Like many Minnesotans, Joe Brandmeier will pack the car and head up north with his family this summer. The Edina director and producer said nothing beats the quiet draw of the lake and cabin. “When you’re driving out of town, you’re thinking about utility bills and all these little things, and then you just start to relax a little bit,” he said. Brandmeier could use a vacation after a busy year that included filming the Minnesota Opera for theatrical release and his first book. “Up North: Reflections, Moments & Memories,” printed earlier this summer by Golden Valley-based Tristan Publishing, features 80-pages of his nature photography. He hopes the book will help readers get in the “up north” state-of-mind even when they can’t physically be. The images shot in northern Minnesota, Wisconsin, Michigan, California and Alaska are paired with thoughtful quotes about “slowing down, looking at nature and appreciating what you have in your backyard and the direction north,” he said. For Brandmeier, the passion for the north began with childhood trips to his grandfather’s cabin in the Nicolet National Forest in Wisconsin.

Hennepin, Dakota county mayors get behind the wheel for food shelves BY PAUL GROESSEL • SUN NEWSPAPERS New Hope Mayor Kathi Hemken gunned it around the racetrack. She did pretty well since it was her first time hopping into a door-less stockcar, a la “The Dukes of Hazard.” She and other mayors from Hennepin and Dakota county cities are going to face off at Shakopee’s Raceway Park track in September to help raise money for area food shelves. On Thursday, July 28, after laying down a little friendly smack talk to other mayors for a commercial to promote the upcoming “Race for Hunger Mayors Cup,” Hemken took a stockcar out for a spin on the track. So, how’d her test spin go? “Fabulous. You really do have to pay attention,” Hemken said. “It’s not like driving on the streets of New Hope.” Although the list of participants hasn’t been confirmed for the “Race for Hunger Mayors Cup,” event organizer Denny Barlau said around 20 mayors and city representatives could take part in the races. The event has been scheduled Sept. 9 at Raceway Park, 1 Checkered Flag Blvd., Shakopee. Gates open 5 p.m.; time
trials and photo sessions start 5:30 p.m., and opening ceremonies begin 7:30 p.m. Aside from seeing area mayors stockcar race against each other in several heats, guests can also see Minnesota Viking cheerleaders, Swarm cheerleaders, and retired North Star hockey players. To open the event, Westside 1 Skydivers will jump from 24,000 feet and land and parachute to the center of the track. Tickets are $12.50 at the gate and presale tickets are $10. Children 12 and under are admitted for free. Ticket proceeds will go to Hennepin County’s Emergency Food Shelf network and Dakota County food shelves. Raising $100,000 is the goal, Barlau said. “Because our food shelves are in such bad shape … there’s nothing worse than letting kids go hungry,” Barlau said. Hemken hopes some people show up to have a good time and support families in need. (And, maybe so they can see other racers eat her dust.) “[It] sounds like a fun event, and the money is all going to a really good cause,” she said. Info: 612-280-7418.

Despite funding delay, education bill could benefit Edina Public Schools Borrowing offset by increased funding formula Edina Public Schools is actively preparing for the 2011-12 school year. A final piece of the planning puzzle was the conclusion of the 2011 Minnesota legislative session. While no one desired a state government shutdown, I recognize and appreciate the hard work of all our state elected officials to complete the session. I feel this session had many favorable results for our school district related to the education bill. The significant state funding challenges will require school districts in Minnesota to have 40 percent of their state funding revenues (approximately $24 mil-

