Thanks to ABATE I was fortunate enough to attend the NCOM Meeting in New Mexico last month. There was an outstanding variety of thought provoking sessions that dealt with motorcyclist issues from discrimination, to profiling and getting riders to stand together, (no matter what they ride) in order preserve their right to ride free. For the last several years, ABATE of AZ has been trying to reach out to the Sport

Bike community to join ABATE to increase our numbers, add younger riders and increase the strength of our voice. As I was attending a break out “Lobby 101 Sport Bike Issues” I realized that sport bikes have their own unique problems, that in many cases we can’t relate to. We do know that they are stereotyped as “maniacs” who weave in and out of traffic recklessly, paying no attention to other vehicles. Do you really believe that everyone on a sports bike has a death wish? An outstanding presentation by Lady Ninja representing the National Sport Bike Association passionately detailed some of the reasons many of these moves are safety oriented. I think the message to the MRO’s, who are fighting for motorcycle rights, is that we cannot exclude or minimize the challenges these bikers face! If someone you know has a sports bike, bring them to a meeting, offer a bribe if you have to but urge them to get involved.

Double D (David Devereaux), another leader of the younger generation (can’t believe I’m using this phrase) is from Washington state. Law enforcement in Washington decided it was a good idea to set up “motorcycle only” stops, thereby profiling and harassing motorcyclists. Double D activated the Defender Program and got clubs as well as MRO’s to join forces and with their numbers and determination got the police to back off. He’s also has a video concerning how he got these results. If you or your group should encounter harassment, record in writing the following: Badge #, Name, Law Enforcement Agency, Date of Incident, Time and a dialog. The next and perhaps most important is to then call a lawyer. This is just a small sampling of what we can learn, and how we can be inspired by those who really take what’s preached about and put it into action.

So, I made it through the first month lol. I had the pleasure of attending my first NCOM, in New Mexico. It was really good see people that normally wouldn't/couldn't be in the same neighborhood let alone the same meeting center, standing next to each other all for the sake of motorcycle rights. So it makes me think back on just how ABATE came to be. As in most states, before bikers became politically organized, the clubs were the first to fight helmet laws and other restrictions. In the previous decade, before ABATE came into existence, people like the Hells Angels M/C and Ralph “Sonny” Barger had succeeded in keeping California helmet-law free. Rumors still circulate around Sacramento about 1,000 Hells Angels on the Capitol lawn (well, it seemed like a thousand) and more HA's camped out on the doorsteps of legislative opponents. But the old intimidation tactics were beginning to wear thin, and club leaders realized that they needed to legitimize their efforts by creating a more sophisticated political lobbying arm. Easyriders magazine editor, Lou Kimsey, made a plea in issue #3, October 1971, for bikers to come together to fight impending restrictions by joining a new national organization called the National Custom Cycle Organization, but because of a conflict with the acronym the name was changed in February 1972 to A Brotherhood Against Totalitarian Enactments (ABATE) (since, some have changed it to A Brotherhood Aimed Towards Education). Easyriders began granting state charters around 1974, and Keith Ball was the original national coordinator (Keith was for many years the editor of Easyriders). ABATEs which came into existence around this same time were chartered in Kansas, Virginia, Maryland, Pennsylvania, South Carolina and New York. So there you have it, a very brief explanation. As I have said many times before we need to get back to working together because the laws still affect us ALL the

same. Someone told me last week that it's like this. "If I come over to your house and have a cup of coffee with you then when I leave I take your helmet, and you don't do anything about it then next week I will come over again and have coffee and when I leave I am going to take your bike. If you still don't do anything about it I am going to keep coming over until I have everything you own." We need to stand shoulder to shoulder and show them we will not stand by and watch them take every right we have. We are not fighting for our rights, we have them, we are fighting to be able to exercise those rights and not loose them. The roots of ABATE run deep in the hearts of those who accepted, and in turn, passed on the torch called Freedom of the Road. To all those who came before, we salute you. To our current leaders wondering where the future will lead us, remember that it's totally up to us!

