It appears there will be nine candidates on the ballot for Eden Prairie School Board this November. The filing period ended 5 p.m., Tuesday, Aug. 16. After the 5 p.m. deadline, nine people had filed their candidacy papers. They include Karla Bratrud, Dave Espe, Tim Fox, Derek Gunderson and Bill Lapadat. Eden Prairie police write 382 speeding tickets in July BY PAUL GROESSEL • SUN NEWSPAPERS In July, as part of a statewide Safe and Sober traffic enforcement program, the Eden Prairie Police Department issued 382 speeding tickets, along with a few other citations. Increased enforcement came in several waves throughout July, according to Sgt. Pete Vosbeek. The extra enforcement took place over four days at specific areas in the city. Each wave consisted of regular traffic enforcement and a couple extra officers, funded from a federal grant and distributed through the state. Less than a third of the 382 citations came from extra officer time, funded from grant money. There were 106 citations issued during the extra enforcement, and the rest were from the regular traffic enforcement budget, Vosbeek said. The enforcements took place July 5, July 11, July 19 and July 27, Vosbeek said. The fine amount for most speeding tickets is $67, but after surcharges, the total reaches $145 for most speeding offenses in Hennepin County. During the increased Eden Prairie enforcement, there were other citations handed out. Several were for suspended, revoked or canceled driver’s licenses and a few for uninsured motorists. There were two daytime DWI arrests, as well. Daytime DWIs are not typical, Vosbeek said, but it’s an example of how basic traffic enforcement can be a pre-
ventative measure. “We got a couple of drunks off the road that may not have been detected otherwise,” Vosbeek said. That’s why the point of the increased enforcement is not to raise revenue or generate numbers, Vosbeek said. It’s about creating awareness. “When we do these, it truly is in the interest of public safety,” Vosbeek said. The idea is to make sure people are driving safely and paying attention. Distracted driving has become a big issue lately. Drivers have a lot more gadgets, devices and car features that can distract them. In a sense, drivers can lose just a basic sense of where they are going and their surroundings, Vosbeek said. “The scarier parts of the speed is that they’re mind is not on the game … to drive a car well, you have to focus on it,” Vosbeek said. “If you’re driving a car — drive the car.” With school soon back in session, the police department will increase traffic enforcement in school zones, Vosbeek said. “We’re just going to be more aggressive, be more proactive, be where the problems historically are,” Vosbeek said. A commonly reported spot is Valley View Road and Eden Prairie Road, near Eden Prairie High School, Vosbeek said. But, the police will be keeping patrols around many schools, Vosbeek said, and they’ll be looking for school bus stop arm violations in particular. Info: edenprairie.org.

Do you have what it takes to volunteer? This is the time of the year when many of the communities we serve begin looking for volunteers for boards and commissions. Generally, the candidates are screened and vetted between now and the end of the year, and then appointments are made. I am amazed that in today’s world of insane schedules and everyone running short of time that folks still volunteer. On top of that, commissioners take a lot of heat on many occasions, a headache most people would rather avoid. But there remains that stalwart group who see public service as their duty to their community. May their tribe increase. Among the most frustrating aspects of serving on a commission or similar panel is the relationship with the appointing entity – usually the city council. I’ve been covering govern-

ment for 30-plus years and became aware of this yin and yang experience from the outset. City councils generally appoint commissioners. The idea is that topics that need a broad hearing start at the commission level. Inevitably, the commissions forward a recommendation to the council and that’s often where the problems start. While everyone recognizes it is just that – a recommendation – commissioners work long hard hours to come to their conclusions and rightly resent when their work is dismissed out of hand. They take owner-
ship of the issue. I have seen entire commissions resign en masse over what it perceived as a slight by a council that had obviously made up its mind long before hearings were held. Now I’ve never served on one of these commissions because as a journalist it would be inappropriate. I’ve sat there through their deliberations, often the only member of the public. My sympathies generally run in favor of the commissioners in these tet a tet situations. We’ve had several instances around our coverage area over the past few years where clearly there was little or no communication between the council and the commission in question. I covered one instance in which the council didn’t even read the recommendation of its planning commission prior to voting on a particularly sticky topic. A few thoughts on correcting errors Depending on where you are reading this, you may have seen a small box on the lower righthand corner of this page in the last few weeks. You might not have noticed it, but I can assure you it was there, emblazoned with black letters spelling an ominous word to many journalists: "Correction." Brrreeeggh. I just got the shivers. Nah, I'm kidding. We work in an industry that is ideally aimed at facts. And we like to get them right. No matter what. There is a school of thought in the media community that says you shouldn't publish corrections unless absolutely necessary to avoid hurting the publication’s credibility. The idea is that by pointing out the mistakes, readers will see how often you're getting things

