And again, Motorcycle Day at the Dome is 12 March 2014. I strongly suggest that everybody starting around the 24 of Feb. start contacting your state legislators for an

appointment to speak with them on 12 March. You have one State Senator and two State Representatives, If you do not know who they are you can go to (www.votesmart.org), enter your zip code and it will tell you who your legislators are. Ask your legislators to meet you on the lawn for lunch and to meet their motorcycling voters. As of this printing three different wraps from the Hop Shop will be served. The other two Lobbyist and I will be available to speak to your legislators with you if you think that you need that and talking points will be available. We are also looking for volunteers to help with last minute legislator searches and spot policing of the grounds. I am still urging every rider to urge their Federal Legislators to sign the

"Petri letter" to the CDC to tell them to back off of their unreasonable assumption that we all need to wear a helmet.

I hope to see lots of you at the Capitol on 12 March, they are your rights that we are trying to protect. We do all of this for every motorcycle rider in this state, Patch holders, Independents, AMA members, SMRO members, If you ride, your rights are important to us and I hope it's that important to you as well. As always much love and respect. and keep the shiney side up and the rubber side down. Watch out for cars because they are probably not watching out for you. On Monday, January 13th, 2014 the 51st AZ Legislature, 2nd regular session, convened. That means there will be multitudes of proposed bills hitting the House and Senate at our State Capitol. Our lobbyists’ job is to sift through those bills to ensure that we identify each and every one that could infringe on your freedom to ride your motorcycle. This is exactly why I became an ABATE of Arizona member back in 1998. I realized that I cannot rely on main stream media to keep me informed as a biker, about what’s going on at the AZ Capitol that affects me directly.

As we identify motorcycle-related bills that we want to endorse or squash, we will send out email alerts to the ABATE Discussion e-list, asking that you notify your State Senator or State Representatives accordingly, and we will provide suggested wording/arguments. In order to receive these e-alerts, you must sign up at the ABATE of AZ website. We do not automatically add you to this list. A lot of you have been getting pulled over for ape hangers, as an excuse for L.E. to interrogate you and check you out. We would like to get the current 15 inch handle bar height limit law repealed. It would help get bill sponsors if we can find veterans that ride with tall handle bars to alleviate shoulder or back pain while riding. If you are one of those, please contact us at lobbyist@abateofaz.org

On the Federal level, we continue to monitor the National Highway Traffic Safety Administration (NHTSA) program that pays private contractors that use state and local law enforcement to conduct checkpoint programs and collect blood samples or mouth swabs from drivers. This is a “voluntary” program, even though they force you off the road into a parking lot. You do NOT

have to participate. “NO THANK YOU OFFICER, AM I FREE TO GO NOW?” On January 9, U.S. Rep. Jim Sensenbrenner (R-Wisc.) sent a letter to U.S. Dept. of Transportation Sec. Anthony Foxx requesting information on this program.

Sensenbrenner is sponsor of H.R. 1861, Stop Motorcycle Checkpoint Funding Act. As of this writing, there are 42 cosponsors to this bill. The only AZ U.S. Rep. is Ann Kirkpatrick. Please write or call your U.S. Representative and ask them to co-sponsor H.R. 1861. In the coming weeks, the U.S. Senate will introduce a bipartisan bill to ban federal funding for motorcycle only check points, too. Currently, only New Hampshire, Illinois, California, Missouri and Virginia have restrictions on motorcycle only checkpoints. This has allowed other states to continue to employ this discriminatory and ineffective practice, especially during rallies and other large motorcycle events such as Rolling Thunder in Washington, D.C. and Daytona Bike Week in Florida. When this bill is introduced, ABATE will send out e-alerts asking you communicate with your elected officials, urging them to support this important measure. “Motorcycle only check point ban” was recently voted by our members as their #1 concern. So, when we ask that you contact your representative/senator, PLEASE DO IT. We can get it passed, if we come together in ONE LOUD VOICE!

Regarding the E-15 fuel EPA wants to force into your gas tanks, 10 major car companies and several motorcycle manufacturers will void your warranty if you use this fuel. AAA advises DO NOT USE THIS FUEL in vehicles older than 2012! The problem is that the ethanol and gas separate. The ethanol is heavier and very corrosive and will damage fuel systems, emission systems, engines, gas-

2.a.1. Discussion: Lengthy and lively discussion regarding cash flow and proposed budgets for the organization followed. The future of the organization depends on conscious spending. Projected budgets guide organizational spending and must be presented in a format that is clear and understood by all. If submitted in a timely manner, budgets provide fiscal guidance for the coming year. The BOD and State Officers must be aware of spending and possible income sources. Membership dues provide some income, but not enough to run the organization. The main fund raising event for the organization is Too Broke for Sturgis. However, it is costly production. In recent years it has not been as profitable due to the costs of production. Costcutting opportunities must be explored this year. It is fiscally risky for the organization to rely only on Too Broke to sustain the financial health of the organization. Merchandise is another area of potential income. We have not done well promoting the sale of ABATE products. The White Bandana project could be an income opportunity. Currently, they are free promotional items. Scottsdale H-D had pledged to support the project with approximately $200 monthly. However, that has not been consistent. We should consider corporate sponsorships, possibly through social media. Masterlink is a large expense. Ways to decrease spending on the monthly publication must be explored. ABATE had loaned an undisclosed amount to ARA (ABATE’s Rider Advantage) for start-up. Perhaps ABATE could request early repayment of the loan. Discussion concluded with comments regarding informing the general membership of the state of the financial health of the organization. Everyone should know these are austere times for ABATE. Current spending is too great for the organization to survive, without change. Action: 2.a.1.a. Priorities for spending will be communicated to the Treasurer to enable him to develop a working budget. Responsible person: Mary K Donnay and Matt Brown will work together. 2.a.1.b. ANATOMY OF A SLIP AND FALL CASE

