As our temperatures here in Arizona start too cool down some, the election is heating up. I see people very passionate about whichever presidential candidate they are choosing to support. Me, being the instigator that I am, have some fun at times poking the bear with folks. I recently told a friend that there was no way I could vote for Trump because of his hair and that I was voting for Clinton. I think his eye twitched as a blood vessel was trying to burst in his head. On the flip side, I told a very liberal female friend that I refused to vote for a woman and that the only thing Hillary is good for is making a sandwich. I think she had to gargle with Listerine before kissing her kids after the language she spewed at me. I did tell both I was kidding. I am
There are so many implications of having the wrong representation at the capital. I get emails every day of proposed legislation from around the country that makes me shudder. From increasing the ethanol in our fuel to motorcycle checkpoints to handlebar height laws, it’s scary knowing what certain states are going through. I am glad we have a strong and active motorcycle presence here in Arizona. Your voice matters. We have seen over the past few years what we can get accomplished if we move towards to common goals. Things like emissions testing for motorcycles gone, HOV lane access, the right to decide to wear certain equipment or not. One election cycle can change the way you are able to enjoy the wind.
The American Motorcyclist Association (AMA) is doing a grassroots push to get people to vote like a motorcyclist. ABATE of Arizona has been saying this for years. The AMA has put out a voter’s guide as well. You can go to their website www.americanmotorcyclist.com to find it. This is from their website: “As citizens we should exercise our right to vote and weigh the candidates’ positions on issues important to us. In particular, motorcyclists should take note of where candidates stand on motorcycling issues.” So let me encourage you to vote like a motorcyclist.
Your ABATE leadership sent out a survey to
all members a few months ago. Based upon the issues that are important to the membership, a survey was sent out to all the candidates to see where they stand on those four issues. Four issues! I’ll get to that in a minute. Thanks to Woody from our High Country chapter, the results are in, compiled and posted. Check it out on the ABATE of Arizona website.
When I received the email from Woody with the results from the candidates I got a little excited. I wanted to see where certain candidates stood and if they made any comments. I was wholeheartedly disappointed. Alot of incumbents did not respond. A big DNR. I felt slighted in a way. I can understand if a presidential candidate does not respond but a local state candidate? Come on people. Take a look at the list. I feel as if the candidate/incumbent just blew me off personally. Yes, I take things like that a little too personal at times and makes me mad. Maybe that’s why some people call me Grumpy. I for one am giving a DNR to those incumbents who did not respond. Do Not Reelect.
Do your research on all the candidates. Don’t listen to the pundits. Don’t listen to the ads. Vote your conscience. And vote like an Arizona motorcyclist.

In fact, three bikes in the last month have come into the shop with fuel system issues I can only attribute to the ethanol in the fuel. Here's an article for info. Pass it along to any rider you know in any state. Call your representatives to let them know how ethanol is harming your bike. Let us know what they say.

The Saga Of Ethanol E15 Continues Reprinted from http://cyrilhuzeblog.com The American Motorcyclist Association (AMA) informed its members that it appears that the U.S. Environmental Protection Agency (EPA) is reviving the 4-gallon minimum fuel purchase at blender pumps that dispense both E10 and E15. Everybody thought that this issue was put to rest in 2012!
As part of its E15 “Misfueling Mitigation Program”, the EPA is allowing retailers to
sell fuel with 10 percent ethanol from the same pump used for blends of 15 percent ethanol. This creates a problem for motorcyclists, who could wind up with as much as a quart of E15 in their tanks even if they select the proper grade of fuel. The ethanol lobby is promoting this approach offering this advice. “E15 can be sold on the same hose with gasoline (E0 to E10). Just require a minimum purchase of four gallons and apply a label

On October 15th in the afternoon High Country Chapter is hosting their 11th annual CHILI COOK OFF! This runs from noon until 5PM at the Spur Bar in Start Valley, AZ. FMI call “CC” at (928)476-1955. Lastly Phoenix-Shadow Mountain Chapter is hosting their annual “MOON MULLINS RUN” which is an afterhour’s jaunt in the cool October evening also on October 15th .

Hello to all my fellow Freedom Fighters! Well as I sit down to write this summer is officially winding down. The days are getting a little shorter, the nights are cooler and the humidity has dropped. The night time low here in Tucson is finally back to about 70 degrees. As the rest of the country prepares for winter we here in the desert areas of Arizona are gearing up for the best riding weather.
As I look over the calendar I see many, many upcoming events. Every year there is a big increase in activity as the calendar flips over to October. Our ABATE

