Good news folks, we have “intellectuals” who are really interested in helping to keep motorcyclists safe. They are really excited about finding out why there are so many avoidable crashes and how they can be avoided by building better roads. Well that is until they find out that it isn’t attached to the five million dollars they thought was available for the study. The gentleman mentioned below is one of those people. Apparently his motivation was the money and fame. Dr. Ahmed is a civil engineer with road engineering experience but little or no knowledge of traffic management or driver psychology. He’s never been on a motorcycle, nor was he anxious to give it a try.

The Motorcycle Riders Foundation has learned that the chief engineer of the FHWA motorcycle crash causation study has removed himself from the project.

In an email sent on Tuesday, September 11 2012 by Ahmed he announced the following: "I am writing to let you know that I am no longer working on the motorcycle crash causation study. I have serious reservations about the value of study with the existing FHWA involvement. My expectations of the study are very low." Dr. Samir Ahmed, PhD, PE, was in charge of conduction and then evaluating the Federal motorcycle crash causation study for the FHWA. The study was mandated by Congress in the

SAFETEA-LU bill (PL 109-59). The study was supposed to collect data from 1200 crashes, however when the cost of the study more than doubled it became necessary to shrink the size of the project now the Feds are estimating that the number of crashes that will be investigated is down to less than 120. That’s just %10 percent of the original number. The mandate directed the FHWA to work with the Oklahoma State University Transportation systems engineering school, a leading research center for all things transportation. The MRF has had some serious questions about this study since its conception. The MRF did not lobby Congress to have the study mandated.

So, there you have it, as motorcyclists we must encourage training, we must encourage safety and of course we must encourage sober riding. Carole O’Reilly

I found this article in the American Motorcycle Association’s publication and thought this may be of interest to everyone, as I was unaware of Dr. William’s appointment. IRVINE, Calif., Aug. 23, 2012 – The Motorcycle Safety Foundation’s Dr. Sherry Williams, the MSF’s director of quality assurance and research, was recently appointed to chair the prestigious Transportation Research Board Motorcycles and Mopeds Committee. This accomplishment, along with presenting peer-reviewed papers at the upcoming VTTI International Symposium on Naturalistic Driving and ifz/MSF-International Motorcycle Safety Conference, is one of the many ways Dr. Williams contributes to the MSF’s goal of developing and maintaining high-quality, innovative motorcycle-safety research.

According to the TRB, its mission is to promote innovation and progress in transportation through research, and to this end, it incorporates more than 200 committees composed of individuals who share an interest and expertise in transportation. The Motorcycles and Mopeds Committee is concerned with all aspects of motorcycles and mopeds, including the operator, the vehicle and the transportation environment.

“Each TRB standing committee brings together experts in a specific field from academic, practitioner, user and industry sectors, and from all levels of government,” said TRB Transportation Safety Coordinator and Senior Program Officer

Richard Pain. “The Chair provides leadership in carrying out the scope of the committee, developing research needs statements in its field, developing and carrying out a committee strategic plan and more. Dr. Williams brings many years of diverse and directly relevant experience to the committee and has been an active member since 2005.”

In her three-year role as committee chair, Dr. Williams will continue to lead the committee in developing a Triennial Strategic Plan and identifying research needs specific to motorcycles and mopeds, as well as issuing Research Needs Statements. These statements will be used to stimulate research that addresses issues relating to motorcycle safety and motorcycles as a transportation mode for use by practitioners, researchers and others.

“Being appointed Chair of the TRB Motorcycles and Mopeds Committee was a tremendous honor for me,” said Dr. Williams. “This is another excellent opportunity for the MSF to serve millions of riders by championing representation from a broad cross-section of voices, and bringing them together and amplifying their voices in order to accomplish progress in motorcyclists’ safety and inclusion through actionable transportation research.”

Dr. Williams has served as the director of quality assurance and research for the MSF since 2003, where she directed the MSF-NHTSA-sponsored Discovery Project and currently serves as co-principle investigator for the MSF 100 Motorcyclists Naturalistic Study. Dr. Williams has been attending the TRB’s Motorcycles and Mopeds Committee meetings since 2004 and has been a member since 2005. She earned her PhD in Organizational and Interpersonal Communication with an additional emphasis in Statistics and Research Methods from the University of Kansas, and she has an M.A. in Communications with an emphasis on Training and Organizational Development from the University of Northern Iowa. FEDERAL HIGHWAY SAFETY GRANTS IN JEOPARDY Despite a spike in traffic fatalities, states could lose as much as $120 million in highway safety grants if Congress doesn't change a planned bill to fund the government's operations for six months. Congress passed a new highway bill this year that streamlines the federal grant process that provides state funds for alcohol-impaired and distracted driving prevention, increased occupant protection, motorcycle safety, teen driving safety and data collection. Under the typical rules for a continuing resolution, new programs such as those authorized under the highway bill cannot be funded.

The National Highway Traffic Safety Administration recently reported that its estimate of all traffic deaths for the first quarter of 2012 show a 13.5% increase to the highest number since 2008. The substantial increase is the second-largest quarterly jump in traffic deaths since NHTSA began tracking deaths on a quarterly basis in 1975 -- and the biggest since 1979.

NHTSA reported the rate of traffic deaths per 100 million miles of vehicle travel increased significantly to 1.1 fatalities per 100 million miles traveled during the first three months, up from 0.98 in the same period last year, with 7,630 fatalities compared to 6,720 in the first quarter of 2011. The increase would end a steady decline in U.S. road deaths over the last seven years, falling last year to their lowest number since 1949.

HEAD OF MOTORCYCLE CRASH STUDY RESIGNS OVER CONCERNS Dr. Samir Ahmed, the Oklahoma State University researcher who has been heading up the latest motorcycle crash causation study, announced that he was leaving the program in a Sept. 11 e-mail stating; "I am writing to let you know that I am no longer working on the motorcycle crash causation study. I have serious reservations about the value of study with the existing FHWA (Federal Highway Administration) involvement. My expectations of the study are very low."

