ABATE of AZ. 7509 N. 12th St, #200 Phoenix, AZ 85020

Thank you for allowing me to represent you at the Meeting of the Minds in Romulus, Michigan. The MRF always provides great breakout sessions with invaluable information and lively discussion and the opportunity to meet motorcycle activists from around the world.

As of this writing our bill “to alleviate the problem of over heating of Air Cooled engines, heat exhaustion (related to extreme temperatures) and clutching, related to stopped or slow moving traffic on Arizona highways

No matter the topic it always comes down to education. Some states provide rider ed courses at very reasonable prices, but also very limited availability. The reason I bring this up is because in Arizona we have very good motorcycle training schools however the cost may be a deterrent, especially during the current economic situation. The schools are not charging too much, they provide the bikes, riding courses, training on “Motorcycle Rules of the Road” and (of number one importance) trained instructors. They are businesses, not charities, they save lives with education, but they are “for profit”.

ABATE is all about education. We educate the public to “Look Out for Motorcycles”, we try to educate our legislators to pass motorcycle friendly legislation, we even educate our members on motorcycle safety. We don’t provide rider training. There are a lim-

ited number of riding schools, but as I’ve recently noticed, they’ve also been offering specials on some classes. Perhaps ABATE can look into the possibility of offering a limited number of “financial aid scholarships” for new or experienced riders. Eligibilty criteria would have to be determined and since this whole thought came to me suddenly, (it hasn’t been discussed with the Board) please take it a “brainstorming”.

If you’ve been watching the news lately it seems that more people are using their motorcycles as their main means of transportation. This inevitably translates to an increased number of motorcycle crashes. Education on “defensive” riding, traffic awareness and emergency maneuvering can only help save lives. Please be aware, never trust the next guy, ride defensively! Ride Safe,

Hope this month’s paper finds everyone healthy, wealthy and wise, lol, if not, just plan old safe and happy will work for me.

I am constantly going on about how the cagers etc. need to watch out for us, which they do need to do, but it's that time of the year when we too, must look out for ourselves. The weather is changing not only daily but hourly almost. So what the heck am I getting at? Ok I will keep it short and simple this month.

What I am getting at is, take a couple of minutes before you get on your bike and check your bike out. Check your tires, with the changing weather the roads as well as your tires change, make

sure they have enough or not too much air in them. Check your fluids, that goes for your bodily fluids as well. Remember even if you don't feel the heat quite as much, you still don't want to dehydrate. Another thing you should keep in mind is when it might be hot here as you go up north it gets very cold, so dress or pack appropriately. Ok so that's it for this month.

Ride safe and watch out for the people not watching out for you!

Mohave Chapter

Hi Everyone,

Since the last report, not much has changed as far as getting Mohave Chapter members to participate and help fill open officer positions. However I did receive some uplifting news from the Red Iron Brotherhood MC. They are going to try and get their members to join as well as members from other MC's in our county. That would be the boost we need to keep this chapter solvent.

Our gun raffle on the 1st of October went off great. Thank you to all that bought tickets and participated. Thanks also go out to Cathie'z Leathers for all their support and the gifts they provided as well as the BHC Moose Lodge and Moose Riders who helped sell tickets. Although we didn't make as much as we would have liked, we did manage to recover the cost of the gun plus a bit extra. Lets hope by next month I can report that the Mohave County Chapter is up and running strong.

Again, I'm asking our members to come out and get involved. We need your help. Ride safe, Joe Monfredo Coordinator/ Mohave Chapter

Phoenix/Shadow Mountain Chapter

Happy Halloween!

We had a smaller turn out this month then usual, But it was a great meeting, I am sure that those who weren’t there are just planning for the MOON MULLINS RUN. That is right, this year we are shak’n things up - the end stop is at a haunted house.

VOTE VOTE VOTE VOTE. Reminder: VOTE

Officers election next meeting, there is still time to nominate the 2012 Chapter Officers. To clear up a question regarding taking office, you must be a member for one year, then you are eligible to be a Chapter Officer, to be a State Officer you need to complete the above.

It’s perfect riding weather, check your ride before you go, it’s a bummer waiting for repair when all you want to do is RIDE. Short and Sweet this month, Until November…

Our last meeting was held at our usual spot at the Kettle Restaurant on Starr Pass Blvd. As usual many members came early for the excellent food from our host Sam and Staff.

The meeting called to order by Don Boule at 9 am. Pledge of Allegiance was led by Don Boule with a moment of silence for Rich Montgomery and our brothers and sisters who have been lost this year.

Our secretary Rich is still in Idaho recovering from his motorcycle accident. The reading of the minutes for the last meeting was waived.

MASTERLINK OCTOBER 2011

Gina Stanfil won the 50/50 for $5.50 and donated it back to the chapter. Tommy Rollins won the dollar jar but was not present. Tommy and his wife are usually present at all of our meetings. As always the money rolls over to the next meeting. We had a $25 gas card donated by Ron. The gas card was one by Dawn Detlj. Congrats on winning a couple tanks of gas.

Remember if you bring a raffle prize to the meeting you will receive an extra raffle / 50/50 ticket. The meeting was short due to a lack of officers.

Coordinator Ron is still around but has had conflicts due to state officer duties. Ron hopes to chair the December meeting.

Secretary Rich is making progress. He is pretty much off of the ventilator though still has some assistance with his breathing. Many members have asked if I know what happened exactly. Al I know is it was gravel related. I don’t know if it was in a corner or not. We also don’t know the type or condition of the road. Here’s something to think about while driving in town. If you travel a little faster than other vehicles you will always be in someone’s “blind spot”. You may want to ride a little slower than traffic or the same speed but not in a blind spot. Our next meeting is November 19th at the Kettle. Meeting adjourned at 10:50 am.

