President’s Report THINK GLOBAL, ACT LOCALLY! Monday, January 12th, 2015 marks the first day of a new legislative session at our State Capitol. Our new governor, Doug Ducey, will give his State of the State address and swear in all elected state legislators. This is a big meet ‘n greet day at the Capitol. Feel free to attend and wear your vest, be visible and approachable.

Are any of you surprised that our elected Federal officials waited until the last minute AGAIN to pass a $1.1 trillion budget in the middle of the night to avoid shutting down the U.S. government, with only hours to spare? We have the most dysfunctional legislative body in U.S. history, and are a laughing stock in the eyes of the World. What a poor example they set for the rest of us, instead of working together for the betterment of ALL. Did you notice dur-

ing the recent mid-term elections, some of the politicians avoided calling themselves Republicans or Democrats? While some of them are as tired as most of us about the extreme partisan arguments, others proudly stand by their party lines and won’t budge or negotiate. Will it change in 2015-2016 with the newly elected officials? I doubt it, but shame on us if we don’t make our voices heard. I like to get news and views from “across the pond” and go to www.eutimes.net The European Union Times reports on subject matter you don’t see on U.S. main stream media. Check it out.

Treasurer – Matt Brown 1. Sent Chapter balance sheets for review, awaiting year-end account information. 2. Several Chapters are not consistently sending monthly financial reports to Matt. The ones who not sending the reports are also the ones who did not attend Officer Training at the beginning of the year. It is most important that ALL Officers attend Officer Training each year so they are aware of requirements, especially treasurers. 3. We are reminded of rules regarding proximity of decision makers to the treasury of the organization and each chapter; for example Chapter Coordinator and Treasurer cannot be the same person, nor can they be members of the same family or living together under the same roof. State Officer Meeting Minutes

1. Annual Pins v. patches article written by Larry appeared in the most recent Masterlink. Larry will update Chapter Membership Officers regarding process for ordering pins at the Chapter level. 2. Updated Chapter rosters have been sent to Chapter Membership Officers. 3. The PayPal account holds a balance that gets swept by Matt twice a year. Safety – Jim Silk MAP – Working on updating material to be ready for spring presentations.

ARA – So far, there is no response from the article in the Masterlink. Jim will make a flyer to be distributed at Bike Night events. Jim continues to work with local H-D dealerships for sponsorship of the program.

Designated Lobbyist – Vic Grady 1. Motorcycle Day at the Dome (MDATD) is scheduled for 2/23/2015, 11-3 on the Senate Lawn. Volunteers are needed for setup and tear down. School children may request to attend the event and may be excused from school that day to attend this civic event. Planning is ongoing. 2. The lobbyist team is continuing to focus on issues of handlebar height. 3. Vic is actively recruiting business members to join ABATE. 4. Legislation regarding permanent plates for motorcycles is on hold for now. 5. Opening day of the Legislative Season is January 12, 2015. The Lobbyist Team is hoping many motorcyclists will show up to meet their legislators. Communications – Charity Stuart – Deferred. ANNOUNCEMENTS: Upcoming RUNS/Events: 12/13 – Barbie Hensler Memorial Toy Run, Payson, sponsored by HCC of ABATE, starting at the Historical Journigan House, 202 W Main Street at 10 AM. 01/03/15 - ABATE Officer Training 11-3 at the American-Italian Club. 1/17 – American Legion Rider, Post 2 – Skin & Steel Event OLD BUSINESS:

1. Topic: Membership

a. Discussion: a.i. Progress continues on placing the membership database on the Cloud. Steve Palmer hopes to have the project complete by Officer Training so a demonstration can be done at that time.

b. Action: ongoing. c. Responsibility: Officers.

2. Topic: Too Broke for Sturgis a. Discussion: Planning for the 2015 event is underway. The next committee meeting is scheduled for 12/17 @ 7PM at American – Italian Club. b. Action: Ongoing c. Responsibility: TBFS Committee

3. Topic: Run Coordinator Vacancy Discussion: This position is still open. Action: Ongoing Responsibility: All Officers 4. Topic: White Bandana Program Discussion: Mike is working with Scottsdale H-D and Chester’s H-D to develop a process for distribution of the bandanas at those locations, as well as financial support from those dealerships for the program. More bandanas need to be printed soon. Dealerships want to put their logos on the bandanas since they are sponsoring, however there are some apparent legal issues to resolve first. The dealerships have been strongly encouraged to become business members of ABATE to further demonstrate their support. Marketing departments of the dealerships are involved to resolve issue. The cost of printing bandanas for each location is yet to be determined. Action: Ongoing Responsibility: Mike 5. Topic: Proposed Policy &Procedure Updates Discussion: Several updates and revisions have been suggested, discussed and adopted throughout the year. Action: All accepted changes will be completed in time to provide updated P&Ps to Officers and BOD members during Officer Training. Responsibility: Jean 6. Topic: Stand-Up for Standdown Discussion: ABATE has been asked to assist with this fund raiser for homeless veterans by producing bike games at Chopper John’s Bar on Saturday, 3/21/15. Those working the games need to meet with the event organizers to work out the logistics. ABATE can have a membership booth at the event. This event is around the same time as Bike Week, so the organizers hope to have a good turnout and raise money for their cause. Action: Meeting to be scheduled. Responsibility: Clyde Brooks and others will meet with the organizers.