Treasurer Joel Jackson asked for a motion to move 40k from savings to checking to cover TBFS expenses. Motion Passed. At this time, treasurer Joel Jackson hand-

ed in his resignation effective October 31, 2011, later moved that to April 30, 2011 Discussion: Lobbyist Carol O'Reilly commented on motorcycle accidents/deaths: the common answer from the other motorist is "I didn't see them" as an excuse. Eric Hampton gave Tim's PAC report from memory from the chapter meeting earlier that morning. Noted that Scottsdale's intersections have the left turn after the green, thus in part giving a 4 second time for the intersection to clear and we should really push for this issue towards finding a solution to intersection accidents. With the loss of Kimmy as an example, we should question and demand for more right of way tickets. Matt Brown stated that the current time for pursuing a civil ticket is 6 months and in most criminal tickets there is a 7-year statute of limitations, depending on the charge. If the driver at fault is ticketed on the spot and then if the Attorney General

For us at H.C.C. we had one Hell of a weekend! It was our 7th annual Wild In The Weeds weekend , it was a good time for all that made it! We had riders from all over the state of Arizona! We had Ron Kool and the Gang (Southern Arizona Chapter) made there for the weekend ! JR from Phoenix he made it also, we also had more from there also! Riders came down from Showlow, Legion Riders from Fountain Hills made it, people from everywhere ! We all had a blast!

I also signed up some new members also! One business member ( WEAR THIS ) and two members! H.C.C's secertary signed up two also ! Yes Ron Kool's gang did too! Now I would like to give SHOUT OUTS to H.C.C.'s Activity Officer Spinner, JOB WELL DONE !!! My thanks too DEB FICKEL H.C.C.'s treasurer, H.C.C.'s vice coordinator Bill ( BUNGEE ) Hensler, WAYNE and DEE and too all that volunteered ! A very big one goes out too Jake's Corner Bar Rick and Ron and their crew ! Oh yea too Steve the outback man (haha), he's the person that runs the Jake's Corner Storage - that's where we camped for free ! the band Moonshine Mafia. The winners from the bead run and the raffles you know who you are! We must not forget the winners of the WET TEE SHIRT contest NORA 1st place and Cindy 2nd place a big WOW for all the girls ! Now you do know that our wheels are turning for our 8th annual already! Hope too see you there !!!

Mohave Chapter Phoenix/Shadow Mountain Chapter I’m back! I missed last months report, things got crazy here at ABATE, we have had a changing of the guard so to speak, and a few names you might recognize from our chapter, First is our NEW President - Margie Ferrucci, State Secretary - ME! Treasurer - Matt Brown and Assistant Treasurer - Jess Method. Designated Lobbyist - Carole O’Reilly, State Safety Officer - Jean Cooper, and in our chapter our new secretary is Donna Woodworth. Congrats to all, and Donna…Thank You! Thank You! Thank You! This months meeting was a bit small due to Mothers Day, here is what you missed. We had a toy run for Devin’s Toy box and PCH, we had collection boxes around the valley, The Maverick Bar, Dude’s Place the Cave Creek Café, Caldwell Banker, and American Legion Pat Tillman Post, Thank you so much for your donations! A great big Thank you to those riders who rode with us and donated their toys as well. Which brings me to a decision made by members, the toy run is a great idea but we have changed the date to Easter 2012. We are also having our annual TBFS packing party after our July meeting we need all the hands we can get we only have 2500 packets to fill. There are still openings for volunteers at TBFS, see Jimmy Page to sign up. It was a very short meeting. Next meeting June 12th 2011. Mark your calendars now! See you then! The meeting was called to order by Ron at 10:05 am. The Pledge of Allegiance was led by Ron Kool with a moment of silence for all those in harm’s way and all of the bikers recently lost. Our secretary Rich was not present and celebrating his wedding anniversary. Family always comes first! We had 20 members present with several guests. This was our first ever Saturday meeting at an earlier time. We enjoyed seeing some of our members that are at church on Sundays. If we our turn out is as good at the May meeting we will make the third Saturday permanent. A few of us did a quick check of our road cleanup mile. We snagged a few plastic bags in trees. Just a few of these bags makes our otherwise clean mile look crappy. We discussed the free bill board that MMA has on I-10. I think it is around mile 202 facing the east bound traffic. RJ will look into opportunities in southern Arizona. Besides a bill board other items are renting space on taxi cabs or other business fleets. Of the original charter members we still have 33 active that are due for renewal in April. Renewal notices have been sent and we have received several renewals back in the mail. Sean reported the BOD continues to research bylaw changes that will be included on the November general assembly vote. Sean brought is up to speed on several issues. We had discussion on police short or long accident forms. One problem highlighted is that a motorist who kills a biker may go to defensive driving or go to the clerk and pay the fine. This often happens before the police report is available to the victim’s family. The dollar jar winner wasn’t present so the money rolled over. It was a lively meeting with loads of information exchanged. Our meetings