Yavapai Chapter

Indian Gardens, where the riders took the chill off with some fresh hot apple cider and coffee. The next destination as Grand Canyon HD where Kyle and his crew provided lunch and thank goodness some more hot coffee. A big thanks to GCHD provided some excellent hospitality (On a personal note another big thanks to Jim, Larry and Stubby at the Mayer GCHD for getting my Road King ready to ride). The ride went back to Jerome and the legendary Spirit Room. Combo Deluxe provided some great music, and some still had the energy to do some serious dancing. McDonald and he crew had our group laughing, dancing and fun was had by all. Don Johnson won the high hand and Ed Lee the low hand. Both won a cool $50.00. The run covered 250 miles of some of the most beautiful country in Arizona, or even America.

Our meeting was held on October 9th at Taj Majal. Our members were encouraged to participate in the upcoming elections for ABATE state officers in November. Longhair James is organizing a ride to the meeting to further encourage our members to participate and get involved in state level freedom fighting. Ralo reported on her, Deb’s and Longhair James trip to Meeting of Minds. She came back from the meeting with a lot of great ideas for our chapter. Also at the meeting in Michigan, Stillray accepted an honor for the ACMC, a Sustaining Member award. In addition, Waldo’s daughter, Charity Stewart got an award for Rider activism and Education. Way to go Charity. We know Waldo is looking down with a very proud smile! Ride free, But aware,

Our chapter’s Oak Creek Run started out pretty chilly at 31 degrees, but turned out to be a very good ride. Thanks to Phoenix riders, Linda and Bob for braving some early coldness in Northern Arizona. The ride started at Bobby D’s in Jerome with a first stop at Garland’s

NO REPORT

We now have 133 active members and 6 business members. If we each signed up one new member our roster would double

Sean had emailed his pac report. We had discussion about the required minimum three second yellow. Sean reminds us that the best motorcycle awareness is to ride and ride often. The more motorcycles a cager sees the more they will look for them. We are still seeking chapter officer nominations. Those wanting to assist by taking an officer position may be nominated at the November meeting. We will have the elections in November. All positions are open.

Since we now meet the third Saturday we will meet in December this year.

ABATE of Arizona has an insurance policy for all members in effect. This accidental death or dismemberment and was increased $2500. That is pretty cheap insurance for $25 a year($15 for charter members). It does seem that our attendance is down whenever we don’t send the reminder post cards. Please mark your calendars. It’s the third Saturday every month.

Our next Celebrate with ABATE Run will be March 26th, 20ll. We are still seeking a run coordinator. After the November elections we will have to get at least enough info to post online and in biker magazines. We had ballots available to vote for state officers and bylaw amendments for the general membership meeting in November. Members may also mail in their ballot from the Masterlink or vote in person at the general meeting. The general membership meeting is Sunday November 6th at Kid Cheleen’s in Black Canyon City north of Phoenix.

MASTERLINK OCTOBER 2011

Hello to all my Brothers and Sisters;

Last month I attended the Meeting of the minds motorcycle conference which was held in Romulus Michigan. I want to give a big thank you to ABATE of Michigan for their hospitality. Also for a very appreciated Hospitality Room.

What a great conference. Ran into many old friends and made some new friends from all over the United States. The great thing about this conference is once we get talking we discover we have many of the same issues which we are dealing with. Thursday night was Meet the MRF Board. Each board member introduces him or herself and a brief description of their duties with Motorcycle Riders Foundation. After the BOD introductions there is an opportunity for attendees to introduce themselves and what MRF or Club they are affiliated with. Also give a brief description of what has been, and is currently being accomplished in their State.

On the Federal front, a couple years ago I, as ABATE of Az. President and Carole O’Reilly, ABATE of Az. Authorized Lobbyist were invited by the MRF State Rep Deb Buttita to attend a meeting at a local auto repair facility, here in Phoenix. The purpose of the meeting was to give information to Senator Jon Kyls’

by Rod Taylor - ABATE Legal Services

How to Play Russian Roulette Or Make A Quarter Million Dollars--just read and do this:

Do you like to play Russian Roulette? How about for $100 bucks a year? Doesn’t seem worth it, does it? But that’s what you’re doing if you don’t buy uninsured/underinsured motorist coverage for your motorcycle, car, or truck insurance policy. Studies indicate that more than 14 out of a 100 drivers do not carry any sort of coverage. And those that do have minimal limits that effectively provide no coverage (It is a joke for the adverse driver to say he has $25k of insurance coverage when your losses are approaching $500k. Let’s say you’re going for a summer ride. Remember the blue-hair you saw driving that 1979 Buick Electra? She hasn’t had insurance since 1980, and she’s going to run into you. What can you do to get the bike fixed, not to mention paying your medical bills? How about mortgage or rent payments and your living expenses? If you do not have

PAC Report

Assistant, regarding the Right To Repair Act HR1449. Deb, Carole and I, along with representatives from auto and motorcycle aftermarket manufactures, and repair shops attended the meeting. Right to Repair Act is still floating around somewhere in Congressional cyber space. No official action has been taken like passing legislation to prevent corporations and manufactures from not sharing software and repair manuals to smaller repair shops. The good news is over the past couple years, much of the needed software, current repair manuals and other information that was not available has become available to almost all repair facilities.

