e patched his tattered corduroys with duct tape. The torn-open toes in his ten-year old sneakers he did not bother with though. In fact, Peter liked them that way. He told me the holes in shoes allowed the stream water to flow nicely BY JAMES EHLERS between his toes. It made no difference that he was not going to stand in the brook that day or not. He might. And he did not want the bother of having to change footwear should the urge move him should he find himself away from his home stream. He wore the vagabond shoes everywhere, perhaps even to church were he the type to be found in such a place. Odd to me and my perception of the world then. I admit to not understanding his economy. He was a man, however, who practiced conservation in his actions if not always in words. He liked to talk.

Often on summer days, he would stand in the brook just off my shoulder as I teased or annoyed brook trout with some offensive, but new, fly I had just invented. He did not fish, anymore. He just talked. I listened. Peter would talk about politics, engine design, classical music, nuclear engineering, gardening, shortwave radio, alcohol, women, firewood, maple syrup, and of course, fishing — sometimes hunting. Not necessarily in that order and perhaps not all on any particular day. Throughout his six decades he had formal and informal experience in those and many other subjects decidedly not suitable for retelling here. As I said, I listened—a lot. Ineffective flies made me a better listener than an angler, no doubt, but looking back I have no regrets choosing the wisdom over the worms. Shin deep in that murmuring brook years ago, I know I did not appreciate the white-haired man’s words at the time. I mostly liked the company of one who knew me better than I knew myself. It was comforting, indeed. Like the lessons that only fishing teaches, the most valuable gifts friends offer us often must ripen. A companion had, but lost to another life, is one such offering. I miss Peter. It would not surprise me had Peter fed the brook trout handfuls of his garden worms prior to me

With many miles separating my childhood fishing companions — my brothers — and me, and Peter and I separated for want of a heartbeat, I find myself standing in the brook forgetting the pole in my hand as the cool water flowing over my bare feet leads me back to friends and family. It does not bother me so much that trout want neither worm nor fly today. I am satisfied just being in the place where I know my friends and family would want to be if not for the circumstances we call life—and death. Fishing has taught me this much. I am certain, as well, it is why I find myself never throwing away tired pants: duct tape works just fine, resurrecting otherwise doomed trousers while eliminating the need for sewing. My flies are proof I have no knack for the economical use of thread. This, of course, leaves much more valuable time for the discussion of women, firewood, politics, hunting and other sundries out on the stream with my fishing companions, not to mention sharing stories about Peter. June 20, 2020 Any species of fish in the Winooski River Recreational Area is eligible as long as it’s legal and caught by a child 14 or under, accompanied by an adult. The child must play and land the fish; the adult may help bait hooks, cast and land the fish with a net. Each entry will be judged on weight and time of entry. Refreshments provided by Shaw’s Supermarkets.

Nick Mayer decided to pursue his dream of making art after one too many close calls. He works out of his home in Lincoln, Vt., where he is known for his scientifically accurate drawings of aquatic life. In his spare time he’s on the water casting for toothy-giants like this Northern Pike.

here’s something fishy about a scientist who’s also an artist, isn’t there? Especially when he’s a marine biologist. Well, that’s exactly what Nick Mayer is. He’s a bona fide science guy, with undergraduate and graduate degrees in biology from Brown University to prove it. And two Vermont studios, one in Bristol and the other in his Lincoln home, where he creates

his pencil and watercolor, lifelike illustrations of aquatic life. So which is he? Scientist or artist? The short answer is both. “I use my biology background to inform my artwork, for sure,” he said during a recent interview. “Ever since I was a kid growing up in Rhode Island, I’ve been interested in all things aquatic… I started off catching turtles — the kids would call me the ‘turtle man’

— then I got into fishing, then fly fishing, scuba diving and pretty much anything to do with the water.”

Choosing to study biology seemed natural to Mayer, who would rather wear hip boots than a suit any day. His biology track took him to a transfer program at Duke University that really sparked his interest in marine biology. And from there his career as a marine biologist took off. Mayer’s worked for the fish and game departments in Alaska

(doing research on how the Exxon Valdez oil spill affected the sockeye salmon on Kodiak Island) and Oregon (where he did radio tracking of steelhead to learn more about their habitat restoration.) He’s also worked for the Caribbean Conservation Corporation in Costa Rica, and did marine biology education in the Florida Keys. After his research concluded in Alaska, he got a job on a commercial fishing boat. Now, Mayer had worked on a couple commercial boats in Rhode Island

before, so he knew what kind of hardship he was signing up for… but this time was the closest to death he’d ever come.

