Al Franken visits Dakota County school Seeking feedback on No Child Left Behind BY MICHAEL RICCI – SUN NEWSPAPERS A U.S. senator did his homework at one Burnsville-Eagan-Savage Independent School District 191 recently. Sen. Al Franken (D-Minn.) spent half the day Thursday, Jan 5, in the Burnsville-Eagan-Savage school district, visiting various classrooms and concluding his visit with a one-hour listening session at Burnsville Alternative Learning Center, 2140 Diffley Road, in Eagan. Its purpose was to learn of educational successes and challenges as he prepares for the upcoming Senate debate to reform the federal No Child Left Behind legislation. Franken’s day began 12:30 p.m. He arrived at Burnsville High School, met Principal David Helke and other attendees, and then dropped by the math classes of teachers Brooke Delmont, and Jeff Nelson, as well as spending time with students from the FIRST Robotics Team and coaches Jon Huber and Hugh Scherrer. But this was all a prelude to Franken’s 3:30-4:30 p.m. visit to the Burnsville ALC.

ECM Publishers Inc. has acquired the Sun Newspaper Group from American Community Newspapers II, combining two large Minnesota newspaper groups. Signing the agreement for ECM, Friday, Dec. 30, were Publisher and Chief Executive Officer Julian Andersen, President and Chief Operating Officer Marge Winkelman, and Chief Financial Officer Rod Garbe. ECM is based in Coon Rapids. American Community Newspapers II is based in Dallas, Texas. The newly acquired newspaper group will be called ECMSun Group LLC. The combined company will now include 500 associates and 55 publications, reaching 700,000 homes weekly. “The merger of the Sun Group into ECM Publishers continues the growth of ECM, combining two strong, well-managed Minnesota media organizations,” Andersen said. “This combination creates opportunity and capability to enhance services provided to both readers and advertisers, to be active partners in an extended group of Minnesota communities, and to provide many associates the chance to step up to bigger responsibilities.” “We are excited about this new opportunity to expand our ECM PUBLISHERS: TO PAGE 7

Eagan council passes domestic partnership registry ordinance One council member sees new registry as a ‘step forward’ for city BY MATTHEW HANKEY – SUN NEWSPAPERS Eagan will soon become one of a select number of Minnesota cities that have passed a domestic partnership registration ordinance. At its Jan. 3 meeting, the Eagan City Council unanimously approved to establish a voluntary domestic partnership registry for all couples living within the city. This ordinance will make Eagan the 17th city in Minnesota to have such a registry, which includes unmarried heterosexual and homosexual partnerships. According to the ordinance, “The domestic partnership registry is a means by which unmarried, committed couples who reside in Eagan, and who share a life and home together, may document their relationship.” Other cities include Hopkins, Minnetonka, Minneapolis, Edina, St. Paul, Red Wing and Duluth. In July 2011, an Eagan resident requested that the city consider creating a domestic partner registration as a service to the members of the community, said City Administrator Tom Hedges. At a Dec. 20 listening session, the council instructed city staff to draft the domestic partner registry proposal. This city registry, which will be effective Jan. 13, will allow unmarried couples to document their relationship status. Residents in an unmarried couple ages 18 and older are eligible to register with the city clerk. Cost for a registration application is $25, which includes a certificate from the city. If the couple breaks off their relationship or finds another partner, it will cost $25 to file an amendment or termination with the city. Hedges said the registry fees are competitive with the 16 other cities that currently have the ordinance in place. “This will not provide a service for, I would gather, the vast majority of citizens here in Eagan,” said Mayor Mike Maguire. “But it does provide a service to some who want it. And, it was requested.” While the creation of the new ordinance will have minimal affect on a couple’s legal standing, one audience member outlined benefits for those who use the registry. Phil Duran, legal director for OutFront

Minnesota, said this registry will assist unmarried couples acquire insurance benefits they had previously been ineligible for. “It does make it easier for those institutions who … wish to provide health coverage to their employees and domestic partners to do so, because otherwise typically an employer will create their own registration mechanism,” said Duran. “It makes it easier to go down to city hall, pay your fee, bring a certificate and we’ll take it from there. And, employers do that. It is a benefit to the families of Eagan.” Maguire said the city has the infrastructure in place for the creation of new registries. Before the council voted, one resident questioned the council regarding the usefulness this ordinance would provide. “How does this benefit us as a city to have this ordinance go into effect?” asked resident Tim Lewis. Councilmember Gary Hanson outlined the council’s process in considering passing the ordinance. “We have carefully considered the request and as it has been discussed and as it has been developed, we saw no reason not to provide the requested service,” Hanson said. “We’re not creating any legal rights or privileges or responsibilities. So, based on those considerations, I see no reason why we should not provide the requested registry.” Councilmember Paul Bakken considered other cities history in dealing with this ordinance. In his research, he has not seen a “firestorm or a real downside” or any liability issues in creating such an ordinance. Another factor Bakken considered was that the registry would help unmarried couples apply for previously ineligible benefits. “If we can do something so simple as this to encourage people to be allowed to take care of each other, I see that as a step forward,” Bakken said. Maguire said that though this new ordinance is not monumental, if it can “[move] the ball forward” for some Eagan citizens, it’s a positive for the city. “The fact of the matter is, there are any number of different kinds of relationships that people engage in,” Maguire said. “And, unfortunately, the only one that’s legally recognized is marriage. “And, there are people who engage in relationships that aren’t marriage and are doubly or just as committed to each other, if not more so, in spite of it, and it’s just fine that a community be welcoming and recognize that.” CMYK