Cary Scott stayed at a hotel recently, La Quinta Inn. He is a good customer and will be returning in a couple of weeks. His job as a project engineer takes him all over the U.S., but he is originally from Flora, Illinois, an ABATE member, and regularly reads this column. He is a stand tall, pays his bills, supports his family, votes, never been sued or ever sued anyone kind of guy, and a pretty good pool player. And he needed some help from ABATE LEGAL. Here is the problem. In early December, he was leaving the Inn, minding his own business, watching where he was going and slipped on the wet tile at the exit door all the while wearing Wolverine boots with one of the best non slip soles God ever made. Partially catching himself in the fall, Scott injured himself and tore a leather coat. The staff at the hotel quickly placed a weather mat at the entry of the hotel to take care of the slippery nature of the tile. ADMISSION NUMBER ONE. There is also a video camera at this entrance area. ADMISSION NUMBER TWO. After the treating doc examined him, a prescription for pain pills was given and he went about his way. Hopefully he just got shot at and missed and would be ok in a few. All of this was communicated to the folks at the hotel and they promised that they would get with him regarding his medical bills and damaged coat - over a month ago. ADMISSION NUMBER THREE.

After getting no response from La Quinta, Scott called ABATE LEGAL as he suspected they were ignoring him. In today's world many companies pass their responsibilities to companies with nefarious names like “risk pool managers, risk assessment evaluators, risk adjustment bureaus” etc. You get the idea. Just like in a John Wayne movie - they went that away. My experience is that delay, avoidance and the like are part of the strategy - “if we don’t call them back maybe THEY will go away and we don’t have to pay THEM.” “Let’s make it too hard to deal with us.” Hopefully that will not be the case with La Quinta - but we shall see. Scott is a straight shooter and only wants to be reimbursed for his losses. He has read my previous article on signing releases and so he knows that nothing should be signed that would waive any right to claims he may have for permanent injuries. He needs to continue with his medical treatment to make sure that his problems are not permanent and that he will not need surgery in the future. Nothing worse than having signed a full and complete release for a few hundred bucks, only find out a couple of months later that you need shoulder surgery and may not be able to do your job - or worse. In the meantime Scott will copy me on all correspondence to La Quinta and their “risk pool manager.” Hopefully that will help; and

hopefully his injuries are temporary; and hopefully the hotel will do the right thing and that I will not be needed. But if I am needed, we are prepared to help him to the next step because it is the right thing to do. And he wants his experience published so that others can benefit from his efforts. We will keep you posted as his case develops. Remember that America is one of the safest countries in the world according to my theory. First, we don’t want to get hurt ourselves, Second, we don’t want to hurt others, and finally, if you have to pay for what you break you are that much more careful. It is that simple. SCOOTERS, MOTORCYCLE COPS, WILLIAM MIDDLETON AND TRAFFIC COURT

William Middleton is a wonderful success story, but it did not start out that way. Twenty years ago he had it all. He was married with a wonderful family and a good job. But he was also in a serious relationship with DEMON RUM. He was an alcoholic doing what many alcoholics do - drinking and driving his way through life. He did this so much that the law threw the book at him and took his driving privileges for a decade. It was then that the light bulb came on. He quit drinking and started appreciating life booze free. He became a wonderfully changed man. And about that time he started riding a scooter as his way to work. You know one of the 49cc jobs made in China or somewhere, with a foot pad, no requirement for insurance, registration, or a drivers license (or so we thought). Life was good, real good. He reconnected with his responsibilities and never had another drink.

The scooter worked for him. When he asked how he got to work when the rest of us were snowed or iced in, he would demonstrate the scooter “V” with his legs spread as far as they would go astride an imaginary scooter. He claimed it was a “hell of a two wheeler”, which got him to work no matter the weather, and for cheap. But then he was stopped by a motorcycle cop for going 40 in a 35 (what?); slapped with an “eight pack of charges” designed to get him off the road and derail his new life of meeting his obligations. After being charged with eight traffic violations (speeding, no license, no license in possession, no registration, no registration in possession, no motorcycle endorsement, no insurance, and exceeding speed for a motorized bicycle) William gave us a call to see how it was possible they could give him all those tickets, and if there was anything we could do about it. It’s been 20 plus years since I stepped foot in traffic court, but the thought of him getting stuck with over a $1,000 fine for going 40 in 35 was a bridge too far. I felt like the guy in No Country for Old Men - agua. I did not want to get involved, but I couldn’t help it. So I became a traffic court lawyer for a day been a while since I have been there. Turns out, Indiana law on scooters/mopeds is about as clear as the roads after this year’s blizzard. Since the law is so muddled - local law

