I-Team: Daycare Inspection Violations Stack Up October 2008 through March 2011, only seven were routine. That means 11 were for “Re-inspection” after the daycare failed other inspections. The newer records show 22 violations or non-compliances. Eleven in safety categories DCF experts told I-Team Investigative Reporter Stephen Stock, the agency considers “serious”.

Of the 18 new inspection reports at Bright Stars Learning Academy on West Palm Drive in Florida City covering
Add that to past inspection records and Bright Stars had a total of 50 violations, 24 of them serious. Thirteen of them were for Class 2 issues, which is only a step away from Class 1 violations which often means the daycare should be shut down immediately. Another troubling trend, two were for “driver’s license violations”. In one case, the “facility’s driver did not have documentation of a valid Florida’s driver’s license.” Another was for not properly insuring
and inspecting the vehicle-the van. Another violation was for not properly maintaining the Transportation Log meaning workers hadn’t swept the van to make sure children weren’t left behind. When Jomiba opened in October, 2010, the same DCF inspector made note of that van sweep problem on its first inspection report. The inspection records indicate that the state of Florida was unaware that Bright Stars was closing. According to state records, five months after Jomiba opened two-and-a-half miles up the road in Homestead, a DCF inspector went to inspect Bright Stars in March of this year and found it abandoned. The report states that “the voice mailbox is full… the children transferred up the road to Jomiba.”

I-Team: New Questions For Lead Poisoning Tests “We need to be worried about how do I prevent any further damage not just cleaning up property. That’s been mismanaged,” implored Holmes as she and Chief Investigative Reporter Michele Gillen walked next to the Annie Coleman apartments. This morning, residents there awoke to bulldozers tearing up their front and back yards. The workers are replacing soil the county says is contaminated from fuel and diesel spills from parked cars. Reporting Michelle Gillen mgillen@cbs.com MIAMI (CBS4) -Residents in a Liberty City neighborhood plagued by toxic soil are demanding answers from city leaders about the state of their health. “What is it? What’s attacking my child? Or what I’ve been exposed to?” begged Renita Holmes, a long time resident and community advocate for the beleaguered Northwest Miami-Dade area.
Folks who live here just steps from the poisoned Olinda Park across the street are left wondering what the health effects of all this might be? “I am holding a picture of a kid who’s hair is falling out,” said Holmes. All this as the state is extending free lead poisoning testing next door. So far, the state says no children have turned up positive for lead poisoning.
But for weeks, the I-Team has been exposing the fact that the parents of the children being tested are not being asked if their children ever even visited the contaminated park. The I-Team raised the concern with United States Senator Bill Nelson who recently visited the lead testing site. The Senator was surprised. ”You don’t know who was or was not exposed,” Nelson asked officials. The senator urged a change. “It’s very easy to ask that question and important to find out,” he added. And late Monday, the Florida Health Department informed CBS4-NEWS that it would begin asking that key question. Also at issue… reaching out to the hundreds of thousands who played in the park who are grown or moved. “Many of these kids are 18 and 19 years old. Their brains may have been affected by lead and their ability to learn and progress in
school. They need to be reached out to,” said Environmental activist and lawyer Louise Caro. With urging on this matter from Senator Bill Nelson, the Florida Department of Health now says it will begin reaching out to their offices around the state and will attempt to do a larger outreach to those exposed to the soil of Olinda Park.