BUSINESS Eagan business recieves Bob Killeen Award Eagan-based business Ironwood Electronics received the 2011 Bob Killeen Award at the Dakota-Scott Workforce Investment Board’s annual legislative and awards event Dec. 16 at the Burnsville Performing Arts Center. The award recognizes companies for their quality practices. The company develops and manufactures precision test sockets for testing a large variety of very high-speed computer chips. Ironwood also designs and produces several lines of probing and analysis adapters for these integrated circuits. Ironwood’s customer base covers the medical, automotive, semiconductor, military and consumer electronics industries. Their quality initiatives include training, bimonthly machining kaizen, continuous product and design review, and regular review of product quality and customer satisfaction goals. Bob Killeen Sr. was a long-time labor representative who previously served on the Workforce Investment Board. Apple Valley Police Chief Scott Johnson retires Bids farewell to city after serving for 10 years BY MATTHEW HANKEY – SUN NEWSPAPERS After nearly 40 years in law enforcement, retired Apple Valley Police Chief Scott Johnson does not have a plan. “For the first time since I was 17, I don’t have a clue what to do with my life,” he said from his cabin in northern Minnesota. The day before he retired, Johnson was presented with the key to the city at the Dec. 8 city council meeting. Though he might not have a plan for the future, Johnson said he stands by his decision to retire. “It was kind of a gradual thing,” said Johnson. “We sold the house in November. We had to decide what we’re going to do with the rest of our lives and the time was right.” Johnson, who will turn 57 at the end of the month, began his police career with the Lakeville Police Department in 1973 as part-time dispatcher. Two years later, at age 20, he was pro-

moted to a patrol officer. Over the following years, he climbed the ranks to sergeant and later to lieutenant. Johnson’s big break came in 1998, when he became the Mendota Heights police chief in 1998. He served there for the next three years, before he took the job where he finished his career – as the Apple Valley police chief. Johnson spent the next 10 years as head of the Apple Valley Police Department. He brought years of street policing experience to the leadership position, which garnered respect of those under his command. Acting Apple Valley Police Chief Jon Rechtzigel said he appreciated Johnson’s personal work ethic, but also the way he got the best out of those in the department. “He was big into personal development and education development,” said Rechtzigel. Johnson said he took pride in having an educated department. Sixteen police staff members have master’s degrees and Johnson said the AVPD is one of the best educated in the state.

Rechtzigel was one police staff Johnson encouraged to further his education. “He told me, ‘Jon, you gotta get to work. You’ve got your bachelor’s, but you gotta get an advanced degree,’” said Rechtzigel. Johnson credits his first chief, former Lakeville Police Chief Don Gudmundson, with teaching him to be a leader. Johnson said he learned his management skills, decision-making skills, budget tracking, media relations and strategic planning from Gudmundson. “I give him a lot of credit to my success,” Johnson said. “He really did teach me how to be a police chief.” In turn, Rechtzigel said Johnson was a mentor for him, especially in advancing his career. At Johnson’s suggestion, Rechtzigel took part in a three-month FBI National Academy training in Quantico, Va. “I went off and went through that training and it was a long time away from family, but boy was that good for professional development,” Rechtzigel said. Rechtzigel said very few law enforce-

ment officials aspire to work at a desk for the duration of their workday. Johnson was no different. “You couldn’t get the cop out of him,” said Rechtzigel. Rechtzigel said Johnson would get in his car at about 1:30 or 2 p.m. every day and patrol the streets. But, his car was not equipped with all the modern law enforcement technology. His vehicle had an old radio and did not have a laptop computer, which is now prevalent in many patrol cars. “He had to have it his way,” Rechtzigel said. “The man did not forget where he came from. He’s still a street cop. It’s called humility.” Johnson said he takes pride in how many officers were promoted under his leadership. His goal was to develop people within the department to become leaders themselves. “It’s a good time to leave,” Johnson said. “I had accomplished all I wanted to as the Apple Valley police chief.” Apple Valley Mayor Mary HamannRoland said she would remember JOHNSON: TO PAGE 14

PUBLIC SAFETY Burnsville man sentenced to more than 25 years in prison Burnsville resident Jonas Gerald Grice, 29, was sentenced Thursday, Jan. 5, to more than 25 years in prison by Dakota County District Court Judge Karen Asphaug, announced Dakota County Attorney James Backstrom. Grice previously pled guilty to second degree intentional murder in connection with the shooting death of Anthony Hartman, 22, of Apple Valley on Monday, July 12, 2010, at a Rosemount car wash business. In addition to his prison sentence, Grice was ordered to pay restitution to the victim’s family as determined by Community Corrections. Grice will serve at least 17 years of his 306-month sentence before he is eligible for supervised release. Asphaug found Grice guilty in the first phase of this case on Oct. 26, 2011 following a court trial. The second

phase of this trial involved the defense of mental illness. In presenting this defense, Grice claimed at the time of the offense he was suffering from a mental illness to the extent that he did not know the nature of his actions or that they were wrong. Asphaug rejected Grice’s defense of mental illness. “While everyone loses in a tragedy of this nature, the Hartman’s have suffered the most with a tragic and senseless loss of their son, a young man with a bright future,” said Backstrom. “The defendant had a history of mental illness and violence and should never have been carrying a weapon.” Backstrom expressed his deep sympathy to the family and friends of Anthony Hartman. Backstrom also expressed his appreciation of the Rosemount Police Department who assisted in the investigation of this crime. Backstrom praised Jessica Bierwerth, assistant county attorney, and Phil Prokopowicz, chief deputy, who prosecuted the case.

