Senate Committee Passes Highway Safety Bill

United States Senate Committee on Commerce, Science and Transportation passed a sweeping safety bill known as the Motor Vehicle and Highway Safety Improvement Act (S. 1449). The bill passed by voice vote.

There was some discussion about making Motorcycle Day at the Dome 2012 a little different this year, so ABATE of Arizona will be hosting the event on February 22nd. One of the biggest changes is that we are encouraging all of those planning to attend, to make appointments with their legislators and visit with them in their office, as opposed to waiting for them to come to us. We will have a tent for shade, but we won’t be serving food. All motorcyclists are welcome and encouraged to attend!

On December 14, 2011 the MRF sent out the following news:

Earlier this week, Senator Lautenberg (DNJ) filed an amendment that would have gutted the popular federal motorcycle education and awareness grants, known as the 2010 funds. The Motorcycle Riders Foundation is pleased to report that Lautenberg did not call that amendment for a vote. Due to an overwhelming response from the motorcycle community, the 2010 grants are safe for now.

Also under attack was the National Highway Traffic Safety Administration (NHTSA) lobby ban. This law prohibits NHTSA from using federal money to lobby State legislatures, uninvited. The way Senate Bill 1449 was drafted, it removed this lobby ban. Senator Jim DeMint (R-SC) introduced a number of amendments to maintain the ban and the

necessary amendments were agreed to, by unanimous consent of the full committee.

The one sticking point that remains is at least, the least troublesome. That being said, it is still something that will keep the attention of the MRF lobby efforts.

The trouble lies in a provision in S. 1449 that calls out motorcycle helmets in the list of definitions as "motor vehicle equipment". Previously, the list simply stated: "any device or an article or apparel... that is not a system, part, or component of a motor vehicle".

The MRF would like to thank all the State motorcycle rights organizations and everyone else who helped with this legislation.

The bill passed today will likely move on to be a part of the larger Highway Bill which could happen in early 2012.

I would like to give a big “thank you” to the returning ABATE Officers and all the new ABATE Officers, State and Chapter. Many are holding Officer Positions for the first time, not to worry, we will support one another.

I am sure the State Officers will be more than happy to help any of the Chapter Officers if asked.

I also want to take this opportunity to thank Margie F. for everything she accomplished as State President.

Welcome her, in her new position, as Chapter Coordinator of our newest ABATE Chapter, that held its Charter Membership meeting on December 10, 2011. The Northern Arizona Chapter will be holding their meetings in Show Low. Congratulations and thank you to all the Brothers and Sisters of that chapter for allowing ABATE of Arizona to represent you as motorcyclists in protecting your right to ride free and all other motorcycle rights affairs.

Membership is the heart of any organization. We need every ABATE member, whether you are an officer in ABATE or not, to actively support ABATE in recruiting new members, individual and business members. Remember ABATE is your Motorcycle Rights Organization we need new members to help support our “Mission Statement”

ABATE will lobby and educate the government and the general public to promote motorcycling in a safe

I’d like to thank our members for supporting me as your State Vice President and State PAC Coordinator for the past 2 years; it has been a pleasure serving you and our organization. This special teleconference is called to go over 2011 budgets.

At the General Membership Meeting and Election Rally in Black Canyon City on November 6th, the ABATE Board of Directors approved a motion to establish a new organization; ABATE’s Rider Advantage. This new organization will provide motorcycle training for all riders in Arizona.

The organization will be classified as a 501(c)3. What this means, is that any donations made to the organization will be tax deductible and the new organization will be able to apply for state grants to help fund the operating expenses. The new organization will also be set up as a membership-based organization. All that is required for membership is an annual minimum $5.00 donation. This gives the donor/member voting privileges when officer elections are held.

If you or your company would like to make a donation of funds, motorcycles, repair services, gasoline or motorcycle parts, please don’t hesitate to contact Jean Cooper at Azjkc@aol.com. As soon

as the I’s are dotted and the T’s are crossed, we will be announcing a new web site and plans for the future.

The first President of ABATE’s Rider Advantage is Jean Cooper. Jean has been dedicated to motorcycle safety and rider education in Arizona for many years.

Her experience writing proposals to bridge the gap between organization funding and external financial support – grants will be most helpful.

We’re very excited about getting this new venture off the ground and hope to make riders education classes more affordable throughout the state.

In time, we will be hiring MSF certified instructors to present classes. If you are interested in becoming an instructor, contact Jean Cooper.

ABATE is proud to be creating this new company and we are proud of the fact that ABATE will be creating new jobs in Arizona.

Mohave Chapter

It's been a busy last few weeks.

Christmas parties, toy runs and shopping for the holidays. Too much fun, so little time!!

We are pleased to announce that the Mohave Chapter looks like it will be making a complete recovery. Our last meeting looked very promising.

We have sent reup notices to the expired members in our county along with info on the new board and meeting place.

