Before anything else, I would like to thank all of you for giving me the opportunity to attend NCOM this year. It was held in Indianapolis and the speakers presented a variety of issues, some of which we as ABATE of Arizona haven’t had to deal with…yet.

Some states have law enforcement blatantly profiling motorcyclists as criminals and pulling them over for any number of “violations”. I hope you noticed that I said motorcyclists, all motorcyclists; not just those on crotch rockets or those with patches or those who ride on Sunday to go to breakfast.

It seems as though our legislators never turn down the opportunity to amaze and confuse. As you all know the motorcycling community has been discussing the pros and cons of a bill that would ban texting while driving in Arizona. On March 5th the House “mistakenly” voted to pass a bill that would ban texting while driving. Within an hour they voted again, this time to defeat the bill. Apparently the bill originally contained the requirements for when officers have to complete traffic accident reports and as an add-on, the texting issue was addressed. When they realized the texting ban was included they quickly squashed the bill.

In fairness to the House, the texting while driving has been batted back and forth for years. Critics say that drivers should be able to make their own decision and government should not “micromanage” and there should be a delicate balance between liberties and protecting lives. The divide is not strictly along party lines, we have some who say that a

driver should have the same duty to stop texting while driving as they do to stop drinking while driving. One legislator said, “I would have been in favor of the bill if it applied only to minors or was designed to apply to the multitude of activities that can distract drivers.”

Personally, I’m certain that we haven’t heard the last of this debate. Even though most of us do use our phones while driving, whether once in a while or constantly, we can’t forget that when a car or truck hits a motorcycle, it usually isn’t the motorcycle that wins.

To anyone really interested in politics and what other states’ motorcycling issues are I suggest that you begin to get involved. The next time chapter or state elections come up, raise your hand, take an officer position, and go to some of the other chapters’ meetings. It takes some time, but you will learn so much and really begin to feel you can be a part of the solution. Carole O’Reilly ABATE Designated Lobbyist

I am writing this month’s article as I return from the 27th Annual National Coalition of Motorcyclists Convention, (NCOM). This year’s convention was held in Indianapolis, Indiana. Indy was a great host city, and welcomed us bikers with open arms. The JW Marriott Hotel did a fantastic job and was very hospitable to all attendees. On behalf of the Arizona contingent, I want to thank Richard Lester and especially Sarge, (NCOM’s Sgt.at Arms), ABATE of Indiana and the Indiana COC for hosting another successful convention.

AIM Attorney Mitch Proner from New York, gave an update on freedom of the road and the use of the courts. Many states are writing their own bills, preventing motorcycle only check points. U.S. Department of Transportation Secretary, Ray LaHood, has proposed cutting off grant money funding motorcycle only check points. If this measure is successful, these check points will, for the most part go away. as it would be very costly for States to fund the check points on their own.

Keynote speaker for Saturday was Dan Jeffries from the Indiana Criminal Justice Department, Alcohol Countermeasures at State of Indiana. Dan’s duties include Alcohol Countermeasures and Motorcycle Safety at Indiana Criminal Justice Institute. I will say, no one slept through his presentation, because as controversial as it was to some, many interesting statistics were presented. In 2009, persons killed in motorcycle crashes in Indiana declined 15 percent, from 133 in 2008 to 113 in 2009. Individuals killed in motorcycle collisions accounted for 16.3 percent (113/692) of total Indiana traffic fatalities. Indiana motorcycle collisions per 10,000 registered motorcycles decreased over the 2008 to 2009 period, from 190.7 to 162.1. The fatality rate per 10,000 motorcycles also dropped

(6.6 to 5.6) from 2008 to 2009. This is the first annual decrease in total motorcycle collisions in the period between 2003-2009. Single vehicle crashes accounted for 45.6 percent of all motorcycle collisions. Of the 111 fatal collisions, 48 (43.2 percent) were single vehicle.

43.2 % of these crashes as stated were single motorcycle crashes. Riders were hitting guard rails or other objects off the roadway, or just not navigating turns properly. Dan’s statistics showed that about ¾% of these, single vehicle (motorcycle) crashes were either alcohol related, (BAC 0.08 or higher) or the motorcyclist did not have a motorcycle endorsement on their license.

In 2008, nearly 23 percent of motorcycle operator fatalities had reported BAC levels of 0.08 or greater; in 2009, the rate dropped to 12.1 percent, by far the lowest rate since 2005. This is compared to 2.5 percent of motorcycle operators in non-fatal collisions.