COMMUNITY BRIEFS MVTA bus fleet boasts zero deficiencies for third year in a row Continuing the streak, the Minnesota Valley Transit Authority fleet of 118 buses passed their annual inspection by the Minnesota Department of Transportation with zero deficiencies for the third year in a row. The MVTA buses are annually inspected by the Minnesota State Patrol’s commercial vehicle department to ensure compliance with the Americans with Disabilities Act, bus registration and insurance compliance. The inspection includes a visual walkthrough of each vehicle, checking for defects. Vehicles are either approved for in-service operation if everything is in compliance, or the bus is “downed” if there is something wrong. The inspection is either a pass or fail. Vehicle inspection, repair and maintenance standards are critical to the safe operation of commercial motor vehicles, according to a fact sheet prepared by MnDOT. The MVTA operates more than 3.75 million miles annually and provides transit service for Apple Valley, Burnsville,

Eagan BP station takes part in Fueling Communities Day The Cystic Fibrosis Foundation of Minnesota received a check in the amount of $20,000 thanks to Fueling Communities Day at local BP stations. On Oct. 26, 33 local BP stations, including the Eagan BP location, participated in Fueling Communities Day. For every gallon of gasoline sold that day, BP donated 10 cents to The Cystic Fibrosis Foundation of Minnesota. The total amount donated came to $20,000, which was presented to Cystic Fibrosis of Minnesota at the annual Gala Nov. 19. Cystic Fibrosis is an inherited chronic disease that affects the lungs and digestive system of children and adults. Due to great advances in research into cystic fibrosis, many people afflicted with this disease can now expect to live into their 30s or even older. If someone were to have asked me 10 years ago whether I thought my brother would be running 1,000 miles in a year to raise money for breast cancer research, I would have told him he would have to wake him up to find out ‘cause he’s probably napping. When we were kids, Conor and I were more likely to be found on the couch than, well … moving. One of us is still firmly ensconced on the couch. Conor, on the other hand, has made a few strides in the right direction and has recently taken on a goal that makes the lazier of the two of us cringe just thinking about it:

running. A LOT of running. And he’s doing it for two stated reasons: First, to fight breast cancer. Second, to prove fat guys can do stuff. The whole idea started as a “disagreement” over a haircut, he told me during a recent conversation. Conor wanted to shave his head then let it grow out for a full year and document the growth along the way. His wife wanted him to be

half-way presentable for more than the first few days of January. This is where the story gets a little confused. Suffice to say, running 1,000 miles came into the mix (likely to make a point), Conor’s sporting a mohawk and new running shoes and breast cancer research has another advocate. Before I start getting emails asking why I’m shamelessly promoting a family project, I’ll tell you that’s exactly what I’m doing. As children of a breast cancer survivor — 10 years in remission — conquering cancer is high on our list of priorities. And, I’ve written

in these pages before about my admiration for dedication. Sticking with something for an extended length of time requires will power and commitment far above the norm. In short, I’m really, really stinkin’ proud. And not just a little motivated to get going and remove “the fat brother” from my list of personal descriptions. The majority of my closet is filled with decent items scored on the cheap at consignment shops and thrift stores. For me, there’s nothing like flipping through racks of secondhand clothes to discover a $5 Jean Paul Gaultier sweater someone else bought

for at least 100 times the price. Thanks for that one, Arc’s Value Village in Richfield. Usually, delight at my own luck fades to shock – People actually spend this much on a piece of clothing? – then to dismay – And then they get rid of it? – and finally, back around to gratitude. Well, at least they didn’t just throw it in the trash. So you’d think I’d be espe-

cially taken aback by the big story last week that an Edina bridal shop destroyed gowns worth thousands of dollars. All 19 Priscilla of Boston locations across the country, including the 50th and France outpost, closed their doors in the last days of 2011. In Edina, leftover dresses were spraypainted Dec. 30 with big red Xs in public view before being tossed in a Dumpster. I came across the story as it lit up my Twitter feed back at work from the New Year holiday. Other people were certainly outraged. Links to local media reports were accompanied with messages calling the move “heartless,” “disgust-

ing,” “so, so wasteful,” a “boneheaded corporate decision” and “a bad PR move.” Some said “shame on you,” “this makes me sick,” and “sad they didn’t think of others in need.” I’ll admit, while I’m not in the market for a wedding dress, if I came across a good one for the right price, I might buy it just for the deal. But better yet, as many said, the dresses could have gone to a number of nonprofits that help provide special moments for women in need. It said it would do better next time. “David’s Bridal has already begun bringing together all of the remaining Priscilla of Boston gowns to evaluate them and ensure that they are donated to our charitable partners wherever possible,” the apology read, in part. But should they have to apologize? I am not condoning the defiling of dresses said to be worth thousands, however, I think there are plenty other areas of waste that go without the same level of fury. Hotel rooms empty at nightfall aren’t opened to people who could use the shelter. Movies, plays and concerts

don’t give away seats still open on the day of the show. Restaurants and bakeries throw out uneaten goods. I sometimes let food in my own fridge go bad even though there are starving children in Africa. I, and probably you, would not do what David’s Bridal did. Really, who thought it was a good idea to blatantly squander something as sentimental as a wedding dress outside in daylight on a Friday in a busy shopping area? But it was their – and the designer labels they work with – business decision to destroy unsold dresses to prevent resale. Apparently, its not uncommon for high-end brands to ruin their goods rather they are offered at a large discount in a dingy bargain basement, cheapening the idea of luxury that many of their customers have bought into. And I guess I can understand that. Imagine if every time you needed a hotel, you stall until the midnight hour when vacant rooms are offered up free, or if you waited to buy that designer dress you covet because you knew inevitably it’d show up at the local outlet. Well, eventually, I’d bet those companies would go out of business for lack of full-paying customers. And then how would I find my bargains at the thrift store?