Dr. Samir did not offer any further explanation as to the reservations he has regarding the FHWA involvement. The study was originally planned to examine

Coast to Coast

The Motorcycle Safety Foundation (MSF) had raised commitments from its members to provide $3 million to the study but decided not to make the money available for a study with fewer than the 900. It was decided then that the study would use only one location instead of the three that had been envisioned, and the reduced study got underway last year.

In the meantime, the MSF has announced the conclusion of an unprecedented yearlong Motorcycle Naturalistic Study in conjunction with the Virginia Tech Transportation Institute designed to track comprehensive, real-time routine riding that likely included near crash, pre-crash, and actual crash data that had heretofore been unavailable. The study is yielding preliminary results that will be released at a later date.

HELLS ANGELS SUE FEDS OVER BAN ON MEMBERS ENTERING THE U.S. NCOM Brothers Behind Bars Newsletter editor Mike Davis SOS MC Retired recently reported that the Hells Angels Motorcycle Club is going to court to protest a U.S. government policy barring the club’s foreign members from visiting the United States and is also fighting its federal designation as a “known criminal organization.”

In a complaint filed in federal court in Washington, DC the Hells Angels Motorcycle Corporation names Janet Napolitano, the Secretary of the Department of Homeland Security, Secretary of State Hillary Rodham Clinton and Alejandro Mayorkas who is the Director of U.S. Citizenship and Immigration Services, and claims its designation as a "known criminal organization" by the departments of Homeland Security and State violates immigration law and the group's constitutional rights by systematically denying entry to its members in 26 countries on six continents.

HAMC v. Napolitano et al. (1:12-cv1357) disputes the Obama administration’s foreign policy that declares “the Hells Angels, the Outlaws, Bandidos, and the Mongols” to be organized crime groups and is seeking an injunction allowing foreign members to be granted visas to travel to the U.S. In its lawsuit,

the group claims the government routinely denies visas "to all aliens based solely on their membership in a Hells Angels charter without further analysis into whether or not that individual seeks to enter the United States to engage solely, principally, or incidentally in unlawful activity."

Opinion on Cellphone Searches --

DEPUTY SUSPENDED FOR SEIZING BIKER’S CAMERA The Dallas County Sheriff's office issued a 30-day suspension without pay to a deputy after footage showed him seizing a helmet-mounted camera from a motorcyclist as potential evidence of alleged crimes committed by other unidentified riders.

Prosecutors argued that a jailed individual had no rights to expectation of privacy. The Texas Court of Appeals disagreed and stated that while an inmate has no reasonable expectation of privacy in his cell, his/her stored property does fall under reasonable expectation of privacy. It is not as though the officer saw the pictures scrolling on the display screen, rather the phone had to be turned on and the photos accessed and scrolled through. While this may not stop a rogue officer from scrolling through your cellphone, anything found will not be admissible in court without a search warrant first.

Lawyers for the club describe its membership as composed of loosely associated charters, "made up of motorcycle enthusiasts who have joined to ride motorcycles together, organize social events, fundraisers, parties and motorcycle rallies" and the group says any crimes committed by its members have been done as individual acts, and are not representative of the club as a whole.

A video viewed nearly 500,000 times on YouTube shows the Texas deputy on camera issuing this comment to the biker: "The reason you're being pulled over is because I'm gonna take your camera and we're gonna use it as evidence of in the crimes that have been committed by other bikers." Our legal experts at AIM/NCOM (Aid to Injured Motorcyclists/National Coalition of Motorcyclists) agree that the officer’s rationale does not constitute probable cause to make a traffic stop and does not justify seizing the camera, nor is it illegal to wear a camera on a helmet.

The sheriff’s deputy eventually arrested the motorcycle rider and according to the Examiner newspaper he then tried to slam the door of the patrol car on the biker’s leg before hauling him off to jail. The biker was finally released and issued a ticket for only an obstructed license plate. The officer was also disciplined for leaving a drunk driver at the jail without booking him before going out on the call relating to motorcyclists riding on I-35.

LONE STAR COURT RULES ON CELLPHONE SEARCHES Suds, Texas Commander of the U.S. Defenders/COIR Division, issued the following notice re: Texas Court of Appeals

Our AIM/NCOM Attorney Bill Smith shared an important decision made by the Texas Court of Appeals about evidence retrieved from a cellphone without a search warrant. The Court rules in favor of the people. The opinion cited a case where an individual was arrested on one charge, and based on hearsay, an investigating detective went to the property room of the jail and retrieved the individual’s cellphone and scrolled through the photos he had stored on it. Originally arrested for disorderly conduct, the defendant now had to face an indictment of improper photography or visual recording.

SPEED CAMERAS COULD BE ANYWHERE As drivers become more savvy about spotting speed cameras along roads and highways, police are making it tougher by disguising their revenue-generating equipment. Authorities in and around Washington D.C. are expanding their speed camera programs, reports the Washington Examiner, and now they're purchasing cameras that look like mailboxes and trash containers to unsuspecting motorists. They're also more mobile, so police can reposition them so drivers cannot get used to seeing them in one particular area. Nearby Prince George's County in Maryland purchased nearly 60 mobile cameras last year, and expects to generate $28 million in annual revenue, reports the news outlet. A similar speed-camera program in D.C. generated $55 million in fiscal year 2011.

Hello, fellow travelers.

Our August meeting was held at the Eagles (as usual) but no one from the Eagles showed up to let us in (as very unusual) so, being that we didn’t have anything that was really pressing to discuss, plus the fact that it was hotter than f@#k out there on the front porch, we decided to call the meeting.

We held our first annual “Biker Bowl” (instead of our usual “Biker Ball”) August 12th at Brunswick Zone in Mesa. Boy did we have fun! Bowling beats the s&*t outa baseball in the summer. You don’t have to be out in the sun, you don’t have to be able to run, and…they bring you beer and snacks! The perfect sport for us Geezer Glide Riders.