wrong and stop reading your paper. So why do we publish corrections? Why do we go out of our way to point out our inaccuracies? Because we don’t believe printing corrections diminishes our credibility, but rather enhances it. I am well aware that media hasn't been seen in the best light in the last few decades. There still is that nasty persisting stereotype of the unethical reporter. In some newsrooms, the theme is "get the paper out," not necessarily "get the paper out right."
Here at the Sun-Current, we aim higher. Let me be clear, we endeavor to get the facts right the first time. Frankly, I’m rather proud of the staff here; we don't often get things wrong. But when we do err, it's simply irresponsible for us not to issue a correction. After all, the goal for any newspaper is to provide you, the reader, with factual information. When that information is wrong — something as small as an improperly labeled photo caption or as major as a misspelling of a name — it is our duty to provide you with the correct information as quickly as possible. We want to earn and maintain your trust. By pointing out where we've had issues, we hope you'll see we value precision above all else.

They short-circuited the commission process because they knew the idea was not going to fly in a broader public hearing setting. Against that backdrop we ask people to step up and volunteer to commit hundreds of hours of their lives to making their communities better. The pay is bad. The hours are long. Still there is that small group of heroes out there who will take up the challenge. Are you one of them? Contact city hall and find out what positions are open and what you need to do to become part of the action. And if you haven’t attended a commission meeting, take the time to drop in and observe. If you decide to go forward and are appointed, let us be the first to congratulate you.
CORRECTION In the Aug. 11 edition of the Eden Prairie SunCurrent, the article entitled “Eden Prairie Public Schools’ referendum planning in early stages,” had incorrect tax levy information. The levy increase on the average-priced Eden Prairie home would be approximately $179 per year if the operating funds referendum passes. Also, if the school board decides to go out for technology referendum funds, it would have to be a separate ballot question; it could not be tied in with an operatingfund ballot question. Eden Prairie residents evacuated from apartment after deck fire BY PAUL GROESSEL • SUN NEWSPAPERS The Eden Prairie Fire Department acted quickly to put out a second-floor deck fire at an apartment complex. Firefighters responded to the call around 6:20 a.m. Monday, at Edenvale Apartments, 13700 Valley View Road. Upon arrival, firefighters pulled the fire alarm to get residents out. Even though it turned out to be a relatively small fire, the

crew did not initially know how serious it was, Fire Chief George Esbensen said. The fire started on the deck and appeared to have been accidental, said Esbensen. No apartment residents or firefighters were injured, Esbensen said. “Essentially it burned the siding and deck material on the exterior of the building, but it did get on the wall a little bit,” Esbensen said. • Vehicle crash – 17

Details of some incidents: • A representative of LifeTouch, 11000 Viking Drive, reported to police Aug. 4 that someone had been stealing from them. The reporting person said another employee was suspected of stealing $2,781 from the company through fraudulent refunds. • An employee of Fireside Hearth & Home, 12780 Plaza Drive, reported credit cards were stolen from his wallet while he was working 7-7:30 p.m., Thursday, Aug. 11. The employee said the suspected thieves came into the store and asked unusual questions to distract him. His briefcase and wallet were located
Firefighters responded in six minutes, which is four or five minutes faster than a normal response time, Esbensen said. He credited the speed to an apartment resident who immediately called 911 and to his daytime staff, which was arriving to the station when the call came in, leaving little time to wait for enough crewmembers to arrive at the station before responding. The cause of the fire is under investigation, Esbensen said.
This fire was small, and there haven’t been any large apartment fires since the city began an apartment inspection program five years ago, Esbensen said. BBQs and smoking receptacles, the two biggest deck-fire culprits, were banned from apartment decks as part of that program. Before inspections began, one large apartment fire per year was the norm, he said.

