(g) COURSES ON THE CONSTITUTIONAL RIGHTS OF PEOPLE, INCLUDING HOW THE PROFILING OF MOTORCYCLISTS VIOLATES THOSE RIGHTS. FOR THE PURPOSES OF THIS SUBDIVISION, "PROFILING OF MOTORCYCLISTS" MEANS USING THE SOLE FACT THAT A PERSON RIDES A MOTORCYCLE OR WEARS MOTORCYCLE-RELATED PARAPHERNALIA AS THE BASIS FOR TAKING ANY LAW ENFORCEMENT ACTION AGAINST THE PERSON, INCLUD-
ING ARRESTING, SEARCHING OR QUESTIONING THE PERSON, WITHOUT ANY OTHER LEGAL BASIS UNDER THE LAWS OF THIS STATE OR THE UNITED STATES AND THE CONSTITUTION OF THE UNITED STATES OR THIS STATE.
Jan. 29, Per Dave Kopp, On Target Policy Advisors, LLC: “According to Senator Burges, we face an uphill climb this year. We had a hard time corralling cosponsors, and she’s been told by several legislators that they just don’t want to deal with this issue in an election year. Most of them see this as a bikers vs. cops thing, and they don’t want to be on the wrong side of that, especially if they’re facing a tight election. As a result, we may have a hard time even getting it out of committee this year.
If we want this to move, we’ll need to work for it. Now that we have a bill number, we need everyone to start getting in touch with their district reps and asking them to support us on this. Every biker who wants to see this bill move, should dedicate himself to the idea of learning 1) his legislative district, 2) the names of his two State Representatives and one State Senators, and their contact info, 3) the names of their Legislative Assistants, 4) the websites of the Arizona Legislative Information System (ALIS http://www.azleg.gov/) and the Arizona State Request to Speak system (RTS https://apps.azleg.gov/Account/SignOn - only works if you have created an account at the capitol), and maybe most importantly, 5) how to be polite and respectful, but firm and insistent at the same time. These people need to hear from us, and they need to understand that we are their constituents and that we expect them to act on our behalf, but at the very first sign of disrespect, they will turn away and use that against us and the bill.” Dave Kopp dave@otpallc.com

Discussion: ARA has returned money donated by ABATE. ARA activity is suspended until after TBFS.

1. Discussion: Postcards were used for renewals, several were returned due to wrong address. How many total postcards were mailed out? Is it broken down by Chapter? The questions were unanswered. It is estimated that Tucson sent out 110 postcards, East Valley 104 and High Country fewer than that. Unknown if Phx/Shdw Mntn, Yavapai and Yuma Chapters have sent out renewal reminder cards. Action: Tina Benoit will ask Chapter Membership Officers to track the number of membership renewal postcards are mailed out, how many are returned due to wrong address, and how many renewals result from postcard reminder. 2. There is no discount available for ‘transfer’ of membership from one state to another because ABATE is not a national organization. ABATE is comprised of multiple organizations throughout the states. 3. Discussion: Cost of mailing anniversary pins is greater than the value of the pins. Often the pin is broken in mailing or lost due to torn envelope. Perhaps, anniversary pins should be replaced by anniversary patches. Discussion: New brake lights are LED instead of traditional bulbs. The new lights are brighter and more easily seen. Jim was commended on the quality of his Safety articles in the Masterlink.

1. Motorcycle Day at the Dome (MDATD) planning is ongoing. (see Old Business for explanation of planning) Flyers and tri-folds will soon be available. The tri-folds will include talking points and appropriate behavior when visiting the legislature. A Freedom Ride will start at the Glendale Civic Center and meet the riders at the K-Mart at I-17 to ride as a group to the Capitol. Safety and traffic control concerns are being addressed. 2. SB1278 is Anti-profiling Bill 3. HR61 is the Bill regarding the ban on funding for motorcycle-only check points. 4. Action: Mary K will delegate Handi to notify Chapter PAC Officers regarding expected behavior while visiting the legislature. Communications – Charity Stuart (absent 1/27-4/5/14)
Discussion: Charity has been deployed with the military and will not attend meetings. But, she is able to follow through will assignments. She will update our Face Book page to reflect the date for the event, June19-22, 2014 at Mormon Lake Lodge.
ANNOUNCEMENTS: Discussion: Mary K has asked that all officers make a greater showing at events. It would be ideal to have an ABATE membership table at more fixed events (Westgate Bike Night, Motorcycles on Main-Mesa). Contact members to work the events. It would be a great opportunity to distribute White Bandanas. Vulcan Riders have asked for 100 bandanas. Jim Silk indicated he would get bandanas to the Vulcan Riders.
Upcoming RUNS/Events: 1. 2/14 – 2/16/14 Custom Builders Showcase at the Hideaway, Cave Creek 2. 2/22/14, 12pm-5pm, MMA’s 22nd annual freedom beach party at

ABATE pays for food, canopy/chairs/tables and road barricades, then splits 1/3 each with MMA and ACMC. MMA (Cindy Gates) to get liability insurance from AIM/Richard Lester.
2. TBFS – Mike Schneider is the new Chairperson of the TBFS Committee. A negotiation meeting with Mormon Lake Lodge (MLL) representative was held prior to this officer meeting. The meeting resulted in a solid plan to hold TBFS at MLL June19-22, 2014. Mike will produce the flyers and business cards advertising the event. Charity will update the Facebook page and Mary K will update the ABATE and TBFS websites. 3. MasterLink savings – Mary K cut the January 2014 issue from 24 to 20 pages and cut February 2014 production 600 copies, from 1850 to 1250 for money saving. Both actions were taken. The publication will remain 20 pages per issue.
NEW BUSINESS: 1. Topic: Spending - In order to continue, ABATE must operate with greater attention to responsible spending. Austerity measures include no spending by state officers without prior approval; no state reimbursements for gas / travel to meetings (Chapter, State, BOD); individual ABATE members will not be reimbursed for membership dues for joining other MROs; ABATE will not provide funding to attend conferences until further notice. However, the B.O.D. did approve our Lobbyists budget for $1400.
2. Topic: ABATE’s Rider Advantage (ARA) - has suspended activity as of 1/14/14. Donated money was returned to ABATE on 1/26/2014. ABATE had donated ARA money to cover business start-up expenses. Officers resigning: Jim ‘Maverick’ Clark, Darin Yates, Casey Yates, and Denise. Officers remaining: Jim Silk, Jim Page and Charity Stuart. 3. Topic: Radio Interview - Mike Schneider, Clyde Brooks and Jean Cooper were interviewed by Monkey
Butt Radio on 1/21/14. The radio show was approximately an hour of discussion regarding ABATE of Arizona, it’s mission and impact on legislation related to motorcycling, as well as the mission to promote motorcycle safety through the Motorcycle Awareness Program (MAP). Monkey Butt Radio can be heard and seen on the internet every Tuesday evening from 6-7 PM. The originators of the program are long-time riders and Veterans. They cover all topics related to motorcycling. 4. Topic: State Run Coordinator – The position remains open. Anyone interested should contact any State Officer.
5. Topic: White Bandana Program Scottsdale H-D has been distributing white bandannas. Mike and Mary K plan to follow up with the company marketing manager to review how the program is going and ascertain their intentions to continue to program.
6. Topic: ABATE business cards for State Officers – Mike will produce standardized business cards for officers as they are requested.
7. Topic: Standardized ABATE BANNERS - for membership booths are inconsistent throughout the state. Consider adopting ONE STYLE and order one for each chapter. It will be requested that chapters destroy out dated banners. Run Coordinator may be responsible person for banners used by Chapters. This project will be postponed until after TBFS and analysis of organizational financial health. 8. Topic: Membership applications – Mike will review and update the applications. He will present updates at next meeting.