In a sequence of transactions over the past 30 years, ECM acquired additional newspapers. Andersen, son of the late former governor, said ECM believes many Minnesotans agree with investor Warren Buffet who said recently, after acquiring his hometown newspaper -– the Omaha World Herald: “There are still a lot of things newspapers can do better than any other media. Rosemount ready to loan $750k for park & ride lot City would loan money to MVTA to cover federal funds, which are set to be dispersed in 2013 BY MATTHEW HANKEY – SUN NEWSPAPERS Rosemount is likely less than a year away from having a dedicated transit hub in the city. The Minnesota Valley Transit Authority was awarded a grant in 2009 that would provide funding for a Rosemount park-and-ride lot in 2013. “The MVTA has been working for a number of years to get federal funds for the city of Rosemount,” said MVTA Customer Relations Manager Robin Selvig. But, the city of Rosemount has taken an interest in seeing the project begin a year sooner. At a December meeting, the Rosemount City Council voted to advance loan the MVTA $750,000 to begin construction of a new park-and-ride lot and facility. The total project cost is roughly $1.1 million, which doesn’t include the cost of acquiring the land, said Selvig. The federal portion of the project – $750,000 – is the amount the city would loan to the MVTA. If the MVTA cannot acquire the federal grant funds a year ahead of schedule, it will use the advance loan Rosemount is offering to begin construction. Construction of the facility, located on the corner of 145th St. West and Burnley Avenue, would begin this summer and be completed by the end of the year. “It is expected to take one construction season, “Selvig said. “If we are able to construct this year, we expect to begin service from the site in December.” But, Selvig said, more planning is needed before ground can be broken. “We need to do a fair amount of specifications created and bid the work,” said Selvig. “The hope is that the construction could begin May, June timeframe.”

Currently, MVTA Route 478 provides two morning rush hour trips from the Rosemount Community Center to downtown Minneapolis and two rush hour afternoon routes back to the community center. Route 476R has one morning trip from Rosemount into downtown Minneapolis and two afternoon trips back to the community center, Selvig said. These routes have been operating from the community center for about two years, said City Administrator Dwight Johnson. Current plans for the proposed park & ride call for a 102-stall parking lot and an outdoor – but covered – passenger waiting area, Selvig said. Additionally, there will be bumpouts to accommodate pick up and drop off of riders. The facility will include a restroom and mechanical room, said Johnson. “Quite a bit of it would be enclosed, but one part of it would be an open canopy,” said Johnson of the building. Parking lot plans feature native shrubs and perennials, in addition to ornamental trees and grasses. Johnson said the location of the park and ride would be beneficial for residents who will use the bus in the future. “I think it will be better located [with] more dedicated parking,” Johnson said. “I think we just have more people located closer to our downtown area than we do towards the north.” Bus users will not be the only ones who benefit from the available parking stalls this transit hub would make available, said Johnson. “This would be less than a block away from Highway 3,” Johnson said. “Along state Highway 3, there’s very limited parking … where you can actually park on the street. That’s why adding more parking into our downtown area would be a beneficially good thing.” Johnson said Rosemount would be notified within the next couple of months if the federal funds can be advanced or if the city’s loan will fund the federal portion of the project. Either way, he wants to see the project get started as soon as possible. “I’m hoping it goes this summer,” Johnson said.

EDUCATION Search begins for new School District 197 superintendent At the Dec. 19 District 197 School Board meeting, Interim Supt. Tom Nelson began the conversation on the search for a new superintendent. After weighing its options, the school board agreed that its best option was to hire a consulting firm to assist the board in this important process. Nelson recommended that the school board hire a search firm because a consultant’s past experience, professional network of eligible candidates and ability to develop a strong candidate profile would be beneficial to the process. Nelson noted that while a board-run process would save money, it would be very labor intensive and time consuming for both the board and for district staff, and the district would be limited in its ability to actively recruit strong candidates. While the board agreed with Nelson that hiring a consultant to perform a lot of the legwork was important, many members articulated a strong desire to be very involved with the process. The consultant chosen by the board will serve as an independent collector of input, gathering community, parent, student and staff opinions in a neutral way. A draft timeline for the process includes interviewing and selecting a search firm by early January, conducting stakeholder meetings in late January and early February and candidate interviews and selection of the new superintendent in late March or early April so that the leadership transition can begin in the spring. The school board interviewed search consultants prior to its Jan. 3 meeting, but the district could not be reached for comment prior to press time. Info: isd197.org.

Elementary Inventors Fair set for Jan. 14 at Eagan High School School District 196 fourth- and fifthgrade students will be displaying and explaining their inventions at the annual District 196 Inventors Fair Saturday, Jan. 14, at Eagan High School, 4185 Braddock Trail. Judging begins at 8:30 a.m., with public viewing at 10:30 a.m. and a brief awards ceremony at 11:30 a.m. Organized and hosted by the district’s Gifted and Talented Program teachers, the fair is designed to teach and encourage students to use creative problem-solving

