2017 promises to be a busy year

Let’s continue that into the next year as well. January 9, 2017 - Opening Day at the legistlature. This is the first day in session for the 53rd Legislative Session. Come on down to the state capital and see how things go.

There is alot on the agenda for 2017. I was going to start out the year with an article on freedom. I put the notes back in the binder and will write that article on another day.

There are a few things I want to pass onto you all. Get out your calendars and write down the dates because we all need your support. ABATE of Arizona has a reputation of being freedom fighters.

February 15th, 2017 - Motorcycle Day at the Dome. Join us on the Capital lawn for lunch and discussion with the legislators about motorcycle issues. It’s always a great time. Make an appointment with your representatives that day and/or just invite them to the lunch. Officer training is January 7th at the ABATE State office. Johnny D and I will be going over some PAC training. If you’d like to come up and sit in so you can support your chapter PAC officer, we would love to have you sit in.

Freedom Fighters. This is what we do. We challenge the status quo and make sure motorcyclists are represented in Arizona. We need loud voices. I have pictures of my father outside of the state capital in California standing with ABATE fighting the mandatory helmet law there. He was a loud voice for motor-

cycle rights.

There are a few things on the agenda that I want to share as well. We have a sponsor for the extension of the Motorcycle Safety Fund in this next session. This will extend it and do away with the committee so the red tape can be cut. We are still working on the research for a lane splitting/lane filtering legislation. Also we are still fighting for more sponosrs/co-sponsors for House Resolution 831. Call your US Representative and encourage them to sign on and support the resolution. We are looking into an anti-profiling legislation here in Arizona as well.

It’s going to be a tough battle this coming year but the lobbyists from all the SMRO and PAC are standing together and helping each organization out so we all have a united front. Join the cause and support your local chapter. I hope to make the rounds to all of the chapter meetings in the next few months. As always, if I can help you out, let me know. News from the MRF

ethanol with gasoline and diesel. Under the law, the EPA has the authority to designate volume requirements,which according to the 2007 law passed by Congress must reach 36 billion gallons by the year 2022. However, the law does provide the EPA with some authority to lower the annual volumes as circumstances warrant. The 2017 requirements were published just days before the Thanksgiving holiday. Every year, the EPA adjusts the

amount of renewable fuel it requires oil refiners to pump into the nation’s gas supply. After initially signaling lower renewable fuel goals, the agency reversed course. According to the EPA Press Release, total renewable fuel volumes grew by 1.2 billion gallons from 2016 to 2017, a 6 percent increase. Ethanol enthusiasts were quick to praise the EPA. Senator Joni Ernst, a Republican from the corn-producing state of Iowa, released a statement saying this:

President’s Report

Motorcycle Day at the Dome is put on by the State Motorcycle rights organizations here in Arizona, ABATE of Arizona being one of them. This is on Wednesday February 15th, 2017. It is a day set aside for motorcyclists from all around the state to ride to the Capitol and set appointments to meet with their legislators and let them know the issues that are important to us and to get them to support us. All the SMROs are involved and they provide the tents, tables, chairs etc. along with a lunch for those who come out meet with us. ALL ABATE members are urged to attend and to contact their Representatives and Senators. If you cannot make it to the Capitol please be sure and call or email you Legislators that you wish them to meet with the motorcyclists who are in attendance.

Greetings Fellow Freedom Fighters! Happy New Year! I hope everyone had a Great Holiday Season! This year looks to be a very good year for ABATE of Arizona and the other SMROs here in our state. There are several upcoming events that we are looking forward to. First there is the opening day of the Arizona Legislature in January. It would be great to see as many motorcyclists as possible to be at the Capitol to let the new legislature know that we are involved and willing to make our voices heard.

Also coming up is the annual BIKERS INSIDE THE BELTWAY! This is put hosted by the Motorcycle Riders Foundation in May. Every year Motorcycle Freedom Fighters from all over the United States converge on Washington DC in May to walk the halls of Congress and meet with the Senators and Congressmen in order to further the legislation that is important to motorcyclists on a Federal level. This is an amazing event. As it gets closer more information will be coming out. Many of our

lady types. I would imagine that we are the object of their fascination. I also believe it is a fundraising scheme by the various law enforcement agencies that will participate. Be careful, save your money, watch your speed.