Mormon Lake Campground Due to the heavy monsoon rain season, ABATE of Arizona has changed the date for our Annual Fundraiser. Last year’s one inch of rain per day but a big damper on the attendance of the Event, so after 23 years we have moved the event to an earlier date. Please help by getting the word out. This event helps sustain ABATE of Arizona financially so we can help protect your motorcycling rights. Same great Party just a different date.

Participants visit as many ABATE business members as possible in a certain time frame and maybe double points for attending sister chapter meetings. Collect points for each stop/chapter meeting/event. It was suggested that Griz provide greater detail regarding planning and outcome of the event and re-propose it for consideration. Hello, my name is Dan LeMond, aka “44 Dan”. I am the State Commander for the US Defenders Coalition Of Independent Riders (COIR) in Arizona. I've lived and rode in Arizona for over 25 years, and have been riding for 45+ years. I live in the Dewey-Prescott area, and am currently the ABATE Yavapai Chapter Safety Officer. Like many of you, I'm a member of several different Motorcycle Rights Organizations (MRO's) and have attended many Motorcycle Rights Conferences, and will continue to do so.
The US Defenders is a grass roots motorcycle riders rights movement that consists of The Confederation of Clubs (MC's) on one side and the Coalition Of Independent Riders (COIR) on the other. The US Defenders program unites all MRO's and Independents together, so everyones vote counts. We are a registry of Motorcyclists that will act when called upon to notify their Legislative Representatives, either for or against a particular bill, this is a Call To Action. These CTA's will include all the information you'll need to perform the act (respond). We place a timeline in which you will complete your act and it will
include that you CC a copy of your sent e-mail to me, as well as any responses received. This way I will know how many acted and it also helps give you the incentive to act (your proof of accountability). Through this timed act (e-mails, phone calls, etc) we can have one powerful voice that has a proven positive record. It normally will take you 5 minutes to send a prepared e-mail (or one you personally write) and brief phone call. When this happens all at once, WE Get Noticed and WE Get Results!
New Registrants please contact me directly for Registration forms and Patches. You can call or (preferably) email me and I will get you registered quickly. Please feel free to check out our website if you have any questions or call or email me directly. http://usdefender.net/arizona

East Valley Chapter
On Sunday, January 26, 2014 East Valley ABATE members and friends gathered at the FOE building in Mesa for our first meeting of the year. We had a great turnout, and it was good to see so many bikes parked out front. Lots of visitors in anticipation of our guest speaker, Matt Brown.
Joe kicked off the meeting by introducing this year’s new chapter officers. Jack kept the minutes, and kept us up to date about B.O.D. activities, as well as encouraged us to come out to Motorcycle Day At The Dome on March 12th.
Mike with Membership reported having some success by using renewal postcards. Jim Silk talked about the long running success of the Motorcycle Awareness Program, and invited members to come out in February to check out the classes and lend a hand.
I talked a little about the so-called Black Box legislation, and its potential threat to our privacy and freedom, and the importance of not only owning the recorder’s data, but also ensuring that the legislation’s language include motorcycles. 44 Dan talked about the COIB (Coalition of Independent Bikers) and how to get involved.
Guest visitor, ACMC board member, and Medieval Maidens MC president, Kat Grover, informed us about the issue of Biker Profiling in local law enforcement training. This was interesting info, and sparked a lively debate and open discussion about the public’s perception of motorcyclists, profiling, and how we can best address this issue.
And then it was time for the main event. ABATE member and criminal defense attorney, Matt Brown, took the floor and gave us an enlightening talk regarding Search and Seizure. He educated us on the erosion of the Fourth Amendment over the years via case law history that has taken away our rights little by little. He also provided us with valuable information about what we could do specifically in order to protect ourselves when pulled over. Use good judgement, don’t give consent, and be persistent in asking for a lawyer. And Matt Brown would be a good resource if we ever need one.
Jack videotaped Matt’s presentation, and Mary K is working on a way to get this Search and Seizure presentation available to all of ABATE OF AZ via social media.
East Valley ABATE would like to sincerely thank Matt Brown for taking time out of his busy schedule to come and teach us about search and seizure. Thanks to everyone who came out and made the first meeting of 2014 a success. Two wheels, brothers and sisters. Larry VC, PAC, COMMS

get a break once in a while for a good ride. So pack your cold weather gear and come visit the High Country. There is plenty of things to see and do up here. Just be mindful of icy road conditions, and our wildlife population. They can be hazardous, and a chance encounter can turn a beautiful ride into a bad one. Just be safe.
In our last meeting we discussed our upcoming 10th Annual Wild In The Weeds event, to be held the 1st weekend in May. It's sure to be a great time. We talked about having two bands, one for each night. We have a couple of really good ones in mind, just have to get them locked in. We stay in contact with them, so this should not be a problem. Also discussed the bead run and decided to call it the "Rick Heppler Memorial Bead Run". For those that don't know of Rick, he was the owner of Jake's Corner Bar, where we hold Wild In The Weeds. He was a good friend and brother, that passed away due to a motorcycle accident, a week after last years event. We would like to honor him in this way.
After the meeting we went for a ride. Eight bikes strong We headed south towards Tonto Basin,(it's just a little warmer down there) to talk to a few of our expired Business Members to see if we can get them to renew. While we were riding we ran into a few other riders, and talked to them about ABATE and it's benefits. Before leaving we made sure to give them membership sign-up forms and bandanas. Rather than a Membership drive, it was more a membership ride. We had a good ride, and if we get a few new members too, all the better. Keep wind in your face, sun on your back, fuel in the tank, and rubber on the road. Enjoy the ride. Wayne Slocum Coordinator, H.C.C. ABATE
Phoenix/Shadow Mountain Chapter
We had a good turnout for our Feb. 9 chapter meeting, despite the awesome weather with record highs in the Valley of the Sun, it was a great day to be riding. Our main focus was on Motorcycle Day at the Dome to be held March 12th. As for Too Broke For Sturgis, it should be out of the mud this year with the earlier date of June 19th -22nd . We need to make everyone aware of the earlier date, please help spread the word. We will also need members to step up and volunteer for TBFS event coverage.
We are considering a new chapter event, a “Shoot and Scoot” at Ben Avery Shooting Range. We will keep you posted as it develops. Our next meeting is Sunday, March 9th. Hope to see YOU there!