Cuban-Americans Concerned About Travel Restrictions Backers of the bill said people are abusing the system and are propping up a repressive regime. The measures highlight the split between those who fled the country decades ago and those who left more recently and maintain ties there.
MIAMI (CBS4) – A growing number of Cuban-Americans are concerned about two bills in Congress that would reinstate strict limits over their travel to Cuba, including how often they can visit and how much money they send family there. One of the bills would also limit new cultural and educational exchanges. Many South Floridians are worried Congress might succeed in bringing back the Bush-era of travel only once every three years and a $1,200 annual cap on annual remittances. Also under way is an effort to restore stricter limits on the kinds of educational and cultural exchanges now permitted with the authoritarian government of Raul and Fidel Castro. Sonia Rodriguez is among those who oppose the measures. She doesn’t want her money going to the Cuban government but fears without her help, her mother in Cuba will go hungry.
Soon after taking office, President Barack Obama eased the family travel restrictions to pre-Bush administration levels. He has also issued regulations encouraging travel opportunities for religious, cultural and educational groups. Pure tourist travel is still prohibited under the U.S. trade embargo imposed on Cuba decades ago. But two Republican Cuban-American congressmen from Miami-area districts are sponsoring measures to roll back the Obama changes, highlighting the division between those who left Cuba long ago and those who arrived more recently and still have ties to the Caribbean nation. Last week, the Republican-led House Foreign Affairs Committee approved a sweeping bill targeting a Cuba travel and remittances. Republicans and Democrats on the panel backed the move pushed by Rep. David Rivera, R-Fla, according to CBS4 news partner The Miami Herald. Rivera said the Bush limits were enacted because of abuses to the system, and that a visit once every three years was a reasonable compromise. There is currently no limit on the number of trips Cuban-
Americans can make to visit family in Cuba. The bills are likely to pass the House but face opposition in the Senate and a presidential veto threat. Although the full House likely will approve the bill this fall, its prospects are bleak in the Democratic-controlled Senate. Rep. Mario Diaz-Balart has pushed for a narrower measure targeting only Cuban-Americans. His measure is part of a must-pass financial spending bill, although Senate Democrats could oppose the provision on Cuba. All but certain is opposition from the Obama administration. Diaz-Balart said too many people were taking advantage of eased travel to Cuba to act as merchandise couriers, propping up the island’s faltering economy, and in turn its government. Travel charters for the Cuban-American community also have gained under the Obama changes, the Herald reported. In the past, people were more likely to fly out of third countries. On Wednesday, the agency ABC Charters announced an agreement with Tampa International Airport to provide charter flights to the island for CubanAmericans. ABC owner Tessie Aral supports unfettered travel to Cuba. She acknowledged some fellow Cuban-Americans take advantage of the system but says they’re the minority.
She showed The Associated Press petitions signed by more than 1,500 individuals who identified themselves as Cuban-Americans living in Diaz-Balart’s district – all collected in the past week. They want the representative to drop his efforts and to meet with them. Diaz-Balart has refused to receive the petitions as his policy is not to meet with anyone who does business with “totalitarian regimes.” Agencies that charter planes to Cuba must pay a fee to Cuba’s national tourism agency. Miami-Dade Program Saves Residents Water & Money by adding zones and installing a timer with moisture sensors.
So how can you save money with these Smart Irrigation Rebates?
Now Robert has a lush lawn, a vegetable garden, and he takes great pride in his lawn’s practicality.
If you install rain sensors, you’ll get a $120 rebate, a sprinkler installation will land you $200, a moisture sensor will garner you $300 and a redesigned irrigation system will get you a $400 rebate.
“Everything that I have planted is native and Florida friendly,” explained Robert to CBS4’s Jorge Estevez, which means it all requires less water. However, the dry season presented a problem. Without the rain, the yard and lush landscaping would get a little brown. Research shows more water is used during the month of July than in any other month of the year and that could mean weigh heavily on your wallet. But there is a local program designed to save money now and in the future. The program is run by the Miami-Dade Water and Sewer Department which modified Robert Ruano’s sprinkler system
By modifying the sprinkler system, Robert saves money and targets the problem areas. “They saw where it was watering too much and too little and they helped me adjust it,” explained Robert. The adjustments literally pay off. “You would be amazed at how much water is used. More water is used in your lawn that any other part of your house,” said Jennifer Messemer of Miami-Dade Water and Sewer.
Another popular plan is removing unnecessary sprinkler heads for a $200 rebate.
The plan is simple, wasting water wastes money. Robert received $400 back on the work he did with his lawn. “I am very happy with the system. I am very happy with the program,” said Robert. The average savings can vary but the department estimates people who apply some of the water saving tactics will use about a third less water on their lawns.

Unemployment Claims Go Digital skills review over the Internet to qualify for benefits. Also, if claimants’ severance pay for a week equals or exceeds their benefits for that week they will not get the compensation. Severance pay, though, will not affect their total benefits. Those receiving benefits will be required to contact at least five potential employers or else meet with a state reemployment services representative each week. TALLAHASSEE (CBS4) – Florida’s jobless are going to have to jump through a few new hoops if they’re planning on applying for unemployment benefits. Several new requirements go into effect Monday under a law passed this year to help reduce unemployment taxes paid by businesses. First off unemployed workers will have to use the Internet to file initial and continued claims. That change alone is expected to save the state $4.7 million annually. They’ll also have to complete a