Welcome to 2017. We are about to find out what this new year holds for us. One thing for sure is something called Zero Tolerance Zones. Apparently there will be sections of Arizona freeways that will have extreme speed law enforcement. One mile an hour over the speed limit is all it takes to get a ticket. You probably know they will not focus on the little old

This past month the State Officers and the Board of Directors hosted our first Holiday/Christmas Party and Social. This was an experiment to get our ABATE members from various Chapters to come together and socialize and just enjoy a little Holiday Happiness. I feel that this was a great success. We had a good turnout especially for the first year, and we are going to look into doing more of these types of events throughout the year. I feel it is important for members of the different Chapters around the state to get to know each other and to spend time together. It seems that the only time we get to do this is at Too Broke for Sturgis and most of us are way too busy working and putting on the event to enjoy each other’s company. I want to take this opportunity to express my sincere thanks to Dawn and Nolan

ABATE PAC Report

January 9th is opening day at the legislature. All the freshly elected legislators will be sworn in and listen to the Governor give his state of the state speech. I am sure all of you will be at full attention during this time. It would be great to have as many bikers there as possible. We really don’t have much on the table this year. We should be there to show that we are paying attention. There will probably be a helmet law proposed. I don’t think they will do much with it.

I did meet with several Senators and was disappointed that there is a great deal of law enforcement influence there now. Our Governor is very pro-LE. We will proba-

bly have an Attorney General at the Federal Level that will not be biker friendly. I fully expect to see the Feds cracking down on the biker lifestyle, especially the motorcycle clubs. Rudy Giuliani was involved with the transition team for the new president. There is a picture of him wearing a confiscated Hells Angels cut when he was the Manhattan District Attorney and he directed an all-out assault on the New York charter. There are 98 federal benches that are vacant due to the Senate refusing to hold hearings on nominees. Those will be filled with judges that are of the mind set favoring law and order. When I hear Law-And-Order, my head goes on a swivel. It is usually me or someone like me who is deemed out of order. I know that I am considered an outlaw. February 15th is Motorcycle Day At The Dome. It is a day to come to the Capitol and meet with your legislators. We will

The strength of an organization like ABATE of Arizona is its membership. Without members we cannot accomplish the good work that we try and do. It takes many hands pulling on the rope to get the job done. I want to thank all of the members of ABATE of Arizona for being here and supporting the cause of motorcycle rights here in Arizona. If you think we are doing a good job please tell your friends and other riders you encounter what we do and who we are and encourage them to join. If for some reason you feel we are not doing what we should or you know an area we may want to look into please contact any of the State officers or any of your Chapter officers and pass the information on to us. I hope this coming year is a good one. I really feel that what is coming will hurt a great many people as well as help a great many. My wish is that we all prosper and keep our health. I will endeavor to fight for our rights and work for the betterment of the biker community. Until the 9th, keep the shiny side up. Stay safe out there, there will be a lot of sunshine to ride in.

East Valley Chapter Honors Jack Batty

Jack Batty... even just seeing or hearing his name brings a smile to most everyone who knows him. Jack has decided to take a break from being an officer and board representative.

Compared to many of our members I am still a wet behind the ears newbie. Being said newbie and curious I asked Jack what positions he had held so far during his ABATE adventure. At the chapter level it might be easier to just say what he My name is Robert Keith Rice. I go by Keith. I have been a part of A.B.A.T.E. in a few different states since the late 70s. I am interested in starting a new chapter with local motorcycle enthusiasts in and or around Bullhead City, Lake Havasu and Parker. There are alot of motorcycles on this side of the state and I believe if

hasn’t been. Here is the list he gave me: Jack has held the positions of Chapter Coordinator, Vice Coordinator, Secretary, Runs/Events Coordinator, Communications, Merchandise, Masterlink distribution, and last but not least East Valley Chapter Board of Directors representative.

At the State level Jack has been President (Coordinator), and Vice President (Vice Coordinator).

At the November 27th ABATE of Arizona East Valley Chapter Meeting we surprised Jack with a lifetime membership in recognition of all he has done for the East Valley Chapter, because Thank You just couldn’t even come close to cutting it. East Valley Chapter

I am writing this as I sit here with my big toe wrapped in ice poking up in the air, because a big toe doesn’t win against an electric pallet jack. Ha ha ha.

By the time you read this some of the big holidays will be behind us for 2016. We will be creeping up on New Year’s. A time for resolutions like do better maintenance on your bike, buy a new bike, take a safety course, or better yet get endorsed just a few suggestions.

Let’s look at what this newest Chapter of the East Valley saga has in it.

On November 19th our very own Joe Ferrucci finally put his money where his mouth is or should I say Spaghetti. Our beloved Joe won the Spaghetti eating contest at American Legion Post 2, becoming the Spaghetti King complete with crown and cape. Being the awesome man that he is he donated back the money he won. At our Nov 27th monthly meeting we took care of a little business with completing the annual Chapter Officer vote. On Dec 4th many of us attended the annual membership meeting and 1st annual Christmas Social Chili Cook off that was hosted by the State officers and BOD representatives. It was a blast. Thank You to the FOE on Broadway in Mesa. Everyone was so awesome. We had Santa stop by for a visit. White elephant exchange was a lot of fun. Some of us got up and did Karaoke for the first time ever. Speaking of Karaoke Woody from High Country Chapter is amazing. Not only can he sing he has a heart of gold he won the 50/50 for $62 and donated it back.

