and the home depot card. Art was seen giving Ron a kick back since he drew the numbers.

The dollar jar was $83 and won by Angelique Perea who was not present. It rolls over to the next meeting. For the first time ever next month’s dollar jar will be over $100. Remember you must be present to win.

The short meeting was adjourned at 9:30 And followed by the Gala gift exchange we do every year.

I always start the report for the Masterlink thinking I don’t have anything to write. By the time I quit rambling I have three pages!

The next meeting will be January 21st at the Kettle.

Yavapai Chapter

Now don’t get your boxers (panties) in a twist, I’m just pinch hitting for our great communicator Dawolf. I promise he’ll be back writing up the next chapter report. I suggest you fill up the coffee maker cuz this might be on the lengthy side as usual.

This report is being written the day after our first chapter meeting of 2012. Wow, where does the time go? So, how do you

think our first meeting went? One word, great, no better than great, fantastically great. I do tend to exaggerate, let’s just say it went very well. Thirty plus people turned out, some regulars plus many new faces as well; we even managed to secure several new memberships. 2012 is beginning to look like an excellent year for Yavapai Chapter, maybe even better than 2011 and that one would be hard to beat. We had some lively conversation including a riveting report from our BOD Rep. Stillray Fitzgerald. He certainly knows how to get people motivated and inspires a fighting spirit, especially when it comes to profiling bikers which in turn trickles down to all citizens of this exceptional country. I highly recommend getting your hands on a copy of the Jan. /Feb. 2012 MRF Report Information Bulletin. On page 19 is the MRF Motorcycle Club Committee Position Paper that Stillray was the driving force behind. Read it, it should make you mad as hell when you realize what crap the feds are trying to pull. This is a perfect example why organizations like MRF, ABATE, MMA, all MROs are so very important in our fight for freedom. Please join ABATE of Arizona, MRF or any other Motorcycle Rights Organization. It’s going to take a nation to stop this injustice in its tracks. Oh man, I told myself “self, no preaching allowed when writing this report”. Guess you can’t teach an old dog new tricks, especially one named “Gabby”.

Pour another cuppa Joe, time for the fun stuff starting with our first run of the year, the March 17th Luck of the Irish Membership Ride and Poker Run. Sign in 9:00am, kicks stands up @ 10:15am at The Jackass Bar in Prescott Valley, $5.00 per person, free poker run. Second stop is Drunken Lass in Prescott then on to The Burro Saloon in Wilhoit, back to Prescott for the last stop Gurley St. Sports Pub. We’ll have a Bike Show, raffles, music and much more. If you attended last year’s Membership Drive you know how much insane fun you had. It was crazy good.

Bike Nite will start in March this year back at The Drunken Lass. Be on the lookout for flyers for more info. Remember Run to the Hills last year? We’re doing it again this year on May 19th at the Gold King Mine in Jerome. This is still going to be a weekend event following in the “old school” tradition. Once again look out for this flyer coming soon to a neighborhood near you.

Now, how about a really fun event that is also for a good cause? Well, I have one for ya; on Saturday February 15th there will be a Horseshoe Tournament to benefit local kids for Pay to Play Sports. Three clubs have banned together, Red Iron Brotherhood, Journeymen MC. and Wind and Fire MC to organize this worthy event. Registration is 9:00am – 10:00am at The Roadrunner Restaurant & Saloon, 47801 N. Black Canyon Hwy in New River. This horseshoe tournament is single elimination, $30.00 per team, max 32 teams with a 1st, 2nd and 3rd place winners. There will be music for your entertainment along with food and drink specials.

Guess I better sign off soon before you get caffeine jitters. Oh, oh I just remembered to mention one more thing, you know me, I can’t shut up but this is a good one. Two of our chapter officers now have key ABATE State positions. Our P.A.C. Officer Handi is now State Membership Officer and our Treasurer from last year Paul is State V.P. We’re proud of them and are confident they will do a great job for state as they did for Yavapai Chapter. We sadly lost Paul, he’s got enough on his plate now, but Handi is staying on as our P.A.C. Officer. Yeah!

