This is my first article as the Designated Lobbyist for ABATE of Arizona, so I'm probably going to make a few mistakes, but I hope not. Well, SB1086 (anti-discrimination) made it out of committee and and now needs to get through the Senate and through the House to become law.

I'm sure that I am over-simplifying the process. A lot of work has gone into getting it as far as it has gotten to date and we are running out of time. We need

everybody's help to see this to a positive result that will benefit all members of the motorcycle community without throwing anybody under the bus. We all need to contact our Senators and Representatives and tell them that that you support this bill and how important it is that law enforcement stop treating us like dirt. The way we are being treated is wrong and out of line. This is not the only issue that we are dealing with. I believe that we are still working on the Lane Advancement for motorcycles. As it is written right now, it would only be allowed when traffic is slower than 25mph and the motorcycle would be allowed to travel no faster than 45mph or the posted speed limit. More on that as it progresses.

Everyone should be aware of the threat of toll roads in Az. This already has a lot of people upset. Another thing to talk to your Senators and Representitives about. I can not stress enough to call them, make an appointment and tell them how you feel about these things. And I hope everybody makes it to Motorcycle Day at the Dome and the Freedom Ride.

Hello to all my Brothers and sisters;

This has been a very busy first 2 months of 2013. We all got a great Christmas present from the Federal EPA here in Maricopa County. The EPA set a target date for ending emissions testing for motorcycles within the first quarter of this year. Motorcyclists have waited nearly 10 years so what’s a couple more weeks!

ABATE has appointed a new Designated Lobbyist to take over Carole O’Reilly’s position. Thanks Carole for all your hard work as a member of the Lobby Team over the past 6 years. 4 years as Authorized Lobbyist and the past 2 years as Designated Lobbyist. Welcome Victor Grady, and thank you for stepping up and volunteering for this much needed position. Vic was approved by the BOD at the January BOD meeting. He is currently working with Carole until he is comfortable with his new position. Vic is also working closely with the other members from ACMC and MMA’s Lobbyists.

SB1086 - Peace Officer Training; Motorcycle Profiling Judy Burges RDist. 22 stepped up and sponsored this bill for the entire motorcycling community. More information will be forth coming as the bill proceeds through the legislative process. I would encourage all motorcyclists to respond accordingly when asked by our Lobby Team. When asked we must continue to call, fax and email the Senators, Congressmen, and the State Capital with requests for support in seeing this important piece of legislation passed and signed into law. All 4 MRO’s need to get on board and support SB1086. I encourage everyone who contacts their legislators to, please be respectful and courteous to whomever you talk to. Most likely you will speak to the legislators’ assistant. Legislator’s assistants have the responsibility in delivering all messages to the legislators. Please keep in mind if your call is rude or offensive your message may not get delivered to your Senator of Representatives. Offensive and rude

behavior will only enforce what law enforcement representatives are communicating to our Senators and House Representatives about the motorcycling community.

The American Motorcycle Association is having success with the US EPA as of last month the EPA has agreed with the AMA and the MRF regarding E 15 standards for Motorcycles.

Federal agency wants separate E10 fuel pumps at certain gas stations that sell E15 ethanol-gasoline blend. The minimum 4 gallons has been eliminated when dispensing E 15 gasoline from a multi blend pump. EPA now agrees that many motorcycles would be exempt from using the E 15 fuel. The past 2 months have been really busy for our new Designated Lobbyist. Kat Grover, Phoenix-Shadow Mountain Chapter’s Vice Coordinator has been working with Vic and Carole as an unofficial Authorized Lobbyist. Kat has done a lot of the leg work researching many legislative items, and other time consuming work. I along with Vic will be asking the BOD to appoint her as ABATE’s official Authorized Lobbyist at their next BOD meeting.

I know several of our members and former guests have been asking where is this years’ Too Broke for Sturgis going to be held? After many months of long committee meetings and very lengthy discussions, the committee is close to finalizing a decision. As soon as we come to that decision, it will be published on our website. We have a lot of work to do but we are confident we can get it all done in time for another great Too Broke for Sturgis.

Sacramento, Calif.: The California Highway Patrol has recently issued a lanesplitting guide and plans to start a public awareness campaign to educate riders and drivers about the long-accepted practice.

CONGRESS TO CONSIDER BARRING E15 ETHANOL GAS

Legislation has been introduced in the U.S. Senate to overturn EPA approval of the sale of E15 gasoline. Calling the U.S. Environmental Protection Agency’s actions to allow the 15% ethanol blend “irresponsible” and “unfair to consumers,” U.S. Senator Roger Wicker (R-MS) and Sen. David Vitter (R-LA) filed a bill on Valentine’s Day, February 14th that would reverse EPA waivers allowing E15 to be sold to the public for use in most modern cars and light-duty trucks. “Whether you drive a car, truck, boat, or tractor, misfueling with E15 could result in engine failure, increased emissions, and the voiding of warranty coverage,” Vitter said in announcing S. 344. “EPA’s flawed waivers allowing E15 amount to government bureaucrats issuing short-sighted regulations that negatively impact families and businesses across the country,” added Wicker, a member of the Senate Environment and Public Works Committee. No motorcycles or ATVs are approved to use E15, and manufacturers warn that its use could damage engines and void warranties.

In related news, in an effort to prevent consumers from inadvertently misfueling nonapproved vehicles with E15, the EPA has announced a new requirement for gas stations that sell E15 to provide a separate E10/E0 pump. Retailers would be required to have a label on pumps that dispense multiple fuel blends of E15-and-higher that reads: "Passenger Vehicles Only. Use in Other Vehicles, Engines and Equipment May Violate Federal Law," and to post signs that indicate the location of the dedicated E10-or-lower fuel pump. MIC OPPOSES MINIMUM NOISE LEVELS FOR ELECTRIC MOTORCYCLES

The Motorcycle Industry Council announced its opposition to a proposed rule by the National Highway Traffic Safety Administration (NHTSA) that would require electric motorcycles to emit a minimum sound to protect pedestrians.