Most of you know Big Ray, the President of the Rez Riders MC. He has been an active member in ABATE for years and has offered his help in

getting this chapter back up and running. With his help, we will be setting up the Motorcycle Awareness Classes again in Mohave County.

A great way to start off the New Year.

This was the last chapter meeting of 2011, out with the old officers and in with the new. This is my last chapter report, Melissa Everest is the new chapter communications officer, Thank You for my 2 year run and I hope my chapter reports were of interest to read.

The meeting wasn’t the largest or the longest, but it was a time for reflection of the year and chapter goals for 2012.

Mark your calendars the NEW Officers training meeting Saturday January 14th, 2012 at 12:00pm at the AIAC. Motorcycle Day at the Dome in February, this is Carole O’Reillys baby and will give us more info as February nears..

The first Accident Scene Management class, taught by our State Safety Officer, Jean Cooper, will be Saturday February 11th 2012 8:30am, space is still available, more classes to follow with time and locations.

Hello to our new chapters: The Yuma Chapter and Northern Arizona Chapter, our own Margie Ferrucci will be the Chapter Coordinator, congrats!

A quorum was established and the meeting called to order by Ron Kool at 9:05 am. Pledge of Allegiance was led

Rich Montgomey is home in Sierra Vista. He has a lot of rehab so please keep your encouragement cards coming.

We had 24 members attending.

mer, we will be riding in comfort. Our meeting held on 12/12 was pretty low key. We did get some important updates of biker rights issue in Arizona and the other 49 states as well. We are so lucky to have Still Ray as our B.O.D. rep as his knowledge of biker rights issues are always informative and helps to remind us what A.B.A.T.E. and the MRO’s are all about. I think I speak for the rank and file in the Yavapai Chapter, when I say he keeps us all informed and passionate about continuing to fight the good fight.

We also had a special, guest at our last meeting of the year, none other than our outgoing president, Margie. Our meeting was her last official visit for her presidency. Congrats to her for getting the Northern Arizona Chapter up and run-

ning.

We have some great events planned for 2012 including our 2nd annual Run to the Hills rally in Jerome. We are planning on making it bigger and better than last year.

So until next year, a very merry Christmas and happy new year goes out to our brothers and sister of all Arizona ABATE chapters.

A motion to waive the reading of the secretary minutes was made by Bob Welton, second by Robert Guenther.

Dawn gave her treasurer report.

Jim Clark had good information on how to handle turns in town.

We discussed practicing low speed practice in a parking lot. Jim had a good explanation of counter steering. Lastly we talked about the T-CLOCKS preride check.

Ron reported we have 138 active members and 6 business members. We have been getting members strictly on the insurance policy. $2500 insurance for $25 a year is cheap.

Sean covered that there is a proposed bill to sweep more of our funds on a federal level. There is a bill to more research into the Ethanol initiatives.

Some auto makers are suggesting the E15 may void a car’s warranty because the Ethanol causes overheating. Of course this is especially problematic for air cooled engines. The emissions testing have not been approved by federal EPA. The lane splitting bill is looking for sponsors. There is a requirement that all yellow lights must be displayed at least 3 seconds. If we see a short yellow it should be reported. We discussed noise enforcement in Arizona.

Motorcyclists in Denver may be cited if their exhaust pipes do not have the EPA 80 decibel rating stamped on the muffler. The bike does not have to be running. So far no sightings of motorcycle only check points in Arizona. At the general BOD meeting it was voted to start and fund the 501-C3 safety organization.

According to the National Highway Traffic Safety Administration 3% of Roadway crashes involve motorcyclists but 17% of roadway fatalities were motorcyclists. Statistically, another motorcyclist is the first to be on the scene of a motorcycle crash.

The purpose of Accident Scene Management Bystander Assistance Programs is to reduce injuries and fatalities to motorcyclists through First Response Education.

100 series: Bystander Assistance Program Ͳ “A Crash Course for the Motorcyclist” This course is designed for the average motorcyclist. No prior training is necessary. “BAP” classes have made an impact on over 10,000 motorcyclists! Don’t miss your opportunity to learn the specifics of motorcycle trauma care. In all fairness to me I did try to make the midnight deadline last night but I fell asleep at the keyboard. I ended up writing nnnnnnnnnnnnnnn for 927 pages. I thought about sending it in like that but I still have visions of Mr. Hampton smashing walnuts with a hammer that looked very much like it might once have belonged to Thor. ABATE Of Arizona, Inc. is a non-profit motorcycle rights organization that is dedicated to freedom of the road for all motorcyclists.

ABATE is a volunteer organization that fights discriminatory legislation aimed towards the motorcycling community.