The January meeting was held at the Kettle Restaurant on January 18th. The meeting started at 9:00 AM with the Pledge of Allegiance and Prayer for fallen Brothers & Sisters. The meeting room was not available at the Kettle so the staff blocked off half the restaurant for us to have our meeting. Thanks to all the staff at the Kettle.
Officers Present were Coordinator Jim Butsback, Vice-Coordinator Don Boule, Secretary Debbie Strong, Treasurer Dawn Detelj, Safety Officer Jim DeYoung, Sgt. At Arms Robert Guenther, P.A.C. & BOD Rep Sean Pinder, The minutes of last month’s meeting were approved.
We noted that Thunder Mountain Moose Lodge was holding their “Polar Moose” run and we would be passing out white bandanas to the approximately 100-150 riders that they expected to attend. This will give us good exposure and help with efforts to get the Moose Riders to join ABATE as a group and/or individuals.
The Treasurer’s report was read and approved.
We once again had a discussion on ideas to increase attendance at our meetings and to increase membership. At present we have 74 active members and 10 Businesses with 2 memberships each for total of 94. We will be making a push to increase membership in the upcoming months.
Safety Officer Jim DeYoung discussed that “Paying Attention” is NOT the same as being alert/aware. This was very informative and several key points were made. Jim passed out a hand-out which went into details that could not be covered in the limited time of our meeting. Thanks Jim for all the info you bring to us.
Sean Pinder our PAC rep spoke about upcoming events for the New Year. He explained what the Committee was doing about looking into an alternative site for future events. Remember that this year Too Broke will be held in June to try and avoid the weather issues that have plagued us in the past. Also Motorcycle Day at the Dome is coming up on March 12, 2014. Please contact you State reps and make appointments to meet with them. If you cannot attend please contact your reps and encourage them to come out and meet with you Brothers & Sisters and discuss how we can work together to make Arizona safer for all. .
Our Road Clean-up will be held on February 15th after our monthly meeting. Our mile of highway is on Hwy 82 just east of Hwy 90 out be Whetstone, AZ. The Chapter will buy lunch for all who come out and help.
We encourage all ABATE members to become more active and to join the MRF and AMA to stay on top of national issue that affect all riders. Also when talking to

STUDY SHOWS WOMEN WHO RIDE ARE HAPPIER The old adage that you never see a motorcycle parked outside the psychiatrist’s office may prove more insightful than previously considered, as a new study reveals that the key to happiness for the better half of U.S. is a bike key! The Harley-Davidson Female Riders Survey, conducted by a leading global insights firm and commissioned by the Harley-Davidson Motor Company, shows that women who ride their own motorcycles are noticeably happier, sexier and
more confident than women who don't ride. After interviewing 1,013 adult female riders and 1,016 adult female nonriders, the findings make it clear that riding a motorcycle greatly improves a woman's feelings of overall self-worth.
• More than twice as many always feel happy (37% of riders vs. 16% of non-riders) • Nearly four times as many always feel sexy (27% of riders vs. 7% of non-riders) • Nearly twice as many always feel confident (35% of riders vs. 18% of non-riders)
More than half (53%) of women who ride cite their motorcycle as a key source of happiness, according to the findings, and
prospective members, remember that there is a Club membership available that includes 5 memberships.

The Yuma chapter met on 14 February at 6:30 pm at the IHOP to conduct our monthly business meeting. The meeting was called to order, guests were introduced, and normal reports were addressed. The survey of laws that ABATE will focus on in 2014 was reviewed and discussed.
Rick Breadwell reported on the State Abate Officers Training and passed out duties and responsibilities to each officer that held those positions. The Yuma Chapter had a vacancy for the Chapter Communications Officer and nominations were made to fill that vacancy. Pastor D was voted in as the Yuma Chapter Communications Officer. At this meeting we began planning for the 2nd Annual Membership Drive (run) that will be held in Yuma on Saturday, 29 March 2014. A ride committee was formed and assignments for locating run stops, door prizes, and stop events were handed out. We finalize the run at the next business meeting. The Yuma Chapter will be changing our monthly meeting location to The Mad Greek Restaurant located at 1725 S. 3rd Ave, Yuma, AZ 85364. The meeting will still be held the second Tuesday of each month at 6:30 pm. I would like to introduce myself since I am the Yuma Chapter Communications Officer. My name is David “Pastor D” Litts. I am a patch holder with the Christian Crusader Ministry and a licensed and ordained minister so please feel free to call on me for any of your ministry needs. When it comes to romance, the market research collected by Kelton Global also shows riding can improve relationships, as female motorcyclists are more content than non-riders with: • Communication with their significant other (60% of riders vs. 38% of non-riders) • Physical intimacy (51% of riders vs. 35% of non-riders)

Lobbyist Report
Motorcycle Day at the Dome is quickly approaching, it is March 12, 2014. Everybody talk to your employers, take the day off, this is important. It's an opportunity for you to talk one on one with your legislators and let them know how you feel. Hello everyone,
I'm back with another report. The Anti-Profiling bill now has a number and it is SB1278, so here we go again, we're off and running. As for a handle bar height bill, there was not enough support from the biker community to get this one going.
What Is ABATE?
ABATE Of Arizona, Inc. is a non-profit motorcycle rights organization that is dedicated to freedom of the road for all motorcyclists.
ABATE is a volunteer organization that fights discriminatory legislation aimed towards the motorcycling community. ABATE's position is that all motorcycle riders have the right to choose not only the machine that they ride, but also the riding gear that they choose to wear or not to wear, (i.e. leathers, gloves, boots and helmets.) ABATE promotes rider education for all motorcycle riders and motorcycle awareness for all automobile drivers. ABATE needs the support of all motorcyclists.
Arizona Motorcycle Rights Organizations Need Your Help!

That being said, I would like to pass on to you some important information, what you should and should not do during a legislative session. If we are going to get anything positive accomplished in the legislature, we have to abide by their rules, which means if the person speaking says something that you know is not correct or total fiction, you must not blurt out how you feel about the statement. Only the person at the podium may speak. If you must get your objection off your chest, please take it out side. We need to show them that we are better than what we are being portrayed as by our detractors.
I can not stress how important this is to your right to ride and not be harassed and profiled while riding a motorcycle and wearing leather. Whether you’re a patch holder or an independent, does not make you a criminal. What we the Lobbyists do is for the benefit of the entire motorcycle community.
As always my Love and Respect.
Keep the shiny side up and the rubber side down.
I hope to see you all at the Capital on 12 March.