Well guys, As promised we are going to start learning the legislative procedure for getting a bill through our state legislature.

ZZZZZZZZZZZZZZZZZZZZZZZ. CLAaaAAS. CLASS! WAKE UP!!!! Thank You.

What Is ABATE?

ABATE Of Arizona, Inc. is a non-profit motorcycle rights organization that is dedicated to freedom of the road for all motorcyclists.

ABATE is a volunteer organization that fights discriminatory legislation aimed towards the motorcycling community. ABATE's position is that all motorcycle riders have the right to choose not only the machine that they ride, but also the riding gear that they choose to wear or not to wear, (i.e. leathers, gloves, boots and helmets.) ABATE promotes rider education for all motorcycle riders and motorcycle awareness for all automobile drivers. ABATE needs the support of all motorcyclists.

online. It’s important that we know when the committees will be discussing the Bill and the order it’s being heard so our lobbyist can… Well, lobby. This is the time for public testimony.

It will be then the job of the lobbyist to find a legislator that believes in our bill and will follow it through. This will be our sponsor. Our Sponsor and lobbyist will get together and approve a draft and re-submit it to the Legislative council. The Leg council writes the bill in proper form and sends the bill to the “Hopper”. (Not Dennis) Now will be the time to find Co-sponsors and work with the legislators to build interest in the bill. After a first read By the Speaker of the House it will be assigned to the proper committees and the Chief Clerk for Printing. It will be assigned a number and Committees. Rules committee is always a given. They check the language and make sure the bill is Constitutional and in proper form.

Rules Committee will then place the bill on the active calendar and the Speaker sets the order that the bills will be heard. It is then heard by the committee on the whole. This is an informal session of the entire House acting as one committee. The bill will be debated; amended, injected, infected and selected………Whoops wrong song. ANYWHO Then it’s time for the third read roll call and formal vote. If passed, it goes to the senate where the whole process starts again. The senate might accept it in its form or amend it If it comes back to the house in its original form, it will be sent to the Governor for signing or Veto. If it is in a different form the House and Senate will set up a Conference Committee to hammer out the differences. After

At this point the bill can be tracked

they are in agreement they will send a report back to each house for adoption. After Final passage it will then (Finally Jeesh) go to the Governor.

ZZZZZZZZZZZZZZZZZZZZZZZZ Wake UP!!!! Thank You.

You can follow our bills progress by going to azleg.gov and either typing in the bill number or entering a keyword like motorcycle or emissions and all bills that have even a reference to those words will come up.

Still there?

I know its tedious stuff but it’s what we all need to be doing. The more folks with eyes on, the less likely something might slip by un-noticed.

OK I can’t keep my eyes open any longer.

Good Morning America. The only good thing about February is that it's only 28 days long. It's usually cold, gray and dreary here in Indiana but next to North Dakota the place feels like the tropics. I LOVE North Dakota but you have to be one tough individual to call it home year around. Blizzards, White outs, snow drifts 12 feet deep, 25 straight days of minus 20 below zero.... just another day for my North Dakota Brothers and Sisters. I think that Krogers Supermarket sponsors every weather forecast when the weather turns bad, because at the reporting of the first snowfall, people flock to Krogers and attack it like buzzards on a carcass.

When the weather turns to crap here in Indiana and people start bitchin' and whining, I look fondly at a patch on my leather vest that says; What would Fridge do? Then I find myself remembering my last visit to the ABATE State Party in Mandan, North Dakota and just smile. Fridge is one of those North Dakota Brothers that just leave an indelible impression on a person. One of the many people from North Dakota I consider family.

