Fiscal disparities on the menu at State Capitol BY T.W. BUDIG – ECM PUBLISHERS The release of a report on fiscal disparities has pushed the controversial 40-year-old tax base equalization program into the spotlight. Ushered into law by former Anoka County state Rep. Charles Weaver in 1972, the program attempts to equalize tax bases in the seven-county metro area by having the haves share their tax base wealth with the have-nots. “I don’t think you ever could do this again,” said Anoka County Commissioner Dan Erhart of passing such legislation. Under the program, 40 percent of the growth in the commercial/industrial tax base is siphoned off and placed into a regional pool. These dollars are then doled out to recipient localities, those areas with lower tax base growth. The idea behind the program is that it could promote orderly development, provide incentives to work for the betterment of the region as a whole, offer needed funding for communities at their early stages of development, according to the report.

mates that the current law total tax rate without fiscal disparities in Anoka County, for instance, would increase from about 116 percent to about 132 percent — about 16 percent difference. For Washington County the current law total tax rate of about 90 percent would increase to about 101 percent without fiscal disparities — an 11 percent difference. Conversely, Hennepin County, without fiscal disparities, would see its cur-
rent law total tax rate decrease by about 1.5 percent. Erhart, a staunch defender of fiscal disparities, argues it offers positive benefits. The program allows metro communities, for one thing, to vie for business development on a more level playing field, Erhart said. Without the fiscal disparities, some communities, intent on building their tax base, would offer so many tax breaks and other incentives to business to locate that in the long run they would damage more than help themselves, he explained. Rep. Jim Abeler, R-Anoka, acknowledges the program has critics. “It’s an ongoing threat to Anoka County and our area,” he said of removing fiscal disparities. Both House and Senate tax committees will be taking up the fiscal disparity issue in upcoming days. Whatever the merits of the program, the fiscal disparity debate is not a partisan one, explained House Tax Committee Chairman Greg Davids, RPreston. “This is one where Republican and Democrat — you can toss that out of the window,” Davids said. The fiscal disparity debate is geographical, he said. Indications are lawmakers are more likely to simply examine the fiscal disparity program this year than take wrenches to it. CAPITOL: TO PAGE 27

Eden Prairie’s registry: A good example to follow Domestic Partner Registry affords some benefits to couples The Eden Prairie City Council is the latest to approve a Domestic Partner Registry that legally enables couples living together and not married to acquire certain benefits. Domestic partners can be any couple, including same-sex and heterosexual couples. After filling out a one-page form and in some cases paying a slight fee, these couples can be eligible for bereavement leave, family leave and insurance benefits at companies that recognize domestic partnerships. The couple must be unmarried and living together, live in the city and be committed to one another to the same extent as married persons are to each other, except for the traditional