ABATE's position is that all motorcycle riders have the right to choose not only the machine that they ride, but also the riding gear that they choose to wear or not to wear, (i.e. leathers, gloves, boots and helmets.)

and Carole’s articles you will know that we are probably going to have to run the Emissions Exemption Bill for Maricopa County again. We had to get the time limit for the last bill extended but time has run out on it. It seems that anytime the EPA doesn’t want to comply with the wishes of the people they say “We need to study this some more” and request a bunch of data from the state that wants to change a regulation. Data, I might add that has been sent three or four times already. So here we go again. I tell ya it’s enough to make one use multi syllable cuss words. Strike that, Polysyllable compound cuss words.

Something along the lines of M……..never mind I digress.

This provision would make it easier for helmet law states to obtain 2010 grant money. But it wouldn’t provide any funds for motorcycle training or education. We finally get them to realize that training and awareness are much more effective in preventing crashes then they want to revert back to the old “Put a helmet on them” mentality. Arrg

One of the things that really annoy me is when I introduce myself as being from ABATE, and people say “Oh, the AntiHelmet people.” Then I have to explain that no, we aren’t anti -helmet; we are against the government making that decision for us. So it pains me to tell you that we have just dodged the bullet on yet another federal attempt at a national helmet law. It seems that the US Senate Committee on Commerce Science and Transportation will was debating The Motor Vehicle Safety Act of 2011 (S. 1449). This bill governs the National

This years Board Meeting was held in conjunction with the Region Five, Arkansas, Kentucky, Louisana, Mississippi and Tennessee, Regional Conference.These meetings although necessary and informative are a get there get done and get out tireing event. Most of us that come from the Nine Regions all over the Country fly in sometime Friday, as we have the closed Board Meetings Friday evening to cover information and voting on various issues that can then be conveyed to the general public the next morning at the open Board Meeting. Then it's meetings Sat from 10am until 7pm, and then fly out early Sunday morning, exhausted.

After the meeting was called to order, there was a proposed change of a Board

2011 was a pretty interesting year. I met a lot of incredible people and visited some amazing places but there are a couple of things that really stand out as memorable. Looking back over last year, the absolute coolest thing I did or that I've ever been involved in for that matter was the restoration of the 1861 Rodman Cannon that rest in the Spanish American War Veterans' section of my local cemetery.

The main reason that stands out so much in my mind is the fact that 150 years from now, that Rodman cannon will still be standing there and hopefully looking just as good as it did on this past Veterans Day when we rededicated that section of the cemetery.

I'm currently working with some local high school kids creating a plaque that will stand by that cannon for the next couple hundred years commemorating it's 150th birthday.

It's not everyday that you have the opportunity to do something of such a historic nature. It was a project that I poured my heart and soul into for about 9 months and at the end of the day, well, all I can say,,it was worth every second that we spent working on it!

The trip we took to Maggie Valley North Carolina and The Wheels Through Time Museum is another great memory worth revisiting. WOW, that entire area is so Biker friendly and the scenery is so beautiful it's just one of those places that a person just has to experience for themselves. The Spring and Fall are the best times to

Angel Richardson has already been a great influence and dedicated Freedom Fighter for all Motorcycle rights issues and is currently a member of the NCOM National Legiislative Task Force. It was explained to her that according to NCOM By-Laws that as a Board Member she could no longer sit on the Task Force as an authorized Member, but could certainly continue in an advisory position. The head of the Legislative Task Force, Senator Jim Putman from South Dakota asserted that Angel has been very much indispensable in the gathering of information and getting it out to all the other LTF Members, and wanted to be assured that she could continue in this capacity.

The Freedom Fund will this coming year send Jim Putman and another LTF Member to Washington DC for a one on one with current Congressional and Senate Members to personally discuss Motorcycle Rights Issues such as Motorcycle ONLY Checkpoint Stops, Fusion Centers, and other discriminatory matters related to Motorcyclists. He then discussed the issues with AIM, mailings to member groups, looking for more and better Aim Reps and Chief's of Staff. AIM Reps and Board members to reach out to other groups to bring them into the AIM / NCOM Family, and doing this by handing out the new National and State DVD's that are available.

The Wheels Through Time Museum is as good of reason to visit Maggie Valley as any I could ever give you.

It's a place where "Soul" is spoken and seeing is believing !If you do decide to take a trip to the museum and Maggie Valley make sure to cheek out their web sites because the museum does have different hours of operation at different times of the year.

I mentioned incredible people and none is more incredible that Brett Bondurant. On Sept. 28th. 2011, 19 year old Brett was serving with the US Army in Afghanistan when an IED ( improvised Explosive Devise) tore off both his legs and shattered one of his arms. One leg above the Knee and one just below the other. Six weeks later I get a e-mail from my old buddy Dave Teke, it's a video showing Brett "walking" on his "New Legs"... SIX WEEKS !!!!

This kid has the most CAN-DO attitude I've ever seen and a smile that just won't let you feel sorry for him.

His heroism has united my community in a way that no one has ever experienced. Brett is returning home in about 10 days from right now and it will be the biggest homecoming Indiana has ever seen.