The MIC recently submitted comments opposing NHTSA’s published Notice of Proposed Rulemaking for FMVSS No. 141, Minimum Sound Requirements for Hybrid and Electric Vehicles, which would set minimum sound requirements for hybrid and electric vehicles, including but not limited to, motorcycles. Pursuant to the Pedestrian Safety Enhancement Act in 2010, FMVSS No. 141 is designed to ensure that blind, visually impaired and other pedestrians are able to detect nearby hybrid and electric vehicles in a range of ambient environments.

In the MIC’s comments, the motorcycle industry group argued that because of the unique attributes of motorcycles, NHTSA should not need to require a minimum sound for them. The MIC says that motorcycle riders are better able to see and avoid pedestrians because their sight is unobstructed, and motorcyclists are more alert because of their vulnerability. The MIC also stated that electric motorcycles are not quiet, so they shouldn’t need to be subject to minimum sound requirements.

cles have less space to add such a system, the weight of the system would have a large effect on the motorcycle’s low-speed stability, energy consumption of the speaker system would have a greater impact on a motorcycle’s range and the price of installing the system would be higher than with automobiles. NHTSA is seeking comments on minimum sound requirements through March 15, and details can be found at www.federalregister.gov. BIKERS PUSH FOR ANTI-PROFILING BILL IN ARIZONA

A hearing room filled with patch-wearing motorcycle club members broke out in cheers on February 6 as an Arizona Senate public safety committee voted to approve a bill requiring police to take training highlighting a ban on profiling of motorcyclists by law enforcement officers.

Senator Judy Burges (R-Sun City) sponsored the anti-profiling bill to address complaints from motorcycle club members who say they're frequently stopped by police for no legitimate reason. The bill would require the Arizona Peace Officer Standards and Training Board (known as AzPOST) to include courses emphasizing the prohibition against stopping a biker for riding or wearing club colors, or questioning or searching them based only on those factors. Rick Rodriguez of Glendale, a member of the ALMA Motorcycle Club, said that harassment of patch-wearing bikers by police is rampant. "It's not illegal to be an Elk, it's not illegal to be an Eagle, it's not illegal to be a Shriner, a Knight of Columbus," he told the Associated Press. "We wear collective marks, we ride motorcycles, that's what we like to do. I understand the average Joe citizen doesn't feel our plight. But when they get done with bikers, who are they going to pick on next?"

Although the measure passed 4-0, with three Democratic members absent, committee chairman Sen. Chester Crandell cautioned the jubilant crowd that the bill still has a long way to go before it becomes law and needs major changes. TEXAS BIKERS LOBBY FOR CRASH PREVENTION ACT

Suits and leather jackets rubbed shoulders in the Capitol’s corridors in Austin, Texas on Monday, January 28, as the two disparate groups share a concern over education funding; while the state’s universities lobbied lawmakers over the General Appropriations bill’s impact on higher education, motorcycle associations are concerned that funds allocated last session to the Texas Department of Public Safety are not being used effectively to support road safety and thereby costing taxpayers.

More money is needed for motorcycle training and to educate the public about sharing the road with riders, said Terri Williams, a spokesperson for the Texas Motorcycle Rights Association (TMRA2) and on behalf of the Texas Confederation of Clubs and Independents. Texas’ "Share the Road" campaign isn’t long enough, only lasting the month of May, while states with yearlong programs have fewer accidents, which saves taxpayers money.

The motorcycle groups are asking state lawmakers to pass the Motorcycle Crash Prevention Act, a new bill aimed at lowering the number of motorcycle accidents across Texas by providing additional funding to expand Texas’ “Share the Road” program -- a public service campaign intended

to make drivers more aware of motorcycles on the road -- and if the proposed bill becomes law, it would also fund more training for riders.

OHIO MODIFIES HANDLEBAR HEIGHT LAW

Ohio has modified its handlebar height law using language amended into S.B. 114 to change the limit from 15 inches above the lowest point of the saddle to no higher than shoulder height of the operator when seated in the operator’s seat or saddle.

The bill also changes the definition of a motorcycle by creating a “cab-enclosed motorcycle” classification for two- or three-wheeled vehicles having an occupant compartment top that is either permanent or removable. The bill was signed into law by Governor John Kasich on December 19, 2012 and changes take effect March 19, 2013. CALIFORNIA OFFICIALS UNVEIL LANE-SHARING RULES

About 87% of California motorcycle riders reportedly slide between cars on crowded roadways – while only half of car drivers know it’s legal and 7% admit they’ve tried to block them – which is why the California Highway Patrol is now providing guidance to safely maneuver the white lines. California is the only state in the country where so-called “lane-splitting” or “lanesharing” isn’t illegal, but state authorities have never, until now, told motorcyclists how to weave between traffic safely.

The new rules, which the CHP posted on their website after consulting with other state agencies and motorcycle-rider groups as part of the California Motorcyclist Safety Program which trains new riders in the state, apply to city streets, highways and freeways across the Golden State.

"Basically, what we're most interested in is the speeds," said Sgt. Mark Pope, statewide motorcycle safety coordinator for the CHP. "You should lane-split no faster than 10 mph over the speed of traffic around you, and we recommend riders not split at all if the traffic is faster than 30 mph."

CHP officers have always had the legal authority to ticket motorcyclists who were driving dangerously fast, Pope said, but the new rules are designed to provide specifics.

Motorcycle sales in the United States revved up in 2012, rising a healthy 2.6% over 2011, according to a report released by the Motorcycle Industry Council. Better yet, the trade group said, retail activity was up in all four motorcycle "segments" -- the first time that has happened since 2002 -with increases in scooter, dual-purpose, offroad and on-highway motorcycle sales.

Scooter sales rose the most, at 7.7%, with dual-purpose motorcycles following closely at 7.4%. Sales of dirt bikes rose 2.1%, while those of on-highway bikes, which make up by far the largest segment in terms of overall numbers, went up the least, at 1.8%.