marital status and solemnities. Back in 2008, former Gov. Tim Pawlenty vetoed legislation that would have allowed partners of state, federal and city employees to a have the same benefits reserved for married couples. His veto, however, didn’t prohibit individual cities from approving an ordinance for their own domestic partner registry. Minneapolis, St. Paul, Edina, Golden Valley, St. Louis Park, Eagan and Richfield have approved these registries. Rochester, Red Wing and Duluth also have them. The Eden Prairie City Council wrestled with the registry before approving it on second reading, 4-1. One council member, Brad
Aho, said it wasn’t needed, that only nine people in neighboring Edina registered for the benefits and only 2 percent of the cities in the state have adopted it. More to the point, he argued that the ordinance undermines marriage because it infers that any marriage is as equal as the partnership. Councilmember Kathy Nelson said the proposal has nothing to do with the proposed marriage amendment that will be on the ballot in November. “The ordinance,” she said, “does not make a statement in favor of or against any state law, and it is not political.” Another council member, Sherry Butcher Wickstrom, reminded that the city has a Manifesto which encourages diversity. It’s a way of acting and not just talking about diversity, she said. Mayor Nancy Tyra-Lukens was surprised more people didn’t object to the registry. The pattern in cities where it has been
passed is that most people find the registry reasonable. The mayor struck the right chord when she said: “The ordinance may not affect many people, but we deal with things that affect a small number of people all the time, as well as decisions that face all Eden Prairie residents.” That’s the genius of local government; it is local enough to be concerned about all of its neighbors. This action by the Eden Prairie City Council is to be commended, because it enables citizens to get benefits under the law regardless of their marital status as long as they live together in their community. Effective ways to close the achievement gap BY JOE NATHAN – GUEST COLUMNIST This was monumental,” according to Gary Cunningham, vice president at the Northwest Area Foundation in St. Paul. About 200 educators met last week to learn from some Minnesota’s public schools that have been most effective in closing the achievement gap. They were from district and charter public schools, and they focused on helping students. The African American Leadership Forum (AALF), General Mills Foundation and the University of Minnesota co-sponsored the meeting. Cunningham believes “All children will benefit if this continues.” I agree. Eric Mahmund, co-founder
and executive Director of Harvest Prep in Minneapolis, was one of the keynote speakers. Harvest Prep frequently has appeared on lists of Minnesota’s “Beat the Odds” schools. That’s because despite the fact that more than 90% of its students are from low-income families, and more than 95% are African American, 82% of the schools students tested “proficient” in math, and 76% tested proficient in reading. Both are above the state average. Mahmoud listed five key gaps in Minnesota. He’s found that “schools can overcome all of them.” • Preparation Gap (too many youngsters from low income families come to kindergarten with low birth weight, not having
heard enough words or encouragement. • Time Gap: Given the preparation gap, many youngsters from low-income families need a longer day and a longer year. • Belief gap. Mahmoud called this “the most important gap.” It’s the belief of some people that students from low-income families cannot succeed in school. • Teaching Gap – failing to use research based approaches. • Leadership Gap – More leaders needed who know how to overcome other gaps. Mahmoud recalled the 1979 words of the late Harvard Professor, Ron Edmonds: “How many effective schools would you have to see to be persuaded of the educability of poor children? If your answer is more
than one, then I submit that you have reasons of your own for preferring to believe that pupil performance derives from family background instead of school response to family background. … We can, whenever and wherever we choose, successfully teach all children whose schooling is of interest to us. We already know more than we need to do that. Wilson was joined by Mary Donaldson, director of St. Paul’s Concordia Creative Learning Academy, in stressing that successful schools with low-income young people must teach arts as well as academics. CCLA also is a “Beat the Odds” school. “This is not just about test prep,” Donaldson pointed out. “It’s about helping prepare youngsters to be active, caring, involved citizens.” Chris Stewart, formerly a Minneapolis (District) Public School Board member and a member of the African American Leadership Forum, explained that “this was a pilot. We wanted to see if people would come. Today was a trial. This was long overdue, and I hope it’s the start of something.” Jeffrey Hassan, an attorney and one of the AALF leaders, told me he “felt wonderful” about the fact that about 200 people decided to attend the Saturday sessions. He sees this as “a good start” of conversations in Minnesota, not about whether district or charters are better, but about what can be learned from the state’s most effective schools. That’s exactly what young people need – more pragmatism, less politics. This column falls into the latter category. What do I do now that football season is over? OK. Perhaps the difficulty of this question is suspect, but it does need to be asked for my sanity, if nothing else. Since the National Football League owners and NFL Player’s Association came to a working agreement to play games in 2011, I digested all that was football around the clock. I read countless online football articles. I drafted, managed, over managed, and sometimes under managed my two fantasy football teams. I listened to Vikings radio shows daily and I’m not even a Vikings fan. The point is, I couldn’t get enough football. With the Super Bowl over, it will be another seven months before another snap is taken in a

regular season NFL game. Yes, the NFL will hold its rookie combine later this month and rookies will attend mini-camp practices in the spring. Training camps begin in earnest in the heart of summer, but that’s a long ways off. Let’s review some options for how I could spend my time between now and September. Finding another spectator sport seems like the logical outlet for me. As a diehard Badgers fan, it has been fun to watch the men’s basketball team in the hunt for another Big 10 title. But, let’s be realistic. They will likely be eliminated from the NCAA Tournament before the Final Four and will not compete for a title
this year. Moving on. This winter has been strange for a few reasons, weather included. Notably, I’ve found myself watching NBA basketball for the first time since Michael Jordan retired for the second time in 1999. Growing up in Wisconsin, I didn’t root for the Milwaukee Bucks and I feel no allegiance to them now that I live in Minnesota. To the editor: Tomorrow is Thursday. Starting at 7 a.m., I can look forward to seeing, hearing and feeling 12-13 trucks rumble past my house. What are all these trucks doing, banging up and down my street between 7 and 11 a.m. every Thursday? There are numerous garbage companies represented by the many trucks. What is really crazy is that each company will drive by my house about ten times. When I lived in Minneapolis, there was one company that worked to remove trash; therefore I saw, heard and felt one truck every Tuesday. When I contacted