Yavapai Chapter As of this writing we are about to hold the biggest event ever in the history of the chapter. The Run to the Hills event to be held in Jerome will detailed in next month's chapter report. Longhair James and Ralo have worked their butts off to put this together, and our chapter owes them a huge thanks. In addition to this event, it is May, so that means “look out for motorcycles.” I would like to thank Professor Terry Lovell for inviting me on his KYCA AM radio show on May 11th. He helped me to get out the share the road message to Yavapai County and also did a great job of promoting our run all week on his show. He is a former biker and a big friend to riders in our area. Our chapter would like to send out a get-well message to the MMA's Colin MacDiarmid. Who was struck by a person making a left turn on a a Highway 69 intersection in Prescott Valley. As of this writing he is intensive care and we all are hoping for his recovery from this tragedy, we are all too familiar with as riders. I would also like to make a observation of the make-up of the members of our chapters. Everyone I have spoke to are committed to motorcyclist rights and freedom. If our chapter were scrutinized by the E.E.O.C., (Fed's Equal Employment Opportunity Commission) they would have no issues as we are a diverse group. Since last November, the Yavapai A.B.A.T.E. members who are either independents, or belong numerous clubs have united to keep this chapter active. We are also a dynamic force within the state organization. We operate with a fantastically cohesive brother/sisterhood with a “gitr done” attitude. Any decisions made by our members were meant for the good of the chapter, and thus A.B.A.T.E. of Arizona. Until next month, ride free, but smart. Safety Report greeting folks, too.

May was proclaimed Motorcycle Awareness and Safety Month. Several Chapters produced public events to promote the ABATE mission in their areas. Thank you all for your efforts and support of the organization. I hope you all had as much fun as we did during the Phoenix-Shadow Mountain’s Safety Event which was a joint effort with MMA. Tim took photos of folks on the bikes, while Carole folded t-shirts and JC talked to anyone who dared walk past our table. Julie of MMA passed out lots of key fobs and bumper stickers. Robert and his wife were there

Make sure your skills are at their peak. Renew your skills by taking a safety course. Practice, Practice, Practice! Remember the Arizona Precision Drill Team offers a skills course for free, for donations. The next course will start in October. Check their website www.azdrillteam.org.

Last month I commented on the 2010 Arizona Crash Data Report. In that report there were two totals regarding motorcycle crashes. The differences were bothering me and I just could not understand why the two totals were reported. So, I called the Arizona Department of Transportation to ask for clarification. The explanation is: In 2009 there were 2,958 crashes and there were 3,029 injuries. It is all so very clear now! There can obviously be a greater number of injuries resulting from crashes. It did not seem so clear, even though I must have read that report five times. I look forward to the next Report to be published this September. I apologize for any confusion I may have caused.

We’ve learned that we cannot always prevent crashes. We can aim to improve survival. Again take a course. Check the Accident Scene Management Website for more information www.accidentscene.org. To improve your motorcycle safety, stay alert; don’t be the first to move when the light turns green (count to 5 then go); try not to go through an intersection alone (go through with a larger vehicle); perform a comprehensive preride inspection of your bike every time you go out.

Just because the month of May has progressed into June, it doesn’t mean that we can rest. We still have to work every day to get the message out about motorcycle safety and awareness. Visit the ABATE of Arizona website and encourage others to do so and see the newest PSA regarding motorcycle awareness.

PAC Report and Ranking Members of the House Transportation and Infrastructure Committee. The letter asks that the language of H.R. 904 and House Resolution 239 be included in the large Highway Bill that the committee will be drafting later this year. H.R. 904 is a bill that would prohibit future funding of mandatory motorcycle-only roadside checkpoints and H. Res. 239 supports the NHTSA lobby ban and asks the agency to focus on crash prevention rather than injury reduction when addressing motorcycle safety. Hello to all my Brothers and Sisters. One of the hottest issues throughout our Country today is a Federal House Bill (HR904). This piece of legislation, if passed would affect every motorcyclist and their passengers throughout the United States. Basically HR904 would prohibit future funding for “Motorcycle only roadside check points”. The Motorcycle Riders Foundation (MRF) Vice President of Government Relations and Public Affairs, Jeff Hennie, released a statement in support of HR904, during this year’s Bikers inside the Beltway event in Washington D.C. One of the top issues the attendees were lobbying for was asking their members of the US House of Representatives to sign onto a "dear colleague" letter sponsored by Wisconsin Representative James Sensenbrenner. The "dear colleague" being circulated by Sensenbrenner asks his fellow Members of Congress to sign onto a letter that will go to the Chairmen

