Better late than never: Penn & American Phase 1 is coming BY MIKE HANKS • SUN NEWSPAPERS A highly traveled intersection in Bloomington that was once home to two car dealerships has sat vacant longer than anyone anticipated, but it will soon begin taking shape as home to people who live, work and shop in Bloomington.
The Penn & American district at the intersection of Penn Avenue and American Boulevard is not much more than a pair of empty lots at the moment, but groundbreaking for the first of two long-anticipated phases of redevelopment at the busy intersection is slated for next spring.
In November the Bloomington City Council approved the final development plan for what is now phase 1 of the project, the southern parcel and former site of a Mitsubishi dealership. Phase 1 will comprise three multi-unit rental housing developments, with a small retail component at street
level, establishing the streetscape of a new street that already bisects the vacant lots from east to west. The project is a partnership of United Properties and Stuart Development Corporation of Bloomington. United Properties initiated the project several years ago with the pur-
chase of the former Dodge dealership at the corner and the Mitsubishi dealership the following year, according to Keith Ulstad, the senior vice president of retail investment and development for United Properties. PHASE 1: TO PAGE 25

The Bloomington Board of Education has two maps to consider as it collects final feedback for its plan to redraw the district’s elementary boundary lines, feedback it will collect next week. The board was presented with two recommendations during a Dec. 6 study session. The maps were presented a week earlier than originally scheduled and are similar. Rejected purchases at Bloomington Kohl’s results in 2 arrests Suspects attempted to make purchases with stolen credit cards BY MIKE HANKS • SUN NEWSPAPERS A Minneapolis woman who allegedly used a stolen credit card to obtain more than $2,000 in merchandise from a St. Louis Park Target store was arrested in Bloomington after she pressed her luck one more time at a Kohl’s department store. The 26-year-old woman was arrested Nov. 27 in the parking lot of the nearby Target, shortly after her purchase of $135 worth of items from Kohl’s was declined, according to Bloomington Police Commander Mark Stehlik. The woman and her 23-year-old neighbor, who lives in the other half of a south Minneapolis duplex, were arrested for attempting to purchase items from Kohl’s with credit cards identified as stolen. When the credit cards possessed by the women were rejected at Kohl’s, employees were informed one of the cards was stolen, Stehlik said. The store’s loss prevention staff contacted police and followed the women’s vehicle, which included three people who weren’t arrested, to the nearby Target parking lot. Bloomington investigators determined that the 26-year-old woman was connected to three purchases made the previous day at a Target store in St. Louis Park. Transactions totaling about $850, $750 and $510 were made at the store. Two televisions, a video game system, a mobile phone and toys were purchased during the transactions, Stehlik said. A Bloomington investigator identified the 26-year-old suspect as the woman making the fraudulent purchases in St. Louis Park through store security footage, Stehlik noted.
Burglarized again A Bloomington chiropractic office was burglarized for the second time in two weekends. Bloomington Chiropractic, 10607 France Ave. S., was burglarized between Friday evening, Nov. 26, and Sunday afternoon, Nov. 28. The business owner reported the theft of a laptop computer and $100 after discovering the door to the office had been pried open.
A janitorial employee was the last person in the office on Friday and said that there were several people in the common area of the office complex when she departed, according to Stehlik. The office had been burglarized the previous weekend, although there was no sign of forced entry during that burglary.
Arrested again A 71-year-old Bloomington man was arrested for the third time in 10 days after reports of smoke emanating from his apartment. Police were called to the 8800 block of Old Cedar Avenue South Nov. 28 and found evidence of a small fire in the bathroom sink, under the kitchen sink and on the bedroom floor of the apartment, Stehlik said. The remnants of the fire in the bedroom were still smoldering when the Bloomington Fire Department responded to the scene, Stehlik noted. The man’s hands were covered with soot, and a fire marshal said it appeared the fires had been intentionally set. The
man said he was heating a can of water for coffee when the candle he was using flared up, which he tossed in the kitchen sink, according to the complaint filed in Hennepin County District Court. He also told police he suffers from bi-polar disorder, is not on medication and hopes to be civilly committed so that he does not hurt anyone, the complaint noted. He was charged Nov. 30 with one felony count of first-degree arson. If
convicted he faces up to 10 years in prison and a fine of up to $10,000. The man had been arrested previously for possession of a dangerous weapon, making verbal threats and stalking during a Nov. 19 incident involving his ex-wife at her Bloomington residence. Three days later he was arrested for violating an order for protection by attempting to return to her residence.