Controversial discussion in the presentation began when Dan explained that a large part of his job is procuring grant money for law enforcement. Although he has no direct involvement in how the money is actually spent, the end result of his effort is to prevent fatal crashes involving motorcycles. Some grant money is spent on overtime pay for State Police to conduct “Wolf Packs” stopping motorcycles leaving events and runs. Dan explained this as “picking low hanging fruit”. Police use these Wolf Packs to stop motorcyclists leaving events after observing minor traffic offenses, check for impaired riders, motorcycle license endorsements and proper insurance - “Low Hanging Fruit” or easy pickins. Indiana’s State Constitution prohibits motorcycle only stops, it is considered profiling and is not allowed.

MICHIGAN RIDERS WIN HELMET FREEDOM Proving that persistence pays off, motorcyclists in Michigan shook off the sting of two previous gubernatorial vetoes of their helmet law repeal bills over the past few years and bounced back to win freedom of choice with the stroke of their new governor’s pen.

“Michigan gained freedom today when Governor Rick Snyder signed the bill (SB 291) into law (Public Act #98) that repeals the 37-year old mandatory helmet law,� announced Angel Richardson, Legislative Director for the Michigan Confederation of Clubs and a member of the National Coalition Of Motorcyclists (NCOM) Board of Directors. “The repeal is effective immediately!,� she continued. “Thanks to everyone who made a phone call, sent a letter or a postcard, or sent an email.....your efforts made a difference.�

The Michigan legislature overwhelmingly approved the measure with broad bipartisan support, and with Gov. Snyder’s signature on April 12th Michigan now joins 30 other states in amending their mandatory helmet law in favor of adult choice. “The new law modernizes Michigan's outdated mandatory helmet law, which was a holdover from bygone days leaving Michigan in the minority as one of only 20 states left enforcing an empty federal mandate,� said Vince Consiglio, President of ABATE of Michigan.

The proposal to update Michigan’s mandatory helmet law was introduced in the Senate by Senator Phil Pavlov (R) St. Clair. "Every year, millions of dollars leave our state because of Michigan's outdated mandatory helmet law," Pavlov said. "This bipartisan plan will keep our dollars here, attract even more tourists to Michigan and help our state in these tough economic times."

Allowing motorcyclists to ride helmetfree could also generate more than $1 billion in direct and indirect revenue, according to a recent Michigan Consultants study.

The new law gives Michigan the strictest requirements for riding helmetfree of any state that has modified mandatory helmet laws for adult choice. To ride helmet-free in Michigan, motorcyclists must: * Be at least 21 years old. * Have at least two years of riding experience or undergo special safety training. * Carry at least $20,000 in additional medical insurance.

mitting them to ride two abreast in a single driving lane in Virginia.

House Bill 97, sponsored by Delegate Tony Wilt (R-Harrisonburg), passed overwhelmingly 87-10 in the House and 38-2 in the Senate, and will now allow two-wheeled motorcycles to drive alongside each other in one lane. State law currently prohibits motorcyclists from riding next to one another, and violators can be charged with reckless driving. “The bill allows riders to use their own judgment in determining when it is appropriate to ride beside someone, but does not require them to do so,� said Del. Wilt. “One goal is to eliminate the harsh punishment placed on riders for doing something as innocent as pulling aside another rider while stopped or taking off together after being stopped.� Virginia will become the 49th state to accommodate two-abreast riding when the new law takes effect July 1. Vermont remains the only state to prohibit the practice.

KENTUCKY MOTORCYCLE LICENSING MEASURE PASSES “HB 328 was signed into law by Governor Steve Beshear on April 11th, 2012,� announced Jay Huber, State President of the Kentucky Motorcycle Association in a legislative alert to KMA/KBA members. “In short this bill does two things: Stops the cycle of people riding around on a permit for years and years along with providing a way for 16 and 17 year olds to once again get a motorcycle license.� According to the bill’s digest, the new law will “allow a person who has received an intermediate operator's license to apply for a motorcycle instruction permit; make a motorcycle instruction permit good for 1 year, with the ability to renew the permit 1 time, allow a person whose motorcycle instruction permit has expired apply for a motorcycle operator's license if the person can present proof of successful completion of a motorcycle safety education course.�

FLORIDA FUNDS RIDER SAFETY “This morning the Governor of the State of Florida signed into law the budget for the next fiscal year,� reported ABATE of Florida State President James “Doc� Reichenbach, adding that “Included in the budget was $250,000 to ABATE of Florida, Inc. for motorcycle safety.� In the past five years the Florida Legislature has put in the budget $1,250,000 for motorcycle safety to be administered by ABATE. “Congratulations to the members of this great organization,� Doc told the membership.

BIKERS ROLL WITH “COLORS� LAWSUIT Police claim that a group of bikers was pulled over for wearing improper helmets, but an attorney for the bikers claims they were stopped by state troopers because of their colors.