All in all 2011 was a pretty good year, I'm still cancer free and have a roof over my head and food on my table. I read a lot of good books and wasted a lot of time watching some really crappy TV. I added cruse control to my dresser which I plan on using a lot in 2012 and my dance card is filling up quickly for events, runs, benefits and parties. So in closing this month, I thought I'd leave you with a quote attributed to the late Andy Rooney. He said;

I've learned.... That I can always pray for someone when I don't have the strength, time or money to help him in some other way.

One of the most important things that we discuss at the Board Meetings are Recipients for the Silver Spokes Awards, people that have done outstanding things for the Motorcycling Community, and I am happy to say that although posthumously, A Specvial Award will be given to Kimmy Chapman, for her dedication to Motorcyclists through the AZ Biker Guide, which has now gone Nationwide.

FEDERAL HELMET LEGISLATION NARROWLY AVERTED Due to the quick actions of concerned motorcyclists across the country, a major federal transportation measure narrowly avoided becoming a bill to encourage states to enact helmet laws nationwide.

On Monday, December 12 Senator Frank Lautenberg (D-NJ) filed an amendment to S.1449 the "Motor Vehicle and Highway Safety Improvement Act of 2011” that would call for mandatory helmet laws nationwide and could jeopardize funding for Motorcycle Safety programs across America.

By Tuesday the motorcycle community was alerted to Lautenburg’s efforts by national and state motorcyclists’ rights organizations, including the National Coalition of Motorcyclists (NCOM) and numerous NCOM Member Groups, and riders were urgently urged to contact their U.S. Senators to oppose the amendment -and time was of the essence because a Senate committee was to vote on the bill the following day!

Wednesday, Dec 14, during the hearing held by the U.S. Senate Commerce, Science & Transportation Committee to “mark-up” the bill, Senator Lautenburg decided not to introduce his amendment.

response help avoid another federal helmet law battle and preserve federal funding for motorcycle safety programs, but the committee also voted to accept two amendments by Senator Jim DeMint (R-SC) that removed language in the bill that would have lifted the current ban on the National Highway Traffic Safety Administration (NHTSA) from lobbying states to enact universal helmet laws for all riders.

S.1449 passed the committee by voice vote and now goes to the Senate floor for further action, while riders remain ever vigilant.

JUDGE UPHOLDS N.Y. MOTORCYCLE-ONLY CHECKPOINTS A federal judge rejected motorcyclists' claims that their Constitutional rights were violated by New York State Police motorcycle-only “safety checkpoints” that detained thousands of riders en route to large N.Y. rallies and ticketed many of them for mostly non-safety violations.

Aid to Injured Motorcyclists (A.I.M.) Attorney Mitch Proner of NYC sued troopers on behalf of four motorcyclists who claimed that safety was a mere pretext in looking for criminals and that the practice was intrusive and unfair to motorcycle riders as a group.

But Judge Gary Sharpe concluded that safety was indeed the main focus of the initiative, which distinguishes the checkpoints from "a general interest in crime control" that could have amounted to unconstitutional seizures when there’s no "individualized suspicion of wrongdoing."

"The court concludes the checkpoints were enacted to promote motorcycle safety, a manifest public interest; they were effective in addressing this interest; and that any interference with individual liberties was not only minimal, but also grossly outweighed by the interest advanced," Sharpe wrote in his ruling.

"The intrusion on civil liberties is something that shouldn’t be countenanced," Proner told the Associated Press, adding that the discriminatory roadblocks have been ongoing since 2008 even though motorcycles, like other vehicles in New York, are already subject to annual safety inspections, and no other vehicles are stopped for roadside safety checks.

"It’s obvious just from their own internal documents they’re looking for criminal activity," said Attorney Proner, citing a checkpoint near Buffalo’s Peace Bridge that included border patrol agents, and one in central New York near a rally sponsored by a motorcycle club included gang task force officers.

"The fact they didn’t find crime doesn’t mean that wasn’t what they’re fishing for," he said. "That just shows you’ve got law abiding citizens on motorcycles primarily being inconvenienced."

Proner told the AP news agency that motorcyclists across the country are interested in this case, the only such federal lawsuit nationally though some other states have similar checkpoint programs, and that he will appeal.

SAFETY BOARD SEEKS BAN ON CELL PHONE USE WHILE DRIVING States should ban all driver use of cell phones and other portable electronic devices (PEDs), except in emergencies, urges the National Transportation Board. The NTSB recommendation, unanimously agreed to by the five-member board, applies to both hands-free and hand-held phones and significantly exceeds any existing state laws restricting texting and cellphone use by drivers.

The board made the safety recommendation in connection with their investigation of a deadly highway pileup in Missouri last year that was caused by the inattention of a 19 yearold-pickup driver who sent or received 11 texts in the 11 minutes immediately before the tragic crash that involved a semi and two school busses.