Everyone, riders, passengers, their friends and family need to contact their U.S. House Representatives and ask for their support for HR904. Your phone calls and emails to your U.S. Rep’s will assist in passing this bill. May 5-8 I attended the NCOM (National Coalition of Motorcyclists) Convention held in Albuquerque, NM. Many issues affecting motorcyclists throughout the country were discussed including HR904. I attended a session whose guest speaker was Mitch Proner. Mitch, an AIM attorney spoke about a case he had just won in Washington State. The case involves Anti-Profiling of Motorcyclists. The Confederation of Clubs, US Defenders and ABATE of Washington State are seeking support for legislation that would condemn and prevent the widespread law enforcement practice of motorcycle profiling. Requiring law enforcement agencies to adopt a policy

preventing and condemning motorcycling profiling, would reinforce the State Supreme Court’s rejection of discrimination and pre-textual traffic stops reaffirming our right to privacy as outlined in Article 1 Section 7 of the Washington State Constitution. After a long legal battle the case was won and a monetary judgment award against Washington State Police of $90,000.00 for numerous rights violations against the bikers involved. I want to congratulate “Double D” David Devereaux from Outsiders MC and member of ABATE of Washington in his diligence in the passage of Washington State (SB5242) which was signed into law 4-13-11 by Gov. Chris Gregoire. This is an example of what can be accomplished when all MRO’s, U.S Defender programs, and the Confederation of Clubs unite for the passage of such important legislation. Washington State SB5242 was won on the state level, but we all need to join together to get U.S. HR904 passed on a federal level so motorcycle MRO’s of each state do not have to fight separate battles on illegal Motorcycle profiling stops, (Motorcycle only roadside check points). Motorcycle Fatalities Drop in 2010 The Motorcycle Riders Foundation has been informed of a report that will be released at midnight April 19th by the Governors' Highway Safety Association. The report takes a close look at preliminary highway fatality data for the States. The report which examines data for the first three quarters of 2010 shows motorcyclists fatalities dropped two percent. A similar report released last year had motorcyclists deaths down ten percent. It is not known what the fourth quarter will bring but the first two had significant drops and the third had a slight increase. The same report also indicated that overall use of DOT helmet use had risen by thirteen percent. On a call with journalists, MRF Vice President of Government Relations said "if you want to increase DOT helmet use, abolish mandatory helmet law, forcing helmets onto motorcyclists against their will pushes them to purchase the lightest, smallest helmet that can be found and are often times not DOT compliant."

11NR17 - MRF News Release Sensenbrenner Resolution and BITB FOR IMMEDIATE RELEASE 27 April 2011 Contact: Jeff Hennie, Vice President of Government Relations and Public Affairs Sensenbrenner Resolution The Motorcycle Riders Foundation (MRF) reports that US Representative Jim Sensenbrenner (R-WI) will be introducing a House Resolution supporting the law that prohibits the National Highway Traffic Safety Administration (NHTSA) from lobbying the States for legislation. The resolution also urges NHTSA to make motorcycle crash prevention their number one priority when they address motorcycle safety. Sensenbrenner said, "Despite significant opposition from Congress, NHTSA continues its attempts to mandate universal one-size-fits-all motorcycle helmet laws. NHTSA believes that the first step in saving a motorcyclist's life in the event of a crash is to mandate helmet use. The fact is, that preventing a crash from occurring

through rider education, training and proper licensing are the best methods to increase motorcyclists' safety. I agree that wearing a helmet can protect a motorcycle rider, but helmets do not prevent crashes." Please contact your Member of the US House and ask them to cosponsor the Sensenbrenner Resolution. The resolution is without a bill number for now and officially drops May 2nd, 2011. The whole state voted for the BOD members. The question was asked if it was ever a chapter decision. Still Ray thought it was 25% of a chapter's membership. Southern AZ chapter - Sean Pinder stated the problem with voting for other chapters' BOD reps is there is no opposition to elect/remove a chapter. The wording in the Bylaws for the removal of a State Officer are very precise and clear. The wording for the removal of a BOD member is not so clear. ABATE bylaws are open for interpretation. Is it 25% of general membership statewide or 25% of each chapter? Ross Rutherford - general membership notified by chapter can be interpreted now but needs to be done in the bylaws. The "dear colleague" being circulated by Sensenbrenner asks his fellow Members of Congress to sign onto a letter that will go to the Chairmen and Ranking Members of the House Transportation and Infrastructure Committee. The letter asks that the language of H.R. 904 and House Resolution 239 be included in the large Highway Bill that the committee will be drafting later this year. H.R. 904 is a bill that would prohibit future funding of mandatory

motorcycle-only roadside checkpoints and H. Res. 239 supports the NHTSA lobby ban and asks the agency to focus on crash prevention rather than injury reduction when addressing motorcycle safety. During the Congressional Panel portion of the day, the group of riders gathered in a Ways and Means Committee room to hear from a select group of Members of Congress. Addressing the group was Congressman Burgess, the Motorcycle

safety caucus co-chair, Mr. Walberg, an avid rider from Michigan, Mr Pallone, a strong supporter of motorcyclists and a 13 term congressman from New Jersey. Wrapping up the day was Congresswoman Michelle Bachman, a presidential hopeful in 2012 and an outstanding advocate for motorcyclists. Thanks to all of these Members of Congress for helping make the day even better.