Motorcycle Only Check Points and the Fourth Amendment. This is an area which we all should be very concerned over. The bottom line is that when it comes to discrimination, it is illegal to discriminate against a protected class under the Fourth Amendment. The government cannot discriminate based upon race, religion, etc. It is not illegal to discriminate due to the clothes a person is wearing or the vehicle he or she operates. In short, motorcyclists are not a protected class for the purpose of the Equal Protection Clause. (This is a case where you probably hate the message but don’t take it out on the messenger (me). We as a Motorcycle Rights Organization need to continue to fight all efforts put forward by law enforcement regarding, “motorcycle only check points” Individual States all over the Country are having to deal with these check points.

If anyone encounters a Motorcycle Only Check Point be polite and courteous. If possible obtain the officers name and badge number. You may or may not receive a ticket. If you do the date and time will appear on the ticket. If you don’t record the time, date how may officers were present, along with names

Ask Our Lawyer UM/UIM coverage, you are screwed.

Your parachute is uninsured/underinsured motorist coverages. Most people who don’t have insurance don’t because they think they can’t afford it or don’t want to pay for it. In other words, they do not have any money. The odds of them having sufficient resources to pay off a personal injury claim are slim and none. Without coverage of your own, there’s no compensation. You might be able to get a 1979 Buick Electra, but that doesn’t pay the bills.

If you don’t have uninsured motorist/underinsured motorist coverages (UM/UIM coverage), you are underinsured. If you carry the legal minimum coverage, you are in compliance with the law, but still woefully underinsured. Unfortunately, “state minimum” coverage only protects the other guy, not you. And when was the last time you heard of a motorcyclist that caused personal injury to the driver of a Mack truck or a minivan for that matter? Where you made the mistake was in declining the uninsured motorist/underinsured motorist coverages (UM/UIM coverage.) And you have to

PAGE 9 and/or their car numbers. Get as much information as possible, for later use. Everyone in your group should send a Freedom of Information Act letter to the jurisdiction(s) that conducted the stop. Send the letter to Chief of that Police Department and request the operating plan for the check point. Identify the checkpoint by date, time and location. Specifically ask for the following information. (1) Who created the plan? (2) What was the duration of the Check Point? (3) Who were the officers involved? (4) How was it determined which vehicles would be stopped? (5) How many and what type of citations were issued? (6) What was the purpose of the check point?

You as a rider / passenger can do this for free. After receiving the requested Freedom Of Information Act information now would be the time to Contact ABATE of Arizona’s’ Designated Lobbyist or an attorney for further guidance with your case. FOIA forms are available on the web.

This year at Meeting of the Minds we had a live demonstration on Proper Breaking Techniques, which was held outside in the parking lot. Congratulations to Charity Stewart on being awarded the MRF’s Young Activist Scholarship Fund Award. Also for those of you that are keeping score on the Bibs VS Kilts. The Bibs won.

Until next month

affirmatively do that. The law puts it on your shoulders to say no. Why would you do that? Well, my guess is that you wanted to save a few bucks, and figured that since the law required everyone to have coverage, you didn’t need to pay for additional coverages. Bad decision based on bad facts. Unfortunately, not everybody complies with the financial responsibility laws. Some people simply never get insurance and give a bogus policy number when the register their cars. Others may have coverage, but they cancel it after getting the car registered. Our laws our weak in that it allows scofflaws to pull a fast one. That means you are left holding the bag when you get injured in an accident with a near-do-well.

You ask, but how would that get the bike fixed? Simple. Remember that even if you have medical insurance that will cover your medical bills, you would still be entitled to compensation for your lost wages, impairment and pain and suffering. That’s YOUR money, to spend or pay bills as you please. If you want to fix your bike, you can.

Don’t forget that when you get your insurance that you may be asked if you want to have your UM/UIM coverage at the same limits as your own personal injury coverage. For example, you can have liability coverage of $50,000/$100,000 (that $50,000 per person and $100,000 total per accident) and have UM/UIM coverage in the same amount, or elect to have only $25,000/$50,000 UM/UIM coverage. The cost difference is very small, and

CONGRESSMAN CHALLENGES THE SCIENCE OF E15 GAS

U.S. Representative Jim Sensenbrenner (R-WI) has introduced legislation to require the Environmental Protection Agency to “seek independent scientific analysis on the effects of 15 percent blend ethanol gasoline” (E15), which the EPA recently allowed to be sold for use in 2001 or newer vehicles; though motorcycles and ATVs are not approved for its use, nor are most small air-cooled engines, and using the hotter-burning fuel could cause premature wear, engine damage and void the manufacturer’s warranty.

"The EPA's decision to allow E15 into the marketplace will impact every American who owns a car, lawnmower, or boat,” said Sensenbrenner in announcing his bill, H.R.3199. “Automakers insist that using E15 will void warranties, lower fuel efficiency, and cause premature engine failure. In off-road engines, the effects can even be dangerous for users.” Motorcyclists should be concerned about the availability of compatible fuel supplies if gas stations primarily provide E15 gasoline that’s EPA-approved for the majority of their customers -- but no on- or off-road motorcycles or ATVs appear on the EPA’s list of vehicles approved for use of E15. "There are serious concerns that the EPA used only one Department of Energy test and rushed E15's introduction into the market place. This test was limited in scope and ignored a plethora of evidence albeit inconvenient evidence for the EPA that shows E15 gasoline has a negative effect on engines,” according to Sensenbrenner. “I introduced this legislation to ensure a decision of this magnitude will be vetted by independent scientific research, rather than political expediency." Earlier this summer, Congressman Sensenbrenner, who is the Vice Chair of the House Committee on Science, introduced H.R. 748 to prohibit the EPA from authorizing the use of gasoline containing greater than 10% ethanol (E10). BIKERS’ RIGHTS TO HEALTH CARE

Akin to some Unions that have negotiated lower health care costs by excluding insurance coverage for so-called “risky” behavior such as horseback riding, skiing and riding motorcycles, the state of Georgia may soon exclude motorcyclists from their healthcare benefits.

