BIO SECURITY RULES KIVELLS EXETER LIVESTOCK CENTRE Notice to all Visitors and Traders Please read and observe the following:

No Purchasers or Vendors, their staff or agents will be allowed to handle livestock unless wearing clothing and footwear capable of being cleansed and disinfected.

Livestock Vehicles: All livestock vehicles may be cleansed and disinfected on site or if a self cleansing licence is obtained they must be washed out and disinfected within 24 hours of completing the movement. All livestock vehicles must have their tyres, mudguards and wheel arches cleansed and disinfected on the Exit Gate. If the gate is unmanned and you require assistance then please call at the Market office.

IMPORTANT NOTICE TO PROSPECTIVE PURCHASERS SETTLEMENT AND CLEARANCE OF STOCK Please note that all lots must be settled on the day of purchase.

Completion of a buyers slip is essential for parties who have not dealt with the company before.

New customers and agents wishing to purchase on behalf of another party must contact the company’s main office 48 hours prior to a sale.

No lots can leave the market without a Sheep Movement Licence and/or Receipted Account, obtainable only from the Auctioneers Office.

General Information and Sale Notes All exhibitors MUST wear the new showing uniform, i.e blue trousers, society tie and white shirt when showing.

ALL INDIVIDUAL SHEEP FOR THE SHOW AND SALE MUST BE ON SITE BY 10.00A.M. ON TUESDAY, 7TH MAY, 2019.

ALL PENS OF SHEEP (FEMALES) FOR THE SALE ON WEDNESDAY, 8TH MAY MUST BE PENNED BY 9 A.M. ON THE WEDNESDAY MORNING. ALL VENDORS MUST BRING THEIR OWN STRAW FOR BEDDING.

NO SHAVINGS.

NOTE FOR VENDORS REGARDING EXPORT TO NORTHERN IRELAND If vendors have completed the necessary paper work for export to Northern Ireland, please ensure this is handed in to the market office.

Vendors MUST then ensure that notices, which can be collected from the Breed Secretary, stating that these sheep are eligible for export, are clearly displayed on all their pens.

NOTE TO POTENTIAL PURCHASERS REGARDING EXPORT TO NORTHERN IRELAND Pens of sheep that are available for export to Northern Ireland will be marked with a notice stating that they are eligible for export. Any pens not marked with a notice will not be eligible for export.

Insurance: Agents for the N.F.U. Mutual have an office within the Livestock Centre and will be pleased to quote purchasers for transit and other risks.

Method of Sale: In catalogue order, unless any alteration is announced by the Auctioneers.

Commissions: The Auctioneers will dutifully execute commissions to purchase for buyers unable to attend the sale personally, upon receipt of written instructions.

Upset Prices: There will be an “Upset� price of 350 guineas on all Rams, 150 guineas on individual shearling ewes and 120 guineas on individual ewe lambs.

All individual sheep sold through the sale ring will be sold in guineas and all other sheep will be sold in pounds.

Inspection: A strict inspection of the rams and individual females for Health, Teeth and Testicles will be carried out on the Tuesday morning.

This will include physical and type traits. Any sheep not passing the inspection will have movement documents supplied on the Tuesday evening returning the individual animal to the farm of origin only.

Although the sheep are inspected, the Society recommends that all prospective purchasers carry out their own inspection of potential purchases, or ask advice from a recognised breeder.

Genotyping is voluntary, but if tested, the genotype must be declared on the entry form with official certification available if required from one of the following companies: NSP, Innovis, SAC, SVS, Turner Land Biolabs, or Lincoln University Gene-Marker Laboratory. Please note that the vendor will be responsible to ascertain whether the company used meets ministry approval for export and for any genotype stated and if found to be incorrect must take full responsibility for any dispute arising. A reader will be available at May Fair for any vendor or purchaser who may wish to use it.

If semen has been taken from a ram for sale or the ram has been used prior to sale, this will be declared under the appropriate ram entry.

Catalogues: Catalogues will be sent to all members and vendors and to all those who request catalogues prior to the sale day. Please remember to bring your catalogue with you.

Settlement and Clearance of Stock: Settlement in full is due immediately at the close of Sale. No animal may leave the Sale Premises without a Movement Licence and/or Receipted Account obtainable only from the Auctioneers upon settlement.

Payment will only be accepted in Sterling.

Animal Welfare: Vendors and Purchasers should note that the CODE OF PRACTICE published by the Livestock Auctioneers’ Market Committee for England and Wales IS OPERATIVE IN THE EXETER LIVESTOCK CENTRE and that weakly, unhealthy or injured stock will be refused entry by the Auctioneers. Refreshments: There is a market restaurant on site which will be open on Tuesday for snacks and drinks until approx. 2 p.m. The market restaurant will be open for hot food, snacks and drinks on Wednesday, with breakfast being served from 7.00a.m.

BBQ Following the conclusion of showing on the Tuesday, there will be a BBQ very kindly sponsored by Kivells and the Dorset Horn & Poll Dorset Sheep Breeders Society. The Society would like to invite everyone to enjoy this hospitality.