After fleeing police, man arrested for DWI BY MIKE HANKS • SUN NEWSPAPERS A Richfield man with three driving while impaired convictions during the past 10 years is facing a first-degree DWI charge after a low-speed pursuit and confrontation with Bloomington police. The 38-year-old man was charged Nov. 30 in Hennepin County District Court with one felony count of driving while impaired. If convicted he faces 3-7 years in prison and a fine of up to $14,000. The man was arrested following a report of a possible drunken driver Nov. 28 at T.G.I. Friday’s in Bloomington. The man appeared to be intoxicated and refused recommendations to take a taxi home from the restaurant near Bloomington’s Mall of America, according to the complaint. Bloomington Police arrived at the restaurant and determined that the man’s red Chevrolet Blazer was parked in the lot of a nearby restaurant. They observed the man leave the parking area, exit onto Old Shakopee Road and drive westbound toward Highway 77, according to Bloomington Police Commander Mark Stehlik. The man weaved as he drove westbound at approximately 11 p.m. He turned onto the entrance ramp for Highway 77 north and nearly hit a light pole along the shoulder of the road as he made his

way toward the highway, Stehlik said. Officers following the man attempted to make a traffic stop, but the man ignored them and headed north on Highway 77 at approximately 30 mph, Stehlik noted. The man exited at Killebrew Drive and drove back to the restaurant parking area where the pursuit initially began. In the parking lot the man was instructed by police to exit the vehicle with his hands up. He said he was going to park the vehicle instead and proceeded to do so. He then exited the vehicle and approached officers, ignoring orders to stop and put his hands up, Stehlik explained. Officers forced the man to the ground and eventually handcuffed him, despite his resistance, Stehlik said. The man made threats toward officers before and after his arrest. When the handcuffs were removed for a Breathalyzer test at the Bloomington police station the man raised his fists and made another threat toward officers. He was shot twice with a Taser after disregarding police orders, Stehlik noted. The man never submitted to any tests of his level of intoxication. He was previously convicted for driving while impaired in October 2001, December 2002 and May 2004. His license was canceled at the time of his arrest and his vehicle was impounded, according to the complaint.

Mall launches public awareness campaign Mall of America in Bloomington has launched a public awareness campaign in partnership with the U.S. Department of Homeland Security, encouraging guests to identify and report indicators of any type of threat. Campaign messages will be visible – reaching more than 10 million visitors during the holidays – in Mall of America common areas through traditional and digital signs. The implementation of the campaign at Mall of America, and eventually throughout the state, encourages the public and employees to identify and report anything that may be seen as a threat. U.S. Rep. Erik Paulsen, whose Third Congressional District includes Bloomington, applauded the mall for its continued commitment to safety. “Mall of America has made great efforts to ensure the safety and security of the Mall’s many visitors and staff,” Paulsen said. The mall’s campaign is an example of its proactive approach to safety and its commitment to protecting its visitors, he added. The campaign was originally implemented by New York City’s Metropolitan Transit Authority and has since been expanded to other parts of the country.

Richfield Bloomington Credit Union opens its Bloomington branch BY NICK CLARK • SUN NEWSPAPERS Pat Brekken has himself a new office, with a fresh view of a community he has helped reinvigorate with its credit union needs. RBCU (Richfield Bloomington Credit Union) opened its new branch at 9550 Lyndale Avenue in Bloomington. It is the unofficial offspring of a 2005 decision to move away from servicing strictly Select Employee Groups (SEG) to anyone and everyone living, working, worshiping, volunteering or going to school in Richfield, Bloomington, Edina, Fort Snelling and the Minneapolis/ St. Paul Airport. And its one that officially signifies the commitment RBCU has made to the communities it serves. “We have a niche, and a focus on these communities,” said Brekken, RBCU’s president. “As the national econo-

equally. When it originally opened in 1957, their focus was teachers, meaning in order to be a member of the credit union, one had to be employed by the school district. Eventually, that expanded to all families with children in high school, but that still left a large gap in who could attain membership. “The students at the senior high schools were eligible,