Kingman Settles Lawsuit for $50,000
KINGMAN - The city of Kingman will pay Melissa Summerson $50,000 to settle a lawsuit related to her termination more than a year ago, purportedly over her ties to a so-called outlaw motorcycle gang.
Summerson was fired from her job in Human Resources and Risk Management more than a year ago because her husband is a member of the Desert Road Riders, a motorcycle club branded as an outlaw gang in a 2009 law enforcement report. In court documents filed Tuesday in the United States District Court in Phoenix, the clerk of the court noted there was an offer to settle and an acceptance of that
The Board of Directors has recently taken on the responsibility to conduct periodic Legislative Surveys from their respective Chapters the past couple of years. The initial purpose of the surveys has been to provide guidance to the Lobbyist(s) of ABATE of AZ based on the membership priorities. The results varied by Chapter of course. The results are also not to bind the hands of the Lobbyists as discretion must be allowed to take advantage of acting on issues as opportunities arise and based on feasibility, especially in the case when active bills are moving through the legislature. Speaking of the active legislature, Motorcycle Day at the Dome (MDatD) is scheduled for Wednesday, March 12th from 10:30 AM to 3:00 PM at the State Capitol (1700 West Washington St; Phoenix, AZ 85007). Be sure to email or call your legislators. There are two Representatives and one Senator representing your Legislative District (LD) and ask for an appointment in their office or to join on the House lawn for lunch to discuss motorcycle issues. You can find your LD and contact info at www.votesmart.org. There will be talking points available and stay tuned to the email distribution list to for the active bills for 2014.
Getting back on point, the important take away to continue the Legislative Surveys is to provide a voice for our membership, since we are a grass-roots organization. An added benefit is that the surveys act as a vehicle to engage the membership in a conversation about Motorcycle relevant issues. Look forward to an annual Survey from your Chapter Board member or PAC officer with the intention to have results available for the November membership and election meeting traditionally held at Chilleen’s on 17 (formerly Kid Chilleen’s Bad Ass BBQ). Please participate, because the more members those contribute to the survey, then the higher the confidence level that the survey results reflect accurate representation of members.
The results of the 2014 Survey were as follows: 1. Ban Motorcycle Check Points 2. 3 issues tied for second…“Texting” while driving, No Helmet used as failure to mitigate damages and E-15 Study in Motorcycle engines 3. 2 issues tied for third…Anti-Profiling & Vertical Plate 4. Lane-Splitting 5. 2 issues tied for fifth…Red Light treat-
offer from Summerson in the amount of $50,000, bringing the troubling case to an end, along with potentially expensive litigation for the city. "Melissa feels vindicated by the court's entry of a substantial judgment in her favor on her constitutional claims," said her attorney, David Kresin, in an emailed statement.
"Because Melissa was such a good employee with an outstanding record, she quickly found other employment in the human resources field and worked hard to limit the economic harm that she suffered as a result of the city's illegal conduct. Despite her successful efforts to mitigate her damages, she strongly desired to obtain a judgment holding the city liable for its actions and succeeded in that effort." Summerson was terminated in late
December 2012 after members of the city's legal and law enforcement departments expressed concerns that Summerson, as a human resources employee with access to sensitive employee information, such as their home addresses, might leak that information to members of the Desert Road Riders.
Kresin filed a federal lawsuit on Summerson's behalf last spring, alleging the city violated her constitutional freedom of association.
Summerson, who still resides in Mohave County, had an exemplary employment record with the city prior to her dismissal. The city's contract attorneys who settled the case rather than go to trial never provided any evidence Summerson did, or planned to do, anything improper.
And now for the verbose comments: 1. Ban Motorcycle Check Points as this is a form or discrimination/profiling. In fact, any Checkpoint or Roadblock at least undermines or at worst violates the 4th (Search and Seizure) and possibly the 14th (due process) Amendments of the US Constitution. According to 4th (Search and Seizure) the police must have a warrant, probably cause or reasonable suspicion to search your vehicle and must explain prior to such as search. Case law has determined that 15 to 20 minutes is the maximum amount of time a motorist can be detained prior to taking formal action. However, the motorist must specifically ask to leave and if the response is no, then the legitimate reason must be provided. The reason why I mention the 14th due process amendment is that the Check point or Roadblock itself whether random or for all implies that the person being interrogated and detained (even for a few seconds) can be interpreted as guilty of something until proven innocent which is backwards to the constitution, but often reality. Being stopped on a fishing expedition may very well be a violation of due process and has become all too common in American culture today with knee-jerk reaction and judgment passed upon the accused before their day in court. Read more at http://www.motorists.org/. The MRF and AMA have been very diligent on following up on the issues nationwide, but there is no reason that an AZ ban could be implemented. We need to educate ourselves not just as Bikers, but constitutional Americans and know our rights under the 4th and 14th Amendments, as well as invoking the 5th Amendments to remain silent. Ironically you must speak to invoke that right, and then remain silent or you will need to invoke the 5th Amendment again even after answering what appears to be an innocuous response to if you need to use the bathroom. Although, in AZ you may need to produce a DL, registration and Insurance even though there was no cause for the stop. I say “may”, because I am not aware of a judicial test in AZ nor am I an attorney. Lastly on this issue, is that the Motorcycle Only checkpoints are being guised as “Safety” checkpoints to benefit Motorcyclists. The problem with this Bullshit reason is that Law Enforcement actually benefit from revenue enhance-
this year, but the settlement effectively brings the action to a close.
City Attorney Carl Cooper was not immediately available for comment.
Mayor Janet Watson, who seemed to be surprised to learn the city had settled the matter, said she could not speak publicly because all of the discussions regarding the lawsuit have been held in closed executive session.
"As you know, by law we can't discuss anything that's said in executive session," said Watson, who noted the lawsuit was scheduled for discussion in another closed session at Tuesday's meeting. She agreed she might be at liberty to speak about the issue.
The case was expected to go to trial later

ment by ticketing motorcyclists while attempts to steal SAFETEA-LU funds for Motorcycle Awareness and rider education that actually serve to save motorcyclists lives and reduce injury. The Motorcyclists do not benefit from harassment, delays, detention and maltreatment while being treated as criminals. Checkpoint action by law enforcement only breads contempt by citizens and does little to promote collaboration to pursue safety to reduce injury and death or motorists. 2. 3 issues tied for second… a. “Texting” while driving and I deliberately put texting in quotes, because any distracted driving is a problem where people seem to be doing everything, but actively driving these days from shaving, reading the paper, yelling at the kids, tweeting, and browsing the Internet. However, let’s at least start with sensible legislation to banning manual composing of electronic devices while driving. The AZ Legislation did “accidentally” approve HB2125 in 2012 until Representative Harper moved to reconsider on March 5th, despite such laws on the books in Phoenix and Tucson. Below are the votes in light gray killing the legislation under the argument of “freedom” to drive distracted without regard for others.
b. No Helmet used as failure to mitigate damages in order to reduce damages awarded to plaintiff from serious injury or death may be subject to the “reasonable man” interpretation in the court of law. So unless there is a specific law to prohibit the use of such a legal argument, then this will continue, and motorcyclist victims that are seriously injured and disabled will received diminished rewards and the families of those killed will have an increased burden after loss of a loved one and often provider. c. E-15 Study in Motorcycle engines (EPA) which is primarily the issue that affects small engine motors including
motorcycles that may void the warranty when a blender pump is used. E-15 or Ethanol of up to 15% burns hotter in engines that will cause greater maintenance costs and earlier engine failure. There was insufficient study when the EPA hastily approved use of E15 in Blender pumps. Again the Motorcycle Riders Foundation (MRF) and American Motorcyclist Association (AMA) have been great following up on this issue. If you are not a member, please join as the MRF (http://www.mrf.org/) and AMA (http://www.americanmotorcyclist.com) who are the ABATE equivalent in D.C. for federal motorcycle issues. 3. 2 issues tied for third… a. Anti-Profiling of Motorcyclists. SB1086 Introduced by Senator Burges in 2013 and almost passed the Senate if it had only one more vote (or one less Nay or one more Yay vote). The language proposed to be included in 41-1822 to read Courses that emphasize the prohibition against motorcycle profiling. For the purposes of this subdivision, "motorcycle profiling" means using the sole fact that a person rides a motorcycle or wears motorcycle-related paraphernalia as the basis for taking any law enforcement action against the person, including arresting, searching or questioning the person, without any other legal basis under the laws of this state or the United States and the constitution of the United States or this state. This bill got so close is spooked the DPS to produce an “Educational Video” as part of their Motorcycle profiling policy. The intent is questionable and reduced motorcycle profiling remains to be seen. The problem is that a DPS policy is not binding and can be changed at will of the DPS, where an ARS is far binding. The Voting results of the Peace officer training SB1086 were as follows:
b. Vertical Plate exception ARS 28-2354 “C. A person shall maintain each license plate so that the name of this state at the

