Department is urging residents to lock their cars and pay attention in their neighborhoods. Arrests have been made since the city released statement Wednesday, Oct. 5, advising residents to be aware of any suspicious activity and prevent the “crimes of opportunity,” where valuable items are stolen from unsecured cars
and open garages. Last week, Eden Prairie Police received reports of 28 thefts and tamper with motor vehicle incidents — two involving residential garage burglaries and one involving a stolen vehicle. These crimes occurred in residential neighborhoods, during all hours of the day and on all days of the week,
according to the police department. On Monday, Sgt. Dennis Paulson said the incidents are likely related to incidents in Eagan, Lakeville and other cities. The department is trying to figure out how people arrested over the weekend are linked to incidents in other BREAK-INS: TO PAGE 14

BY PAUL GROESSEL • SUN NEWSPAPERS It’s a mix of basketball, lacrosse and hockey – with bumper cars. It’s called Whirlyball, and it’s big in Chicago, where Nick Lambrecht started playing in law school. He thinks it would be big in the Twin Cities – specifically in Eden Prairie, where he’d like to open a Whirlyball center by next spring. That’s if a land sale, liquor license approval and a host of other planning and project steps go smoothly. Whirlyball players drive small, bumper car-style buggies called “whirlybugs” that are powered by a floor grid, meaning no over-head grid or pole on the cars. Players use a lacrosse-style scoop to pass a hollow plastic ball among teammates and shoot at a backboard with a hole in the middle. The courts are approximately 60-feet by 80-feet, and the cars travel just a few miles per hour, Lambrecht said. There are 16 centers in the United States and Canada, Lambrecht said, and given the Twin Cities’ approximate 3.2 million population, its overall affluence CMYK
and strong corporate presence, it would be a good location for Whirlyball. A majority of Chicago Whirlyball’s business comes from corporate outings, Lambrecht told the Eden Prairie City Council recently. Lambrecht described the game to the Eden Prairie City Council during a workshop Oct. 4. Of course, he wasn’t addressing the city council to get the game’s approval. He was there to gauge the city council’s tolerance to granting a liquor license if he were to open a franchised Whirlyball location in a 39,000square-foot warehouse space at 14675 Martin Drive, across from PROP. City Attorney Rick Rosow said liquor is highly regulated in Minnesota, so the city council has broad discretion about what can it can regulate to allow liquor sales. That’s why the city’s current ordinance is written specific enough to allow liquor sales for restaurants and a bowling alley the likes of Brunswick Zone. In restaurants’ case, food sales must account for at least 50 percent of total sales to allow liquor sales. Like the 50 percent split for liquor and food sales, Brunswick also has a ratio it must meet to maintain a liquor license; 70 percent of its revenue must come from bowling and food sales while WHIRLYBALL: TO PAGE 20

Eden Prairie makes AYP with a few asterisks Waiver denied, Oak Point subject to corrective action even with grade changes BY PAUL GROESSEL • SUN NEWSPAPERS This year, the Eden Prairie School District made Adequate Yearly Progress under the federal No Child Left Behind requirements, which many states are contesting. Three schools did not make AYP, however. They were Oak Point Intermediate (now an elementary school), Central Middle School and the high school. Students’ scores on the Minnesota Comprehensive Assessments – the state’s standardized math and reading tests – determine if student subgroups, schools and districts are making AYP. The AYP results were released in late September, delayed due to the state shutdown and the state’s request for a waiver from the federal government. The waiver would have exempted Minnesota schools from AYP standards and conse-
those standards increase every year, which is why a school or certain students can make progress but still not make AYP, Aamot said. “Unfortunately the word is failure, but it shouldn’t be that word,” Aamot said. Eden Prairie keeps a close eye on all subgroups in multiple categories with several indicators, West said, so AYP results do not disappoint or excite the district, since it’s only one sign of achievement. “We can’t get too excited when we see no cells (missing AYP),” West said.