city hall to find out why it seemed that anyone with a truck is allowed to collect garbage in the community, I found that it is an “open market.” What I don’t understand is the fact that we can’t avoid the “open market” garbage collection, but when our streets are falling apart we are the ones who have to foot 100 percent of the cost of repairs! Something is very wrong with this system! Why doesn’t Edina put out a bid to collect the trash of its citizens so that one company can manage the number of trucks to cut down on the noise, air and street pollution of its citizens? EDUCATION Edina parents raise funds for senior party Parents of Edina High School seniors give their students the gift of a successful senior party by getting involved. There will be an open house at the warehouse, 7119 Amundson Road, at 6 p.m., Thursday, Feb. 9 and 10, and 9 a.m., Saturday, Feb. 11, to help get parents acquainted with the process, drop of photos and donations for the prizes, and purchase senior son or daughter’s ticket for the party. A fundraiser will be held at Chipolte, 6801 York Ave. S., at 5 p.m. on Thursday, Feb. 16 and Chipolte will be donating a portion of the sales to the Edina senior party. A plant sale will help raise funds for the party as well and will take place Thursday, Feb. 9. Parents can place their plant order at the open house. The annual senior party is planned, organized, funded and run by seniors’ parents. Hundreds of volunteer hours are required to make the party a success.

On thin ice Hennepin County lakes close to vehicles; fish houses getting iffy BY BLAZE FUGINA – SUN NEWSPAPERS The first day of spring may not fall officially until March 20, but officials are warning Hennepin County lake users ice is already dangerously thin in many areas. Hennepin County Sheriff Major Darrell Huggett announced all lake access points were closed at a new conference Feb. 9. That means cars, trucks and SUVs are taboo. “It is unsafe for vehicles to drive on the ice, the lakes, rivers and ponds of Hennepin County,” said Huggett said. “Recreational vehicles such as snowmobiles and ATVs will be allowed on county lakes.” Huggett has been overseeing the
department’s Enforcement Services Bureau since early January. It includes the patrol and communications division. Owners of vehicles caught on the ice are subject to a misdemeanor citation. Huggett said the early restrictions are due to the unseasonably warm temps this winter which have created inconsistent ice conditions. A sheriff ’s department spokesman said that at least five cars have fallen through lake ice in the past week. Besides Lake Minnetonka, vehicles have fallen into Medicine Lake in Plymouth, Bald Eagle Lake near White Bear Lake and Lake Riley in Eden Prairie, among others. “This is a very uncommon winter we are having,” said Huggett. “Talking with folks in the community, I want to reiterate that this is something that we ICE: TO PAGE 17

PUBLIC SAFETY Early-morning fire causes water, gas leak at Braemar Golf Dome While the exact cause of a fire early in the morning Friday, Feb. 10, remains unknown, the Braemar Golf Dome in Edina will be closed indefinitely. Around 6 a.m., fire crews were dispatched to the dome, 7420 Braemar Blvd. Upon arrival, they found it to be partially deflated along with a water leak and the smell of gas. Edina Fire Marshal Tom Jenson
said the fire might have started in the northwest corner of the facility, which burned a hole in the side of the dome. The fire slowly spread to the hill behind the dome, but burned itself out before fire crews arrived. Water and gas lines were dislodged from the clubhouse when the dome collapsed. Both were immediately shut off and CenterPoint Energy was called to the scene. Electricity to the dome was also turned off. Braemar Golf Dome will be closed until further notice. The facility had been scheduled to remain open for the season until April 1. Info: 952-826-0330.

We’re pushing it up a little bit because we don’t want to see those cars, those SUVs and those pickup trucks go through and risk people’s lives.” Huggett said that the ice restriction includes upcoming festivals that are taking place on county lakes.

Simple is the new rich Boomers should spend more time sitting on the porch BY EMILY HEDGES – CONTRIBUTING WRITER When Ron Timm of Minnetonka gives seminars on how to live simply, he frequently refers to the concept of “empty porches.” He challenges his students to drive down Summit Avenue in St. Paul, or around Lake Minnetonka when it’s beautiful outside and see if anyone is
using their porch. “They’re never sitting out there because they are always working,” he said. “Boomers, especially, are finding that they’re working during the years they expected to be sitting on the porch.” Twenty-two years ago, Timm was one of those executives working long hours with an expensive home on the lake that he never had time to enjoy. That is, until the day he thought he was having a heart attack. Come to find out, he was okay, but the experience left its mark. “When I thought I had a heart attack I started thinking about what is important,” he said.