Another highlight of the day was the news that Congressmen Reid Ribble (RWI) was added to the powerful House Transportation Committee. Congressman Ribble is an avid rider, so he will be a strong advocate and a real asset to the motorcycle community. We look forward to continuing to work with Congressmen Ribble in his new role. She was arrested and charged with DUI with Serious Bodily Injury, DUI and Causing Damage or Injury, and DUI Manslaughter. After numerous hearings at the Seminole County Courthouse since the September 2009 fatal crash, Ruth Perez has finally entered a plea of GUILTY to all charges. Judge Donna Mackintosh allowed Perez to remain free on bond until the June 17, 2011 sentencing, however, she specifically required that Perez cannot possess or consume any alcohol, and cannot operate a motor vehicle. Judge Mackintosh also made the June 17, 2011 sentencing mandatory for Perez to attend, possibly since Perez had missed many of the previous hearings. According to those in the courtroom during the May 16th hearing, Perez is subject to being sentenced between four and twenty-one years. The "Transportation Opportunities Act" for the first time floats Obama administration backing for the concept of an added charge on drivers for the use of roads throughout the country, including on existing, untolled freeways in major metropolitan areas. "This section [2217] amends existing law to include two new

options that provide more flexibility to finance new construction or capacity, and manage congestion, through the imposition of tolls," states the proposal's official summary. "

The first option focuses on metropolitan congestion reduction and permits state and local governments to impose tolls on existing interstate and non-interstate facilities for the purposes of improving or reducing congestion in metropolitan areas with populations over one million people. Under this option, tolls may be imposed on specific lanes, whole facilities, or a network of facilities within the metropolitan area." The plan would require that commuters be charged higher rates during peak morning and evening periods and that the revenue generated be used for capital improvement projects near the toll facility.

Cody Eller of 123 Lowell Road in Windham was arraigned in Derry District Court Friday morning on a felony charge of second-degree assault and a misdemeanor charge of vehicular assault.

A second "interstate system improvement" plan would allow tolling in smaller areas so long as the project included new capacity. Electronic transponders would be required for toll collection on the new lanes.

Police said Eller was driving south on Windham Road in Pelham around 4:30 a.m. Friday when he noticed a motorcyclist trying to pass him on the left, according to a police affidavit filed at Salem District Court.

The changes are significant, as existing federal law limits tolling of interstates to a specific number of pilot projects. The proposal is also a reversal of sorts for an administration that early on backed away from the concept of a nationwide per-mile toll floated in February 2009 by Transportation Secretary Ray LaHood. "I can weigh in on it and say that it is not and will not be the policy of the Obama administration," then-Press Secretary Robert Gibbs said at the time. That would change as the draft White House plan would set up a six-year project to address the technological challenges to establishing a system to track drivers for the purpose of imposing a tax for each mile driven. "

William Hawksley, 45, of Brentwood, was identified by police as the driver of the Kawasaki ZX1400 motorcycle. Both were nearing the intersection of Tallant Road, according to the affidavit.

This section [2218] would establish a Surface Transportation Revenue Alternatives Office within the Federal Highway Administration," the section-bysection analysis states. "The office would analyze the feasibility of implementing a national mileage-based user fee system that would convey prices to users to reflect system use and other travel externalities and serve as a funding source for surface transportation programs." The purported reason for including the per-mile taxing system is the potential for increased use of electric vehicles. The administration has poured billions in gas tax dollars to subsidize the companies that manufacture these electric vehicles as well as the end users who buy them. A "public awareness communications plan" would be implemented to sell the plan, which may be difficult. In the UK, an official petition against the idea of a permile tax gathered 1.8 million signatures on the prime minister's website.

PELHAM, N.H. - “I wasn’t going to let him pass me.” That’s what police say a Windham teen told officers at the scene of a motor vehicle crash in Pelham early Friday morning, where the 18-year-old is said to have intentionally crashed his car into a motorcyclist, causing serious injuries.

As Hawksley attempted to pass Eller’s Ford Fusion, Eller allegedly crossed into the northbound lane, nearly forcing the motorcycle off the road, said Pelham police prosecutor Dennis Mannion Friday morning. Eller’s car then allegedly struck Hawksley on the right side, fracturing Hawksley’s leg in several places, said Mannion. Hawksley was taken to Parkland Medical Center in Derry where he awaited surgery Friday, he said. Mannion said Eller told an officer at the scene that he intentionally steered his car toward Hawksley to prevent him from passing. “Yes, he was passing me illegally,” Eller said, according to the affidavit.