Information on all these events can be found here in the Masterlink. If you work it right you can ride up to Star Valley for chili in the afternoon and still make the Moon Mullins Run in the evening.
The Arizona Confederation of Motorcycle Clubs is holding their annual fund raising event THE RIOT ON THE RIVER! This takes place the weekend of October 21st, 22nd, 23rd at the Winkleman Gila River Park. ABATE of Arizona is a charter member of the ACMC and I encourage everyone to attend. I try to attend every year and have always had a great time. It is really a good time to meet riders from all around the state and ABATE members for other chapters. I hope to see you there. The primaries are over and we are enter-
ing into the final few weeks of the political campaign season. I really want to encourage everyone to get out and vote! Woody, Sean, Johnny D and Mike and have worked very hard at trying to get candidates from around the state to answer our short questionnaire on how they stand on issues affecting motorcyclists here in Arizona. The results will be shared with you. Unfortunately not every candidate or their staff responded. The results are just one more resource for you to use when determining who has earned your vote. Please take this duty very seriously and make informed decisions. When you do go to the polls remember to wear your riding gear and also ride your bike to let those who are working the polls know you are a motorcyclist and you are involved.
As many of may have heard the state of California has finally passed legislation to make lane sharing legal. This is the first state to do so. Most folks thought that it was always legal in California but that was not the case, it just was never actually listed as being illegal. They have now made it legal and have set when and where it is allowed and various conditions etc. This is a big step for all the other state looking into this. As this moves forward and data is collected it will make it easier to make a factual argument to bring to other legislatures around the country. Next week a few of us will travel to Oklahoma City to attend the Meeting of

the Minds which is put on by our friends at the Motorcycle Riders Foundation out of Washington DC. This a conference of motorcycle rights advocates from around the country. There are seminars and meetings to exchange ideas and learn how others are dealing with issues facing the motorcycling community in their states and maybe we can learn how to do it better here in Arizona. We will report back in the next issue of The Masterlink on what we learned and how it may affect us here in AZ. If you are not a member of the MRF I would like to encourage you to join. They do for us on the national level what we try and do here in Arizona on the state level. The information on the MRF and the MRF Awareness & Education can be found here in the Masterlink or go to www.mrf.org. Please as you go about your travels either on your bike or in your cage, be aware of what is around you. This time of year we get a big influx of winter visitors and college students who are away from home for the first time, and who may not be familiar with the area etc. The weather can also be very changeable especially in the higher elevations. Well now would you look at that another month has gone by bringing us closer to the reason we all love to live in AZ. RIDING SEASON. While most of the rest of the states are starting to prep for the long winter months of limited to no riding, we are just coming alive. Now starts the adventures, the there just isn’t enough of me to go on every ride and Damn it I have to go to work time of year. Nobody can say there is nothing to do on a weekend from now until the heat returns.
Since we are on the subject let’s talk about the “HARD ASS RUN” this years will be the 14th annual. It is on October 8th, get out your calendar, create a reminder and mark yourself busy for the day. Depending on how sensitive your tushie is you may need to set aside the next day too. Registration is at the Trough Bar & Grill it starts at 7:30am, kickstands up at 9 am. $20 solo & $30 2 up, Other than I will see you at registration and I’ll be the last bike out I couldn’t tell you more if I wanted to this year. MUHAHAHAHAHA.
It has been said many times it pays to come to the monthly chapter meetings. I know from time to time we all have things that come up, life happens. 50/50 went to the ever handsome Shorty to the tune of $5 which he graciously donated back to the chapter. Thank you, Shorty. Dollar jar has sky rocketed to a whopping $256 which could have been enjoyed by our lovely #110 Patty S. Oh well, maybe next time.
I figured it was past time to go check out one of our business members. So Nolan and I took a little putt over to Gypsy’s Roadhouse. It is a very comfortable, welcoming place with the most wonderful people. It was late afternoon early evening, so not prime party time yet, when we first walked in there was only 4 or 5 people but a few more started wandering in as we were leaving. Andi was the lovely lady who took care of us while we snacked on some chicken strips she is awesome and very attentive. Thanks Andi for making our visit so pleasant and us wanting to return. Would be a good place for a chapter adventure or event? Hmmmmm.
As many of you may know our after meeting East Valley adventure this month was Biker Bowling at Fat Cats in Gilbert. East Valley chapter glove slap challenged Phoenix Shadow Mountain chapter to a bowling duel. I won’t get into all the sweaty details here but the bowling pin trophy is at Jim Silk’s house. Woo Hoo go East Valley! We admit that as with any new adventure we have some details to iron out. Everyone had a blast. I know that I look forward to the next one.
Motorcycles on Main is back on the first Friday of the month. Mike Shearhart and crew were there with our ABATE booth in energetic spirits as always working on educating the masses on who we are and what we do. Look forward to seeing everyone next month on Friday October 7th the day before the HARD ASS RUN!!!!!!