When the 63-year-old Bloomington resident got her results back from the Kolbe Index full of verbs to finish that sentence, she realized that she would never relate to people around her quite the same way again. “I’m a lead, follow or get out of the way person,” said Stepney. “I’m a decision-maker who likes to put two and two together. I’m the one in the group who moves projects along, the one who knows how to get the deliverables done.” Helping clients like Stepney know themselves better is at the heart of why St. Louis Park-based Affiance Financial began offering the Kolbe Index last September. According to Financial Advisor Steve Lear, Kolbe isn’t about cognition, intelligence, personality, or values. “There are other types of tests for that. The Kolbe Index is about how people take action; if they were free to be themselves, how would they do something.” The 36-question assessment reveals the way people operate in four areas: Fact Finding (the way you gather information), Follow Thru (how you arrange and design your environment); Quick Start (the way you deal with risk); and Implementer (the way you handle space and tangibles). Unlike an IQ test, there are no wrong answers. This is a test to understand yourself better,” said Stepney. What she learned has helped Stepney in the way she relates to clients as a technologist in the computer industry. She now understands how individuals want her to communicate with them. “I can tell now who needs high facts, low facts, and it’s made me more successful,” she said. “When you can interpret through observation how to understand and communicate with clients better, they think you’re a genius.” As Stepney looks at her own future, she sees how the Kolbe Index is key for Boomers trying to decide how to spend the rest of their careers and beyond.
“Boomers want to keep working. Maybe you retire from a job you didn’t like. Now through Kolbe, you can go find a job that fulfills you in your later years,” said Stepney. “It helped me discover what I want to do. I’m realizing I want to set up some charitable activities that make me more well-rounded and happy.” Lear counsels Boomers daily who are contemplating a longer working life for all sorts of reasons. “For Boomers, we can help if they need to work, or want to work for their health and sense of purpose. The biggest gift Kolbe gives is to tell you where you fit in. It can also help a Boomer figure out ‘what’s your next career?’” While Stepney isn’t looking to retire anytime soon, and believes many Boomers feel the same way, she realizes that many don’t have the choice whether or not to look for another career. “For Boomers, whether they call it right-siz-
ing or downsizing, many are being squeezed out. Or companies are using various methods to move to a younger workforce. Some of us Baby Boomers have to face facts, there’s going to be changes,” said Stepney. “That’s the benefit of Kolbe. It tells you what makes you tick, what is your mojo. So if you do make a transition, what are the aspects that are going to make you the happiest.” Finding what makes his clients happy is the challenge for Lear, and achieving what he believes is true success. “We define it as “freedom to be yourself,” and that is the essence of Kolbe. We need to switch our societal definition here. It’s not how many cars you have, or how big your house is, or the clothes you wear. It’s this: do you have the freedom to be yourself ? “When you’re on your death bed, no one is going to say, ‘I wish I’d spent another four or five hours every week at the office.’” From that moment on, he wanted to do something different with his life. He started by going back to graduate school, and ended up writing his doctoral dissertation on Exit Strategies from Corporate America Using Voluntary Simplicity Principals. Timm not only read a couple hundred contemporary books on the subject, but also relied on the writing of philosophers hundreds of years old. “Philosophers call it voluntary simplicity,” he said. “It’s about living below your means. It gives you time to enjoy the things that are meaningful.” Timm left his job and opened his own graphic arts business. After 15 years, he decided to close the doors

and pursue two passions, photography and teaching. Since then, he has helped support his family with his photographs, and teaching photography at the college, community education and through one-on-one instruction as a photo coach. But it permitted her to change her career and get into a different business that she was passionate about.” Another student, a 25year-old woman, already knew she didn’t want to be an undertaker for the rest of her life. She took Timm’s course to figure out how to transition into another line of work. Timm points out to his students all of the options that become possible in life if you reduce the amount you need to live on. “Maybe you work four days a week instead of five, change fields or it gives you more time to go back to school or maybe even retire.” While all ages regularly attend Timm’s seminars, it’s Boomers that come most often.

The city is conducting a one-hour presentation on coyote hazing, and offering several opportunities for residents of Edina and neighboring communities to learn the technique and its benefits. The first presentation on Feb. 9 brought Davis to Edina City Hall because her dog “Ruby” was attacked by a coyote last March. Davis didn’t see her miniature dachshund being attacked by the coyote, but she heard Ruby yelping outside. Davis yelled as she saw the coyote from inside her house, enough to scare it away. Although Davis didn’t see the skirmish, Ruby’s injuries left no doubt the coyote had attacked her small dog. Ruby had “several bite marks on her rump” and broken ribs, Davis said. Ruby recovered from her injuries, and Davis is careful not to leave the dog unattended in her fenced-in yard, as she periodically sees a coyote outside her home near Edina’s Pamela Park, sometimes walking down the street or crossing nearby France Avenue in the afternoon. Coyotes are smart animals that will adapt to their urban environment, according to Edina Animal Control Officer Tim Hunter. Hazing is intended to re-instill the fear of humans. “This isn’t going to make them go away,” he said. “It’s just going to make them change their clock.” Hunter outlined several techniques and recommendations for hazing a coyote, and also discussed their seasonal behavior and how to identify them. Foxes are often mistaken for coyotes, Hunter noted. “A lot of people mistake coyotes for wolves, as well,” he said. Hunter’s presentation included pictures comparing foxes to coyotes, as well as information to help distinguish between the two. Coyotes are attracted to Edina for the plentiful food, water and shelter that is