lion for Edina Public Schools) delayed by a year. This will require school districts to borrow money to meet their cash flow needs. School districts will receive a slight increase in the funding formula (approximately $400,000 for Edina), which will cover the costs of borrowing. The administration is assessing our future cash flow and other educational needs to ensure we effectively use this new revenue. The approved 201112 budget anticipated a majority of the changes to state funding revenues. The $2.3 million of
Budget Reductions, Reallocations and Revenue Generation adjustments reflected in the budget will remain in place. The school district is still waiting to receive specific details from the Minnesota Department of Education related to this session. The final bill has several provisions that can create opportunities for Edina Public Schools to advance our educational plans, including: • creating a task force to repurpose integration revenue to close the achievement gap • retaining costing formulas to support excess costs in Special Education • repealing the Jan. 15 negotiation deadline, which had negatively impacted our district in 2010 • establishing a principal and
teacher evaluation framework • creating greater flexibility in several categorical funding areas • modifying the school calendar to be based on total number of hours versus school days • increasing spending flexibility in several categories for school districts Our school district will continue to keep everyone informed as the provisions are implemented. Further, I will continue to work with our state elected officials to address the long-term school funding challenges facing our state. The 2012 legislative session is not that far away, and I expect discussions will be occurring seeking long-term solutions to ensure adequate funding to support students well into the 21st century. I wish everyone a great start to the new school year.
Know your long-term care funding options A common misconception by many seniors is that Medicare will pay for their long-term care needs without any limits. But it’s not that simple. Seniors do get a booklet titled “Medicare and You” from the office of the Centers for Medicare and Medicaid Services. That booklet has 140 pages explaining the benefits and special programs that a person age 65 is entitled to if they have worked at least 40 quarters. Other special ways to become eligible for Medicare are also outlined in that booklet. It is not until page 109 that the subject of long-term care and payment is addressed. Only three pages are dedicated to the topic. These pages explain what services are covered and where the

services can be provided. The list is quite broad and comprehensive. It does point out “at least 70 percent of people over 65 will need long-term care services at some point.” Most of the pages tell about various programs that pay for long-term care. First on the list is long-term care insurance, followed by personal resources and other private options. Those are followed by the mention of Medicaid and other programs. All of the care offered by
Medicare is to help individuals recover their health. Medicare, as explained on page 28, covers care in a skilled nursing facility on the condition it “must be medically necessary after a three-day minimum inpatient hospital stay for a related illness or injury. An inpatient hospital stay begins the day you’re formally admitted with a doctor’s order and doesn’t include the day you’re discharged. To qualify for care in a skilled nursing facility, your doctor must certify that you need daily skilled care like intravenous injections or physical therapy. Medicare doesn’t cover long-term care or custodial care.” Then you have to go to page 136 to find out that if you do qualify for skilled nursing care, Medicare will pay in full the first
20 days of your stay and you will pay a daily cost of $137.50 per day, if necessary, for days 21 to 100. The average stay is less than 30 days with these restrictions. Since many seniors fail to plan for a long-term care event, many end up on Medicaid as the default source of funding. The Citizens League reported in December 2010 that Medicaid as a default source of funding cost the state of Minnesota $1.1 billion in 2010 and could increase to $5 billion in 2035. With an aging population, and a lack of planning and understanding, Minnesota should prepare for a flood of taxpayer-supported Medicaid. OPTIONS: TO NEXT PAGE

Let opinion be known To the editor: Paul Wahl’s July 14 column “Letters to the Editor: We really do love them” urged readers to step up to the press with their opinions. I have also wondered why letters are seldom written in response to published opinion pieces in the Sun-Current. When seeing my own entries in print on wood smoke, scented laundry products and
other practices that degrade our community health and livability, I have anticipated both affirmation and opposition, but no response seems to be the norm. Could it be that Edina is a stereotypical suburb that chooses isolation from big city issues, even though these issues are just as prevalent here? I hope not. It is an honor to be published anywhere, because the written word is powerful. Words can educate, mold public opinion and move mountains. I’m told that many folks read only
the opinion section because it helps them connect with others and sharpen their perspective on a variety of current topics. It is relatively easy to be published in community newspapers compared to competing for ink in larger newspapers. Edina man charged in $20M fraud scheme An Edina mortgage broker was charged Friday, July 22, in federal court for his role in a $20 million mortgage fraud scheme that involved 57 properties. Derrick Ivan Lance, 40, was charged via information with one count of conspiracy to commit wire fraud, according to the U.S. Attorney’s Office. Between 2004 and 2007, Lance allegedly conspired with others to obtain mortgage loan proceeds based on fraudulent documentation. Lance’s co-conspirators identified residential properties available for purchase and recruited buyers for those properties. Two of the co-conspirators allegedly told buyers they would receive kickbacks after the property transactions closed, and that they could put those payments toward the mortgages or use them to improve the properties. Lance allegedly used his licensed mortgage brokerage and his position

within that brokerage to help prepare and submit false mortgage loan applications, which misrepresented the buyers’ true financial situation. Based on those fraudulent documents, loans were approved and disbursed by wire transfer into the accounts of various title companies. Lance and his co-conspirators then allegedly caused those title companies to disburse a portion of the proceeds from each transaction into bank accounts not associated with the property buyers, the purpose being to conceal the undisclosed kickbacks. Lance received approximately $200,000 for assisting buyers to secure mortgage loan funding for 26 properties. If convicted, he faces a potential maximum penalty of 20 years in prison. On June 27, Roger Bill Hanks of Coon Rapids pleaded guilty to one count of conspiracy to commit wire fraud in connection to the scam.