So, if it's February 1st., Spring will be here in about 28 days so just shut up and deal with it. OK, according to those devil worshiping nose pickers who try to continually confuse people with their over zealous ego and underused sense of humor factors, they think otherwise . They spew and otherwise pontificate crap like..(Making that clearing of the throat sound )........ Spring, otherwise known as the Vernal Equinox... (see I told you they were confusing) starts officially at 7:21 PM Eastern Daylight Time on March 21st. for those of us in the Northern Hemisphere...................... Well LA DI FRICKIN' DA !

So, I may not be technically or politically correct but if you look at a calendar; there are 12 months and 4 seasons. Do the math and when you look at it my my somewhat jaded point of view, March 1st is my official start of Spring. So on March 1st. my mood improves dramatically and hopefully, so will yours ! Of course, you could just sit around moaning about the long cold, miserable winter all the while taking great pride in that fact that your one of those politically correct snobs who uses words like Vernal Equinox regularly in the course of your normal vocabulary and stay depressed for an

PAGE 9

extra 21 days of Winter while life passes you by.

We only have about 3 months of real bummer winter weather around the Ohio Valley where we call home, where as in North Dakota, their winter's start about September 7th and last until early May and they are some of the happiest people on the planet. Their secret? Well, I guess you just have to visit North Dakota and find out for yourselves. A word of warning here.. if you do visit North Dakota you had best bring a powerful thirst and a mighty hearty appetite for a real good time because they do know how to party !

Speaking of parties..... ( nice lead in huh?) The V-Twin Expo will be hitting Cincinnati like a freight train. Brothers and Sisters from all over the US will converge on The Duke Energy Center to bring out the latest and greatest motorcycle aftermarket products known to man. We always have tons of columns about what we see and experience at these shows. This is not a public event but downtown Cincinnati should be rocking and rolling after the show closes for the evening. On February 18th. we will be hitting the ABATE of Indiana Daytona Warm Up dance at Agner Hall . Agner Hall is located on the grounds of the Lawrenceburg Fairgrounds. I'm not sure how long this event has been happening but I've never missed one. It's always a great time and a good chance to catch up with a lot of folks I only see once a year. It starts at 6PM.

There are tons of really good events and rockin' good times ahead just take a look through the calendar in this magazine, lace up your boots and let the good times roll. I want to leave ya this month with a great quote by Father James Keller;..."What this country needs is more people to inspire others with confidence, and fewer people to discourage any initiative in the right direction. More to get into the thick of things, fewer to sit on the sidelines, merely finding fault. More to point out what's right with the world, and fewer to keep harping on what's wrong with it and more who are interested in lighting candles, and fewer who blow them out.......... somehow, that quite just feels right . Peace... See ya next Month........................Hamster

MASTERLINK FEBRUARY 2012 by Rod Taylor - ABATE Legal Services New York Motorcycle Stops - We Were Done In By A Cop Getting A Government Grant For His Master’s Degree. Is His Ph.D. Next?

I have written a couple of times about the motorcycle-only checkpoints that have been springing-up around the country. Motorcyclists have not taken it lying down. Suit was filed in a New York federal court, asserting that the stops were unconstitutional and demanding that the state stop using them. The first round in a longer struggle has concluded in New York, with the Federal Court there finding that the stops did not violate the rights of motorcyclists. If you read the decision, you will discover something very interesting starting on page three. The judge noted that, “As part of his Master’s course work at the State University of New York at Albany, Defendant Lt. James Halversen, the commanding officer of the New York State Police Motorcycle Unit, wrote a thesis on the increasing rate of motorcycle fatalities for riders over forty-years old. With the help of Defendant Lt. Daniel Larkin, Halversen submitted a grant application to the GTSC in 2007 to fund the checkpoints. The GTSC, which is chaired by Defendant David J. Swarts, approved the application and funded the initiative with federal grant money “provided by NHTSA and [Federal Highway Administration (“FHA”)].” What the Court failed to note was that the primary cause of death in that age group was speed and alcohol usually involving other drivers.