The Chili was awesome. There wasn’t a single one that I didn’t like but in the long run Trauma Mama from Phoenix Shadow Mountain Chapter beat us all winning $160 which being the beautifully gracious woman she is she donated back.

I must admit I am looking forward to our Chapter meeting this Sunday with it being our Annual potluck. Yummy, Yummy. Looks like that about brings us up to date. I can’t stress it enough PLEASE be extra careful and watch out for our visiting drivers (snowbirds). Until next month, be safe out there.

High Country Chapter

Hello brothers and sisters.

Well here it is 2017, with 2016 in our rear view mirror, our chapter is already working on this years events and activities.

We held Barbies Toy Run in December as we always do and the amount of donations were incredible. We had four truck loads of toys and over $2000 in cash donations, all to help the children of rim country. Most of us were pretty beat after Barbies, but stuck it out to help deliver. Dry eyes were in short supply when we delivered all the toys and cash to the Ladies Of The Moose, Moose Lodge 852 in Star Valley.

The Moose Lodge held their Christmas party the following week and invited the families that need the help. Gifts, coats, hats, gloves, and food boxes were handed out, and every child got a chance to sit on Santa's lap and tell him what they wanted for Christmas. Oh and did I mention Santa and his Ole Lady arrived on a fire truck? Thanks Again to Hell's Gate Fire Department. Just goes to show how the biker community and the community of the Rim Country area comes together to help out their fellow man.

Special thanks goes out to CC rider, Woody, and Debi Shaffer for their hard work. To the Buffalo Bar and Grill.and their awesome staff for hosting us. To Butcher Hook, Jake's Corner. To the Spur, El Rancho, and Sidewinders. To MMA, AAA Med-ex, and a few others I'm sure I may have forgotten. Special Recognition should really go to Punkin Center Bar and their customers. They are responsible for almost half of all the cash donations we received in the last three years. They are just awesome. Phoenix/Shadow Mountain Chapter

The Phoenix/Shadow Mountain Chapter met on Sunday November 13th at the AAIC. Among other things, the following was discussed. The Treasury report accounted for the chapter funds and Membership reported 151 individual members and 11 business members. In the Safety report, Teresa informed us that in the healthcare industry, through Trauma Statistics, they work with legislators to assist in putting up traffic lights and turn arrows in high frequency crash locations; and also reported on the ADOT Special Strategic Safety meeting she attended to provide input on how to reduce fatalities for motorcyclists. Filling in for the PAC report, our Designated Lobbyist Michael Infanzon spoke about the progress being made by the Arizona Motorcycle Riders Political Action Committee (AMRPAC) through its outreach to our returning and new representatives. Merchandise reported that Moon Mullins Run shirts are still available for purchase and chapter hoodies will be available soon. In New Business, JR is proposing that all ABATE Chapters purchase pop-ups and asked that our Chapter agree to contribute. The cost is being finalized and a decision for our Chapter’s participation will made at the December meeting. The goal is for each Chapter to have ABATE branded popups available for their local and State events, including “Too Broke For Sturgis” in June 2017. The November meeting was held on the 19th at the Kettle Restaurant.

The minutes of last month’s meeting were approved as written, and the Treasurer’s report was accepted.

Once again our meeting fell on the same day as the “Tour De Tucson” bicycle event. Unfortunately we failed to realize this at last month’s meeting or we would have change the location for the meeting as we have done in the past. Several of our officers were absent due to various reasons and we had a small turn out because folks could not get past the police state running the bicycle race. By the time this hits the Masterlink we will be into the New Year. We hope all had a happy holiday season and we look forward to a productive 2017. We have several important events coming up. It is important that we have as much representation as possible. If you

“Bikers inside the Beltway” is coming up quickly. This is held in Washington DC and is when motorcyclists from around the country descend on the Capital and lobby our federal lawmakers. Anyone interested in attending this event please get in touch with the Chapter officers.

Opening day at the Arizona Capital is January. Try and make it to the Capital to let the lawmakers know we are involved and active here in Arizona! In a last-ditch effort by Democratic strategists and the Hollywood elite to derail President-Elect Donald J. Trump’s ascension to the presidency, U.S. Electoral College delegates have been swamped with requests to ignore their pledge and “vote your conscience,” but longtime bikers’ rights advocate Jim Rhoades of ABATE of Michigan, one of that state’s 16 electors, says they’re cries are falling on deaf ears because he’s obligated to speak for the voters of his state. Appearing on FOX News network’s "Your World" wearing his ABATE shirt, Rhoades revealed that he's gotten over sixty thousand emails, phone calls and basketfuls of form letters calling on him to vote against Trump, as well as some threats, but believes fellow electors also feel steadfast about their duty and will support the will of their states’ voters when they cast their ballots on Monday, December 19th.