In other parts of the country coyotes compete with wolves, cougars and bears for food, and survival. In Edina, “They don’t have to run away from anything,” he noted. Although coyotes are carnivores, they will eat vegetables, plants and bugs, Hunter said. A study of urban coyotes determined that 1 percent of their diet appears to be domestic animals, he added. Coyotes may pose a danger to family pets, but, “The vast majority of their diet is beneficial to us,” Hunter said, explaining that they will eat animals that commonly feed on gardens and landscape plants. They will, however, take advantage of opportunities provided by home-
owners. “They’re perfectly happy eating any pet food that we leave out,” he noted. Likewise, coyotes will take advantage of most water sources they find. “They don’t really care if they drink chlorinated water,” according to Hunter. It’s impractical to do away with backyard swimming pools, he noted, but their attraction to coyotes “is something we can be aware of,” he added. Coyotes will take refuge in culverts or underneath backyard decks, sheds and other out buildings, Hunter noted.
Before and after Before a coyote is spotted in a yard or neighborhood, several steps can be taken to minimize the attraction. Cleaning up fallen fruit from trees or bushes was one of several suggestions Hunter made. He also recommended

cleaning up around bird feeders. Although a coyote may not be attracted to the seeds that fall to the ground around a bird feeder, it will be attracted to the animals that congregate at the base of the feeder, he explained. Since coyotes can climb and jump fences, Hunter recommends installing outward extensions or a product called a coyote roller that attaches to the top of the fence and prevents a coyote from maintaining its footing atop a fence. Minimizing hiding spots available in a yard will help dissuade coyotes from taking up residency in a yard, Hunter said. Several measures can be taken to scare a coyote upon an encounter, according to Hunter. “Don’t run,” he said. Coyotes are fast, and they may follow somebody running away from them. They don’t view humans as prey, so it is best not to invoke a pursuit, he explained. Instead Hunter said it is best to give them a reason to be scared of humans. As long as a coyote isn’t cornered, noise and aggressive behavior toward it are recommended. Yelling and waving arms are a good first step. Throwing sticks and stones at them will also scare them, he noted. Coyotes that have not been hazed are “probably not going to run away immediately,” according to Hunter. They may retreat a short distance and stop to determine if the threat is real. As long as you can still see a coyote, the hazing should continue, he explained. “You want them to run out of the area.” Hunter suggested several other techniques for hazing coyotes, such as using air horns, cans with old batteries inside them and whistles to make loud noises that will startle them. “Be aggressive, don’t be shy,” he said. There are few instances of coyotes biting humans, and no known instances of coyotes biting someone who is hazing them, he noted. Hazing is being recommended because there is “no other method we’ve been able to research that has demonstrated the long-term results that hazing does,” according to Hunter. Trapping coyotes is expensive, and doesn’t provide a long-term benefit if the trapping is discontinued, he explained. Trapping also poses a danger to other animals, including pets, and children, he noted. “Hazing is free, and free is good.” Hazing isn’t intended to take police out of the equation, but the police can’t provide an immediate response when a coyote is spotted, Hunter noted. Consistent hazing will force coyotes to change their patterns, he said. The fiscal disparity program needs to be examined in the broader light of overall tax reform, he explained. One Dayton Administration goal regarding property taxes is to make them more understandable to taxpayers, Frans explained. “I think it’s (property taxes) a mystery for a lot of people,� he said. Frans said he believed the fiscal disparity program has merit. “Well, I do,� he said. For one thing, Frans believes the program does serve to lessen potentially zero-gain competition for business development.