“It’s all about that one rare fish of a lifetime that keeps us casting.” – Nick Mayer

“There was the captain, one guy on a tractor skiff, a native and me — that’s it… I jumped on this boat with a crew of four and spent a few months fishing,” Mayer remembered. “It’s a hard life, you fish for 21 hours and sleep for three… One day we blew a hydraulic hose and it sprayed the fluid all over the deck. We used this special soap to clean it up, which caused us to lose the whole catch. It was devastating. We ended up fishing for 48 straight hours to try and make up for it… At some point during that shift, I found myself sliding backwards across the whole 20 maybe 30 feet of the deck, and flipped backward into the water.” Man overboard. With no PFD, just a raincoat, and something like two minutes to survive in the frigid, rough Bering Sea. “I remember seeing bubbles from the prop and then I popped up and just saw the stern of our boat going away,” Mayer said. “I started freaking out a bit and then saw the bright line hanging off of the tractor skiff nearby. I swam over to Fred’s boat and had to pull myself in — there’s a thing out there, where you don’t help the man overboard in, otherwise you might end up with two drowned men.” Usually it only takes one of these close-call experiences to inspire us to pursue our dreams. For Mayer, it took two. The next came when he was out hunting caribou in northern

Labrador, Canada. “My wife and I had decided to move back East and I got a job as an environmental scientist in Burlington… that’s when I had my second close-call,” he said. “We went up into northern Labrador to hunt for caribou in the fall of 2011.” Mayer had a successful trip: he got two big bulls. But on the return trip from their remote camp, the crew of seven’s 1950s floatplane encountered some fog. “The normal procedure is to land on a lake, since they are everywhere, and wait it out,”

Mayer said. “Our pilot kept skirting the perimeter of the fog to try and get around it and then he decided he would try and go through it to find the other side. There are no electronics on these planes — pilots just use their vision. We couldn’t see anything at all in front of us and we were all looking back and forth at each other discussing what was wrong when all of a sudden we see a rock face directly in front of us. The pilot turned the plane vertically and did a 90-degree turn, everything in the plane fell to one side, everyone was screaming. It was definitely an event that made me feel like I had to treat every day of life as a gift.” That was it. That was enough. “After that, I knew I had to give my dreams of being a full-time artist a try and see if I could make it work,” Mayer said. “Art was always a passion of mine, but it was something I did on the side. Science was how I made my money.”

Mayer ditched the lab coat (so to speak) in August 2012 and went

full time with his art. “I start with a pencil sketch, using a No. 2 pencil — just like you used in school… Every species of fish has a specific number of scales along the lateral line, this is key in identification. So I count those scales and pencil them in; that’s the most laborious process. That’s the more scientific, headscratching and measuring part of the process. Once the pencil sketch is all right, I start painting.” Mayer uses watercolors, which he taught himself through trial and error. “I feel like painting is the fun part, there’s a little more pressure because you can’t really afford to screw up with watercolors… I make these paintings look more realistic by using layer upon layer. I don’t paint the whole thing when it’s wet and loose. I do one layer at a time and build up the painting until it looks accurate.” Mayer’s art has been commissioned by Anglers Journal, American Angler, and Grays (See Artist, Page 17)

Sporting Journal, he’s also the author of three books: “Catalina Dive Buddies” published in 2013 by Silverfish Press, an adult coloring book called “Wild Oceans” published in 2016 for Fox Chapel Publishing, and in 2019 his latest title, “An Angler’s Journal” also published by Fox Chapel. Mayer was a finalist in the World Illustration Awards in Seoul, South Korea, in 2017, was awarded Artist of the Year by the Billfish Foundation in 2016 and was a Martha Stewart American Made Finalist in 2015. His work and licensed products can be seen in galleries and stores in over 30 countries around the globe. Accolades and praises follow Mayer’s work for it’s technical accuracy and authentic realism.