which then made their families eligible,” said Brekken. “But for the second grade families, there was no way for us to go catch them and bring them in as members, so in 2005, we basically parlayed our work with the school districts that we’ve been doing for years, and just reached a little bit further.” That meant finding a way to expand. RBCU has it’s branch on 77th Street in Richfield, and another office another at 4025 West Old Shakopee Road in Bloomington. But a presence in the heart of Bloomington’s business district was a still a desire. “The low-hanging fruit was over here in Bloomington, because a lot of people in Bloomington didn’t know we existed,” Brekken said. “We didn’t have a real convenient location for them. We did a big market research study as far as where to put branches up, and 98th and Lyndale is still considered the downtown of
Bloomington from a business perspective, and fortunately, that is basically where we ended up.” The 16,000 square foot location features two floors, with the main branch on the first floor, and a call center and some executive offices on the second – one of which is Brekken’s. The City of Bloomington originally green lighted a 40,000 square foot building, and Brekken said the current building could handle an 18,000-square foot expansion at some point. Either way, it’s a start, and it looks a lot better than the old ICO gas station that used to reside on that corner. “It’s a beautiful building,” Brekken said. “And it gives us a great presence. We put in two new scoreboards at the Bloomington high schools, and people go to those fields and have their kids in school and love their community, and now here we are rising out of the abyss. And we are here to stay.”

Follow at a safe distance Delivering fresh gift ideas How many times has this happened to you: You’re driving down a snow-covered highway in obviously slipper conditions. You hang back a bit from the car in front of you, giving yourself a barrier, should traffic flow suddenly stop. Within seconds of establishing a safe following distance, someone darts into your lane – into your safety zone. Suddenly you find yourself on the bumper of the person ahead of you. I can’t tell you how many times this has happened to me already this winter driving season. Are drivers totally brain-dead? I didn’t create a safe breaking distance between my car and the car in front of me for you to have a shot at changing lanes. And what’s with people changing lanes at the drop of a hat, anyway? If you’re driving down a two-lane highway and both lanes are moving slowly or stopped, it really doesn’t matter which lane you’re in. But that doesn’t stop the idiots amongst us who still think whatever lane they are in at the time has to be the wrong one and their choice has to be remedied within the next 10 seconds or else their heads will explode. Occasionally, you come across someone who is obviously experiencing their first round of winter driving. You can usually tell by the white knuckles gripping the steering wheel. These folks I’m willing to cut a bit of slack. It’s the life-long residents who have 30 or 40 years of driving and still have no respect whatsoever for Mother Nature when she begins messing with the roadways.

Sudden movements – stopping, accelerating to fit into a six-foot opening in the opposite lane – are not part of safe winter driving. No amount of horn-honking that I’m aware of can part a weather-congested freeway. Moses may have been able to part the Red Sea, but even he would have a difficult time unclogging snow- and ice-covered roads in Minnesota. And why are people always in a hurry when the weather is the worst? If ever there were people who will understand why you’re late, it’s Minnesotans in the wintertime. Each one of us has, at one time or another, been delayed because of bad roads. No one is going to think less of you for slowing down and matching your driving style to the condition of the road. Really. It’s not a badge of honor to drive like a boor in lousy conditions. Each time a winter storm moves in, the weather folks on radio and television always tack this little caveat to the end of their forecasts: “If you don’t have to drive, stay home.” Yeah, right. Like that’s going to happen. Somehow we’ve gotten the idea that driving is our right, even if the snow is up to your hubcaps and there’s a coating of ice everywhere. Don’t be an idiot driver this winter. Slow down. Be cautious. Driving like the vehicle next to you is carrying your grandmother.
When it comes to gift ideas, it’s hard to find the right fit for each friend and family member. You want to give something that’s unique, fits the recipient’s style and still fulfills a need, but doesn’t break the bank. While I can’t knit an iPad, a luggage set or a coffee machine, knitting can create those small, personal, meaningful gifts. They are not expensive or flashy and you can’t check your email on them, but they show dedication and an attention to detail. I try to brainstorm all sorts of clever gift ideas before we even reach December. There are only so many dishcloths a person wants to receive over the years, you know. So last summer, I made a matching set for a sister-in-law’s Christmas gift: a fuzzy, black hat and a skinny, long, scarf in the same yarn. In early November, I knitted a few cranberry-red coffee cup sleeves – do they become sweaters if you add buttons? – for some of my coffee-addicted relatives. Inevitably, I hit a rut and run out of ideas. Maybe I should get a tie for Dad, but I probably shouldn’t knit one. And back to the ubiquitous dishcloth patterns I go. But Three Rivers Park District sent out an email last week with a few nifty, nonknitted gift ideas: • Gift cards – OK, so maybe a gift card to a favorite restaurant or clothing store is not unique, but I’ve heard that more people are trying to give gifts of activities or experiences rather than gifts of possessions. With a gift card, people can buy rounds of golf or golf lessons, nature and recreation program registrations, and downhill ski or snowboard lift tickets and lessons. Gift cards are available at Park District nature centers and visitor centers, Hyland Ski and Snowboard Area in Bloomington, and Elm Creek Winter Recreation Area in Maple Grove.