7. Topic: ABATE Communication e-list Discussion: The e-list on abateofaz@googlegroups.com needs to be updated for 2015. Once all 2015 officer information has been sent to the State

8. Topic: ABATE website merchandise store Discussion: ABATE of AZ has been connected to Café Press for some time for sale of ABATE merchandise. However, ABATE of AZ has not received any money from that website for sale of products related to our organization. MK has made repeated attempts to communicate with managers of the website with little success. Squarepeg Promotions is developing a similar online store and may be a better resource for merchandise sales in the future. Further information is needed regarding both sites. Action: Communication with both businesses. Responsibility: Mary K will communicate with both and share information with officer group. NEW BUSINESS:

1. Topic: Annual Officer Training Discussion: Officer training will be held at AAIC on Saturday, January 3, 2015, 11-3. The large Bingo Hall is reserved for the event. All Officers are expected to attend. Lunch (sub-sandwich) and drinking water will be provided. Officers will receive materials and instruction regarding duties of their offices. There will be a whole group meeting followed by small group meetings. Action: All Officers are expected to attend. Responsibility: All Officers.

CRITICAL TIME FRAMES: DECEMBER – State Treasurer – Corporation Commission Report due, to be submitted on-line. DECEMBER – State Officers/BOD – prepare for Officer Training to be held in January. DECEMBER – State President – bi-annually, as new State Officers are elected, ensure at least 2 ABATE State Officers are AMA members and receive AMA’s Safety Training Certification. Sunday November 23 2014 East Valley Chapter members gathered at the FOE building in Mesa.

Joe Ferrucci conducted the meeting while Jack Batty took minutes.

Richard Dalton led the Pledge and a moment of silence.

Mike Shearhart gave a chapter membership report that he sent out a lot of renewal reminders.

Larry gave a PAC report focusing on the MRF's Legislative Agenda for 2015. Larry also reported on ABATE of AZ switching from pins to patches to recognize years of continuous membership.

Jim Silk reported on Riders' Advantage Program.

Woo Hoo! So let the New Year adventure begin Other important and exciting news:

Phoenix Vulcan Riders had a successful run and made a lot of money for MAKEA-WISH.

It was decided that Michele Peltier will head the committee for the Valentine's Party on February 7th.

Mike Meyers was approved to give presentation at our February meeting.

After the meeting, several of us rode over to support the 2014 MMA Birds on Bikes at St. Vincent De Paul. Then it was off to Minder Binders in Tempe for lunch and exciting conversations. Be safe out there enjoying the ride and as always keep it rubber side down. Here’s to my first Chapter Report and wind knots in our hair,

High Country Chapter

High Country Chapter ABATE held our 12th annual Barbie Hensler Memorial Toy Run on Dec 13th. We hold this event to benefit the less fortunate children of the Rim Country area. Barbie, though H.C.C. ABATE began working with the Moose Lodge 852 of Star Valley, AZ, 12 years ago. Helping less fortunate children was her passion She organized and ran this event every year until she passed away Dec. 6th 2010. This event was named in her honor. At the Historical Journigan House, HCC volunteers began setting things up. Every one was coming together to make this happen. It was great to see so many Brothers and Sisters volunteering to help. Special thanks to those that got involved.

When the event began we suspected a small turn out due to the nasty weather. We soon realized we were wrong. People started rolling in and bringing a multitude of toys. Brothers and Sisters of RCD MMA helped out by bringing a load of toys,bicycles, and warm jackets. Our thanks goes out to them.

Due to the weather our bead run was done in cages with trailer in tow. We hit all the business members to pick up the donation boxes that had been dropped off in November. Thanks goes out to; Punkin Center, Butcher Hook, Jakes Corner, Spur Bar, Moose Lodge 852, Sidewinders, Tonto Silksreen, Payson Wellness Cntr, Buffalo Bar & Grill, El Rancho, Scrubbs & More, and The Historical Journigan House. Without them and their patrons generosity none of this would have been possible. They do so much to help us out, and welcome us with open arms we love them all.

Back at the Jounigan House we unloaded and began to party. Our gracious hosts were serving up food and drink while we did raffles photos and announced winners. Thanks to them for allowing us to hold our event at their establishment.