I find it hard to stomach that motorcyclists were done in by a government funded thesis for a Masters Degree. And that, my friends, is why New York is where it is regarding illegal stops of motorcyclists. If only Officer Halversen had applied for a grant to be used for enforcing alcohol and speeding laws regarding the general driving public, wouldn’t that have been a better use of taxpayer funds? Now, instead of enforcing alcohol and speeding laws which really saves lives, we have cops all over New York pulling us over on our time off and looking at our helmet stickers. Thank God Officer Halversen didn’t request money to study the elimination of motorcycles in general. Who knows where that would have gone? With that kind of thinking, can anybody doubt that ABATE and the MRF are needed now more than ever? Let’s hope the officer gets his degree sooner than later as we can’t afford anymore education disguised intrusion on our constitutional rights. She Fought The Law And She Won Lawyering Drone Style

ABATE member Benitta Yearton and her daughter Rene (16) are fighters and they know their rights. When Renee was given a bogus ticket by Hebron’s best, every bit of their “fight city hall” exploded all over the face of the arresting police officer. Here is what happened and how we became involved. Benitta called us knowing that we do not do traffic tickets, but we were her last

Ask Our Lawyer

great hope. And her question was a good one: “should you pay a traffic ticket that was issued without evidence to back it up?” The answer in a perfect world is never, but in today’s economy, there is not a lot of money for traffic ticket lawyers, especially for the type that would just plead her to a lesser offense and a lighter fine. And who has time to fight city hall?

So what to do when you didn’t do it? Here is the plan that Benitta and I hatched. I would advise her along the way and she and her daughter should go to court and do battle. You know “millions for defense, but not one cent for tribute.” The Yeartons would actually be their own lawyers for a day. With my cell number and me on stand-by, it was like a remote controlled drone situation.

Here are the facts: Rene, age 16, has a perfect, but short driving record. That is until now when “Officer Misguided” appeared. When the traffic citation was issued, the arresting officer advised that he had “heard” that Rene was speeding two days before. The officer was not a witness to anything, and had only been given a report by a crossing guard. The crossing guard could not identify Rene as the driver of offending vehicle and did not get a plate number. Rene drives a Chevolet Blazer S-10. I wonder how many of those there are in Hebron?

Day of trial. When he heard the Yeartons weren’t going down easy, the prosecutor scurried out into the hall to talk plea bargain with Benitta and Rena. He offered a reduced $50 fine and 100 days of court supervision. Stunned at the rejection of his “deal,” the prosecutor mumbled to himself all the way back into the court room saying he could not believe we were turning down such a good deal.

State’s first witness was the errant officer. That was easy. He did not see or hear anything, wasn’t there and couldn’t prove anything. He just took the word of the crossing guard. Can anyone say “hearsay?” Next witness, the crossing guard, who testified that a Chevrolet Blazer that looked like Renee’s was speeding, but astonishingly, could not testify to anything else. Are you wondering how the case got this far? So were we and so did the Judge. After ruling in favor of Rene and against the State, he complimented Rene’s handling of the court proceeding and her mother’s support - remember, Rene is only 16. Of course, I was proudly stashed in my office and satisfied with the thought that our system works “most” of the time. As we all know, “most” is a lawyer hedge word.

P.S. Rene plans to be a teacher. I bet she will have a great story to tell her future students about the time she tried her own case at age 16-and won. I think maybe our system won too. Yellowstone, U.S. 14, And The Big Horn Mountains

The Road To Paradise - Ride It Before You Die

While out in Sturgis, I had the chance to

ride Yellowstone and took U.S. 14 to get there. That road was built in 1926 to get the hordes of Ford Model A’s there in good style. It goes from Chicago and follows I-90. I call it the road to paradise. If it ever had an Indian name, that has to be it.

I used to suffer under the illusion that all U.S. highways could have no more than an 8% grade. Not so! If you want a riding experience that will test your skills, ride U.S. 14 into Yellowstone. Coming from the East, cut through Sheridan, Wyoming and head to Burgess Junction. A few miles out of the Junction, you will be treated to some of the best riding and scenery God ever made as you are smack dab in the center of the Big Horn Mountains. Once you get to the top and start the down-hill slide, stop at the only rest area on the way down and take a moment to collect your skills - you will need it as old U.S. 14 gets narrower and the switchbacks get scarier. Some folks say that the Big Horn Basin was possibly the site of the greatest mammal explosion the world has ever seen. This is riding with knowledge, folks.