FIRE REPORTS Fire department called to freeway fire The Bloomington Fire Department responded to two recent vehicle fires, including a van that caught while on the freeway. Firefighters responded to the van fire just before 11 a.m. Nov. 27. The van caught on fire near the junction of Interstate 494 and France Avenue, according to Fire Chief Ulie Seal. “The freeways are dangerous spots for us,” he said. No injuries were reported as a result of the fire and it was contained without further incident, Seal noted. A garage fire reported Nov. 26 turned out to be a vehicle fire inside the garage.
Donate Your Car Firefighters responded to the report of a detached garage fire on the 2300 block of West 111th Street, but found that it was the vehicle parked in the garage that was on fire, according to Seal. There was minor damage to the garage in addition to the vehicle, and it remains unclear as to the cause of the fire. The fire may be the result of an equipment malfunction of the vehicle or a heat lamp in the garage, he noted. It wasn’t errant cooking that caused a kitchen fire on the 9800 block of Humboldt Avenue South, according to Seal said. The Dec. 1 incident appeared to be the result of a malfunctioning dishwasher, Seal said. The damage was contained to the kitchen, he noted.

Just because school will be in recess much of the latter half of December doesn’t mean students can run amok. Hennepin County has a curfew system set by age for all minors. On weeknights curfew is 9 p.m. for children younger than 12, 10 p.m. for ages 12 to 14, and 11p.m. for ages 15 to 17. On Fridays and Saturdays, curfew is one hour later for each age group. The county curfew regulations are followed and enforced by each city.

adult supervision is a violation the law, which requires them to be home by the time of curfew, not just on their way. The purpose of the curfew law is to encourage unsupervised minors to be home at a reasonable time to prevent trouble and forego opportunities for destructive or offensive behavior. General procedure for curfew violations is that the offenders are cited fined. The fines are $25 for a first offense, $50 for a second offense and $75 or two days of community service for a third.

Problems with curfew violation vary between communities. The Edina Police Department issued 115 curfew citations in 2010 through the end of October; up from 88 in 2008 and 101 in 2009. In St. Louis Park there were only 8 citations in each 2009 and through October 2010, a decrease from 15 in 2008 and around 40 in 2007 according to annual reports. Police departments with increases in citations report that the spike results in part from the rise in the level of enforcement. There is no requirement that
minors be given a warning when out past curfew. While some departments do general periodic sweeps for curfew violators, most are found and cited in the normal course of officers’ work. Historically curfew is meant to prevent delinquent behavior. If minors are required to be home or supervised by a reasonable time, it becomes less likely that they will spend their nights violating laws and regulations involving such activities as drinking, vandalism, assault and theft.

Normandale Student Showcase is Dec. 10 BY NICK CLARK • SUN NEWSPAPERS The work of around 250 of Normandale Community College students will be on display this week. Normandale will be hosting its Student Showcase from 1-3 p.m. Friday, Dec. 10 in the college’s gymnasium. As always, the highlight will be the robotics work put forth by Normandale’s first year engineering students, as they demonstrate in a very unique way what it is they can do. “They create robots that move on their own, and it’s really fun to watch,” said Jami Viergets, a lab assistant in Normandale’s engineering and physics department. “They are very diverse in what they come up with. That is a big part of the show.” The space cleared out in the middle of the gym will provide proof to just how big it is. Around it, rows of work by students from the match, biology, archaeology, physiology, astronomy and physics departments will be in display for visitors to look at and ask questions. Poster boards set up on tables will show most of the work, but the stu-