top of the license plate is not obscured.” There is some dispute as the legislation does not clearly state orientation of where the top of the plate should be when mounted, only that the top of the plate where “Arizona” is clearly readable. It could be argued that the top of the plate could be to the right or left depending on the base mounting bracket or the bottom is located. However, that does not mean that Law enforcement may be free to interpret and use as an excuse for the traffic stop to harass a motorcyclist. 4. Lane-Splitting or Lane Sharing was originally introduced by the DPS (Department of Public Safety) state Police. However, ADOT has opposed due to a critical mass of lanes that are believed to be too narrow. Would be interesting to explore the amount of lane widths in CA for public roads, especially the numerous winding mountain lanes as a point of comparison. Not to mention, I have personally witnessed law enforcement lane splitting through traffic without lights, siren or emergency simply to get to a turn lane or at the front of the line. 5. 2 issues tied for fifth… a. Red Light treated as Stop when a Motorcycle does not trigger typically if reported to ADOT (or the county/municipal jurisdiction) the sensitivity can be adjusted for resolution b. Handle Bar Height repeal of ARS 28964. “C…handlebars that are positioned so that the hands of the operator are above the operator's shoulder height when the operator is sitting astride the seat and the operator's hands are on the handlebar grips.” Motorcyclists have argued that there are no compelling studies that indicate that handle bar height presents any safety issue. Rather this seems to be an issue of preference where some find varying styles and handle bar heights more comfortable than others. Furthermore, this law has become an abused state in order to harass and stop motorcyclists where vagueness of posture and measuring point of hip, bottom, or edge of seat is not consistent. 6. NHTSA (now CDC) Lobby Ban for Mandatory Helmet within Feds and States. While this is primarily a Federal issue that the MRF and AMA have been following, the bigger issue is the illegal action of one government body Lobbying another. It is bad enough that there are gross amounts of money in our political system where the wealthy and well-connected disproportionately perverts the Campaign Finance and government Lobbying that do not accurately reflect the will of the American person or their Interests. The real problem here is that no scientific (meaning unbiased) study has been produced on the study of bodies in motion nor appropriate follow up studies. The fact despite the incredible Patriotism, Loyalty and Generosity among motorcyclists, the general public often views motorcyclist as a burden to society. Knowing this, government officials often
target the motorcycling minority for political gain. If mandatory helmet laws prove ineffective (as they will since helmet manufacturing engineers already state that in-effectiveness exponentially approaches zero at speeds as low as 1520 MPH), then the next step would be to outlaw motorcycles, period. Unfortunately, we live in a culture that is becoming less responsible and instead of actually driving and avoiding hitting motorcycles, they would prefer motorcycles to crash more safely. Unfortunately, helmets may prove to provide other injuries such as increased neck injury that may simply trade one serious injury or cause of death for another. However, without an actual scientific study then the lack of effort and revenue that government officials are willing to put forth speaks volumes while their prognosticating of safety is disingenuous at best, ignorant and optimistic depending on the person that will not ‘Let Those Who Ride Decide!’ Some other issues that did not make the survey are the following, and should be
considered for completeness are Intersection Engineering solutions, since Intersections often present the greatest risk to serious injury and death to motorcyclists, and other motorists and pedestrians alike. A. Extending Yellows beyond the unrealistic 1.0 second perception/reaction time used by ADOT per ITE’s “Manual of Traffic Signal Design” (see Section
1A.11). a more realistic 2.5 second average perception/reaction time is prudent. Below is the equation description used based on a zero percent grade and ideal surface conditions and does not considered vehicles requiring more than average stopping distance such as trucks and motorcycles. B. Similarly, the Red to Red all clear time also need to be increased, especially with the higher average of elderly in AZ with reduced reaction time ability and the complete lack of Driver Education. My license does not expire until 2037. I think laws may change before then, and a refresher would not hurt when renewing a Drivers License.
C. Lagging Left Green arrows may move traffic volume more efficiently until an accident occurs versus leading Green arrows. However, the inconsistency where some are lagging and other leading seems to counter to traffic flow and provides for confusion an opportunities of accidents. I have noticed that many intersections with lagging Green arrows often have no Red all clear delay where the oncoming traffic has a green immediately after the yellow turn arrow is off or turns red. Furthermore, the lagging Green is displayed immediately when the yellow straight turns red without an all red clear where I have personally seen accidents due to this because the Left turner is unable to see if someone is pushing the yellow or running the red due to oncoming left turn traffic obstructing view. To these points, a leading Left Green turn arrow seems safer, as the lead car can look left and right with a less obstructed view if it is indeed safe to proceed. D. Timing adjacent lights for main thoroughfares across metropolitan areas to the speed limit will accomplish both improved traffic flow and encourage people to travel at the posted speed limit. I have been told far too often that lights seem to be timed to 5 and even 10 miles over the speed limit which encourages speeding. Also, I have noticed when photo enforcement is installed at intersections that the timing seems to be deliberately off perhaps to increase revenues from Photo enforcement. Streets that signal controlled do not need to trigger immediately and can be timed to the cycle at the next timed window. Remember, the best Motorcycle Awareness Program is to ride and ride often. I hope to see you all down the road a piece soon. Motorcycle Day at the Dome, March 12, 2014 Your Opportunity to Get Involved! are in session.
RTS or Register to Speak is new and you must open a new account, even if you did last year, to make yourself accessible to the new system.
By Handi State PAC Officer
The purpose of the Motorcycle Day at the Dome (MDATD) is to meet, greet and converse with your District Legislators. You will have the opportunity to discuss various issues facing Motorcyclists this day at a Luncheon on the Lawn. You can also sit in the gallery as the Legislators Johnny D, ALMA MC Arizona Confederation of Motorcycle Clubs Designated Lobbyist American Brotherhood Aimed Toward Education / Phoenix-Shadow Mountain Chapter Vice-Coordinator, PAC Officer Hello again friends.
This month I am involved in a few different projects. First is the new anti-profiling bill SB 1278. This year I changed the language a bit, I was hoping to make it easier to pass. One problem I didn’t foresee was the lack of interest by the motorcycle community. While we announced the bill and it’s co-sponsors, we were under the impression that our people would contact their legislators and request them to support the legislation. I am sorry to say that the response has been negligible. Feedback from our sponsor, Senator Judy Burges is that very few people are calling or emailing. By the time you read this it will be either past a committee or dead for the year. Another is the law on handlebar height
More and more women are, in fact, riding. A 2012 study by the Motorcycle Industry Council found that women accounted for 12% of U.S. motorcyclists -- up from 10.5% in 2009, and Milwaukee-based Harley-Davidson is selling more motorcycles to women than all their competitors combined, according to Claudia Garber, Director of Women's Outreach for Harley-Davidson.
LIMIT ON LEARNER’S PERMITS IN PA Pennsylvanians who perpetually renew their motorcyclist permits to avoid having to take the state's motorcycle safety course will soon have their strategy derailed, as a new law will limit the number of times a motorcycle rider can reapply for a learner's permit to three times in a five-year period. Representative Seth Grove (R-Dover), author of House Bill 892, said some riders have been treating permits like actual licenses since current law allows them to reapply for a permit every year. "Permits are temporary and their purpose is to get riders to obtain full driver's licenses," said Rep. Grove. "This legisla-