“Scientific illustration of fish is what I’m known for,” he said. “But there’s not a lot of opportunity for me to experiment in styles and get more expressive in that area.” To open a little more flexibility, Mayer started up a side company called Predator Fly Gear. It’s a gear shop that allows the artist to do more in line drawings and work with single colors. He puts these images on t-shirts, hoodies, stainless steel drink containers, hats, iPhone cases, neck gators… you name it. “The images are all inspired by warm-water, toothy fish,” said Mayer, who is — surprise, surprise — an avid angler. He mainly flyfishes for pike around here with big flies (that he ties). “These fish are the boss of the water. They’re not even afraid of the canoe. A lot

of the time we catch these pike and muskies, it’s a pretty visual experience: you see the fish, it opens its mouth and chomps… The initial take is so exciting — it’s so aggressive. The whole predator fly-fishing is a different game; it’s explosive.” Together, Mayer has made a sustainable life for himself with Predator Fly Gear and his fine art work. “This is year eight,” he said. “And I’ve been able to make it work… I view things more like a business owner; I make and sell my artwork and product with my art on it. I’m always trying to make it consistent and sustainable.” Mayer does this with the help of 24 sales reps nationwide who work for him on commission, as well as

“The sales reps pound the pavement with my wholesale catalogue,” he said. “They give me the orders and I give them commissions — it works.”

“There was this guy in Maine who commissioned me to do a lifesized portrait of a blue fin tuna he caught,” Mayer said. “The fish was 10 feet and the canvas was 10 feet. That took several months and was the best of both worlds, because I got paid good money and got to paint every day.”

Mayer stressed how important the business aspect is for him. “I’m a working-class artist,” said Mayer, a father who’s eldest son just started college. “I grind every day to try and make it all happen. For me, I don’t choose a whole lot of what to paint, it’s what someone is paying me to paint. I also spend a lot of time wearing all the different hats of an entrepreneur: I make my own catalogue, design ads, work in QuickBooks, etc.” But every once in a while, Mayer

In the end, Mayer’s not wearing a suit. He’s living his dream as a fishy, art-inspired scientist and casting new lines every day. ae Washburn has a favorite fishing story involving his friend Wayne Bailey. They were fishing on Lake Champlain and Bailey was helping Washburn land a lake trout. In a painful and awkward moment, the Moretown resident found himself pierced through his finger with the fishhook that was already protruding from the mouth of the wriggling trout in the net. 18 — A Publication of Vermont Sports

Wayne Bailey jumped in to help his friend. “He had a cast on his right hand, but Wayne was right handed. He was trying to help me out by hitting this fish with a pair of Vise-Grips, but he was doing it left handed,” Washburn said. As a solution, Wayne suggested they tape the fish to his chest and attempt to remove it on shore. Fortunately, they were able to dislodge the hook before any further action was needed.

For last year’s fishing season, after the death of his friend in a boating accident, Washburn said he used hardly a tank of gas in his boats. “The day that he died was the day fishing died,” he said. A familiar face will be missing from Lake Champlain this spring as well as from the Father’s Day Fishing Derby, hosted by Lake Champlain International. Wayne Bailey, age 63, of Berlin was a Vermonter and dedicated member of the Canadian Club, Masonic Temple, and the Central Vermont

Boating Club. While he was an avid outdoorsman and hunter, his true love was fishing. From trolling for lake trout in the summer to fishing for perch on the wintertime ice, friends and family described a man constantly in pursuit of the next big catch, guided by his motto, “They won’t start biting until we get there.” Wayne Bailey grew up in the Montpelier area fishing on rivers and ponds with his brothers and father. “We fished about everything that we could think of,” said his brother Eric Bailey, who lives in East Calais. “We started off walking the brooks, casting for brook trout and when we got older we fished a lot of the ponds in our area because Lake Champlain didn’t have very many fish in it at the time.” Lake Champlain became Wayne’s favorite place to cast a line. “He just loved to be on that lake,” his wife Lisa Bailey said. “That was just who Wayne was.” Boating deaths are rare in Vermont. Between 2013 and 2017, Vermont had the fewest boating deaths of any state in the nation, averaging 1.2 fatal accidents per year. The statistic is markedly lower when compared to Florida or California, which averaged more than 650 and 350 crashes per year during the five-year period, respectively. Vermont’s Fish and Wildlife Department requires that boat operators take a safety education course. The Department also publishes a handbook that outlines best practices. During fishing derbies, he often volunteered to take out the individuals who showed up without a team. “He could always talk someone into coming down, getting a ticket, and joining the fishing derby,” Lisa said. “Even if they didn’t have a team he would tell them to come on the boat.”