Q. What happens to the ashes after cremation? A. Your cremated remains (ashes) will be handled according to your written instructions. They may be picked up by your survivors, or will be delivered or mailed for a fee.
Q. At the time of death, what is the cost for the cremation service? A. The cost of the basic cremation service which includes removal of the body from the place of death, cremation, filing of the necessary papers and cardboard container suitable for burial is presently $1395.00 for members. This is payable at the time services are rendered. The charge to non-members, whom we also service, is more.
At the time of death, our counselors are available to assist your survivors in arranging for memorial services, obtaining certified copies of the death certificate, cemetery services, grave makers and monuments, obituaries for the newspaper and paperwork for Social Security and Veterans’ benefits.
Q. How do I join the Cremation Society of Minnesota? A. Fill out the registration form and mail it to our office with a one time registration fee of $15.00 per person. This fee defrays the cost of setting up and maintaining your records. It is not refundable nor an offset to the final service costs. Seniors and boomers see the home as the center of the family Boomers are happy where they live and like what their communities offer, enjoy being near friends and family, and appreciate access to shopping, social opportunities and healthcare, according
to a poll from AARP. Just like previous generations, they plan to stay in their homes and communities. More than eight in 10 Boomers and effectively nine in 10 people 65+
report they want to stay in their current homes for as long as possible, according to the poll released in conjunction with the unveiling of two national contestwinning room makeovers. The makeovers showcase how two of a home’s key rooms can be updated not only to be fresher and more appealing but also to be easier to use. Most Boomers already have a few basic elements in their homes that can help the homes age gracefully with their occupants, the poll reports. Eight in ten Boomers and almost nine in ten Americans over 65 have homes with two of the key elements of comfortable living at any age or ability. Eighty-two percent have a full bath on the main level of their home and 81% have a bedroom or a room on the main floor that could become a bedroom if they were injured or wanted to downsize from multi-floor living. “Far too often a person has to break a leg or contract a serious illness to discover that the home they love could restrict their comfortable lifestyle,” said Elinor Ginzler, AARP Senior Vice President for Livable Communities. “A few tweaks to key rooms and entrances when boomers and empty nesters are already remodeling can make a standard home more user-friendly for anyone at any age or ability.” To prove that point, AARP launched its “Recession Remodel” room makeover contest last year intending to show that even in a recession, bathrooms and kitchens can be updated not only to be more attractive but also to make the home more comfortable and efficient now and in the future. The final makeovers of the winning rooms — a farm house kitchen outside Charlotte, North Carolina and a Snohomish, Washington bath – are being revealed today with before and after photos and videos at www.aarp.org/remodel. Both makeovers employed universal design, a design approach that assures a room or home is easily used by anyone of any age or ability.
The Makeovers Not too long ago, North Carolina winner Jamie Hammill’s mom Judy moved back to the family farmhouse in Richfield, NC about an hour outside of Charlotte. But the pleasant old-fashioned farmhouse kitchen was outdated and hard to use. AARP’s total makeover of the winner’s kitchen unveiled today expanded and brightened the room, added an open floor plan, extensive cabinet and counter space, multi-level work and eating space, and easy to reach appliances. But her cramped bathroom didn’t fit her mother’s wheel chair and the traditional shower/tub combination posed a safety hazard for her father. Five steps to create and keep a holiday budget Unless you’re among a select group of people, sitting down and creating a budget does not sound like much holiday fun. Senior citizens and Baby Boomers love to be able to do something special for their children and grandchildren during the holidays. Nevertheless, in tough economic times, the Better Business Bureau of Minnesota and North Dakota (BBB) advises that taking the time to map out your spending in November will help ease the strain of a holiday financial hangover in January. According to a survey by Consumer Reports, shoppers planned on spending about $699 over the holidays last year, but, in a follow-up survey, admitted to actually spending closer to an average of $811 – 16 percent more than planned. Creating a budget, and being disciplined
enough to follow it, is one of the best ways to avoid overspending during the holidays. “While it isn’t the most festive way to spend an evening, sit yourself down with a calculator and crunch the numbers, because challenging economic times mean that few people can afford to spend with abandon,” said Dana Badgerow, president and CEO of the BBB. “Building a budget and sticking to it over the holidays is the best way to get your new year off to a good start.” Step One: Consider your Income. The first step is to measure how much money is coming in. Add up your monthly salary along with your spouse’s and any child support payments, dividends or interest payments and other sources of income. Especially for a senior citizen on fixed income, this
step is vital. Step Two: Add up regular monthly expenses. Adding up expenses is usually harder than determining your income because there are so many more factors to consider. Start with your rent or mortgage, utilities and credit card payments. Also factor in other expenses for gas and car maintenance, healthcare and groceries. Step Three: Estimate Extra Holiday Expenses A lot of little purchases have a way of adding up over the holidays and it’s important to consider all of the expenses of the season including: - Gifts - Make an itemized list of everyone you want to buy presents for