“Motorcycles on Main” resumes in October and runs through June 2013. (provided that the Mayans were wrong) It is held on the first Friday of the month in downtown Mesa on Main St. (duh) from 6:00PM to 10:00PM. Motorcycle parking is Sturgis style. This is what the City of Mesa has on their web site:

For this family friendly event the streets will be closed off to all car traffic, motorcycles only! Motorcyclists will be able to cruise down Main St. or park and show off their bikes. Everyone is invited to experience motorcycle-related vendors, local food restaurants, beer gardens, and live music.

The weather up here in rim country has been beautiful for riding !! So come on up and enjoy our beautiful riding area. Be sure and stop at some of our new and old business members eateries and other other places to wet yourwhistles at.

Membership is on a rise up here, old members are renewing and new ones also , I have to give Grizz an atta boy for signing up the Landmark in Christopher Creek. That is our newest business member. OK, now for upcoming events up here, we have our annual Chilli cook off to be held on Oct.13th 2012, at the Grizzley and Wind Mill Hotel in Strawberry, starts at noon till when ever all are welcome. Then in December, we are going to have our 8th annual BARBIE'S TOY RUN. Hope to see you there. That will be on the 15th at the Buffalo Bar and Grill. Remember our meeting time is on the 3rd Sunday of the month 10am at the Moose Lodge in Star Valley.

Hi all Mohave County members, We are back!!

Our chapter decided to black out for the summer months due to the excessive heat and low turnout we were experiencing. We will be returning to our regular meeting schedule beginning on the first Sunday in October, the 7th, at the BHC Moose Lodge on Miracle Mile. The lodge has a full breakfast available for $5.00 from 9 - 12 PM, so get there early. The meeting will begin at noon. Hope to see you all there.

Southern AZ sure has been has been busy. AUG Chapter Meeting

Southern AZ has a new Secretary, Marie Baker. Somehow S. AZ seems to squeak by with volunteers to fill vacancies. It is always great to get new blood as it seems to breathe new life into a Chapter.

The Chapter nominated me, Sean Pinder, to be the Board Representative for the Southern AZ Chapter. I was hoping someone else may be interested, or may have been “mandateered”…I am honored to serve again, but new blood, fresh faces and ideas with new energy is always good for a volunteer non-profit. I hope all Chapter members think about stepping up for a Chapter Officer role. Volunteering is a rewarding experience, and the more we have the less work it is for individual officers. The Southern AZ Chapter is fortunate with members who also step up for events and other roles that are not official officers, but appreciated the same. I enjoy the Chapter member when they attend the meeting and engage, ask questions and provide ideas and suggestions. That’s what it’s about.

Our faithful leader Jim Bustback delivered my PAC report as I was traveling for business in Dallas dodging WestNile Mosquitos. Anyway, topping the list is redistricting. Know your district, and Jim distributed the new maps. If you are registered to vote, the County Recorder’s office should have sent you a new Voter ID Card with the updated info. Many District Boundaries have changed and the District identifying number as well for both AZ LDs and US CDs. Approved Final maps can be viewed and downloaded at < http://azredistricting.org/Maps/FinalMaps/default.asp >. The district locator feature at < http://azredistricting.org/districtlocator/ > link is a great tool for street level detail and you can simply type in your address to locate all new district boundaries. On Friday, July 13, California State Governor Jerry Brown signed AB 1047 into law, becoming the fourth state in the country to prohibit roadside checkpoints that only target motorcycles. California joins with New Hampshire, North Carolina and Virginia who have already enacted similar legislation. AB 1047 passed by a unanimous 77-0 vote. The new law will become effective on January 1st, 2013.

A letter of support circulated to California State legislators by the Coalition of Independent Riders (C.O.I.R.), through the US Defenders program, stated that the motorcycleonly checkpoints were discriminatory and un-American. Meanwhile in the U.S. Congress, dozens of Congressional Representatives have signed on to House Resolution 904 to prohibit the U.S. Department of Transportation from providing funds to State and local government agencies to check helmet usage or create checkpoints for a motorcycle. Two of our Jim’s had surgery, the back and the other his toe. They are both becoming bionic men with all of their new parts. DeYoung handed out flyers on tire blow outs. There was also a discussion of tire shelf life where most tires dry rot after five years. The dry heat in the desert may be quicker than the standard shelf life. Jim Clark, the ABATE’s Rider Advantage (ARA) 501c3 is seeking future trainers. Riding classes cost upwards about $250-$280, and the ARA’s mission to offer at more affordable price. Instructors will be paid and

The Motorcycle Awareness Program (MAP) generally goes to schools and talk with young student drivers about motorcycling…Why we ride a certain way, dress the way we do, etc… It is a great program to educate others who may not understand motorcycling. Great Southwest Chopper Fest & BBQ Cook Off.

Bikers descended upon Bisbee on Labor Day Weekend for the second annual event at at the La Ramada Steakhouse & Cantina, 1948 S NACO HWY, Bisbee, AZ 85603. ABATE of AZ had a booth at no charge courtesy of Kim Collins. Check the web site at <www.hdbbq.com>. (3) Jims (2) Bobs, Patrick, Charlie, and Brian all attended and worked the event. There was a last minute cancellation for a hotel room and Jim Butsback and Bob Welton got a free room (quite an upgrade from camping). Of course Bob was up at 530A to squeeze in a quick ride before working the booth the second day. Highway Mile CleanUp

The Southern AZ Chapter has a Mile just east of SR82 & SR90 in whetstone. SR83 is a great piece of road that extends from Nogales, through Patagonia and Sonoita (at SR83) in Santa Cruz County. Then, SR82 into Cochise County through Whetstone (North of Sierra Vista) across the san Pedro to SR80 just North of Tombstone. John Hanusch organized another great clean up and was joined by Jim, James, Jerry, Hilda, Ruben, Kim Collins and her son. I am forgetting someone, probably another Jim. Nine people made a quick 45 minute work of the mile, to then have lunch provided by the Chapter at Biker Friendly Buddy’s Bar. Just as John warned everyone to be careful and watch out for snakes, a four foot beautiful Rattler joined the party. Yes, those thick-high leather biker boots are recommended for working our mile. I have more faith in thick leather boots than the Harbor Freight grabbers for protection. We picked another member. May seem inconsequential, but that one member may be the one to do great things. Besides, one member at time is usually what it takes. ACMC meeting