The following is a summary of selected incidents listed on the Edina Police Department weekly crime report July 1824: July 18 – A 28-year-old Edina man was arrested for DWI on the 7500 block of Cahill Road after officers responded to the report of a man passed out in a vehicle behind a business. A Hyundai vehicle valued at $6,000 was reported stolen from a driveway on the 5000 block of Bruce Place. A burglary was reported at Voice and Data Network, 6981 Washington Ave. S. Unknown persons forcibly entered the business and stole laptops valued at $2,300. Property damage was reported on the 3700 block of 57th Street West. An unknown person poured an unknown liquid on the victim’s lawn. An undetermined amount of merchandise was reported stolen from Viking Sewing Gallery, 3411 Hazelton Road. A 14-year-old boy was arrested for theft at Southdale Center after stealing two baseball hats valued at $50 from Franchise Sports. July 19 – A 16-year-old boy and two 14year-old boys were arrested for curfew violation after officers responded to McDonalds, 6575 York Ave. S., on the report of a disturbance. Property damage to a mailbox was reported on the 6200 block of Hillside Road. A 31-year-old Minneapolis man was arrested for stealing a cell phone valued at $700 off a desk at Nielson Company, 7600 France Ave. S. Property damage to a mailbox was reported on the 6000 block of Arbour Lane. A cell phone valued at $500 was reported stolen from a locker at LA Fitness, 4175 76th St. W. Property damage to a mailbox was
reported on the 5000 block of Schaefer Road. A 53-year-old Minneapolis man was arrested for theft at Cub Foods, 6775 York Ave. S., after leaving the store without paying for chicken valued at $14. July 20 – A 17-year-old boy was arrested for possession of stolen property on Highway 169 after officers stopped the vehicle he was driving for speeding. The vehicle had been reported stolen. An 18year-old Shakopee woman and 19-year-old Richfield man in the vehicle were arrested for tampering with an automobile. Another 17-year-old boy in the vehicle was arrested for tampering with an automobile and curfew violation. A purse and contents valued at $630 were reported stolen from a vehicle parked on the 4300 block of 66th Street West. July 21 – A 19-year-old River Falls, Wis., man was arrested for theft of a motor vehicle and burglary on Highway 62 at Tracy Avenue after an officer on routine patrol stopped the vehicle he was driving for a traffic violation. The vehicle and contents were valued at $55,104. A 19-year-old Bloomington man was arrested for burglary and two other 19year-old Bloomington men were arrested for tampering with an automobile. Property damage to a mailbox was reported on the 4900 block of Malibu Drive. Property damage was reported on the 7500 block of Cahill Road. An unknown person scratched the paint a vehicle. A 28-year-old Prior Lake man was arrested for driving after suspension, with no insurance and for failure to transfer a vehicle title on Highway 169 at Highway 494 after the vehicle he was driving was stopped for a traffic violation. July 22 – A purse and contents valued at $1,057 were reported stolen from a vehicle parked on the 5100 block of Wooddale Avenue.