Stat. §123B.59, establishes an alternative facilities bonding and levy program for school districts that have: (a) An independent or special school district qualifies to participate in the alternative facilities bonding and levy program if the district has: (1) more than 66 students per grade; (2) over 1,850,000 square feet of space and the average age of building space is 15 years or older or over 1,500,000 square feet and the average age of building space is 35 years or older; (3) insufficient funds from projected health and safety revenue and capital facilities revenue to meet the requirements for deferred maintenance, to make accessibility improvements, or to make fire, safety, or health repairs; and (4) a ten-year facility plan approved by the commissioner according to subdivision 2. (b) An independent or special school district not eligible to participate in the alternative facilities bonding and levy program under paragraph (a) qualifies for limited participation in the program if the district has: (1) one or more health and safety projects with an estimated cost of $500,000 or more per site that would qualify for health and safety revenue except for the project size limitation in section 123B.57, subdivision 1, paragraph (b); and (2) insufficient funds from capital facilities revenue to fund those projects. (c) Notwithstanding the square footage limitation in paragraph (a), clause (2), a school district that qualified for eligibility under paragraph (a) as of July 1, 2007, remains eligible for funding under this section as long as the district continues to meet the requirements of paragraph (a), clauses (1), (3), and (4). Subd. 2.Facility plan. (a) A district qualifying under subdivision 1, paragraph (a), must have a ten-year facility plan approved by the commissioner that includes an inventory of projects and costs that would be eligible for: (1) health and safety revenue, without restriction as to project size; (2) disabled access levy; and (3) deferred capital expenditures and maintenance projects necessary to prevent further erosion of facilities. (b) A district qualifying under subdivision 1, paragraph (b), must have a five-year plan that includes an inventory of projects and costs for health and safety projects with an estimated cost of $500,000 or more per site that would qualify for health and safety revenue except for the project size limitation in section 123B.57, subdivision 1, paragraph (b). (c) The school district must: (1) annually update the plans; (2) biennially submit a facility maintenance plan; and (3) indicate whether the district will issue bonds to finance the plan or levy for the costs. Minn. Stat. §123B.59 also specifies that a school district may levy for alternative facilities bonding and levy revenue to finance the portion of the facilities plans approved by its Board of Education and the Commissioner. A district must notify to the Commissioner that the plan will be funded through levy. A district also must publish a notice of the intended projects and their total estimated cost before it levies for alternative facilities bonding and levy revenue. DESCRIPTION OF INTENDED PROJECTS The Bloomington Public School District #271 intends a series of deferred maintenance, accessibility improvement, and fire, safety, and health repairs projects. These projects will help provide a well-maintained, accessible and safe learning environment for district students, staff and community members who use school facilities. The projects are contained in the district’s 10-year facility plan. Engineers, architects and other specialists were consulted in the preparation of this 10-year facility plan. Consultants, site teams and building & grounds leadership prioritized the projects in this 10-year plan. Phase 1 FROM PAGE 1 The two companies are collaborating on the project because United Companies is primarily a retail and office development company and will be responsible for those components of the project, while Stuart Development will be responsible for the rental housing units within phase 1. Phase 1 will include a large apartment complex parallel to Penn Avenue, comprising 152 units in the eight-story building. Parallel to the new West 80-1/2 Street – the visible street bisecting the empty lots – will be 60 additional apartments in a fourlevel development. The street level space will provide 14,000 square feet of retail space for lease to several tenants, with apartments stacked three levels above. The third building in the project is a four-level townhome project, parallel to the new 81st Street that will extend east from Penn Avenue. The 22 units in the building will be two levels each, stacked in two rows of 11, making it a four-story building. Since its inception, the project has been re-imagined many times. Ulstad estimates there have been about 100 different site plans. Previously the plan was to sell condominiums as part of the development, but that was abandoned three years ago when the market for condominiums dried up, Ulstad explained.