I attended the ACMC meeting in Tucson, Sunday the 9th. Richard M Lester provided an informative packet of pending litigation and proposal for anti-profiling legislation around the nation. Topics discussed were the discriminatory Motorcycle Only Check Points and how to conduct oneself during an arrest and a Police investigation was discussed. Documenting incidents with comprehensive information is needed to create a record. Lester reminded all that Litigation is the last resort for remedy due to cost and the burden of evidence. The over-arching topic is clearly the Discrimination and police Harassment issues. I am sure Patch holding clubs experience harassment and discrimination more often. Many brothers and sisters believe that this is only a club or patch issue, but they would be wrong. I myself wear clean leathers without a patch or pin, not even an ABATE patch. However, I am not under the illusion that I will not get harassed, because I have been. I am sure I will again, just less often. It is a slippery slope to allow and brother and sister on two or three wheels to endure discrimination and harassment and remain silent and apathetic. So, let’s not venture down that slope and regardless of what any motorcyclist thinks of a club, discrimination, profiling, is wrong.

ABATE of AZ had a booth here courtesy of the Bashful Bandit among other vendors. This is a great dive biker bar in Tucson has been on Speedway for, forever and a day. Butsback, Welton, and myself worked the event. Cruiser was also pitching his wares who I bring all my leather work. Chapter member, Ann, won a trophy for her Can-Am. There was a ‘what’ T-short contest, 50/50, and raffle. Later another Chapter member arrived as the event wound down. I think she goes by Chipmunk, Weasel, Ferret, or some kind of rodent. Summer is letting up but the Prescott monsoon, best in years has not. We had a great meeting on September 9th and quite appropriately; our safety officer 44Dan gave us some great information on riding in wet condition. The best tip was make sure your tires are not underinflated as it can lead to hydroplaning. Handy updated us on important information from the NCOM meeting held in Colorado and passed on some great tips on avoiding a DUI even if you are sober. She rightly pointed out than many of could potentially fail an agility test. Don’t offer to show off your coordination skills to the officer, only comply with what is mandatory. Still Ray reported to the rank and file wearing a wide variety of hats (when Webster decides to define motorcycle rights activist, they could simply say Still Ray) what is going on across the country in regards to M/C rights. NCOM Regional is in Phoenix 11/10. Here is a line everyone should use when trying sign up a new ABATE member: it only costs only $1.00 a week to help MRO/MRFs. With the Riot on the River on 10/9, and independents should step up to the plate and help at event. If you were at TBFS, you might have noticed just how many patch holders were there to volunteer. A lawsuit instituted for a discrimination issue and if it is won, a 1 million dollar contribution will be given to the MRF, (relates to murder/suicide@ TBFS). There is video evidence of harassment of Sons of Hell.

Our next meeting is going to be a great event as well. After the meeting we are riding to Nowhere, AZ to the Burro Inn. We will be doing the photos shoot for our calendar there and again at the Gurley Street Grill at our upcoming social on November 17th. Photo taking was originally scheduled for 9/9. In all, 13 states utilize speed-reading cameras, while 12 states have passed laws banning them. Twenty-four states are currently operating at least one red-light camera within their borders, while another nine prohibit their use. Despite the conflicting laws, overall use of cameras has gone up rapidly in recent years: redlight cameras were in 25 communities in 2000, compared with more than 500 today. A Place To Ride to Die - the Pyrenees Mountains - Col d'Aubisque

When I lived in Wayne county about a thousand years ago, I dreamed of riding the Pyrenees Mountains. No more dreaming, because I just did it, and I would never ever think of doing it again. In fact, knowing what I know now, I would have paid criminal amounts of money not to go. And I would tell every friend of mine t never even think about it. Because of this trip, a good argument could be made that I have a case of post traumatic stress syndrome, treatable only with good whiskey - for now.

I went with two friends Andre Lacy, Don Palmer and Ann, of course. The bonds formed as a result of surviving the ride can almost be described like that of combatants having survived a battle. Here is why. Don Palmer, Ann and I are motorcycle cruisers. We are not MotoGP kind of riders. Andre is hard core. His 73 years belie a man of steel and guts. His ability to handle a BMW sport bike is impressive, especially when he encountered a 13 percent grade on a 180 degree switchback. He took a fall, did two perfect rolls, shook it off, picked his bike up and went on like nothing happened. Simply amazing. I see why Tucker Rocky has done so well with him at the helm as well as any other business/activity he chooses. The state of Indiana is so lucky to have him as a citizen.

Here is what happened. In taking the roads up to the pass from hell, we encountered narrow roads - no big deal. That is, until you take away guardrails, leave the roads at about a 13 per cent grade and throw in a menagerie of farm animals, all loose and roaming around looking for handouts like an NYC panhandler. Then there were the French tourists driving mini campers, seemingly always looking the wrong way and driving on your FIVE FEET of road. Not sure if the middle finger was a universal sign before I rode there, but I am pretty sure it is now. Cows with bells, sheep with bells, goats with bells and did I mention bulls with horns? And of course throw in a horse with a cowbell (I felt sorry for the horse; he looked embarrassed). In this open barn yard I learned all about the coefficients of friction of manure, which was everywhere. Crudely put, cow shit is slicker than goat shit, which is slicker than sheep shit and horse shit is slicker than all of them. Am not sure about the

Ann and I have ridden nearly every major mountain range in the good old U.S. and we love it and the safety attention usually afforded roads in our country. But that experience did not come close to preparing us for the Pyrenees mountain pass from hell - Col d'Aubisque. The motorcycle rental company only rented BMW's great motorcycle, but I had never ridden one. My friends know me as a Harley guy and that is the bike that I know well. It was a big mistake to take an unfamiliar bike to that pass, but I am an old farm boy with a "how hard can it be attitude". I found out.

bull shit. This is very important information to know with a two wheeler on steep roads.