enforcement has come up with their own rule to determine whether your scooter is a “motorcycle” requiring a license, registration, insurance, and an endorsement. Here is the rule: if the manufacturer’s identification tag on your scooter lists the vehicle type as a “motorcycle” then you will be subject to the laws for operating a motorcycle. You know that old adage, “looks like a duck, walks like a duck, etc.”, well apparently even though it looks like a scooter, rides like a scooter, and is defined as a scooter by Indiana law - it is not a scooter (per the higher ups). And it seems that every two wheeled vehicle made for street use, in Indiana at least, happens to be labeled a “motorcycle” on the manufacturer's identification tag, even if it is under 50cc, has a floor pad, and is really a scooter. In the end, the prosecutor agreed to drop 7 out of the 8 charges - except for the speeding. C’mon, 40 in a 35 - who gives a ticket for that? But my guy says that the cop nailed him right on the speed. It wasn’t a complete victory - but it was a hell of lot better than where we started. Moral of the story - if you ride a scooter in Indiana without having all of the requirements for riding a motorcycle you might end up with an eight-pack of charges (even if you kicked the habit years ago). CAN I CUT THE BITCH/BASTARD OUT OF MY WILL? (LET’S TRY THAT AGAIN) CAN I DISINHERIT MY SPOUSE?

Q: I have been married for 22 years, but we are no longer getting along. She is my sole beneficiary under my Last Will and Testament - CAN I CUT HER OUT OF MY WILL?

A: Most states let you do what you want with your stuff [personal property and real estate] when you die. However, most states will not let you cut out your spouse completely unless they agree. In many states, including Ohio, Indiana and Illinois, a surviving spouse can renounce your Will if you have cut her out and elect to receive a percentage of your assets, regardless of what you provide for in your Will. And you thought you got rid of him/her! WHERE THERE'S A WAY, THERE SHOULD BE A WILL

Q: I want to do my will, but I'm not sure what I should put in it or what I need to consider when I'm doing my will. A: Anybody who's ever heard me speak at one of the state meetings knows that I think everybody should have a will. They don't have to be complex, and they don't have to be expensive. We do wills for ABATE members for free!

When you are ready to make a will, there are several things you will need to think about and come to a decision on: • Who should receive my property? • Who should take care of my minor chil-

PAGE 3 dren? • Do I need to create a trust for my spouse or minor/adult children? • Do I want to make any charitable gifts? • Should my life insurance go to a trustee or directly to the beneficiaries? • Who do I want to administer my will? • What about taxes?

If you already have a will, you should review it to make sure it is up to date and reflects changes in your marital status or changes in the beneficiaries you named. And by the way, there are several requirements that have to be met to ensure that the will is valid. In general, the will has to be made by some over 18 and of sound mind and memory. Also, it must be in writing, signed by the maker, and witnessed (with signatures) of two disinterested persons (not anyone who would benefit from or is named in the will). Upon the death of the person who made the will, it is presented to the court, who will make sure it is valid and provide appropriate orders to make sure the instructions are carried out. If you don't have will, or want to make changes to your will, call ABATE LEGAL SERVICES. We will do your will for you, free of charge!

On Monday, December 30th we received notification of a cluster of potholes that needed attention on 21st Street in Indianapolis (at 10:58 AM). We promptly reported this area to the Mayor’s Action Center, which is the go-to for road issues within the city limits. After reporting this area, we sent an email to Josh Cornell (the gentleman who made us aware of this issue) advising him to let us know when the potholes had been fixed. We were astonished to receive an email from him at 2:58 PM (the same day) that a majority of these had already been filled! Thanks to Josh and the MAC for your help in keeping our roadways safe! New RTS System Makes Everyone More Efficient

STATE CAPITOL, PHOENIX (Jan. 2, 2014) – The system allowing members, lobbyists and the general public to request to speak at a House or Senate committee meeting will be much improved in 2014. The improvements will make it possible for committee chairs to re-arrange agendas on the fly, and will make it easier for users to speak on bills being heard in separate com-

mittees with overlapping meeting times. The three main improvements to the Request To Speak (In Committee) System are: • Committee chairs will be able to easily rearrange the order of agendas • Users will be able to access re-ordered agendas via smartphones and other devices • Agenda items voted on during committee will be updated in real-time Committee chairs can easily rearrange an agenda to suit a meeting’s immediate circumstances with the new RTS system. And as agenda items are heard that information will be updated in real-time allowing users to follow the committee as it works through each item on the agenda. Consequently, users who have bills being considered in two or more committees that are meeting at

the same time can better gauge which committee to be at first and when to leave it for the next one. Mike Braun and his team at the Arizona Legislative Council will hold two meeting Thursday, Jan. 9, at the House on how to use the new system. Committee chairs are strongly encouraged to attend one of the sessions. East Valley Chapter

Greetings,

On Sunday, December 22, East Valley ABATE members gathered for our last meeting of 2013 at the FOE in Mesa. Joe Ferrucci conducted the meeting. Jeff Gorall kept the minutes.

Richard Dalton led us in the Pledge and a moment of silence. Jessica Method informed us of our financial status. A warm thank you goes out to Jeff and Jess as they served in these officer capacities for the last time in 2013.

Jim Silk brought us up to date about the ARA, as well as his and the committee's efforts to secure a band for TBFS. Jim also informed us that MAP continues to be successful as new classes are scheduled for the end of February.