In a recently issued court opinion, U.S. District Judge Jerome Simandle in Camden, N.J. said two members of the Pagans Motorcycle Club and one Tribe M.C. member can proceed with their lawsuit stemming from a July 30, 2009, traffic stop in Burlington County, including malicious prosecution. During the stop, New Jersey state troopers ordered riders of six motorcycles to remove their "colors," the members' patched jackets, but the bikers refused -- leading to a federal lawsuit alleging actions by the troopers violated their constitutional rights.

"The court has basically said, 'Yes you have a right to wear a patch, these logos,' " said Norristown attorney Boyd Spencer, who represents the Eastern Pa. Confederation of Clubs. The bikers were ticketed for not having approved helmets, and were told to remove their colors if they wanted to leave. The whole traffic stop, which lasted more than an hour, was captured by mounted cameras in the police cruisers. "Now you're all going to take your jackets off, because on this highway, these are the only colors," one of the state troopers told the group after nearly 50 minutes had passed, referring to State Police blue and gold uniforms. None of the bikers removed his colors, and at a later municipal court hearing, the helmets were found to be legal and a prosecutor dismissed the charges.

“We’re looking ‌ for the court to rule the obvious: These people have a right to wear their colors,â€? said Spencer, who is the Aid to Injured Motorcyclists (A.I.M.) attorney for Pennsylvania and New Jersey, and serves as legal counsel for the local Confederations of Clubs. “This is a widespread practice of police officers harassing people with (club) patches on,â€? asserted Spencer, who contends his clients were stopped and detained by the troopers because of their colors. “It’s not an isolated incident.â€?

MOTORCYCLE SAFETY ACT BECOMES LAW IN WISCONSIN Governor Scott Walker signed AB55 into law, reports ABATE of Wisconsin, which not only clarifies penalties for right-of-way violations but also establishes motorcycle awareness training in Drivers-Ed courses.

AB55 provides a technical correction for 2006 Wisconsin Act 466, moving the penalty provisions from the courts to an administrative function of the DMV. All right-of-way violators that cause serious injury or death on Wisconsin's roadways will be subject to up to a one thousand dollar fine and up to a nine month license suspension and must complete a DOT approved rightof-way awareness class before being reinstated. Also, AB55 adds a mandatory minimum of thirty minutes of motorcycle awareness training in all drivers' education classrooms throughout the state.

Hi Brothers and Sisters,

It has been a pretty slow couple of months at our chapter due to Easter and vacations, so we haven't had a lot to report. Our ABATE party we held in April had a fairly good turnout and we were able to sign a few new members. Everyone had a great time and the band held riders there most the afternoon.

Margie contacted me this past week with some encouraging news. The Desert Road Riders MC is interested in signing up members in ABATE. From what I understand, an agreement of sorts has been reached with the AZCMC, AMA and ABATE to support each other. Therefore each MC will be asking 4 of its members to join ABATE in their perspective Counties. It is my opinion that with the way motorcyclists especially MC's are being discriminated against, we need to join forces to battle for our rights. In my 46 years of riding, I have never seen such fast movement in law enforcement to stampede our rights. Everywhere I turn, some new establishment is banning colors, and gang task forces are present at most runs. Even the Moose Riders who are not an MC, have been denied entrance in some establishments as long as they are wearing their colors. This is totally unacceptable, and we need to get this kind of thing under control before it gets worse. So those of you who are not ABATE members and are reading this issue of Masterlink, need to rethink your position. $25.00 annual membership is a small price to pay for protecting your rights. Hello again! It was good to see the turn out for our May chapter meeting despite the fact that it was Mother’s Day. We had a break in April due to our normal meeting place was unavailable on Easter Sunday. Several of the members got together anyway for a ride starting at the Steel Horse for Sonny’s B-Day. We are saddened to say that Mikki Aaronson will no longer be our Membership Officer. Sorry to see you go Mikki. Dee Grady unanimously approved by all in attendance at the chapter meeting. Congratulations Dee!

We currently have 186 active members and only 13 business members. Dee has her work cut out! Although Dee is our Membership officer it is up to everyone to recruit new chapter members as well as business members. It is very important that we continue to grow in numbers and are ready when the “Big One” comes up. I personally carry applications with me wherever I go.

Pamela addressed “PSI” for our safety topic. We should be checking the air pressure and the condition of our tires every time we ride or at the very least once a week if you ride daily. You can find the correct PSI for your bike in your owners manuals provided you use the tires recommended by the manufacturer. Darin our Ride Coordinator gave us a list of rides for May: 5/19 Freedom Ride starting at Chester’s, Run for the Hills-Yavapai Chapter, Remember Waldo starting at Kid Chilleans, Jesters Run 5/26 Spartan Riders Glendale. Darla Hampton our P.A.C. Officer announced that HR 2073 Emissions was passed and will be extended for two more years to 07/14/2014. Now we just need to get the EPA on board and get it finalized! Eric Hampton passed out Poll sheets to see which subjects were the least and most important for our Lobbyist to address to our State congressmen congresswomen. All the subjects are important but they need to be prioritized and this will be a good start.