A 24-year-old Champlin man was arrested for possession of marijuana and drug paraphernalia on Highway100 at 66th Street after the vehicle he was driving was stopped for a traffic violation. July 23 – A 22-year-old Minneapolis woman was arrested for theft at Southdale Center after a Macy’s employee observed her leave the store without paying for clothing valued at $308. An 18-year-old Edina man was arrested for violation of an order for protection on the 7100 block of Tralee Drive. July 24 – A cast iron chicken valued at $400 was reported stolen from a yard on the 4200 block of Crocker Avenue. Suspicious activity was reported on the 4800 block of Bywood West. A cell phone valued at $250 was reported stolen from a vehicle parked on the 3900 block of 70th Street West.
Fire report The Edina Fire Department responded to the following incidents July 18-24: July 18 – An ambulance and engine crew responded to a vehicle crash with injuries on France Avenue south of Highway 62. Firefighters helped remove a person from a stalled elevator on the 7100 block of France Avenue. Smoke and a burning plastic odor were
reported on the 4200 block of Crocker Avenue. A plastic bag was placed on a toaster oven while the power was out and when power was restored, the toaster oven turned on, melting the bag. Firefighters investigated a malfunctioning carbon monoxide detector and 17 false fire alarms. There were 14 responses for emergency medical service by paramedic firefighters. July 19 – There were eight EMS responses and five false fire alarms. July 20 – A natural gas odor was reported near a park building on the 5200 block of Minnehaha Boulevard. No gas was measured but combustibles found too close to the water heater. It was recommended that the gas company continue to the scene to inspect. There were nine EMS incidents and five false fire alarms reported. July 21 – Paramedics responded to a vehicle versus bicycle accident with injuries on the 7000 block of York Avenue. A smoke odor was reported on the 5200 block of Grandview Lane. The resident also reported a buzzing sound coming from a newly installed doorbell. Firefighters used a thermal imaging camera to find heat coming from the doorbell. Firefighters disconnected power to the doorbell and recommended the resident contact the person who installed it for repair.
A natural gas odor was reported on the 7600 block of Parklawn Avenue. No hazardous amounts of natural gas were measured. Sewer gas was found to be the cause of the odor. There were nine EMS responses and two false fire alarms reported. July 22 – There were 16 EMS calls and one false fire alarm. July 23 – A vehicle versus bicycle crash was reported on the 4300 block of West 66th Street. Firefighters and paramedics assisted an occupant of an apartment building with a malfunctioning natural gas stove. Gas was turned off to the stove and the resident was advised to notify maintenance to repair. Arcing power lines were reported and investigated twice on the 6400 block of Parkwood Road, the 4600 block of Lexington Street and the 6000 block of Kellogg Avenue. A smoke smell was reported on the 7300 block of Gallagher Drive. Burnt food was found to be the cause of the odor. Firefighters assisted a resident of an apartment building with a fire alarm malfunction. There was one false fire alarm and 12 EMS incidents. July 24 – There were three EMS and three false fire alarm responses.

Help homeless teens in Hennepin County The Suburban Host Home Program is a new community-based response to homeless youth in the suburbs of Hennepin County. The mission of the program is to address the housing needs of homeless youth age 16-21 by connecting them with caring adults from their
own communities who are willing to provide safe, stable housing and support. It is a collaboration of Avenues for Homeless Youth, Teens Alone, YMCA/POINT Northwest and Oasis for Youth. Book FROM PAGE 1 “We’d all pack into a bad station wagon with no seatbelts and we would drive north,” said Brandmeier, who grew up in Fond du Lac with five siblings. “It’s always been an escape from reality for me.” Brandmeier’s work has taken him around the globe, including six weeks in Africa for MTV and time in Haiti with Wyclef Jean. He’s worked with celebrities including Prince, Janet Jackson, Run-D.M.C. and Suze Orman, but while exciting, the entertainment business can be draining, he said. “On a set of a shoot you have numerous people – 50 or 60 people sometimes. You’ve got clients, and artists and egos, but when I’m with my camera it’s my getaway,” he said. “It’s just me and my camera.” The photos in the book show a range of seasons, from colorful summer sunsets and bright autumnal leaves to snow-covered branches and the baby deer of spring. He said people from Minnesota and Wisconsin – where everyone “owns a cabin, rents a cabin or has friends that do” – have a special appreciation for summer, especially after a “winter from hell” like this year. He said he’s always amazed to see the landscape go from dead

I think nature helps me reenergize,” he said. Brandmeier said everyone can relate to the idea of “Up North” no matter where they’re from. He said he expects readers to see themselves inside the pic-
tures and remember a moment they’ve had. “It’s about a feel and a place rather than a specific location,” he said. His favorite quotation in the book comes from legendary preservationist John Muir, considered the father of the national parks. He said, “When one tugs at a single thing in nature, he finds it attached to the rest of the world.”
Other words in “Up North” are credited to great thinkers like Albert Einstein, as well as Brandmeier’s friends and family, including wife of more than 20 years Joan Steffend, a former KARE-11 news anchor and reporter and HGTV host. When they travel up north with their daughters 27 and 22, Brandmeier said they are always still happy to get back to their longtime Edina home.