techniques and to bring creative ideas to reality through the medium of invention. To be entered in the fair, inventions have to be a completely new product or an improvement to an existing product. Three volunteer judges, who include teachers, principals, parents, business leaders and District 196 high school students, will judge each entry. Student inventions are judged on the following criteria: • Originality: The invention is original either in the problem it addresses or the solution. • Need: There is a need for the invention. • Workability: There is evidence the invention will work. • Research: The student investigated what similar inventions exist. • Improvement: The solution offered by the invention is better than previous or existing ones. ISD 196 accepting nominations for Randall Award ISD 196 is accepting nominations through Feb. 24 for the 2011-2012 Andrew Christopher Randall Memorial Travel Award, given to one Rosemount-Apple Valley-Eagan Public Schools employee annually in recognition of their ability to foster mutual respect between individual students and school staff. Any employee, student, parent or resident may nominate a District 196 employee for the award. Employees must have worked in the district for at least five years to be eligible. Dr. Ruth Randall Benson, who was district superintendent from 1981 to 1983, established in memory of her grandson Andrew Christopher Randall, who died in September 1990 at age 14 following a 6.5year battle with cancer. The award is given to honor the employees at the schools Andrew attended – Valley Middle School and Southview Elementary School – for the sensitivity, humor, kindness, love and mutual respect that marked their relationship with Andrew. The $2,000 cash award is designated for travel because travel brought great pleasure to Andrew. The award is also supported financially by Andrew’s parents Robert and Laurie. Franken authored four amendments that, according to the senator, would give schools more flexibility in testing, improve schools by strengthening leadership, create stability for foster care kids, and clarify that teachers don’t need to be forcibly transferred from their schools to meet equal funding requirements. Dan Solomon, a field representative for the senator, said Franken’s staff members have led around 15 similar listening sessions around the state of Minnesota in the past months, but this was the first time Franken has attended an event due to his busy schedule as a member of Congress. “At all 15 sessions, no one said they like the NCLB law as it is,” he said. “There was great consensus that there needs to be some change.” And those changes were addressed by the senator, who took about 20 minutes to inform all those in attendance about the amendments. “This is an important part, hearing from Minnesotans,” Franken said, adding that many people have some frustrations with aspects of the law. He added that it is always good to hear thoughts and ideas from people that

may be specific to their respective communities. Franken authored the computer adaptive testing amendment, the school principal recruitment and training amendment, the fostering success in education amendment, and the no forced transfer amendment. These would allow states to use standardized tests that include questions within, as well as above and below grade level; address the shortage of skilled principals in high-need and rural schools; improve the school stability and educational outcomes of foster youths by allowing them to remain in their current schools after moving to foster homes; and clarify that districts don’t have to force teachers between schools to equalize funding. Franken stressed the need for improved early childhood education. “We need to start kids learning at the earliest age possible,” he said, adding that there is no doubt that early childhood education pays for itself down the road. The senator also addressed adequate yearly progress and why it needs to be replaced. He said some schools in Minnesota have been the best in the state but did not meet AYP due to “an arbitrary achievement bar.” AYP would be eliminated in the Elementary and Secondary Education Act. that supports this measure. “I have seen schools turned around by principals,” Franken said, “And I have been to schools that have been turned around.” According to Franken, the bill received 75 to 90 percent bipartisan support in Senate Health, Education, Labor, and Pensions committee, the committee in which the bill was drafted. Assistant Principal Chris Belmont indicated that the school’s government class was excited about Franken’s visit. “They really took to this opportunity,” he said, adding it has allowed the students to learn of the senator’s role in Congress, in addition to being a bridge for learning as a real-world application. Amy Kirchner, the ALC government class teacher, said she engaged her students in talks about Franken’s political philosophy and about NCLB. Two of her students, seniors Cierra Jones and Michelle Zarazua, said they also talked about the 2012 election, who might win and why. Jones asked Franken about his views on unions, while Zarazua asked about whether or not Franken supports the Dream Act. Marc Kimball, communications coordinator for Franken, said that the Elementary and Secondary Education Act now needs approval by the full Senate, and there is no specific time or date as to when the bill will be debated in the Senate. He added that they hope the time comes in the next couple of months.

The Burnsville Performing Arts Center, 2600 Nicollet Ave., Burnsville, will be hosting “Hope is Alive,” an Elvis tribute and a silent auction fundraiser to benefit St. Jude Children’s Research Hospital Saturday, Jan. 21. with a common interest and desire of making a difference in the lives of others. It is the first time the group has combined efforts with the BPAC, according to Jodi Lang, a representative of ESA. K a t y Sunnarborg serves as event marketing representative for St. Jude and serves as liaison between ESA, the hospital and t a l e n t . According to Sunnarborg, the night will feature a St. Paul family whose son was diagnosed with a form of cancer at 9 months of age, but thanks to the work of doctors at St. Jude for the last two years, today he is cancer free at age 5. The family will speak before the audience, stressing the importance of the work performed at St. Jude and the ongoing need for charitable dollars. “That is why we do benefits like this,” she said. “When a person is

referred to St. Jude, his or her family will never receive a bill. No child would ever be turned away despite creed, race, religion, or ability to pay.” For Steve Marcio, he and his son’s efforts to perform many evenings as Elvis tribute artists are somewhat personal. “We had a niece who died at age 2,” Steve said. “She had neuroblastoma, and that is a childhood cancer.” The form of cancer is a malignant tumor that develops from nerve tissue and occurs in infants and children, according to the U.S. National Library of Medicine. According to Steve, he wanted to help St. Jude, especially after he received a call from hospital officials who put him in touch with ESA. He said it is the perfect organization for which to do more fundraising. “They have raised $150 million over 40 years,” he said referring to the