We began to reload the toys and gifts into the trailer and found we needed a bigger trailer. We loaded the rest into other vehicles and headed for the Moose Lodge for delivery. They were very grateful and amazed at the amount of toys we were able to collect. Then when we presented them with the cash donation of $782.00 their jaws bout hit the floor.

The generosity of the High Country community is outstanding. They really come together to help those in need. I know Barbie would be proud, and I am proud to be a part of it. It was a lot of work but well worth it. The Moose Lodge will be having their Christmas party for the children and I will be in attendance. Last year was pretty touching to watch these kids having a Merry Christmas. Now with the new year we will begin plans for Wild In The Weeds. We have a new venue and some new ideas that I believe will make this year bigger and better. Still, we have a lot of work ahead of us and only five months to do it in. I will keep everyone informed. The meeting was relatively short this month since many of us were out preparing for the holidays. Vic Grady announced that he will be stepping down from the designated lobbyist position after the Motorcycle Day at the Dome event on February 23rd. Jonny D reminded us that the new legislative session starts on January 12th and if you can, be at the capital or at least make an effort to contact your legislators at that time. Let them know we care.

The November meeting was held at the Kettle Restaurant on November15th. The

meeting started at 9:10 AM with the Pledge of Allegiance and Prayer for fallen Brothers and Sisters.

Officers Present were Coordinator Jim Butsback, Vice-Coordinator Don Boule’, Treasurer Dawn Detelj, Sgt at Arms Robert Guenther and our BOD/PAC Officer Sean Pinder.

The minutes of last month’s meeting were approved.

The Treasurer’s report was read and approved.

We explained the 50/50 and the Dollar jar for new members is attendance. Once again we had a problem with the Kettle’s meeting room being double booked so we had to hold the meeting in the one wing of the restaurant. This seems to happen a couple times a year. We will meet with Sam and see if we can do something different to avoid this. The nominations for officers for the upcoming year were opened. As usual we are having trouble getting folks to step up and help. Elections will be held in December at the meeting on Dec 20th. Safety Officer Jim was not able to attend so we reminded everyone to be sure to check tire pressures and drive carefully until your tires warm up on these cold days. Be careful also as drivers are consumed with holiday events and will not be looking out for motorcycles.

Membership reported one new member on the roster and notice from the state that one more has joined. We also had one new member turn in an application at the meeting. WE show three members renewed and two business members renewed.

Sean Pinder was reelected as our B.O.D. rep and our P.A.C. rep. Sean reported on permanent plates for motorcycles being discussed. Also VMT taxes are being proposed in many states based on miles driven. To date 18 states have studied this type of tax. Did everyone read the article in the Masterlink that motorcyclists are 23% better behind the wheel when they get back into their cars? One study from London found this to be the case.

On the distracted driving front the question comes up on how does an Officer determine and prove that distracted driving contributed to an accident? Should we really push for legislation for distracted driving or does this fly in the face of education not legislation? Motorcycle Day at the Dome is set for February 23rd, 2015. This is a Monday, so mark your calendars. This event is put on by A.C.M.C, A.B.A.T.E., and M.M.A. It has usually been held on a Wednesday in the past but was changed to try and accommodate the Reps & Sens. Bring your families to let the politicians know we are families that ride together.

The State meeting and Election was a success. The Yuma chapter met on December 9th at 6:00 pm at the Kountry Kitchen Café in the foothills to conduct our monthly business meeting. MOTORCYCLISTS GAIN SOME RELIEF FROM CONGRESSIONAL HELMET LAW EFFORTS Driven by discontent, disillusionment and distrust, American voters saw red in November’s mid-term elections and whisked control of the Unites States Senate to the first Republican majority since 2006 and won additional seats in the Republican-led U.S. House of Representatives, as well as favoring the GOP in numerous statewide races and a majority of gubernatorial contests nationwide.

While most of the electorate is simply happy to see an end to a record $4 billion in campaign ads appearing incessantly on television, radio and newspapers, and in in-boxes and mailboxes everywhere, motorcycle riders should be especially glad to have won at least a temporary respite from helmet law threats from Congress and in states where Republicans have remained or gained in governance.

Administration included a thinly-veiled attempt to impose a national helmet law through the U.S. Department of Transportation’s (DOT) surface transportation reauthorization proposal to Congress, but the measure was derailed by the Republican-controlled House. Three years ago, motorcyclists across America successfully opposed a proposed amendment to S.1449, the "Motor Vehicle and Highway Safety Improvement Act of 2011,” that would have called for a National Mandatory Helmet Law for all motorcyclists.