that I was working on with Rep. Karen Fann. That is already dead for this year. Once again we had almost no response from our community. One big upside to being politically involved is dealing with the people who are elected to govern us. Some of them are really interesting. One friend of mine is Rodney Glassman, he ended up being the town manager of Cave Creek for a while. During that time I met with him and Bikers Against Child Abuse. We decided to set up an event to benefit BACA and The Shriners’ Hospital. This will be on April 19, 2014 at the Tap Haus. We are in the process of setting it up and are recruiting vendors. ABATE is going to have a booth to sell merchandise and give out bandanas while promoting membership. I invited MMA as well. It should be a hell of a day as it will include our children and grandchildren. A lot of people have been saying that we need more family oriented events. Others say we need to improve our public image. I just want to be involved with great people and help our community.
Motorcycle Day At The Dome. This year, it will be on March 12th from 11 am until 3 pm. Our friend, Mayor Jerry Weiers of Glendale, will lead a freedom ride from the Glendale Civic Center in 57th Drive and Glenn Drive at 10 am . They will ride to Kmart on I-17 and Northern. They will leave there at 10:30 am and proceed to the Capitol. The Mayor will also address the crowd of bikers in attendance. This year we should have great weather so no one will have to freeze to ride there. We need to start ASAP to contact our legislators to come down and meet us. We need them to put faces to our complaints.

among types of riders: 94.5% of people riding sports bikes wore helmets while only 33.3% of riders of choppers and custom bikes did. Female riders and those under 30 and over 60 also wear helmets more frequently.
Still, the authors note that Michigan's usage rate is 13% higher than the 60% of U.S. riders spotted wearing helmets in a nationwide survey in 2012. Also interesting to note, the current rate of riders wearing helmets is slightly lower than the 74.7% of helmeted riders involved in motorcycle crashes, according to the Michigan Office of Highway Safety Planning, meaning lidless riders have a somewhat better safety record.
The alderman is calling it a quality of life issue, and his proposal would increase the maximum fine for violations from $100 to $1,000.

Outside of that we have the CDC chiming in on helmet laws. Last year when I was in DC, a congresswoman told me that they are basically tired of trying to push nationwide helmet laws. That fight was won by massive voter response and very effective lobbying by the MRF. That doesn’t mean the issue is dead, but they don’t really want to start that fight again just yet. The E-15 issue is very nearly dead and

Under current law, a permit is valid for one year, but some motorcyclists apply for it year after year so they are never required to take the safety course that's required to receive the full four-year license, said Charles Umbenhauer, spokesman for ABATE of Pennsylvania, which supported the measure. Umbenhauer told the York Dispatch that the legislation is a continuation of other safety measures for which the ABATE organization has pushed. Grove also introduced legislation that, when signed into law last year, required minors who hold motorcycle permits to successfully complete a free 15-hour riding course.

MASTERLINK MARCH 2014 When we ran this bill last year, it received 14 YES, 14 NO, 2 DIDN’T VOTE. We feel DPS recognized there was a problem because after running this bill last year, DPS produced an educational video as their motorcycle anti-profiling policy and sent out DVD’s to all the AZ SMRO lobbyists, showing them they have addressed this issue. The problem is that a DPS policy is not binding and can be changed at will of the DPS, where an ARS is binding. As of February 15, this bill had not been assigned to a committee because they have not heard from anyone except the lobbyists and don’t feel there is enough demand for it vs. over 500 other bills that have to be addressed. If it is not heard by Friday, 2/21/2014, it will be dropped.

Do Everything Turn, Turn, Turn...
der—you may inadvertently turn your handlebars as they turn your head, and take too much of your attention away from the traffic in front of you.
Your turn...
By Jim Silk State Safety Officer
Although motorcycles are more maneuverable than cars, not all bikes can go around corners as quickly. Most motorcycles are capable of cornering quite rapidly if you ride them correctly. Taking turns and corners for a beginner motorcycle rider can be intimidating, but if you use these techniques you’ll be cornering like a pro. Here’s how you do it.
I got this whoa Nelli! Slow Down
Motorcycles can corner incredibly quickly, but overly hard and poorly coordinated braking can upset a motorcycle’s chassis more than a car’s causing all sorts of strange dynamics. These antics can be especially dangerous while leaning over in a corner, so brake and reduce your speed before entering a curve in the road. Yes you have a blind spot here,,,HELLO!!!
Before turning or changing lanes, check your mirrors and make a sideways check into your blind spot, to make sure the lane you want to occupy is clear. Never rely just on your mirrors, which on most bikes give you a better view of your elbows and sounders than they do of the traffic behind you. On the other hand, don’t look completely over your shoul-
“etc.”??? How long is their list? I can’t even take over-the-counter antihistamines for my allergies anymore without fearing a DUI. Geez, or is that sneeze! ?! So much for better living through pharmaceuticals.
Apply your turn signal well in advance to let other drivers know what you intend to do. Then, when the coast is clear, lean the motorcycle into the turn by applying slight pressure to the inside of the handlebar in the direction you want to turn. The faster you are moving, the more you’ll have to lean the motorcycle to negotiate the turn. At normal highway speeds, you should lean with the bike. When negotiating tight turns that require you to ride more slowly, just lean the motorcycle while you remain in an upright position.
Get your braking done before you turn. Apply the brakes when the motorcycle is upright, before you lean over to turn. If you brake when you’re leaning over, you’re much more likely to slide off than you are if you brake when the motorcycle is upright. Remember, when you’re leaning over, you already have less traction available.
Time for a speed check here...
Once you have settled into a turn, roll on the throttle to maintain a steady speed or accelerate slightly. This helps keep the bike stable through the turn. Rapid acceleration or deceleration in a corner can cause you to lose control of the bike.
Because of that lack of traction, you must use the throttle smoothly in a corner. Don’t accelerate or shift during a corner, because this will upset your chassis. Wait until you’ve finished the turn and your bike is once again upright to accelerate. As you develop your technique and become more proficient at taking curves, you will be able to apply power slightly earlier as you exit a corner. When you do this, you make the motorcycle’s dynamics work for you: when you accelerate,
you place more weight on the rear of the motorcycle, thus increasing your traction. As you become more familiar with your bike’s reactions to throttle input, you can use that increased traction as you exit a corner.
If you are going too fast into a corner and need to slow down, stand up the bike for a brief moment, brake, and then immediately lean back into the curve. But be careful—if you do this for more than a split second, you will run off the road.
Look out for crap in the road
You always need to scan the surface of the road for debris—such as leaves, sand, fluids, and gravel buildup—but the situation in which these conditions will most often lead to a crash is when you encounter them in a curve. These materials tend to accumulate on the outside edge of a curve, so pay close attention to that part of the road when scanning a corner.
If there is debris on a curve, slow down to give yourself time to maneuver around the debris. If you are unable to avoid it, don’t panic and hit the brakes; that will make you more likely to lose traction and crash than if you maintain a steady speed through the corner. If you’ve slowed down to a safe speed before entering the corner, you should be all right.
Cool, calm, collected... its your time... no panic, no panic
Your safest bet is to make certain you’re not going too fast when you enter the corner in the first place. If you’re in doubt, slow down even more. If you find yourself going into a curve too fast on dry pavement, don’t panic. Just countersteer more to lean harder into the curve. The more you lean, the sharper you turn. Leaning harder also scrubs off excess speed with your tires, slowing you down. You need to trust the capability of your tires; motorcycles have more traction than you might imagine.