Additionally, as Safety Officer, Jim wisely reminded us to check our tires' air pressures regularly. As the meeting continued, we discussed the membership renewal process, and learned that the venue site for TBFS 2014 is still being negotiated to ensure the best circumstances possible for ABATE of AZ. We talked about upcoming events: New Officer Training; Skin and Steel; and Motorcycle Day at the Dome on March 12, 2014. Mary K also mentioned that the AMA had requested a meeting with the CDC regarding the proposed helmet law.

Mary K talked about the forced exit from a highway up in North Texas, where drivers were asked for "voluntary" saliva samples. This was a good segue into the importance of us knowing our rights, and the timeliness of our upcoming guest speaker, Matt Brown, who is scheduled to talk on search and seizure on January 26th.

Finally, in the spirit of the season, we dug into the delicious potluck food. Thank you to all who came and visited and brought food to share. Breaking bread with fellow members was a nice way to end the year, as we look forward to working together in 2014 to protect

In Arizona, a conviction for any type of felony suspends a variety of civil rights. Many people do not realize that, in addition to any other punishment they are receiving when they plead guilty, they are also losing the right to vote, the right to hold a public office of trust or profit, the right to serve as a juror, and the right to possess a gun or firearm. The process for restoring those rights depends on a variety of factors.

If you have not previously been convicted of any other felony, every civil right except for the right to possess weapons is automatically restored as soon as you 1) pay any remaining fines or restitution and 2) complete your term of probation or receive an absolute discharge from prison. You do not have to do anything to get most of your rights back. Your right to possess weapons is different, however, and even if you are a first-time offender, you must apply to the court to restore that particular right. If you were placed on probation, you can do that at the end of your term of probation, but if you went to prison, you have to wait two years from your absolute discharge from prison. The situation is the same with regard to getting your non-firearm rights back after your second felony conviction. You must

First off, thank you Chick-n-Bone for your service to High Country, we all appreciate you. I would like to thank H.C.C. for their faith in me, I see it as a huge honor. Second I would like to congratulate all our new Officers, and the others that remain in their positions. Thank you all for stepping up. Also to our State Officers, congratulations and thanks.

Winter is definitely here, so if you are traveling up to the high country pack your cold weather gear. Remember, there may be ice on the road in spots. Stay alert, keep in mind this is elk country, and they don't hibernate. Don't meet one by accident.

Well, as Chick-n-bone mentioned in his last report, Barbie Hensler's Memorial Toy Run was a huge success. We brought in a lot of toys and cash donations for coats and such, to help the less fortunate children of the rim country area. We enjoy helping these struggling families, and will continue to do so.

In our Jan. meeting we will be planning our 10th annual Wild In The Weeds, at Jake's Corner. We expect this to be the biggest one we've ever had. We hope to see you all there, it's sure to be a lot of fun. Ride safe everyone.

is quite an event. The poll taken at the last meeting placed Motorcycle only checkpoints at the top of our top ten issues to address this year. There is already a federal bill in the works to ban federal funding of MC only checkpoints.

We are also preparing for Motorcycle Day at the Dome on March 12th. We had a good turnout last year. Hopefully this year will be even bigger.

Southern Arizona Chapter

First of all as this will be published in the February issue, the members of the Southern Arizona Chapter hope that everyone had a safe and joyous holiday! Due to the timing of our meetings and the deadline for the Masterlink it seems we are always behind.

The December meeting was held at the Kettle Restaurant on December 21st. The meeting started at 9:00 AM.

We had a discussion on the upcoming Officers Train to be held in Phoenix and all members, Officers or not, were encouraged to attend to see how things are run and to gain some insight on what is required to be an officer. It was also mentioned that this a great opportunity to meet the new State Officers and other ABATE members from around the state. The minutes and treasurer reports were accepted.

We once again had a discussion on ideas to increase attendance at our meetings and to increase membership. At present we have 71 active members and 10 Businesses with 2 memberships each for total of 91. This is down from a few years ago and we need to make a real effort to increase membership in the

apply for restoration of those rights, and you cannot do so until the end of your term of probation or until two years after your absolute discharge from prison. To get your right to possess firearms back after a second or subsequent conviction, you have to wait until two years after you have completed your term of probation or received an absolute discharge from prison.

If you were convicted of a “dangerous offense,” which is defined as any offense “involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the intentional or knowing infliction of serious physical injury on another person,” you can never file for the restoration of your right to possess or carry a gun or firearm. If you were convicted of a “serious offense,” which includes a wide variety of different offenses currently listed in A.R.S. 13706(F)(1), you have to wait ten years before you can apply. With those two types of offenses, it does not matter whether it is your first or second conviction. You are either permanently barred from possessing weapons or must wait ten years, depending on your charge. Not everyone convicted of a felony was convicted in Arizona, of course, and that can make a difference as well. If your civil rights were lost because of a federal felony conviction, you can apply for restoration of civil rights to the presiding judge of the Arizona Superior Court

where you reside in basically the same manner as you would for a second or subsequent Arizona felony offense. Unfortunately, there is no way for you to restore your right to possess a gun or firearm if you lost it because of a federal felony conviction. The same is true if you lost your federal firearm rights due to a qualifying misdemeanor domestic violence conviction in state or federal court. Believe it or not, you can forever lose your federal firearm rights for certain types of state misdemeanor convictions even though most state felonies carry no such penalty. Furthermore, there are no provisions in Arizona law to restore any of your rights lost as a result of a felony conviction in another state. Finally, there is one other step to help undo the damage of a criminal conviction that many people do not realize is available to them. In Arizona, there is not really such a thing as “expunging,” but the law does allow for a person to ask the court to “set aside” a conviction. If you are successful, that means the judge will issue an order saying the judgment of guilt is set aside in your case and that the court is dismissing the accusations or information and ordering that you be released from all penalties and disabilities resulting from the conviction except for certain MVD and game and fish commission implications.