A smarter man would have turned around at Col de' Tourmalet - the famous point of the Tour de France - and gone back home to Indiana. Forrest was right, stupid is as stupid does. While there among the animals, I looked over towards the pass from hell. I said to my companions that surely that was not the road. It was chiseled into the side of the mountain which was maybe 16 feet wide in some places, and it was at least 2000 feet straight down - a sheer cliff. (Remember, no guardrails!) When I had passed the point of no return, I was thinking that my new Tucker Rocky riding gear with state of the art body armor was not going to be much help with a 2000 feet drop. And what a horrible time to discover that you are a closet height-fearer. Nothing scared me more than when Ann leaned over and whispered in my ear, "whatever you do don't look down". I and my stomach knew she meant it, so I didn't, even when we got to a safe point. My peripheral vision wanted me to look. I refused the bait. I was going up a steep grade in first gear while wishing I had an even lower one and facing a 180 switch back on a blind turn (remember the French tourists in the mini campers looking in all the wrong directions and usually driving on my part of the road). The view of just sky ahead and not knowing if the road continued straight or hung a left out of sight was paralyzing, or was it a 13 percent grade, or a 180 degree switchback on a blind curve? And by the way, when does a BMW 1200 stall

out? I had never ridden so much in first or second gear in my life. [Ann, I promise to never-ever threaten to fatten you up and sell you ever again.] Here is how I put this ride up through the pass from hell in perspective - in hindsight, of course. Most states have a building that is 600 feet high. Pretend some idiot builds a ramp at a conservative 6-7 percent grade three times higher than that. Next, he builds a wall on one side and makes the ramp 16 feet wide. Then, he leaves the other side wide open - not even a dandelion on the edge. Then, he spreads a herds of sheep, cattle, horses and goats along the way and don't forget the French guys in the mini vans he has invited to start up from the opposite direction driving a lot on the “not their” side. Then he invites you to ride your Harley up the ramp to enjoy yourself and the view. What do you say?

Some of you may be thinking that this bike trip was a Darwin theory screening device to get rid of those (me) who are not smart enough to deserve a place on this earth. The ACMC’s Riot on the River

On Oct 19th-21st, 2012 Motorcyclists from all over our great state of Arizona (and surrounding states) will be converging into a little town called Winkleman, AZ for the 6th Annual Riot on the River hosted by The Arizona Confederation of Motorcycle Clubs (ACMC). Don’t let the name of the event deter you from showing up and enjoying such a great event as this one. This is the ONLY statewide event the ACMC hosts and the funds from the event help The Confederation continue their mission and agenda. The ACMC has its roots and history deeply implanted into the Motorcycling Community in AZ for well over 15 years. And some of the Motorcycle Clubs and Organizations have been here for 30+ years. The MISSION is simple and clear. The ACMC is made up of Arizona Motorcycle Clubs and Organizations which have come together in unity to facilitate and broaden communication amongst its Members, within the riding community and general public. It serves to educate both riders and the non-riding public on all of the positive aspects of motorcycling and to warn against and oppose any intrusion(s) upon their rights to live and ride free. Its goals are to promote and protect motorcyclist's rights. It

will accomplish these goals by any lawful means necessary. The ACMC does not approve organizations, or in our language, “sanction” Clubs. The ACMC Members are a select group of Elite Clubs and Organizations who have banded together in a fight for freedom and stand in defense of American rights, especially MC Clubs, and all Motorcyclists. There are currently 42 Member Clubs and Organizations in the ACMC. There are 34 Associate Clubs and Organizations working towards becoming a Member of this ELITE group of Motorcyclists. And the list continues with Guests of the ACMC. PLACES TO RIDE BEFORE YOU DIE: OMAHA BEACH -DOG GREEN SECTOR

On my way over to ride the Pyrenees Mountains, I stopped and paid my respects to those that died at Omaha Beach in Normandy. If you ever get the chance to go, take it. You will never forget what was done there. On June 6th, 1944, among the many units, Company A of the 116th Regiment was going to hit the beach at Dog Green Sector in a Higgins boat-not a good place to be. All 200 of them were from Bedford Virginia (a wonderful place to ride to if you are riding the Shenandoah Valley). They have a monument on the town square to the 176 of Company A that died when the ramp of their landing craft dropped and exposed all of them to German MG 42 machine guns. At 1500 rounds per minute, the boys from Bedford didn't have a chance. The MG 42 sounds like a chainsaw when it is fired - probably the most dreaded sound at Omaha Beach. So distinctively terrifying was this machine gun that the Army developed training films to help our troops deal with the psychological trauma of facing this weapon. It made a sound like ripping cloth. Our boys called it crudely Hilter’s zipper. It bothers me that, I am pretty sure our soldiers knew what they were in for when the ramp on that higgins boat dropped. The thought of dying for my county is ok with me, but dying before I even had a chance to shoot back is not. I gathered some sand from Dog Green sector; I couldn't help it. I will put that sand in an hourglass and set it on my desk to remind me of what they did and what a bad day is all about. After I left the beach, I had to visit the Colleville cemetery where the Bedford boys and many others are buried. It overlooks Omaha Beach and by any definition is a holy place. I couldn’t talk there - draw your own conclusions. The gravestones are marked with the name and state of the fallen soldier. Indiana, Illinois, Ohio and Missouri are inscribed on too many. Before leaving, I thought Omaha Beach was a long way from home for those guys and I wondered how many of their folks were able to visit the graves before they too, passed on. It bothers me that most of their loved ones didn’t get the chance to pay their respects. P.S. Our guide took us by the German cemetery. I didn’t ask to go there and he did not ask if I wanted to go. If he had, I would have said no, after all I had lost family in that conflict. I learned there was a 13 year old German soldier buried there, and there was a marker that said, “Most here did not pick the fight or the cause”. I think, I am glad I went. CONFUSION IS AS CONFUSION DOES - SOME HELP FROM AN INSURANCE EXPERT FRIEND