Senate Tax Committee Chairwoman Julianne Ortman, R-Chanhassen, said the fiscal disparity program will probably be more fully addressed next year. “I don’t know if we’re going to do anything this year,� she said. Still, some lawmakers are keenly interested in the program, she noted. And legislation is possible, Ortman indicated. Ortman criticizes the fiscal disparity program on several levels. For one thing, it makes an already complicated property tax system even less understandable, she explained. “Complexity is layered on top of complexity,� she said. Beyond heaping complexity, the program serves to “distort� the property tax picture, Ortman argued. And she questions why growing cities, such as Chanhassen, are required to share their tax base with older, more established cities.
Yet Ortman indicated that simply jettisoning the program is unlikely. “I don’t think that’s an option,� she said. Local communities are counting on fiscal disparity dollars, she explained. Ortman cited a number of potential program tweaks, including looking at the 40 percent commercial/industrial threshold percentage. The fiscal disparity issue is not only financially intricate, but politically intricate as well, she noted. Some of her cities are contributor cities to the program, she said. Others are recipients of fiscal disparity dollars, she explained. Sen. Ray Vandeveer, R-Forest Lake, suggested the program could continue into the future. “I think it would be a very difficult road to remove it,� he said. The House will have two hearings on Feb. 15 on fiscal disparities. The Property and Local Tax Division will
meet at 8:15 a.m. with the Tax Committee meeting at 10:15 a.m. The Senate Tax Committee hearing is scheduled at 8:30 a.m. on Feb. 16. The report cites a number of fiscal disparities variables open for discussion. For example, it’s been argued the 40 percent threshold is arbitrary and not proven to be the point after which commercial/industrial property pays for itself, the report notes. Questions of exclusions from the program for regional benefits, such as the Mall of America, have been raised. It’s been argued, the report notes, that the 1971 commercial/industrial base value starting point in the program discriminates against localities that have experienced most of their growth since that time. Pesheck was charged Wednesday with one count of second-degree burglary after his arrest in Eden Prairie Monday, but authorities expect to file more charges after sorting through evidence found in his Richfield home that could link him to burglaries in several southwest Twin Cities homes. According to a criminal complaint and police officers involved in the arrest, Pesheck was under surveillance Monday after allegedly burglarizing an Eden Prairie home on Antlers Ridge. He allegedly left his car parked in the driveway, broke into the home, grabbed items from the house and put them into the garage; from there he pulled in his car, loaded it up with stolen goods and then left, the criminal complaint said. After he left, officers found the back door had been pried open and telephone wires to the home cut. Officers then pulled Pesheck over and arrested him. Pesheck was out on bail after his arrest last June, according Det. Dave Carlson of Edina. He was released on bail in early October, and police from

Dennis Paulson of Eden Prairie said they are still compiling evidence from other burglaries connected to Pesheck. Evidence links him to eight other cases in Eden Prairie, Paulson said. Metro wide, he is suspected to have burglarized at least 20 homes in the last few months, Carlson said. In that time,
he has been linked to incidents in Deephaven, Eden Prairie, Edina, Minneapolis, South Lake Minnetonka and Washington County, according to Eden Prairie police. Last year he ran into authorities in Anoka and Ramsey counties, and he’s had a prior arrest in Edina, Carlson said. In June and September 2011, Pesheck was charged in Hennepin County District Court with two separate felony
counts of second-degree burglary. The June charge relates to an attempted burglary in Minneapolis around the same time as the Edina burglaries. According to the criminal complaint, in April, Minneapolis officers published photos from a video caught by a surveillance system at a home where the phone line was cut. Several callers identified the man pictured as Pesheck. One caller said Pesheck was storing stolen goods in St. Louis Park. Edina Police Department officers observed Pesheck at the storage facility. A subsequent search resulted in the recovery of stolen property. Another charge dates back to a 2009 burglary in Maple Grove. According to the criminal complaint, in June 2011, the Minnesota Bureau of Criminal Apprehension notified Maple Grove police that shoeprints found in inside a burglarized home matched the shoes Pesheck was wearing when arrested near the site. In the recent burglaries, police believe he has stolen “thousands, thousands, thousands of dollars” in goods, Paulson said. Much of that was gold and jewelry, and police are still compiling details and totals. Although he afforded bail for his October release, Paulson said the $250,000 bail set after his recent arrest should keep him in custody. “I don’t think he’s going to be going anywhere for a while,” Paulson said.