The chairman of a House study committee looking at Georgia's health benefit plan said the state might require employees to disclose dangerous activities like skydiving and riding motorcycles.

State Rep. Carl Rogers (R-Gainesville) said that the panel is looking to bring down skyrocketing costs in the state health plan. Earlier this year, lawmakers were forced to scramble to fill a $300 million budget hole for the health benefits.

Rogers told the Associated Press that state employees who take part in risky activities might eventually pay higher premiums.

TRUE COLORS: COPS VS. BIKERS

“Nowadays, officers also have to worry

Coast to Coast

about lawsuits when they pull over a ‘onepercenter’,” reported the Philadelphia Daily News in response to a civil rights lawsuit claiming profiling and police harassment, adding that “Biker gangs might have a well-deserved reputation, but one local attorney who represents several clubs says that ‘reputation’ isn't a valid reason for a traffic stop.” "Some of this tension between the cops and the bikers is because the cops hassle them ALL the time," said Aid to Injured Motorcyclists (A.I.M.) Attorney Boyd Spencer, who represents the Eastern Pennsylvania Confederation of Clubs.

Spencer is representing three bikers in a civil-rights lawsuit stemming from a July 30, 2009, traffic stop involving six motorcyclists, two of the defendants are Pagan’s M/C members and a third defendant was a Tribe M/C member.

According to the complaint, the bikers were ticketed for not having approved helmets and were told to remove their "colors", the patched jackets members wear. The whole traffic stop, which lasted more than an hour, was captured by mounted cameras in the police cruisers. "Now you're all going to take your jackets off, because on this highway, these are the only colors," one of the state troopers, referring to State Police blue and gold, told the group after nearly 50 minutes had passed.

The bikers didn't budge. None of them took off his colors. The helmets were later found to be legal, and a prosecutor dismissed the charges. Spencer, who said the demand to take off their colors was out of bounds, chalks up the traffic stop to harassment. Spencer said he always hears about bikers getting harassed. "I've got a guy in Upper Darby who gets pulled over every time he goes out on his bike," he said. Upper Darby police Superintendent Michael Chitwood Sr. told the newspaper that bikers get pulled over if they break traffic laws, like anyone else. Police keep tabs on them, though. "These operations have become very sophisticated. They know what their rights are and what the police can do," he said.

“NO COLORS” RULE RESCINDED AT KENTUCKY EVENT

Following failed negotiations with Beech Bend Park near Bowling Green, Kentucky upon announcing they would no longer allow club colors of any kind at their All Harley Drags, the Kentucky Motorcycle Association/KBA called for a boycott of their events until this discriminatory policy was changed.

“After the word went out it is my understanding that several hundred phone calls went to the offices of Beech Bend Park,” said Jay Huber, President of KMA/KBA. “As a result of those calls the management at Beech Bend has reversed its decision regarding NO COLORS at its events.”

“The KMA/KBA along with the Kentucky Confederation of Clubs is committed to eliminating this type of discrimination as it hurts the entire biker community,” said Huber, adding that his organization will post listings on their website of businesses that discriminate with regard to No-Colors and urge “that ALL bikers please refrain from using the services of any business that participates in this type of action.”

SUIT CHARGES DISCRIMINATORY ENFORCEMENT OF NEVADA HELMET LAW

A dozen motorcycle riders recently filed a class action lawsuit charging arbitrary and discriminatory enforcement of Nevada’s helmet law.

The suit filed in U.S. District Court charges "defendants, through their agents, have an ongoing pattern and practice of issuing helmet tickets to the class members that are not supported by constitutionally sufficient probable cause, thereby violating the civil rights of the class members." The action blames Clark County and the cities of Las Vegas, North Las Vegas, Henderson and Mesquite; and Boulder City, and their police departments for the disparity in enforcement, and if certified as a class the suit could represent more than 40,000 motorcycle riders in the county. The group is hoping to ultimately win the repeal of Nevada's helmet law, but this lawsuit is not about whether the government has the right to require motorcycle riders to wear helmets, which the Nevada Supreme Court ruled that it does, but instead the action accuses local police and prosecutors of selectively enforcing the helmet law and of using it unconstitutionally to hassle bikers.

“This violates the Fourth Amendment to the U.S. Constitution barring unreasonable search and seizure,” commented A.I.M. (Aid to Injured Motorcyclists) Attorney Sam Hochberg in The Gunny’s Sack monthly e-column. “The suit also alleges violations of the 14th Amendment protections against arbitrary and discriminatory enforcement. They are saying the fines are all over the map with no balance. The suit essentially says that law enforcement folks are using the Nevada helmet law to harass motorcyclists.” Dubbed the Class M class action, the suit seeks to include some 40,000 Nevadans holding motorcycle endorsements on their driver's licenses.

NATIONWIDE MOTORCYCLE THEFTS DOWN A motorcycle is stolen every 9.5 minutes in America, but according to a report by the National Insurance Crime Bureau, motorcycle thefts last year were down 24% from their 2007 total. There were 65,678 motorcycles reported stolen in 2007 compared with 49,791 in 2010, according to data from theft reports contained in the National Crime Information Center.

The top five makes stolen last year were: (1) Honda, 12,260; (2) Yamaha, 9,853; (3) Suzuki, 7,869; (4) Kawasaki, 5,470; and (5) Harley-Davidson, 3,301. Combined, these five brands accounted for 38,753 thefts in 2010, or 77.8 percent of the total.