Increasing the office space of the site and incorporating a hotel were two alternatives considered during the revisions. “We think we have struck a balance between what can be delivered and what can be financed,” Ulstad said. United Properties initiated the project, but its maturation has been in conjunction with the Bloomington Housing and Redevelopment Authority. Upon purchasing the Dodge dealership, the company sold the property to the HRA, which in turn has a development agreement with the company. The HRA’s involvement helps facilitate the public assistance typically necessary for redevelopment, according to Regina Harris, administrator of the HRA. Redevelopment comes at a higher cost than starting with an undeveloped site, but that higher cost doesn’t translate to higher lease rates for the finished project. The HRA provides assistance necessary to make projects a market-rate deal, she explained. The phase 1 projects were initially intended to be phase 2. The lack of anchor tenants for the office and retail space on the northern half of the property – a result of the downturn in the economy that delayed the project in the first place – brought about the change in development plans, Ulstad said. The office and retail development plans of the project have yet to be finalized. A preliminary plan has been approved by the city council, but the final
plan remains in limbo. Ideally the start of phase 2 will immediately follow the conclusion of phase 1, and as the housing units go up, that may foster the interest needed to finalize agreements for phase 2 occupancy, Ulstad explained. Ulstad estimates the project is about three years behind its initial timetable, but given the downturn in office and retail development during the past few years, “this project is no different than any other,” he said. When development begins to rebound, the best sites are typically the first to develop, and Ulstad thinks Penn & American fits that description. Brandon Champeau, a development manager for United Properties, agrees. When the market declines, developers walk away from many properties they were eyeing, he explained. United Properties may have had to delay its plans for Penn & American, but abandoning the site was not a consideration, he noted. Upon completion, Penn & American will give Bloomington its first vertically integrated mixed-use development, Harris noted. Ulstad likened the project to the 50th and France district of Edina and Excelsior & Grand in St. Louis Park. The 50th and France district is an organic product that has evolved over many years, he said. Penn & American will be developed similar to Excelsior & Grand, with the goal of growing into a district such as 50th & France, he explained.
Presenting the maps a week earlier allows more time for residents to review the proposals and submit comments online prior to two board hearings on the subject, according to Rick Kaufman, the district’s executive director of community relations. With the map recommendations already in place, the board will turn its attention to related matters at next week’s meeting, revisions to the district’s transfer and open enrollment policies. The policy revisions are intended to help meet the goal of the boundary adjustment project, to keep one school from becoming overcrowded while another school is under capacity. The second reading of the transfer and open enrollment policies is scheduled at a Dec. 20 board meeting. If approved, both policies go into effect immediately, Kaufman noted. The board will also review a revised transfer transition plan that addresses how families with students presently enrolled outside of their home elementary school will be governed under the revised boundaries and policies. The proposal has been to grandfather fifthgrade students next fall and require younger students to apply for an intradistrict transfer, subject to the district’s new guidelines. Parents of students enrolled outside their home attendance area have lobbied to maintain their ability to enroll students elsewhere without being subjected to the new guidelines. “The district embraces parental choice,” Kaufman said. In order to meet the district’s goals, however, “not everyone is going to be happy,” he noted. “We are working hard to find a way to limit the impact.” Overall the project is intended to adjust the distribution of elementary school students within the district’s 10 elementary buildings in an effort to mitigate the socio-economic divide found within them. The board’s decision is scheduled for its Jan. 10 meeting. Maps are available online at bloomingtonschools.info.