LOCATION: Exeter Livestock Centre, EX2 8FD Directions from the M5: Leave the M5 at junction 30, services exit, follow the slip road to the roundabout, take the 3rd exit onto the dual carriageway towards Exeter (signposted “Dawlish”).

Take the 3rd slip road, which filters onto a dual carriageway, follow to the roundabout with traffic lights (Countess Wear), continue straight ahead.

Go over the Countess Wear swing bridge, continue to the next roundabout, ignore Dawlish turning taking the 2nd exit. Proceed to the next roundabout, the Devon Hotel will be on your left. Take the 4th exit signposted Marsh Barton.

Continue to the next roundabout, bear left. Follow signs to the Livestock Centre.

Directions from Plymouth: Follow the A38 towards Exeter, take the A379 to Marsh Barton.

Follow the A379 to the roundabout, the Devon Hotel will be on your right, take the 2nd exit signposted Marsh Barton. Follow this road to the next roundabout and bear left. Follow signs to the Livestock Centre.

Dorset Horn and Poll Dorset Sheep Breeders’ Association Annual Show commencing with the Best pen of rams to be followed by Class 1 at 12.30 p.m.

Following the judging of the Championship and the Best Horn Ram Exhibit, all first prize winners will have their photographs taken and will be presented with their trophies at that time.

Champion and Reserve animals will be sold in catalogue order.

ACCESS TO THE MARKET Sheep will be allowed to enter the market premises from 8 a.m. on Tuesday, 7th May and will be received from 7 a.m. on Wednesday, 8th May. Vendors travelling long distances may be allowed, with special permission, to enter the market on the Monday night, but this will entirely depend on the cleaning of the market following the Monday sale. Any vendors wishing to do this MUST ring Russell Steer AFTER 6 P.M.on Monday 01392 251261 to ascertain exactly what time they may be allowed to gain entry, BUT THERE IS

ABSOLUTELY NO GUARANTEE THAT ACCESS WILL BE ALLOWED, AND IT IS ENTIRELY AT THE VENDORS OWN RISK. If you do wish to arrive on the Monday evening, you

MUST PARK UP IN THE MAIN CAR PARK ON THE RIGHT JUST BEFORE THE MAIN MARKET GATES AND YOU MUST NOT ENTER THROUGH THE MAIN MARKET GATES, UNTIL YOU HAVE BEEN GIVEN PERMISSION TO DO SO.

IMPORTANT NOTE For vendors with MV Accreditation The Scottish Agricultural College Sheep and Goat Health Scheme (S.E.H.S.) for Maedi Visna Accreditation is policed through Signet Farm Business Consultancy in England. Vendors are reminded that all accredited stock entering the May Fair must be accompanied by an SAC Valid Certificate of Status which must be signed and dated for the current event (show and sale).

These certificates will be collected at the gate of entry to the sale centre and sheep will not be allowed into the accredited section without a current certificate.

Any farm certificates of inspection for export to Northern Ireland and movement licenses will also be collected at this time.

In order to protect the accreditation of all vendors the Sheep Breeders’ Association has asked that all vendors of MVA sheep send or fax a photocopy of the S.E.H.S. form to the Auctioneers at least one week prior to the sale day. Please note that the original forms still need to accompany the sheep and be presented to the Auctioneers PRIOR TO UNLOADING. The old MAFF SH20 Certificate is not acceptable and has been obsolete since 31 March, 1997.

Scrapie Monitored Sheep A copy of the Certificate of Registration under the DEFRA Scrapie Monitoring Scheme must be lodged with the Auctioneers at least one week prior to the sale day.

Export Buyers wishing to export must make their own arrangements to satisfy the regulations of the country to which the sheep are being exported.

SPECIAL SALE CONDITIONS Important to Buyers and Vendors 1.

Note to Purchasers: The Auctioneers do all in their power to see that the Lots are properly described in the Catalogue from the information furnished by the Vendor(s) who supply such statement(s) and is (are) alone responsible for any error or misstatement there maybe. Any sheep in a Lot not answering the description will be subject to the following conditions but no complaint will be entertained by the Auctioneers after sheep have left the pens (unless subject to Condition 3 below) and in all cases of dispute the Purchaser will be required to keep all sheep in question subject to the allowances stated.

The bidding to be regulated by the Auctioneers. If any dispute arises the Lot in dispute may, at the discretion of the Auctioneers, be put up again and resold. No person shall retract his or her bidding. All Lots to be paid for at the close of the sale and to be at the risk and expense of the Purchaser from the moment they are sold. Immediately after the fall of the hammer the Purchaser shall give his name and address and shall remove the stock immediately after the sale with all the faults and errors of description, if any. The Auctioneers shall be under no liability either to the Vendor or the Purchaser in any way and, if any dispute arises between the Vendor and the Purchaser, which cannot be amicably settled, the remedy, if any, of the Vendor shall be against the Purchaser and vice versa.