In the aftermath of a norm-busting 2016 Presidential campaign, Trump won 306 Electoral College votes to Hillary Clinton’s 232, but if 36 “faithless electors” changed their ballots it would send the election to the U.S. House of Representatives to be determined, where Republicans hold a majority. In the past, some electors turned “faithless” in nine out of the last 17 elections, and a total of 179 times throughout American history, but no electors have ever changed the outcome of an election by voting against their party’s designated candidate.

ANALYSTS ADVISE INVESTORS TO BET ON MOTORCYCLES AND PIZZA

Every U.S. presidential transition brings a change in priorities, forcing market gurus to bet on which sectors of the economy might benefit from the new administration, but with corporate analysts admittedly baffled by Donald Trump, prognosticators are doing some intellectual gymnastics.

Joseph Spak, a Royal Bank of Canada analyst, thinks Donald Trump’s $1 trillion plan to rebuild American infrastructure will ultimately provide construction

workers with extra cash. And what do construction workers like to spend money on? Motorcycles, of course.

“If the economy is stimulated and construction jobs increase,” Spak recently predicted that Harley-Davidson Inc. “could see some better demand.”

According to the Wall Street Journal, another firm advises investors that pizzadelivery companies that benefited from a high-drama campaign that kept many diners glued to their televisions might continue to profit from the drama of a Trump transition. FEDS SEEK TO REQUIRE NEW VEHICLES TO TALK TO EACH OTHER

U.S. auto-safety regulators have proposed new rules requiring automakers to adopt crash-avoidance technology that allows all new vehicles to communicate with each other, a move that could help accelerate the development of self-driving cars.

The requirement of so-called vehicle-tovehicle connectivity (“V2V”) on all consumer vehicles within the next five years is viewed as central to the development of a new age of cars that can avoid accidents by wirelessly monitoring each other. V2V technology uses short-range radio communication to allow vehicles to identify each other's speed, location, direction and acceleration or braking,

The move marks a concrete step by the National Highway Traffic Safety Administration toward its goal of eliminating roadway deaths within 30 years, and agency officials told USA Today that vehicle-to-vehicle and vehicle-to-infrastructure technology could eliminate or greatly reduce the seriousness of up to 80% of crashes that don't involve driver impairment. NHTSA pledges that the new technology would not divulge any personal information regarding drivers. EUROPEANS TO TEST AUTONOMOUS CARS WITH MOTORCYCLES

Vehicle authorities will cooperate with European motorcyclists’ organizations to conduct their own test program with different brands of semi-autonomous cars. “The Dutch are authorizing further testing to see if these ‘semi-autonomous’ cars can operate safely with motorcycles on the road,” says Oregon A.I.M. (Aid to Injured Motorcyclists) and COC (Confederation of Clubs) Attorney Sam Hochberg, who alerted the National Coalition of Motorcyclists (NCOM) about this important issue here and

abroad. “This is going to be a real issue here in the USA in the not-too-distant future.”

In response to a letter motorcyclists' organizations FEMA (Federation of European Motorcyclists Associations), MAG NL (Motorcycle Action Group – Netherlands) and KNMV (Dutch Motorcycle Association) sent to RDW, with regard to the European type approval of the Tesla by RDW, a meeting took place recently where the motorcyclists' worries were addressed. RDW is the Netherlands Vehicle Authority that issued the European type approval for Tesla.

A driver of a Tesla - and other advanced cars - can leave key actions to the vehicle itself, while in the opinion of the motorcyclists' organizations this equipment is not, or not sufficiently, tested with motorcycles. In the discussion about the concerns that motorcyclists have with admitting (semi-) autonomous vehicles on the roads, it soon became clear that many of the concerns of the motorcyclists' community are shared by RDW.

RDW proposes - in cooperation with the motorcyclists' organizations - to conduct their own test program with different brands of cars with Advanced Driver Assistance Systems. RDW also believes - as do the riders - that testing with motorcycles should be part of the test protocol for European type approval.

Dolf Willigers, General Secretary of FEMA: "We are very pleased with the outcome of this first meeting with the experts of RDW. We are going to act together and we will see in the field tests to which extent the technique takes motorcyclists into account." NEW YEAR, RENEWED EFFORTS IN D.C.

With the 114th Congress set to adjourn, and a new congressional session beginning in January, some federal bills that motorcyclists have been advocating will expire and need to be reintroduced.

House Resolution 831 was introduced in the U.S. House of Representatives on July 13, 2016 to “Promote awareness of

motorcycle profiling and encourage collaboration and communication with the motorcycle community and law enforcement officials to prevent instances of profiling.”

The National Coalition of Motorcyclists (NCOM) is working with other state and national motorcycle organizations to address profiling legislatively, and with Washington State enacting the first antiprofiling law in 2011, followed by Maryland this year, a national motorcycle anti-profiling measure would advance the efforts in every state to prevent discriminatory enforcement.

HR 4715 & S 2659, the RPM Act (Recognizing the Protection of Motorsports Act of 2016), would ensure that the American tradition of modifying vehicles into dedicated racetrack competitors is not only continued for today, but will be protected for future generations of race fans as well.