The numbers were in line with expectations, as the MIC reported in December that for the first time since the market softened in 2006 and then crashed in 2008, it anticipated reporting an increase in sales figures.

JAPANESE MOTORCYCLE EXPORTS TO U.S. FLATTEN FOLLOWING DRAMATIC RISE

Japanese manufacturers in 2012 exported 166,601 motorcycles to the United States, an increase of 1% compared to 2011, following a dramatic 87% increase in 2011 after the OEMs exported only 88,074 motorcycles to the country in 2010.

These figures come courtesy of the searchable database of the Japan Automobile Manufacturers Association. They pertain to the Big Four: Honda, Kawasaki, Suzuki and Yamaha.

JAMA reports that exports worldwide in 2012 decreased 5% to 479,163 after last year’s upturn.

USED BIKE MARKET EXPERIENCES UPTURN

Used motorcycle sales have heated up, sparking optimism at dealerships where trade-ins have become more valuable.

As the economy has improved, even if it's been marginal, more people have decided to go ahead and buy a motorcycle. And if they can't afford a new bike, it could be a used one.

Used motorcycle prices have recovered meaningfully since 2008, rising to a level that supports a healthy demand for new bikes as well, according to a recent survey from Robert W. Baird & Co.

Used Harley prices were up 7% from a year ago and remain well above the low points found in the recession, said Baird analyst Craig Kennison who analyzed motorcycle sales data from the National Automobile Dealers Association. "If the demand for used motorcycles picks up, it usually suggests the demand for new bikes will go up as well," Kennison said.

East Valley Chapter

At our January meeting, we were given the white bandanas for alerting people we are having difficulties with our bike. This will be a good way for us to let others know we need help as they drive by.

After the February 24th meeting, we will ride to the Renaissance Festival. Tickets are $22 per person at the gate, or can be purchased in advance on line, or at Fry's Food Stores for $20.

On March 23rd, we will help the Christian Motorcycle Assoc. raise money for Sunshine Acres Children’s Orphanage, located on Higley Road, just south of the 202 in Mesa. The East Valley chapter will once again grill and serve burgers, hotdogs, pulled pork and salads. There is a ride-in bike show and the CMA will have a bake sale. Come out and help raise money for the kids, and give them a ride on your motorcycle (bring a helmet for a kid).

Our annual Spaghetti feed is on June 1st at 6:00 p.m., so save the date. It will be at the F.O.E. (Eagles) located at 1712 W. Broadway Road in Mesa (Broadway and Dobson). The cost is $10 per person.

SAFETY TIP: Jim Silk, our Safety Officer, reminded us to check tire air pressure to our motorcycle specs (not tire specs).

At the January meeting, the dollar jar would have been won by Nathan VanKuren, but he wasn't present, so it will roll over to next month. Be sure to attend the chapter meetings, because you never know when YOUR name may be called.

At the Valentine's Party Last night we all had a great time. The I Pad Mini was won by Charity Stuart. The Nook Tablet was won by Jim & Betty Hellman. Thank you to everyone who helped put on the event, and also all those who came out and supported our event.

Our meeting was relatively short this month as some of our officers were on vacation. Kat Grover spoke extensively on the progress of SB1086, Kat also read excerpts from the current Police Officer Training Manual where it pertained to motorcycles. To say the least, its a currently a tad slated against motorcycle riders. We'd like to thank everyone who showed there support at the SB1086 public safety hearing.

Our chapter also voted and passed a proposal for our chapter to provide writing materials and stamps and email templates to encourage members to contact their senators and congressman. J.C actually voted for. (maybe the

world is ending).

Our December meeting was held on Saturday January 19th at the Kettle Restaurant at I-10 & Starr Pass in Tucson. Meeting was called to order at 9:05 AM

Officers present included Coordinator Jim Butsback, Vice Coordinator Don Boulé JR, Secretary Marie “Lou” Baker, Treasurer Dawn Detelj, Membership Art Burke, Sgt at Arms Robert Guenther, Run / Events Teresa Davidson. Communications Officers Jimmy “Maverick” Clark was meeting with Mike from Victory about the Abate Riders Advantage program. Jim DeYoung & Sean Pinder had personal business and did not attend.

The Dollar Jar rolled over again; Dave Kimbrell’s name was drawn. You have to be there to win!!! Don Boulé won the 50/50.

There were 20 members present; the Pledge of Allegiance was lead by Sgt at Arms Robert Guenther along with a moment of silence for fallen brothers & Sisters.

There was a motion to accept the minutes and the Treasurer reported that the Chapter had $853.80 as of Dec 31st. Our membership officer Art Burke reported that the current membership stands at 116 and we also have 8 business members with 2 members each.

February 20th is Motorcycle Day at the Dome. We have power in numbers! We want to make a big show at the Capitol. Make us known to our Legislators, go and talk with them and let them know what is important to us! We will meet at the Kettle to ride up. KSU at 8:30 AM.

Safety Officer Jim De Young wasn’t able to be with us but asked for more members to step up to be MAP instructors! We have a large area to cover and we are trying to get into the Marana Schools but need more instructors to help.

We have our next road clean-up on January 26th which is next Saturday.

John Hanusch is heading this up again and he does a great job. Meeting time is 11:00 AM at Buddy’s Bar and as usual the Chapter will buy lunch for all those participating AFTER the work is done! Meet at the Chevron at I-10 & Wilmot and ride down as a group. KSU at 10:00AM.

Jim went down to Sierra Vista to present ABATE to the members of the VFW Riders! Terri Deppa, one of our members, is also a member of the VFW Riders and has been trying to get more SV riders involved in ABATE. Thanks Again Terri! The VFW also has a bike night every month at the Post. Once the evenings start warming up we will plan a group outing to attend their bike night!! We are still planning a Pasta Dinner for March. Jim will contact the Moose Lodge to see if we can have it there again. Last years dinner went well and we raised a few bucks and had fun at the same time!