Hello Brothers and Sisters.
Up here in the High Country the weather is great for riding. Although it has been cool at night and in the mornings, it been just right during the day. Monsoons have begun to subside a little, but don't let that fool you, always be prepared when riding in the mountains. Stay alert and watch for elk, this being rut season herds are on the move. You don't want to meet by accident.
October 15th is our 11th Annual Chili Cook-off. Hans Olson will be preforming. Bring your best chili and enter to win $100+ and a damn fine trophy. If you don't know how to make chili, but you're a pro at eating it. Then come be a judge. If your not that good at being a judge, but
you just like chili. Then come eat, there will be plenty. There's something for everyone, just bring your appetite for good music, food, and fun. Starts at 11am, Spur Bar in Star Valley. All entries must be in by noon.
Both State and Chapter elections are right around the corner. So if you think you know someone that would be beneficial to the organization to have them in an officers position, nominate them. If you believe you have what it takes to take on an officers position, then step forward. New people, and new ideas is what helps us to grow as an organization and a family, and both are welcomed.

Phoenix/Shadow Mountain Chapter
The Phoenix/Shadow Mountain Chapter met on Sunday, August 14th at the AAIC. Scott, our Sgt at Arms opened the meeting with a recital of the Pledge of Allegiance followed by a moment of silence. Our Coordinator Mike led the meeting, and among other things the following was discussed.
Sunny’s Treasury report was approved and Jeremy updated us on local runs and events. Jean filled in for the Safety report and mentioned the lane splitting (aka: lane filtering) law passed in California. Those in the conversation were divided on how such laws should be implemented if legalized here, or felt it should remain illegal. However, we seemed to agree on the need for driver awareness programs if it was allowed. Another safety tip shared was to remember to leave your motorcycle in gear when stopped. The time it takes to pull the clutch, lift your foot and shift a gear could have been the amount of time you needed to save yourself from a very bad situation. So, keep it in gear in case you need to move out of the way for a fellow rider or if you need to escape to a safer part of the roadway.
Mike, our Chapter Coordinator, informed us of an opportunity for ABATE to be the non-profit sponsored by EagleRider at their events in late March or early April 2017. Visitors to this meeting included Ray Strauss, a MRF member and former Buckeye city councilman; and Dave McGrew, member of the Coalition Of Independent Riders (C.O.I.R.) and an Arizona lobbyist. First, Ray discussed his run in the primary for Arizona’s 4th Congressional district, his reverence for motorcycling and his wish to respect the rights of motorcyclists if elected. Dave informed us about the current state of motorcycle profiling by law enforcement and the progress being made to advance anti-profiling legislation. Both Ray and Dave took questions from Chapter members and were well received by those in attendance.

The August meeting was held on the 20th at the Kettle Restaurant. The meeting was called to order with the Pledge of Allegiance, and a prayer for all those in harms was and our fallen brothers. We also reminded everyone to keep our Sgt of Arms “Grinder” in your prayers as he is going through so very serious health issues and the State PAC office Johnny D who underwent surgery and is still recovering.
The minutes of last month’s meeting were approved as written, and the Treasurer’s report was accepted. Our annual raffle was held at the August meeting. The total prizes payout was $500.00 which broke down as follows: 1st - $300, 2nd $150.00 and 3rd - $50. This fund raiser supports the Chapter and allows the Chapter to send a representative to conferences like the upcoming “Meeting of the Minds” put on by our friends at the Motorcycle Riders Foundation, make contributions to various organizations and causes. I want to thank everyone who purchased tickets and especially those who sold tickets. Once again our own Bob “Gizmo” Welton did an outstanding job of running this year’s raffle.
Mark your calendars for the weekend of Oct 21 – 23. Our Chapter is planning on sending a good size group of us to the ACMC “Riot on the River”. This event includes a weekend of camping. It is held up in Winkelman, AZ.
Our road clean up will be held after the October meeting. Anyone who wants to come out and help the Chapter clean our 1 mile stretch of roadside down in Whetstone, AZ is welcome to come along. H-D CEASES SALES OF PERFORMANCE DEVICES THAT ADD TO AIR POLLUTION
Without conceding, Harley-Davidson will pay $15 million in fines and penalties to settle a federal lawsuit brought by the U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice (DOJ) accusing the American motorcycle-maker of selling illegal performance devices that increase pollution.
Under terms of the settlement on Thursday, August 19, 2016 Harley is to stop selling its "Screamin' Eagle" Pro Super Tuners by August 23, and to buy back and destroy all such tuners in stock at its dealerships. H-D must also deny warranty claims if owners continue to use the "illegal devices."
The consent decree resolves government allegations that Harley-Davidson sold roughly 340,000 "super tuners" since 2008 that, once installed, cause motorcycles to emit higher amounts of certain air pollutants than what the Milwaukeebased manufacturer certified to the EPA. According to the EPA, the modified settings increase power and performance, but also increase the motorcycles’ emissions of hydrocarbons and nitrogen oxides.