Before Friday, Mannion said Eller had no criminal record and only a single speeding ticket from 2010. “We felt that the incident that took place this morning was serious enough that if he was released he would be a danger to public safety,” said Mannion. Judge Kristin Spath chose not to grant Mannion’s request that the teen be barred from driving if released on bail. “I’m hesitant at this point to adopt the state’s recommendation with respect to your not driving,” Spath told Eller during his arraignment. “Mostly, it’s in the hopes that you can be out looking for a job.” Eller told the court he had recently lost his job and that he had been looking for work but had no luck. If Eller makes bail and commits another driving violation, Spath said his bail could be revoked. He is scheduled to appear in Salem District Court for a probable cause hearing May 23. =========================== reprinted from www.bikernews.org Motorcycle Helmet Law Could Change in DE Since 1978, Delaware law has required motorcyclists to have a helmet in their possession while driving or riding on a motorcycle. That could change though. House Bill 95 which is before lawmakers in Dover would eliminate the 33-year-old law that bikers carry a helmet while riding on or driving a motorcycle. State Representative Michael Mulrooney is sponsoring the legislation. He says it just doesn’t make sense to carry the helmet on your bike because unless it’s on your head it serves no purpose. The group, American Bikers Aiming Towards Education of Delaware (ABATE), agrees with Representative Mulrooney and supports the new legislation.

Pelham police Lt. Gary Fisher said Friday that investigators believe Hawksley was in a legal passing zone at the time of the crash.

Instead of revving motors and rapping pipes, they're waving signs to remind car drivers to watch for cycles. That's the gist of the chilly rally; look twice and check your car's blind spot in case a motorcyclist is obscured there. Attendees included motorcycle clubs, riding associations and members of ABATE, a biker's advocate group. The various groups' message is spread through more than just some symbolic sign waving. The D.O.T. thinks most of the deaths and injuries could be prevented if all motorists share the road. =========================== NHTSA Updates Motorcyclists' Helmet Rule The new certification label will bear the manufacturer's name and helmet model and the words "DOT FMVSS No. 218 Certified." May 14, 2011 Motorcyclists' helmets are about to change. The National Highway Traffic Safety Administration published a final rule on May 13 that took effect immediately and is meant to decrease the use of "novelty" helmets while making it

more difficult to sell helmets with markings that resemble the current "DOT" label showing compliance with Federal Motor Vehicle Safety Standard No. 218, the motorcycle helmet safety standard issued in 1973. NHTSA says 5.2 million helmets are sold annually. Its text says 54 percent of motorcyclists in 2010 wore a FMVSS No. 218-compliant helmet, 14 percent wore novelty helmets, and 32 percent did not wear a helmet. "These figures represent a significant reduction in FMVSS No. 218compliant helmet use compared to 2009, when the comparable figures were 67 percent, 9 percent and 24 percent," according to the agency. "This reduction in FMVSS No. 218-compliant helmet use is especially significant in the jurisdictions (20 States and the District of Columbia) with universal helmet use laws where the use of compliant helmets dropped from 86 percent in 2009 to 76 percent in 2010 and the use of novelty helmets increased from 11 percent in 2009 to 22 percent in 2010. This 11 percentage point increase in novelty helmet use in jurisdictions with universal helmet use laws between 2009 and 2010 is evidence of the difficulty encountered by law enforcement officials in enforcing helmet use laws." The standard was revised because

NHTSA became concerned when injuries and fatalities among motorcyclists increased for 11 consecutive years, until the current recession halted that streak. Deaths more than doubled, according to the Fatality Analysis Reporting System, from 2,116 deaths in 1997 to 5,290 deaths in 2008, and the age group with the largest increase in fatalities (from 760 in 1998 to 2,687 in 2008) was motorcyclists ages 40 and older. FMVSS No. 218 includes energy attenuation, penetration resistance, chin strap structural integrity, and labeling requirements for on-road motorcycle helmets. According to NHTSA research published in 2004, wearing a helmet certified as conforming to FMVSS No. 218 reduces the risk of dying in a motorcycle crash by 37 percent. NHTSA says its tests of novelty helmets found that they failed all or almost all of the safety performance requirements in the standard. The new certification label will bear the manufacturer's name and helmet model and the words "DOT FMVSS No. 218 Certified." If 10 percent of the motorcyclists now wearing novelty helmets switch to compliant ones, the new rule could save 75 lives, NHTSA says.

Eric submitted a draft letter/survey that is intended to be given to state legislators to evaluate their opinion of the motorcycle lobby and identify new contacts for motorcycle legislation. The letter would be delivered by Carole, Designated Lobbyist. It was agreed that the letter should be acted upon but to remove the question to legislators asking them whether they had ever ridden a motorcycle.