If, under special circumstances (the decision as to whether the circumstances are special or not to be decided by the Auctioneers) a buyer is unable to examine his purchases on Sale Day, he should inform the Auctioneers before leaving. In which case the buyer must make any complaints as to description afterwards, in writing, to the Auctioneers together with a Veterinary Report, by the third day after the fair. The buyer to bear the cost of the veterinary fees. No complaint will be considered unless this condition is strictly observed. BUYERS are however expressly requested, wherever possible, to make their examinations and any claim arising ON THE DAY OF THE SALE.

RAMS: All Rams and Ram Lambs will be sold as warranted of getting stock. In the case of incapacity of any Ram or Ram Lamb, the Purchaser must notify the Auctioneers, in writing, within three months of the date of the sale, after which no complaint will be entertained. If it is established that any Ram or Ram Lamb is incapable of getting stock and such incapacity is not due to injury suffered or illness contracted since the date 128

of the sale, then the Purchaser may return it at his own expense to the Vendor and the Vendor shall refund the purchase price in full or make a replacement with a Ram or Ram Lamb acceptable to the Purchaser. In no case shall the Vendor be liable for a sum exceeding the amount which the Ram or Ram Lamb was sold (and any expenses awarded under the following paragraph).

In the case of any dispute between the Vendor and the Purchaser as regards the incapacity or otherwise of any Ram or Ram Lamb then the Vendor and Purchaser shall mutually agree upon a Veterinary Surgeon to examine the Ram or Ram Lamb to declare whether or not, in his opinion the Ram or Ram Lamb is capable of getting stock and, if found to be incapable, then he shall decide whether or not its incapacity is due to injury suffered or illness contracted since the date of the sale. The Veterinary Surgeon’s decision shall be accepted as final and binding on both parties and the party at fault shall pay the Veterinary Surgeon’s fees.

5.

EWES: An allowance of 30% of the selling price shall be made to the Purchaser by the Vendor for any Ewe which does not answer the age of the Lot (unless otherwise stated at the time of the sale ) BUT NO ALLOWANCE shall be made for any Ewe which may be found to be younger than the description given. Likewise, an allowance of 40% of the selling price shall be made to the Purchaser by the Vendor for any Ewe which is wrong in udder having been described as good on udder, subject to supporting Veterinary Certificate. All Ewes up to full mouth age are sold as good on teeth and under unless otherwise stated.

REGULAR DRAFT: Ewes must be of right age having lambed three times only and be good on tooth and udder.

DRAFT EWES: No warranty unless otherwise stated.

GOOD ON TOOTH AND UDDER: Ewes described thus should be correct in the mouth (i.e. Full mouth, no corner teeth missing) and not diseased or deformed in the udder.

FEMALE SHEEP NOT DESCRIBED AS IN LAMB: A female sheep, which is not described in the catalogue, or at the time of the sale, as in lamb, is warranted as not being in lamb. If within 14 weeks after the day of the sale a female sheep warranted as aforesaid proves to be in lamb, and within 14 weeks and 5 days after the day of sale, the purchaser gives to the Auctioneers written notice supported by a certificate signed by a slaughterhouse manager, a veterinary surgeon, or other competent person, that such female sheep has proved to be in lamb then, either the Purchaser may return the sheep and her lamb, if any, to the Vendor, or, at the sole 129

option of the Purchaser, the Vendor shall pay to the Purchaser as and for ascertained and agreed, liquidated damages, to cover all expenses, depreciation in value and other damages, whatsoever, a sum equal to 30% up to £100 and 40% thereafter of the purchase price of the sheep. Where a purchaser exercises his right, under the Conditions, to return an animal to the Vendor he shall be entitled to the return of the purchase money paid and to a refund of the reasonable costs and expenses incurred by him in obtaining any veterinary surgeon’s certificate or other person’s certificate or opinion which he is required to furnish under these Conditions in order to exercise his right.

7.

LAMBS: Unless otherwise stated at the time of the sale, a pen described as Ewe Lambs shall contain only Ewe Lambs, and a pen described as Wethers shall contain only Wethers – any other pen of Lambs shall contain Ewes or Wether or both (All male lambs must be Wethers). An allowance of 25% of the selling price shall be made to the Purchaser by the Vendor for any Wether lambs found to be in a pen described as Ewe Lambs and a further 10% shall be allowed by the Vendor for any Ewe Lamb sold in a pen found to contain a Ram Lamb or a Rig (Subject to supporting Veterinary Certificate). Likewise, an allowance of 25% of the selling price shall be made to the Purchaser by the Vendor for any Rig or Ram Lamb found to be in a pen of Lambs. These allowances shall include any expenses incurred by the Buyer for the castration of any Ram Lambs or Rigs or other charges.

8.

BUYERS: Must carefully check the number of sheep in each pen bought and notify the Auctioneers of any discrepancy before leaving the sale site.

Shortages cannot, in any circumstances, be considered once the sheep have left the pen which they were allotted by the Auctioneers.

9.

VENDORS: Are reminded that any sheep penned in the Fair, whether sold by auction, or privately, are subject to the commission charges and must, if sold privately, be booked through the Auctioneer’s Sale Office.

10.

All prize winning sheep must be bona fide sold by the Auctioneers, failing which, the prize money may be withheld.