Harley did not admit liability, and said in a statement it disagrees with the government's position arguing that the devices were designed and sold to be used in "competition only." The Motor Company said the settlement represents "a good faith compromise with the EPA on areas of law we interpret differently, particularly EPA's assertion that it is illegal for anyone to modify a certified vehicle even if it will be used solely for offroad/closed-course competition."
An EPA spokesman said that the vast majority of these tuners were used on public roads, and the sale of such "defeat devices" violates the federal Clean Air Act. Harley was also accused of selling more than 12,600 motorcycles that were not covered by an EPA certification that ensures a vehicle meets federal clean air standards.
"Given Harley-Davidson’s prominence in the industry, this is a very significant step toward our goal of stopping the sale of illegal after-market defeat devices that cause harmful pollution on our roads and in our communities," said John Cruden, head of the Justice Department's environmental and natural resources division.
The EPA has been investigating aftermarket part emission issues for more than five years. In 2012, Suzuki Motor Corp paid an $885,000 fine to EPA for selling 25,458 ATVs and dirt bikes because they were built to allow for the installation of
an after-market part that increased horsepower and emissions.
CALIFORNIA LEGALIZES LANE SPLITTING, GOVERNOR SIGNS BILL INTO LAW
California has become the first state to formally recognize lane splitting as a legal maneuver for motorcyclists, as Governor Jerry Brown signed Assembly Bill 51 into law on Friday, August 19, 2016.
The legislation does not specify rules for lane splitting, but simply a) defines lane splitting as “driving a motorcycle, that has 2 wheels in contact with the ground, between rows of stopped or moving vehicles in the same lane, as specified”; and b) authorizes the California Highway Patrol (CHP), in consult with other agencies and organizations, to “develop educational guidelines relating to lane splitting in a manner that would ensure the safety of the motorcyclist, drivers and passengers.”
Lane splitting has long existed in a legal gray area in California, without being expressly prohibited nor allowed, but permitted by law enforcement. The CHP published educational guidelines on lanesplitting in 2012, but regulators later ruled the agency had no authority to make public policy.

PAGE 5 The bipartisan bill, sponsored by Assembly members Bill Quirk (DHayward) and Tom Lackey (R-Palmdale), passed unanimously through the state Senate 38-0 and the Assembly 74-0 and essentially clarifies that the CHP does in fact have the authority and permission to devise guidelines for splitting lanes.
Many studies have found proper lane splitting to be safe, and the practice of "filtering" through traffic to reduce congestion is legal in much of the world.
RESTRICTING ETHANOL LIMITS IN AMERICA'S FUEL
NCOM Board Member Dave “Animal” Reid (Touring Groups Liaison to the National Coalition of Motorcyclists) recently reported that; “I sent a letter to my congresswoman about the EPA’s desire to increase the ethanol content up from E-10 to E-15, and what it might do to all manner of small and air cooled motors.
She responded, saying that a congressman from Texas had introduced a bill that would prohibit the EPA Administrator from introducing anything greater than 9.7% into the fuel supplies.

Folks of both our Confederation of Clubs (COC) and ABATE inquired about the bill, and I’ve tracked it in the U.S. House of Representatives - it’s fresh and has quite a list of co-sponsors, so with other changes happening in the world, with the bipartisan support it seems to have, it may see some forward movement."
That measure, House Resolution 5180, was introduced on May 10, 2016 by U.S. Representative Bill Flores (R-TX) "to alleviate the ethanol blend wall under the renewable fuel program," and has been referred to the Committee on Energy and Commerce. H.R. 5180 currently has 103 cosponsors from both sides of the aisle.
The bill effectively circumvents the Renewable Fuel Standard (RFS) mandates for increasing levels of ethanol in our gasoline, capping the level at E-10, stating "the Administrator shall not determine any renewable fuel obligation for a calendar year that would result, directly or indirectly, in the introduction into commerce in the United States of a total volume of ethanol contained in transportation fuel that is greater than 9.70 percent of the total volume of gasoline projected to be sold or introduced into commerce in the United States for such calendar year." ILLINOIS OKAYS BLUE-DOT TAIL LIGHTS
"Blue Dot" tail lights, so-called because a blue crystal mounted in the center of the red lens cover emits a violet hue when actuated, have become popular with motorcyclists for both customization and conspicuity, but most states' traffic codes specify that a tail light must be red in color, and therefore they are illegal.

be equipped with a blue light or lights of up to one inch in diameter located on the rear of the motorcycle as a part of the motorcycle's rear stop lamp or lamps," and was signed into law by Governor Bruce Rauner on July 22, 2016, becoming effective January 1st.
RIDERS AND DRIVERS NOW HAVE OPTION TO "RIDE ON RED" IN PENNSYLVANIA
Motorcyclists and motorists in Pennsylvania will no longer have to wait at a traffic light that is locked on red, as Governor Tom Wolf signed into law a bill sponsored by Rep. Stephen Bloom (R-Cumberland) that allows drivers of all vehicles the option to proceed with caution through an intersection when a traffic signal is unresponsive, only after exercising due care as provided by law.
“If the vehicle detection system fails to recognize the vehicle and the driver has come to a complete stop, the driver must then make sure it is safe to continue, and only then would they be able to lawfully proceed with caution through the intersection,” Bloom explained to FOX43 News in Harrisburg, PA.
Originally intended only for motorcycles, which often fail to trigger traffic lights due to their smaller size, Senate Bill 1267 was expanded to apply to all vehicles.
Deemed “Ride on Red,” Bloom added that the goal of the legislation is to solve practical problems while ensuring safety. “This law does not give drivers a free pass, but ensures a safe and legal option to avoid the danger and inconvenience of being trapped in perpetuity at a locked red light,” Bloom said. “This issue is more common than many people realize, especially on rural roads or during late hours when long periods often elapse before a heavier vehicle comes along to finally trip the unresponsive light.”