As you shoot into Cody on the way to Yellowstone, there are beaucoup campsites that are reasonable and fit the bill for bikers. If you like guns, take in Buffalo Bill’s Museum. And if you don’t take in the Cody rodeo. People from all over the world flock to see this AllAmerican experience. Sitting behind us were Germans, to our left - French, and to our right were a bunch of Scandinavians. The world comes to see us there as this event underscores our American image. But if anyone would have yelled “fire” few would have understood.

As you come out of the rodeo, hang a right. It takes you straight to the Yellowstone gate. What will strike you is the size of the park. It is at least 60x70 miles so calling it a “park” is misleading as it is bigger than some states. Call ahead for campsites (I was not so smart) and live in paradise. You can be just like Jim Bridger, Kit Carson and Jeremiah Johnson for at least one night.

You can’t get enough of “Old Faithful.” It is more impressive than I imagined. Some say that it is part of a super volcano that it will erupt like no other volcano has in the last few million years. When it does, they claim that ash from the volcano will go all the way to Delaware Street in Indianapolis. But don’t fret, as that is not supposed to happen for a few more million. As you leave paradise, you are joining the likes of Teddy Roosevelt and just about anybody that was somebody in the world. And they and you will say that there is no other place like it. Do it and do it again, before you die. Slipping Away

Q: I’m very frustrated and don’t know where to turn. Illinois Central College in Peoria recently repainted some of the road markings, including direction arrows

and stop bars. As part of the painting process, the painter spread glass reflective beads in the wet paint. Apparently, the beads make the paint reflective. As I entered one of the parking lots, my back tire slipped on the painted surface and I went down and was pinned under my Sportster. I broke my right ankle and a had a class three sprain in my right knee and had a possible rotor cuff tear in my left shoulder. Have you have heard of similar accidents like this and is there is anything that can be done to stop this procedure of putting glass beads in the painted surfaces of roadways? It is slippery to walk on and motorcycle tires lose traction on this type of surface. Jim Miller, Tazwell County Illinois, ABATE MEMBER.

Ask Our Lawyer (continued)

A: There isn’t much literature out there on the effect of these types of painting methods on motorcycle traction. Tales told among motorcyclists have long cautioned that riding across painted areas is dangerous, and the advent of thermoplastic road decals have proven the collective wisdom of motorcyclists over and over. I suspect that the same applies to the use of reflective glass beads in paint. Since the use of such paint procedures is approved by national transportation officials, if not encouraged, it will be difficult to get their use stopped. Which means ABATE LEGAL needs to get involved on this one. Once again, the legitimate concerns of motorcycles gets short shrift from the powers that be. Probably our best course of action would be to increase our education and outreach efforts so that

ABATE has, as part of its mission, a dedication to educate riders and drivers about motorcycle safety. There are many ways for all of us to participate in ABATE’S safety goal. Here are just a few:

Happy 2012 Everyone! Welcome new and returning ABATE Chapter Safety Officers!

Safety is everyone’s business. We rely on the Chapter Safety Officers to share information and keep us aware, but all of us are responsible for our own safety and the

riders understand the risks of these painting techniques. In the meantime, keep sending those RoadHazard reports in and we will continue to notify the appropriate officials about our concerns. We will ask Wolf Technical if they will provide some needed expertise on the coefficient of friction regarding the glass beads and will supplement this report. ABATE, though many know it not, is one of the greatest rights organizations ever; but what it reaches for by far exceeds what it has achieved,

and what it has achieved is magnificent.

Take a skills update course. It is good to renew your skills at least every 5 years. The longer we are riding, the more chance to become complacent and less attentive to proper riding techniques.