We are also looking into a hot dog / Hamburger picnic for the summer. Park Lakes was suggested and we will contact the park and see if it can be worked out. Harley-Davidson is having a 110 year party in Milwaukee this summer Aug 29th – Sept 2, 2013. Several members have expressed an interest in riding to Wisconsin for this. More info will be coming.

Ron Kool donated some HOG swag for our drawing, Thanks Ron! He then won the 50/50 AGAIN but he donated it to the Chapter – Thanks AGAIN Ron!!! Bob Mulcahy’s name was drawn for the jar, but he was not in attendance so it rolls again!! You have to be present!!!

Yavapai Chapter

Our February meeting was held on the 10th of February and was very well attended. This came as a surprise as we thought several members and officers would be headed down to the Florence Prison run. However, due to the cold up here, several that planned to go, decided to stay home. During the meeting, we discussed a few items of note and several local chapter ideas.

We discussed at great length the passing of the first hurdle with the anti-profiling bill and heard from several members that were in attendance at the hearings. Very promising information, but it shows we have a lot of work ahead us to get this finalized. As a chapter, we were very excited and everyone is ready to keep up the work on the personal front. We also discussed our membership run on March 23rd. We will register at Roberts Market, just off 89A from 810am. We will be holding a mystery ride that will end at the Burro Inn in Wilhoit. Also discussed was the change of dates for the Run to the Hills this year. The date has been changed to Saturday, June 1st.

Our next meeting is March 10th at the Taj Mahal in Prescott. 10am officers meeting, 11am general meeting. We will be riding after the meeting, weather permitting.

TIS THE SEASON FOR POKER RUNS AND GETTING WAIVERS IS A PAIN

Q. Rod. We are having a Poker Run in early spring. Each year we have more riders and handling the number of waiver documents is becoming more difficult. I have been to rides where they staple a waiver to the front of a legal pad. Participants are then handed the legal pad and are asked to read the waiver and sign on the next available line on the legal pad. This would save us a lot of work. We only need a few waivers and three or four legal size pads to get everyone’s signature. Can we do it this way? P.L. ABATE OF ILLINOIS MEMBER

A. It would beat nothing, but here is what I fear would happen. Judges strictly construe the waiver of legal rights, as they should. Afterall, we are asking a fellow motorcyclist to give up his sacred right to go to court and sue us if we are negligent and cause him harm in exchange for our permission to allow him to go on our poker run. What I fear is that a participant on our poker run would say that he thought he was “merely signing a sign-in sheet” and did not see or

notice there was a waiver attached to the front of the legal pad (it may have been honestly folded back so one could sign on the lines of the legal pad). I am not buying that argument but several courts have, and agreed that the waiver may have been overlooked. Since waivers are strictly construed, many courts would hold that the waiver was ineffective as it was not knowingly signed. In other words, the guy gets off the hook for the waiver he signed and we may get screwed in any claim/lawsuit. So the better way to accomplish getting a knowingly signed waiver is to have a separate waiver for each participant.

waiver is when there is an incident. When that occurs, we need someone to go through what may be several hundred/thousand waivers in the hopes that the proper waiver can be identified and produced. Issues concerning legibility can be solved by requiring a printed name below the signature. But what do you do if a participant questions the signature? The solution is simple. A waiver overseer can initial each waiver that is signed during his “shift” and in his presence. That way, I can obtain an affidavit from the overseer that affirms that he saw the person sign the waiver. This is critical to have, in case the validity of a waiver comes into question.

Q. Hi Rod, a question came up regarding liability waiver forms for our runs and activities. Question is this: What if a person jumps in on the run (seeing a buddy having fun), crashes the gate or just refuses to sign in? How does the law look at this if the person (God forbid) is harmed in some way during our activity? Is this person “Not trespassing?” Who’s got our back on this one? Or , how do we cover our backside? James Blevins,

A. A waiver overseer should be appointed at all events for which you are requesting a waiver as a condition of participating. The only time we need the signed

A. A sign that declares that all participants in the ride must sign a waiver works. Banding is the best way to mark those that have paid and signed the waiver. All others are not authorized (trespassers) and should be admonished to stay clear of the ride/activity. Rides should be escorted by police officers, so a simple gesture from them is usually all it takes. If they stay with the ride and are injured, evidence that all participants were required to sign a waiver will be significant to the court in deciding responsibility, and testimony from the escorting police officer will be helpful in establishing the unauthorized (trespassing) status of the interloper. Recently a California Appellate Court decided a case that may be a good precedent for us. In that case, a couple attended a poker run for several years and signed the required waiver. Then one year, they did not sign the waiver and were seriously injured in a crash on the run. Of course, they sued the run organizers for damages. Interestingly, the court held that there was an expectation

While Ohio has not decided a case with those facts, you can bet ABATE LEGAL will be pointing at that California case and arguing that Ohio should adopt such a good rule. I don’t think so. As a matter of fact she is right on and doing her job, and no one has ever done it better.

Q. Last week Julie and I had the following conversation. “Rod, what can we do to eliminate calls from our Chapters (Regions in other states) that complain that a local treasurer/assistant has “borrowed” money from their local ABATE account.

A. The problem is that “honest people are trusting people” and as such we are vulnerable unless we strictly follow the rules implemented by most not for profit corporations. As Julie and I discussed, the

solution is very simple. RULE 1: Follow the rules. RULE 2: Require dual signatures on all ABATE checking accounts. RULE 3: Require bonding for accounts that will have balances over $5k. Bonding is cheap and it spares us of having to eat our own. If you have a loss, simply report it to the bonding company. They will send you (Chapter or Region) the money lost and will collect the amount “borrowed” from our errant money caretakers. Believe me, those folks are brutally efficient at collecting amounts taken. People like “Luca Brasi” work for them and some of them are lawyers. The only problem is that bonding companies are particular as to the individuals they will agree to bond, as they like making money. Come to think of it, a rejection by a bonding company may be a good way to delegate the asking of and receiving answers to embarrassing questions of one of our fellow members. RULE 4: If the member can’t get bonding, should they be handling our money? I don’t think so, unless you are willing to suffer Julie’s wrath when you

He wrote this letter for the ARIZONA MOTORCYCLISTS to help in our efforts to get our BIll SB1086 to become a LAW here in Arizona.