The top five states with the most motorcycle thefts in 2010 were: (1) California, 5,662; (2) Texas, 4,394; (3) Florida, 4,148; (4) North Carolina, 2,649; and (5) Indiana, 1,925. These five states accounted for 18,778 thefts, or 37.7% of the total. FACT OR FICTION: MOTORCYCLES ARE ECO-FRIENDLY

In the popular belief that since motorcycles get better mileage they must be greener than cars, "People are trading in their cars and driving motorcycles instead because they believe that's the more environmentally friendly choice," said “MythBusters” television host Adam

MASTERLINK OCTOBER 2011

Savage in the season opener of the popular Discovery Channel show. "The logic is because motorcycles are generally more fuel-efficient than cars, they burn less gas and thus they must be better for the environment."

As the MythBusters have done with each of the show's previous seven seasons, Savage and his co-host Jamie Hyneman set out to test the theory, and the Los Angeles Times recently reported on the show’s findings.

The MythBusters duo selected three motorcycles and three cars that were common in the 1980s, 1990s and 2000s and put the undisclosed vehicles through a 30minute, 20-mile real-world course, 75% of it consisting of highway driving and 25% city driving.

Savage drove all three cars while Hyneman trailed him on the bikes, each one equipped with portable emissionmeasuring systems that tracked exhaust gases from a probe in the tailpipe and collected engine information from the engine control unit to determine each vehicle’s fuel economy and emissions profile.

The upshot of the experiment was that the newer two-wheeler was indeed 28% more fuel efficient than the comparable car and emitted 30% less of the greenhouse gas carbon dioxide, however the same motorcycle emitted 416% more smog-forming hydrocarbons, 3,220% more oxides of nitrogen and 8,065% more of the toxic air pollutant carbon monoxide.

The MythBusters' conclusion: "At best, it's a wash. Motorcycles are just as bad for the environment as cars," Savage said on the show. "At worst, they're far worse."

But emissions are only one factor in the equation that measures a vehicle's true impact on the environment, and as LA Times columnist Susan Carpenter concludes; “Despite the MythBusters' findings, emissions are only part of the story of a vehicle's true greenness. According to the Motorcycle Industry Council, motorcycle manufacturing requires thousands fewer pounds of raw materials than automobiles. They require less fossil fuel, so they require less energy to pull that fossil fuel out of the ground. They use fewer chemicals and oils than cars. And motorcycles produced today are 90% cleaner in California than they were 30 years ago. Note to MythBusters: How about a cradleto-grave life cycle assessment for cars and motorcycles for the Season 9 opener?”

WEIRD NEWS: MOTORBIKERS TAKE BITE OUT OF APPLE

Just like in the movies, seven motorbike riders carrying passengers wearing full face helmets recently conducted an earlymorning “smash-and-grab” robbery by busting a window of an Apple Store in central London and plundering thousands of dollars in Mac laptops, iPads and iPhones. “Apple is a big ticket item and a very easy sell,” deputy inspector Gregory Antonsen told the International Business Times, calling this one “primarily an Apple case”. the added coverage you would have is immense. The best advise is to have the highest limits (both liability and UM/UIM) that you can afford. The reason for this two-fold. One, higher limits protect your assets (your house, car, boat, vacation cabin, bike, etc.) if you get sued after an accident. Two, higher UM/UIM protects you if you get injured in accident, even if the other guy carries minimum coverage. Let’s say you get injured in an accident that is the other guy’s fault. You have damages from the accident (medical bills, bike repairs, and pain and suffering) of $200,000.00. The other guys has basic coverage,

$25,000/$50,000. His insurance coverage pays you the $25,000.00, leaving you with $175,000.00 of uncompensated damages. You can make a claim for the additional damages from your carrier under your UM/UIM coverage. However, you can only make a claim for coverage to the extent that your UM/UIM coverage exceeds the other guys basic coverage. For example, if you have $25,000/$50,000 UM/UIM coverage, then you can’t make a claim because your coverage doesn’t exceed his coverage. If you have $50,000/$100,000, you can claim $25,000 of coverage from your UM/UIM coverage. The higher your cov-

I have often wondered how does one determine when they are too old to drive? Whether it’s by car or a bike, I assume that it’s a like the last link to independence. I remember the day I knew my grandmother shouldn’t drive anymore, Eric Hampton Masterlink Editor

For most people that attend the Motorcycle Riders Foundation’s (MRF) Meeting of the Minds, it is three days of making new friends and revisiting old friends from all around the country, attending workshops and if they’re lucky, taking a ride around the hosting city for a bit of sightseeing. For me, it’s a bit more like a job than a vacation.

Being on the Board of Directors for the MRF, I am required to arrive in the host city two days in advance of all the real festivities. Darla & I usually arrive on a Tuesday night so that we don’t have to fly the red-eye. We’re required to attend Committee meetings that are held throughout the day on Wednesday. I’m the Chair of the Communications Committee and also help on the Membership Committee and an award committee. Darla serves on four committees and is an Assistant to the Membership Director, John Pierce.

Then, when all the committee meetings wrap up sometime Wednesday evening, everyone gathers to blow off some steam. This will be the only real opportunity for us to just relax and enjoy ourselves and shoot the breeze. Thursday morning, it’s ‘rise and shine’ before the sun comes up. The all-day, marathon board meeting begins at 8 am, so it is a scramble to get showered,

There is no excuse for ANYONE to decline UM/UIM coverage. It can be your resource of last resort. Don’t be caught on the wrong side of being injured - protect yourself and your bike, and carry UM/UIM coverage. You can’t afford to play Russian Roulette – not for a hundred dollars.