The accident is a "big red flag for all drivers," NTSB chairman Deborah Hersman said at a meeting to determine the cause of the accident and make safety recommendations. "No call, no text, no update is worth a human life."

The board has previously recommended bans on texting and cell phone use by commercial truck and bus drivers and beginning drivers, but it has stopped short of calling for a ban on the use of the devices by adults behind the wheel of passenger cars. While the NTSB doesn't have the power to impose restrictions, its recommendations carry significant

In November, Pennsylvania became the 35th state to forbid texting while driving, but despite such laws the problem is continuing to get worse according to the National Highway Traffic Safety Administration (NHTSA) that reports nearly 20% of drivers admit to texting or e-mailing, and at any given moment last year almost 1 in every 100 car drivers was texting, emailing, surfing the Web or otherwise using a handheld electronic device, up 50% over the previous year.

Joining in the campaign to curb distracted driving, Aid to Injured Motorcyclists (A.I.M.) has produced a color vinyl bumper sticker that reads; ‘HANG UP AND DRIVE!” that is available free by calling A.I.M. at 1(800) ON-A-BIKE.

US TRAFFIC DEATHS HIT LOWEST LEVEL SINCE 1949 Annual traffic deaths in the U.S. have fallen to their lowest level in six decades, reports the U.S. Department of Transportation. Despite the fact that Americans drove almost 46 billion more miles during the year, highway deaths fell by nearly a thousand to 32,885 in 2010, representing a 2.9% drop from 2009 (33,883) and the lowest number of fatalities since 1949.

"While we have more work to do to continue to protect American motorists, these numbers show we're making historic progress when it comes to improving safety on our nation's roadways," said DOT Secretary Ray LaHood.

According to DOT statistics, deaths in crashes involving drunk drivers dropped 4.9% in 2010, resulting in 10,228 fatalities compared to 10,759 in 2009. Fatalities declined in most categories in 2010, including for occupants of passenger cars and light trucks, but fatalities rose among motorcycle riders (4,469 in 2009 to 4,502 in 2010, an increase of 33, or less than 1%), pedestrians (up 4% from 4,109 to 4,280), occupants in medium and heavy trucks (499 to 529, +6%) and buses (26 to 44, +41%).

The latest figures also include a new measure of fatalities caused by distracted driving, essentially a refinement of existing data that focuses more directly on situations where dialing a phone, sending a text or the activities of another person or event are likely to lead to a crash. The DOT reports that 3,092 fatalities were the result of such “distraction-affected crashes.”

FEDS PROPOSE ADDITIONAL MOTORCYCLE SAFETY STUDY The National Highway Traffic Safety Administration (NHTSA) is proposing to launch a study program equipping 160 motorcycle riders with cameras, GPS, and other data recording devices in order to track riding behavior and how riders avoid -- or fail to avoid -crashes.

"Knowledge of both how riders successfully avoid crashes and of behaviors that correlate with and contribute to crash risk is crucial to developing effective countermeasures to reduce motorcycle crashes and fatalities," says the NHTSA study proposal.

The federal agency is currently seeking comments on their proposed motorcycle safety study, which is very similar to a “naturalistic study” being conducted by the Motorcycle Safety Foundation (MSF) tracking 100 specially-equipped motorcycles for one year to compile data on rider behavior.

NOISE CAMERA TO MUFFLE LOUD VEHICLES First came red-light cameras, followed closely by speed-cameras, and now Calgary will soon become the first municipality to introduce noise cameras to the motoring public.

“Motorcycle riders and hotrod enthusiasts beware: the Noise Snare is one step closer to squelching your highdecibel expressions of mechanical masculinity,” reported the Calgary Herald about the pilot project that pairs a noise-reader with a camera to catch law breakers.

The $112,500 device was offered to Calgary for free as the first city to test the gadget, and if all goes well the city expects to be handing out $200 tickets by summer.

"This is something that will allow municipalities across North America to start enforcing (noise) bylaws. The fact that now it's been proven to be an accurate test is very, very important," said Bill Bruce, the city's director of bylaw services.

Electrical engineer Mark Nesdoly invented the “Noise Snare” after a loud motorcycle awoke his sleeping daughter one night.

SHOOTINGS PROMPT HONDURAN CONGRESS TO BAN MOTORCYCLE PASSENGERS Following two recent high-profile killings, legislators in Honduras approved a decree banning motorcyclists from carrying passengers. It took the deaths of a radio journalist and a former government advisor to convince the National Congress of the need to restrict the number of riders

on a motorcycle to one -- the driver.

Suspects in both cases were passengers on motorcycles, who got away.

The legislation is being hailed as a common sense approach to fighting crime that will help discourage driveby shootings, which have been one of the most common murder tactics in this Central American country because it makes it nearly impossible to identify and catch the helmeted killers who quickly flee the crime scene. Now, any motorcycle with two people will be suspect and can be pulled over by the police.