The reason that we all need be supporting this bill should be clear to all of you. Discrimination against bikers is rampant and mostly based on the images of a few crack ass movies from the 70’s. House of Representatives, My name is David Devereaux, Spokesperson for the Washington Confederation of Clubs and National Legislative Liaison to the US Defenders, and I have extensive policy experience relating to motorcycle profiling legislation. Indeed, the wording of the proposal in Arizona, SB 1086, is almost identical to the law adopted unanimously by the Washington state legislature in 2011. Since adoption motorcycle profiling incidents in Washington State have dropped by more than 90% Based on the testimony given during the Senate hearing on SB 1086, motorcycle profiling is occurring in Arizona on a widespread basis. Even the opposition conceded that the incidents described by the motorcyclists present made it clear that profiling is an issue and that Arizona law enforcement officers involved should be reprimanded. The inevitability of continued profiling and the resultant civil judgments granted for constitutional violations will continue to plague the state of Arizona unless the legislature acts. The only arguments advanced against the bill are based on the fragmented logic that training will not solve the problem because the terms are ambiguous and that there would be a conflict with Arizona's gang law. These assertions are patently false. First, contrary to the claims of Lyle Mann of the Arizona Peace Officer Standards and Training Board, the very simple training required by this proposal is empirically proven to solve the majority of the

problem. As stated, motorcycle profiling incidents in Washington State have dropped by over 90%. This statistic is a consensus among the motorcycle constituency and law enforcement alike. The Washington State Criminal Justice

Training Center spends 10 minutes focused on addressing motorcycle profiling issues to every new law enforcement recruit in the state of Washington. Also, every veteran officer receives similar training at the department level. This seems to prove that training works. There is every reason to believe that the exact same requirements would work in Arizona. Second, the terms and concepts proposed to address profiling are clear and precise. The opposition's claims of ambiguity are simply subterfuge and are not true. It is very simple to explain to every new recruit that the biker stereotype has outlived its usefulness. It is very simple to explain that profiling an individual based on the biker stereotype violates the equal protections guaranteed by the 14th amendment and the reasonable search and seizure requirements of the 4th amendment. It is easy to explain that the publicized actions of the few are not enough to justify a negative presupposition about thousands of people and organizations. Third, there is absolutely no conflict with SB 1086 and law enforcement efforts to combat gangs. Washington State has a gang law almost identical to Arizona's and there has been no conflict with our motorcycle profiling law.

Whether someone is a gang member is irrelevant to the issue. Even if some gang members ride motorcycles the practice of profiling based on this stereotype results in widespread discrimination against the thousands and thousands of motorcyclists that are average, hard working Americans. Also, it is illegal to seize an individual solely because they might be a gang member without proof of some specific crime being committed. Using traffic code to avoid 4th amendment warrant requirements should be considered a reprehensible violation of due process. Law enforcement has sufficient tools to investigate gang related crimes. Profiling is an ineffective and constitutionally impermissible law enforcement tactic. Finally, motorcycle profiling training is virtually cost free. Making a policy statement requires little more than the cost of the paper that it is printed on. This is especially true considering that every judgment in favor of a profiled motorcyclist financially impacts the state of Arizona and its citizens. In the end, the only responsible decision ethically, legally and financially is to implement training to address the irrefutable issue of motorcycle profiling in Arizona. Iron Brotherhood bar fight: 'Everybody was swinging at everybody,' witness says of brawl allegedly involving off-duty police officers By Lisa Irish The Daily Courier

Incident reports from the Prescott Police Department paint a picture of an unruly scene inside a Whiskey Row bar where a fight allegedly occurred Dec. 22, 2012, between members of a police motorcycle club and a bar patron.

The reports were released Thursday evening by the Arizona Department of Public Safety to The Daily Courier as part of a public records request.

The Iron Brotherhood Motorcycle Club is a men's group made up of active and retired law enforcement officers from Prescott and Prescott Valley police departments, Yavapai County Sheriff's Office, DPS and other law enforcement agencies throughout the state.

Witnesses told police that after Iron Brotherhood Motorcycle Club members entered Moctezuma's Bar on Dec. 22, some members fought with a bar patron, then swung at bar employees trying to break it up.

One witness told investigating officers she jumped behind the bar because men wearing black vests "were coming up to the bar" and "everybody was swinging at

everybody."

Another witness said "he did not know what to do, because he knew the group of bikers to be police officers," according to PPD reports. Earlier that evening, about 20 Iron Brotherhood members wearing black vests displaying their club's name held a party with wives and girlfriends in a back room at Hooligan's Pub.

Witnesses told officers "they were a rowdy group," the bar "cut off about 90 percent of them from alcohol by the time the party ended," and "the whole group was acting like some outlaw motorcycle gang," the police reports state.

A bar employee, needing to get past a woman in the bar, said when he put his hand on her to get her attention and ask her to move, a man identified as an Iron Brotherhood member yelled at him and "got in his face," according to the reports.

One witness told investigating officers he didn't feel police officers should act that way, noting that previous encounters with Iron Brotherhood were usually polite and pleasant.

After leaving Hooligan's, some Iron Brotherhood members wearing their vests flashed badges and "tried to bully their way inside Matt's Saloon," which has a "no colors" (gang-related clothes) policy, but failed, according to police reports.

Several Iron Brotherhood members went on to Moctezuma's, which also has a "no

colors" policy, but the members showed bar security their badges and were let in with their motorcycle club vests on.