COMMENT. Rod - I am an ABATE member and enjoy your monthly column. With respect to the “Am I Covered” question, [this question and

answer appeared in last month’s column] you mention “The standard coverage for ABATE events will provide coverage for the ABATE member if that ABATE member is listed as an additional named insured under that policy”. My comment has to do with “additional named insured”. Named Insureds are those folks that purchase the policy and if there is more than one Named Insured, there has to be some connection between them such as co-owners of the property or one person or a group of persons together own 51% of the various entities or assets. Named Insureds have rights under the policy which include requesting policy changes and cancelling the policy. They also get to pay the premium. Additional Insureds are those folks that are added to the policy via an endorsement for a certain reason such as, in the case of the writer, being the property owner where an ABATE event is being held. The coverage provided to the Additional Insured is contingent on the acts of the Named Insured. Example – during the event, an invitee falls and is injured. Since this occurred during the event, the ABATE policy would come into play. Additional Named Insured – this is a figment of the imagination of most attorneys nationwide. There is no such animal –never was, never will be. While I have seen requests for this in many contacts, I have to advise the attorney that they are asking for something that does not exist. Sometime in the past, some attorney put this wording into a lease agreement or other agreement and the error has been carried forward even to this day and will be until attorneys correct their master documents. ADDITIONAL NOTE FROM JAN: I also see requests from attorneys for a Comprehensive General Liability Policy which was eliminated in 1986 when the Commercial General Liability Policy was published. Same carry forward error issue.

NOTE FROM ROD: Jan thank you for your input as it helps make this column worth reading. Lawyers using confusing terms reminds me of a story. Back where I am from, there was part of the county that had inexplicably reversed the colloquial terms for the male and female sex organs. Since the guys that had this reversal of terms problem were pretty tough guys, we never got around to correcting them, and we knew what they meant any way-or at least we thought we did. As a matter of fact, I wound up befriending one of those tough guys and besides, having him as an ally came in handy at the local VFW and the Sims Tavern. The day of truth, however, came one time when I invited him up to a University of Illinois football game. Unfortunately, he was still afflicted with the reversal of sex organ terminology problem that I alluded to above, but I had forgotten all about our unique county confusion. Apparently no one from Wayne County had dared to correct him. At my favorite bar Kams, painfully, I recall him exclaim that he was going to go out and get some (FILL IN THE BLANK). That declaration of intention created a show time intermission-the likes of which I had never seen before, or since. I could tell by the shock and awe, that this confusion in terms, caused

How can I have ridden for so long and not known that we have a law in some states concerning ear plugs and ear phones? I am now convinced we have a law for everything - there can't be anything left to law on. With one deaf ear, the law in Illinois and Ohio lets you put the ear plug in your good ear and leave the plug out of your bad ear- no problem. I guess that is so you can hear with your bad ear? And Indiana does not have a law period. Go figure. I will do a summary of the laws of the various states as to the use of ear plugs-ear phones in a future edition as the laws are perplexing. The PAC Rant

Something that just popped up, our good friends at the Motorcycle Riders Foundation has learned that the chief engineer of the Federal Highway Administration (FHWA) motorcycle crash causation study has removed himself from the project.

Jim Page State PAC Officer Well, here I sit in front of the computer screen, pushing the deadline yet again. Mr. Editor has just sent me the email equivalent of the Hairy Eyeball and I’ve got so much whirling about in my noggin that I can’t focus on one thing to write about.

In an email sent on Tuesday, September 11 2012 by Dr. Samir Ahmed he announced the following: "I am writing to let you know that I am no longer working on the motorcycle crash causation study. I have serious reservations about the value of study with the existing FHWA involvement. My expectations of the study are very low." Dr. Samir Ahmed, PhD, PE, was in charge of conduction and then evaluating the Federal motorcycle crash causation study for the FHWA. The study was mandated by Congress in the SAFETEA-LU bill (PL 109-59). The study was supposed to collect data from

1200 crashes, however when the cost of the study more than doubled it became necessary to shrink the size of the project now the Feds are estimating that the number of crashes that will be investigated is down to less than 120. That’s just %10 percent of the original number.

With a study that small, how do you even get a proper level of randomness? The study is flawed from the start. It is a total waste of money that could be better spent on awareness and education.

I’m just waiting for that roulette wheel that I call a brain to stop spinning ….. And there it is! I’ll use this opportunity to remind you about the “Freedom Ride to the Dome” that will be held on February 20th.2013. We are trying to re-create the old Freedom Rally but with the difference being that there will be legislators present at the Capitol. We will be meeting at a pre-staging area and riding in together as one big (I hope) group.

Feds, Automakers Launch Pioneering Connected-car Study in Mich.

ANN ARBOR, Mich. -- The U.S. Department of Transportation today launched its first large-scale real-world study on the use of vehicle connectivity to enhance safety -- an effort that officials compared to the early development of the seatbelt or airbags.

Nearly 3,000 cars, trucks and buses have been outfitted with sensors that will allow the vehicles to communicate with one another and collect data that researchers will be able to use to determine whether the devices helped drivers avoid crashes. In a ceremony on the University of Michigan campus here, U.S. Transportation Secretary Ray LaHood, who was joined by National Highway Safety Administrator David Strickland and Michigan Gov. Rick Snyder, said the "smart" cars could, one day, prevent up to 80 percent of crashes involving nonimpaired drivers.

"Cars talking to cars is the future of motor safety, it opens the possibility of not just reducing the number of crashes, but preventing them all together," LaHood said, speaking in the safety pilot's preparation garage.

LaHood said that at the end of the yearlong study, NHTSA would review the data from the pilot program and determine whether to implement federal regulations.

"There's no decision on a rule, we don't even know if there's going to be a rule," he said. "We're going to work with our friends in the industry, we're going to work the researchers, we're going to look at the data and then we're going to decide how to proceed.

The University of Michigan Transportation Research Institute will conduct the $25 million federally funded study, and eight automakers -- General Motors, Ford Motor Co., Toyota Motor Corp., Honda Motor Co., Volkswagen AG, Hyundai Motor Co. and Nissan Motor Co. -- are each contributing eight vehicles that will be equipped with transmitters and receivers to communicate with other vehicles and warning systems that will alert drivers if a crash is imminent.