Remember, injured ABATE members pay only 28 ½% of total recovery and expenses as approved by client, consistent with and conforming to applicable state law. Elsewhere, you may pay 33 ⅓%, 40% or

erage is, the better your protection is.

Get this, I took her to the MVD to get an ID card, they told me she could just renew her drivers license! I thought, oh hell no, not another one of those too slow drivers sitting on a phone book, holding the steering wheel for support and have no clue where they are going. I explained that she had mild Alzheimer’s, the MVD agent replied “that’s ok she just has to pass the eye test”. Honestly, that is what she said. In our meetings we talk about a lot of what is going on and what can we do to

change it, with that being said, there are very few questions about motorcycles on the MVD drivers’ exam. What, I had to go to a motorcycle training class, pass a written test, and a riding test just to get a motorcycle license. Since I got my license, I see the craziest stuff those cage drivers do while driving (probably myself included). Maybe that is what got me more involved in ABATE - just a member at first - but I figured I could be of use as an officer. Currently, I have had the luxury of caretaking my mom with moderate Alzheimer’s. She is a flight risk, she had her keys hidden in her purse, she got pissed. She was gone. She had no problem remembering how to get home, when my daughter caught up to her she was changing lanes like a pro. That’s what the first time, second time she STOLE the keys, yes that is right. She has turned into being a feisty and sneaky gal. Ever call 911? Yikes! My dad-eight weeks in the hospital, on the ride home his only con-

dressed, tanked on coffee and a quick bite for breakfast. Even before I cut off all my hair, (I got tired of using six rubber bands to hold back 10 strands of hair) I could be ready to go anywhere in under half an hour. But, now that I’m married… well, I won’t say anything else about that if I know what’s good for me.

So, anyway, the Board meeting begins at 8am. With pitifully few breaks during the day, we work through our lunch and finally emerge from the room around 5:30 that afternoon. An exhausting 9 ½ hours, enhanced by – usually – jet lag. That gives us a full hour and a half to wind down, get dinner and be ready to go again by 7pm.

At 7:00, on the first night of Meeting of the Minds is always ‘Meet the Board’. The members of the Board pass the microphone rather quickly down the line, introduce ourselves and explain where we’re from and what we do there and the office that we hold on the MRF Board. After that, the mic gets passed around the room and representatives from (this time) 35 states get 5-10 minutes to share with everyone what they are working on and concerned by in their home state. As you might imagine, some people like to talk. And talk. And talk. This part of the evening used to go on for over four hours. Thankfully, they recently brought in a timer/buzzer to keep folks from rambling on, but even with the buzzer, it is a long evening. After that, it’s up to the hospitality room for beverages and munchies and of

course, hooking up with friends that we haven’t seen in - too long. Even though most of the conversations are still ‘shop talk’ about motorcycle-only roadblocks or noise laws or any number of other things, that is the most enjoyable part of the weekend. Since I’m the newsletter guy for the MRF, I’m the one stuck lugging around the camera all weekend. It didn’t take long for me to realize that if I don’t take pictures, I’m not likely to get many to run in the paper. Lucky for me, the wife is a camera nut and enjoys taking over for me at times. Friday morning, it all begins again.

The color guard escorts our flag into the silenced room, and we pay homage to the stars and stripes and remember those riders that we have lost over the past year. Shortly thereafter, Hardtail, the MRF President, delivers his “State of the MRF” speech and gets everyone fired up for the weekend. Then it’s Jeff Hennie’s turn. He is the MRF’s paid lobbyist in Washington, D.C. He gives everyone a rundown on the lunacy that happens there and how it affects bikers across the country. After that, we all enjoyed a free lunch provided by Harley-Davidson. I, for one, am thankful that the hotel makes the sandwiches, and not the guys in the factory… they make good bikes, but I’m not sure how their cooking skills are. I picture sardines and hogs head cheese on toast.

cern was when he would be strong enough to drive! This man has no business behind the wheel, trust me on that. But he has a license.

So how old is to old to drive? Well, left to the MVD, as long as they are breathing, pass an eye test and can write a check they are old enough to drive. Of course, very few elderly admit that they shouldn’t be driving (in my experience).

It is up to us, it’s the family or caretaker that has to tell them and take away their license, get them an ID card instead. Get the keys! Prepare for mass resistance, but someone has to make this decision for them, like I told my parents “it’s because I love you and I said so”. The glory in that a “priceless.” That is truly the moment I knew…

They are way TOO OLD TO BE driving.

Afterwards, the workshops begin.

Serving on the Board of the MRF, I am sometimes ‘volunteered’ to present one of these workshops. I love Carol, our Conference Director, to death - but it never ceases to amaze me when I find out three weeks before a conference that I’m presenting a workshop that I haven’t even put together yet. Good thing that I can think on my feet.

Some of the workshops this year included “What Are Your Rights in a Traffic Stop?”, “Motorcycle-Only Checkpoints and the Fourth Amendment”, “Accessing Public TV”, “A Biker’s View of the US Constitution”, ”Overview of the Advanced Rider Course” and “Sportbike Riders: Bridging the Gap”.

These workshops and others were divided between Friday and Saturday afternoon. Definitely some valuable information there, free for the taking. The workshops are really kind of the focal point of the conference and are very well attended by all.