A man and women were not home at the time. When they returned, they found
their front door had been forced open, and jewelry was missing inside the home. There were 20 pieces of jewelry missing, most of which ranged $100$550. Two watches, valued $2,000 and $5,500, were also stolen. About that closed, emergency school board meeting… BY PAUL GROESSEL • SUN NEWSPAPERS It may not be a huge legal case; it is a private matter – one unknown, former Eden Prairie School District employee or former employee who challenged his or her denial of benefits – and there are plenty of issues the Eden Prairie School Board has been facing lately. Even so, the circumstances surrounding the situation are perplexing. To start with, the Eden Prairie School Board had an emergency, closed meeting that began around noon Friday, July 29, and ended 3:04 p.m. Notice of the meeting was given around 8:30 a.m. the same day. Approximately three hours after the meeting started, it was opened to the public. School Board Chair Carol Bomben read a statement to summarize the meeting. A school district attorney working on the case, Susan Torgerson, sat next to Bomben. According to the statement, the closed meeting was about pending unemployment litigation, involving “...an employee’s appeal of denial of benefits.” Possibly weeks before the meeting (an exact date is unknown) an unemployment law judge had made a ruling in the administrative litigation, but the school board learned about the unemployment benefits challenge only three business days prior to a deadline for filing an appeal (or “a request for reconsideration”). According to Bomben’s statement, the deadline to submit the request was Tuesday, Aug. 2, but the school board didn’t hear about the situation until Thursday, July 28 — hence an emergency meeting July 29. “To wait 72 hours for this advice would impair the public welfare and wave important rights of the district in the pending legal proceeding,” Bomben read. That’s nearly all the public information that’s available about the litigation. The name of the employee who was denied benefits has also not been made public. Torgerson has stated attorney-client privilege as the main reason for not providing information. After all, when the word “litigation” is brought up, a case like this is probably not what most people would think of. It’s not
even in public court. It’s administrative litigation, conducted through the state Department of Employment and Economic Development. In Bomben’s statement (and thus, in the newspaper’s update about the matter online), the unemployment law judge was also referred to as an administrative law judge. Torgerson, in her daily work, uses them interchangeably, even though there is a difference, she said. To clarify, in this case, an unemployment law judge made the ruling. Unemployment benefits challenges are handled through DEED. In unemployment challenges, cases are private, unless rulings are challenged twice, then it could reach the Court of Appeals. At that time, further case information becomes public. So, the unemployment law judge is different from an administrative law judge, who would work in the Office of Administrative Hearings, which oversees worker’s compensation claims – not unemployment benefits claims. Even though it’s a private matter, there are still a few things to consider. Why did the school board get notice of the case only three business days prior to the deadline? Because, according to DEED staff, when an unemployment law judge makes a ruling, a party has 20 days to file for reconsideration. But, to explain why the school board received such short notice would violate attorney-client privilege, Torgerson said. Another question: Why does the school board have to get involved with an unemployment benefits matter? In many unemployment benefit challenges, a school district’s administration could manage the case. Torgerson could not explain why the school board was involved in this matter – it would violate attorney-client privilege, she said. Mark Anfinson, an open meeting law and data practices lawyer who consults Sun Newspapers through the Minnesota Newspaper Association, said this can be all frustrating from an outsider’s perspective, but it’s also understandable and expected, given it’s regarding an employee MEETING: TO NEXT PAGE