At our Chapter Meeting, our Coordinator jim Butsback spoke about getting to know your fellow SAC members. Since we only meet once a month, we need to take the time to actually know each other. There is great value in knowing of fellow Chapter members beyond the ABATE events and Officer Duties. We are social animals, and we all have more dimensions to us all, besides ABATE. This extra level of interaction helps us all in promoting relationships and understanding. Strong relationships will only benefit us all in our endeavors. So, before or after our next meeting or during our next event, take the time to get to know your Biker brethren. I will betcha they do more than just ride a bike, even though this is our obvious bond within ABATE. You never know you may actually like the person or at least understand them better. April’s dollar Jar was up to $158.00, and Stan Still was not present to win. You gotta attend to win cash. The Dollar Jar rolls over to May 19th.

The City of Tucson intends to Declare an official Motorcycle Awareness Month of May consistent with the GOHS for Arizona.

TBFS is quickly approaching and we need all hands on deck to help with volunteering our part as a Chapter to work the event. Too Broke is a helluva event that is incredibly affordable and great time. This is our most significant fund raising for ABATE to support our Rights and Safety Activities to protect motorcycles and reduce accidents in AZ. Besides, there will be a great extended family of Brothers and Sisters in Mormon Lake

The “Can You See Me Now?” event started off in a discouraging way with very low attendance for the Ride. This has been a trend in the last few years. However, the gathering at the end may the day successful with attendance increased and the raffle and 50/05 put us in the Black. In fact, Papa Gene seemed to have some very lucky tickets cleaning up with many of the raffle items that were generously donated by local businesses. Papa Gene also walked away with the 50/50 Cash prize. Thank you to mark B who donated back $10 of the Low Hand take to ABATE of AZ. A special thanks to Ivette and Dave Fossan for working the Bonus Stop in Rio Rico. We wish we could have sent more riders his way to keep them company. Moving on due to low attendance for Rides, Southern AZ is leaning toward

focusing our events on less labor intensive efforts such as Pasta Dinners, Safety Events at local Dealerships, and Bike Nights. It is May in the Prescott area and the riding weather is great. Everybody is having a ride to this or that. By the time you read this our “Run to the Hills” in Jerome event will be over. Hopefully all that came had a great time supporting the A.B.A.T.E. extravaganza.

Our meeting in May was centered on the Jerome event, but several other topics were discussed as well. The bumper stickers and t-shirts that say “Distracted Driving Kills” were distributed. This is a bold and in your face statement and it should be. I was sitting on a bench in downtown Prescott recently watching the cars go by. The number of people talking and fiddling with their phones was astounding. I was driving on Gurley recently as well. I saw someone on a bicycle in front of me riding erratically. I gave him a wide berth, and when I glanced at him, I saw he was trying to text! Ladies and gentlemen, do we really have to be in touch with our technology 24/7? When I am in my cage, I purposefully put my cell phone where I can’t reach it. It seems for many that when the thing rings, it orders a person to answer me now! We have to change this behavior now! Speaking of another danger on the road, Doc reported that Governor Brewer refused to sign a bill that would kick out the red light cameras of Arizona. I have had several instances in which cages have slammed on their brakes in front of

ABATE Of Arizona, Inc. is a non-profit motorcycle rights organization that is dedicated to freedom of the road for all motorcyclists.

ABATE is a volunteer organization that fights discriminatory legislation aimed towards the motorcycling community. ABATE's position is that all motorcycle riders have the right to choose not only the machine that they ride, but also the riding gear that they choose to wear or not to wear, (i.e. leathers, gloves, boots and helmets.) ABATE promotes rider education for all motorcycle riders and motorcycle awareness for all automobile drivers. ABATE needs the support of all motorcyclists.

Helmet removal, jaw thrust, and moving the injured are all addressed & practices. Accident Scene Management, Inc. believes that the most likely person to be at the scene of a motorcycle crash is another motorcyclist. Our goals are t reduce severity of injury & fatalities at the scene of a crash through proper actions and reactions. Southern AZ Chapter’s “CAN YOU SEE ME NOW” Run

Another event has come and gone as we progress further in to this year. This event was successful but yet by the same token there never seems to be enough to get beyond just that. We had a course that stretched over Southern Arizona encompassing Sonoita, Patagonia, Nogales, Rio Rico then back to Tucson. Right at 156 miles of untouched and unspoiled areas that are soon to be a past memory. The BOD participation with this event was awesome and we had a large raffle prize pool to cap it off with. The run opened early considering temperatures’ and we could not have asked for a better day to

This is a brief progress report for ABATE’s Rider Advantage.