An agenda item regarding the BOD mailing list was brought up next. It was suggested that only BOD members be on that list and not the President or Lobbyist. Hamstertime Good Morning America ! Since 1905 an old cannon has stood as a silent guardian over the sacred ground of the graves of Spanish American War Veterans in my local cemetery. I've passed it at least a thousand times while visiting friends or loved ones buried there in the cemetery but never really gave the old gun a lot of thought. Then about a month ago ,I found myself really looking at this massive old cannon for what felt like the first time and I was drawn to it. I guess to a lot of people ,myself included, it would just look like any old cannon but the closer I examined this amazing piece of American history the more impressed I was . I found a bunch of markings around the front of the barrel that started telling a story about what a historic weapon I was staring at. This was just no ordinary cannon, this was a genuine Rodman Gun. Number 30 of that series. Re-

Made at the West Point Foundry in New York in 1885. It originally came from Fort McHenry in Baltimore so it is actually far older than that . It has a bore of 9 inches and the rifling down the barrel is incredible. When you realize the age of the cannon and really look at the exacting quality of the workmanship, you get a genuine appreciation of the craftsmanship that went into producing the weapon.The cannon is almost 12 feet long and weighs 9500 lbs. When you stand next to it you instantly notice the great mass of the weapon and you can almost feel the history that it has been witness to. OK, for all of you non military types and other non gun persons, liberal types reading this , the bore is the diameter of the hole at the end of the barrel. The barrel is the long thing on a gun that the bullets comes out of. Please... never look down a barrel of

Hamstertime (continued) any gun. I don't have the time to explain why so you'll just have to take my word for it. Then I noticed something along the sides and top of the gun that has bothered me since the first time I noticed it and felt ashamed. This old war relic had been defaced, people had carved their names into it and scribbled graffiti all over it. Why people do some of the dumb shit they do sometimes is beyond me but to do something so disgusting to a war relic in a veteran's cemetery is disgraceful. Something needed to be done and I have just the friends to make this happen. My friends hail from every walk of life and every once in a while, you need to call in a favor. So I called my friend Eddie Edwards. Eddie in one of the local councilman from my hometown who also happens to be a fellow Harley rider and a hell of a nice guy! Ed is a person that would make a hell of a congressman or Governor because he cares about his hometown as much as I do. Ed was willing to listen to my ideas and more importantly, act on them ! When I mentioned it to our town's mayor, Doug Hendricks he also agreed we need to do something about it...and do something, we shall!!! I expressed my heartfelt concern about that old cannon and came up with a proposal to get the cannon back in shape. Ed invited me to come down to a council meeting and share my vision with the rest of the city council. First I

had to draw up a proposal for the cemetery board but in all fairness to them, they were on board from the first day. These folks care about their cemetery and as long as I was willing to treat this project with the respect and dignity it deserved, they were more than willing to give the project their blessing. Now for the record, I know squat about restoring old cannons, writing proposals, installing dusk to dawn lights or making and installing plaques and landscaping. What I do know how to do is get people interested in passing down a little history and getting people The meeting is this coming Wednesday but I'll let you know how the whole thing plays out in a future issue. So what does this have to do with Bikers? Why is this something we would care about? Because as I said in my last column" Bikers Care" if the cause is righteous, the Biker community will get behind it 100% and when it comes to restoring an old war relic in a veteran's cemetery, we owe it to those brave men buried there. I'm hoping to have the entire project wrapped up in time to be rededicated Veteran's Day, November 11, 2011. I'll keep you up on our progress. Special BOD Meeting Minutes Teleconference to Ratify Positions Thursday April 28, 2011 7pm Present: Stillray Fitzgerald, Eric Hampton, Margie Ferrucci, Sean Pinder, Bill Hensler, Rick Henry, Bill Baxter Meeting called to Order By Eric Hampton The purpose of this meeting is to ratify open positions. Joel Jackson resigned effective 4/31/2011. The position of treasurer is open. Matt Brown has been nominated for the position and has accepted. Matt will be on a cross county trip until TBFS. His law firm would be made a Trustee Of ABATE. Jess Method, East Valley has been nominated for the positions of Assistant treasurer. The Assistant treasurer will handle all bills and expenses. She will not be a signer on the account. The motion to approve Matt Brown as treasurer was made by: Bill Hensler, High Country Chapter, 2nd Stillray Fitzgerald. The MRF’s BEAST of the East, Baltimore, Maryland This year’s MRF BEAST of the East was hosted by ABATE of Maryland in a suburb of Baltimore. Despite this crappy economy, there was a great turnout with riders coming from as far away as California and Arizona. This year’s BEAST was preceeded by the Third Annual Michael “Boz� Kerr Bikers Inside the Beltway. This is an event where motorcycles ride into Washington, DC and lobby our federal representatives and senators. This was my first visit to Washington, so of course, with the visit to Rep. Gabrielle Giffords’ office came the mandatory sight seeing in our nation’s capital. Walking 10 miles in my boots wasn’t exactly what I’d like to repeat any time soon, but it was worth it.