A few hundred other vehicles will be equipped with the transmitters and receivers that will allow them to communicate with one another, but won't notify drivers. Still, even more vehicles will just have units that will just send data to researchers regarding the speed and loca-

tion of the vehicle as they interact with other equipped vehicles

Denso Corp. and Savari Inc. of Santa Clara, Calif., are the primary suppliers of the systems.

Applications

The devices in the study will be used for a handful of different safety applications.

They'll be able to send an alert when:

• A driver fails to break quickly enough when another car is coming to a stop in front of them;

• When a driver tries to change lanes with a vehicle in its blind spot; • When there's a vehicle ahead of the driver that comes to a sudden stop; and

• When it's not safe to enter an intersection.

Many vehicles on the road today are already equipped with radar-based technology that can perform some of these functions, but the safety pilot is using a Wi-Fi-like system, called dedicated shortrange communications, that will actually allow the vehicles to "talk" with one another. So, for instance, an equipped car

will be able to alert the driver when a car two or three vehicles ahead makes a sudden stop.

More than 73 miles of roadway throughout Ann Arbor will also be outfitted with transmitters and receivers that will communicate with the vehicles and can potentially alert drivers about road and traffic conditions. Implementation

Speaking after the event, Mike Shulman, technical leader of Ford Research and Advanced Engineering called the Wi-Filike system "the next big opportunity in safety."

Though production costs aren't yet known, Shulman said the technology is relatively affordable, comparing it to WiFi systems in laptops, cell phones or other mobile devices. And while NHTSA said it'll begin to consider rulemaking for the technology at the end of the study next year, Shulman said the earliest the systems could be implemented would be within six to eight years. "It's a little bit a way," he said, "but not incredibly far."

The Motorcycle Awareness Program (M.A.P.) is an educational program aimed at the target audience of high school students in driver’s education classes. There has been a small group of instructors who have volunteered to present the M.A.P. to students throughout the state. But, we need more instructors.

Remember, that ABATE stands for EDUCATE. Our purpose is to spread the word about safe motorcycling and promote a positive image of motorcyclists. What better way than to speak to the future drivers of our state. The students hopefully, will not only be better equipped car and truck drivers but will also be more aware and watch out for us.

To become an instructor you must:

1. Be available during the day: The presentations in the high school driver’s education classes last about an hour during the school day. There may be as many as 5 classes in one day.

2. Be willing to stand up in front of a group of about 30 high school students and speak: That sounds easier than you think. You need to be able to gently maintain control of the group.

3. Know the material being presented: There is an outline for all presenters to follow so there is uniformity in

the material presented.

4. Commit to teaching at least 2 classes per school year: We hope to have at least one volunteer instructor in each ABATE Chapter. That person will attend and instructor class (about 4 hours), attend a M.A.P. with an experienced instructor, teach a class with an experienced instructor in attendance. When the new instructor is comfortable and the experienced instructor assesses him/her to be ready the new instructor may begin teaching alone. The mentor program assures that everyone is teaching the same material and everyone has support.

5. Provide record of teaching to the M.A.P. Coordinator on a consistent basis.

As politically active motorcyclists its our job to be politically active. For a long time that meant voting it now must also include intense campaigning. I know its easier said than done, but consider this. Dedicate yourself to campaign for the next 60 days and you will form a life long relationship with that candidate. Those sorts of relationship last as these politicians aspire to bigger positions, and they all do aspire, and some succeed and the relationship continues.

Dr. Samir Ahmed has resigned from the Federal Highway Administration's (FHWA) motorcycle crash causation study citing "serious reservations about the value of the study".

The Motorcycle Riders Foundation has learned that the chief engineer of the FHWA motorcycle crash causation study has removed himself from the project.

In an email sent on Tuesday, September 11 2012 by Ahmed he announced the following: "I am writing to let you know that I am no longer working on the motorcycle crash causation study. I have serious reservations about the value of study with the existing FHWA involvement. My expectations of the study are very low." Dr. Samir Ahmed, PhD, PE, was in charge of conduction and then evaluating the Federal motorcycle crash causation study for the FHWA.

The study was mandated by Congress in the SAFETEA-LU bill (PL 109-59). The study was supposed to collect data from 1200 crashes, however when the cost of the study more than doubled it became necessary to shrink the size of the project now the Feds are estimating that the number of crashes that will be investigated is down to less than 120. Thats just %10 percent of the original number. The mandate directed the FHWA to work with the Oklahoma State University Transportation systems engineering school, a leading research center for all things transportation.

The MRF has had some serious questions about this study since its conception. The MRF did not lobby Congress to have the study mandated. "It is no question that we need more information on why motorcycles crash, but with such limited resources in the motorcycle safety world we should be putting them toward proper motorcycle rider education and motorist awareness to prevent crashes." The full results of the study should be out sometime next year.

Dallas County deputy suspended without pay for seizing biker's camera The Dallas County Sheriff's office issued a 38-day suspension today to



MASTERLINK OCTOBER 2012 Deputy James Westbrook after footage showed him seizing a camera from a motorcycle rider. The case received a large amount of media coverage in the days following the incident which took place over the Memorial Day weekend.

The majority of outspoken commentators freely acknowledge that they sympathize with the challenges that law enforcement personnel encounter; however, it was not justifiable for Westbrook to seize the camera that belonged to rider Chris Moore.

The video has been viewed almost 500,000 times on YouTube at this link and Westbrook is on camera issuing this comment to Moore:

"The reason you're being pulled over is because I'm gonna take your camera and we're gonna use it as evidence of in the crimes that have been committed by other bikers."

Legal experts state that Westbrook's reason does not constitute probable cause to make a traffic stop nor is it illegal to wear a camera on a helmet.

Westbrook ended up arresting Moore and then trying to slam the door of the patrol car on the leg of the biker before taking him to jail. Moore was finally released and issued a ticket for an obstructed license plate.