At 10:59 p.m., a Prescott Police officer went to Yavapai Regional Medical Center west campus and spoke with an injured man - Justin Stafford, 23 - who said he was punched by bikers earlier that night at Moctezuma's, according to the report. Stafford said the bikers wore black vests with patches on them reading "Iron something." Much of Stafford's statement, as well as that of his friend, concerning what happened was redacted from the report, including how many times Stafford was punched and who punched him.

Names of all witnesses, victims, Iron Brotherhood members, and large portions of their statements were removed from PPD reports released to the Courier.

When the investigating officers arrived at Hooligan's, one saw several policemen he knew wearing Iron Brotherhood vests. The investigating officers were approached by a man in a black vest who showed a badge and asked what was going on, the report states. The officer told the man flashing the badge they were investigating an incident at Moctezuma's, at which point the man pulled both officers to the emergency exit. Soon after, the officers called a sergeant saying the people they spoke with did not appear to provide them with all the information they knew. While waiting for the sergeant to arrive, an Iron Brotherhood

MASTERLINK MARCH 2013 member whose name was redacted said, "We knew you guys were going to show up. They told me you were coming, so I told (name redacted) to go home," according to the police report.

The officers returned to Moctezuma's to view surveillance videos of the fight, then placed them into evidence. Police reports were so heavily redacted it's not clear what the officers saw in the footage. No one from the Iron Brotherhood returned an officer's request to provide the legal name of the man involved in the assault by the next day, according to a police report turned in on Dec. 23.

On Monday, Dec. 24, a Prescott Police detective was told by command staff that officers may have been involved in an assault at Moctezuma's two days earlier and asked detectives to obtain more video from the three bars, which was placed into evidence, according to police reports. After the PPD's initial investigation, Prescott Police Chief Mike Kabbel, who has since retired, requested that the DPS Special Investigations Unit take over the case to avoid any perceived conflicts of interest.

DPS spokesman Bart Graves said Friday morning the agency's investigation into the incident should be completed in 30 to 45 days and surveillance videos will be released at that time. The Courier is continuing its efforts to obtain the video as well as unredacted reports.

A. Probably nothing to guarantee that it never happens, but there are

several things we can do to minimize the chances and the amounts at risk. Here are some simple rules.

1. Don't let people who desperately need money handle the money. Get a credit check from those handling the funds. There should be no privacy issues when it comes to those handling our life blood of the organization - dollars.

2. Even if you get a good person to handle the money - get two of them for a check and balance. Always require dual signatures on any checks.

3. You should bond any money transactions over the amount you can't

Worst case is that you embarrass yourself by asking the "who, what, when and where" questions. 6. What do we do when we find a theft? Do we hang/prosecute them or? A policy should be followed that takes into account our legal requirements, but also should allow for explanations for the failure of trust. Remorse, mistakes etc., should be evaluated. Once upon a time, there was a bantam rooster. Since it looked different than the regal all white Leghorns, about a third of their size and brownish, it pretty much lived a life outside the chicken world being that he was the only one of his tribe in that flock. I think he decided that since he was not one of them he would hang with us - the need to belong somewhere must be universal. And he even had a name - Chicken George. An amazing thing was that he had learned to ride on a platform in front of the handlebars of a bicycle. So it didn't take much for it/him to transfer the bicycle perching skills to motorcycle perching skills. Here is how that happened. One summer, a neighbor had some friends visit from the Chicago area. They brought with them motorcycles that needed stored "for a while". I didn't

know then, what I probably do know now, about those motorcycles. Just guessing but I am reasonably sure, now, that then, there was some confusion as to ownership. So for one good part of a summer we had to make sure that these motorcycles were properly exercised for the rightful owners of course. And so did the biker chick. Nothing more amusing than watching this biker chick perched at the top of a buddy seat on an old knuckle going down the road at about 50 mph. The Motorcycle Riders Foundation reports; Transportation Secretary Ray LaHood, the lone Republican in President Barack Obama's Cabinet, is leaving the administration.

The departure of LaHood is the latest of several changes in Obama's administration since the President won re-election in November. Secretary of State, Treasury, Defense, Interior and Labor have all been recently vacated.

Possible LaHood replacements include Los Angeles Mayor Antonio Villaraigosa and Jim Oberstar, a former Democratic Congressman from Minnesota and chair of the House Transportation and Infrastructure Committee. LaHood, 67, was named Transportation Secretary in January 2009. Before that, he served seven terms in the U.S. House as a representative from Illinois.

Washington DC is back at work and the Motorcycle Riders Foundation is no exception.

Two separate lobby trips have been made on behalf of ABATE and the MRF. ABATE of Wisconsin and Pennsylvania have both made visits to the nation's capitol so far this year. Many others have their trips booked for the busy winter and spring lobby season.

The main issues of concern to the MRF before Congress are, ending the motorcycle only roadside checkpoints the use of high ethanol blended fuels that have been approved for use by the public but have not been tested on motorcycles. Also on the radar is stopping outside agencies from wandering into motorcycle safety as the Centers for Disease Control (CDC) and the Government Accountability Office (GAO) have recently done.

The MRF also had a solid presence at ABATE of Pennsylvania's Leadership and Legislation seminar this year. MRF

President, Kirk "Hardtail" Willard stole the show at the opening evening's panel discussion which was aired on Pennsylvania public access.

United States Senators Roger Wicker (RMS), and David Vitter (R-LA), have introduced legislation that would invalidate the Administrator of the Environmental Protection Agency (EPA) from approving introduction into commerce gasoline which contains greater than 10-volume-percent ethanol.

The EPA admits it did not test the 15% ethanol blends on motorcycles or small displacement engines. The Motorcycle Industry Council has gone on record saying that the higher blend will be damaging to motorcycle engines.