Attend an Accident Scene Management course. We have learned that we cannot always prevent motorcycle crashes. So, it is important to know what to do should you encounter a crash scene. Take a first aid course. Take a first responder course. Ask your Chapter Safety Officer about

only 28 ½% of total recovery and expenses as approved by client, consistent with and conforming to applicable state law. Elsewhere, you may pay 33 ⅓%, 40% or even 50% of your recovery. And, ABATE members are not charged for recovery of damage to your motorcycle, and have access to a 24-hour toll-free telephone number. Call us at (800) 25-RIDER

If you have any questions you would like to ask the lawyer, please submit them to ASK OUR LAWYER, at rodtaylor@abatelegal.com. © 2011, A.B.A.T.E. Legal Services

how to enroll.

Get involved in spreading the word about motorcycle awareness. Become a Motorcycle Awareness Program (MAP) presenter. MAP presenters are volunteers to present information to high school students who enrolled in driver’s education classes at their high schools. Currently, there is a small group of presenters who are providing the educations in some high schools around the state. More volunteers are needed. For more information, contact your Chapter Safety Officer. Get involved, if your ABATE Chapter does not have a Safety Officer consider stepping up to the job, or share with someone.

Attend Day at the Dome. On February 22, ABATE is sponsoring the event to meet legislators and demonstrate that motorcycles have the power of supporting legislators who are sensitive to the rights and concerns of the motorcycling public

through our right to vote. Being aware of legislation that affects our motorcycling rights goes hand-in-hand with safety. We, as voting motorcyclists, have the responsibility to know what laws affect our riding, thus affect our safety. Show the Arizona Legislature the motorcycle community is watching by attending the event. If you cannot attend the event, learn who the legislators are that represent you and contact them to see how they support you on motorcycle issues. Practice Defensive Riding. The National Highway Traffic Safety Administration published their annual report last fall. You can visit the website www.nhts.gov to see the report. The take home message for me is that DISTRACTED DRIVERS are now the biggest menaces on our roadways. We must be ever vigilant to avoid them running us down. Make 2012 your year for greater SAFETY awareness!

Making a Difference ARIZONA MOTORCYCLIST MEDICAL CARE PLAN (AMMCP) “BIKERS HELPING BIKERS”

Arizona Motorcyclist Medical Care Plan (AMMCP) founded by Medieval Maidens MC as a Non-Profit corporation has created a way for patients to get expedited care while removing some of the hassles and cost of obtaining quality medical care. AMMCP will provide coordination of all primary care needs including office visits, arranging referrals, lab work, outpatient diagnostic testing, telephone consultations, and prescription refills by contracting with a primary care physician.

The plan will allow for every patient to have one complete physical at first visit and two other office visits per calendar year. We will make every attempt to consult with patients regarding their medical problems over the telephone, however, some problems may require a physical examination by the physician to diagnose and treat the problem. We will be able to fill out paperwork for you as well with a

limit of three forms per year including FMLA, Short Term Disability, disability plate/placard for the Motor Vehicle Department, etc. This excludes medical narratives. The enrollment fee for ONE YEAR in The Plan is in 3 levels--$300 for a single member; $500 for family of 2 members; and $750 for a family of 4 members. A $75 administration fee per plan will be charged.

We offer a Payment Plan to help in these tough times. Three (3) consecutive payments and you are a Member of AMMCP for ONE YEAR. $300 + $75 = $125 per month. $500 + $75 = $192 per month. $750 + 75 = $275 per month. That easy!

Within this Plan we are able to manage patients with chronic conditions as well as patients who may rarely need to see a physician. Patients with chronic conditions such as diabetes, high cholesterol, high blood pressure, etc., might be asked

According to the National Highway Traffic Safety Administration 3% of Roadway crashes involve motorcyclists but 17% of roadway fatalities were motorcyclists. Statistically, another motorcyclist is the first to be on the scene of a motorcycle crash. The purpose of Accident Scene Management Bystander Assistance Programs is to reduce injuries and fatalities to motorcyclists through First Response Education.