Although federal agencies like the National Highway Traffic Safety Administration (NHTSA), the National Transportation Safety Board (NTSB) and Centers for Disease Control (CDC) will undoubtedly continue to advance their pro-helmet law agendas, lacking a Democrat majority in either chamber will likely curb enthusiasm for helmet law mandates from Washington, for now. PAY-TO-PLAY HELMET LAW PROPOSED IN NEW MEXICO In a unique scheme to punish motorcyclists for exercising their right to ride without a helmet, a Discussion Draft of a Senate bill proposed for the 2015 52nd

Legislature for the state of New Mexico would create a system of taxation for riders who opt not to wear a helmet.

Specifically, “The department [Motor Vehicles Division] shall make available distinctive motorcycle validation stickers that signify that any person age eighteen or older who operates a motorcycle on which that sticker is affixed are not required by law to wear a safety helmet. The department shall issue validation sticker when a qualifying person pays the fee as provided for.”

A standard validation sticker is just $15 annually, but it would cost $692 per year for the “distinctive motorcycle validating sticker” that allows the rider to go lidless…the additional tax revenue to be distributed as follows: $541.60 to the trauma system fund, $135.40 to the brain injury services fund, and $15 as additionally provided by law. Otherwise, the rider and passengers must wear a helmet, even though New Mexico law currently does not require helmet use for those 18 and older. “My concern is this will turn into a helmet law in New Mexico,” said Annette Torrez, chairperson for the New Mexico

Universal Helmet Laws May Help Save Young Motorcyclists

WEDNESDAY, Oct. 29, 2014 (HealthDay News) -- A new study suggests that state laws requiring "universal" motorcycle helmet use -- instead of helmet laws just for certain ages -- may lower the rates of traumatic brain injuries in young riders.

of the Texas Department of Motor Vehicles that the DMV is taking the position that even if dealers are licensed to sell it as a motorcycle, owners of the Slingshot will not be able to register it because it is not street legal as far as Texas “motorcycles” are concerned.

The conflict hinges on the wording used to define a motorcycle in Texas. The Texas Department of Public Safety Motorcycle Operator’s Manual says three-wheelers are defined by certain characteristics, one of them being “saddle seating,” meaning “seating in which the rider/passenger straddles the vehicle,” but the Slingshot’s seats sit side-by-side. Because it doesn’t have a “saddle,” the DMV ruling prohibits the Polaris Slingshot from being registered as a motorcycle, so they will not be sold in the state until this “VERY urgent matter” is resolved.

The Texas precedence has the potential to sway other states to define the Slingshot similarly, a scenario Polaris is surely hoping to avoid. Polaris has fought hard for their not-car classification, and have used the fact that their vehicles are legally considered motorcycles to ease their passage through regulatory waters, but this gray area has led to some other unintended legal consequences, such as operator licensing, vehicle registration and applicable helmet requirements. Ultimately, it has everything to do with the way laws are written and how "motorcycle" is defined therein,

Traumatic brain injuries are "the biggest burden in trauma care, so we wanted to see whether having universal helmet laws versus age-specific helmet laws really made a difference in the younger population," study co-author Dr. Bellal Joseph, a trauma surgeon and associate professor of surgery at the University of Arizona, Tucson, said in a news release from the American College of Surgeons.

States with universal helmet rules require all motorcycle drivers and passengers to wear a helmet. The new research doesn't confirm a link between the universal motorcycle helmet laws and lower rates of serious head injuries among youths. Still, researchers said that laws requiring helmets do reduce deaths and traumatic head injuries in adults.

Nineteen states and the District of Columbia require all motorcycle riders to wear helmets. Some states require them only for those under 18 or 21, even though research shows that the highest rates of death and injury are among riders

Indiana scooter riDers facE new regulations Indiana officials are warning motor scooter drivers that starting in January they’ll need license plates on those bikes. Legislators have approved Indiana’s first license requirements for scooters, and under the new law drivers of scooters with engines of 50 cubic centimeters or less will need to buy license plates and pass a Bureau of Motor Vehicles test involving road signals and signs. Operators of scooters with larger engines will be required to follow motorcycle requirements, including holding a valid motorcycle license or learner’s permit. Evansville police officials told a legislative committee that scooters had often been involved in accidents and used in crimes such as robberies, but that the owners couldn’t be found because they lacked any registration. The new law doesn’t require insurance for drivers of the smaller scooters, and the registration will cost $26.35, plus a $10 excise tax.

Law sponsor Rep. Dave Wolkins (RWinona Lake) said not requiring a driver’s license for scooter operators was important because he felt it was necessary that those with drunken driving convictions still have a way to get to work. Minibike Manufacturer to Pay RECORD $4.3 Million Federal Fine

The settlement resolves CPSC charges that the firm knowingly failed to report within 24 hours, as required by federal law, known defects and an unreasonable risk of serious injury involving 11 models of minibikes and go-carts sold nationwide from November 2004 through June 2010. The defects in Baja’s products, which consisted of fuel leaks and unintended acceleration, resulted in the recall in 2010 of 308,000 Baja Motorsports minibikes and go-karts, which is when Baja filed its Full Report with CPSC.