Some of the best senior golfers in the world will come to Blaine for the annual 3M Championship this week. Rounds will be played Aug 5-7 at TPC Twin Cities in Blaine. Among the competitors will be tour greats Tom Watson, Tom Lehman, Mark O’Meara and Fred Couples. Greats from the past will also be on hand for the 3M Championship. There will be autograph sessions with Arnold Palmer and Lee Trevino.
ILYA Championships The Inland Lakes Yachting Association is set for its championship regatta on Lake Minnetonka. ILYA champions will be determined in the MC, C, A and E classes Aug. 12-21 as the Minnetonka Yacht Club serves as the sponsoring organization. Rob Evans and Tom Burton, two of the local sailors vying for titles, will skipper their boats against some of the top sailors in the world. Evans from Orono and Burton from Deephaven each have won nine ILYA championships.
Legion regional set Minnesota’s state champion and runner-up will play in the Central Plains Regional American Legion Baseball Tournament Aug. 4-8 in Dickinson, N.D. As of July 31 six teams were still in the running for those two berths. The Minnesota state tourney was scheduled to conclude Aug. 1 at Eden Prairie’s Round Lake Stadium. Minnesota’s final six included two teams from the South Hennepin League, Eden Prairie and Hopkins. Centennial, Hermantown, Osseo and Sauk Rapids were the other teams still in contention. Eden Prairie, the defending state and regional champion, and Sauk Rapids were the two undefeated teams as of Sunday afternoon.

Homers boost Turbos Edina slowpitch slugger rakes in 14-13 victory BY JOHN SHERMAN • SUN NEWSPAPERS Pete “Sundance” Tourek of the Techware Turbos hit three home runs July 25 to lift his team to a 14-13 victory over Mielke Building and Remodeling in the Edina Monday Doubleheader Rec Softball League. The Techware slugger, whose efforts produced nine RBI, modestly assessed his performance after the game at VanValkenburg Park. “It was a good night,” he said. Techware and Mielke are two perennial contenders in Monday Rec slowpitch, and some good-natured banter between them is part of the game. “We always enjoy playing Mielke,” said Techware player/manager Steve
Nelson. “They’re small, but they’re slow.” “They may have beaten us tonight,” said player/manager David Mielke of the Mielke squad. “But I’m sure they haven’t forgotten the 24-4 whipping we put on them the last time.” The Turbos have become accustomed to winning a high percentage of their games. Two years ago, they won the Monday Rec playoffs. And last year, they were runners-up. “The team was formed in 1992,” said Nelson. “At that time, it was basically the 1991 Edina High School baseball team.” Nelson and Kevin Gabrik are the only original members still with the team. The Turbos are known for their defense. Some say hitters dominate the Monday league, but if the old saying TURBOS: TO NEXT PAGE
Solid pitching performances from Mark Schroeder and Chad Volbert helped the Edina ESOX sweep the Westside Bombers in a first-round Riverview Amateur Baseball League playoff series last week. Schroeder pitched eight innings in a 5-0 win in the best-two-of-three series opener. The ESOX won the second game 12-7 with Volbert pitching 4 and 2/3 scoreless innings in relief of starter Erik Olson. “Mark [Schroeder] was in control from the opening pitch,” said ESOX manager Denny Scanlon. “He had all of his pitches working and made it look easy.” “I got ahead on the count, and we made plays defensively,” said Schroeder. “It’s always huge to win the first game of a playoff series, and winning tonight definitely gives us momentum.” The ESOX defense was flawless in the playoff opener, and their hitting was timely. “Robert Dunlop had an RBI single, Brashad Johnson had two hits and Andy Bartz hit a triple,” said Scanlon. In the second game of the series, Edina’s offense was even more impressive. “When you score 12 runs, it’s usually a total team effort,” said Scanlon. “Jack Schechinger hit a home run. Dunlop singled in two runs. Bartz and Brashad [Johnson] had two hits each. Our young second baseman, Alex Smith, hit a pair of doubles Really, everyone, 1-9, got involved.” The win in the first series earned Edina a spot opposite the Bloomington Bandits in the second series. The winner will qualify for the state Class A tournament. George Walker, who played center field for Edina-East High School in the 1970s, coaches Bloomington. He won a silver medal with the Hornet baseball team at 1977 state tournament. George’s two sons, Dusty and Ryan, play for the Bandits and George is still on the active roster. Although it has been a long time since George has played regularly, he’s no slouch at the plate. The ex-Hornet has a .750 average with three hits in four atbats.