Rick Scott signed a bill into law which scaled back the number of weeks for state unemployment benefits from 26 weeks to 23 weeks, causing emergency federal benefits to kick in more quickly and essentially shaving three weeks off the total run of benefits. Under the measure, the number of weeks of unemployment insurance available would gradually decline further once the unemployment rate dips below 10.5 percent, bottoming out at 12 weeks if the unemployment rate hits 5 percent.
The current maximum unemployment benefit dollar amount is $275 a week, already near the bottom of states. Federal statistics show the state’s average weekly benefit is just over $230. Citizens Board OKs Sinkhole Rate Hikes percent in 2012. The proposed sinkhole rates have come under fire on a number of fronts, including from Sen. Mike Fasano, R-New Port Richey, whose region will see some of the highest premium increases for sinkhole coverage. Fasano made numerous, unsuccessful attempts to amend the legislation to reduce the hit on policyholders in sinkhole prone regions of the state.
TALLAHASSEE (CBS4)- Calling the proposed rate increases painful but necessary, Citizens Property Insurance Corp.’s Board of Governors on Wednesday unanimously approved sinkhole premium increases for 2012 that will cause rates for coastal homeowners to skyrocket, some by thousands of dollars a year. Meeting via conference call to adjust the sinkhole rates, board members and Citizens’ staff said they are bound by the passage of a new state law (SB 408) to set rates for sinkholes that are actually sound. “We recognize that the need for sinkhole coverage is enormous,” said Citizens CFO Sharon Binnon. “This fact is not lost on us but this is about Citizens’ past experience…. These rates are the direct result in the explosion of claims.” Non-sinkhole related Citizens coverage, which is capped by law at 10 percent a year, will increase by a statewide average of 8.8
“There are people who live in sinkhole prone areas that could potentially be forced out of their homes due to these rate increases,” Fasano said in a statement prior to the vote. “Homeowners who have lenders that require sinkhole coverage will have to come up with huge amounts of money that will be hard to find, especially during these rough economic times.” Under the new law, Pasco County coastal residents, according to Citizens estimates, will see average sinkhole premiums jump from $441 to $4,017, an increase of 810 percent for the optional coverage required by some – thought not most – mortgage lenders. During the half-hour teleconference, Citizens staff said although many of the proposed premium increases indicate incredible percentage increases, the actual increased costs are far less dramatic. In Jackson County, Citizens rates for sinkhole coverage increased by 6,461 percent. The actual rate increases from 68 cents to $44 a year. Regardless, the rate hike drew harsh
criticism from former Florida Insurance Consumer Advocate Sean Shaw, who now works for a law firm that represents sinkhole claimants. “The Board of Governors vote today was unanimously brash, devastating, and irresponsible,” Shaw said following the vote. “The only thing standing in the way of the big bang of sinkhole costs is the Office of Insurance Regulation – they must protect consumers.” Despite facing no big hurricanes since 2005, the industry continues to lose money from covering people in Florida, with sinkhole claims a big part of that, insurers contend. In addition to having to pay old, re-opened hurricane claims, the companies have been hit hard with a huge spike in sinkhole claims in recent years, particularly in the area north of Tampa Bay. Last year, Citizens collected about $32 million in sinkhole premiums but paid out more than $245 million in claims, Binnon said, a trend that has also hit private property insurers who contend the spike can’t be related to a geological change, but is more likely due to savvy attorneys, public claims adjusters and inadequate protections in Florida law. The bill gave the industry ways to reduce payouts in sinkhole claims, including a twoyear limit on claims, more stringent definitions of what a sinkhole is, and more clout during the claims appeal process. For Citizens, which now handles 1.4 million
policies, most of which are in the most hurricane and sinkhole prone regions of the state, the law clearly stated that going forward, Citizens rates must mirror the sinkhole risk, which unlike hurricane coverage is not based on future probability but on solely on past experience, Binnon said. Board member Carlos LaCasa raised concerns over the inability of buyers to obtain mortgages without optional sinkhole coverage. Citizens staff said most lenders do not require it but the number of lenders who do is increasing. In addition, federally backed lender Freddie Mac requires the coverage, though Fannie Mae does not. New Pro Poker League Hits Jackpot With CBS
LAS VEGAS (CBS4) — A new poker league hoping to become the equivalent of professional tennis or golf to card sharks has a television deal with CBS, with seven hours of network programming planned for the league’s inaugural year. Epic Poker League officials tell The Associated Press that the deal will include 20 hours of programming from five poker tournaments, including a $1 million freeroll no-limit Texas Hold `em championship planned in February in Las Vegas. The shows will be hosted by sports announcer Pat O’Brien, a current Fox Sports Radio host and former Emmywinning CBS sports announcer who covered Olympics, Super Bowls and other sports and entertainment. Now touchups are easier than ever thanks to new technologies and there are a growing number of requests to work even more magic. Retouching photos is nothing new, but now it’s becoming more common for parents to make their children look picture perfect on print. Kara McGinnis is a professional child
“Certainly we’ve had all kinds of requests for re-touching,” explained McGinnis. “People might want to change their eye color or their hair color.” It’s not just for high school kids either. Lifetouch, the company Kara works for, recently started offering correction services all the way down to Kindergarten. Parents seem to have split opinions on the option. “I see nothing wrong with it,” said one parent.
“It helps their self esteem when they take a look at the pictures and they’re proud of it as well,” said another. Psychologist David Walsh said it’s not simple. “Think about the psychological impact of the child and saying, ‘oh sorry, you’re not good looking enough or handsome enough or beautiful enough to be in the photo as you are’,” explained Dr. Walsh. Lifetouch isn’t the only company offering touch-up services, so does Sears, Wal-Mart and other chain portrait studios. And for less than fifty dollars, anyone with a computer can buy software that transforms their pictures. “I think the inappropriate use is when we start to want to change how our kids really look,” said Dr. Walsh. He feels this practice deserves a close-up look from parents on why changes need to be made. “There’s a temptation to want to have our kids be our report cards and if our kids look like the glamour shot, if they look like the movie star somehow that makes us look better,” said Dr. Walsh.
Walsh points out little changes are one thing, but be careful. “The message that’s sending to kids is that you are not okay the way you are. We want to change you.” Lifetouch said there are limits to what the company will do. “We want to enhance the portrait itself yet not change the natural look of the child,” according to McGinnis. It’s a policy Dr. Walsh agrees with and applauds. “We need to strike that balance between using the technology in an appropriate way and misusing the technology for our own kind of, for our own purposes,” said Dr. Walsh. Most basic retouching packages cost between six and ten dollars for blemish removal only. Premium retouching to whiten teeth, fix a bad hair day or remove a scar can cost as much as twenty dollars or more.