West is the school district’s executive director of educational services, and Aamot is the director of teaching and learning for secondary schools. Under No Child Left Behind, all U.S. schools are supposed to be 100 percent proficient in math and reading by 2014. The Minnesota Department of Education leaders, like many other states, do not think that’s reasonable. “Minnesota is directed by state law to release AYP data this year - however we are hopeful that positive changes in how we measure, support, and report school improvement are on the way,” said MDE Commissioner Brenda Cassellius in a statement. “Labeling schools as ‘failures’ or imposing one-size-fits-all mandates is a flawed way to address the unique challenges facing some of our schools.” Even though seven Eden Prairie subgroups did not meet AYP standards,
Oak Point oddity If one student subgroup does not test proficient in math or reading under NCLB standards, the entire school does not make AYP. It’s all or nothing. Of the three schools that did not make AYP, only one subcategory did not make it in both CMS and Oak Point. At the high school, five subgroups did not make it. Only Oak Point receives Title I funding, so it’s subject to “corrective actions,” since it has missed AYP three
years in a row. West said they are focusing additional help toward Limited English Proficiency students, the subgroup that did not meet math AYP requirements at Oak Point. Since it’s the third year the school has not made AYP, the district has to provide additional services (such as tutoring or after-school programs) in addition to offering families the option of attending a school that is meeting AYP standards. That “choice school” option began last year, but families didn’t have another choice since Oak Point was the only 56 grade school in the district. This year, it’s K-6. Even so, the state still classifies the school as an intermediate school, not an elementary school, so the Title I corrective actions still apply. That means Oak Point K-fifth graders could have an option to enroll one of the other elementary schools, which have become K-5 this year as part of the K-6 transition. West and Aamot said the district is working on its supplemental services plan for Oak Point, and it will communicate that with parents once it’s finalized, also an NCLB requirement. Despite what AYP may classify a school, Aamot and West said focusing on such subgroups is something the district focuses on in all subjects – for art, science, social studies – not just math and reading, as federal requirements deem.

Temporary foster pet homes for cats, puppies, litters of kittens, rabbits and dogs are needed in Eden Prairie. The Humane Society provides all medical care, food and litter. Volunteers provide a loving, safe home for an average of three to six months. Once or twice a month the foster family comes with the pet to a public adoption day for three hours, held in Eden Prairie and Chaska. The Carver Scott Humane Society is without a permanent building, hence all abandoned pets are housed in foster care until permanent adoption occurs. The society
Coats for Kids drive short, deadline moved As of Oct. 7 the Coats for Kids drive had only collected about 4,000 coats toward its goal of 10,000. Originally scheduled to end Oct. 8, the deadline for donations has been extended to Saturday, Oct. 15. The drive is sponsored by Pilgrim Cleaners, Sun Newspapers, KARE 11, KFAN and Subway. The program accepts new and gently used winter coats for all ages to be giving to families in need. Pilgrim Cleaners owner

We’re not as socialist as some may think We’ve been following the process of setting budgets and determining preliminary proper tax levies for cities, the county and schools for the past few weeks. A few things are clear in this year’s deliberations. The changes the state made to the Homestead Credit in the waning moments of its special session earlier this year has caused a lot of gray hair. Honestly, the upshot of that change is too complicated to explain to you in the space allocated for this column. What’s worse is that every municipality and school district seems to have a slightly different take on what the impact will be. Here’s my take: Your property taxes may or may not go up, but if they do, your city, school district and county will have had very little to do with it. Polite society doesn’t use tar

and feathers any longer, but were we still in those halcyon days, I would recommend that each of our legislators and governor be staked to an anthill and covered in honey. Sad fact is, I’m not sure how many of our legislators actually knew the tax credit was being messed with in the first place since it all came up and was approved before you could blink an eye. Now that’s really an effective way of making legislation, isn’t it? Truthfully there isn’t a legislative incumbent planning to run next year who deserves your vote.
Here’s the other thing that struck me in reviewing dozens of reports on preliminary levy hearings. Minnesota for all of its socialist efforts to share the wealth still manages to have a rather nasty system of “haves” and “have-nots” when it comes to public funding. Maybe that’s the way it’s supposed to be. If a community wants better schools, it certainly can vote to pony up dollars to make that happen. Right? But then let’s stop the charade that every child is getting the same education if we compare the impact of finances, for instance, in Wayzata School District and Brooklyn Center School District. I don’t believe finances determine outcomes in education 100 percent, but they sure make a big contribution. Knowing what to do with your money also helps.
The funding formula for public K-12 schools in Minnesota is tremendously intricate and designed to deal with every known inequity. Yet it doesn’t take much observation to see that it isn’t working. If you’ve been following national politics, you might see a parallel here between the argument over class warfare in taxing the rich and providing a world-class education for every student in Minnesota. The system seems to be slightly more fair for municipalities, but if you dig deep enough, you can find inequities there, as well. But in that case it only means you drive on roads with more potholes. You aren’t jeopardizing the future of our state’s ability to provide a highquality workforce. Final budgets and tax levies must be approved in December. Stay tuned.