BY JOHN SHERMAN • SUN NEWSPAPERS The Love Handles have dominated the Edina 35 & Over Men’s Rec Softball League for the last six seasons. However, the team’s three-year, 33game winning streak ended in a 19-17 loss to the Bruce Avenue All-Stars July 21 at VanValkenburg Park. There was a party on Bruce Avenue that night. Meanwhile, the Love Handles took the loss philosophically. Rick LaVercombe, player/coach of the Love Handles, said, “Eventually, we had to lose one. We’ve won the Edina 35 & Over championship five years in a row.” The 33-game winning streak began when the Love Handles won their final 10 games in 2009. Last summer they made a clean sweep with a 14-0 record. They had nine consecutive wins this season before losing to the Bruce Avenue All-Stars. How did the team get the name Love Handles? “We were sponsored by Bunny’s for a long time,” said LaVercombe. “The Love Handles name describes our body shape.” LaVercombe has been playing Edina rec softball since 1987 and is one of the most recognizable faces at VanValkenburg Park. He usually plays third base for the Love Handles and also plays third base for Mielke Building and Remodeling in the Monday Night Doubleheader League. “Our core group has been together for a long time,” he said LaVercombe. “That would be me, Mike Halloran, Scott Jenewein, Bob McGarry, Pat McGovern, Tim McGovern, Mike Rooney and Jim Williams.” Other team members are Bill Bausman, John Conway, Chris Garvin, Dave Mielke and Jason Sirek. “We play for fun, and we play to win,” said Pat McGovern, the starting pitcher. Most of the Love Handles also play in the Monday Night League, so there is plenty of bonding on the field and after the games. “If we weren’t playing ball together, we might not see each other at all,” said LaVercombe. “In the old days, we used to play in state tournaments. Now, we’re just a bunch of friends getting together to play ball.” The Love Handles take a 9-1 record into the 35 & Over playoffs, which begin this week at VanValkenburg Park. While the Bruce Avenue All-Stars are a definite roadblock, the Love Handles are once again favored to pinch the playoff title.

Third baseman Matt Svidron made a couple of impressive defensive plays to help save the win over Mielke. Mielke was down 14-8 going into the seventh inning and gave the Turbos a scare before the game ended. Scott Bantz hit a three-run homer to cut the Turbos’ lead to 14-11, and then Rob Presthus smashed a two-run homer to make it 14-13 before a flyout ended the game. In their other game on the 25th, the Turbos defended well all over the field and beat Mayhem 17-7. The Turbos are 15-5 this summer and took third place in regularseason play. Champps emerged as the regular-season champion, but with the playoffs coming up, the Turbos are optimistic. “We beat Champps once and lost to them once,” said Nelson. “Anything could happen if we play them again.” Mielke Building and Remodeling finished sixth in the league standings, but could be a tough out in the playoffs with its power hitting and speedy outfield defense. Mielke also has one of the league’s most deceptive pitchers, Pat McGovern. Monday Rec playoffs were underway as this edition went to press. The playoffs will continue Monday, Aug. 8, at VanValkenburg Park.