Signed into law on July 20, 2016 as part of Act 101, the new law takes effect 60 days after the bill-signing, near the end of September.
CRASHES INVOLVING DISTRACTED TEENAGERS ON THE RISE
Not only have inattentive Pokémon GO players caused accidents with everything from motorcycles to police cars, it gets even more dangerous when teenagers get behind the wheel with their phones. The AAA Foundation for Traffic Safety reports that 59% of teen crashes involve distractions behind the wheel, and highlights a disturbing trend showing that texting and social media use are on the rise amongst teen drivers. In collaboration with researchers at the University of Iowa, as part of the most comprehensive eight-year research project ever conducted into crash videos of teen drivers, the AAA Foundation analyzed the moments leading up to a crash in more than 2,200 videos captured from in-car dash cameras:
- Talking or attending to other passengers in the vehicle: 15% of crashes - Talking, texting or operating a cell phone: 12% of crashes
- Attending to or looking at something inside the vehicle: 11% of crashes
This supports findings by Pew Research Center, which shows text messaging has become a key component in day-to-day interactions among teenagers. Fifty-five percent of teens spend time every day texting, sending an estimated 80 text messages per day.
Research by the Virginia Tech Transportation Institute found that texting creates a crash risk 23 times worse than driving while not distracted. A recent AAA Foundation survey shows that nearly 50% of teen drivers admitted they had read a text message or email while driving in the past 30 days. NHTSA’s National Occupant Protection Use Survey also shows that from 2007 to 2014, the percentage of young drivers seen visibly manipulating a hand-held device quadrupled. Some states have laws against using a cell phone while driving for any reason, but most do not.
Of states, 39% ban cell phone use for under 18 and 46% ban texting while driving.

Yamaha Motor Co. is working on the use of artificial intelligence to enhance motorcycle safety. The system, developed jointly with a U.S. research body, is based on the same one revealed last year that allows humanoid robots to test ride motorcycles.
The objective is to reduce motorcycle spills, said company President Hiroyuki Yanagi. “We want to facilitate driving operations of our motorcycles and reduce the burden on riders to allow them to pay more attention to safety,” said Yanagi. Yamaha hopes to reverse slumping domestic sales by adopting advanced technologies to reduce motorcycle accidents such as overturns and collisions.
“We’ll use the expertise we’ve acquired from robots for our motorcycles,” Yanagi said. “We’ll promote the development of technologies to make motorcycle driving easier.”

gallons. And, even motorcycles with larger tanks could end up with a blend with more than 10 percent ethanol. Or, end up fueling what you think is safe fuel and end up with something much worse. AMA thought common sense prevailed at the EPA when on Dec. 17, 2012, the agency informed the AMA it had reversed its
decision to require the 4-gallon minimum purchase.
After reading the pro-ethanol group’s “roadmap”, AMA immediately sent a letter to the EPA and contacted the EPA public relations office for clarification. The agency has not yet responded to AMA’sletter. But the media inquiry prompted a response. According to an EPA spokesperson:
Dispensing E10 in volumes less than 4 gallons from a pump that supplies E10 only is absolutely NOT a violation. The excerpted portion you highlighted should refer only to the less than 1% of gas stations that have gasoline pumps that dispense BOTH E10 and E15 from a single hose or nozzle. The 4 gallon fueling minimum for E10 is only required for these “co-dispensing pumps” and is there to protect consumers. The 4 gallon minimum ensures that engines that are not allowed to use E15 (like those in motor-
cycles) do not inadvertently get too much ethanol in the tank. To comply with EPA regulations, most stations with co-dispensing pumps simply put up a sign that says the co-dispensing pump may only be used for passenger vehicles and separately offer a dedicated E10 pump for motorcycles and other engines that cannot use E15. Motorcyclists or other types of vehicles and engines that require E10 in volumes of less than 4 gallons should not have a problem finding E10 in any volume they need.