In November the BOD of ABATE voted to establish a not-for-profit corporation with the goal of providing rider training to motorcycles following MSF guidelines. The training would be provided in the most cost-effective manner and pass the saving on to the public. The work began and the Board of Directors was chosen in January.

Dan concluded his presentation with these statistics. In 2008, 23% of single vehicle (motorcycle) crashes involved, the rider had an alcohol concentration of 0.08% or more. In 2009 that figure dropped to 12.1% of single motorcycle crashes with an alcohol concentration of 0.08 or more. A question was asked why law enforcement doesn’t provide more enforcement to violators running red lights or vehicles violating motorcyclist’s right of way, while turning left. Dan stated “I know it’s not right but until we as motorcyclists reduce or totally remove the three fac-

This is a crucial juncture for the legislation that would end the motorcycle-only roadside checkpoints. The language is in the HR 7, (the House bill) but not in the US House passed bill, HR 4348 and not in the Senate bill, S 1813. It’s our goal to have the conference adopt the language into the final report.

Kimmy and her crew always went above and beyond in promoting motorcyclists and motorcycling. Wow, is it June already??!! Governor Brewer proclaimed May as Motorcycle Safety and Awareness Month. The proclamation can be seen elsewhere in this issue of Masterlink. Several Chapters of ABATE put on awareness events in their neighborhoods or had booths at other events. Other Chapters are planning events for this month and later in the year.

The Governor’s Office on Highway Safety (GOHS) uses some of the $1 registration money that we pay when we register our bikes to purchase give-away items that can be requested from their office. It’s a good idea to request items (pencils, key fobs, and safety tri-folds) about a month in advance via email. GOHS would like any requests to include the name of the event, date, planned number of attendees, and the number of items requested, pick up date. Requesters are expected to pick up their own items. Check the website for more information, www.azgohs.gov. The M.A.P. continues to be presented to high school students in driver education classes around the state. The program is well received and the instructors do a great job to promote the message to share the road with motorcycles. The goal of the program is to present the program in every driver education class in the state.

Call for MAP Instructors

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us. To become an instructor you must:

1. Be available during the day: The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in the material presented. 4.

Commit to teaching at least 2

classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.

5. Provide record of teaching to the M.A.P. Coordinator on a consistent basis.

This is your opportunity to get the word out to new drivers about the importance of sharing the road with motorcyclists. This is your opportunity to support the mission and vision of ABATE in your community. Even though May was Motorcycle Safety and Awareness month, there were still crashes and we lost brother and sister riders. Rider skill training and practice are so very important. Common sense is a big factor. I heard about a rider who fell off his bike on the 101 one morning and was run over and killed by a motorist. It was stunning to hear about such a tragedy. As the details were shared, I learned that the biker was doing stunts in morning traffic, standing on the seat of the bike. While that might be an exciting challenge, it was not smart. There are tracks and other facilities to practice stuff like that for such riding. Not only did the biker lose his life, but the public will remember the negative image that doing stunt riding in traffic. Morning traffic is a

PAGE 15 place to practice defensive riding, not stunt riding. Be careful and use common sense.

The HOT weather is upon us. HYDRATE with water every time you stop. Also watch out for road hazards like the slippery repair patches on the road. While we’re talking about slippery…..watch out painted stripes, markings on the road. They are very slick. In some locales, granules are added to the paint to provide traction, but not here. Perhaps, that issue can become a point for us to pursue. I would like to see the highway and city road painters change the formula of their road paint to include granules for skid-resistance. Recently the Motorcycle Riders Foundation (MRF), along with ABATE of Illinois, sat down with United States Department of Transportation (DOT) Secretary Ray LaHood to discuss a few key motorcycle issues.

First and foremost is the issue of the National Highway Traffic Safety Administration’s (NHTSA) funding of mandatory motorcycle-only roadside checkpoints. LaHood let his arsenal of safety experts defend the checkpoints. It was revealed that the only state to apply for the funds was Georgia. No other states expressed any interest in the federal program.

There was a lively debate about the checkpoint issue, and we eventually had to agree to disagree on the effectiveness, fairness, and resource worthiness of mandatory motorcycle-only roadside checkpoints. As of now, NHTSA does not have any plans for future funding of these checkpoints. We also discussed the Department’s position on E-15 blended fuel, they don’t have one. LaHood is stepping down from the DOT Secretary role at the end of the year. ============================

During the Congressional Panel portion of the day, the group of riders gathered in a Ways and Means Committee room to hear from a select group of Members of Congress. Addressing the group was Congressmen Burgess, the Motorcycle Safety Caucus co-chair, along with his colleagues in the House of Representatives: Alan West-FL, Scott Rigell-VA, Jon Runyan-NJ, Bob Dold-IL, Todd Young-IN, Richard Hanna-NY, Erik Paulsen-MN, and Adam Kinsinger-IL. The MRF thanks all of the Members of Congress who attended the event. Coinciding with Bikers Inside the Beltway week, Congressman Jim Sensenbrenner ran an op-ed in the daily paper, "Roll Call" urging conferees on the highway bill to include language from HR 904.