On the water, Wayne Bailey could be counted on for his knowledge of which knots and lures to deploy and under which conditions. In addition to making his own experimental lures and developing new tactics to get a bite, he developed new prototypes of his invention for managing downriggers used while trolling for fish. While working at Miles Supply in Barre, Wayne often took clients out onto Lake Champlain for their first experience fishing for lake trout. “They always came back with a smile,” said his brother Clay Bailey. “The knowledge he had was incredible,” said friend and coworker Dave Heath. “We lost one hell of a worker and one hell of a fisherman.” Eric Kemp of Middlesex said his friend introduced him to fishing on the lake. “When I first started I’d never fished on a lake in my life,” he said. “It was always river fishing and I’d never been out in the boat. got me so addicted to it I ended up getting my own boat.” Adam Martin of Barre described his friend and coworker as “the definition of a true sportsman.” “He was someone who loved everything about being outside and on the water. He was a real steward of the sport of fishing. He loved anything and everything about it and would help anyone to be successful at it,” he said. “He got real joy out of watching everyone else catch fish, especially kids,” Martin said.

Wayne also had a love of music and wrote and recorded what the band’s bassist Rae Washburn called “classic country.” His family played a recording of one of his songs titled “Where the sun meets the water” at his funeral. Following his death, the Bailey family requested memorial contributions be made to the Central Vermont Boating Club’s Little Anglers Fishing Derby, which saw about 40 local kids participate. “Wayne always said if you can get young people into fishing at a young age and keep them interested in it, the sport will go on and on forever,” said Lisa Bailey. “He was always trying to make sure that kids were always involved.” This June 20 through 22, Washburn will join the thousands of participants in the annual derby. “I think I’m ready to fish extra-hard in Wayne’s memory,” he said. 2020 LCI Fishing Derby — 19

INTEGRITY STATEMENT

1. Each LCI Father’s Day Fishing Derby presented by Yamaha participant and all registered affirming witnesses must submit to a polygraph (lie detector) examination upon request of Father’s Day Derby Officials, or he/she shall be disqualified. Based on the results of this examination, the Lake Champlain International, Inc. Board of Directors reserves the right to disqualify the contestant. In the event that LCI Father’s Day Fishing Derby presented by Yamaha Officials disqualify a contestant, any and all fish which were offered by that contestant during the LCI Father’s Day Fishing Derby presented by Yamaha shall also be disallowed. Furthermore, any contestant who has ever been disqualified by LCI Father’s Day Fishing Derby presented by Yamaha Officials shall be permanently barred from participation in any and all future fishing derbies promoted by Lake Champlain International, Inc. 2. The LCI Father’s Day Fishing Derby presented by Yamaha will hereafter be referred to as the “Father’s Day Derby.”

REGISTRATION

3. Prior to the Father’s Day Derby, each contestant must purchase a valid individual, junior or family registration, either directly from Lake Champlain International, Inc. or through one of the LCI Derby 2020 Official Retail Registration Outlets. 4. All participants must hold a valid fishing license for the waters they are fishing as required by state law. 5. All persons aboard the same vessel/boat must be registered in the Father’s Day Derby. No one is allowed to be on the boat if they are not registered, regardless whether or not they are fishing. 6. A family registration may be purchased for the Father’s Day Derby and includes the following: registrant, spouse and their legally dependent children seventeen (17) years of age or younger at opening of the Father’s Day Derby. Only one registration form will be issued per family which covers all family registrants. Each registered family member is eligible for Father’s Day Derby prizes; however, any random drawings to determine prize winners will be executed according to the rule of one chance per registration form, not per person registered (lottery prizes excluded). 7. Father’s Day Derby registrations must be purchased no later than 11:59 pm on Friday, June 19, 2020, at specified 2020 Official Retail Registration Outlets. VISA and MasterCard applications will be accepted by telephone, facsimile, or internet through May 31, 2020. 8. Father’s Day Derby registration forms are not transferable. They must be presented on each occasion a fish is offered, and they may not be honored or replaced if lost. This determination is

made at the sole discretion of Lake Champlain International, Inc. Any number of fish may be offered by each Father’s Day Derby contestant using the same registration form. 9. Requests for refunds due to accidental duplicate registration purchase will be considered only if made in writing and postmarked on or before June 19, 2020. 10. Requests for refunds for any other reason must be made in writing, submitted with the registration to be nullified, and must be postmarked on or before June 19, 2020.

WITNESSES

11. In order to affirm the integrity of the catch of each fish offered in the Father’s Day Derby, there MUST BE A REGISTERED AFFIRMING WITNESS TO EACH CATCH. 12. Shore and pier anglers MUST HAVE A REGISTERED AFFIRMING WITNESS TO EACH CATCH.