Although the federal EPA bowed to political pressure and public outcry this past April by removing provisions from proposed regulations that would have prohibited street-legal vehicles, including motorcycles, from being modified for racing, members of both chambers of Congress have introduced bipartisan legislation to protect the sport of racing by blocking the EPA from over-regulating the industry and ensuring that it remains legal to convert street legal motor vehicles for racing purposes.

Responding to the controversy over the proliferation of E15 fuel, which is not approved for use by any motorcycle manufacturer and can invalidate warranties, Congress is considering HR 5108 (the “Food and Fuel Consumer Protection Act of 2016) “to alleviate the ethanol blend wall under the renewable fuel program.” Specifically, the bipartisan bill would cap the ethanol content of fuel at 9.7%, and would also effect the EPA’s Renewable Volume Obligations under the Renewable Fuel Standard.

In addition, in January Congress banned the use of federal funds for controversial Motorcycle-Only Checkpoints as part of a $305 billion highway bill called the Fixing America’s Surface Transportation (FAST) Act, as well as allocating more than $4 million towards motorcycle safe-

ty programs, and going forward into the next Congress and an all new Administration bikers must work to protect those advancements we’ve already made. ANTI-MASK LAWS USED AGAINST BANDANAS

During the Confederation of Clubs (COC) meeting at the NCOM Region I Seminar in Irvine, California in November, as an example of discriminatory profiling, attendees were notified of motorcyclists in Louisiana who have allegedly been arrested for wearing bandanas over their faces while riding because police claim that covering your face in public violates the state’s antimask law against concealing your identity.

According to Louisiana statute (LSAR.S. 14:313) – “No person shall use or wear in any public place of any character whatsoever, or in any open place in view thereof, a hood or mask, or anything in the nature of either, or any facial disguise of any kind or description, calculated to conceal or hide the identity of the person or to prevent his being readily recognized…Whoever violates this Section shall be imprisoned for not less than six months nor more than three years.” It was further noted that many states have similar anti-mask laws on the books, so be aware.

“THE TWIN PEAKS AMBUSH”

On the fateful day of May 17, 2015, hundreds of motorcyclists and rights activists met in Waco, Texas to discuss current events and motorcyclist rights issues at a meeting of the Texas Confederation of Clubs and Independents (COC&I), and many subsequently had their lives changed forever. Nine people died, another 17 were injured that day after police opened fire on the gathering. Before the dust settled, 192 people were arrested, and charged with cookie cutter charges of participation in organized crime and held on $1 million bail each. Ultimately 106 were indicted on felony charges of “engaging in organized criminal activity.” A recent post from Easyriders Scuttlebutt

announces that Donald Charles Davis, who runs the popular Aging Rebel biker news site “has penned this interesting book (titled “The Twin Peaks Ambush: A True Story About The Press, The Police And The Last American Outlaws”) including far reaching interviews with people who were there on the scene, and attempts to make sense of it all, a tall order. He has done a good service, and we recommend the book to anyone who has an open mind and a heart. Bikers lives do matter.” WEIRD NEWS: WITCHDOCTOR SUMMONS BEES TO STOP MOTORCYCLE THIEF

Local news reports from Mbooni, Makueni in Kenya claim that a motorcyclist has managed to recover his bike from a thief after asking the local witchdoctor for help.

The witchdoctor allegedly contacted a large swarm of bees that had already begun to invade a local market, and sent them to track down the stolen motorcycle instead. According to motofire.com, the spell worked, and the thief is said to have run off ‘for dear life’ as the bees began settling onto the yoke and tank of the bike, as depicted in photographs of the scene. The reports then go on to suggest that the bees “also protected the bike from any further interruption for over half an hour until the owner could arrive, who then took his motorcycle home.”

Some say the swarm was merely an act of nature and nothing supernatural at all, and Assistant Chief Patrick Mwanzia said that the swarm simply arrived after the queen of the hive got stuck within the bike’s handlebars. And, in fact, “a similar incident had happened just days before when another bike was covered in a swarm for over two hours”… but how does that explain how the queen bee just happened to get stuck in that particular stolen bike? The U.S. Congressional Energy and Commerce Committee which has jurisdiction over the issue released a statement signed by Chairman Fred Upton (R-MI), Energy and Power Subcommittee Vice Chairman Pete Olson (R-TX), and Environment and the Economy Subcommittee Chairman John Shimkus (R-IL). The statement indicated that they still believed the “right balance” needed to found on the issue of ethanol,

but they praised EPA for meeting its statutory deadlines set forth in the 2007 law and vowed to continue to monitor the issue going forward.

The Motorcycle Riders Foundation (MRF)and other consumers of smallengine motors continue to have concerns about the effects of higher blends of ethanol in gasoline and the potential to cause severe damage to their bikes. The MRF is working with stakeholders on both sides of the ethanol debate to negotiate common sense alternatives that would allow the RFS program to continue while keeping in mind the interests of the American street biker.