Danielle Kinzer, senior representative of event marketing for the Minneapolis St. Jude office, said fundraisers are vitally important to the ongoing existence of St. Jude. “Fundraisers are so important to us because St. Jude relies primarily on the public’s generosity to support our lifesaving mission,” she said. “It costs $1.7 million to operate the hospital every day, and more than 75 percent of that funding comes from the public.” Doing fundraisers for ESA is nothing new to Marcio, who has been performing what he calls the Elvis Experience for around seven years that included four fundraising shows. “The Elvis Experience has raised between $10,000 and $12,000,” Marcio said, adding that he and his family really would love to sell out the BPAC and raise as much as $20,000 for the charitable cause. Marcio estimated that he and Tommy have performed the Elvis Experience from 300 to 400 times. Along with the father and son on stage at each event, other family members are typically involved. Carol, Steve’s wife, will be directing the Jan. 21 show, a duty she is very familiar with, while daughter Cassie Rombach usually sells merchandise. Program helps reduce ISD 197 utility costs Independent School District 197 has avoided $1.5 million in utility costs since 2003 thanks to participation in LIVEGREEN, the district’s sustainability program. This program helps keep more general operating funds in the classroom by taking a comprehensive approach to sustainability and incorporating recycling, composting, using green cleaners, reducing diesel emissions, using less paper and updating engineering controls throughout the district. Three years ago, only 30 percent of all district waste went to recycling. Now, nearly 60 percent of all waste goes to either

compost or recycling, which has helped reduce the amount of times trash had to be collected in the district. To help promote these sustainability efforts, each school in the district has a LIVEGREEN Club to support and facilitate annual sustainability events. These include a Recycle Review, Lights Out Challenge, America Recycles, Energy Week and Earth Day. Each school in the district has also earned the Environmental Protection Agency’s Energy Star Award for demonstrating energy efficiency, and the district was named an Energy Star Leader for demonstrating 30 percent improvement in 2010. He was truly vested in his community.” Rechtzigel can attest that the department is in good shape following Johnson’s retirement. “Scott did not leave this place a mess,” he said. “This department runs.” “He’s a very fine example of what a great leader is and that it would be that kind of smooth transition,” said Hamann-Roland. Johnson said it was equally enjoyable to build up the police department and make connections with Apple Valley residents during his tenure with the city. “Being the police chief of Apple Valley was the highlight of my career,” he said. “It was an honor and a privilege to serve with the officers of the depart-

The Apple Valley City Council will soon decide on a process for hiring a permanent police chief. Rechtzigel is acting police chief indefinitely until the position is filled long-term. Johnson said there are two candidates within the department that are ready to be police chief – Rechtzigel and Capt. Mike Marvin. “That’s going to be up to the city council,” Johnson said. “Whatever the council will do will be best for the community, what’s best for the department.” City Administrator Tom Lawell said the council is set to discuss its next steps at upcoming listening sessions this month. But, Hamann-Roland said discussions could carry into February. The council will discuss the possibilities of hiring from outside the department and advertising options, Lawell said. Replacing Johnson’s experience and leadership is no small task, but Hamann-Roland is confident the police department will hire a deserving candidate. “I think it’s going to be a challenge, but I think Apple Valley attracts great people,” she said.

Happy New Year! More than 500 people joined Eagan’s very own Times Square ball drop and New Year’s Eve countdown celebration Saturday, Dec. 31, at the Lebanon Hills Regional Park. Event attendees iceskated and kick sledded on Schulze Lake, among many other all-ages activities. The city of Rosemount, in cooperation with Dakota County and the Dakota Communications Center, is undertaking federally required upgrades to outdoor warning siren equipment. play a physical style, but doing it with the rules can be a challenge. “High school athletics are meant to be fun, meant to be a positive experience for kids,” said Eigner, who also has coached at the professional minorleague level. “I think all the coaches preach safety. “In high school hockey, what you want are good, hard-nosed kids who play the right way and don’t take dangerous chances.” Checking from behind is illegal; the player who hit Jablonski received a major penalty and game misconduct. The National Hockey League has issued a number of suspensions this season for hits from behind that propelled players into the boards. Privette’s injury made it clear that girls hockey players also are exposed to the dangers of hits from behind even

Losing a couple of top-level skiers to graduation hasn’t slowed the ISD 196 boys Nordic team. Neither has a snow drought. Few trails in the metro area have enough snow for skiing, but the ISD 196 boys – consisting of skiers from Apple Valley, Eagan, Eastview and Rosemount high schools – won two of their first three meets. Two were in Maple Grove and one was in Lake Elmo on trails with man-made snow. “We’ve had some kids who have made major leaps, like Nick Couillard and Nick Acton,” ISD 196 coach Brian Abery said. “We’ve also seen a lot of progress from David Bumgarner and Josh Podpeskar. And all four of them finished in the top 10 at our last race.” That was a 5K classic race at Elm Creek Park Reserve in Maple Grove on Jan. 4. Couillard (third place individually), Acton (fourth), Podpeskar (seventh) and Bumgarner (ninth) led ISD 196 to first place with 141 points, 15 more than Bloomington Jefferson/Kennedy. The boys team also finished first and second in two South Suburban Conference freestyle races in December. Two ISD 196 skiers – Chris Parr of Eagan and Andy Dodds of Apple Valley – finished in the top six in pursuit at the 2011 state meet. Both graduated last spring, but there were others ready to take their places. Podpeskar, for example “was a freshman last season,” Abery said. “In addition to the training he’s done since then, he just looks more comfortable and confident on his skis.” Eagan junior Sonja Hedblom, who finished 19th at the 2011 state girls meet, is 3-