REGISTERING THE FISH

13. CONTESTANTS and AFFIRMING WITNESSES must complete a weigh-in form furnished by the Lake Champlain International, Inc. Board of Directors at the weigh station. Only official weigh-in forms transmitted to LCI Derby Headquarters at 531 Main Street, Colchester, VT 05446, from official 2020 Father’s Day Derby weigh stations will be accepted. 14. The contestant is responsible for the accuracy of the information about his or her entered fish as it is transcribed on the official weigh-in form. Once the contestant has affixed his or her signature to the weighin form, he or she relinquishes all rights to challenge the accuracy of the data. 15. Weigh-in data as transcribed, and signed to, on the official weigh-in form at the weigh station will not be considered final until all entered information has been transmitted to LCI Derby Headquarters at 531 Main Street, Colchester, VT 05446 and reviewed, subjected to biological feasibility scrutiny, and accepted by Father’s Day Derby Officials. The signature of a Father’s Day Derby weigh attendant on an official weigh-in form does not in and of itself constitute the final determination concerning any entry.

BOUNDARIES/HOURS

16. The boundaries of the Father’s Day Derby shall include: a. Lake Champlain Proper as defined in the New York Freshwater Fishing Official Regulations Guide and Vermont Hunting, Fishing and Trapping Laws and Guide. b. Southern Boundary: Lock Number 12 at Whitehall, NY c. Northern Boundary: Canadian border. 17. Any waters fished must have reasonable and convenient access by public right-of-way. Anglers may not fish in waters that are only accessible by private permission or limited right-of-way, or that cannot otherwise be reasonably accessed by all participants. 18. Father’s Day Derby hours: Opening: 12:01 a.m., Saturday, June 20, 2020 Closing: 4:00 p.m., Monday, June 22, 2020 19. Father’s Day Derby Weigh Station hours: Weigh station hours are 9:00 a.m. to 6:00 p.m. Saturday & Sunday, 9:00 a.m. to 4:00 p.m. on Monday, at any of the regular weigh stations (listed on locator map). Three weigh stations will operate with extended hours of 9 a.m. to 8 p.m. Saturday and 8 a.m. to 8 p.m. on Sunday and three weigh stations will operate

24-hours a day beginning at 9:00 a.m. Saturday June 20, 2020. All weigh stations close at 4 p.m. on Monday, June 22, 2020. 20. All fish entered in the Father’s Day Derby must be caught upon hook and line and retrieved by rod and reel within the boundaries of the Father’s Day Derby. 21. Fish must be caught between 12:01 a.m. Saturday, June 20, 2020 and prior to 4:00 p.m. Monday, June 22, 2020. All fish must be presented to a Father’s Day Derby weigh station no later than 4:00 p.m. Monday, June 22, 2020. 22. Any angler found importing fish from another body of water, misrepresenting a fish’s weight, attempting to alter a fish’s weight or manipulate the fish in any manner to achieve a change in weight will be subject to legal proceedings.

ANGLING REGULATION

23. Father’s Day Derby contestants shall only enter fish caught within the derby boundary and hours. 24. The same angler must cast and hook, or, in the case of a trolled release, fight, and bring the fish to net unaided by any other person. No other person may touch any part of the tackle during the playing of the fish, or give aid other than taking the leader for landing purposes. 25. Only two (2) lines are permitted per angler at any time during the derby. This applies for both the Vermont and New York side of the lake. This rule applies regardless of state regulation. 26. Father’s Day Derby contestants may enter one or more fish. 27. All contestants must follow local and federal angling laws.

CONDITION OF FISH

28. All fish must be whole, fresh and never been frozen. No gaffed, snagged or foul-hooked fish will be accepted for entry. All fish entered will be marked for identification purposes, and may at the sole discretion of the Father’s Day Derby Officials become the property of the Lake Champlain International, Inc. Board of Directors. Any angler found misrepresenting a fish’s weight or attempting to alter a fish’s weight will be subject to legal proceedings. 29. In the interest of conservation of fish species, anglers are encouraged to release all fish caught in the Father’s Day Derby. The intent is to release all fish entered alive, and anglers are encouraged to properly handle live fish. For the purposes of the Father’s Day Derby, a Father’s Day Derby-eligible fish shall be determined to be alive if it is the sole discretion and judgment of the Weigh Station Captain that the fish

shows any reasonable signs of life. Any entered fish which is considered to be alive under this criterion shall be validated for a 5% LCI Derby Prize Point bonus. The Weigh Station Captain’s determination shall be made at the time of weigh-in, and shall be considered final.