Moore's attorney, Hunter Biederman, is prepared to take the case to court even though an obstructed license plate is a small matter, it is more to address the principle of the situation in how Westbrook opted to handle himself.

LA MESA, Calif. – A star of the Discovery Channel show "The Devi's Ride" was arrested Tuesday and accused of committing sexual acts with his stepdaughter, police said.

Matt Nicholass. “We had information from a parent that initially gave us some information,” said Nicholass. “The detective conducted a pretty thorough investigation and ended up arresting him.” Fox 5 tried to contact other members of the club as well as other bikers in the East County Community and were told “silence” is the code of the club.

A Step Up

One day a farmer's donkey fell into an abandoned well. The donkey cried piteously for hours as the farmer tried to figure out what to do. Finally, he decided the donkey was old and the well needed to be covered up anyway. So, it just not worth it to him to try and retrieve the donkey.

He invited all his neighbors to come over and help him. They each picked up a shovel and began to shovel dirt into the well. Realizing what was happening, the donkey at first wailed and cried horribly. Then a few shovels, he quieted down and completely , The farmer peered in to the and was astounded with what he saw. With every shovel full of dirt that hit his back, the donkey was doing something amazing. He would shake it off and take a step up on the new layer of dirt. The farmers neighbors continued to shovel on dirt on the donkey, he would shake it off and take a step up. Soon, the donkey stepped over the edge of the well and trotted off, to the shock and astonishment of all the neighbors!

Life is going to shovel dirt on you, all kinds of dirt. The trick to getting out of the well is not let in bury you, but rather,to shake it up and take a step up. Each of our troubles is just a stepping stone. We can get out of the deepest wells by just not stopping, by never giving up! Shake it off and take a step up! Remember these 5 simple rules to be happy: 1. Free your heart from hatred 2. Free your mind from worry 3. Live Simply 4. Give More 5. Expect less

Epilogue: After the donkey trotted off, he eventually returned to his owner. He then kicked the crap out of the farmer for trying to bury him.

Which brings me to another moral of this story: When you try to cover your ass, it always comes back and get you-eventually. -Unknown

Running off the road in corners is a very common crash scenario in fatal motorcycle crashes (it represented over 40% of fatal crashes during 2009-2011 in my state of Idaho). Running off the road and hitting an oncoming car; running off the road into a ditch; running off the road into a guardrail; running off the road and hitting a tree or some other solid object. You get the point - running off the road in a turn is not good.

hazard. Riding at a 100% is for the track (and even there, a little reserve is a good idea). Riding on the street requires that you always have a reserve. Control your speed to control your lean (and to know that you can lean more if and when you need to.) • Learn, practice, and master counter-

leaning. It is very common to see riders with their bike leaned farther than their body. This makes turning harder. One way to help keep your body leaned is to line up your chest with the center of the handlebars (or even just to the inside). That way, as you lean the bike, the center of the handlebars goes down and keeping your chest lined up helps you lean with it.

So, what does it mean to have 'Corner Control?' If you unintentionally cross over the centerline or the fog line, you lack corner control. That's just a fact. If the bike goes somewhere you didn't want it to go, you weren't in control. Most of the time, the rider doesn't crash or hit anything, but whether or not there was a car or something else there to be hit was simply a matter of luck (and yes - it has happened to me a time or two...).

Picture this scene - you are riding on a beautiful twisty mountain road halfway through a right hand curve. All of the sudden, you see an oncoming car that is straddling the center line (that means halfway into YOUR lane). If you quickly and precisely change your line so that you turn tighter and move your bike to the fog line (all the way right) to avoid the head-on crash, you have corner control. If you panic, hit the brakes, lay the bike down and crash, you do not have corner control. So, how do we do this the right way? There are several elements to surviving this scene: • Always ride with a reserve. If you are already leaning over as far as you can, you have nothing left to avoid a sudden

steering.

To turn left, press forward on the left hand grip. To turn right, press forward on the right hand grip. The forward press initiates the lean; the lean causes you to turn. To turn sharper (lean more), press more forward. To turn less sharp (lean less), reduce the amount of the forward press. If you just don't get this concept, find a rider training course in your area and have the professionals work on it with you.

• Body position. You should be leaning your body at least as much as the bike is

• Arms bent. Keep your shoulders relaxed and your arms bent at all times in the turn. Riding with locked arms like Dennis Hopper in Easy Rider may seem cool, but it puts you in a very poor control position. You may need to scoot up in your seat to keep your arms bent. You may need to adjust or even get a new seat, handlebars, or both. If the bike doesn't fit you so you can stay in a good riding position, adjust it so it does. With arms slightly bent, pressing forward on the hand grips is easy and precise. With locked arms, you have to press from the shoulder and this tends to be difficult and 'sloppy.'

• Lane position. Keep all of you and your

bike well within your lane at all times. It is very common to see riders with their tires right next to the centerline. This means their handlebars, mirrors, saddlebags, and (in left hand curves) their head can be over the line (in the other lane!). If you want to take it home with you, keep it well within your lane. Put some space between you and the center line. • Eyes on target. When riding a motorcycle, you tend to go where you look. If you've ever seen motorcycle racers or motorcycle police officers doing cone drills, they all very aggressively look where they want to go.

It is human nature to want to look down, or look at the potential trouble. "Oh no, I'm going over the centerline!" and we stare right at the centerline, ensuring that it happens. It takes practice and discipline to use 'target fixation' to your advantage. If you tend to go where you look, then look where you want to go. Simple in theory, but if you never practice it, you are unlikely to be very good at it in an emergency. If you want the bike to complete the turn, turn tighter, and make it go down the road, look through the turn and down the road. Eyes up and level with the horizon; nose pointed to where you want to go.

None of this is rocket science, but neither is it common knowledge or common practice. If you learn, practice, and master these items, you will develop corner control. When you have corner control, not only is riding much more fun, but you also greatly increase your chances of staying out of the crash statistics. Ride safe, ride well, ride lots. -Ax