BY MIKE SHAUGHNESSY – SUN NEWSPAPERS Jerry Hayes returned to work at Apple Valley High School last week following the holiday break, and his colleagues bombarded him with questions about a boy he has never met. What do you think? Have you talked to your team about it? How can it be prevented from happening again? The subject was Benilde-St. Margaret’s sophomore Jack Jablonski, whose catastrophic injury suffered during a junior varsity hockey game Dec. 30 has touched off a nationwide discussion about hockey safety. Hockey safety is an issue for Hayes on several levels – as head coach of the Apple Valley High School boys team, as a board member of the Apple Valley Hockey Association youth program, and as a parent with a daughter playing youth hockey. He has been closely monitoring the reaction to Jablonski’s injury. Jablonski’s doctors say it is unlikely he will walk again, although his parents said last weekend he has regained some movement in his right arm and left hand. As support poured in for Jablonski, a second Minnesota high school player was hospitalized with a similar injury. Jenna Privette, a Burnsville resident and a senior at St. Croix Lutheran High School in West St. Paul, was taken to Hennepin County Medical Center after reportedly being hit from behind during a Jan. 6 girls game. The following day, Privette’s parents said she had pain and tingling in her

Privette plays for the Minnehaha Saints, a cooperative girls hockey program with players from Minnehaha Academy, St. Croix Lutheran and St. Agnes. Last week, Privette had organized a memorial at her school for Jablonski. Now they might be facing the same uphill battle. “Very few people go on the ice with the intention of hurting someone,” Hayes said. “The hockey community has been taking steps to make the game safer, such as when USA Hockey took checking out of Pee Wee hockey [for 11and 12-year-old boys]. “We’re all aware of the issues, and we’re all aware there are risks inherent with any sport.” Lakeville North boys hockey coach Trent Eigner said many teams aspire to

Apple Valley boys win at Timberwolves Shootout BY MIKE SHAUGHNESSY – SUN NEWSPAPERS In the final seconds of a tied game, Apple Valley almost always will look to Tyus Jones to take the last shot. But at last weekend’s Timberwolves Shootout, it was Mitch Hechsel who took his team’s last shot – and the Eagles couldn’t have been more pleased with the result. Hechsel, a senior forward, rebounded a missed shot by Jones and scored with 1.9 seconds remaining as Apple Valley defeated Onalaska, Wis., 66-64 on Jan. 7 in the Timberwolves’ annual high school basketball showcase at the Target Center. “[Dennis] Austin and Hechsel are combining to shoot 74 percent,” Apple Valley coach Zach Goring said. “Some of those are layups off Tyus’ missed shots, but they’ve shot the ball well.” Apple Valley had the ball with the game tied 64-64 and 58.3 seconds remaining. Goring said the Eagles planned to hold the ball for the final shot, but junior guard Dustin Fronk found himself open for a three-pointer and took it. Fronk missed, but Goring said he didn’t mind the choice because he has confidence in Fronk’s shooting. The coach felt even better about it when Austin grabbed the rebound and the Eagles retained possession. In the closing seconds, Jones drove into the lane, met an Onalaska defender and put up a floater that was short. Hechsel, running to the basket from along the baseline, grabbed the ball and scored.

Lakeville South girls hockey coach Natalie Darwitz said she received several hits that sent her headfirst into the boards during a playing career that spanned high school, college, numerous international tournaments and three Olympics. But the difference between legal and illegal contact can be thinner than a skate blade. Darwitz recalled receiving one major penalty in her career for sending a player headfirst into the boards. In that instance, she said, she and another player were pursuing the puck. Just

Hechsel scored 15 points and junior guard Harry Sonie had 14. Fronk was the fourth Eagles player in double figures with 11 points on what Goring called “an off night. He doesn’t miss eight threes on a night very often.” The Eagles were happy to come to the Target Center with all of their players healthy. They were invited to last year’s Timberwolves Shootout with the idea that they would get to showcase Jones, one of the nation’s most coveted high school recruits, and Tom Schalk, a forward now playing college basketball at William and Mary. Jones and Schalk both sat out the game because of injuries and the Eagles were blown out by Iowa state power Linn-Mar. At 9-1 this season, Apple Valley is a state power. The Eagles are ranked fifth in Class 4A. Apple Valley played Bloomington Kennedy on Jan. 10 and will have a showdown with No 1-ranked Eastview at home at 7:15 p.m. Friday, Jan. 13.

before they reached it, Darwitz said the other player turned her back to her, leaving her no time to avoid making contact. “What we teach is, if you see the other player’s number, or the back of her helmet, don’t hit her,” Darwitz said. “You don’t want to see any injury, let alone a life-altering one.” In response to the Jablonski injury, the Minnesota State High School League sent a memo to coaches and officials on Jan. 3 asking them to be vigilant about checking from behind. Hayes said rules already are in place to address it, but because of advances in equipment and athlete conditioning, the game is more violent than ever. “It’s a much faster game than it was 20 years ago,” he said. “And the equipment makes kids feel like they’re bulletproof. With the equipment from 20 years ago, if you checked a guy you might come away

from it hurting as much as the guy you hit.” Hayes said young players also take cues from television. Many hockey highlights that show up on TV are of big hits. “The high school game can get pretty rough,” Hayes said. “When kids whoop and holler about a big hit, we have to try to remind them, ‘Guys, that’s not going to help us score a goal.’” Coaches also need to continue educating players about not making themselves vulnerable to potential injury, Hayes said. Skating toward the boards on a perpendicular route exposes a player to unnecessary danger, he added. The preferred route is to go in at an angle and be skating parallel to the boards as the player reaches the puck. Also, Hayes said, players might need to unlearn some habits when it comes to protecting the puck along the boards. He

said he has seen more players turn and face the boards when they’re controlling the puck, assuming that doing so means they can’t legally be hit. But if they are hit, they’re not in a position to protect themselves. News of the Jablonski injury seemed to put some players on edge. Ten players were ejected from a boys game between Winona and Owatonna high schools last week when a check from behind triggered a brawl. A rivalry game, such as the one the Lakeville North and Lakeville South boys played Jan. 7, also could have caused some dicey situations. But the game played out without incident. “All the players know each other,” Lakeville North senior forward Blake Winiecki said. “We’re rivals on the ice, but you don’t want to do something stupid and hurt somebody.”