Meeting FROM PREVIOUS PAGE matter. “[Attorneys are] going to err heavily on the side of what they see as caution,” since an attorney’s liability for improper disclosure of personnel data is so great, Anfinson said. And, when it comes to administrative matters and the Open Meeting Law, the law is not articulate, Anfinson said, there haven’t been any court cases, to his knowledge, that have set strong precedence. That doesn’t mean rules for closing a meeting have to be complex. When a meeting is closed to the public, two things must happen. The board – or the public body that closes a meeting – must give a legal reason for closing the matter and the subject to be discussed. To justify the closure of the emergency meeting, Bomben cited state statute 13D.05, “for privileged discussion with an attorney on pending litigation,” she said. As for the subject to be discussed in a closed meeting about pending litigation, the name of the plaintiff – the defendant and their pleadings – should be a minimum, Anfinson said.
Finally – if pending litigation is the reason to close a meeting under attorney client privilege, then logically, shouldn’t the plaintiff ’s name and the pleadings be provided as well, to satisfy the second criteria of a closed meeting? “There are always grey areas in the law, but since it’s private personnel data – just as with a student matter – we would typically not give more than that,” Torgerson said. She said it’s similar to other private administrative litigation proceedings, such as a teacher discharge, teacher arbitration or an incident involving a student. If the ruling process goes beyond DEED and into the court of appeals, then case information becomes public. If it doesn’t reach the court of Appeals, even if it’s settled, the case may not become public since it’s an unemployment matter, Torgerson said. At any rate, after Bomben read the statement after the closed meeting July 29, the school board had Torgerson work toward filing an appeal by the Aug. 2 deadline for reconsideration. An unemployment judge is expected to respond in 30 days, according to Torgerson. The public, maybe for good reason, just may not know much about it. The matter is not public data at this time, but a decision has been issued by the state administrative law judge, unemployment law judge, on an employee's appeal of denial of benefits.”