Researchers Find Many Successful People Cry At Work
Reporting Lisa Petrillo lpetrillo@wfor.cbs.com MIAMI (CBS4) — There’s no crying at the office at least that’s what many people believe, but researchers are finding out that plenty of successful people break that rule which shows emotions and business can mix. You see it in the movies and sometimes you
see it on the campaign trail but nobody wants to do it.

“Emotions are something that you can’t control,” said one woman.
“I’m the supervisor, so I’m not allowed to cry at work,” said one man. “I cry at home.”
Showing emotions is something many people don’t want to do, especially at work.
One reason women cry more? Their tear ducts are larger and therefore, spill more than men.
“Many times,” said one woman. “I have three teenage boys, so yeah, especially when you get a call from the principal and stuff.”
“There’s not a person among us who wants to be in a meeting and burst into tears,” said author Anne Kreamer. She wrote It’s Always Personal, a book about emotion at work. Crying is not foreign to her. She remembers her boss, a CEO, calling to chew her out. “I obviously couldn’t get angry at this man, so I just sort of sat there and took it, and when he slammed the phone down ninety seconds later, I burst into tears,” Kreamer said. Kreamer’s research found 41-percent of

Professor Sigal Barsade researches how emotions affect organizations. “Very often people view emotions as, sort of, it’s noise. It gets in the way of rationality,” said Barsade. “But in fact, what we know from the science is that emotions and cognition are completely intertwined. You can’t have one without the other.”
Since many people believe crying in the office has the potential to hurt your career, what should you do if it happens to you? “You shouldn’t ignore the tears as if they didn’t happen, which is generally what people do. ‘I didn’t see it, you didn’t see it, we’re good!’” Barsade said. “But to say something like, you know, ‘I’m composed now. As you can see, this is something that I feel really strongly about.’” Both experts say good workplaces understand that their employees are wired for emotion and should give them an understanding ear.

The Center for Science in the Public Interest just released a list of the ‘biggest losers’— foods that are super sized in calories and fat. Or how about Cheesecake Factory’s Farmhouse Burger, a cheeseburger topped with pork belly, mayonnaise and fried egg? This little treasure contains 1,530 calories and would be equivalent to gobbling down four McDonald’s 1/4 Pounders with cheese. As if these hefty dishes weren’t already
enough, a study published on Tuesday in the Journal of the American Medical Association found that many fast-food and sit-down chains underestimate the caloric content of their foods. After looking at 42 popular American chains like Burger King, Olive Garden, Outback Steakhouse, and McDonald’s the team concluded that on average, fast-food restaurants underestimate their food items by 134 calories, while sit-down restaurants do so by about 225. With so many mouth-watering temptations and mis-marked menu items, it can be tough making healthy choices. While no studies have definitively proven that displaying calories affects decision making, health experts hope that this soon-to-be required information will lead to better choices.