Alipate back to direct Jaguar offense Jefferson senior guard nears 1,000 career points BY GREG KLEVEN • SUN NEWSPAPERS Two veteran guards are expected to carry a heavy load for Bloomington Jefferson’s boys basketball team this season. Jaguar fans have watched Marcus Alipate handle point guard duties with flair the past three seasons. The 6-foot1 senior averaged 17 points per game last season and earned all-conference honors. “Marcus is about 25 points away from reaching 1,000 during his high school career,” said Jefferson coach Jeff Evens, starting his 15th season. “He directs our offense well from the point guard position and has the ability to drive inside or hit from the outside. “Marcus is a hard-working athlete.” Alipate will share the Jefferson captaincy with 6-1 senior Matt Hovila. “Matt is a shooting guard and plays solid defense,” said Evens. “He started for us last season.” Jefferson will depend on three other seniors for varsity contributions. Senior Kevin Handt is a 6-5 forward while Aaron Larkin stands 6-4 and also plays forward. Adam Witherspoon is a 6-2 guard/forward. Evens expects 6-4 junior forward Ryan Gilmer to earn valuable varsity minutes. “We have about five or six other varsity prospects we are looking at,” said Evens. “We will use our early games to find out who can help us as the season progresses.” Jefferson was 7-18 overall last season. The Jaguars defeated Edina 63-52 in the Class 4A, Section 2 quarterfinals before losing 64-50 to Eden Prairie in the semifinals. There will be a new look on and off the court for Kennedy’s boys basketball team this season. On the sidelines, Nick Pocius takes over the head coaching duties as a replacement for last year’s coach Jared Nuness, who left to accept an assistant coaching position at Baylor University. There will also be many new faces on the Eagle varsity roster. Kennedy’s four captains are 6-foot senior guard Jake Hodgson, 6-3 senior forward Dillon Lee, 6-0 junior guard Rico Gunn and 6-7 junior forward Jake Kohner. The Eagles will also count on 6-6 senior forward K-Cee Winfield, 5-8 senior guard Raphael Cabannis and 5-10 senior center Stephen Davis. Kennedy coach Pocius expects varsity help from 6-7 junior center Cullen Russo and 6-0 senior guard Deshun Patterson. “We are looking closely at a couple of other varsity prospects,” said Pocius. “We have a lot of good athletes and hard workers on our team. “The guys have been doing a lot of conditioning drills and should be in good physical shape.” Pocious wants to utilize his squad’s athleticism. “We will attack the lane hard and try to get to the free throw line as often as possible,” said the Eagle coach. The Eagles’ girls basketball team pulled out a 51-49 triumph over defending state Class 3A champion Benilde-St. Margaret’s. Kenisha Bell scored the winning field goal in the final seconds. Bell finished with a team-high 18 points. Tonoia Wade collected 15 points and Jade Martin finished with 10 points. Sheridan Reiners added six points to the Eagle victory cause. Kennedy (1-2) opened its season with a 77-65 loss to host Chanhassen Nov. 30. Three Kennedy players scored in double figures – Martin (19), Reiners (16) and Wade (12). Bell finished with eight points. Kennedy lost 61-56 to No. 2-ranked Eden Prairie Dec. 3 at home. Martin and Bell finished with 17 and 14 points respectively. Andrew Lamere scored a shorthanded goal in the second period for the Eagles in the second period. Tom Hinrichs picked up an assist. St. Louis Park tied the score at 1-1 on a goal midway in the third period. Ryan Kutzler scored the winning goal at 2:50 of overtime on a goal assisted by Matt Benolkin. Goalie Tony Basil preserved the win by making 15 saves. Rochester John Marshall blanked Kennedy 3-0 Dec. 2 in another nonconference game. Robbinsdale Cooper defeated Kennedy 9-2 Nov. 27. Bloomington’s cooperative high school wrestling team has two state tournament returnees as building blocks. Bloomington, composed of Kennedy and Jefferson high school wrestlers, has a strong upper-weight wrestler in Kennedy senior Josh Vaughan at 189. Vaughan is seeking a return ticket to state, as is Kennedy junior Ulises Diaz. Bloomington will also count on help from Kennedy senior Jared Rau at 171. He placed third in last season’s section tourney. Bloomington head coach Chuck Vavrosky has a huge rebuilding task ahead. There were 19 seniors who graduated from last year’s team, including state 145-pound champion Dylan Ness and Andrew Hermann, fifth at heavyweight. “We graduated a lot of good wrestlers, but I have been impressed by many of our new wrestlers,” said Vavrosky. “We have 16 freshmen out for the team and many are good varsity prospects. “Our young guys wrestled very aggressively in early season competition.” Bloomington opened its dual-meet season with a 37-31 victory over Lakeville South in South Suburban Conference action Dec. 2 at Kennedy High. Kennedy winners were Diaz (103), ninth-grader Johnny Maiers (112), senior Cullen Eidem (130), junior Hugo Felix (135), senior Caleb Miller (140), junior Ben Cousins (160), Vaughan (189) and senior Josh Harris (heavyweight). Bloomington was 1-3 in the Monticello team tourney Dec. 4. The locals defeated New Ulm but lost to St. Francis, Monticello and North Branch. Vaughan was unbeaten at 189 pounds in four tournament matches, improving his season record to 5-0. Bloomington’s other top season records belong to Cousins (4-1), Diaz (41), Rau (3-2), Felix (3-2) and sophomore Nick Lembeck (2-1). Bloomington’s junior varsity team placed first at Monticello. Bloomington will compete in a quadrangular meet at 4:30 p.m. Friday, Dec. 10, at Northfield. Other tournament entrants are Faribault and Eastview.