You may feel like the bike is nearly touching the floor, when you’re only actually a few degrees from vertical; so again, don’t panic. Even if you feel the toe of your boot drag the ground, it’s okay; most bikes still have the capability to go even lower.
The most important thing is to keep a cool head. Unless you are going at a ridiculous speed, if you don’t panic you should be able to make just about any corner.
You own this corner... take it
The path you take through a corner plays an important role in both safety and speed (the gentlest arc through a curve is also the fastest). By selecting the right route, you improve your view and make yourself more obvious to oncoming traffic.
The most important thing is to stay in your lane. When going around a corner, treat your lane like it’s the only part of the road that exists. The oncoming lane might as well be a cliff or a solid wall of rock, because under no circumstance should you ride there when going around a curve.
When approaching a corner, move to the outside of the lane before entering the turn. This lets you see farther around the corner, and it also makes you visible to oncoming traffic earlier. As you enter the corner, counter-steer the bike to the turn’s apex—the point in the corner where you can begin straightening up the bike—and start smoothly accelerating.
Now you see it... watch your vanishing point
Using the vanishing point will encourage you to position your bike safely, use appropriate speed, and force you to keep looking where you want to go.

The United States Senate is addressing privacy concerns surrounding data event recorders in automobiles. Event Data Recorders (EDRs), commonly known as “black boxes” are almost standard equipment in all new cars and trucks. They record everything the vehicle is doing, or not doing at the time of a collision or other on road mishap. The boxes can record everything from speed and vehicle angle, to seat-belt use.
U.S. Senators John Hoeven (R-ND) and Amy Klobuchar (D-MN) have introduced legislation, S.1925, to make the data recorder the sole property of the vehicle owner. Anyone else would need a subpoena to access the data. The data would also be available should the vehicle owner consent to data retrieval or for traffic safety research.
“Technology is advancing at an unprecedented pace and that poses new risks to personal privacy and new concerns for the public,” Hoeven said. “While EDRs can serve a useful function by helping to make cars and streets safer, access to the data should be treated as personal except under very specific circumstances. Our bill makes clear what those circumstances are and helps to ensure that government and other entities respect the Fourth Amendment rights of Americans.”
The Senate legislation is similar to the bill currently being worked on by the U.S. House of Representatives, H.R. 2414. The Motorcycle Riders Foundation supports both pieces of legislation and encourages you to contact your elected officials in the House and Senate and ask them to cosponsor these important bills. ===========================
14NR03 - MRF News Release - EPA Proposed Ethanol Rule Comment Period FOR IMMEDIATE RELEASE 22 Jan. 2014

EPA Proposed Ethanol Rule Comment Period
The United States Environmental Protection Agency (EPA) is considering altering the Renewable Fuel Standard (RFS) to lower the amount of ethanol produced in 2014. The proposed drop in ethanol production is a result of the Obama administration acknowledging that the biofuel law, RFS, is not working as well as expected. The proposal would require almost three billion gallons less be sold at market in 2014.
The Motorcycle Riders Foundation (MRF) Vice President of Government Relations and Public Affairs, Jeff Hennie, testified at a hearing held by the EPA on this proposed rule in December 2013. The higher blends, such as E15, have not been tested on motorcycles, and the extent of the damage is just beginning to be realized by those who have used the
News from the MRF
blend. Of particular concern to motorcyclists is that many manufactures are voiding warranties in cases where E15 is used in the motorcycle and causing damage.
Demand for the higher blends of ethanol, such as E15, a blend of 15 percent ethanol to 85 percent traditional fuel, has been lower than expected. This shrinking of the marketplace has the EPA rethinking the future of biofuels. The EPA is requesting comments on the proposal to drop the amount of ethanol produced in the U.S. in 2014. You can add your thoughts to the proposal by visiting www.regualtions.gov and searching for Docket ID No. EPA-HQ-OAR-20130479.
The deadline for comments is January 28th, 2014. The MRF encourages you to let the EPA know how you feel about lowering the amount of ethanol to be produced.

Congress came back into session this week and actually did a little work. The House has passed a nearly $1 trillion dollar farm bill. Supporters of the bill say it’s a bipartisan effort and detractors claim the process was rushed. The last farm bill passed in 2008. The bill has an interesting detail; it removes the federal subsidy for rural biofuel blender pumps. Why only the rural pumps is a bit of a stab to the heart of ethanol supporters because that is where the pumps are most popular. It seems likely that if the feds are not picking up the bill then we will see less blender pumps and ultimately less or none at all of E-15 at gas stations. The Senate is expected to pass the house legislation without amendments and President Obama should sign it on arrival to his desk.

Farm Bill Removes Subsidies for Biofuel Blender Pumps
The Motorcycle Riders Foundation reports that the United States House of Representatives has passed a bill that would end a federal subsidy for biofuel blender pumps in rural areas. The measure passed by a vote of 251-166 and costs the U.S. taxpayers $956.4 billion.
The Senate is expected to vote on the matter next week and there is little that those in support of the subsidies can do to reinstate the money. President Obama is expected to sign the legislation into law.
Putting an end to these subsides will likely result in less biofuel blender pumps in the market place and therefore less E-15 fuel.
The Motorcycle Riders Foundation supports the removal of E-15 from the market until thorough, scientific study is conducted on the effects of the higher blend on the entire power train, not just the tail pipe emissions.