Around 1:30 in the afternoon on Thursday, the MRF held a press conference in the Rayburn Building in the House of Representatives building complex. Even though the House was being shown the pictures of a dead Osama bin Laden the same day, five congressmen took time out of their schedules to come to the press conference and address those in attendance. After the train ride back into Baltimore, I attended the meetings for the MRF committees that I sit on. Friday morning started bright and early with the MRF Board meeting. This is an all day affair and it just amazes me at how much business had been taken care of since our last BOD meeting. After the marathon Board meeting, we had an hour or two to wind down a bit and get some dinner. That evening, everyone piles into a large convention room for the “Meet the Board, Meet the States� session. This is where the Board quickly passes the microphone down the table and introduces themselves and then the mic is passed around the room for representatives of the states in attendance to stand and talk about

issues that they are dealing with back home. Saturday morning begins with a General Session, where MRF President Kirk “Hardtail� Willard speaks about the “State of the MRF� followed by the MRF lobbyist, Jeff Hennie, who provided a Washington Update. After a short break, we all returned to the main conference room for MRF Vice President Jay Jackson’s presentation of the new “Fact or Fiction� piece that the Research and Statistics Committee has prepared (see page 21). Some good info there. We have to call out the inconsistencies in all the stats that the government releases as truth. After a sponsored lunch, the workshops begin. Fortunately, I didn’t have to present one this time around, so I was able to check out a couple of them. Some of the workshops covered “Bikers and Badges�, “A Biker’s View of the US Constitution�, “How the MRF Can Best Work with Your SMRO�, “Insurance: What You Need to Know� and “What’s All the Noise About Noise?� Later that evening, everyone gathers in the main conference meeting room for the conference banquet. After dinner, the silent and live auctions begin to benefit the MRF. It costs the MRF more than $1500 per day to keep the opertion running in D.C., so this fundraiser is very important to the MRF. Still Ray outbid me on a commemorative knife - I hope it looks good in his office. Darla & I never recovered from our jet lag, so we were very glad to get back home after a full day on airplanes so we could get some real rest when we went back to work. May’s Guest Safety Article by Stacey “Ax” Axmaker Director - Idaho STAR Motorcycle Safety Program Riding in the Heat/Riding in the Cold Idaho is one of the most beautiful places in the country to ride – mountains, valleys, rivers, desert, forests, lava beds – we’ve got a little of everything. We also have a pretty long riding season so we can enjoy those beautiful roads most of the year. During that riding season, however, the temperature can run the gamut from well into the 100s to well below freezing. Here are some tips for keeping your rides safe in extreme temperatures. Riding When It’s HOT: The Facts: Hot weather drains your energy, so you

will become fatigued more quickly Exposed skin will cause you to dehydrate more quickly than covered skin Fast moving air that is hotter than your body temperature will not cool you down Heat cramps, heat exhaustion, and even heat stroke are real possibilities and can be life threatening When a rider overheats, they start to lose both the mental AND physical skills they need to identify and deal with hazards The Strategies: Take breaks frequently so you (and your passenger) can cool off in the shade or in an air conditioned room - and drink plenty of fluids Wear riding gear that covers your skin to reduce dehydration Consider wetting down your shirt under your riding jacket – this can work

like a “swamp cooler” and keep you more comfortable Consider products such as “cooling vests” to keep your body’s core temperature down Riding When It’s COLD: The Facts: Cold weather drains your energy, so you will become fatigued more quickly Much of our body heat is lost through the head when it’s cold out. A helmet can not only provide comfort and injury protection, but can help you stay warm as well When a rider gets cold they can experience hypothermia – a condition that causes slowed mental and physical reactions, as well as the loss of smooth muscle control The Strategies:

Take breaks frequently so you (and your passenger) can warm up in a heated area Wear multiple layers to help trap warm air close to your body Consider heated clothing (vests, jackets, chaps, socks, gloves, etc.) to fight off the cold (remember that unless you have your own source of heat – the cold will eventually win). Watch for the signs of impairment – increased number and frequency of ‘surprises’ and loss of smooth motorcycle control. These signs tell you that your mental and physical abilities are being affected by the heat or cold and it may be time to slow down, take a break, or even park it for the day. Take care of yourselves out there. Stay cool in the heat; stay warm in the cold and enjoy the ride.