100 series: Bystander Assistance Program Ͳ “A Crash Course for the Motorcyclist” This course is designed for the average motorcyclist. No prior training is necessary. “BAP” classes have made an impact on over 10,000 motorcyclists! Don’t miss your opportunity to learn the specifics of motorcycle trauma care. Rescuer Safety, Assessment & Treatment, Mechanisms of Injury, Good Samaritan Laws are all covered in this seven hour course. There are no other classes like it! For more information or to sign up for a class, call Jean @ 602Ͳ616Ͳ9855. CPR & First Aid Course This class is for those who need or want CPR & First Aid (Heartsaver) Certification according to American Heart Association guidelines. Chest Compressions, Rescue Breathing, Recovery Position, Choking Interventions and hands on testing are all part of this six hour course. For more information or to sign up for a class call Jean @ (602)616Ͳ9855. Jean Cooper, RN, MSN has been riding motorcycles for over 40 years and has been a nurse for almost as long. She has also been an American Heart Association Basic Life Support (CPR) Instructor for about 30 years and a Certified Accident Scene Management Instructor for the past three years. She has passion for motorcycling safety. Let her share her knowledge and enthusiasm with you!

to send in an update form occasionally to keep the physician informed of your current condition(s). This form will include your vitals (blood pressure, weight, etc.), an area to update your family and personal medical history, and a section for you to make notes related to your medical condition(s). The physician may require you to also have your blood tested periodically if you are on certain medications or for some medical conditions, i.e.: thyroid, diabetes, and high cholesterol. This is in accordance with the standards of medical care that all physicians must adhere to. There may be other medical conditions which require frequent monitoring by either the update form and/or lab work. This Plan can be purchased and used in conjunction with your insurance with the exception of Medicare, Medicare Advantage, and AHCCCS plans.

We do have other services available not included for an addition fee outside of this base price including OMT/Manipulations, weight loss, adult immunizations, and minor skin procedures. If additional visits are needed before the calendar year is up, these will be at the cost of $25 each. We have an imaging facility and a lab who have agreed to provide discounts for our patients without insurance. Those would be billed to you separately.

Exclusions of The Plan include chronic pain management, and any psyche diagnosis other than mild depression or anxiety as determined by physician.

If you have any additional questions regarding this Plan call AMMCP Administrators Kat (602) 758-2201 or Mariah (623) 238-2211. We look forward to helping you.

MASTERLINK FEBRUARY 2012 A.B.A.T.E. of Arizona has lost another great freedom fighter.

It is with a very heavy heart that I write this letter to you all.

Robert Vasquez passed away on Jan. 14th, 2012 after complications due to health problems. He passed away with his wife Cheryl and his family by his side. Robert was a devoted husband, father, grandfather and freedom fighter. Robert was an A.B.A.T.E. East Valley Chapter member and our Sgt. of Arms. Robert and Cheryl, his wife of 34 years have been very active in our chapter. You might not have heard Robert because he was a quiet guy but he and Cheryl were always in the background making sure everything got done and went smoothly. They were always ready to volunteer for whatever needed to be done at every event we had. From running a stop for

PAGE 15

God Needed Another Angel

the Hard Ass Run to helping out at the spaghetti feed or helping with security, registration or merchandise at Too Broke. Even if his bike was down, Robert would drive his truck and haul everything we needed for an event. He was always ready to lend a hand to anyone who needed it. He has been a true asset to the East Valley Chapter. He was truly a big part of our family

Robert was born in Colorado on September 22nd, 1957. Robert and Cheryl came to us from Oregon where they were very active in A.B.A.T.E. of Oregon with toy runs, camp outs, poker runs and membership drives. They moved to Arizona in April of 2000. They joined the East Valley Chapter when they came to their first meeting and have been very active with us ever since. I just can’t say

enough about Robert and Cheryl and what they have meant to all of us.