Thursday, May 17th, 2012 was the 4th annual Michael "Boz" Kerr Bikers Inside the Beltway event in Washington, DC. The event is a national lobby day, sponsored by the Motorcycle Riders Foundation, for motorcyclists to come to Capitol Hill to meet with their elected officials and brief them on all issues affecting motorcyclists at the federal level. This year's event drew hundreds of motorcyclists from 17 States and met with almost 250 elected officials.

One of the top issues the attendees were lobbying for was asking their members of Congress to work the HR 904 language into the now conferenced highway legislations. HR 904 is the bill to prohibit federal funding of motorcycle-only roadside checkpoints.

Speeder Tells Cops His Bike Can Go 190 mph

RAVENA, N.Y. -- New York state troopers arrested a boastful -- and unlicensed - motorcyclist for going at speeds in excess of 150mph for 50 miles on the New York State Thruway, before telling them his Suzuki was capable of even more.

A trooper first spotted the motorcycle heading south through Ravena, near Albany, going 166mph, police said Wednesday. Other troopers and Thruway workers tracked the motorcycle's location for about 20 minutes until police were able to stop it more than 50 miles south in New Paltz, near Poughkeepsie. During that time, police clocked the bike

going between 150 and 170mph.

The rider, Nikkolaus V. McCarthy, 25, of Charlton, N.Y., pulled over because he was low on gas, police said. When troopers told McCarthy how fast he had been going, he told them his Suzuki could easily top 190mph. Police arrested McCarthy and charged him with third-degree fleeing police, reckless driving, speeding and operating out of class, because he did not have a motorcycle license, authorities said.

McCarthy was arraigned in the Ravena Village Court and sent to the Albany County Correctional Facility on $20,000 bail.

According to the National Highway Traffic Safety Administration 3% of Roadway crashes involve motorcyclists but 17% of roadway fatalities were motorcyclists. Statistically, another motorcyclist is the first to be on the scene of a motorcycle crash. DATA SHOWS HIGHEST RISK FOR NEW MOTORCYCLISTS Safety studies show the most dangerous time for motorcyclists is their first year riding, peaking in the first month. For motorcycle riders, their first 30 days are about four times more risky than their entire second year. A study by the Highway Loss Data Institute shows 22% of nearly 57,000 collision claims from 2003 to 2007 occurred within 30 days of a new policy taking effect. The claim rate then dropped by one-third in the second month and by almost twothirds after six months.

PREDICTING FUTURE CYCLES The Motorcycle Industry Council has reported a 7.2% gain in first quarter motorcycle sales across 18 leading brands, and a staggering 50% increase in scooter sales – suggesting that the recent spike in gas prices is inspiring more Americans to take to two wheels.

The MIC also notes that total on-highway tire sales rose 27.5% for motorcycles and 48.6% for scooters, indicating that already-owned bikes are seeing usage.

Market prognostication is an iffy proposition at best, but the MIC is boldly offering their first ever estimate for future motorcycle sales, though it’s not an entirely rosy outlook. Regarding the remainder of 2012, MIC president

The MIC does offer a positive observation: "Spending on maintenance and repairs has been rising since April 2010, according to the business advisory, suggesting that the market for consumers taking care of bikes they've long owned, or improving used bikes they've recently purchased, could continue to improve." The MIC also states that tire sales confirm that riders are putting more miles on their motorcycles, suggesting that while new bike sales might be weak, interest in the sport isn't waning. WEIRD NEWS: MOTORCYCLISTS CHARGED WITH TERRORISM FOR NOISY EXHAUST Prosecutors in violence-stricken northern Mexico have brought terrorism charges against two motorcyclists because their loud exhaust pipes backfired and caused a sound like gunshots that sent a crowd into a panicked stampede.

The two motorcyclists were leaving their workplace near the main square of the northern city of San Luis Potosi, where an Easter week festival was being held. The two got on their bikes and fired them up, and that is when the confusion began. Because the backfiring of the engines sounded like the popping of gunshots, hundreds of people stampeded out of the square seeking cover. But the streets were nearly

blocked by vendor stalls, causing the crowd to pile up and resulting in some people getting trampled.

That, not the motorcycle engines, was the real problem, according to the state Human Rights Commission, which has launched an investigation into the arrests and noted that the two suspects had been beaten by police.

State law defines terrorism as acts that "produce alarm, terror or fear in the population ... to disturb the public peace or try to undermine government authority." Officials say state criminal codes often lack lesser but more appropriate charges to handle situations involving acts that may be irresponsible but are hardly criminal.