You cannot set aside a conviction for a dangerous offense, an offense where you

Safety Officer Jim DeYoung discussed what to do when you come upon a accident scene. Remember that the first thing you should do is the call 911. Then begin checking to see what needs to be done. This is important so that emergency responders are on the way while you help those in distress. Sean Pinder our PAC rep spoke about upcoming events for the New Year. Motorcycle Day at the Dome is set for March 12th. Sean also went into some detail on the difference between the Freedom Rally of the past and MDATD for those not familiar with them. We reminded everyone the Too Broke for Sturgis will be held in June this year instead of July as it has in the past. This is to try and eliminate the problems we have had in the last few years with the rains that usually hit in July. Remember the change as you plan for Too Broke!!

We encourage all ABATE members to become more active and to join the MRF and AMA to stay on top of national issue that affect all riders. Also when talking to prospective members, remember that there is a Club membership available that includes 5 memberships. Bill Filed to Add New Classification of 3 Wheeled Vehicles

While going through introduced legislation this morning I realized that I forget to share the most recent legislative activity in the Virginia General Assembly with the list. In an effort to keep everyone informed as to what is going on in other states below is a post that went out on December 18. I apologize for the tardiness.

Today Delegate Ed Scott introduced HB 122. This bill creates a new classification of motor vehicles called autocycles. Under the bill an autocycle would be

"Autocycle" means a three-wheeled motor vehicle that has a steering wheel and seating that does not require the operator to straddle or sit astride and is manufactured to comply with federal safety requirements for motorcycles. Except as otherwise provided, an autocycle shall not be deemed to be a motorcycle.

The goal of the bill is to take three wheeled automobiles, which are currently defined as motorcycles, and give them

their own classification. The benefit of this bill for the owners of these hopefully soon to be autocycles is that they will no longer have to obtain a motorcycle endorsement in order to operate their three wheeled cars. The benefit of this bill for motorcyclists is that these vehicles will no longer be part of our crash data. I would like to thank all of you, Veterans and new energy and ideas alike, for stepping up to volunteer to help protect motorcycling. Volunteering is often a thankless job in which we all sacrifice valuable and limited time often competing with Family and Friends, as well as our Professional lives. ABATE of AZ is a non-profit that depends on the Officers and Members alike to contribute and volunteer at the level for which each person is comfortable and able to do or ABATE of AZ will cease to exist.

However, ABATE of AZ also needs to raise sufficient revenues to cover costs for the many valuable programs that ABATE AZ funds and promotes. Some of the valuable activities included are the Motorcycle Awareness Program (MAP), Safety Awareness Events, White Bandana Program, Accident Scene Management, Motorcycle Day at the Dome, and the SOH Defense Fund. Further, ABATE is active to Lobby our Public officials and collaborate with other Motorcycle stakeholders to protect Motorcycling and Promote Motorcycling in a positive image. All of these activities including Motorcycle Day at the Dome and educating ourselves through Seminars cost money. The annual Too Broke For Sturgis (TBFS) event is our primary fundraiser

So, for the time being, there has been a Moratorium on travel expenses as well as spending on all activities above, except those approved by a State Operating Budget. I personally apologize for the inconvenience to Officers as I do consider reasonable travel expenses as a valuable and acceptable expense to help relieve Officer Hardship as a small consolation for their volunteerism. However, denial of reality will not help ensure ABATE of AZ exist past 2014.

The Board and State Officers are continuing to Brainstorm for other Revenue Streams in addition to TBFS, while also re-evaluating costs versus benefit. All Officers and Members are welcome to contribute in the conversation at a Chapter, Committee, State or Board meeting. As an Organization we need to create a better conversation with our members and in many cases appreciate every level of volunteerism from the basic level of being a member, to attending meetings, attending events or assisting with activities to stepping up as an Officer. Most members only want to volunteer as a member and never attend a meeting which should be perfectly acceptable. There is a fine line between inspiration and a nag. When Officers resign or members are unable to contribute at a meeting or an event for whatever reason we need to simply thank them for the level of the contribution as a member first and the additional levels of volunteerism they are comfortable with and are able. When a leader steps down, we need to leave the guilt trip at the Altar and the knee jerk

Pa. Police Pull People Over for Random DNA Tests for Feds

Pennsylvania police this week were pulling people to the side of the road, quizzing them on their driving habits, and asking if they'd like to provide a cheek swap or a blood sample — the latest in a federally contracted operation that's touted as making roads safer.

The same operation took place last month at a community in Texas. Then, drivers were randomly told to pull off the road into a parking lot, where whitecoated researchers asked if they'd like to provide DNA samples for a project that determines what percentage of drivers are operating under the influence of drugs or alcohol at given times.

With uniformed police in the back-

ground, the researchers also offered the motorists money — up to $50 or so — for the blood or saliva samples.

Apparently, next stop: Reading, Pa.

Police there joined forces with the Pacific Institute for Research and Evaluation — a company hired by the National Highway Traffic Safety Administration and the White House Office of National Drug Control Policy — to conduct the road stops. And even though the drivers were told their provision of DNA was purely voluntary, many complained about the insistent quizzing and overall feeling of pressure — and that they were pulled to the side of the road in the first place for a research project, the Reading Eagle reported.