ELIGIBLE SPECIES & SIZES

30. The eight eligible species categories in the Father’s Day Derby are: a. Cold Water Division: Lake Trout Species Category Atlantic Salmon Species Category, to include: Landlocked Atlantic Salmon, Steelhead and Brown Trout b. Cool Water Division: Walleye Species Category Northern Pike Species Category Smallmouth Bass Species Category c. Warm Water Division: Largemouth Bass Species Category Bowfin Species Category Extraordinary Species Category, to include: Carp, Catfish and Sheepshead (Freshwater Drum) 31. All Fish and Wildlife laws of the applicable state, where fishing shall be followed during the Father’s Day Derby. Fish which do not conform to all Fish and Wildlife laws of the applicable state shall be disqualified. Due to concern for the conservation of all fish species, the following minimum lengths have been established: Atlantic Salmon/Steelhead 21” Brown Trout 19” Lake Trout 28” Smallmouth Bass 17” Largemouth Bass 16” Northern Pike 32” Walleye 25” Bowfin 23” Catfish 26” Carp 26” Sheepshead 22” Yellow Perch (Junior Anglers Only) 12” 32. No fish under the above-stated lengths will be accepted for entry in the Father’s Day Derby.

PRIZEWINNER DETERMINATION

33. It is the responsibility of the prize-winner to collect his/her prize(s). Prizes, or parts thereof, not claimed by July 15, 2020 will become the property of the Lake Champlain International, Inc. Board of Directors. 34. All tax liability is the burden of the recipient of the prize. Additionally, in accordance with state and federal authorities, Lake Champlain International, Inc. may be required to collect taxes before prizes can be

Thus, the entry earns the angler 440 + 22 = 462 LCI Derby Prize Points. 37. 1st Place Species Prizes shall be awarded, for each of the eight (8) eligible species categories (see Rule #30), to any Father’s Day Derby registrant who enters one fish from that category which amasses the highest number of LCI Derby Prize Points for a single fish. Subsequent Species Prize places shall be likewise determined, in order, according to total LCI Derby Prize Points. 38. The Junior Division Prizes shall be awarded to the Father’s Day Derby registrant who is fourteen (14) years of age or under on June 20, 2020 and who enters one fish from any of the eligible species in the Father’s Day Derby (see Rule #30), between the opening and closing hours of the Father’s Day Derby, that amasses the highest number of LCI Derby Prize Points. Subsequent Junior Grand Prize places shall be likewise determined, in order, according to total LCI Derby Prize Points. Only a junior angler’s highest scoring fish per Junior Division will be considered eligible for an award. Awards will be made for Cold, Cool and Warm Divisions. a. In addition to the eligible derby species, junior anglers may also enter yellow perch that are a minimum of 12 inches in length. There will be a special award category for junior yellow perch. 39. Early Bird Special. a. Anyone who registers for the Father’s Day Derby on or before March 31, 2020, will be entered to win a Smugglers Notch Resort vacation package valued at up to $1800 dollars. b. To qualify, anglers must submit a COMPLETE registration for the Father’s Day Derby either by phone or online. c. Winners will be drawn during the awards ceremony on Friday, June 26, 2020. Winner need

not be present to win. 40. Ladies of the Lake a. The female angler who is both registered in the Father’s Day Derby, and catches the fish that scores the most points in the Cold, Cool, or Warm Water Division, shall receive a prize package.

(b.iii.ii) All fish weighed in from anglers registered under a family registration, and that qualify for bonus points, will be attributed to the family registration number. Anglers must enter three fish – one fish each day of the derby – that amass the highest number of LCI Derby Prize Points in either the Cold Water, Cool Water or the Warm Water Division (see rule #36 for more on point calculation). Only the angler’s single highest scoring fish per division per day for each of the three days of competition will be included in their final point total. d. Each fish entered MUST be weighed on the same day it was caught to qualify for Angler of the Year. For example, a fish caught at 11:45pm Saturday, but weighed in at 12:45am Sunday, will still count towards species and T.E.A.M. prizes, but not toward Angler of the Year. e. Throughout the Father’s Day Derby, our computerized results program will keep track of the single highest scoring fish per division per angler for each of the three days, automatically replacing lower-point fish when a higher-point fish is registered. Lower-point fish will still be considered for any other prize for which an angler is eligible. f. This is a non-exclusive prize, which means it can be won in addition to whatever other prize(s) the angler might also earn. g. Tiebreakers will be determined by the single highest-scoring fish entered. If still a tie, the prize shall be split. h. Failure by any claimant(s) to comply with the terms and conditions of the Father’s Day Derby Official Rules and Regulations will render the claim void and no prize will be paid. i. As a condition for claim consideration an investigation will be conducted if, in Lake Champlain International, Inc.’s sole opinion, such action is warranted. Such an investigation will include, but will not be limited to, requiring the winner and/ or witness to submit to and pass in a conclusive manner polygraph examinations.