Support bill to require U.S. Environmental Protection Agency to seek independent scientific analysis on the effects of 15 percent ethanol Contact U.S. House Speaker John Boehner and your representative today! On April 19, the American Motorcyclist Association (AMA) sent a letter to U.S. House Speaker John Boehner urging the House to consider H.R. 3199 that would require the U.S. Environmental Protection Agency (EPA) to seek independent scientific analysis on the effects of E15 gasoline as soon as possible. This bill needs the support of the House so the American people will know exactly how the use of 15 percent ethanol blend (E15) gasoline will affect the operation of their vehicles. The House Committee on Science, Space and Technology reported H.R. 3199 favorably, as amended, with a vote of 19-7 on Feb. 7. The bill was introduced by U.S. Rep. Jim Sensenbrenner (R-Wis.).

"The EPA's decision to allow E15 into the marketplace will impact every American who owns a car, lawnmower or boat," Sensenbrenner said. “Automakers insist that using E15 will void warranties, lower fuel efficiency and cause premature engine failure. In off-road engines, the effects can even be dangerous for users.

"There are serious concerns that the EPA used only one Department of Energy test and rushed E15s introduction into the marketplace," Sensenbrenner said. "This test was limited in scope and ignored a plethora of evidence -- albeit inconvenient evidence for the EPA -- that shows E15 gasoline has a negative effect on engines." The new E15 gasoline formulation may soon appear at a fueling station near you, and you need to be careful how you use this new fuel blend. That is because the EPA, in October 2010, approved E15 for use in model year 2007 and newer light

duty vehicles (cars, light-duty trucks, and medium-duty passenger vehicles). In January 2011, it added model year 20012006 light duty vehicles to the approved list. Riders should pay attention to this list because no motorcycles or ATVs are currently listed.

The AMA is concerned about E15 because it burns hotter than gasoline that contains a lesser amount of ethanol. In engines not designed to dissipate that extra heat, damage in the form of premature wear can result. Although this is a concern in all motorcycles, it's particularly problematic for air-cooled engines found in many bikes. Moreover, use of E15 may even void the manufacturer warranty. Since the approved list includes many light-duty vehicles in use today, refineries, distributors, and fueling stations may choose to offer primarily E15 gasoline because of this action by the EPA. This should concern all motorcyclists and offhighway enthusiasts since this may affect the availability of gasoline with less or no ethanol (E10 or E0).

PAGE 22 I’m getting’ older (aren’t we all?), and my vision ain’t what it used to be. Not even close. I find I have to be more alert and pro-active in order to successfully deal with potential hazards when I ride, especially at night.

We all know that many motorists don’t see motorcycles in time (or at all), and as the average age of drivers increases, we can assume that, since their vision is getting worse, so is the problem of not being noticed when we ride. Visibility – it’s about both seeing and being seen.

Lately I have been on a quest to improve my visibility when I am on my bikes. I have done some research into cost-effective ways to improve the lighting on my bikes, and I’d like to share that now. The first bike I am working on is my main ride, a 2003 Harley FLHTI (ElectraGlide). But the make and model doesn’t matter much for the purposes of this discussion because most of the improvements I have chosen apply to almost any bike. My parameters are: cost, effectiveness of the lighting changes, electrical load on the charging system, and changes to the look of the bike; I am not looking to make any significant changes to its appearance and have extra lights hanging off the bike. I just want to improve on what is already there. First, I want to improve the headlight. I just bought a PIAA Xtreme White Headlight bulb (mine is type H4, but many other

In the last installment I described my quest to improve the lighting on one of my bikes, and now I am going to let you know how this is working out. I have had some success, but not completely, as you will see if you read on.

First of all, I upgraded the headlight by changing the stock H4 bulb to a PIAA Xtreme White unit. Although I have not ridden at night since I made the change, I can tell even in daylight that this bulb is brighter than the one it replaced. But I will know more after I use it at night. (While I am on the subject of improved headlight bulbs, I would like to relate a story from years past. I bought a bulb that was actually rated at 80 watts/low beam and 100 watts/high beam, for my ’97 Sportster. It got so hot and/or drew so much current that it actually melted the plastic connector and surrounding wires! So I am glad my new PIAA bulb is the same wattage-rating as the stocker. A representative from PIAA told me that it

types are available). The factory H4 bulb that came on my bike is rated at 55 watts low beam/60 watts high beam. This PIAA bulb has the same ratings, but is claimed to be twice as bright! So it won’t draw any more electrical power than the stock unit. I have not installed the new bulb yet, but I have high hopes that it will be a marked improvement. The cost of the new bulb is about $50; if the manufacturer’s claims are true, I figure that the price is well worth it. I will carefully wrap up the old bulb and carry it in my saddlebag just in case I need it. This type of improvement can be made on most bikes.