LETTERS TO THE EDITOR Parker, Estall, Bratrud for EP School Board To the editor: There is more that unites than separates our values in Eden Prairie, but it is the arrogance of a couple school board members that has been so destructive. The process leading up to the musical chairs exercise of nearly 1,000 kids changing schools was never supported by the community. Have we moved on? In truth, we’re trying to make the experience of a new school, a positive one for our child though this was not ideal. Most of the parents who opposed this change believe: — Diversity is a good thing –
our children learn from each other, — Disrupting 1000 kids’ friendships and their current school was not a good thing. These are not mutually exclusive values. My neighborhood is carved up with kids who left for Minnetonka, kids who remained in Prairie View, and a couple that now go to Forest Hills. It is sad. Nearly all of my daughter’s closest friends remain in the Prairie View boundary except her. There were many more gradual options proposed with less disruption. These were ignored. The lack of clear community support for the Spanish immersion school to take over Oak Point was widely discussed but ignored. We have committed to make this year as positive as possible. We fully support the election

To the editor: I would like to thank Minnetonka Community Education & Services for hosting the Camp Invention program this summer. CampInvention is tackling our country’s innovation deficit by encouraging exploration and curiosity in our youth and developing such 21st century learning skills such as creativity, teamwork, and critical thinking. One hundred thirty-two local elementary students joined over 76,000 students nationwide in exciting hands-on STEM activities at Minnetonka Middle School East and Minnetonka Middle School West. They were challenged to solve a variety of problems using science, technology, engineering, and math concepts that they learned throughout the week. I especially want to thank camp director Joan Wright, her talented local teaching staff and counselors, and the creative students in Minnetonka for their exceptional work. Susan Z. Angel’s Attic Sale begins Saturday in Bloomington Fundraising event benefits families affected by cancer BY MIKE HANKS – SUN NEWSPAPERS On the outside it’s a nondescript warehouse that thousands of people drive by every day. On the inside it’s a treasure hunter’s dream. Bargain hunters are likely to find something they like, too. Part rummage sale, part estate sale, the second annual Angel’s Attic Sale begins Saturday in Bloomington. The name may not ring a bell, but bargain hunters have seen it many times before. A team of about 100 volunteers is organizing the sale, many of whom have a lot of experience
Valley is another longtime volunteer whose cousin’s wife was being treated for breast cancer at Minnesota Oncology a few years ago. While there she picked up a brochure from the Angel Foundation, a nonprofit organization that provides nonmedical emergency financial assistance to families dealing with cancer. Kauffman’s cousin and wife soon became donors to the Twin Cities organization and approached Kauffman about continuing her organizational efforts, this time to benefit the foundation, Kauffman explained. So instead of retiring from the secondhand goods business, the volunteer corps continued their efforts on a smaller scale last year, holding a sale in St. Louis Park that raised about
in bringing secondhand merchandise to the masses, according to event organizer Kay Melemed of Minnetonka. “It’s the same volunteers that put on the American Cancer Society garage sale,” she said. The garage sale was an enormous annual fundraising event that was retired two years ago. Many of the same volunteers organized the annual sale for decades, including Melemed, who has volunteered for 35 years. Each year volunteers gathered donations and sorted them in a large, empty retail space for a multi-day sale that drew thousands of people to whatever suburb the sale called home that year. PROP Shop wants your help with ensuring a good night’s sleep this winter BY PAUL GROESSEL • SUN NEWSPAPERS Winter can be colder for some than others, especially for those who may not have a bed to sleep on. The PROP Shop in Eden Prairie is asking for bed donations to help those in need sleep better this coming winter. “We’ve got about 45 current requests for beds right now,” said PROP Shop Operations Manager Vicki Bomben. “… This is the time of year when [requests] start increasing. We’re expecting a good number of requests in the next month or two.” The PROP Shop will take frames, box springs or mattresses (twin, double or queen-sized) that are in good condition. Good condition means if you’d let a family member sleep on it, it’s good enough to donate, Bomben said. Since there were 100 bed requests last November and December, the shop is putting the word out early to head-off an