Letter from Executive Director of AMSAF

First of all, what a wonderful year 2016 has been for AMSAF. We are so grateful to everyone that has helped to support AMSAF in so many ways. We have been so fortunate in getting support for our ultimate goal of helping to reduce motorcycle crashes, injuries and fatalities. It’s been a very rewarding year for AMSAF and yet there is still a lot of work to do in this area.

I’d like to reflect on our many accomplishments and hopefully those accomplishments have touched you in one way or another. At the beginning of the year, we worked on wrapping up a $150,000.00 Grant for Motorcycle training through our Scholarship process. Then in July we received another grant for $250,000.00 for additional Scholarships on motorcycle training. As we finish up 2016 we have given close to 2000 Scholarships to motorcycle riders across the State for a Basic Rider Course in motorcycle riding through these grants. This includes individuals from age 15 ½ on up to age 70. Many had never ridden before, some had but didn’t have an endorsement, and some had experience but wanted more training. AMSAF, from the beginning, has felt that the more folks we can get into a training course, from an education standpoint, the better chance we have to reduce motorcycle fatalities.

Our AMSAF motorcycle training Scholarship program is for the Basic Rider Course (BRC) and the Basic Rider Course 2 (BRC2). Both courses help you get you’re motorcycle endorsement here in Arizona.

During March, we held our 2nd Annual “Riding for the Long Haul” which was a huge success. This event is possible due to the State, Healthcare, Legal, Insurance, community organizations, and many motorcycle businesses coming together to help promote motorcycle safety and at the same time raise money to get more folks into a motorcycle training course here in Arizona. We are so appreciative of the many Sponsors and donors that helped on this and continue to come back each year for the “Riding for the Long Haul”. This next year’s “Riding for the Long Haul” will be Sunday, March 5th. Mark your calendar.

We expanded and updated our web site to make it easier to use for everyone looking at our web site. A lot of information on this site that is pulled from a number of sources along with information on what is going on with AMSAF. Check it out and if you have some suggestions on sections or topics we could add, please let us know.

Bikers Arrested for Wearing Bandanas

Louisiana motorcyclists in the Bossier/Shreveport area may be experiencing a mechanism of profiling that many are unaware of. It has been reported to the MPP that 17 motorcyclists in the area have recently been arrested for wearing bandanas, scarves, and even a bubble shield while riding because it conceals their identities in public. Local law enforcement contends that covering your face in public is a violation of Louisiana’s anti-mask law, LSA-R.S. 14:313, which carries a 6 month to 3 year term of imprisonment. Although every incident has not been confirmed, the MPP spoke to one motorcyclist directly and confirmed that he was arrested for concealing his identity on November 8, 2016.

The law used to justify targeting motorcyclists for wearing masks in Louisiana exists elsewhere. At least 15 states have what experts call “general anti-mask laws” that could be applied to motorcyclists. Applying anti-masking laws to motorcyclists covering their heads and

faces with protective gear is an abuse of statute and demonstrative of motorcycle profiling. An exemption for public safety ought to be obvious. Motorcyclist Arrested For Concealing Identity

While visiting Louisiana to attend and speak at a state Confederation of Clubs and Independents meeting in Alexandria, the MPP became aware of the alleged arrests for concealing identities in public. The MPP spoke to a member of a motorcycle club in the Bossier/Shreveport area that was able to confirm the validity of the rumors.

Although a traffic pretext was used to justify the stop, the MPP evaluated his citation and he was indeed arrested for concealing his identity, an alleged violation of state code LSA-R.S. 14:313. This individual was on his way to vote in the 2016 National Election. He was denied this opportunity. He was forced to pay a bond in order to obtain his release and as of this writing the issue has not yet been resolved.

(Notably, this same individual has been experiencing a pattern of harassment while riding his motorcycle. 9 days after the mask arrest he was again stopped and harassed for a series of pre-textual infractions preceding more questions about his club affiliations.) LSA-R.S. 14:313

Masks or hoods, wearing in public places prohibited; penalty; exceptions; permit to conduct Mardi Gras festivities, how obtained.

No person shall use or wear in any public place of any character whatsoever, or in any open place in view thereof, a hood or mask, or anything in the nature of either, or any facial disguise of any kind or description, calculated to conceal or hide the identity of the person or to prevent his being readily recognized. Whoever violates this Section shall be imprisoned for not less than six months nor more than three years.