The ElectraGlide has a fender tip light on both the front and rear fenders; they seem to be mostly decorative, and I don’t think they really make the bike more noticeable to drivers. I just found out about a company called Custom Dynamics. They make lots of LED (light emitting diode) options for bikes. One of their products replaces the wimpy #194 bulb that is used in both front and rear fender tip lights: it is an LED panel with 40 white LEDs on it and it fits underneath the existing lens. I opted to install a clear front lens to replace the stock amber one. I have already done this modification (takes about 2 minutes with a single flatblade screwdriver, and costs $38 including the new lens); and it makes a huge improvement! more visible now. Another good thing about LEDs – they draw a lot less power than incandescent light bulbs.

For the rear of the bike I tried a 4-LED replacement for the #194 bulb (also from Custom Dynamics). Unfortunately, this mod was not a success. This new LED unit faces upward, and it turns out that LED light is very directional; so the view of the rear of the bike is not enhanced by this unit at all. The sixteen dollars were not well-spent. They do make a 40-LED panel for the rear fender tip as well, so I may go for that one soon; I know that will make a big difference.

I also bought a PIAA Xtreme White #1157 stop/taillight bulb to replace the stock bulb. It’s rated at 27 watts – pretty healthy for a taillight! I haven’t installed that one yet, but I have high hopes for it. These are about $20 for a pair, and they should be well worth it for cost-effectiveness. The extra one will go in the saddlebag, too. This bulb will draw more electrical power than the stock bulb, but not so much that the charging system will be taxed. I will report on the effectiveness of both the headlight and tail/stoplight bulbs in my next article if things go as planned. The only change to the look of the bike from these modifications is that I went from an amber fender tip light to a clear one, otherwise the bike looks stock.

Next I mentioned the rear fender tip light; I got a 4-LED replacement bulb for the stock (#194) bulb. As I said previously, that didn’t work out so well, because of the fact that LEDs are highly directional, and the angle of the bulb when mounted on the bike improves visibility only skyward, but not to the rear.

I reported that I was happy with the replacement for the front fender tip bulb, as it is a 40-led panel and very bright. But after studying it for a couple of days I realized that the panel is also angled too far upward to be effective for other traffic or pedestrians. So I put the stock bulb and lens back in the front fender and moved the LED panel to the rear fender, which has a more suitable mounting angle. This really works for visibility from the rear; it’s a keeper! Again, it came from www.customdynamics.com, part #GEN-

Another plan I had mentioned was to replace the taillight bulb with a PIAA Xtreme White #1157 replacement. I had high hopes for this change, but was disappointed to find out that my bike takes a different taillight bulb, a #3157 (same general type of bulb but with a different base). I may use the two new PIAA #1157 bulbs in my Buell, which takes two of them in the taillight section. This ought to make a big difference for that bike. In the past I had improved the brake lights by doing two things: adding a Harley-Davidson brake light kit, which makes the turn signals into additional brake lights while it keeps them functioning as turn signals, too. This is an inexpensive modification. The other thing was to add a “Stopper LED Brake Light”, part #4635 from Aerostitch (www.riderwearhouse.com). This is a neat product

There are many options for improvement to turn signals as well. But be aware that when you change to LED turn signal bulbs you will most likely have to either change your flasher unit or install a load equalizer. Remember, the LED units use less power, and that will fool your stock flasher unit into thinking that you have a burned out bulb. I have not made changes to my turn signals because of this, but I am giving it some thought. A few other cautions: some LED lighting is not DOT approved (yet), so it comes in packaging that says “for off-road or show use”. Some LED replacement bulbs are red or amber, and may not show well through your red or amber lenses. So either look for a white LED bulb, or change the lenses to clear ones.

Do not handle halogen bulbs with your bare fingers, as it will reduce the longevity of the bulb. Any dirt or oils from your skin or other places are enemies of the bulb. Amber lights can face any direction. Red faces the rear. White faces the front. You get the drill. So far I have under $150 invested in improved lighting and I expect it to be money well-spent. To recap, after all the swapping of parts back and forth, the front of the ElectraGlide was updated with a more effective headlight bulb. And the rear was improved with the brake light kit from Harley, the Stopper LED Brake Light, and the 40-LED panel for the fender tip light. It all just gives those inattentive drivers fewer excuses to say, “I didn’t see him.” And the bike looks totally stock, except for the addition of the additional LED Brake Light, which is fairly unobtrusive. If I do anything else to this bike’s lighting it will be to replace the tail/brake light bulb with an LED unit. But that may be overkill; I think this project is complete. Now that the ElectraGlide is done, let’s see how much I can improve the Buell’s lighting…