expected high demand this winter. Demand for beds is coming from all kinds of backgrounds, Bomben said, whether it’s the recently unemployed, those facing medical emergency or eviction. “The stories really vary, but it boils down to somebody who needs just a little bit of help to keep going,” Bomben said. Other winter necessities people seek from the PROP Shop include coats, boots, hats and gloves – especially for kids. “Winter puts a lot of demand on families and families with kids,” Bomben said. Because space and volunteer time at PROP Shop is limited, Bomben asks those who would like to donate a bed or frame call ahead before they drop off a donation. Garbage to gas Firm has big plans to turn trash into fuel at Plymouth facility BY PAUL WAHL – SUN NEWSPAPERS Burning garbage to power to your vehicle once was the purview only of science fiction. Shortly the technology to turn household waste into fuel will be up and running in a large warehouse in Plymouth. Rational Energies Inc., which maintains an office in Eden Prairie, struck a deal with Hennepin County recently that will give the firm access to the waste stream at the Brooklyn Park Transfer Station. Rational Energies will have first dibs on 300 tons of waste a day, according to Dave McNary, Hennepin County's assistant director of environmental services in charge of energy and solid waste. He added that the plan is a boost to the county’s bottom line and efforts to reach a 45-percent recycling rate by 2015. McNary said Rational will lease a 15,000 square-foot space at the Brooklyn Park facility to establish a sort line, for which it will pay the county $60,000 annually.
For the materials it pulls out, the county will receive another $900,000 annually. McNary also estimates that the savings in hauling fees and other disposal costs will save the county $1.1 million a year. A portion of the waste captured by Rational will be hauled to a 26,260 squarefoot processing facility on 27th Avenue between Niagara and Fernbrook lanes north. There it will be turned into high quality fuel. “In layman’s terms, they plan to take plastics recycled from the Brooklyn Park facility and using a heating process turn it into a petroleum product that will be sold to refineries,” said Steve Juetten, Community Development Director in Plymouth. Of all the theft from motor vehicle incidents reported to Eden Prairie Police in 2011, 45 percent involved a vehicle that was unlocked, according to a statement from the city. Again, in what has become a re-occurring message, the Eden Prairie Police want to remind people not to leave anything of value in cars, to close garage doors and remind neighbors to keep their garage door closed (since their open door could attract robbers to the neighborhood), Paulson said. “I think (for) the general public, until you become a victim of it, you just don’t believe it’s going to happen to you,” Paulson said. Since Eden Prairie is arguably an affluent and overall safe community, vehicles can be an easy target if items are left inside. Electronics can be stolen and sold quickly, making it more advantageous for
robbers, Paulson said. And, even if it doesn’t seem like there is anything valuable in the vehicle, some robbers can use personal information from insurance cards or other documents for fraud, Paulson said. “It’s sad that we have to be that protective,” Paulson said. The most common items stolen in theft from motor vehicle incidents this year include GPS systems, iPods, laptop computers, wallets, purses and designer sunglasses, according to the city. And, even if arrests are made for a particular string of vehicle and garage break-ins, that doesn’t mean everything is clear. “There’s always someone else to take the place of the person we arrested … because again, it’s a crime of opportunity,” Paulson said. Even over the weekend, after a couple suspects were in custody for the vehicle breakins last week, three or four more incidents were reported, Paulson said. Break-ins don’t always