The RFS Standard and the Next President
WASHINGTON, DC– Over the past several years, motorcyclists have shown an increasing interest in the politics surrounding ethanol, and more specifically, the Renewable Fuel Standard. Congress adopted the Renewable Fuel Standard (RFS) in 2005 and expanded it in 2007. The program requires oil companies to blend increasing volumes of renewable fuels like ethanol with gasoline and diesel, culminating with 36 billion gallons in 2022.
Ultimately, the effects of the mandatory increase in renewable fuels will be seen at the pump. Critics of the RFS are concerned that they will be forced to use higher ethanol-blended gasoline like E15 in their bikes. And their concern is valid. There is reason to believe that ethanol can impact smaller engines like those used in motorcycles, boats, snowmobiles and power equipment among others. Higher levels of ethanol put into a small engine, can make it run at higher temperature. Further, because ethanol is an alcohol, it attracts water. When you have water that comes into an engine, the potential of corrosion can occur.
Needless to say, motorcyclists are concerned. But so are many others. Because there is so much controversy over the ethanol mandate, we have seen Congress introduce dozens of measures that both support and criticize the current mandate. However, as the legislative year winds down, it is looking less and less likely that any of these proposals will be passed into law. As an effect, both ethanol proponents and critics are looking at the issue through the lens of a possible Trump Administration or Clinton Administration. Rhetoric on the issue between the two candidates can give some indication of where they might fall on the contentious issue of ethanol.
At an event hosted by the Iowa Renewable Fuels Association, Trump clearly stated to the room of ethanol sup-
porters that he supported higher blends of ethanol and that the EPA should follow through on the ethanol mandates set forth by Congress. Though he made his position crystal clear, it’s important to remember the setting for the speech and also that the speech was made just days before the Iowa caucus; a critical state during primary season. Although since then and more recently, Mr. Trump has been quoted as saying that ethanol is, “the key to complete American energy Independence,” even meeting with major ethanol producers.
For former Senator Clinton, she made waves recently, when it was reported that that the Clinton campaign had discussed the Renewable Fuel Standard with Mary Nichols, chairman of the California Air Resources Board, a noted critic of the ethanol standard, and potential Clinton EPA chief. Though when asked, a Clinton spokesperson rejected the notion that Mrs. Clinton would repeal the RFS. It also should be noted that in May, Mrs. Clinton wrote an op-ed for an Iowa publication where she indicated that she supported the ethanol mandate but there was room for improvement.
Given the controversy surrounding the issue, it’s likely that both candidates will be asked for their positions during the presidential debates leading up to the November elections. Both those who support and those who oppose the ethanol mandates are likely to be listening with baited breath in an attempt to predict what the future holds for ethanol in America.

Today, the U.S. Department of Transportation’s National Highway Traffic Safety Administration released an open data set that contains detailed, anonymized information about number of people who died on our nation’s highways in motor vehicle traffic crashes in 2015. The data showed traffic deaths ris-
ing across nearly every segment of the population including motorcyclists. Motorcyclist deaths increased over 8 percent. In response to the increase, DOT, NHTSA, and the White House are issuing an unprecedented call to action to involve a wide range of stakeholders in helping determine the causes of the increase. NHTSA will share its Fatality Analysis Reporting System (FARS) with safety partners, state and local officials, technologists, data scientists, and policy experts. According to NHTSA, job growth and low fuel prices were two factors that led to increased driving, including increased leisure driving and driving by young people. Undoubtedly, the increase in motorcyclist fatalities will result in an increase of pressure for tougher stances on universal helmet laws and mandatory safety wear. We’ll need to come together to address the increase and be prepared to discuss the findings. As a start, I have also attached a press release from earlier this summer where the MRF refutes similar findings from the Governors Highway Safety Administration and ‘digs in’ as to how a universal helmet law is not the solution. Government Study Announced on Motorcycle Conspicuity
WASHINGTON, DC – The Governors Highway Safety Association (GHSA) held its annual meeting this week in Seattle, WA. The theme for this year’s event emphasized the importance of safe driving behavior in an era of rapid technological advancement. More than 500 state highway safety officials and advocates were in attendance including government officials from the Department of Transportation, the National Highway Traffic Safety Administration as well as representatives from State Motorcycle Rights’ Organizations and the Motorcycle Riders Foundation.
During the course of the conference, plans regarding an upcoming motorcycle study, funded by money in the highway bill passed by Congress late last year, were announced. Though in the early planning stages, the study is aiming to address motorcycle crash prevention. This is a pivot from previous positions from government officials whose sole focus appeared to be geared towards “safer crashing” through the practice of universal helmet laws.
Though details of the upcoming study remain limited, it appears that it will examine the impact of high-visibility clothing and effects on motorcycle crashes. The project is in the solicitation process but the details suggest a hypothesis aiming to prove high visibility clothing can prevent motorcycle accidents. Details including available data, the entities or contractors conducting the study and when the study will be released will be available in the coming months. Depending on the outcome and findings of the study, legislative and regulatory activity by states and the federal government could follow. ==========================

2015 Motor Vehicle Crash Data Released; Increase in Motorcyclist Fatalities
WASHINGTON, DC – This week, The National Highway Traffic Safety Administration (NHSTA) released 2015 data concerning motor vehicle crashes and fatalities. This data also included information on motorcyclist fatalities. The data comes from NHTSA’s Fatality Analysis Reporting System (FARS) as well as the National Automotive