Although the company agreed to pay the fine, it did not admit any wrongdoing and said it was paying to “avoid the cost, distraction, delay and uncertainty” of continued proceedings. Previously, the highest penalty the safety commission had issued was a $4 million fine against Graco Children’s Products in 2005 for failure to inform CPSC about dangers to children.

On Nov. 1, Military Police and leaders at all levels began enforcement of U.S. Army-Hawaii Policy Letter 11 on Motorcycle Safety, consisting of four major changes to the pre-existing policy, including changes to required safety equipment and prohibited equipment. “When operating a motorcycle on USARHAW installations, riders must wear a DOT approved helmet, protective eyewear, abrasion-resistant gloves, long pants (excluding PT pants), long sleeves, and leather/canvass boots or sturdy overthe-ankle shoes,” and such regs are typical of most military bases, but their new policy “prohibits riders from wearing high-top basketball shoes while riding.”

Additionally, the new policy specifies the use of reflective gear at all times, and riders must wear either a fluorescent (brightly colored) and reflective vest, jacket or upper outer garment, or they must wear a motorcycle specific jacket with padding/armor. But what’s most concerning is “Prohibited Equipment” that is NOT allowed to be worn: “Riders on-post are not authorized to wear any garment that

By Handi, S.R.M.C. & A.B.A.T.E. State PAC HOPE YOU AND YOURS’ HAD AN AWESOME HOLIDAY SEASON AND NOW I FIND THAT, YES, Another year has slipped by. Beginning with the New Year, personally I have a refreshed state of mind, and this year I have some rebuilt human body parts. Yeah!

I truly believe that the forthcoming legislative sessions, for all the states, will undoubtedly be a busy one. The AMA, MRF, ABATE, COIR, and US Defenders are a few of the many motorcycle rights organizations nationwide fighting to keep our freedoms. These organizations, along with the many designated lobbyists, are warming up and getting ready for a busy time. Sharing ideas and staying in the information loop is my plan, and I hope to bring important information to all that read this publication every month.

Sharing information I uncover from many sources continues to be a privilege. As your ABATE State Political Action Coordinator, I realize that my perspective may be a little different because I hold opinions of a MC patch

holder. But the current laws that are in place effect all riders, period. I take interest in the how those laws are enforced here and elsewhere, and like keeping you informed on trends. I believe there is growing interest in what’s next. New language for old bills, new sponsors along with new laws, will affect all motorcyclists across the nation and globally. WE CAN, and must, set aside our differences and unite as one voice. To initiate change, we need to know our Representatives and Senators, and support the officials that are interested in what we think. There will be an opportunity on January 12, 2015 at the State Capitol to find the officials that want to be our allies. OUR recently elected officials will be “shaking hands and kissing babies”, in an effort to get to know their constituents that elected them. This will be a great opportunity for an initial introduction that will be followed by MOTORCYCLE DAY AT THE DOME, ABATE’s annual “lunch on the lawn” at the capitol.

MORE MOTORCYCLES EQUALS SAFER ROADS

According to the Motorcycle Industry Association (MCIA), an increased number of motorcycles on the road results in a lower rate of serious accidents. When 10% or more of vehicles on the road are motorcycles, mopeds or scooters, there is a proportionate reduction in rider fatalities, says Steve

PAGE 9 Kenward, CEO of the MCIA, a motorcycle trade association in England. Japan has 98 bikes per 1,000 vehicles (9.8%), and for every 1,000 bikes on the road, the country has 0.8 motorcyclist fatalities per year. In Europe the ratio of bikes to cars is lower, at 73 per 1,000 (7.3%), and the rate of motorcyclist fatalities is higher, at 1.52 per 1,000 bikes. In the USA, the ratio of bikes to cars is just 27 per thousand (2.7%) and the motorcyclist fatality rate is much higher, at 5.32 per thousand bikes.

Kenward told how “volume breeds safety” at the recent National Safer Roads Partnerships’ Conference, where police forces, local authorities, government officials and academics meet to discuss road safety.

There is also a growing body of evidence that those who start their motoring career on motorcycles make better car drivers.

With congestion on the rise, Kenward explained that getting more motorists on motorcycles would result in a “virtuous circle” leading to better road users. According to their research, an increase in motorcycle use has also been proven to keep traffic flowing. A study which models traffic for one of the busiest roads in Europe concluded that if just 10% of drivers swapped to powered two wheelers (PTWs), congestion would be reduced for all road users by 40%. Increase that number to 25% and congestion is eliminated entirely.