“These medicines partially block the muscle from contracting, and since the muscles around the eye can’t contract, the fine lines and wrinkles can’t appear,” explained Dr. Grant. Dr. Grant said Retinols, both over the counter and prescription, can help reduce the fine lines and wrinkles. But in this case, he says prevention is the best medicine.
Doctors believe “Smartphone squint” can lead to eye strain and dry eyes, as well as those fine lines and wrinkles.
“There’s lot of things you can do to adjust the settings on your Blackberry to avoid having to squint. You can make the font size bigger; you can have the print appear larger on the screen,” he said.

Lose Weight With Facebook “Friends” Bradford lost 75 pounds in a year.

“Nobody could believe that I did it without diet pills or a special diet,” Bradford said.
While it’s not a specific diet plan, Bradford said her Facebook diet works by providing support, encouragement and the motivation dieters need to stick with their new routines. In looking at some of her posts, she’s written about organizing a neighborhood group walk and telling people to e-mail her for help and support in any way.
So how did she do it? She did it with a little help from her friends, all one 1,121of them, on Facebook.

“It’s everyday people, so you can relate to that,” Bradford said. They started out as strangers, but Bradford credits her new friendships on the popular social networking site with not only helping her lose weight, but keeping it off. She found the website so helpful she created her own weight-loss page, which now has more than 1,000 followers of the Facebook diet. “I wanted it to be where people can relate to everyday people and feel comfortable

She lost 80 pounds. “There’s everybody there to support you. I think Facebook is a great thing for a lot of people, especially if they don’t have the motivation, if they don’t have anybody to talk to,” Czerw said.
The 26-year-old said the Facebook diet provided her with the tips and tools she needed to help her lose all that weight. Now she’s using her success to help motivate others on Facebook, so they fit into their favorite skinny jeans, too. “I love wearing jeans, love it,” Czerw said. Diet experts said having a support system is a critical part of successful weight loss, and it’s especially good to have fellow dieters who know how difficult and frustrating the process can be.

Dolphins’ Brandon Marshall Drops Bombshell: I Have Borderline Personality Disorder an awareness of BPD and better treatment options.
MIAMI (CBS4) –After years of struggling with a personal problem, Miami Dolphins wide receiver Brandon Marshall has revealed that he has been diagnosed with borderline personality disorder. Sunday afternoon Marshall talked about it publically at the team’s training facility in Davie. He said he had informed the Dolphins’ organization and decided to ‘go public’ in hopes that it will created
“I can’t explain to you and paint a vivid enough picture where I’ve been in my life, probably since the end of my rookie year. My story has play out publically since I stepped foot on an NFL field. It was hard for me to understand how someone so blessed, since I was a little boy with dreams and goals that I have accomplished. It was hard for me to understand why I felt the way I felt inside,” said Marshall. “I want you guys to tell my story accurately, in a way that people who read it, who may suffer from what I have suffered from, can get the proper help and treatment.” Marshall opened his remarks by apologizing to his wife and thanking her for the way she handled the situation and the one in April where she was accused of stabbing him during an argument.
“I wouldn’t be a man if I didn’t stop the ‘villainization’ of my wife and to tell the truth. I want to thank her for how she handled not only this situation all summer, but the entirety of our relationship,” said Marshall, “She handled it with grace, dignity and honor.” After Marshall finished, Coach Tony Sparano said “My job as a coach is to give this young man support and that’s exactly what I’m going to do.” To learn how to control what he was feeling, Marshall reportedly underwent three months of treatment and exams at Boston’s McLean Hospital. People with BPD often have trouble with self-image, relationships and controlling their moods. On Friday, Marshall received some good news regarding his wife Michi’s legal problems.

The Broward State Attorney’s Office announced that it declined to file aggravated battery and violation of pretrial conditions charges against Michi Nogami-Marshall. The case surrounded a stabbing incident at Marshall’s home in April. Nogami-Marshall told police she acted in self-defense after a domestic situation ended up with Marshall getting stabbed in the abdomen. Marshall told prosecutors he slipped and fell onto broken glass from a vase. Police said there was no blood on the broken glass, or the area surrounding it and charged Michi Nogami-Marshall. The State Attorney’s Office said the state was unable to file charges due to the conflicting stories from police and from Brandon Marshall.