Friday evening is the MRFPAC fundraiser. The MRFPAC accepts donations from MRF members and makes donations to federal election candidates who champion the issues relating to motorcycles. In other words, they give money to bikerfriendly US Reps and US Senators. For the past six or seven years, this fundraiser has been the Kilts vs. the Bibs tug o’ war. Nothing like seeing a bunch of burly bikers in kilts battling with an equally burly bunch of bikers in overalls. This year, the

Kilts just didn’t have enough weight on their end of the rope and went down 0-2 out of three. Later that evening, in the ballroom, carnival games continued the festivities raising money for the PAC.

Early Saturday morning, we scrambled again to get showers, coffee and breakfast in time to catch the presentations from Europe & Canada. Whether you know it or not, Europe has some of the most smothering regulations on motorcyclists in the world. Unfortunately, our lawmakers and the EPA watch them closely and

Deborah Butitta Board of Director Chairman Motorcycle Riders Foundation Awareness & Education Inc. deb@mrfae.org ==========

Hello, my name is Charity Stuart, age 24. I was born into the motorcycling community with a single father, bound to a wheelchair; he rode a Harley with a sidecar. Born in Michigan but moved to Arizona when I was five, so my dad could study at Motorcycle Mechanics Institute and ride in all seasons. Our humble beginnings started.

MASTERLINK OCTOBER 2011

He and I became actively involved in ABATE, MMA and the ACMC of Arizona the minute tire touched Arizona desert. He was a gifted writer and contributed to every motorcycle publication available; this allowed us our active lifestyle in the motorcycle community. At the age of six, I was the youngest member to have joined ABATE of Arizona, as part of Phoenix chapter. To this date I still hold the record for youngest officer in the state, Dad and I held office as state and chapter communications officers. Also, I have received awards for

what happens overseas, soon makes it to our shores. It’s a good practice to pay attention to our brother bikers in Europe so that we can anticipate the next idiotic thing that our federal lawmakers try to lay on us.

After another afternoon of workshops, it’s finally time to catch your breath, have a cocktail and shoot the breeze for a couple of hours. Saturday night consists of a banquet in the ballroom and a silent and live auction

to raise money for the MRF. The MRF doesn’t receive any federal funds to operate and depends entirely on our State Motorcycle Rights Organizations (SMROs) to keep the door open to our office in DC. These auctions go a long way to keep that going too.

So, this whole time, Darla & I are lugging around that damn camera, shooting pictures of everything and everyone – even at the banquet when everyone else is eating and drinking.

The MRF’s Young Activist for 2011 recruiting the highest number of new members in that time period in membership drives. Furthermore, I am a charter member of Shadow Mountain chapter. I believe we started with 9

members and grew fast when word spread of our lively bunch. In 2010, the chapter was merged with Phoenix

to strengthen the force now called Phoenix/Shadow Mtn Chapter. Dad and I, as a team, also worked for Aid to Injured Motorcyclists (AIM) under Joe Eggleston where we also took

part in NCOM Activities and was very grateful to be awarded the Silver Spoke award for promoting the image of motorcycling about 10 years ago.

Due to the fact my Dad was bound to a wheelchair, he needed me. We went absolutely everywhere, did every-

thing, and met everyone together. He and I had an unbreakable bond to each other, and our fellow bikers. Those people (bikers) I now call family that I have watched and learned

When the banquet is finally over and the event is winding down, we look at each other and realize that we need to get back home and back to work to get some rest. Sure, going to these conferences is a lot of fun and we get to catch up with old friends, but it is also a lot of hard work. But, in the end, there is nothing that I’d rather be doing.

from, they have helped me become who I am today. Many of them and I are affected by the rights we are fighting for today. Having such a close relationship with these people fuels my passion to fight that much harder as legislators come up with new ways to word upcoming rules or regulations regarding our way of life.

Unfortunately, my dad passed away in May of 2007. How I cope with his loss is to carry on with what we loved most in life. The freedom to ride, to wherever and the way we want to. My feeling of loss is very great, everyday it helps to ride and carry on with our fellow beloved bikers supporting AZ's MRO's and their causes. My beautiful baby boy was born a very short 2 months after my dad died, now almost 4. My son already shares our love for motorcycles and people. I hope to show him all that my Daddy has shown me. Sadly, I am not gifted with my dad's journalistic abilities that allowed him to involve motorcycling with being the breadwinner. Currently I am In the US Air Force working 1 weekend a month in the Air National Guard as a Jet Engine Technician, part time at Paradise Valley Community College as a Public Safety officer and lastly, I attend classes there where I'm only 4 classes away from my furthering my education with an associate's degree.

To wrap up, I feel I deserve this scholarship because of my steadfast allegiance to my community’s MRO's and their causes, my proactive and passionate attitude toward motorcyclist rights and education. I feel very lucky to have been given this lifestyle; it is my goal to continue to share my experience and knowledge with those who ride and may not know what they are missing.

MASTERLINK OCTOBER 2011

Hamstertime

Good Morning America. This months column is dedicated to every American Veteran who has ever served in our country's Military, God Bless You ! Towards the end of last month, Aurora Indiana had an unusual visitor docked along the banks of the Ohio River. Seeing a ship on the Ohio River is rare but a WW-2 era LST is like looking at an aircraft carrier in a fishing pond. It looked enormous ! At 328 feet long and 50 feet wide, she turned a lot of heads to folks traveling along Rt. 56. The very last remaining LST-1 Class Landing Ship Tank.