Notebook: Eastview vs. Apple Valley a marquee matchup in boys hoops BY MIKE SHAUGHNESSY – SUN NEWSPAPERS One of the most eagerly awaited boys basketball games of the winter will be Friday, Jan. 13, when Eastview makes a 2.5-mile trip across town to play at Apple Valley. Eastview, which started this week 9-0, moved up to No. 1 in the state Class 4A rankings in December. Apple Valley, 9-1 at the start of the week, is ranked fifth in the state. The Lightning has been involved in a lot of blowouts; only one of its first nine games was decided by fewer than 16 points. But Eastview might get all the competition it can handle this week; the team played undefeated and fourth-ranked Lakeville North on Jan. 10, after this edition went to press. Eastview senior forward Joey King, a Drake University recruit, is averaging 28.3 points a game and has

scored 33 or more four times. Forward Ben Oberfeld (13 points per game) and guard Darin Haugh (12.1) also have double-figure scoring averages. For Apple Valley sophomore guard Tyus Jones, the question is not if he will play Division I basketball, but where. Michigan State coach Tom Izzo has watched Jones play twice, including Jan. 6 at Lakeville South. Minnesota coach Tubby Smith was in the crowd when Apple Valley played Onalaska, Wis., in the Timberwolves Shootout on Jan. 7 at the Target Center. Going into the Timberwolves Shootout, Jones was averaging 29.3 points and scored more than 30 five times. Perimeter shooting specialist Dustin Fronk was averaging 17 points. In 2010-11 Eastview defeated Apple Valley twice on its way to the South Suburban Conference championship.

Eastview Athletic Association will hold a free lacrosse clinic Sunday, Jan. 15, for boys in grades 2-8 who are interested in playing this spring and summer. The event will be in the Scott Highlands Middle School gym. The clinic for boys in grades 2-4 will be noon-2 p.m., with boys in grades 5-8 having their clinic from 2-4 p.m. EVAA youth lacrosse coaches will run the clinic. The clinic is open to all skill levels. Players may bring their own equipment, otherwise some gear will be available for use at the clinic.

AV youth wrestlers win The Apple Valley youth wrestling team won the Rumble on the Red Youth Duals championship Dec. 30 in Fargo, N.D. Apple Valley was 4-0 in the tournament, held at the Fargodome on the North Dakota State University campus. Apple Valley defeated Hillsboro, N.D., 60-15, Cobber Club of Minnesota 74-12 and Tech Team Black of North Dakota 48-25 in the first three rounds before defeating Bismarck (N.D.) MatPac 50-24 in the championship match.

Skiers FROM PAGE 21 for-3 in conference meets this season. “Sonja swims in the fall, and we weren’t necessarily expecting her to win her first race,” Abery said. “But she did, and then she won the next race by 32 seconds. She won by almost a minute last week in the classic race.” Some of Hedblom’s rivals in conference girls Nordic meets include Vivian Hett of Burnsville and Amy Ferguson of Lakeville North, both of whom skied at state last year. Hett was 11th in pursuit at state in 2011. ISD 196 senior Laura Bailly was sixth in the Jan. 4 conference classic race, with Roxy Holt 18th. The ISD 196 girls team’s top four skiers went to the Mesabi East Invitational in Biwabik on Jan. 7. One thing that makes the meet attractive to skiers is it’s usually on the same course that’s used for the state meet in February. This year, because of lack of snow on the regular Nordic course, the race took place on man-made snow near the bottom of the Giants Ridge Alpine hill. Abery said the top ISD 196 boys opted to stay home and train because the state meet course at Giants Ridge couldn’t be used, but the girls wanted to go regardless of

which course they skied. The skiers are resigned to competing on man-made trails for the foreseeable future, Abery said. South Suburban teams had a relay meet at Elm Creek on Jan. 11 and will ski in a classic meet at Green Acres Recreation Area in Lake Elmo at 3:30 p.m. Friday, Jan. 13. The South Suburban’s annual Martin Luther King Day meet will be 9:30 a.m. Monday, Jan. 16. It had been scheduled for Valleywood Golf Course but likely will be moved to one of the metro-area trails with artificial snow.

Nordic notes • Lakeville North edged Burnsville by one point in the girls team standings at the Jan. 4 classic meet. Amy Ferguson (second) and Sara Nelson (eighth) led North, while Vivian Hett (third) and Jordan Horner (seventh) were Burnsville’s top skiers. The Blaze won the season’s first two South Suburban Conference meets. • Lakeville North’s Lewis Kunik (second), Burnsville’s Mikey Johnson (fifth) and Lakeville South’s Michael Picken (10th) were top-10 finishers at the Jan. 4 conference boys race. • Defending state boys pursuit champion Ben Saxton of Lakeville North skied in one of the first three conference meets. He finished first by 25 seconds in a 4.8K freestyle race Dec. 21 at Elm Creek Park Reserve.