In November 2012, AAA urged the Obama administration to halt the sale of E15 because of possible engine damage. AAA said it found in a survey a strong likelihood of consumer confusion and the potential for voided warranties and vehicle damage. Senator Vitter had this to say “It is irresponsible for EPA to allow E15 without sufficient testing and technical analysis. I support an all-inclusive energy strategy, but experimenting before understanding the consequences and potential cost of using E15 is unfair to consumers.� As stated in the Motorcycle Riders Foundation Legislative Strategy Agenda for 2012-2013, the decision was made to not support the use of E15 fuel without further testing and specific recommendations from motorcycle manufacturers. Out With Old, In With the New… Well, Kind Of Visual – taking your eyes off the road; Manual – taking your hands off the wheel; and Cognitive – taking your mind of what you are doing. While any of these distractions can endanger the driver and others, texting while driving is especially dangerous because it combines all three types of distraction.

We’ve all seen it. Heck, we probably all have done it at one time or another. DISTRACTED DRIVING!

We recognize that distracted driving is a problem. But, what does it really mean and how does it impact motorcyclists? According to information from the Centers for Disease Control, more than 15 people are killed and more than 1,200 people are injured in crashes involving a distracted driver every day.

Distracted Driving is when someone operates a motor vehicle while having their attention diverted in some way by another task. Years ago, the most common distractions were eating, changing the radio station and passengers. Today, we can add such things as GPS and cell phones. Texting on a phone is by far the most lethal action when it comes to distracted driving. When you are behind the wheel there is no such thing as a small distraction.

There are three main types of distraction:

Driving is one of the most dangerous activities that we will do in our lifetimes – and we do it nearly every day. Vehicle crashes are costly, time consuming and potentially fatal. Distracted drivers are 23 times more likely to cause crashes. Compare that number to impaired drivers who are merely 7 times more likely to cause a crash. Approximately 25% of drivers in the United States reported that they “regularly or fairly often” talk on their cell phones while driving. Those drivers between 18 and 29 years old reported they talk on the cell phone while driving 40% of the time.

Approximately 9% of driver in the United States reported that they text or email while driving. I believe that such activities are vastly underreported because in some states, it is illegal to do so while driving. More than 50% of drivers ages 18-29 reported texting or emailing while driving in the last 30 days and more than a quarter reported they do so regularly.

So, what’s the big deal? Well, activities, such as texting, take the driver’s attention away from driving more frequently and for longer periods than other distractions. When driving, especially at high speeds, it only takes a split second for the situation to change, and if you are not fully aware of your surroundings and in control of the vehicle, a crash is likely to happen.

Call for MAP Instructors

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us.

To become an instructor you must:

1. Be available during the day: The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in

the material presented.

4. Commit to teaching at least 2 classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.

5. Provide record of teaching to the M.A.P. Coordinator on a consistent basis.

This is your opportunity to get the word out to new drivers about the importance of sharing the road with motorcyclists. According to Harvard Mental Health Letter published September 2010, roughly 8 in 10 Americans who own cell phones say they talk on them while driving. About 1/3 of U.S. traffic crashes each year (about 1.6 million) are attributed to people talking on cell phones. People like to think they can multitask, however, cognitive research suggests that the brain tends to focus on one major activity at a time, while slowing the processing of other external cues. That is why talking on a cell phone may cause “inattention blindness.” Drivers using cell phones miss half of the information in their driving environment. Drivers using cell phones not only display slower reaction times and have difficulty staying in their lanes, but also are less likely to see high and low relevant objects, visual cues, and exits, red lights and stop signs. There is also a huge financial burden for distracted driving. Costs include fines, court costs, lawsuits, insurance claims, medical care, wages lost, vehicle repair and/or replacement. A Harvard risk analysis study estimated the annual cost of crashes caused by cell phone use to be

$43 billion.

Motorcyclists have the unique vulnerability of sharing the road with distracted drivers. We are at greater risk for disastrous outcomes because of our lack of protection, even if we use all safety gear available. A large percentage of crashes involving motorcycles and distracted drivers actually come at slow speeds and in heavy traffic. The old claim, “I didn’t see the motorcycle,” may actually be true in this case, due to the above reasons.

So, take personal responsibility to not be a distracted motorcycle operator (do not use your cellphone while riding). Remain aware of your driving environment, always plan ahead for possible problems and be ready to take evasive action. Additionally, discourage anyone you know to not drive distracted. Stay Safe,

Southern AZ Chapter’s Road Clean-Up January 26th, 2013

The Southern Arizona Chapter has been taking care of a one mile stretch of Highway 82 near Whetstone Arizona for years. This involves cleaning up all the waste paper and various pieces of trash along that highway three times a year. John Hanusch has been leading this effort for the past several times we have done it. Coordinating with the Highway Department and keeping track of the supplies and making sure lunch is provided for all who work. This year’s first outing to clean our highway was scheduled for Saturday January 26th. We were set to meet at the Chevron

Station at I-10 & Wilmot at 9:30 AM to ride down to Whetstone and meet up at Buddy’s Bar, which is near our mile, at about 11:00 AM.

The weather report called for rain all day on Saturday and there was discussion on calling things off, but after talking it over it was decided to go ahead and try and get it done. As usual in Arizona the weather forecast was a guess at best. On the ride down to the Chevron I ran into a few light sprinkles but nothing much. I pulled in to find Ron Kool & Jim De Young waiting but no one else there. One other member showed up but decided to

go back home because he was feeling under the weather. The three of us headed out for the ride down I-10 to highway 90 and south to highway 82. we ran into a little light rain for a mile or two on the interstate but after that it was clear all the way down to Buddy’s.

We arrived at Buddy’s to find John ready and all the supplies on hand. We broke up into two groups, each taking a section and the entire project only took about an hour. Since we have been cleaning the road on a regular basis, the trash hasn’t built up to the volume it was when we began doing this. After we finished and stacked the

trash near the sign so the highway department could pick it up, we took a few photos and retired to Buddy’s to enjoy our lunch. There were only four of us so there was a lot of food to go around. Once again thanks to John for organizing everything and thanks to those who took a chance on getting wet to do something good for the community. Jim Butsback

Industry Update: Motorcycle Industry Council Expands Membership to Powersports Dealers

Powersports dealers and retailers can now take advantage of proprietary market research and technical data, local, federal and state regulatory support, and other benefits of membership in the Motorcycle Industry Council to grow and protect their businesses and enhance the customer experience.