Can Hornets win out? If the Edina High boys hockey team can win its final two Lake Conference games this week, another league championship banner will hang in Braemar Arena. However, there are two major obstacles in the Hornets’ way, namely Wayzata and Eden Prairie. Edina will play both on the road – Wayzata at 7 p.m. Thursday, Feb. 16, at Plymouth Ice Center and Eden Prairie at 3 p.m. Saturday, Feb. 18, at EP Community Center. Senior captain Sam Majka leads Wayzata’s balanced offense. Eden Prairie relies heavily on sophomore forward Steven Spinner.
Tonka-Edina exchange The boys and girls basketball teams from Minnetonka and Edina high schools will battle at 7 p.m. Friday, Feb. 17, at separate locations. Edina’s boys team will travel to Minnetonka’s West Gym. The Hornets won the first meeting 68-55 with junior guard Graham Woodward denting the Skippers’ defense for 30 points. The Hornet girls, a 52-47 winner over Minnetonka the first time around, will have home court for the rematch at Edina High School. Katybeth Biewen and Lindsey Johnson lead Edina against a Tonka lineup that features Joanna Hedstrom and Courtney Fredrickson.
Tuesday’s topper Two weeks ago, the Hopkins High boys basketball team handed Wayzata its first loss of the season, 63-54. The Trojans will have another crack at Hopkins at 7 p.m. Tuesday, Feb. 21, at Hopkins Lindbergh Center. Hornet girls stand 19-3 BY JOHN SHERMAN – SUN NEWSPAPERS Edina High’s girls basketball season has been a tale of two parts. In non-conference games, the Hornets are 17-0. But in Lake Conference games, they are 2-3. Before making any rash judgments, consider that two of the Lake losses are to Hopkins, the undefeated (21-0) state Class 4A rankings leader. The other is to Eden Prairie, last season’s state Class 4A runner-up. “We played very well against Hopkins Friday night,” said Edina head coach Matt Nilsen, following a 73-54 loss Feb. 10. “But Hopkins is the kind of team that wears you down – they are so athletic, so skilled. Hopkins hits jumpers and also attacks the basket. That’s why they’re so hard to stop.” Hopkins pulled away in the second half after leading 34-31 at halftime. Hopkins coach Brian Cosgriff said Edina definitely got the Royals’ atten-
tion. “Edina shot extremely well in the first half [61 percent from the field], but we still had a three-point lead,” said Cosgriff. “This time of year, it’s a good night for us if nobody gets hurt.” In a close game, there are always going to be key moments. Lindsey Johnson, Edina’s senior forward and co-captain, picked up her third foul late in the first half, and that altered some of the things Edina likes to do on the defensive end. One of the positives for Edina was the scoring of senior guard and co-captain Katybeth Biewen. She penetrated the Hopkins defense for a game-high 25 points. Nia Coffey led Hopkins with 18 points. Junior guard M.C. McGrory, who is coming back after a concussion, scored 13 points and pulled down five rebounds for the Hornets. In its other Lake Conference game last week, Edina defeated Wayzata 66-54.
Buie, who played high school hockey for Edina, is having a productive year for the Providence College women’s team. Through 30 games she has 22 points on 10 goals and 12 assists. Buie was All-State in soccer and hockey as a senior at Edina High.
Anders Lee The Edina High graduate is the second-leading scorer for the University of Notre Dame’s men’s hockey team. He has 29 points in 14 goals and 15 assists for the Irish. Notre Dame’s season record is 16-11-3. In his high school days, Lee was named All-State in football and hockey.
James Lettow Edina High’s senior 132-pound wrestler made the All-Classic Suburban Conference team for 201112. Lettow wrestles for a co-op team known as the Rampage. The Rampage represent Edina and Richfield High Schools.

BY JOHN SHERMAN – SUN NEWSPAPERS So far, this has been a season of streaks for the Edina High boys basketball team. The Hornets started out with four losses, then won 13 in a row before losing the last three. That adds up to 13-7, a record a lot of teams would like to have. In Lake Conference action last week, the Hornets competed hard but lost to Wayzata (59-50) and Hopkins (93-79). “The league is really balanced,” said Edina head coach Pat Dorsey. “I think our guys earned Hopkins’ respect Friday night. We need to clean up a few mistakes, but a game like that could give us confidence.” Graham Woodward, Edina’s junior guard, was not lacking for confidence against the Royals as he scored 33 points. Philip DeBerg and Reggie Lynch each scored 13 points for the Hornets and Marley Allison had 12. Hopkins’ leader, senior forward Zach Stahl, scored 27 points. In the game with Wayzata, the Hornets had their chances to win. A layup rolled off the rim near the end that would have cut Wayzata’s lead to one point. Edina had to foul at the end and the Trojans capitalized at the freethrow line. Senior guard Colin Nugent scored a season-high 23 points to lift the Trojans to victory. The big story for Edina was the play of Lynch, a 6-foot-9 junior center. He scored 17 points and blocked 12 shots. Woodward was held to eight points but was able to compensate with ballhandling and assists. “The difference in that game was rebounding,” Dorsey noted. “Wayzata had 16 offensive rebounds to our six. We worked on it, and in the Hopkins game, we outrebounded them by a fairly significant margin.”