3. Economic considerations alone do not constitute practical difficulties. 4. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems, 5. Variances shall be granted for earth sheltered construction as defined in Minnesota Statutes 216C.06, Subd. 14 when in harmony with this section. 6. No variance may be granted that would allow any use that is not allowed in the zoning district in which the subject property is located. 7. A variance may be approved for the temporary use of a one family dwelling as a two family dwelling. 8. A favorable vote by the Board shall be deemed to include a favorable finding on each of the foregoing matters even if not specifically set out in the approval resolution or the minutes of the Board meeting. I. Conditions on Variance Approvals. In granting a variance, the Board, or the Council on appeal, may impose condi-
tions. A condition must be directly related to and must bear a rough proportionality to the impact created by the variance. Section 2. City of Edina (Official Publication) ORDINANCE NO. 2011-12 AN ORDINANCE AMENDING CHAPTER 4 OF THE EDINA CITY CODE CONCERNING ELECTRICAL REGULATIONS THE CITY OF EDINA ORDAINS: Section 1. Chapter 4 of the Edina City Code is amended by adding Section 412 to provide as follows: Section 412 – Electrical Regulations 412.01 Purpose; Application of this Section Subd. 1 The purpose of this Section is to implement the provisions of the Minnesota State Building Code and Minnesota Rules Chapter 1315 which adopts the National Electrical Code. Subd. 2 The provisions of this Section shall apply to all installations of electrical conductors, fittings, devices, fixtures hereinafter referred to as "electrical equipment", within or on public and private buildings and premises, with the following general exceptions. The provisions of this Section do not apply to the installations in mines, ships, railway cars, aircraft, automotive equipment or the installations or equipment employed by a railway, electric or communication utility in the exercise of its functions as a utility, except as otherwise provided in this Section. Subd. 3 As used in this Section, "reasonably safe to persons and property" as applied to electrical installations and electrical equipment means safe to use in the service for which the installation or equipment is intended without unnecessary hazard to life, limb or property. Subd.4 For purposes of interpretation of the provisions of this Section, the most recently published edition of the National Electrical Code shall be prima facie evidence of the definitions and scope of words and terms used in this Section. 412.02 Electrical Inspector, Qualifications and Appointment Subd. 1 Creation; Qualifications: There is hereby created the office of Electrical Inspector. The person chosen to fill the office of Electrical Inspector shall be of good moral character, shall be possessed of such executive ability as is requisite for the performance of his duties and shall have a thorough knowledge of the standard materials and methods used in the installation of electrical equipment; shall be well versed in approved methods of construction for safety to persons and property; the statutes of the State relating to electrical work and any orders, rules and regulations issued by authority thereof; and the National Electrical Code as approved by the American Standards Association; shall have two (2) years' experience as an electrical inspector or five (5) years' experience in the installation of electrical equipment, or a graduate mechanical or electrical engi-
neer with two (2) years of practical electrical experience. A. Licensed Inspector: The electrical inspector shall be a licensed master or journeymen electrician as defined under Minnesota Statutes. B. Duties of the Electrical Inspector: It shall be the duty of the Inspector to enforce the provisions of this Section. The Inspector shall, upon application, grant permits for the installation or alteration of electrical equipment, and shall make inspections of electrical installations, all as provided in this Section. The Inspector shall keep complete records of all permits issued, inspections and reinsertions made and other official work performed in accordance with the provisions of this Section. C. No Financial Interest: It shall be unlawful for the Inspector to engage in the sale, installation or maintenance of electrical equipment, directly or indirectly, and the Inspector shall have no financial interest in any concern engaged in any such business. D. Authority of Electrical Inspector: The Inspector shall have the right during reasonable hours to enter any building or premises in the discharge of his official duties, or for the purpose of making any inspection, reinsertion or test of electrical equipment contained therein or its installation. When any electrical equipment is found by the Inspector to be dangerous to persons or property because it is defective or defectively installed, the person responsible for the electrical equipment shall be notified in writing and shall make any changes or repairs required in the judgment of the Inspector to place such equipment in safe condition. If such work is not completed within fifteen (15) days or any longer period that may be specified by the Inspector in said notice, the Inspector shall have the authority to disconnect or order discontinuance of electrical service to said electrical equipment. In cases of emergency where necessary for safety to persons and property, or where electrical equipment may interfere with the work of the Fire Department, the Inspector shall have the authority to disconnect or cause disconnection immediately of any electrical equipment. 412.03 Standards for Electrical Equipment Installation Subd. 1 All installations of electrical equipment shall be reasonably safe to persons and property and in conformity with the provisions of this Section and the applicable statutes of the State and all orders, rules and regulations issued by the authority thereof. All electrical equipment shall be listed and labeled by a testing agency. Subd.2 Conformity of installations of electrical equipment with applicable regulations set forth in the current National Electrical Code as adopted by the Minnesota Rules shall be prima facie evidence that such installations are reasonably safe to persons and property. Noncompliance with the provisions of this Section or the National Electrical Code as adopted by the Minnesota Rules shall be prima facie evidence that the installation is not reasonably safe to persons and property. Subd. 3 The Electrical Inspector may, with approval of the Building Official, authorize installations of special wiring methods other than herein provided for. Subd.4 Buildings or structures moved from without to within and within the limits of the City shall conform to all of the requirements of this Code for new buildings or structures. Subd. 5 Existing buildings or structures hereafter changed in use shall conform in all respects to the requirements of this Code for the new use.