14NR05 - MRF News Release - National Transportation Safety Board Releases 2014 “Top Ten Most Wanted” list. FOR IMMEDIATE RELEASE 04 Feb. 2014
Contact:Jeff Hennie, Vice President of Government Relations and Public Affairs
National Transportation Safety Board Releases 2014 “Top Ten Most Wanted” list.
Recently the National Transportation Safety Board (NTSB) released its annual list of top ten most wanted safety improvements reports the Motorcycle Riders Foundation (MRF). The most wanted list represents the NTSB's advocacy priorities. It is designed to increase awareness of and support for the most critical changes needed to reduce transportation accidents and save lives. This year’s list contains:
Address Unique Characteristics of Helicopter Operations Advance Passenger Vessel Safety Eliminate Distraction in Transportation Eliminate Substance-Impaired Driving Enhance Pipeline Safety Improve Fire Safety in Transportation General Aviation: Identify and Communicate Hazardous Weather
Motorcycles did not make the immediate list, but the NTSB did reference motorcycle helmet law deeper in the text of the explanation of one of the ten bullets.
According to the NTSB, motorcyclists are considered “occupants,” which is a serious stretch of the definition of the word and a crafty way to address motorcycle safety. The MRF has always urged the NTSB and all other federal agencies that they should focus on accident prevention rather than safer crashing.
“Using such a singular approach to motorcycle safety is not the best way to save lives,” said Jeff Hennie, MRF Vice President of Government Relations and Public Affairs. He continued, “The NTSB has just taken a giant step back from their last attempt to address motorcycle safety in 2011, which included both voluntary helmet use and rider education as equal components.” The fact is the motorcycle fatalities have dropped almost 20% nationwide since 2008, and at the same time we have seen the relaxing of mandatory helmet laws and a steady increase in motorcycle licensing and registrations.
The chairman of the NTSB, Debra Hersman, has taken a motorcycle safety class and has not ridden since, to the best of our knowledge. She is the person who originally spearheaded the NTSB’s involvement with motorcycle safety when she planned the two-day motorcycle forum at the NTSB in 2006, in which the MRF participated. It’s likely that she will continue to use her influence with the agency to keep motorcycling on or near the NTSB top ten list. ============================= 14NR06 - MRF News Release - CDC Responds to Congressional Letter FOR IMMEDIATE RELEASE 07 Feb. 2014
Contact:Jeff Hennie, Vice President of Government Relations and Public Affairs CDC Responds to Congressional Letter
The Centers for Disease Control (CDC) have responded to the Congressional letter sent by long time motorcycle advocate and Motorcycle Riders Foundation (MRF) champion Tomas Petri (R-WI). The letter asked the CDC to focus on areas relative to their expertise and not involve themselves in any way with motorcycle safety. Petri was joined by fellow Congressmen Sensenbrenner (RWI), Davis (R-IL), Runyan (R-NJ), Harris (R-MD), Ribble (R-WI), Griffin (R-AR), Walberg (R-MI), Kline (R-MN), Paulsen (R-MN), and Peterson (R-MN). The letter also asked the CDC to leave motorcycle safety to the relevant federal agencies such as National Highway Traffic Safety Administration and the
MASTERLINK MARCH 2014 Department of Transportation.
The CDC response is predictable government product. Motor vehicle crashes are the leading cause of death in the first 30 years of human life and “how the CDC is uniquely positioned as the nation’s public health protection agency to ensure the most current science is available to keep people safe”. According to the CDC 41% of all motorcycle operators who died in 2010 were not wearing a helmet. That means the majority of those who died in 2010 were wearing a helmet. 59% or most of the people who died in 2010 were helmeted, not exactly a ringing endorsement for the life saving ability of helmets.
The CDC goes on to claim “they are addressing motorcycle safety in the same manner as other public health issues, such as heart disease, asthma, and cancer. We define the problem, identify the risk factors, and assess prevention strategies.”
The Motorcycle Riders Foundation feels prevention strategies are the best way to save lives as well, by preventing the crash from ever happening. In multiple conversations between the MRF and the CDC it has been clear that the CDC has no interest in rider education and repeatedly made it clear that rider education programs and motorist motorcycle awareness campaigns play no part in the prevention of crashes. So prevention strategies for the CDC are simply to pass mandatory helmet laws in each state. While ignoring every other proven life saving strategies.
The letter also attempts to insert itself with the other government agencies and how they all need to work together to keep everybody safer.
It is unlikely that we will sway the views of the CDC to a more comprehensive approach to motorcycle safety. Its reasons like this that we as a motorcycle community need to stay involved and united. The MRF thanks ABATE of Wisconsin for their relationship with Congressman Petri through out the years. The part that had me laughing was when the CDC tried to claim that they need to be involved in traffic safety “to ensure that the most current science is available” this is coming from the agency that faxed their response to Petri’s office. IRS The IRS. When you spell it out it turns into theirs. And it really is. The IRS has been unfairly targeting conservative tea party type groups for a few years now, and now its time to punish everybody because the current IRS does not care for the way that some of these groups have been successful in getting out the vote and raising a lot of money. The MRF tax status is what is known as a 501 (c) 4, that is the section of U.S. tax code that defines us. Some of the tea party type groups are also in the (c) 4 grouping. We are what is known as a “social welfare” group.
Although the 501 (c) 4 segment of the nonprofit world is best known for notorious organizations like Karl Rove’s Crossroads GPS. It is actually made up of over 86,000 mostly small organizations nationwide, some of which are almost certainly active participants in our own community’s civic life. They weren’t invented in the last election cycle; they’ve been around for generations. Their purpose isn’t to hide donors; it’s to advance policies. The big, famous guys and the shady newcomers get all the attention, but they aren’t typical of the sector, any more than Justin Bieber reflects the experience of the bulk of the people making a living in the music industry.
This tax status allows us to “be involved in the political process” so long as the primary purpose of an organization is not partisan politics. Under the proposed rules we would be limited to doing work around elections and key votes. A full release on this complicated issue is in the works as well as draft comments for our members to submit. The IRS said in a hearing this past Wednesday that they have received an “unprecedented” number of comments and that the “rules would not be finalized anytime soon”.
Senate Checkpoint Bill I was hoping to be able to give you the details about the Senate motorcycle only checkpoint bill because it was supposed to be dropped this week. Contact:Jeff Hennie, Vice President of Government Relations and Public Affairs The Senate held its first hearing of the year on the highway bill. “MAP-21 Reauthorization: The Economic Importance of Maintaining Federal Investments in our Transportation
Infrastructure” was the title of the hearing but it could have been called “how the heck are we going to pay for this”. The Committee on Environment and Public Works or EPW held the full committee hearing on Wednesday. All of the witness’s had the same sentiment, we need robust investment in the infrastructure and we need it soon.
A real change needs to happen. The way the money is collected now is a true user fee. The gas tax is about 18.5 cents/gallon and goes into the trust fund. That’s the same amount collected in 1993, add to that the fact that fuel purchases peaked in 2007 and have been dropping like a stone since then. Americans are driving less; we have electric and hybrid vehicles that use less fuel.
Congress is reluctant to suggest raising any tax right now let alone the gas tax. In my opinion it’s the easiest way to immediately start raising more cash. Even if electric vehicles don’t pay the tax it’s still the lowest hanging fruit right now. A study in Oregon is underway where they are taking on 200 volunteers to waive the gas tax in exchange for a miles traveled tax. Congress does not want to raise the gas tax because it will directly affect so many Americans who think that gas is already too expensive. One of the main reasons gas has gotten so pricey is because of State taxes on fuel. The aver-
PAGE 15 age state tax on fuel is fifty cents per gallon.
The highway bill is a long way off, think 2015 or 2017, but it should be a good bill if the committee process is respected. Checkpoint bill. Another week another delay. The bill sponsor wants to have more original cosponsors on the bill, but also wants to stay under the radar until the bill is formally introduced. That means I cannot issue a press release asking for sponsors. Rather work with individuals from key states and their senators. If you get a call or email from me, it’s likely about this.
President Obama scored this week with a clean debt limit ceiling increase. The new date is March 2015, exactly as the president had requested. The bill has been used by House conservatives to reduce taxes in the past making it difficult for the Senate to pass matching legislation thus resulting in America’s ability to pay the bills. This bill was “clean” in that it did not have any conditions attached to the debt hike. Also exactly as Obama had ordered. No wrap up next week as its the Presidents Day recess period. Jeff

Do Everything Turn, Turn, Turn... (continued)
The vanishing point is the farthest point where your eyes see the two sides (or edges) of the road “meet. On a tight corner that point will appear close; on a long sweeping curve that point will appear farther away.
Riding toward a curve, bring the bike down in speed. As you ride around the curve, the vanishing point will appear to maintain the same distance ahead of you. Once the vanishing point starts to disappear off into the distance, the curve has opened up once more and you can gradually accelerate away.
Now that ya know the basics for a good turn its important that you practice this as often as possible. Get some friends together and watch each other thru the turns on a ride and compare how you do. Riding safely is what its all about. Reminding your self of good driving habits will ensure you have fun.
And speaking of fun make it a point to remind people of our upcoming events like TBFS! Lets get more members to sign up for our great organization! Turn it on and go!