Edina boys stand united at section Alpine skiing meet Hornet coach says boys team is ‘on the edge of greatness’ BY JOHN SHERMAN – SUN NEWSPAPERS Dave Nelson, head coach of the Edina High boys and girls Alpine skiing teams, knows greatness when he sees it. Since 1997, the Hornets have won two boys state titles and eight girls state titles. In some circles, that would be called a dynasty. Nelson went into the state meet Feb. 15 at Giants Ridge with hopes of winning another state boys title. This edition went to press several hours before the state meet. “We’re just on the edge of greatness,” said Nelson in his pre-meet analysis. “We’re not holding anything back.” The Hornets qualified for state by placing second behind Chanhassen in the Section 6 meet Feb. 7 at Buck Hill in Burnsville. The top two teams from each of eight sections advance to state. “Chanhassen has a bunch of good skiers,” said Nelson. “Everyone on our
team stood, and that was the main goal. Maybe we were a little bit too conservative, but we accomplished our goal [going to state].” Chanhassen had 378 points to Edina’s 373. Burnsville finished third with 333. Eden Prairie 328 and Jefferson 293 rounded out the top five. Jake Campbell was the Hornets’ top skier, finishing sixth. Spencer Knack followed in ninth place and Peter Smith took 12th place. Rounding out Edina’s finishers were Will Baker (17th), Rolf Tengdin (22nd) and Alex Thomson (26th).
Edina girls Edina High’s girls team finished fifth in the Section 6 team standings with 286.5 points. Anna Martinez, who finished eighth in the section, is Edina’s lone state qualifier. “Anna is a delight to watch,” said Nelson. “She has very good technique and has made great progress this year. “Every one of our girls had her best run of the year.” Jefferson won the section girls title with 304 points. Also finishing ahead of Edina were Burnsville (300), Lakeville South (300) and Lakeville North (299).
Going into the final week of the Lake Conference boys hockey season, Edina High needs two victories for an outright championship. The Hornets will play Wayzata at 7 p.m. Thursday, Feb. 16, at Plymouth Ice Center. They will finish up with a 3 p.m. game against Eden Prairie Saturday, Feb. 18, at Eden Prairie Community Center. “The biggest thing is the competition,” said Edina head coach Curt Giles. “We’re playing two great teams this week.” Against Wayzata, Giles said he expects a physical test. The Hornets go into the game 19-4 overall. Wayzata stands 13-9-1. “Wayzata always blocks a lot of shots,” Giles noted. “And they force you to make the extra pass. They’ll try to keep us to the perimeter as much as possible.” Wayzata has a balanced attack, led by senior captain Sam Majka. Alec Almquist has been steady in goal all season and played well in a 4-3 overtime loss to Minnetonka Feb. 11. Eden Prairie poses a different challenge than Wayzata, Giles said. “Eden Prairie is similar to us,” he said. “They’re fast and they like to move the puck.” Edina is 5-1 in conference play while Minnetonka is second at 5-2 and Eden Prairie is third at 4-2. The Hornets’ success this week could depend on their efficiency on the attack. Sophomore Connor Hurley and freshman Dylan Malmquist are the top guns for Edina. Hurley has 44 points on 20 goals and 24 assists while Malmquist has 39 points on a team-leading 22 goals and 17 assists. Andy Jordahl is another top producer with four goals and 20 assists for 24 points. Junior captain Louie Nanne has 17 points on 12 goals and 5 assists.

Bloomington Kennedy never had a chance in the Section 2AA girls hockey tournament opener against Edina Feb. 10 at Braemar Arena. Edina was too fast, too quick with the puck and too deep for the Eagles. At the end of the night, the shot board showed Edina with 64 and Kennedy with eight in a 10-0 Hornet victory. In most ways, it was a game you might expect between a No. 1 seed (Edina) and a No. 8 seed. “Kennedy played hard and put up a good fight,” said Edina head coach Laura Slominski. “Both teams handled the game well.” There were only four penalties called, two against each team. Edina went 2-for-2 on the power play.
Megan Armstrong, Liz Trautz and Taylor Williamson each scored two goals to lead Edina’s attack. Anna Bartz, Hannah Burns, Sarah Nielsen and Lizzy Otten each added a goal. Armstrong and Nielsen had two assists apiece. Kennedy goalie Kathryn McGaffey had 54 saves in the final game of her high school career. Maddie Dahl stopped all eight Kennedy shots. “It was fun to watch our seniors play for the last time at Braemar,” said Slominski, whose team will play on neutral ice for the remainder of the playoffs. “The last time together in your own building is always special.” Edina advanced to play Bloomington Jefferson in the Section 2AA semifinals Tuesday, Feb. 14. The game was in progress as this edition went to press. The winner will face Eden Prairie or Chanhassen/Chaska in the section finals at 7 p.m. Friday, Feb. 17, at Bloomington Ice Garden.