This LST is an amphibious vessel designed to land battle-ready tanks and supplies directly onto enemy shores. Ships of this type proved to be enormously useful during times of war and peace both. This particular LST was originally known as LST325 during the second world war. Out of 1051 of these ships, she is the only one left but what an illustrious history she had. Including participation in the D-Day invasion of Normandy during WW-2, She also saw action in North Africa and Sicily . I toured the ship on it's finial day in town and was really impressed by not only the ship itself but also by the dedication of the countless volunteers who man the ship and answer any questions about her. I was struck

by two things in particular; First was the berthing compartments . That is the area in the ship where the men slept. It's a hot, cramped, tight, non air conditioned area with almost no ventilation. A place where up to 300 men slept for months at a time while at sea.

You could almost smell the stench of sweat, still there after 67 years. Looking at those racks (racks are military terms for beds) stacked about 18 inches between each other, you get a real grasp on the sacrifice and hardship these men endured. The men who sailed LST-325 were tough dedicated warriors who helped the ship earn 2 battle stars during WW2. The second thing that struck me about the ship was the massive steel doors you entered the ship through. On December 6th. 1944 , these 2 doors opened to a beach where the water ran red with the blood of a lot of fallen heroes. A very real " hell on earth" . If you have ever seen the beginning scenes of the excellent movie "Saving Private Ryan" staring Tom Hanks, you will have a pretty good idea about how tough this ship and her crew were. If you have never seen this film do yourself a favor a see it. It is, in my humble opinion, the best war movie ever made. But back to the ship.

Hamstertime (continued)

In 1964 LST-325 was transferred to the Greek Navy where she served for another 30 years. She was acquired in 2000 by the USS LST Memorial Inc. and in 2000 she sailed from Greece in December of that same year setting a course for Mobile Al., she arrived 10 January 2001 at Mobile. Manned by 29 members of USS LST325 who average age was 72. Now that's pretty cool ! The Greek Navy had 3 old LST's sitting in moth balls destined for the scrap yard and these old guys took parts from all three ships and made one whole again and brought LST-325 Home. A bunch of crusty old sailors bringing home a big part of their past and helping future generations see what it's like to walk the decks of history. Very cool indeed !

AS I was about to wrap this column up when an event happened that caused me to re-think my ending for this months column. The day after I toured the ship, on Wednesday, Sept. 28th. Army Pfc. Brett Bondurant, age 19 was critically injured by an improvised explosive devise ( IED) while serving in Afghanistan. He lost both of his legs below the knees and has a badly broken arm and a lot of burns on various other body parts. He was one of 4 soldiers involved in the incident, two other solders died and the forth soldier also lost one of his legs.

Brett Bondurant lives about 3 minutes away from me here in Greendale

Indiana. He's a local kid . I know both of his grandfathers and his dad is a very close friend of mine. He graduated from Lawrenceburg High School in 2009 . People can say what ever they want about small town America but when something like this happens to one of our own, there is nothing this town and it's citizens won't do to support Brett and his family.

Everywhere you look there are yellow ribbons, signs in almost every store window, banners asking for prayers for Brett and all his fellow soldiers . As I write this column today, Brett is recovering at Ft. Sam Houston in Texas . I hope every person reading this column today remembers this fine young man and every other person serving our country .

As Veterans Day (November 11th.) approaches, stand a little taller and a little straighter and say thanks to God that we have young Men and Woman willing to sacrifice their futures so you may have yours. Freedom comes at a price many of us will never be able to fully pay but at the very least, we need to say thank you to all those brave Men and Woman who wear our county's uniform with pride. No matter if it's a bunch of crusty old sailors bringing a WW2 relic back home or a young hero like 19 year old Army Vet Brett Bondurant, you make us proud to be One Nation, Under God. Thank

It has come to our attention that business establishments in Arizona may still be discriminating against motorcyclists. Please carry copies of this form with you at all times. Discrimination can range from a sign stating "No Colors" or "No Motorcycle Parking" or "No Motorcycle Attire" etc., to simply being asked to leave a place of business, just because you are on a motorcycle or because of your riding apparel. May’s Guest Safety Article

by Stacey “Ax” Axmaker Director - Idaho STAR Motorcycle Safety Program

In 2007 and 2008, 25-30% of motorcycle fatalities in Idaho involved riders who had been drinking. And most of these fatalities involved riders who had a BAC of .08 or higher. Nationally, these percentages are even higher. What gives? One of the unfortunate elements of our ‘biker culture’ is alcohol. Poker runs often go from bar to bar; many bike shows, swap meets, and other riding events have beer gardens (or at least a keg or two). So often we see a row of beautiful bikes parked outside of a bar. Perhaps the riders in there are drinking coffee or lemonade – the fatality numbers suggest otherwise.

You’ll hear people say (or may you say) that they can ride fine with a few drinks. Here is the bottom line:

1. Judgment, vision, and divided attention skills are affected by even small amounts of alcohol. Judgment is the most critical.

2. Reaction time and coordination are also affected and this is where we can

really get bitten. A half second delay in reacting to a car pulling out in front of you can make the difference between a close call and a 911 call.

Our best ‘rescue’ from these crashes and fatalities is each other. Drinking is not the problem; it’s what we do after we drink that can be the problem. Let’s face it – you know when one of your buddies shouldn’t ride. And guess what – your buddies also know when you shouldn’t ride. ‘Knowing’ isn’t the problem. The problem is that we typically don’t take action to stop something we know could result in disaster.

As riders, we take action when issues arise. Those issues could be that one of the riders in the group is having a problem with their bike, or it starts to rain, or maybe there is a speed trap ahead. We recognize the situation, we know what needs to be done, and we do it. In these ways, we look out for each other and ourselves. Alcohol is no different – please – look out for your buddies (and yourselves) and take action when you know they (or you) shouldn’t ride.

It’s your choice. Make the right choice – ride sober.