NIGERIA RESTRICTS MOTORCYCLES TO CURB BOMBINGS Restrictions have been imposed on the operations of commercial motorcycles in Nigeria to check bombing incidences. The restrictions on the motorcycles, popularly called okada, were announced by the Special Task Force (STF) after a deadly triple bomb blast rocked three television viewing centers was attributed to the Islamic sect Boko Haram.

"The general public should be informed that no motorcycle will be allowed to operate beyond 7pm within the Jos-Bukuru metropolis. Riding of motorcycles is only permitted from 6am - 7pm, the enforcement of this ban will be strictly enforced,'' said Ikemefuna Okafor, an officer of STF.

WEIRD NEWS: MOTORCYCLISTS TAKE BITE OUT OF SNAKE VENOM DEATHS In rural Nepal, volunteer motorcyclists are getting snakebite victims to help soon enough to cut deaths by 95%, reports Scientific American.

Snake bites are still a big concern for much of the world’s population, and the World Health Organization (WHO) estimates that about 100,000 people die from poisonous snakebites each year. Many more people become paralyzed or permanently disabled.

Most victims live too far from clinics that could provide them with antivenom. In Nepal, where more than 10% of bite victims die, an experimental program uses volunteer motorcyclists to save residents. Since the program launched 2003, only about 5% of victims who got a ride died.

These findings were presented at the annual meeting of the American Society of Tropical Medicine and Hygiene.

The Motorcycle Riders Foundation (MRF) reports that the National Highway Traffic Safety Administration (NHTSA) has requested comments on a proposed motorcycle safety study.

The study they are proposing copycats one that the Motorcycle Safety Foundation (MSF) is currently conducting, known as the “naturalistic study.”

The MSF study has instrumented a hundred motorcycles with computers, cameras and all sorts of meters. Those specially-equipped one hundred motorcycles are being ridden by volunteers across the country as their personal bikes. After one year, the instruments are taken off and the analysis begins. NHTSA is proposing the exact same study, only with 160 motorcycles.

This proposal does come as a bit of a shock, considering the feds have been struggling to conduct another motorcycle study that tracks actual crashes. That “crash causation study” has been languishing since 2006 and has yet to complete data collection, analysis and final reporting.

“I do like the idea of the study,” said Jeff Hennie, MRF Vice President of Government Relations and Public Affairs.

“Tracking volunteer riders and collecting some best practices for countermeasures is a great idea, but as with every study there will be some technical and logistical bugs to work out over the course of the study. It seems to me that it would be wise to wait on the MSF results and use them to craft a better, sturdier study.”

NHTSA is already predicting that out of the 160 participants in their proposed new naturalistic study, 20 will have a crash and sustain injuries so severe that they must be reported. So far there has been no mention of the cost for the new study.

Senate Committee Passes Highway Safety Bill

Today, the United States Senate Committee on Commerce, Science and Transportation passed a sweeping safety bill known as the Motor Vehicle and Highway Safety Improvement Act (S. 1449). The bill passed by voice vote.

Earlier this week, Senator Lautenberg (DNJ) filed an amendment that would have gutted the popular federal motorcycle education and awareness grants, known as the 2010 funds. The Motorcycle Riders Foundation is pleased to report that Lautenberg did not call that amendment for a vote. Due to an overwhelming response from the motorcycle community, the 2010 grants are safe for now.

Also under attack was the National Highway Traffic Safety Administration (NHTSA) lobby ban. This law prohibits NHTSA from using federal money to lobby State legislatures, uninvited. The way S. 1449 was drafted, it removed this lobby ban. Senator Jim DeMint (R-SC) introduced a number of amendments to maintain the ban and the necessary amendments were agreed to, by unanimous consent of the full committee.

The one sticking point that remains is at least, the least troublesome. That being said, it is still something that will keep the attention of the MRF lobby efforts.

The trouble lies in a provision in S. 1449 that calls out motorcycle helmets in the list of definitions as "motor vehicle equipment". Previously, the list simply stated: "any device or an article or apparel... that is not a system, part, or component of a motor vehicle".

The MRF would like to thank all the State motorcycle rights organizations and everyone else who helped with this legislation.

The bill passed today will likely move on to be a part of the larger Highway Bill which could happen in early 2012. The MRF will keep you informed on this issue.

The Motorcycle Riders Foundation FULL Legislative Strategy Agenda for 2011-2012

At the recent 2011 Motorcycle Riders Foundations (MRF) Meeting of the Minds held September in Romulus Michigan, a Legislative Strategy Session was hosted by the MRF’s Legislative Committee. As has been done for the past several years, the MRF requested that it be attended by Sustaining State Motorcyclists Rights Organizations (SSMRO) Legislative and/or Executive Officers. The goal is to set the MRF’s Federal Legislative Agenda for the coming Meeting of the Minds “to” Meeting of the Minds cycle. Our Sustaining SMRO partners responded once again and the Legislative Committee was extremely pleased at how aligned and clear the direction from our SSMRO partners was. This level of alignment will allow for a solid and focused Strategic Action plan to be developed,

disseminated, and effectively employed.