Rules and Regulations (no electric reels are allowed) and all other rules contained herein. c. The angler must have purchased the 2020 Cash Extras option at time of registration. d. At the request of LCI Officials, any winner must submit to and pass, in a conclusive manner, a polygraph examination as a condition precedent to claim consideration. e. The polygraph examiner shall be chosen by

Lake Champlain International, Inc. The polygraph examiner shall make the final determination regarding passing or failing the examination. f. Fish must be caught by an official entrant in the Father’s Day Derby during official Father’s Day Derby hours. g. If there is a claim, any requisite paper work must be completed in its entirety and presented the same day as the catch to LCI Derby Headquarters located at 531 Main Street, Colchester, VT 05446. Lake Champlain International, Inc. will provide any requisite paperwork. h. Eligible contestants: Only those participants officially entered in the Father’s Day Derby who comply with any and all Father’s Day Derby rules and regulations shall be eligible to compete for a prize. i. Failure by any claimant(s) to comply with any and all Rules and Regulations of the Father’s Day will render the claim void and no prize will be paid. j. As a condition for claim consideration an investigation will be conducted if, in Lake Champlain International, Inc.’s sole opinion, such action is warranted. Such an investigation will include, but will not be limited to, requiring the winner and/ or witness to submit to and pass in a conclusive manner polygraph examinations. k. 49. The T.E.A.M. (Two Entries, Any Member) Prize shall be awarded to that Father’s Day Derby T.E.A.M. which (1) has purchased a T.E.A.M. registration in addition to Father’s Day Derby registrations for each of the individual members of the T.E.A.M., and (2) collectively enters two fish, both from within either the Cold Water Division, Cool Water Division or the Warm Water Division, that when added together amass the highest number of LCI Derby Prize Points. The two fish may be caught by a single member, or by different members of the T.E.A.M., but must each be caught according to the Angling Regulation (Rule #23). 50. All 2020 Father’s Day Derby T.E.A.M.s shall be governed by the following rules: a. The T.E.A.M. (Two Entries, Any Member) will be composed of at least one (1) and not more than four (4) members.

RULES & REGS (Continued from Page 37) b. Prior to the tournament, each T.E.A.M. member must also purchase a valid individual, junior or family registration. c. Each T.E.A.M. member must be listed on the T.E.A.M. registration form d. T.E.A.M. registrations must be purchased no later than 11:59pm on Friday, June 19, 2020, at specified retail outlets. Mailed T.E.A.M. applications must be postmarked no later than May 15, 2020. VISA and MasterCard T.E.A.M. applications will be accepted by telephone, facsimile and online through May 31, 2020. All T.E.A.M. members must be listed on the registration form at the time of purchase. e. A contestant may be a member of one and only one T.E.A.M. f. Each T.E.A.M. shall choose a Captain in whose name the T.E.A.M. will be registered. Also, if a T.E.A.M. name is not indicated, one may be assigned. g. T.E.A.M. members may divide themselves into not more than two (2) groups while fishing. This means a limit of 2 boats per T.E.A.M., or shore anglers fishing in no more than two groups. In all cases, the witness requirement continues to apply (see Rule # 13). h. LCI Derby Prize Point Determination Example for T.E.A.Ms: 7.0-pound Atlantic salmon (not alive): 7.0 x 63 = 441 LCI Derby Prize Points. 10.0-pound lake trout (alive): 10.0 x 35 = 350 LCI Derby Prize Points, plus 5% bonus for being alive gives a total of 367.50 LCI Derby Prize Points. Team Total for above example is 441 + 367.50 = 808.50 Father’s Day Derby Prize Points.