The new policy applies to all motorcycle operators on USARHAW installations. In addition, the policy applies to all 25th Infantry Division Soldiers, both on and off-post.

STUDY SHOWS LANE SPLITTING POSES NO ADDITIONAL DANGERS A series of new studies out of the University of California, Berkeley found that the practice of lane splitting poses no additional danger to motorcyclists. California is the only state that allows for the maneuver, which is the act of a motorcyclist passing slow or stalled traffic by riding in between cars along the lane lines. Two yearlong studies were recently released by UC Berkeley and were commissioned by the California Highway Patrol and the Office of Traffic Safety, and determined that the seemingly risky move of weaving in-between traffic to be

no more dangerous than just riding a motorcycle, when executed in a safe and prudent manner.

The state-commissioned research considered thousands of accident reports and found lane splitting is poses no more risk than riding a motorcycle in a marked lane, with the exception when lane splitting (a.k.a.; lane sharing, or filtering) is done at speeds over 10 miles an hour in excess of traffic flow.

One report is a crash study that examined 8,262 motorcyclists who were involved in crashes while lane splitting between June 2012 and August 2013. The second report examined lane-splitting habits among various groups in 2012 and 2013.

Researchers found lane splitters are less likely to be rear-ended (2.7% of crashes vs. 4.6% for average motorcyclists), and lane-splitting motorcyclists involved in crashes were notably less likely than other motorcyclists to suffer head injury (9.1% vs. 16.5%), torso injury (18.6% vs. 27.3%), or fatal injury (1.4% vs. 3.1%).

Lane-splitting in California appears to be on the rise, with 62% of motorcyclists admitting to lane-splitting on both freeways and other roads, a 7.5-percentagepoint increase over 2013.

Data from the studies will be shared with the CHP, which this year began working on guidelines for lane-splitting. Authors say the report, the first of its kind about lane-splitting, will be followed up by more in-depth analysis, including looking at rider age, rider gender, motorcycle characteristics and collision and roadway characteristics. In many countries, lane splitting and filtering are normal practices for motorcyclists, particularly in highly urbanized areas of Europe and Asia.

I am always intrigued at the reactions of other motorcyclists when I pull up behind one on the side of the road. Whether this person is resting, gearing up, or has a legitimate problem; the reaction is usually the same, thankfulness and disbelief. I attempt to explain my reasoning behind stopping with these simple words: “If I were you and you were me, I would want you to stop.”

So let me relate to you a short story from the road. This happened on my normal morning commute and instilled an unexpected feeling of pure brotherhood.

In Phoenix, motorcycles are allowed to ride in the HOV lane. After entering the freeway I always move all the way over to the left to enjoy riding in this less congested lane. This morning I happened to jump in behind two other motorcycles. The first rider was a KTM and the second was another Harley. I tend to keep my distance from other riders because I like riding not falling down!

After feeling the second rider out a little, you can feel if they are seasoned in your gut, I closed the gap to decrease the likelihood of getting cut off in traffic. We were all very close and starting to get more comfortable with each other. We rode like this for about twenty minutes.

Then it happened.

I spied a Street Glide about half a mile up on the left side of the freeway. Instantly I came off the throttle and slowed to prepare for a stop. Much to my surprise so did the other two riders! The Harley rider in front of me actually turned his left blinker on when he slowed. The gap between the KTM and the car in front of us grew as he slowed preparing to stop. The stopped rider looked like he was just gearing up to protect himself from the cold weather. I racked my throttle, which can be heard for miles much like a howler monkey, and the rider saw us coming. He jumped on his bike and scooted into the gap I held for him. This happened because the

Hello again, this is my last article 2014.

The 113th Congress has just concluded its session. The last thing that they did was to pass a continuing resolution/omnibus funding bill to keep the government running until September 2015. It is a $1.1 trillion, 1603 page monstrosity. It will take some time to read this entire compilation of spending, but I am here to touch on some of the high points.

There was nothing in it that directly affects the motorcycle community except for the NHTSA funding which remains intact so we will continue to get block grants for motorcycle safety and awareness. HR 1861, the ban on federal funding to be used for motorcycle only checkpoints, is dead. The 114th Congress will hopefully take it up and of course I will

work to get every congressperson in Arizona to co-sponsor any bill that will benefit motorcycle riders.

Many in our community are veterans and so I will touch on a couple of points that benefit the veteran community. This omnibus bill had a provision in it that will give active duty military a pay raise, not a big raise but it is a cost-of-living increase. The Veterans Administration received full funding that they requested which will help ease the overload at the VA hospitals across the country. If anyone is having any issues with VA benefits or medical care they are encouraged to seek out their local congressperson by contacting their district office. Every one of them has a staff member that only works to assist veterans in their dealings with VA issues.