The session this year again saw it moderated by MRF Vice President, Jay Jackson, and supported by MRF President, Kirk “Hardtail” Willard, and MRF Vice President of Government Relations and Public Affairs, Jeff Hennie. We continued the practice instituted last year where we utilized the one vote per organization policy and those votes were again recorded. Shown below in the order raised by our SSMRO’s is our upcoming Federal Legislative Strategy Agenda followed by the recorded vote percentages on each.

Google and ITS: Tyranny in the Name of Safety

As a little kid back in the 1960s, one of my favorite cartoons was The Jetsons.

They had all the coolest robotic stuff to make their lives easier… Rosie the maid, the conveyor belt dog walker and especially the flying automated cars.

As an adult, I see that same cartoon as a dark harbinger of our future.

It should come to no one’s surprise that Congress believes that we cannot think for ourselves. In their eyes, we cannot be trusted with our own safety. In their minds, we are the unwashed masses that need constant direction and ever-present supervision. They say that it is for our own good, and we have seen it coming all along.

It’s name is Intelligent Transportation

Systems (ITS) and it wants your motorcycle off the road. Former Senator Bob Letourneau had this to say when I forwarded a link to an article about Google & ITS to the MRF Reps mailing list: “We certainly talked about that at a MRF Board meeting over ten years ago when ITS was first introduced, Wayne Curtin warned the Feds that they would have to take motorcycles under consideration during development. MRF was one of the first organizations to step up and speak to this issue. I guess we are now a lot closer to reality...”

What Bob was commenting on is this recent headline - Google Unveils Driverless Car Tech. A company that started out making the results of your web searches more relevant is upping the ante, and they’re holding all the cards.

Instead of finding results for your search on “spark plug gap on 2002 Harley Evo engine”, they are geek-deep in self-driv-

ing car technology. In fact, a full ten percent of the folks employed by the search engine giant are dedicated to the building of autonomous vehicles.

These driverless cars, completely controlled by computers, are said to be for the betterment of highway safety and traffic decongestion. The car operates with a $75,000 laser spinning around on its roof that generates a 360º, three dimensional model of the space around the vehicle and compares that information to known maps. It can then use that data in a manner that gives it omnipotence of every road and traffic light, but it also recognizes the position of every other car on the road as well as pedestrians. This all happens regardless of weather or time of day.

The Google robot car recently completed a one thousand mile trek through complex city traffic and highway conditions.

Nevada’s legislature recently passed legislation requiring their state Department of Motor Vehicles to create the rules that will govern these robot cars. Google has high hopes that the federal government and even other countries will follow Nevada’a lead and do the same.

This scenario begs the question… what if you have outstanding parking tickets and the cops detect that you have entered one of these driverless cars? Will you then be locked in and chauffeured downtown to address your grievous crimes?

Didn’t these geniuses ever see 2001: A Space Odyssey? I seem to remember that the primary focus of that flick was about an all-controlling computer gone rogue.

Or, even better yet… don’t they remember George Jetson flying around the electric dog walker?

Use of Road Guards May Be Endangering Lives

Because of its size alone, the Big Texas Toy Run can be "an inconvenience one day a year" for motorists, Nick Taddonio says.

On. Sunday, thousands of motorcyclists will leave Fort Worth and Dallas and head toward QuikTrip Park in Grand Prairie as part of the annual charitable event, which benefits needy children in the Metroplex.

To limit the inconvenience, on- and offduty police officers will help direct traffic as the bikers travel along Interstate 30.

"There are many, many police officers involved," said Taddonio, president of the

charity's board. "We say on our flier it's police-escorted and it's not just at the front end of the line."

But not all motorcycle rides are as big, or as organized, as the toy run.

When motorcycle clubs set out on rides -occasionally for charity, often just for fun - they sometimes use their own bikers, or "road guards," to direct and block traffic, a common but illegal practice that is being blamed for the death of a man in October in Granbury.

Gap when he was fatally injured.

According to a Granbury police report, members of the motorcycle convoy were trying to stop cross-traffic at U.S. 377 and Temple Hall Highway so the group of riders could stay together. Del Val and a second biker collided with an SUV while entering the intersection against a red light.

Although a Granbury police spokesman said the case will go to the Hood County district attorney's office for presentation to a grand jury, the accident report lists Del Val's disregard of the red light as the sole contributor to the crash.

The crash has focused attention on the use of road guards to block cross-traffic, regardless of traffic signals, until all riders can pass.

"This is a very common practice for the hordes of bikes that ride around the small towns of North Central Texas -- it happens a lot," a person wrote in a letter to the StarTelegram. "Really friendly way to drive.