Q. What happens to the ashes after cremation? A. Your cremated remains (ashes) will be handled according to your written instructions. They may be picked up by your survivors, or will be delivered or mailed for a fee.
Q. At the time of death, what is the cost for the cremation service? A. The cost of the basic cremation service which includes removal of the body from the place of death, cremation, filing of the necessary papers and cardboard container suitable for burial is presently $1395.00 for members. This is payable at the time services are rendered. The charge to non-members, whom we also service, is more.
At the time of death, our counselors are available to assist your survivors in arranging for memorial services, obtaining certified copies of the death certificate, cemetery services, grave makers and monuments, obituaries for the newspaper and paperwork for Social Security and Veterans’ benefits.
Q. How do I join the Cremation Society of Minnesota? A. Fill out the registration form and mail it to our office with a one time registration fee of $15.00 per person. This fee defrays the cost of setting up and maintaining your records. It is not refundable nor an offset to the final service costs. Newborn clothing drive Loved Twice Twin Cities, part of a national nonprofit that clothes newborns-in-need during their first year, will have its first local clothing drive. Gently-used and new baby clothing sizes 0-12 months is being collected through Wednesday, Aug. 31, at the following locations: Club Kid, 6547 York Ave.. Bloomington’s Haddox Field is the site of the final rounds of the state Class A amateur baseball tournament this weekend. There will be a 7 p.m. game Friday, Aug. 19, at Haddox Field in Valley View Park. Competition continues at noon and 3 p.m. Saturday, Aug. 20, in the double-elimination tourney. The tournament winds down with a 1 p.m. game Sunday, Aug. 21. If necessary, a final game to decide the tournament champion would take place at 4 p.m. Defending state champion Minnetonka came into the tournament as the favorite led by shortstop Joe Shallenberger and center fielder Chris Urbain. Two other Riverview League teams were entered in the tourney. The Bloomington Bandits will rely on two key pitchers, Josh Gist and Cliff Christopherson, along with hot-hitting Sam Baltes (.371, 26 RBI) and Kyle Bassamore (.355, 26 RBI). St. Louis Park will try to duplicate its state title feat of 2008. Pitcher Gabe Eikum was the tournament’s most valuable player that year and is still the ace of the Park staff. Matt Paulsen provided many key hits for Park in the Riverview League playoffs. Canterbury Park has recovered well by drawing several impressive crowds to the Shakopee racing facility after being a victim of the state’s shutdown for three weeks in July. About 15,500 spectators attended the Extreme Race Day event Aug. 6. The track has also had a crowd of more than 9,000 in recent weeks. More metro-area racing fans are expected to flock to Canterbury Park this weekend for several big stakes races. On Sunday, Aug. 21, there will be a HBPA Sprint Stakes race covering six furlongs. Purse is $25,000. Another stakes race is the Northern Plains Stallion Futurity 350-yard quarter horse race with a purse of $10,000. Post time is 1:30 p.m. One of the track’s most popular nights has been Thursday’s Buck Night. Admission, regular programs, hot dogs, Pepsi and nachos and cheese are all priced at $1. Eden Prairie struggled in its first game of the eight-team, double-elimina-
tion event Aug. 12 at Shelby (N.C.). EP committed an uncharacteristic seven errors during a 14-3, eight-inning loss to Midland (Mich.). But Eden Prairie recovered from that defeat to post three impressive victories over Waipahu (Hawaii), Gaffney (S.C.) and Tupelo (Miss.) to boost its season record to 41-8. Berg is valuable booster of youth baseball programs Longtime SLP resident has served kids’ needs for four decades BY GREG KLEVEN • SUN NEWSPAPERS Gene Berg has played a prominent role in making sure St. Louis Park has fielded quality youth baseball teams over the past four decades. And he has fulfilled his greatest mission – giving kids a chance to play and enjoy the national pastime. The 70-year-old Berg became active in the Park baseball program when his three sons Craig, Bryan and Keith began Little League participation. Berg served as Little League coach and president before taking over the presidency of Park’s Babe Ruth program. However, Berg’s greatest legacy is his work with the American Legion baseball program. He has been involved in Legion baseball for 31 years. Berg turned over St. Louis Park’s American Legion team manager duties to Mark Jerve after 25 years. But the longtime St. Louis Park resident has difficulty saying no to
worthwhile youth sports organizations. So, Berg agreed to take over duties as South Hennepin League’s Legion baseball coordinator five years ago. And he plans to continue to help Legion baseball as long as his health allows him to do so. “I have gotten many rewards from working with the various youth baseball programs,” said Berg. “You meet a lot of wonderful people working with these programs. “The main goal is to help kids and keep the programs going.” Berg can’t say enough of the backing he has received from St. Louis Park American Legion Post 282. “We have received outstanding support from Post 282 throughout the years,” said Berg. “The post helps us put on spaghetti and pancake fundraisers to raise money to keep our program going. “Baseball was one of the original programs sponsored nationally by the American Legion. And we are fortunate to have a great post as our sponsor.” Participation numbers are down for the St. Louis Park Legion program. But Berg and other devoted volunteers are determined to keep the program solvent in the future. “We used to have 75 to 80 players
try out for the Park Legion baseball program,” said Berg. “But now kids have so many other sports as options during the summer months. “But we will continue to work hard to keep the program running.” Glory days One of Berg’s greatest Legion thrills was being connected with the 1987 St. Louis Park team that won the state title and placed fifth in the region tourney. Park finished with an impressive 56-10 record. “Those six seasons working with our head coach John Sherman were the most fun I have had working with the Legion program,” said Berg. “John was a great guy and turned out quality teams. “We qualified for district tournaments four of six years from 1986 to 1992. “Our state championship team had many outstanding players including Matt Parrington, Rob Divinski, Pat Fix, Adam Mack, Keelan Conley and Sean McGinty.” Berg credits his wife Rita for putting up with his love of baseball and his demanding volunteer work schedule. “Rita has been very supportive of my Legion duties,” said Berg. “She has traveled with me to many games and tournaments over the years.”

Braemar wins second straight state junior boys golf team title Cichoski is medalist in 36-hole tournament Braemar claimed first-place honors in the 51st MGA Junior Team Golf Championship Aug. 1-2 at Pokegema Golf Course in Grand Rapids. The Edina-based team won the team title by 13 strokes over secondplace Virginia in the 36-hole event. Braemar’s junior team totaled 443 while Virginia finished second (443). Matt Cichoski of St. Louis Park contributed greatly to Braemar’s championship by earning medalist honors with scores of 70 and 74 for a 2-over par total of 144. Cichoski will be a senior at SLP High School this fall.
Olaf Walkley of Virgina finished second individually with a 146 total, two shots behind Cichoski. Nick Weidner of Edina was another Braemar competitor. He placed sixth overall with a two-day total score of 149 and shot rounds of 73 and 76. Brett Draxler of Benilde-St. Margaret’s contributed to Braemar’s title by finishing seventh after shooting rounds of 76 and74 for a 150 total.