412.04 Connections to Installations Subd. 1 It shall be unlawful for any person to make connections from a supply of electricity to any electrical equipment for the installation of which a permit is required or which has been disconnected or ordered to be disconnected by the Electrical Inspector. Subd. 2 The public or private utility providing services shall disconnect the same upon a written order from the Electrical Inspector, if the Inspector considers any electrical installation unsafe to life and property or installed contrary to this Code. 412.05 Permits and Inspectors Subd. 1 Permit Required: An electrical permit is required for each installation, alteration, addition or repair of electrical work for light, heat and power within the limits of the City. Permits for the installation of electrical work in new structures shall only be issued to electrical contractors duly licensed by the State. Permits for the installation, alteration, addition or repair of electrical work in existing structures shall only be issued to electrical contractors duly licensed by the State or to resident owners of property where the work is to be done. Subd. 2 Public Service Corporation Exception: No permit shall be required for electrical installations of equipment owned, leased, operated or maintained by a public service corporation which is used by said corporation in the performance of its function as a utility, except that such electrical installation shall conform to the minimum standards of the National Electrical Safety Code. Subd.3 Ownership: Ownership of any transmission or distribution lines or appurtenances thereto, including, but not limited to, transformers, shall not be transferred by a public service corporation to any person, except another franchised public service corporation dealing in electric energy for distribution and sale, without a permit first having been issued therefore by the City. Such permit shall be issued only after the facilities to be transferred have been inspected and approved as provided in this Section and upon payment of an inspection fee as set forth in this Section of the Section. Subd. 4 Application and Plans: Application for such permit, describing the electrical work to be done, shall be made in writing, to the City by the person so registered to do such work. The application shall be accompanied by such plans, specifications and schedules as may be necessary to determine whether the electrical installation as described will be in conformity with all the legal requirements. The fees for electrical inspection as set forth in this Section shall accompany such application. If applicant has complied with all of the provisions of this Section, a permit for such electrical installation shall be issued. Subd. 5 Concealment: All electrical installations which involve the concealment of wiring or equipment shall have a "rough-in" inspection prior to concealment, wherein the Inspector shall be duly notified in advance, excluding Saturday, Sunday and holidays. Subd. 6 Inspection Fees: A. Permits Required: Before commencing any installation of any work regulated by this Section, a permit therefore shall be secured from the Building Department and the fee for such permit paid. The fess schedule set forth in Minnesota Statutes § 326B.37 is adopted by reference and incorporated herein. No such permit shall be issued to do any of the work or make any installation regulated by this Section except to persons licensed to do such work under the terms of this Section. Holders of a contractor's license shall not
obtain permits for electrical work unless the work is supervised by them and is performed by workers employed by them or their firm. B. Fees Double, When: Should any person begin work of any kind, such as set forth in this Section, or for which a permit from the Electrical Inspector is required by ordinance, without having secured the necessary permit therefore from the Inspector of Buildings either previous to or during the day of the commencement of any such work, or on the next succeeding day where such work is commenced on a Saturday or on a Sunday or a holiday, he shall, when subsequently securing such permit, be required to pay double the fees provided for such permit. C. Additional Fees and/or Shortages: Additional fees and/or fee shortages must be received by the City within fourteen (14) days of written notice. If additional fees and/or fee shortages are not received within fourteen (14) days of notice, permits for electrical installations will not be accepted by the City until such time as the additional fees and/or fee shortages are received. Subd.8 Electrical Inspections: A. At regular intervals, the Electrical Inspector shall visit all premises where work may be done under annual permits and shall inspect all electrical equipment installed under such a permit since the day of his last previous inspection, and shall issue a certificate of approval for such work as is found to be in conformity with the provisions of this Section, after the fee required has been paid. B. When any electrical equipment is to be hidden from view by the permanent placement of parts of the building, the person installing the equipment shall notify the Electrical Inspector and such equipment shall not be concealed until it has been inspected and approved by the Electrical Inspector or until twenty four (24) hours, exclusive of Saturdays, Sundays and holidays, shall have elapsed from the time of such scheduled inspection; provided, that on large installations where the concealment of equipment proceeds continuously, the person installing the electrical equipment shall give the Electrical Inspector due notice and inspections shall be made periodically during the progress of the work. C. If upon inspection, the installation is not found to be fully in conformity with the provisions of this Section, the Electrical Inspector shall at once forward to the person making the installation a written notice stating the defects which have been found to exist.