Sampling System and General Estimates System. The information provides an overall measure of highway safety, and aids in guiding policy solutions for federal and state lawmakers as well as provides a basis to evaluate the effectiveness of motor vehicle safety standards and highway safety programs.
In 2015, the nation saw an overall upward trend in vehicle crashes and fatalities across all segments of the population. Overall, there was a 7.2 percent increase which is the largest percentage increase in almost 50 years. Increases in fatalities were seen in all types of vehicles and roadway users including SUVs, vans, trucks, pedestrians, bicyclists and motorcyclists. Specifically, motorcyclists’ fatalities in 2015 had an increase of 8.3%, the largest since 2012. There were other statistics, specific to motorcycles that are of note:
While the proportion of people killed ‘inside the vehicle’ (which includes drivers and passengers of cars, trucks, etc.) has declined by roughly 15% over the last decade, the proportion of people killed ‘outside the vehicle’ (which includes motorcyclists, pedestrians, etc.) has increased by roughly 15% over the last ten years. There were increases in motorcyclist fatalities in every age group except those 19 and under which saw fewer fatalities in 2015 than in 2014. Though not specific to motorcycles, the most common fatal crash type in 2015 was multi-vehicle rollovers. Data showed that crashes due to ‘human choice’ specifically distracted driving, increased by almost 9%. Other ‘human choice’ factors included alcohol impaired drivers in which fatalities increased overall by 3%. Interestingly, there was a half percentage point drop in motorcyclists who had been involved in fatal crashes due to alcohol-impairment. This may suggest that some of the recent motorcycle and alcohol awareness programs could be starting to take effect.
The NHTSA release offered some possible explanation for the overall upward trend in fatal crashes. Specifically, it linked economic trends like a recovering economy and lower gas prices as reasons more people were on the road, likely due to work travel and increased recreational travel. Warmer weather and milder winters which some of the nation saw in 2015 were also contributing factors.
Though no specific policy solutions were
offered with the NHTSA release, it was noted that, “in States without universal helmet laws, 58 percent of motorcyclists killed in 2015 were not wearing helmets, as compared to 8% in States with universal helmet laws.” This is likely an indicator that NHTSA will continue its position in viewing universal helmet laws as a solution for highway safety. This emphasizes ‘safer crashing’ rather than crash prevention; of which many motorcyclists find fault.
In response to the release of the data, The White House and Department of Transportation are issuing a call to action to involve a wide range of stakeholders in helping determine the causes of the increases seen in the 2015 crash and fatality data. NHTSA announced plans to share the information with its safety partners, state and local officials, technologists, data scientists, and policy experts. States and the nation as a whole are likely to see policy solutions offered and initiatives brokered over the following weeks and months as a result of the newly released data. The motorcyclist community is also in the process of responding to the recently released data through reviewing and confirming the information and preparing to work with the federal agencies to ensure that policy solutions are achieved through the lens of crash avoidance and do not infringe upon their personal rights. These activities will complement the already existing efforts being achieved at the federal and state levels like emphasis on rider education, alcohol awareness programs, share the road initiatives, motorcyclist awareness programs and reduced distraction efforts. State Legislator in Fatal Motorcycle Crash;
Details Raise Questions About Strategies to Address Motorcycle Safety
WASHINGTON, DC – This week, Pete Pettalia, a lawmaker who served in the Michigan State Legislature was fatally injured when a pickup truck turned directly into his lane. It is important to note that, Pettalia, was wearing a helmet at the time of the incident.

State Representative Pettalia was an avid motorcyclist rights defender and advocate playing a key role in what would eventually become the repeal of the helmet law in Michigan state in 2012. News sources like CNN quickly tried to appeal to the irony that a critic of a universal helmet law was killed in a motorcycle accident. CNN’s headline read, “Lawmaker Who Opposed Universal Helmet Law Dies in Motorcycle Crash.” You would expect CNN to be more professional, the headline infers that the lack of a helmet was the reason for the fatality. This biased headline and notion is completely false as reports confirmed that the lawmaker was wearing a helmet at the time of the incident.
This particular occurrence is, very unfortunately, one that has been repeated in the past. Despite helmet use, drivers of the four-wheeled variety often fail to see motorcyclists for a multitude of reasons that can include distracted or reckless driving, or simply the failure to be aware of their surroundings. It is for reasons like what caused the crash involving Mr. Pettalia and others like him, that groups such as the Motorcycle Riders Foundation emphasize the concept of crash prevention rather than safer crashing. The reality is, even if riders choose to wear and helmet and all the protective gear available, it is often not enough to stand up to reckless and distracted driving by motorists who fail to adhere to the oftrepeated biker adage. “Look Twice, Save a Life.” Biker Rights’ activists including SMROs (State Motorcyclist Rights Organizations) are doing their part to emphasize rider education for motorcyclists and driver awareness for the majority of the population behind the wheel. The battle is likely to mount, as referenced by the National Highway Traffic Safety Administration’s recent Fatality Analysis Reporting System (FARS) report which showed that crashes due to ‘human choice’ errors, specifically distracted driving, increased in 2015 by almost nine percent. Though it’s not clear what caused the pickup truck driver to drive into Mr. Petallia’s lane, a safe assumption is that it could have been prevented and that, in this instance, a helmet did not make any difference in keeping the lawmaker safe. Yet, there are many, many groups across the nation that point to helmet use as the ‘cure all’ problems. However, the tragedy that occurred this week speaks to what