This Section shall not apply:

To activities of children on Halloween, to persons participating in any public parade or exhibition of an educational, religious, or historical character given by any school, church, or public governing authority, or to persons in any private residence, club, or lodge room; or,

To persons participating in masquerade balls or entertainments, to persons participating in carnival parades or exhibitions during the period of Mardi Gras festivities, to persons participating in parades or exhibitions of minstrel troupes, circuses, or other dramatic or amusement shows, or to promiscuous masking on Mardi Gras which are duly authorized by the governing authorities of the municipality in which they are held or by the sheriff of the parish if held outside of an incorporated

ties from the mayor of the city, town, or village in which the festivities are to be held, or when the festivities are to be held outside of an incorporated city, town, or village, from the sheriff of the parish, a written permit to conduct the festivities. A general public proclamation by the mayor or sheriff authorizing the festivities shall be equivalent to an application and permit. Applying Law To Motorcycle Safety Gear Is Absurd

Originally the Louisiana law against wearing masks and hoods in public was motivated by the Ku Klux Klan wearing hoods and masks concealing their identity while they terrorized and intimidated others.[1] Louisiana’s law makes exemptions for Halloween and Mardi Gras, but none for public safety. Although clearly not the intent of the law, motorcyclists covering their faces to avoid bugs, wind, and rain may be subject to arrest.

Considering Louisiana’s mandatory helmet requirement based on public safety, the absurdity of applying anti-mask laws to motorcyclists is further demonstrated. Every helmet covers a motorcyclists head similar to a hood and all motorcy-

clists wear eye protection. The very act of riding a motorcycle legally requires concealment. A motorcyclist wearing a full face helmet could be arrested for concealing their identity if anti-mask laws apply. Remember, a full face helmet is considered the best protection among experts that advocate helmets.[2]

Some states that have similar laws have anticipated such conflicts and include an exemption for safety or sporting activities in their anti-mask statutes.[3] But 15 states, including Louisiana, have more general statutes that could lead to these abusive applications.[4] In fact, “general anti-mask laws proscribe the simple concealment of physical identity in public, regardless of coexistent criminal activity. Individuals have been prosecuted under general anti-mask laws for wearing a Ku Klux Klan hood, for dressing in the clothing and wearing the makeup of the individual’s opposite sex, and for placing a leaflet between the individual’s face and eyeglasses.”[5] Possible Solutions

Numerous strategies may exist to combat anti-mask laws being applied to motorcyclists. Judicially, filing for a Declaratory

Judgement arguing that the statute is unconstitutional is another option, although this has been attempted and has not always been successful.

“The conflicting court decisions, along with the varying scope of anti- mask laws themselves, reflect the uncertainty concerning when, if ever, the government can constitutionally ban public maskwearing. Further complicating this area of the law is the apparent political bias of some of the courts that have ruled on the challenges.”[6]

Legislatively, an anti-motorcycle profiling law would eliminate discriminatory pretext stops at the source. Also, adding an exemption to state statute for safety and sport, including motorcycling, would prevent abuse and preserve the original intent of the law.

Filming Police in Public is a Constitutional Right

Does a person have the right to film police officers in public? Despite clear precedent, the MPP has received the inquiry many times. This is a particularly relevant question relating to developing a “pattern of evidence” that proves motorcycle profiling is occurring. Indeed, video of police profiling motorcyclists was critical to passing the law addressing motorcycle profiling in both Washington State and Maryland.

As Americans, we should all be able to agree that the right to be present in a public place and gather information about an ongoing public concern is fundamental to a free society. This is the essence of political expression, political speech, and a free press, particularly when discussing issues of government accountability.

To deny the right to gather information in a public space would deprive the public knowledge about government abuses. Without this knowledge there is no impetus for advancing police accountability. A Legal Opinion-Simple and Concise

Millie Thompson, an attorney from Austin involved in both the criminal and civil proceedings stemming from the Waco tragedy that occurred on May 17, 2015, recently discussed the issue on social media. Thompson writes:

For those of you who don’t know:

We have co-equal rights to 1) be present in a public place, 2) gather information on a matter of public concern, and 3) speak on a matter of public concern. Police officers – as public officials and agents of the government – are by definition a matter of public concern. We therefore have the right to film them. This is not a privilege. It is a Constitutional right. Period.

Filming the police may not be something you would consider doing. You may also not be the type of grab a picket sign and take to the streets to protest something. Pick a topic about which you are passionate – whatever it is – it doesn’t have to be something I agree with.

Are you passionate about pro-life? Are you passionate about supporting the troops? Or ‘backing the blue?’ Pick a topic that you believe in. The people who support that issue have the same rights as those who disagree with you. Remember do unto others? You don’t have to agree with a person’s agenda to defend their First Amendment rights around that agenda.

Why defend it? Because it may be you in

the future who wants to speak about an issue. Or – it may be you who wants to gather information about government actors so that you have something interesting to say when you do speak.

Do you believe in government accountability? Don’t people need to know what the government is doing in order to hold them accountable? What Do The Courts Say?

The right to express information relating to an ongoing public concern often frames discussions concerning the 1st Amendment. Less commonly understood is the equally fundamental right to gather that information. Moreover, in an era of cell phone videos and social media the courts have granted individual citizens the same fundamental right to gather information in public as it has traditionally afforded the credentialed press.