MISCELLANEOUS

51. Lake Champlain International, Inc. Board members and staff and their immediate families, sponsors, and officials and volunteers involved in the daily operation of the Father’s Day Derby, are not eligible to participate. 52. All contestants agree to give the Lake Champlain International, Inc. Board of Directors full rights for promotional or commercial purposes to any photograph of themselves taken by the Lake Champlain International, Inc. Board of Directors or its duly authorized agents. 53. Each contestant agrees to hold the Lake Champlain International, Inc. Board of Directors, Father’s Day Derby sponsors, their agents, employees and volunteers harmless from any liability of any nature for any injuries and/or damage suffered by the contestant in conjunction with the Father’s Day Derby. 54. All entries are subject to review by Father’s Day Derby Officials. Lake Champlain International, Inc. reserves the right to change any entry that it believes to be in error (see Rule #15). The decision of the Father’s Day Derby Officials is final. In the event of a tie, unless otherwise specified, the first fish weighed in will be declared the winner. All prize winners will be posted at LCI Derby Headquarters, 531 Main Street, Colchester, Vermont, at noon on Tuesday, June 23, 2020. Participants who wish to contest posted Father’s Day Derby standings must do so by presenting a valid weigh-in form and registration form to Father’s Day Derby Officials prior to 2:00 p.m., June 23, 2020. Prizes will be announced, and lower-tier prizes will be presented, at the LCI Awards Ceremony on June 26, 2020. Results will be considered final at 5 p.m. on June 25, 2020, and all remaining prizes will be awarded subsequent to that final determination. 55. Participants must present challenges to the final standings, in writing, between noon and 2:00 p.m. June 23, 2020. 56. Lake Champlain International, Inc. reserves the right to change these rules at any time without notice.

57. Dispute Resolution; Arbitration. In the event of any dispute between the parties with respect to any matter covered by these rules, the parties shall first use their best efforts to resolve such dispute among themselves. If the parties are unable to resolve the dispute within thirty (30) calendar days after the commencement of efforts to resolve the dispute, the dispute will be submitted to arbitration in accordance with the following provisions. The arbitrator in such arbitration may rule on any and all claims or controversies for which a federal or state court would be authorized to grant relief, whether or not arising out of, relating to, or associated with the activities of Lake Champlain International, Inc. All claims shall be determined under the law of the State of Vermont, without regard to conflict of law principles. 58. Either Lake Champlain International, Inc. or the Father’s Day Derby participant may submit any matter referred to above to arbitration by notifying the other party, in writing, of such dispute. Within ten (10) days after receipt of such notice, Lake Champlain International, Inc. and the Father’s Day Derby participant shall designate in writing one arbitrator to resolve the dispute; provided, however, that if such parties cannot agree on an arbitrator within such ten (10) day period, the American Arbitration Association shall select the arbitrator. The arbitrator so designated shall not be an employee, consultant, officer, director, or member of any party or an affiliate of or relation to any party.

59. Within fifteen (15) days after the designation of the arbitrator, the arbitrator, Lake Champlain International, Inc. and the Father’s Day Derby participant shall meet, at which time shall be required to set forth in writing all disputed issues and a proposed ruling on each such issue. 60. The arbitrator shall set a date for a hearing, which shall be no later than thirty (30) days after the submission of written proposals pursuant to subsection (b) immediately above, to discuss each of the issues identified by Lake Champlain International, Inc. and the Father’s Day Derby participant. Each such party shall have the right to be represented by counsel. The arbitration shall be governed by the rules of the American Arbitration Association; provided, however, that the arbitrator shall have sole discretion with regard to the admissibility of evidence. 61. The arbitrator shall use his or her best efforts to rule on each disputed issue within thirty (30) days after the completion of the hearings described in subsection (c) immediately above. Any ruling of the arbitrator shall be accompanied by a written opinion of the arbitrator detailing the arbitrator’s reasoning for such ruling. The determination of the arbitrator as to the resolution of any dispute shall be binding and conclusive upon all parties. All rulings of the arbitrator shall be in writing and shall be delivered to the parties. 62. The Arbitrator shall award costs and expenses, including but not limited to reasonable attorney’s fees and arbitration fees and costs. 63. Any arbitration pursuant to this section shall be conducted in Chittenden County, Vermont. Any arbitration award may be entered in and enforced by any court having jurisdiction thereover, and the parties hereby consent and commit themselves to the jurisdiction of the courts of the State of Vermont and any United States District Court in Vermont for purposes of the enforcement of any arbitration award.

ACKNOWLEDGMENT OF ARBITRATION

THESE RULES CONTAIN AN AGREEMENT TO ARBITRATE. THE PARTIES UNDERSTAND THAT NEITHER WILL BE ABLE TO BRING A LAWSUIT CONCERNING ANY DISPUTE THAT MAY ARISE WHICH IS COVERED BY THE ARBITRATION AGREEMENT, UNLESS IT INVOLVES A QUESTION OF CONSTITUTIONAL OR CIVIL RIGHTS. INSTEAD, WE AGREE TO SUBMIT ANY SUCH DISPUTE TO AN IMPARTIAL ARBITRATOR.