“Powersports dealers are impactful businesses on Main Street throughout the United States and are a direct link to consumers,” said Tim Buche, president and chief executive officer, MIC. “By bringing in the new dealer members, we are exponentially extending our collective reach and, as a result, significantly growing our industry community. We look forward to the day when we represent businesses in every congressional district in America.”

A Dealer Advisory Council will be appointed later this year to consult with the MIC board of directors on issue spotting and opportunities to improve the rider experience. “MIC’s mission has always been to preserve, protect and promote motorcycling with the emphasis on riders,” Buche said. He added that the MIC has long supported dealers by working with them on subjects of common interest, and including them in the membership will provide

MIC will be meeting with potential new members this week at the 2013 Dealer Expo in Indianapolis, Ind. (MIC Business Center, Indiana Convention Center, Room Wabash 3). As new MIC members, powersports dealers and retailers will join approximately 300 existing member companies, which include motorcycle manufacturers and distributors, aftermarket product manufacturers, importers, distributors, and more.

Buche said, “An important goal in integrating the dealers into the MIC is to help redefine how both enthusiasts and policymakers view the powersports industry overall. The synergistic relationship created by bringing in the dealers can help evolve the definition of industry so it applies to everyone – companies and consumers – who enjoys the motorcycles, all-terrain vehicles, recreational off-highway vehicles, gear and services that drive our industry.”

In 2012, the Air Resources Board's (ARB) Enforcement Division, in conjunction with ARB's Office of Legal Affairs, discovered that performance exhaust manufacturer V&H Performance, LLC. sold, offered for sale, and/or advertised, in California, aftermarket critical emission control parts. These parts were intended for use with, or as a part of, a required motor vehicle pollution control device or system that alters or modifies the original design or performance of the motor vehicle pollution control device or system. MASTERLINK MARCH 2013 After the Southern Arizona Chapter meeting on Saturday January 19th, a group of our members saddled up for a ride down to Rio Rico, Arizona. It was a great day for a ride, in fact one of the best January days anyone could remember. The ride was an easy 55 miles or so from the meeting at the Kettle to Rio Rico right down Interstate 19 to exit #17. We had a group of 10 on 8 bikes.

The reason for this excursion was that David Fossan was having the Grand Opening party for his latest endeavorSTEEL HORSE MOTORSPORTS! David is an avid motorcycle/motor-sport enthusiast, riding everything from dirt bikes, sport bikes etc. right on up to his beautiful Victory Vision Tour bike. It seems that David had grown tired of hav-

ing to trek all the way up to Tucson every time that he or one of his riding buddy’s needed a part or some accessories. After a lot of inquiries to the local riders and I am sure a LOT of discussion with Ivette, He decided to jump in with both feet and open his own shop if nobody else was going to do it. From Nogales to Tucson there is not a single shop, according to the locals I talked to, so there is a lot of excitement about this new shop opening. The GRAND OPENING featured live music and free hot dogs provided by Chuyito’s Hot Dogs which has a complete restaurant including booths and everything inside a converted motor home, it is really unique.

There were riders from all over the area coming in and out during the time we were there. There seemed to be a lot of interest from the Nogales area on both sides of the border.

David has everything from leathers, boots, and wallets etc. to oil, filters, plugs and other maintenance items. The representative from Bikers Choice, Russell Hacker (an ABATE SAC Member) was on hand to help handle questions and find out from the local riders how to help Dave adjust his stock to better serve all those along the Border. Right now Steel Horse is mostly a retail store but they hope to be expanding into service work as soon as they get on their feet and see how much call they get for services.

The Executive Orders ensure that the aftermarket critical emission control parts comply with the applicable aftermarket part regulations, and thus do not reduce the effectiveness of any vehicle pollution control system or cause the vehicle emissions to exceed applicable emissions standards.

V&H promptly and fully cooperated with ARB during the investigation, and as a result, has already implemented a compliance plan to inform its distributors, dealers, and customers about the types of motorcycle exhaust systems that are legal for sale in the State. In addition, V&H is actively working with ARB's Aftermarket Parts Section to ensure that all of its aftermarket critical emission control parts that are sold, offered for sale, or advertised in California obtain the necessary exemptions from ARB. The case was settled in January 2013 with the penalty total of $500,000, being applied to about 2,000 units at approximately $250 per unit. ============================

California officials release written guidelines on motorcycle lane-splitting

Lane splitting in a safe and prudent manner is not illegal in the state of California. The term lane splitting, sometimes known as lane sharing, filtering or white-lining, refers to the process of a motorcyclist riding between lanes of stopped or slower moving traffic or moving between lanes to the front of traffic stopped at a traffic light. Motorcyclists who are competent enough riders to lane split, should follow these general guidelines if choosing to lane split:

1)Travel at a speed that is no more than 10 MPH faster than other traffic – danger increases at higher speed differentials.

2)It is not advisable to lane split when traffic flow is at 30 mph or faster – danger increases as overall speed increases.

3)Typically, it is more desirable to split between the #1 and #2 lanes than between other lanes. 4)Consider the total environment in which you are splitting, including the width of the lanes, size of surrounding vehicles, as well as roadway, weather, and lighting conditions.

5)Be alert and anticipate possible movements by other road users

The Four R's or “Be-Attitudes” of Lane Splitting: Be Reasonable, be Responsible, be Respectful, be aware of all Roadway and traffic conditions.

Note:These general guidelines are not guaranteed to keep you safe. Lane splitting should not be performed by inexperienced riders. These guidelines assume a high level of riding competency and experience. Every rider has ultimate responsibility for his or her own decision making and safety.