We are all blessed to have had Robert with us if even for a relatively short time. I am honored to have known Robert and very proud to call him my friend and my brother. Ride free Robert. We’ll all be up to see you someday.

Robert is survived by his wife and love of his life Cheryl, his three sons Michael (and Rachelle), David (and Alysha) and Bobby (and Yvonne) and his grandson Kayden in Oregon. Please keep Cheryl and their family in your thoughts and prayers. Jack Batty A.B.A.T.E. of Arizona East Valley Chapter Vice Coordinator

Report Says Arizona Has Second-Worst Traffic-Safety Laws in the Nation

WASHINGTON - Arizona got a failing grade Wednesday from a national highway safety group that said the state has adopted fewer than five of the 15 laws the group considers basic to traffic safety.

Only South Dakota ranked lower than Arizona in the ninth annual report from the Advocates for Highway and Auto Safety. It rated Arizona poorly for its failure to adopt strict laws on teen driving, seat belt and motorcycle helmet use, and distracted driving, among others. Arizona has "some of the weakest laws and yet they're surrounded by states that have better laws," said Jacqueline Gillan, the group's president. "This is really a call to action for Arizona to step up and start passing these laws." Her group said crashes killed more than 700 people in Arizona in 2010, at a cost estimated by state officials at $2.7 billion.

"It doesn't make sense when you look at the economic cost and carnage on the Arizona highways that they are still ignoring some really effective public health interventions that could really bring down deaths and injuries and costs for the state," Gillan said.

But state officials challenged the report, saying the laws it identified as crucial "aren't going to help us."

A report on the website of the Governor's Office of Highway Safety says traffic deaths in Arizona of unrestrained vehicle occupants, alcohol-impaired drivers, motorcyclists without helmets and teen drivers all fell from 2006 to 2009. This in a state that does not have the strict laws for enforcing seat-belt use, requiring motorcycle helmets and restricting teen drivers that the highway safety group says are needed. "We are following what our indicators are and pushing to do safety programs to save and prevent tragedies," said Alberto Gutier, director of the Governor's Office of Highway Safety. "We don't have to consult or react to anything the rest of the country does." Gutier said traffic deaths across the nation have fallen steadily in recent years. That trend is mirrored in Arizona, where the number of highway fatalities went from 1,293 in 2006 to 807 in 2009, according to both the state and the National Highway Traffic Safety Administration.

The number fell again to 762 in Arizona in 2010, according to the Advocates for Highway and Auto Safety report.

Gutier and Gillan agreed that part of the decline has been driven by the poor economy, which made gas relatively more expensive and resulted in fewer drivers on the road. But Gutier said there are other factors, noting that Arizona was one of five states to earn a five-star ranking from Mothers Against Drunk Driving in a report released in November. That ranking was based on drunken driving countermeasures, such as ignition interlocks and sobriety checkpoints.

"Law enforcement has done a fantastic job in Arizona," of enforcing laws already on the books, Gutier said. The report by Gillan's group did score Arizona relatively well for its drunken driving laws, noting that the state had almost all of the recommended restrictions: a ban on open containers, a requirement for ignition-interlock devices for drunken drivers and stiffened penalties for drunken drivers who endanger chil-

dren. The state only got half-credit for its law requiring blood-alcohol tests on drivers killed in crashes; the report prefers that those tests also be required on drivers who survive crashes in which someone is killed. Gutier said his office plans to allocate the majority of its funding to preventing traffic fatalities.

"I'm questioning the whole ranking and the whole report," he said.

Ray "Still Ray" Fitzgerald, chairman of the 7,000 members Arizona Confederation of Motorcycle Clubs, said it would be difficult for state lawmakers to require that all motorcyclists wear a helmet, which the report would prefer.

Fitzgerald, a motorcyclist of more than 40 years, said motorcycle-rights organizations like his support a "pro-choice" stance on helmets. The Prescott resident said he wears a helmet when it snows. "I'm not against wearing helmets, I'm against being told that I have to," Fitzgerald said.