In Buehler v. City of Austin (2014), the federal court concludes that the right to film the police in public derives from “foundational and long-standing principles of constitutional law.”

“A private citizen has the right to assemble in a public forum, receive information on a matter of public concern—such as police officers performing their official duties—and to record that information for the purpose of conveying that information.”

A Word of Caution

Despite the fundamental right to record the police, caution is in order. The right is not absolute and without limits. When filming police take care not to break the law or interfere with an officer’s ability to do their jobs.

“[N]either the First Amendment right to receive speech nor the First Amendment right to gather news is absolute.” Davis v. E. Baton Rouge Parish Sch. Bd., 78 F.3d 920, 928 (5th Cir. 1996). An individual is not permitted to break the law in the process of filming the police in public. For example, an individual cannot interfere with the police’s ability to do their job. “Thus, to the extent that an individual, in exercising his First Amendment right to film police officers as they execute their official duties, violates a valid criminal law, he cannot plausibly argue that his First Amendment right acts as a shield that protects him from criminal liability.”

14th Annual Barbie Hensler Memorial Toy Run

Saturday, Dec 10, 2016 the High Country Chapter of A.B.A.T.E. of Arizona held their 14th Annual Barbie Hensler Memorial toy Run to collect toys and clothing for local families in need this Christmas. The run, started 14 years ago by Payson resident and A.B.A.T.E member Barbie Henlser, was named in her honor shortly after her unexpected death on Dec 6, 2010. Barbie would have been proud of the turn-out this year at the Buffalo Bar & Grill in Payson which collected hundreds of toys which will be distributed by The Women of the Moose at Moose Lodge # 852 in Star Valley. The families benefiting are located from Tonto Basin to Strawberry, and everywhere in between. In addition, to facilitate any special needs and to make sure each family has a Christmas dinner to go with the toys, the High Country Chapter also raised $2,200.00 which the Moose Lodge will

use exclusively for those needy families.

“CC” Ransom of Strawberry was the chapter’s Event Coordinator and has been working since October “to make sure every child in need gets at least one toy this Christmas”. She was not alone, however as numerous volunteers, including the Rim Country District of the Modified Motorcycle Association of Arizona and a wide collection of Rim Country and Tonto Basin volunteers, many who do not ride, all joined together with the A.B.A.T.E. bikers to make this a magical Christmas for as many as possible. Toy collection boxes were made available at many area businesses including HB’s Place and Sidewinders Tavern & Grill in Pine; The Spur Bar in Star Valley, El Rancho and the Buffalo Bar & Grill in Payson, Jake’s Corner, and Punkin Center Bar and the Butcher Hook complex in Tonto Basin. The main event was hosted by the Buffalo Bar & Grill in Payson and fea-

tured music by Plum Krazy, Raffle and door prizes were given away, a silent auction was held, and a 50/50 drawing yielded over $100 to the winner, who then donated the whole wad to the kids (Thanks Bobbie!). The Buffalo Bar supplied the band and plenty of great eats and “holiday cheer”.

In total, there were probably 50 or 60 volunteers that participated at some level in making this event a success. Not to mention the numerous silent auction and raffle items donated to help with the fundraising. “Honestly, there are far too many people to thank. It is so wonderful to live in an area where everyone is willing to dig deep to help their neighbor” said Ms. Ransom. Special thanks goes to The Women of the Moose who will sort, wrap, check their lists at least twice, and ensure that 100% of the proceeds go to the children and families that really need it the most.

Sturgis Motorcycle Museum Hall Of Fame Calls For Nominations

Nominations for the 2017 Sturgis Motorcycle Museum & Hall of Fame are now open and must be submitted by Tuesday, January 10, 2017. The Hall of Fame was established back in 2001 to recognize individuals or groups who have made a long term positive impact on the motorcycle community. After vetting and voting, the Class of 2017 will be honored during the annual Rally on August 10, 2017. “Unlike the confusion caused by the

schism between the electoral college and the popular vote in our nation’s presidential election, there is no confusion as to our nomination process,” explains Executive Director Myrick Robbins. “The Hall of Fame’s mission is to honor those who have made a positive and significant impact on the sport and lifestyle.” There are no restrictions on who may submit nominations. Once the deadline for submissions transpires, all nomination files are reviewed by the Hall of Fame committee made up of the Sturgis Motorcycle Museum’s board of directors,

its Executive Director and staff directors.

“The criteria for being inducted into the Hall of Fame is to recognize the men and women who have dedicated much of their lives to improving, promoting and advancing motorcycling,” adds Robbins. “We also have a separate nomination specifically for the Freedom Fighter Award, which recognizes those individuals who have made sacrifices to protect the rights of those who ride. These men and women serve diligently, humbly and quietly so that we may enjoy the liberties that many of us take for granted.”