Motorcyclists want cars to be bike friendly, but apparently that is a one-way street."

Interpretation of law

Some motorcyclists argue, however, that the law is ambiguous and that the use of volunteer road guards is a safety measure to keep motorcyclists and other drivers safe.

"It's a gray area," said Jeff Wilson, president of the Cowboys from Hell riding club, to which Del Val belonged. "It's always been one of those things that you just don't know what they're expecting of us. When the laws were written, it was for a single bike or a single car. ... But the laws aren't written for 80-something bikes riding at the same time. There's no clause for that."

Today as I put on my thermals, leather pants, chaps, vest, scarf, and another scarf, pull my helmet on then extra thick gloves. I ponder the question

is it just me, or getting older? Seems to me there was a day when I would hop on the back of a bike at any chance I got. My attire never seemed to matter, it was never too cold or too hot. I am not sure if it was just the alcohol that made me weather resistant, or sheer stupidity, but I did it.

If it is 70 degrees or lower, I am a popsicle. Is it because I am from Phoenix, and 70 is cold? And the rain, it rains here so little, more than often I see others riders wearing the same rain gear we are, the hefty bag. In our Too Broke For Sturgis bags we add a hefty bag for it’s primary purpose, to remind everyone to pick up their trash, Due to most activities most riders toss it in their bags, and thank God for that, those afternoon rains come on so fast!

Many say Arizona is the ideal state to live in (and it is!) because our can ride year around, yeah right. When it is 117 here, unless it’s your primary source of transportation, you are defiantly going for A/C, and night riding becomes the norm.

It is cold and rainy now, as I run out to my “cage” to turn it on and warm it up, I look longingly at my bike all covered up, and think to myself “can’t wait until Spring!” I am freezing my ass off, and layering takes so long either way. I envy those who need not layer, but not me, I will be the chick looking like an Eskimo, unable to move my arms, legs and head.

transportation code, only law enforcement officers are allowed to block traffic unless an emergency occurs, such as a wreck.

While Fort Worth and several other cities have ordinances giving funeral escort companies limited authority to stop traffic, such rights do not extend to motorcycle convoys, officials said.

"If someone calls and says we're the DFW rider group and we want to take 200 motorcycles through your city, if you want to go through intersections, you're going to have to hire off-duty officers that assist you because we're the only ones that can stop the traffic," said Sgt. Ann Gates, a supervisor in the Fort Worth Police Department's motorcycle unit. "Otherwise you're going to have to obey all the traffic lights and signs.

You're not going to be able to expect to blow through there as a group and expect everyone to just stop."

Defining 'escort'

Though not funeral escorts, the Patriot Guard Riders often participate in processions as part of their mission to attend, by invitation, the funerals of American service members to show respect and help shield

mourners from interruptions caused by protesters.

George Winslow Jr., national president of the Patriot Guard Riders, said that if the group's members are part of a funeral procession that is not being escorted by law enforcement officers, "our practice is to follow all applicable traffic laws."

He said providing road guards is outside the group's normal practice "unless requested by law enforcement during a particular mission."

"In many states 'escort' has a specific legal definition, sometimes requiring special licensing and equipment," Winslow said.

"Normally we do not provide 'escort' services. However, we often participate in a procession, which is being escorted by law enforcement officers, which I understand leads many of the public to believe that we are the escorts."

But Wilson said hiring officers for informal rides like the one in which Del Val was killed is not feasible.

"It's not a sponsored ride or anything like that," Wilson said. "Nobody raised money.

It's not a sanctioned ride. It's like, 'Let's meet up somewhere Sunday and go for a ride.'"

Wilson said he believes that keeping the riders together is necessary for safety reasons and that road guards are a tool to help warn other motorists.

"I would think if you get a large group of 85 bikes coming through, you keep them together, you get them through and they're out," Wilson said. "To me it's a safety issue -- to keep the bikes together so everyone can watch over everybody."

'It's reckless'

Kat Fay, the driver of the Kia Soul involved in the collision, disagrees.

She said such groups assume that other motorists understand the purpose of a person acting as a road guard.

"I had no idea what was going on," Fay said. "I had never experienced it before or even heard of it."

Fay said she found it unusual when she pulled up to the red light and spotted a

motorcycle stopped in front of the car to her right, but had no idea that the motorcyclists were trying to stop all cross-traffic or that a large group of motorcycles was even headed her way when her light turned green and she proceeded forward.

"The woman on the back of the bike started waving her arms and yelling and pointing to my left," Fay said. "I looked left and there were motorcycles basically hitting my car at that point."

Fay said the Granbury investigator who worked the case mentioned to her that if the group had simply requested the Police Department's help, officers would have escorted the bikers through town.

"They can't take it into their own hands," Fay said. "I think it's reckless. I think that they're putting their lives at risk. They're putting other people's lives at risk."