"I feel this incident is a gross abuse of power on many levels," said Reading resident Ricardo Nieves, in a complaint to the town's City Council earlier this week, Fox News reported.

Last month, the police chief of Fort Worth, Texas, actually issued an apology to drivers and residents, and promised to never participate in the federally driven study again. Fort Worth residents had complained about the high-pressure questioning, the intimidating presence of uniformed officers, and what they called a clear hit to their constitutional rights.

extent of drunken and drugged driving statistics as part of an overall fight to lower road crashes and driving-related injuries. And he said the cheek swab requests weren't aimed at collecting DNA but rather checking for the presence of prescription drugs, Fox News said. Moreover, he claimed police only served as security and weren't actually pulling drivers to the side or asking questions.

"In the grand scheme of things, I think it's a pretty innocuous and minor issue," Mr. Heim said, in the Reading Eagle.

The American Civil Liberties Union of Pennsylvania is watching the operation closely, claiming such checkpoints are only constitutional if they're aimed at protecting the safety of the public, Fox News reported.

AMA: Federal Lawmaker Requests Information on Checkpoints

On Jan. 9, U.S. Rep. Jim Sensenbrenner (R-Wis.) sent a letter to U.S. Dept. of Transportation Sec. Anthony Foxx requesting information regarding a checkpoint pro gram administered by the National Highway Traffic Safety Administration. As reported by news media, the NHTSA checkpoint program pays private contrac-

tors that use state and local law enforcement to conduct checkpoint programs and collect blood samples or mouth swabs from drivers. Sensenbrenner is leading the fight against motorcycle-only checkpoints and is the sponsor of H.R. 1861, Stop Motorcycle Checkpoint Funding Act.

The American Motorcyclist Association is working aggressively on the MOC issue and expects more positive developments in the near future.

Young Activist Scholarship Award: Guardians of Motorcycling

Back in 2004 the motorcycle riding community saw a gaping hole in the future of the young rider’s safety and education. The development of the YOUNG ACTIVIST SCHOLARSHIP AWARD came to fruition. Motorcycle Riders Foundation Awareness and Education, Inc. (MRFA&E) funds and promote this program. MRFA&E is a 501 c (3) dedicated to safety and education.

The following out lines the criteria necessary to qualify:

1) Nominated Candidates must be between the ages of 18 and with a valid Motorcycle Endorsement on their Drivers License. 31st Birthday must fall after the Meeting of the Minds (MOTM’S) for that year. 2) Candidates must be a member in good standing of a State Motorcycle Riders Organization (SMRO). Length of membership required in SMRO to be determined by its members if candidate is qualified.

3) Candidates must be nominated by their SMRO. Nominations will be accepted by their state or local (District/Chapter/Local) SMRO groups, and must be submitted on an MRFA&E

approved application.

4) Nominations must be submitted between October 1st and July 15th and postmarked no later than July 1st of the year for which the application is submitted.

5) Candidates are to submit a minimum three hundred (300)-word essay on why biker’s rights are important to them. A well written essay from the heart is like a picture or blueprint of who the candidate is; coming directly from the candidate, this gives the committee members a better perspective of the individual. Include the essay with the MRFA&E YAS Application Form. WHAT DO CANDIDATES RECEIVE?

1) One year membership to the Motorcycle Riders Foundation, effective the first full day of the Meeting of the Minds (MOTM) during the year in question 2) Round-trip travel expense to the Meeting of the Minds (MOTM) conference.

3) Hotel accommodations at the Meeting of the Minds Conference.

4) Meeting of the Minds conference registration and fees. 5) Special recognition at the MRF Meeting of the Minds conference.

In a recent article the, AMA Board of Directors took a position related to lane splitting, as well as lane filtering, to help you understand this issue, I have researched some information to help you, the motorcyclist, make an informed decision about what you would like to see happen.

Recently an article was written wherein the author claimed that our lobbying efforts were a waste of time. His conclusion was that we should return to the original mission of ABATE which is education. I remember reading Easyriders in the seventies and the original ABATE acronym stood for A Brotherhood Against Totalitarian Enactments. It was initially formed to fight against governmental restrictions on the lifestyle of bikers. Our fight against laws that criminalize or attempt to end our lifestyle has been going on since the advent of motorcycling. Our strength has always been in our numbers and our willingness to petition the government for redress of griev-

We would ride through a gauntlet of armed police carrying full automatic weapons. A sheriff had his tank there for benefit of the viewing public. Three police departments in the east valley who regularly violate our rights and claim the need to keep the public safe from us. In 2013, for the first time in memory, the Florence Prison Run was not populated by an army of armed cops. This was due to the efforts of a bill that sought no more than to train officer candidates a little differently. When our

Can the front brakes fitted to your bike lock the wheel, or lift the back off the deck? If ‘yes’, then they have all the power you can use. Most modern bikes’ brakes are phenomenally powerful, more powerful than their engines – a Harley motor imparts enough energy to have the bike up to 70mph in no time the brakes are powerful enough to remove all this energy in faster then you can say whoa Joe where did ya go!