Every two years at the close of the congressional session, any bills that were not passed cease to exist. When the new Congress is sworn in in January, they will start over and hopefully we can convince some of them to propose legislation that benefits motorcycle riders.

The Arizona state legislature begins its new session on January 12, 2015. Any bills that were in process that have not passed will also be gone and new legislation will begin to hit the floor on January 13. MMA is proposing a bill that will eliminate the height limitation on handlebars for motorcycles. Everyone is encouraged to contact the legislators and Senator in their district and asked them to support this bill. down and make our presence known. As of last count there are more than 183,000 registered motorcycles in the state of Arizona. It would be really nice if we could go to the legislature and tell them that we represent nearly 150,000 voters. The only problem is that most of us in our community are fiercely independent, many of us do not trust any government entities, and a great number of us really don't understand how the government actually works. I find it disheartening that when I speak to some groups I get questions that relate to this basic misunderstanding. I am not a constitutional scholar but I have studied a great deal about how our government is structured and why the founding fathers agreed on this design. One of the biggest misunderstandings we have is that the President of the United


MASTERLINK JANUARY 2015 States somehow can control the budget process. Congress, or more specifically the House of Representatives, must initiate all spending and taxation. No President can levy, raise, or lower taxes without an act of Congress. The President cannot enact laws. The only actual power he has is to direct the agencies under his control to operate in ways that are within the law. He can also veto legislation with which he disagrees. The only way that anything will ever get done in this country is if the different factions in Congress can come to agreements while making the laws and also get the President to agree with their product.

This last Congress was least productive of any in the history of the United States and while they may have passed more than 300 bills, many of them were duplicates that were voted on over and over again. We can expect that the 114th Congress will probably do as much or less.

One question I was recently asked is about the President’s executive order concerning immigrants. The actual order does not grant citizenship or amnesty, it does not even allow people to obtain a green card. All it does is defers action on deportation for people who have children who are citizens. This simply means that for the next two years they do not have to fear being arrested and deported but they still have to register with the federal government for the deferred action.

Another question I was asked was whether there was a $97 million cut to veterans programs and the answer to that is no. Only Congress can raise or lower the amount of money given to federal programs. As we are going into 2015, I am asking everyone to become more involved, call your legislators, call your Congress people, call your Senators. The government that we have is the one that we create.

In this last election 45.7% of registered voters in Arizona voted. Only about half of the eligible voters in this state are registered and that means that less than 25% of people who were eligible to vote decided who is going to run our state and represent us at the federal level.

The congressional race in the Tucson area is still undecided as of the writing of this article. There were 161 votes separating the two candidates. The results of the recount will be published in a Pima County court on December 17. There are more than two hundred ballots that were thrown out and are the subject of further litigation. We may not know the actual results until sometime in January of 2015. So if you voted, look around you and realize that there are three people in your vicinity who didn't care enough to step up and help choose who will be making laws.

Yosemite National Park Set to Overcharge Motorcycle Riders

On Oct. 20, the Yosemite National Park proposed a new fee structure for park entrance that would place a disproportionate and unfair financial burden on visiting motorcyclists.

Under the proposal, fees for passenger motor vehicles would increase 50 percent from $20 to $30. Additionally, the entrance fee for hikers, bikers and horseback riders would also increase 50 percent from $10 to$15. But, the entrance

fee for motorcyclists would increase 150 percent, from $10 to $25.

It may have taken nearly a year, but President Barack Obama has finally made his choice for National Highway Traffic Safety Administration (NHTSA) administrator. The White House announced it was nominating Mark Rosekind , currently a National Transportation Safety Board (NTSB) board member, to lead NHTSA.

House Energy and Commerce Committee Chairman Fred Upton has said that he's glad to see the president is “finally taking steps to fill this critical safety post, especially in light of the mounting recalls."

Rosekind, sleep scientist by training, has been on the NTSB's board since 2010. Before that, he spent 13 years as the president of Alertness Solutions, and also worked for NASA for several years.

I received an invitation to come to Arizona to present the 3Rs at ABATE of Arizona's Annual Members Meeting. The 3Rs is the impaired riding presentation that MRFA&E has been promoting around the country at BEAST of the EAST, BEST of the WEST, Meeting of the Minds, Heartland STEAM, Mid South MILE and a number of SMRO annual meetings.

The opportunity to present this program to more riders and to prolong summer just a little while longer by traveling to Phoenix in November was something I couldn't pass up.

discussing arrangements for my trip long before Meeting of the Minds. She and Clyde Brooks, another BOD member met me at the airport and welcomed me to Arizona.