Arizona Department of Transportation (DOT) requires that you a Class M motorcycle license or endorsement to legally operate a motorcycle. Penalties for not having an M endorsement can range from fines to license suspension and even bike impoundment.
AMSAF has received grant funding for Motorcycle scholarships to obtain your M endorsement. Check out the article in this edition on the grant details that cover the bulk of the cost. A wise investment, especially if you have been riding illegally. Through the grant process, you pay $100 towards a riding school of your choice. The MSF course is 3 days. Arizona Motorcycle Riding Schools will issue students who successfully pass the written and riding evaluation, and meet all of the
course completion requirements a “Motorcycle Safety Foundation Completion Card”. When you take the Completion Card into an AZMVD Driver’s License office they will typically issue you a new license with the “M” endorsement added. This Completion Card is issued only to riders who successfully complete either a Basic Riders Course or Confident Riders Course. (CRC Previously known as Intermediate). Not only do you get to receive your endorsement but you learn the essential skills on riding, breaking, maneuvering and preventing crashes. Surprisingly, some insurance companies will even issue a discount for taking an MSF course. To me that is an easy process. …. Or you can choose to go to the MVD to apply and complete the written and riding course skills test the same day. The skill test is difficult on a full size bike. If you are an applicant from out of state and you have a valid motorcycle license or endorsement, you may simply trade in your out-of-state license for an Arizona one. You will not need to take the driver education/driving practice, and you will not be required to follow the instruction permit requirements.
If the state that issued your license has a similar skills test to that of Arizona, you may also be exempt from the skills test, though you should be prepared to take it anyway.
If you are under age 18 years old, you are required to obtain an instruction permit before getting your Class M license. To apply: - You must be at least 15 years old and 6 months. - You will need to apply at your local Motor Vehicle Division (MVD) office. Pass a vision screening. - Pass a written test consisting of questions from the Motorcycle Operator Manual (99-0129). - If you do not have a current Class D driver's license or instruction permit, you will also need to take a written driver licensing exam. - Pay the $7 permit fee.
The motorcycle permit is valid for 7 months, and can be renewed 1 time within a period of 24 months. During this time, you will need to complete either an MVD-approved motorcycle training course, or at least 30 hours of riding practice in order to receive your full Class M motorcycle license. There are some important restrictions to a motorcycle permit:
- You cannot carry passengers. - You cannot drive on freeways or interstate highways. - You cannot drive between sunset and sunrise, or at any time when there is not enough light to see other vehicles or persons from a distance of 500 ft. - You must be at least 16 years old to
apply for a full Arizona motorcycle license. I
f you are under 18 years old, you will need to: - Hold a valid AZ motorcycle instruction permit for at least 6 months. - Complete any MVD-approved motorcycle driver education program, or have your parent/guardian certify in writing that you have completed at least 30 hours of practice driving on your motorcycle. All applicants are required to: Pass a knowledge test.
- Pass an on-cycle skills test. Pass a vision exam. - Pay your licensing fee (based on your age―see below).
After you have passed both exams, you will be issued your Class M license, which is valid until you turn 65 years old. You will need to retake your vision exam every 12 years.

Every year since 1989 (a total of 27 years) when Michigan started keeping track of this data, 40% OR MORE of the motorcycle riders did not have a motorcycle endorsement and, were thus, riding illegally. In 2013 and 2015 that number reached 57% or nearly 3 out of 5 riders involved in fatal accidents, according to Michigan’s Office of Highway Safety Planning.

The real problems are UNENDORSED MOTORCYCLE RIDERS and car drivers violating a motorcyclist’s right of way, by making a left turn in front of the rider.
Additional claims are taken out of context and show a lack of integrity in their reporting. The claim that there was a
23% increase in motorcycle fatalities from 2014 to 2015 is misleading since they do not state that 2014 had the lowest number of motorcycle fatalities in ten years while 2015 had the highest number. The helmet law faction claims “The very low figure in 2014 appears to be an anomaly.” Thus the truth, buried in their report is that 2015 was normal.
ABATE Statistician, Vince Piacenti, finds this “cherry-picking” of data to falsely represent motorcycle safety records to be unprofessional. He added, “Comparing a high year with a low year is not statistically valid.”
“The reality is that deaths fluctuate with miles driven, which is affected by weather,” wrote Jarrett Skorup of the Mackinac Center. “At the end of the day, the fatalities this year are well within the range of what is normal.

The recent fatality of State Representative Peter Pettalia from a right of way violation, shows the need for a state funded motorcycle awareness program. Pete was an experienced rider.