If you want more braking power, the cheapest and easiest thing to do is build hand strength and squeeze the lever harder. You could fit a more powerful system (from another model, or specialist manufacturer), but this is expensive and changing single areas of a system – calipers, or discs – can throw a whole expensive and extensively tested system out of balance.

Can you feel me now,,can ya,,can ya,,

So, with a very few exceptions, the braking systems fitted to production motorcycles are far more than capable of what’s required for even very serious road use. It’s differences in feel that affect how we, er, feel about our brakes. So what is this ‘feel’? Feel is the relationship between our brains, hands and brakes. Our brains are happier and have less work to do if the amount of stopping power delivered rises and falls incrementally in tandem with the amount of squeezing power we deliver at the bar. We want twice the pressure

We also want ‘bite’. We want the reassurance that something’s happening the moment we stroke the lever. But we don’t want ‘grab’, for the brakes to come on without progression, upsetting the suspension, or breaking the tire away. And yet we want more. Operation must be smooth, free of ‘fade’, ‘judder’, ‘squeal’ and ‘sponginess’. We want all the above, whatever our speed and whatever the weather. Its all about the squeeze so to say. Squeeze me baby!

Twice the squeeze does indeed give twice the force at the caliper, but other factors come into play. As heat in each pad grows, the coefficient of friction (grippyness) may change, requiring more or less pressure on the lever to retain a given rate of deceleration.

If heat goes beyond the pads’ operating range they can fade, requiring exponentially more input to keep slowing. This condition is, however, very rare these days as ‘sintered’ pads, with high metal content, are very efficient at removing heat from the pad surface. This can lead to another problem, ‘fluid fade’ where water vapor in the fluid boils, leading to total brake failure. The chance of this happening is very remote and it only occurs where the brakes are lightly applied, ‘dragged’, over a long distance. So, if hauling ass down a hill, use the gearbox to moderate your speed, only braking when you need to.

To complicate things yet further, wind resistance plays a part in feel. At just closing the throttle will decelerate you down some. so, then during the course of the stop, brain is telling hand to double its pressure. Unless, of course, the pads’ friction increases as they heat… Its all in the Pad,,,

Changing pad material (make) can change the size of your squeeze, bite, progression and power. All the major pad makers have a ‘racing’, or ‘road performance’ pad in their ranges. Often these will improve power (through changing the

‘friction’ bit of the overall equation) and feel, but the only way to be sure they’ll work with your bike is to try them. More friction can also mean more wear to pad, disc, or both.

Everyone has a slightly different idea of what good feel is. And every pad and disc combination will behave differently. There is one compound of pad that has been extensively tested with your bike, taking all factors into account, and that’s the standard one.

Most braking inadequacies are due to poor maintenance, age, wear, and bad riding. Sponginess – where the lever comes a long way back, often described as ‘springy’ – can be caused by a number of factors: air in the hydraulic system, leaks at cylinder seals, flexing of brake lines (bulging) and calipers. Even wear at the lever pivot can have the lever nearer the bar than you’d like.

The first thing to do if brakes are too spongy is bleed air from the system (and fluid should be changed annually) and check for leaks. If the brakes are still springy fit braided, or Kevlar-sheathed, lines that resist bulging.

If brakes are only used lightly, a ‘glaze’ may build up. This can be removed with glass paper. Until you do the brakes will feel ‘wooden’, like the pads aren’t gripping properly – which they’re not. Glazing, overheating and fade can also be caused by brakes binding (part-seizing) on and is often accompanied by blueing of discs. If this is the case, calipers must be stripped, cleaned and reassembled with new seals. Very old or/and worn pads can also glaze thanks to environmental contamination – if they’re anywhere near the wear-marks, change them. Top Brake Tips countdown,,,here ya go

- If your brakes squeal, the anti-squeal shims (metal plates on the back of the pads) may be missing. If so replace, if not lightly smear copper grease on the back of the pad.

- For that racer look, and to save dough, throw the ‘splitter’ away and run two braided lines individually from a doublebanjo bolt at master cylinder to the calipers. Ask for advice on length when ordering.

- Aluminum and stainless brake line fittings must not be use together. All-stainless is definitely best.

- Do not use ‘racing’ brake fluids, as they degrade too fast for road use.Think DOT 5

- Avoid ‘comfort braking’ – brushing the lever. It glazes the brakes. If shutting the throttle doesn’t slow you down enough, change down a gear.

- If brakes judder, check if the discs are warped by placing the steering on fulllock, with a pencil atop a toolbox, tip against the disc. If the pencil moves, or a gap appears, they’re shot. ‘Dished’, conical, discs can also cause a springy feel at the bar.

- Knackered head-races, wheel bearings and forks can also produce juddering when on the brakes.

- If replacing discs with non-standard ones, talk to the manufacturer about pad choice.

- Remove the calipers and spray with aerosol brake cleaner every few months to remove brake dust and prevent glazing.

-- Remember your number one rule in riding is always safety first. Walk around the bike give her the good one eye look. Its its loose tighten it. When was the last time you replaced your brake fluids? If you just said to yourself " I dunno" then its time for a peek, yes by golly fluids do wear our and water gets in and your brakes feel thin. In a sweeping piece of legislation addressed by the New York City Council last month, there was a small provision that would have allowed NYC police to issue fines to motorcycles not displaying the Environmental Protection Agency (EPA) exhaust stamp.

This stamp is currently required by the EPA on all new motorcycles certifying that the level of sound coming out of the tailpipe meets the Federal limit of 80 decibels according to the Federal Noise Control Act of 1972.