Another great surprise was when Mary Kay Donnay, President of ABATE of Arizona told me that Mike Meyers was outside joining ABATE of Arizona. Mike was past State Coordinator for ABATE of Illinois and presented an Illinois fatality study at Meeting of the Minds in Ohio. Mike now lives not far from Phoenix and when he saw that I was to be on the program he rode over to join ABATE of Arizona and to see the 3Rs again.

One of the great benefits of traveling to other states is the chance to renew friendships. That was never more evident than when Eric and Darla Hampton walked through the door on Saturday. Eric is the Editor of the MRF Reports and Darla served as Assistant to Membership for the MRF. I hadn't seen either of them since a Bikers Inside the Beltway meeting in Washington DC several years ago. It was great to see each of them and to catch up on what has been happening with them.

I want to thank all who made it to our Road Clean-up on Saturday morning. We had 9 members show up to help pick up trash. Since we as a Chapter have been doing this it gets easier every time we do it. This past Saturday we finished in less than an hour. The group was sitting in Buddy's enjoying our lunch and some refreshments by 11AM.

Thanks again to John Hanusch for putting everything together and talking time to get the food for lunch. John has been doing a Great Job spearheading this program.

Defense Wins!!

cles, like railway tracks or wet leaves. Educate yourself about the many hazards on the road. Don't assume that you know all the dangers because you've been driving a cage for years. The hazards are different for motorcycles, and the consequences of a motorcycle crash are often severe.

The best defense when navigating the road on a motorcycle are to get lots of training on how to safely handle your bike, use caution, and anticipate hazards. Here are some general tips for everyday riding:

Understand what constitutes a road hazard. Some bikers are unaware that certain things are hazardous for motorcy-

Avoid heavy traffic. When possible, travel when traffic is light. That way, if you encounter a road hazard, you'll have more room and time to maneuver. Look for less-traveled routes where vision is unobstructed.Avoid rush hour if ya can!

Don't tail the vehicle in front. Follow vehicles at a safe distance --at least two seconds behind.Nobody likes a tailgater .

Constantly survey the road and the surrounding area. Keep your eyes up and look ahead. Survey the road and take note of everything --other cars, children playing, trees that might house small animals, painted surfaces --and then change your speed or path accordingly. See,search and evaluate the road front and in back of ya!

Plan escape routes. As you ride, think of ways you could evade any potential road hazards. For example, decide if you can safely travel on a shoulder to avoid a large gravel patch, or notice what cars are around in case you must swerve to avoid a snake or debris in the roadway.

Note hazards on roads you use. Make mental notes of fixed hazards that you encounter on roads you travel. That way, you can anticipate problems or even avoid some routes at certain times or during bad weather.Remember where those road grooves are on the freeway and avoid them at all costs!

Slow down when necessary. Your speed should match your sight distance. Also slow down when you see, or even anticipate, a hazard.

When it rains, wait. If possible, wait until the rain has stopped before you ride a motorcycle. If you must travel in the rain, try to wait until it has been raining for at least one half hour before you hit the road.

Learn the skills necessary to navigate hazards. Motorcycle handling skills are often the key to safely navigating a road hazard, or surviving a skid, wobble, or dicey situation caused by a hazard. Get training on how to safely handle your bike. Learn about ways to navigate gravel and ridges in the road and what to do if your tires skid on slick surfaces. There are many websites devoted to motorcycle enthusiasts that provide practical advice on how to handle hazardous riding situations.

Owner of Motorcycle Maker Sucker Punch Sallys Accused of Fraud

Scottsdale police say Clayton, 64, defrauded at least two people by taking money for custom bikes that were never made.

"They had placed orders from out of state or out of the country and made significant deposits to have the work done, and these custom motorcycles weren't put together and weren't shipped out," Scottsdale Police Officer Kevin Watts tells New Times.

Police say Scottsdale PD's auto crimes unit has been investigating the shop for two years, and along the way, found more than $3.6 million worth of judgments in civil court cases against Sucker Punch Sallys.

The felony charges of theft by misrepresentation stem from two people, one from North Carolina and the other from Canada, who paid out about $35,000 for custom "bobber" motorcycles that were never delivered.

Watts says these latest cases amount to felony theft instead of civil claims because

Scottsdale-based custom motorcycle maker Sucker Punch Sallys, has been arrested on felony theft charges.

While the customers were inquiring as to why their bikes weren't being delivered, police say the company doled out excuses, like, "We're working on it."

"For a while it was, 'We're in meetings with investors, so we're not taking new orders,' but that didn't cover people who put down deposits -- significant deposits," Watts says.

Scottsdale PD's auto crimes detectives think there could be more victims, so they're asking to contact the police department if you've been defrauded by Sucker Punch Sallys.

Back in 2008, Sucker Punch Sallys was profiled in a story for the Arizona Republic's business section.

The story says that at the time, the company was making about 450 bikes a year, and were being sold at 25 dealers nationwide.