However, Driscoll told the Plymouth Planning Commission in a hearing Aug. 17 that the location would be a flagship facility since the company would like to roll out similar operations across the country and around the world. Driscoll told commissioners the project would create “green” jobs that would not be exported overseas. He pledged the operation would be one of the least noticeable manufacturers in Plymouth. Juetten said all city approvals have been given. He was not sure whether the company had pulled building permits. A visit to the site last week revealed little in the way of construction activity. The structure was formerly occupied by Ryerson, a company that distributes and processes metals. That company left the site in 2004. The lease rate was pegged at between $4.50 and $5.50 under a triple-net agree-
ment. A triple net lease in which the tenant or lessee agrees to pay all real estate taxes, building insurance and maintenance on the property in addition to any normal fees that are expected under the agreement. Pine Creek Associates of Edina had listed the property for lease. Rational, started in 2007, plans to recycle approximately 8,000 tons of metal and plastic and convert 14,000 tons of plastic to fuel from the 110,000 tons of waste delivered to the Brooklyn Park facility in 2012. It is one of two year-round recycling operations in the county. The company will hire 12 to 15 employees from area community-based social service organizations to operate its sort line. Rational also recently inked a deal with Manatee County in Florida to construct a facility similar to that planned for Plymouth. The company received local and state incentives for that project, according to published reports. Twentyone workers will be hired there. The county is located south of St. Petersburg in the Bradenton area.

Memorial FROM PAGE 1 George Esbensen. “It was a good sort of large space, and very public place to have this sculpture,” Esbensen said. After the airport got pressed to have more revenue-generating space and security measures tightened, the sculpture was moved, he said. Now, the foundation would like to “claim a more sacred ground” for a memorial, Esbensen said, which would be more accessible to the public, on a southern portion of the State Capitol property in St. Paul. The memorial would provide enough space for large gatherings and up-close viewings of the statue. A new architectural enclosure would house the statue, in the middle of a walking area. That area would be adjacent to a wall listing all the fire departments in Minnesota. The enclosure will be made of weathering steel columns that rust to a certain point, and then the rust will protect the
metal, said Glenn Waguespack, the senior architect who led the memorial’s design for architectural firm Leo A. Daly. Each column represents a year when a firefighter died while on duty, Waguespack said, and the names of those who have died will be engraved on the columns. It will be a living memorial. If a name unfortunately needs to be added to the memorial, it could be. Last spring, Esbensen asked Leo A. Daly to help the Foundation with a design, and the firm agreed to do the work for free. Leo A. Daly is a national architectural firm that has done much public and private sector work. It also designed the World War II memorial in Washington, D.C. “Most of these [firefighters] are doing it volunteer or technically paid, [on a] small dollar value. … What better group could we do some volunteer work for, as architects that live and work the public sector?” said Ted Redmond, vice president and managing principal at Leo A. Daly. The design may be planned; now the money needs to be collected. Since July, the foundation has collected $170,000, mostly from statewide firefighters, Esbensen said. Now, he’s hoping other Minnesotans