Should the stamp not be easily visible, and most of the time they are not, the NYPD would be able to issue noise violations for a motorcycle that was not even running.

This was not the first time this has been proposed by the NYC Council. A similar provision was put forth a few years back at which time the Motorcycle Riders Foundation was very involved with having the proposal shelved.

It was explained to the MRF that this is a last ditch effort by the outgoing NYC Mayor Michael Bloomberg to force a massive piece of air quality legislation. Counsel at NYC Department of Environmental Protection informed the MRF about the language. The MRF mobilized with the politically active bikers of NYC to have a presence at the

Council meeting. NYC Councilman and motorcyclist Peter Vallone, joined the bikers. At that time Vallone was the chair of the Public Safety Committee and backed up what the other motorcyclists were saying.

The MRF source with the Department of Environmental Protection told the MRF that this language was “absolutely Mayoral” and “in no way a part of the normal council business”. Bloomberg has since stepped down.

Welcome back. This week was the official kick off of the 113th Congress 2nd session. What that means is that we are at the halfway point on all federal legislation. We keep all co-sponsors of any of the legislation currently pending. Here is a quick rundown of our most important legislation. H.R. 1861, Stop Motorcycle Checkpoint Funding Act, Introduced May 5th, 2013. [41 cosponsors]

H.R. 875, a bill to conduct a scientific study of the effects of mid level ethanol blends on gasoline engines. Introduced February 27th, 2013, passed out of Committee April 11th, 2013 by a vote of 18-17. [22 cosponsors] H.R. 2414, the Black Box Privacy Protections Act. Introduced June 18th, 2013. [13 cosponsors]

We still have work to do in 2014. Passing legislation through both chambers these days is all but impossible. Anything drafted by the House is DOA in the Senate and vice versa. So much so that even legislation that should be universally embraced by both parties, such as veterans issues, has become a tool for partisan gain. One of the worst examples came during the memorials on the Senate floor for the four former U.S. Senators that had passed in 2013. Sitting Senators from both sides of the aisle gave inappropriate remarks blaming the other party for something they did or did not do. Considering that we are also in full campaign mode always adds a splash of gas to the fire. As I gaze into my crystal ball and conjure up predictions for the future, I see very little of anything meaningful getting done the rest of this Congress. There is a chance that the Highway Bill will get started, but judging from highway bills past, we should expect an unhealthy amount of extensions before getting to an actual bill. Sharing how they feel about the Anti-profiling bill introduced by the ACMC and providing insight and classification of a military veteran to an inquisitive politician, Rep. Kelly Townsend. This goes to show, that your face makes a difference to those who impact our comunity laws. Politicians don’t know any better! They present how they feel a bill should be passed if they don’t have any public opinion- am I right? For someone to come up to one of us bikers and be genuinely interested in what exactly veteran means, helps me to have faith! Keep it up, were getting somewhere!

Im so glad to live in the valley of the sun! Where it feels like 70 and perfect riding weather most of the year. No better way to celebrate than with The Hooligans M/C who just celebrated their 4th Anniversary, Jan 11 at their clubhouse in Deer Valley. Congrats! The party was quite well attended filled with great faces and great people. If you missed it, there were a good handful of vendors to include a masseuse! Excellent door prizes were handed out just after the band “Southern Gait” had their spotlight. To round out the evening, the Leathernecks proudly presented the Hooligans with a plaque in recognition of the memorable event.

It is important I attend these meetings as most of the people in the room swallow the inaccurate government numbers without question. I challenge these inaccuracies.

The team from Texas A&M presented a paper titled “Improving the Quality of Motorcycle Travel Data”. It was an interesting presentation, but relied way too heavily on bogus government numbers. They are going to be doing a study involving 2,000 volunteer drivers who will pay taxes based on vehicle miles traveled instead of a gas tax. The volunteers are reimbursed the tax they pay. With modern GPS units it’s entirely possible to track their every inch of travel. This sort of scheme was laughable a few years ago but with the surge in technology tracking anything is entirely possible. Congress Epic Fail... The House voted Wednesday to overwhelmingly pass a huge $1.1 trillion dollar omnibus appropriations bill. An omnibus is a grouping of appropriation bills. This time all 12, were brought to the floor for a vote. It is a lazy, irresponsible way to govern. Each appropriations bill should have full committee consideration and floor time to amend and craft each bill separately. It’s also much easier to insert special spending priorities for those that want them, in an omnibus situation. Hard line fiscal conservatives voted against the bill as well as several of the vulnerable democrats. Final vote for the House was 35967. As of this writing the Senate has not voted but it should be a similar vote.

dismissed I spoke to an attorney in Reno who has been extremely effective in fighting police harassment. After we talked about the suit I asked him if there were some way to get him on the case. He recently filed in federal court and the defendants are law enforcement. While some MROs have budgetary issues not all do. The trip to Reno resulted in many advantages to the motorcycle community. My trip to Washington DC had some great effects. Our bill HR 1861, a ban on federal funding of motorcycle check-

points has two new co-sponsors in Arizona, Congresswomen Ann Kirkpatrick and Kyrsten Sinema. There is now a Senate version in the works. We do this by spending money to send lobbyists to learn and participate. All of the education on earth is useless unless there is work toward our goals as well.

Effective lobbying and participation are necessary to our survival as well as education.