will help chip in and recognize the nearly 193 firefighters who have died and the 20,000 firefighters who serve in Minnesota now. “I think we honor all of those people that fight for us and protect for us,” Esbensen said, whether it’s military, police officers, firefighters or other service providers. When it comes to firefighters, they run toward a situation everyone else is supposed to run away from, “and stop that chaos from further destruction, and I think we need to commemorate those people” for giving their lives, Esbensen said. Redmond said the foundation is a group that doesn’t draw much attention to itself, so donating a few dollars to help its cause would say a lot. “There isn’t an awful lot of official recognition that happens. … It’s a good cause, a fantastic group,” Redmond said. No. 1-ranked Eden Prairie earned a 16-0 Lake Conference victory over ninthranked Minnetonka before an announced crowd of 7,870 at Aerie Stadium. Eden Prairie improved to 6-0 while Minnetonka is 4-2. The Eagles continued their recent dominance over the Skippers. Since 2004, Eden Prairie has beaten Minnetonka seven consecutive times. Eden Prairie’s defense stopped Minnetonka at the Eagles’ 1-yard line in the second quarter. Eden Prairie fumbled at the Tonka 1 just before halftime, preventing the Eagles from taking a 14-0 lead into the third quarter. Eden Prairie was stopped at the Minnetonka 21 at the conclusion of a 10minute drive in the third quarter. “Our defense did a great job of not letting Minnetonka run the ball,” said Eden Prairie coach Mike Grant. “Minnetonka is a big, physical team that is one of the best five teams in the state. “Tyson Reinke, a junior defensive tackle, came up with several key plays for us in the game. And all three of our linebackers, Grant Gordon, Jack Cotrell and Drake Michaelson, played well.” Eden Prairie opened the scoring in the first quarter on a 10-yard touchdown run by senior Andrew Larson. Eden Prairie’s boys and girls cross country teams had identical fourth-place finishes in the Victoria Lions Invitational meet Oct. 4 at Chaska Par-30 Golf Course. The Eagles’ boys team scored 119 points to place fourth of 24 teams. Stillwater was champion (82) and Burnsville placed second (110). Wayzata was third (114). Sophomore Cal Lawton led the Eagle running pack with a 17th-place time of 16 minutes, 22.8 seconds on the 5K course. Junior Henry Zurn was 22nd (16:29.2) and senior Andrew Hansen finished 24th (16:31.4). Sophomore Jacob Young placed 27th (16:41.3). Other Eden Prairie competitors were senior Ricardo Reyes (29th, 16:43.6), sophomore Jack Odzer (34th, 16:49.8) and senior Evan Olawsky (49th, 17:10.7). Eden Prairie’s girls squad also had a strong showing in the Victoria Lions Invitational with a fourthplace total of 146 points. Lakeville South won the girls team title (110) and Shakopee came in second (113). Wayzata finished third (124). Eagle sophomore Hannah Jeter was 19th overall in 15:30.2 on the 4K course. Senior Tommy Hanson returned a kickoff 83 yards for one touchdown and ran back a punt 33 yards for another Holy Family score. Senior Tanner Steen had two receptions for 17 yards. Defensively, Steen had five solo and six assisted tackles.

Lipovsky places second in state men’s horseshoe tourney Bloomington native and Apple Valley resident Dale Lipovsky placed second in the men’s division at the 2011 state horseshoe tournament Sept. 2-5 in Genola. There were 206 pitchers from across state competing in men’s, women’s, juniors and cadet classes. Lipovsky pitched 62.93 percent ringers in the tournament. He has won 28 Minnesota state titles and three
world championships. Gerald Stangland of Bowstring won his third state men’s championship with a 67.73 ringer percentage. He came into the tournament as the defending champion. Tiffany Syring of Forest Lake claimed her first state women’s title with a 59.55 percentage. Janet Larson of Evansville was second (55.16). Cliff Pressler of Minneapolis was
the Elders Division champion (57.28). Bob Knutson of Columbia Heights placed second (54.71). Joey Mueller of Ham Lake was state junior champion (69.44) and Joshua Olson of Bertha finished second (55.56). Derrick Keller open house benefit dinner is planned Former St. Louis Park High School baseball standout Derrick Keller is battling leukemia and friends are conducting an open house benefit in his honor. Keller graduated from Park High in 2011 after earning all-conference and AllState baseball honors. He was planning to attend Southwest State University on a baseball scholarship this fall. Keller was diagnosed with leukemia Aug. 1 and is currently hospitalized
awaiting a bone marrow transplant. The open house benefit dinner for Keller is 5-7:30 p.m. Sunday, Nov. 27, at Westwood Lutheran Church in St. Louis Park. Proceeds from the benefit will be donated to Keller for ongoing medical costs. Motto for the benefit dinner is “Help DK KO Luke.” Tickets are available at the door or online at www.Kellerwins.com. Meier claims Dwan Ladies Golf League club championship Bunny Meier claimed the Dwan Ladies Golf League’s 18-hole club championship following a three-week tournament that ended Aug. 25. Meier finished with a gross score of 163, the total of her best two scores in the three-round tourney. Bonnie Foley earned second-place low gross with a 166 total. Judith Dahlen won the first flight low net title with a score of 134. In the second flight, Deb Forkins was the low net winner with a 134. Sheryl Clemens placed second (138). Betty Porter took first place in the third flight after winning a scorecard playoff with Irene Bjerke. Both players had scores of 131.
